학위논문(석사)--서울대학교 대학원 :사회과학대학 정치외교학부(외교학전공),2019. 8. 박성우. ; The study of Rousseau's international politics can largely be divided into two main branches: Realism with a pessimistic view towards peace in international politics and Cosmopolitanism via education as depicted in Emile. However, neither interpretation exhaustively covers Rousseau's international political thought. Accepting the framework that International Political Thought should coherently and consistently interpret the individual, national, and international levels of politics, this thesis embodies Stoicism's 'Theory of Oikeiosis' to assess Rousseau's international political thought, focusing on Emile. This study pays attention to Emile because the study of humans embodied in the work contains both a discussion of all three layers – the individual, national and the international - of Rousseau's international political thought, and enough materials to infer his 'Politics of Survival.' Previous studies of Emile has primarily been published by cosmopolitans to invoke idealistic ideas such as conscience, morality, and patriotism. If put under a more realist lens, however, the same ideas could be interpreted as a part of living his life for Emile, or the individual, under the goal of self-preservation. Early in his life, Emile grows up with only negative education as an isolated individual and learns how to live alone. Later, Emile gradually learns how to interact with the society, breaking from his isolated shell to live as a part of a community. In this process, Emile establishes a political society and utilizes concepts that he garnered while in it, such as morality and religion, according to his goal of self-preservation. Although Emile fulfills his duties as a citizen of a Republic, ideas such as civic virtue and patriotism that were created within the country do not initially extend to the outside world. With time, however, Emile's world view expands to encompass the entire human population, and Emile comes to care for even communities outside of his direct community. When the idea of a confederation of countries to resolve the state of war outside of the community turns out to be unfeasible, Rousseau adopts a new solution for the international political situation which is for each individual to strive to do their best in the given situation such as by finding a safe place for his or her freedom of survival. This thesis scrutinizes Emile to depict this process, of the individual striving for survival beyond the community and extending to the nation, international politics, and the entire universe. This research interprets Rousseau's international political thought as 'International Political Thought of Survival' by repurposing cosmopolitan internal mechanisms as tools for survival, while also distinguishing itself from realism by underlining Rousseau's negative pacifism. As such, this thesis provides a balance between the cosmopolitan and realist interpretations of Rousseau's international politics and also attempts to bridge the rift between his national and international political thought by extracting 'survival' as a consistent idea embedded throughout the levels. Purpose: The purpose of this study was to define and clarify the concept of political competence for nurses. Methods: A hybrid model method was used to investigate the dimensions, attributes, and definitions of the concept. In the theoretical stage of the study, literature on nursing, politics, and other discipline were reviewed. In the fieldwork stage, individual in-depth interviews and focus groups interviews were conducted with politically seasoned experts or activists who had an understanding of the concept of political competence for extensive descriptions in nursing and field of health care. Results: The concept of political competence was represented in four dimensions as political knowledge, political efficacy, political interaction, and political activity. In the political knowledge dimension, there were three attributes, namely, political knowledge, political information and systematic analysis ability. The political efficacy dimension had three attributes of internal political efficacy, external political efficacy, and self-pride of nursing profession. The political interaction dimension had three attributes of organizations and community service, networking, and persuasive power. The political activity dimension had six attributes of political leadership, political expression, assertive behavior, political advocacy, political participation, and policy intervention. Conclusion: This concept development might provide a basic understanding of developing a measurement tool and for constructing a theory promoting nurses�� political competence. ; open

학위논문 (석사) -- 서울대학교 대학원 : 사범대학 사회교육과(일반사회전공), 2020. 8. 이미나. ; 본 연구는 청소년의 정치효능감과 디지털 리터러시 수준이 정치 참여에 미치는 영향을 알아보고, 디지털 리터러시 수준이 정치효능감과 정치 참여 활동 사이의 관계에 조절변인으로 작용하는지를 살펴보고자 한다. 궁극적으로 디지털 미디어의 활용에 적극적인 청소년의 정치 참여 방안을 찾는데 기여하는 것을 목적으로 한다. 위와 같은 문제인식을 바탕으로 본 연구는 다음과 같은 연구 문제를 제기하였다. 1. 정치효능감이 높은 청소년일수록 정치 참여에 적극적인가? 1) 내적 정치효능감이 높은 청소년일수록 정치 참여 행위에 적극적인가? 2) 외적 정치효능감이 높은 청소년일수록 정치 참여 행위에 적극적인가? 3) 내적 정치효능감이 높은 청소년일수록 정치 참여 의지가 클 것인가? 4) 외적 정치효능감이 높은 청소년일수록 정치 참여 의지가 클 것인가? 2. 디지털 리터러시 수준이 높을수록 정치 참여에 적극적인가? 1) 디지털 리터러시 수준이 높은 청소년일수록 정치 참여 행위에 적극 적인가? 2) 디지털 리터러시 수준이 높은 청소년일수록 정치 참여 의지가 클 것인가? 3. 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정치 참 여에 미치는 영향이 클 것인가? 1) 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정 치 참여 행위에 미치는 영향이 클 것인가? 2) 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정 치 참여 의지에 미치는 영향이 클 것인가? 첫 번째 질문은 정치효능감이 청소년의 정치 참여에 미치는 영향을 측정하기 위해 설정하였다. 두 번째 질문은 디지털 리터러시 수준이 정치 참여에 미치는 효과를 측정하기 위해 설정하였다. 마지막 세 번째 질문은 디지털 리터러시 수준과 정치효능감이 청소년의 정치 참여에 미치는 상호작용 효과를 측정하기 위해 설정하였다. 본 연구를 통해 다음과 같은 결과를 알 수 있었다. 첫째, 정치효능감이 청소년의 정치참여에 미치는 영향을 검증한 결과, 내적 정치효능감이 청소년의 정치참여에 유의미한 영향을 미치고 있었다. 상세하게 살펴보면, 내적 정치효능감이 정치 참여 행위와 정치 참여 의지에 유의미한 영향을 미치는 것으로 나타났다. 반면에 외적 정치효능감은 정치 참여 행위와 정적인 영향 관계를 보이지만, 그 값이 유의미 하지는 않았다. 외적 정치 효능감은 청소년의 정치 참여 의지에는 유의미한 영향을 주는 것으로 나타났다. 정치효능감과 정치 참여 전체를 대상으로 한 회귀 분석에서는 정치 효능감이 정치 참여에 유의한 것으로 나타났다. 둘째, 디지털 리터러시는 정치 참여 행위와 정치 참여 의지에 유의미한 영향을 끼치는 것으로 나타났다. 디지털 리터러시가 정치 참여에 유의한 영향을 끼친다는 결론은 디지털 세대인 청소년들에게 커다란 의미를 가진다. 청소년들은 디지털 미디어를 통해서 정치에 관한 정보를 접하고, 정치에 참여한다. 따라서 디지털 리터러시 함양을 위한 정치 교육 자료를 개발하고 활용할 필요성을 말해 준다고 볼 수 있다. 특히 연구대상이 된 청소년들에게 디지털 리터러시를 정보 활용 능력, 비판적 사고 능력, 의사 소통 능력, 규범 준수 능력의 하위 요인으로 구분하여 질문하였기에 이와 같은 하위 요인에 포함된 리터러시 능력을 키워주는 일이 중요하다고 하겠다. . 셋째, 정치효능감과 디지털 리터러시 수준의 상호작용 효과를 살펴본 결과, 그 영향력이 크지 않아 모든 가설이 기각되어 정치 효능감과 디지털 리터러시가 정치 참여에 유의미한 상호 작용 효과를 가지지는 않는 것으로 나타났다. 이러한 연구 결과를 바탕으로 청소년의 정치 참여 활성화를 위한 몇가지 교육적 제안을 하고자 한다. 첫째, 청소년들은 정부의 반응에 따라 정치 행위에 참여하기보다는 본인이 정치에 영향을 끼칠 수 있다는 믿음에 따라 정치 행위에 참여하는 것으로 보인다. 따라서 청소년의 내적 정치효능감을 키울 수 있는 정치 교육 자료를 계발할 필요성이 있다. 둘째, 본 연구에서는 디지털 리터러시 수준이 청소년의 정치 참여 행위와 정치 참여 의지에 모두 긍정적인 영향을 끼치는 것으로 나타났다. 이는 디지털 미디어를 적극 활용한 정치 교육에 대해서 많은 자료를 개발하고 활용할 필요성을 말해 준다고 볼 수 있다. 셋째, 청소년의 정치 참여를 위한 교육적 지원 방안 또한 필요하다. 청소년 중에서도 고등학생은 성인이 되기까지 1∼3년 남은 준 성인에 해당한다고 할 수 있다. 실제 만 18세 이상의 고등학생은 참정권까지 보장받았다. 그러나 청소년을 대상으로 하는 정치 교육은 학교 교육 외에는 선거연수원에서 실시하는 '민주주의 선거교실'이 유일하다. 그리고 고등학교 통합 사회에는 정치 참여와 관련한 단원이 없고, 정치와 법은 선택 과목으로 10% 미만의 학생만 수업을 듣는다. 따라서 고등학생들의 정치 참여를 위한 첫 번째 방안으로 고등학교 통합사회 안에 정치 참여와 관련한 단원을 포함시켜야 한다. 주요어 : 청소년, 정치효능감, 디지털리터러시, 정치참여 학 번 : 2017-29900 ; Abstract The Effect of Political Efficacy and Digital Literacy on Adolescents Political Participation Inhae, Song Department of Social Suties Education The Graduate School Seoul National University In the revised social studies curriculum of 2015, democratic citizens are those who develop democratic values based on knowledge and participate with a sense of responsibility. Therefore, it can be said that raising students who are actively participating is a core element of social studies. In recent years, in terms of the political climate of our society, adolescents who participated in the election of the National Assembly directly appeared after the election age was reduced to 18, and the number of adolescents participating in candlelight vigils and Internet petitions is increasing. According to previous studies, it can be seen that political efficacy is a major factor influencing adolescents's political participation. Political efficacy is a direct motivation for individuals to participate in politics. It is said that individuals with high political efficacy have a strong willingness to participate in politics and actively participate in political activities such as voting. Adolescents needs literacy to become a meaningful activity and exercise of rights. In particular, digital literacy is indispensable in times of increasing political participation through digital media such as these days. Digital literacy refers to the level of critical thinking required by all users to properly evaluate the value of information found on the Internet, and the ability to understand and use various types of information found from various sources and to newly combine it for their purposes ( Gilster, 1997). The purpose of this study is to examine the effect of adolescents' political efficacy and digital literacy level on political participation, and to examine whether digital literacy level acts as a moderating variable in the relationship between political efficacy and political participation. The purpose of this study is to contribute to finding ways to actively participate in politics of adolescents in the use of digital media. Based on the above problem recognition, this study raised the following research problems. 1. Are adolescentss with higher political efficacy active in political participation? 1) Are adolescentss with higher internal political efficacy active in political participation? 2) Are adolescentss with higher external political efficacy active in political participation? 3) Is the willingness to participate in politics greater as the adolescents with higher internal political efficacy? 4) Is the willingness to participate in politics greater for adolescents with higher external political efficacy? 2. The following results were found through this study. First, as a result of examining the effect of political efficacy on adolescents's political participation, it was found that internal political efficacy had a significant effect on political participation behavior and willingness to participate. On the other hand, it was found that external political efficacy had no significant effect on political participation, but only on the will of political participation. Political efficacy was found to be significant in political participation in the regression analysis of political efficacy and political participation. Second, digital literacy was found to have a significant effect on political participation and willingness to participate. 학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. Game-theoretic approach has been providing a powerful tool in qualitative understanding of macroscopic social phenomena in social sciences, e.g., in economics and political science. Recently, researchers in physics, especially in statistical physics, use these game-theoretic approaches but in more quantitative way and have been producing a variety of interesting results in the new research area called 'sociophysics' by studying human society as a complex system. This work introduces recent works that have tackled combinatorial complexities arising in game-theoretic studies with the aid of simplified assumptions and numerical computations. We first show how cooperation emerges in the prisoner's dilemma game when each player's memory capacity is enhanced and suggest that the intelligent tit-for-tat strategy plays a crucial role in the history of cooperation. And then it is numerically shown that there is a certain case of simultaneous coordination among many players where the system has a high risk of failure when everyone is willing to follow the coordination, which is actually higher than when some are not concerned about it. Lastly, we discuss mathematical treatment of an equilibrium solution for a reverse auction game, which is a variant of the minority game, and its computational approach. ; Artikel på koreanska, abstract på engelska.

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김상헌. ; 중앙정부는 지방정부의 부족한 재원을 지방교부세, 국고보조금과 같은 지방재정조정제도를 통해 보전하고 있다. 우리나라의 경우 지방 재정조정제도의 하나인 지방교부세에 보통교부세와 특별교부세가 있 다. 특별교부세는 보통교부세의 경직적 산정에 따른 배분의 한계를 보완하여 각 지방재정력의 격차를 고려하여 보전한다는 방침으로 행 정안전부에서 운영하고 있다. 그러나 특별교부세는 배분의 기준과 결 정이 모호하고 불투명하여 그 결정이 정치적으로 이루어진다는 문제 점을 지적하는 연구가 있다. 선행연구로 이루어진 특별교부세 배분에 관한 실증분석에서는 배분의 결정에 영향을 미친다고 상정한 정치적 행위자를 국회 행정안전위원회 소속, 지역구 국회의원 수 등 의회의 영역으로만 한정하였다. 본 논문은 정치적 요인에 의회의 행위자뿐만 아니라 정부의 행위자 를 포함시켜 분석하였다. 본 논문은 전국 234개 시‧군‧구의 2003~2006년도 4개년도의 특별교부세 자료를 이용하여 특별교부세 배분의 결정에 영향을 미치는 요인들에 대해 정부 정무직 공직자를 포함하여 실증분석을 시도하였다. 그 결과 정부 정무직 공직자로 상 정한 변수가 배분의 결정에 영향을 미친다고 파악되었고, 정부 정무 직 공직자 중에서도 국무총리와 국무조정실‧차장이 다른 정무직 공직 자에 비해 더 큰 영향을 미친다고 파악되었다. 특별교부세 배분에 정무직 공직자가 자기 출생지에 더 많이 배분하 려 결정 과정에 영향을 미치는 것뿐만 아니라 정무직 공직자가 임기 후 선출직에 출마할 경우 특별교부세 배분의 결정에 더 큰 영향을 미 친다는 것을 보았다. 이로써 특별교부세 배분의 결정에 정부의 정무 직 공직자가 영향을 미친다는 것을 확인할 수 있었다. ; The national government makes up for any shortfall in finance of the local governments by the local finance coordination system, which includes local revenue sharings and national subsidies. The local revenue sharing, as a kind of the local finance coordination system, consists of an ordinary revenue sharing and a special revenue sharing. The latter is introduced to remedy the shortcomings of the former's allocation system caused by the rigidity of its calculation, and is currently operated by the Ministry of Public Administration and Security. There are some literature criticizing the problem that the SRS allocation is decided politically due to the fact that the principles for its allocation are equivocal and the decisions are arbitrary and not transparent. In previous studies analyzing the SRS allocation empirically, the scope of the political actors who are assumed to exert influences on the allocation decision is limited to the legislative area, such as the members of the National Assembly Public Administration and Security Committee and the number of lawmakers in each electoral district. This study presents a further analysis with a new political factor, the government actors, in addition to the existing legislative actors. Specifically, using the SRS data for the period of 2003 ~ 2006 for the entire 234 cities- counties-districts in the country, the present study attempts to analyze the factors, which affect SRS allocation decisions, including the new variable, the government's political masters. The results demonstrate that the new variable indeed affects the allocation decisions and that, among the political masters, prime ministers and directors generals and deputy directors in the Prime Ministers Office are shown to exert greater influences than others. Moreover, it is also shown that they exercise their power in the SRS allocation decision making process to provide more sharings to their places of birth, and in particular, their intervention is even greater when they decide to run for an elective office from their places of birth after the termination of their government offices. As such, this study verifies that the government's political masters exert influences on the SRS allocation decision. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 엄석진. ; 이 연구는 '입법에 의한 행정통제의 제도화' 과정을 입체적으로 살펴보기 위하여, 김영삼 정권 시기에 제정된 행정절차법과 정보공개법의 제정과정을 옹호연합모형(ACF)을 적용하여 비교 분석한 것이다. 이를 통하여 대통령과 행정부, 의회 등 입법과정의 주요 행위자에 초점을 두어 한국 행정절차법 제정과정을 연구한 Ginsburg(2001)의 고착 모형(Lock-in Model)과 Baum(2007)의 통제 모형(Rein-in Model)이 간과한 시민단체·학계·정당 등의 활동과 관료제의 반발 등 다양한 행위자 간의 상호작용을 규명하고자 하였다. 분석 결과, 첫째, 양 법률의 제정 과정에서 적극적 개혁연합과 보수적 개혁연합이 존재하였으며, 촉발기제 및 여론의 관심, 옹호연합의 대립과 입법 주도권 정도에 따라 입법의 지연과 법률 내용의 변화를 가져왔다. 특히 양 법률의 제정과정을 비교함으로써 이와 같은 상호작용의 특성이 입법의 지연과 법률 내용의 변화를 가져온 주요한 원인이었음을 새롭게 발견할 수 있었다. 둘째, 입법 과정에서 국회의 영향력은 미약하였으며, 대통령이 강한 리더십으로 입법을 추진하더라도 법률의 규율 대상인 관료제가 입법 과정에 참여함으로써 법률 내용에 한계가 나타났다. 이는 그동안 김영삼 정부 시기의 행정법제 개혁에 대한 상반된 평가, 즉 한편으로는 행정절차법과 정보공개법의 제정으로 법치주의를 향한 진전이 있었다고 평가되면서도, 그 내용적 측면에서는 소극적이고 수세적이며 지속적인 개선이 필요하다는 지적에 대해 제정과정 측면에서 해답을 제시하고 있다. 즉, 양 법률 공히 제정과정에서 국회가 주도적 역할을 하지 못한 가운데, 대통령의 리더십과 시민사회의 요구를 바탕으로 입법이 추진되었지만, 양 법률의 규율 대상인 관료제가 입법과정에 깊숙이 참여함으로써 내용적 측면에서 한계가 나타날 수밖에 없었음을 보여준다. 결과적으로 이 연구는 양 법률의 제정 과정을 비교함으로써 시민단체·학계 등의 활동과 관료제의 반발 등 다양한 행위자 간의 상호작용을 규명하고, 이와 같은 상호작용의 특성이 입법의 지연과 법률 내용의 변화를 가져온 주요한 원인이었음을 발견하였다. 향후 대통령과 관료제 간의 심층적인 상호작용 및 정책중개자의 실체와 역할 등을 밝히는 연구가 추가적으로 이루어진다면, 김영삼 정부 시기 행정법제 개혁의 성과와 한계를 체계적으로 밝히는데 기여할 수 있을 것이다. ; This study aims to do the comparative analysis of the enactment process of the Administrative Procedure Act(APA) and the Freedom of Information Act(FOIA) enacted in the Kim Young Sam regime by applying the Advocacy Coalition Framework(ACF) with a view to looking into the various aspects of the process of 'Institutionalization in control of administrative process by the legislative'. This study has the purpose of identifying the interactions of a large variety of agents such as civil organizations, academic profession, political parties and bureaucracy which was overlooked in the previous studies - Lock-in Model by Ginsburg(2001) and Rein-in Model by Baum(2007) - which analyzed the enactment process of Administrative Procedures Act in Korea, focusing on the official agents in the legislative process such as President, the executive branch, and Congress, etc. The results and the findings of this study can be summarized as follows. First, there were two major agents in the enactment process of the APA and FOIA, the active coalition and the conservative coalition, which resulted in the delay of the legislation and the modification of the laws depending on triggering mechanisms, the public's attention, legislative advocacy coalition, and the degree of the initiative. In particular, by comparing the enactment processes of both Acts, it was concluded that the characteristic of the interactions as above was the major cause that led to the delay of the legislation and the modification of the laws. Second, even after democratization in Korea, the influence of the National Assembly in the legislative process was weak. Even though presidential's legislative power was strong, limitations on the institutionalization of legal control has still remained because executive branch as target discipline has been involved in the legislative process. Thus, the findings of this study may partially provide answers to the question on differences between APA and FOIA legislation process. The dynamics of power was present between bureaucrats and civil organizations in the legislative process, and the contents of the bill and the time delay varied with the degree of a legislative initiative of officials who was the main opposition coalition in the enactment process. The further research in the future on in-depth interaction between the president and the bureaucracy, and on the role of the policy broker will be able to contribute to systematically elucidate in the achievements and limits of the reforms of administrative laws in the Kim Young Sam regime. ; Master

학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 지리학과, 2020. 8. 신혜란. ; 본 연구는 정책이동(policy mobility)의 관점에서 서울로 7017의 조성 과정을 분석하였다. 특히 본 연구는 정책이 이동하는 과정에 있어서 도시 정치가 어떠한 방식으로 개입하게 되는지를 집중적으로 살펴보았다. 정책이동은 도시 연구 분야에서 주요 연구 주제로 떠오르고 있다. 전 세계 도시 간 협력과 교류가 활발해짐에 따라 정책의 이동 - 선진 정책의 벤치마킹 및 수입과 모방, 정책 관련 국제 컨퍼런스 발표 및 수상 등 - 은 활발하게 진행되고 있고, 이러한 현상은 도시정책의 추진 및 의사결정에 있어서도 직접적인 영향을 미치고 있다. 한편 기존 정책이동 관련 연구들은 정책이 이동되는 과정자체에 초점을 맞추어 도시들 간의 지역적 맥락이나 정치구조의 차이가 정책의 적용과 변용 등에 어떠한 영향을 미치는지를 주로 살펴보았다. 이에 반해 정책 이동 현상이 넓은 범위의 도시정치와 거버넌스에 어떠한 영향을 미치는지를 활발하게 연구되지는 못하였다. 본 연구는 이러한 부분에 있어서 기여하고자 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹이나 정책 홍보 등의 정책이동 과정이 서울시 도시정책에 어떠한 영향을 미쳤는지를 분석하였다.연구의 결과는 다음과 같다. 첫째, 서울로 7017 조성과정에서 나타난 정책의 이동 – 뉴욕 하이라인의 벤치마킹 또한 서울로 7017 정책의 홍보와 선전 - 은 서울시가 도시정책을 정당화하는 주요한 방법으로서 활용되었다. 서울로 7017은 별다른 공론화 과정 없이 박원순 시장의 정치적 추진력을 통해 급하게 추진되었기 때문에 서울시는 사업에 대한 정당성을 보여주는 것이 필요했다. 이에 서울시는 이미 진행되었던 뉴욕 하이라인의 성공을 통해서 사업의 필요성과 당위성을 보여주었다. 또한 서울시는 사업의 가치와 성공을 국내와 해외로 홍보하는 과정을 통해서, 서울로 7017 대한 성공적인 이미지를 스스로 다듬어갔다. 이처럼 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹과 정책 홍보는 서울시가 도시 정책을 정당화하기 위한 목적에서 진행되었다. 둘째, 서울로 7017의 조성에 있어서 서울시는 하이라인을 벤치마킹 하였지만, 이는 서울시의 정책적 목표와 필요에 따라 선별적으로 이루어졌다. 또한 이처럼 정책적 필요에 맞추어 벤치마킹과 모방이 진행되는 과정에서, 처음 모방하고자 하였던 하이라인의 운영방식과 내용은 큰 폭으로 변용되었다. 일례로 하이라인의 디자인은 유사한 형태로 모방되었지만, 시민참여를 대표하였던 하이라인의 운영방식은 보수적인 서울시의 행정 구조에 맞추는 과정에서 큰 폭으로 변용되었다. 또한 이와 같은 모방과 변용의 과정에서 서울시의 정책, 행정구조, 공간은 빠르게 변화되었다. 본 연구는 전세계적으로 활발하게 진행되고 있는 정책이동 현상이 도시를 어떻게 변화시키고 있는지를 서울로 7017의 실증사레를 통해서 확인하였다. 한편 본 연구는 정책이동을 통해서 이루어지고 있는 다양한 변화들을, 다소 개괄적인 범위에서 살펴보았다는 점에서 한계를 갖기도 한다. 발전된 후속 연구를 통해서 정책이동이 도시의 변화에 갖는 의미를 더욱 면밀하게 검토하고 구체적인 정책적 시사점이 제시할 수 있기를 기대한다. ; This study analyzes the development process of Seoullo 7017 through the theoretical lens of policy mobility. In the past few decades, transfers, diffusion, and movement of urban policies across national borders have increased rapidly. Accordingly, researches on policy mobility have developed in the fields of geography and urban studies. These studies have critically investigated the processes of adaptation, assemblage, and mutation of a certain policy, but have little focused on how the ordinary urban policymaking and the urban area has changed in the process of policy movement. In this regard, this study explores how the mobilization of certain policy has changed and reconstructed the urban policy and planning system. Especially, this research has focused on the interaction of local decision-making and policy mutation processes. The results of the study are as follows. First, the mobilization of policy that appeared in Seoullo 7017 including benchmarking and policy promotion was strategically used by the Seoul city government. The main purpose of these mobilizations was to legitimize the city's urban policy. Seoullo 7017, which was a mayor's landmark project, has proceeded rapidly without the civic consensus process. In this regard, the New York High Line's success was used as a tool to represent the legitimacy of the Seoullo 7017 project. Also, the branding and promotion of Seoullo 7017, which received great attention from the city government, was used as a self-curation tool to make the success story of Seoul's urban policy. Second, the mobilization and adaptation of the High Line were proceeded selectively according to specific political goals of the Seoul city government. Seoullo 7017 benchmarked both the design and governance of the High Line. Lots of critics pointed out that the design should be differentiated, as the regional context of Seoul and New York was different, However, the design was similarly imitated into Seoullo 7017 because of the symbolic image of the High Line's design itself. Also, the management style which emphasized citizen participation and governance were also imitated, but it ends with instrumental form due to bureaucratic political structure. As such, adaptation, mobilization, and mutation has been carried out in accordance with the process of legitimizing local policy and political authority. The importance of this research is that it investigates the consequences and implications of mobile urban policies through an empirical case at various points. However, it also has its limitations as this study looks into various aspects of mobile policies on a superficial level. 학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 사회가 민주화되고 가치가 분화됨에 따라 각종 국책사업을 둘러싼 공공갈등이 심화되고 있다. 단순한 이익갈등뿐만 아니라 가치갈등 또는 복합갈등이 빈번하게 발생하고 있으며, 갈등범위도 전국적으로 확대되고 있다. 본 연구는 국책사업 중에서 '세종시 수정안'을 사례로 선정하여 정책결정 과정을 둘러싼 갈등에 대해 분석하고자 하였다. 특히 세종시 수정안 정책결정을 둘러싼 갈등의 배경과 성격은 무엇이고, 그 갈등을 관리 또는 해결하기 위해 정부에서 선택한 의사결정 방안이 적정하였는지 등을 참여적 의사결정 하의 갈등관리시스템의 틀로 분석하였다. 이를 통해 향후 세종시 수정안 추진과 유사한 대형국책사업 추진에 있어서의 성공적인 갈등관리를 위한 시사점을 도출할 수 있을 것으로 기대하였다. 제1장에서는 연구의 목적과 필요성, 연구의 대상과 범위에 대해서 설명하고 연구에서 사용한 사례연구방법과 자료수집방법에 대해 밝혔다. 제2장에서는 공공갈등의 개념과 유형 등 이론적 논의를 한 후, 참여적 의사결정이론을 소개하였다. 이러한 이론적 배경과 선행연구 등을 바탕으로 연구의 분석틀을 설정하였다. 제3장에서는 세종시 수정안 갈등의 발생배경과 갈등의 성격, 갈등의 쟁점과 이해관계자 분석, 갈등시기별 전개과정 등을 살펴보았다. 제4장에서는 연구의 분석틀에 따라 참여적 의사결정 요인과 정치 환경 요인에 따라 세종시 수정안 사례를 분석하였다. 주요 분석결과를 요약하면 다음과 같다. 우선 참여적 의사결정 요인에 따른 분석결과, 세종시 수정안 사례는 전반적으로 참여적 의사결정 방법에 의한 갈등관리가 미흡하였다고 평가할 수 있다. 첫째, '여론수렴 및 정보제공'이 미흡한 것으로 나타났다. 초기부터 여론수렴 및 정보제공 보다는 정부주도의 일방향적인 의사결정 추진 및 설득에 치중함으로써 갈등관리에 부정적인 영향을 미쳤다고 볼 수 있다. 둘째, '참여적 의사결정 활용' 측면 또한 미흡한 것으로 나타났다. 관련분야의 학식과 경험이 풍부한 전문가들을 민간위원으로 포함시켜 '세종시 민관합동위원회'를 구성ㆍ운영하였으나, 인적구성에서 찬성의견과 반대의견에 대한 균형을 이루지 못하여 활동결과에 대한 신뢰도를 저하시키는 원인이 되었다. 셋째, '협력규칙의 적용 여부'를 살펴보면, 우선 참여규칙, 분해규칙 적용 측면에서 미흡하였다. 그리고 자원확대규칙 측면에서는 원안보다 큰 경제적 보상이라는 인센티브를 제공하였으나, 이해관계자들에게 정치적 신뢰를 얻지 못함으로써 큰 효과를 발휘하지 못하였다. 마지막으로 '결과의 공개 및 정책에의 반영 여부' 측면에서 볼 때, '세종시 발전방안'을 언론 브리핑 형태로 발표함으로써 결정결과의 공개 자체는 투명하게 이루어졌다고 할 수 있으나, 수정안 마련 과정이나 발표 이후 국민의견수렴 절차를 거치는 과정은 미흡했다고 볼 수 있다. 정치환경 요인에 따른 분석결과는 다음과 같다. 우선, 여당내 대통령의 리더십이 수정안 찬성집단과 반대집단으로 분절된 결과, 정책의제 설정 및 정책결정과정의 추진력이 약화되었다. 둘째, 야당이 타협의 의사 없이 세종시 수정 추진에 무조건 반대하는 방식으로 진행되어 갈등이 증폭되었다. 셋째, 핵심 어젠다 제기의 정치적 타이밍과 관련, 5년 단임제의 특성을 고려할 때 집권 2년이 다 되어 갈 무렵 세종시 수정이라는 어젠다가 공식 제기됨으로써 유리한 타이밍을 놓쳤다고 볼 수 있다. 이와 같이 불리한 환경적 요인들은 참여적 의사결정에 의한 갈등관리에 부정적인 제약요인으로 작용하였다고 볼 수 있다. 제5장에서는 이와 같은 연구결과를 요약하고, 다음과 같은 시사점을 도출하였다. 첫째, 갈등과 갈등 당사자의 특성, 갈등이슈 유형 등에 따라서 갈등관리방식의 선택 또한 달라져야 한다는 것이다. 특히, 극단적인 대립과 갈등이 예상되고 그 파급효과가 매우 큰 세종시 수정안과 같은 사례일수록, 사전에 갈등영향분석 등을 통해 갈등의 요인을 사전예측ㆍ분석하여 관리대책을 마련하고, 정책의제설정 및 정책결정과정에서 참여적 의사결정 수단의 적극적인 활용이 필요하다고 볼 수 있다. 둘째, 정책대상집단과 이해관계자에 대한 사회적 인식(social construction of target populations)에 따라 갈등관리의 구체적인 수단 또한 달라져야 한다는 점을 알 수 있다. 따라서 향후 유사한 갈등사례에 있어서 정부의 갈등관리 전략 마련시 대상집단에 대한 사회적 인식에 대한 관심을 바탕으로 유ㆍ무형의 인센티브를 적절히 활용하는 것이 필요하다고 할 수 있다. 셋째, 참여적 의사결정기법 활용을 위한 구체적인 법적ㆍ제도적 장치 마련이다. 세종시 수정안 사례에서 전반적으로 참여적 의사결정방법의 구체적인 수단 활용이 미흡했던 것은 이러한 방안을 준비하고 실행할 수 있는 제도적 뒷받침이 부족했던 점에서도 그 원인을 찾을 수 있다. ; As society is democratized and the value is divided, public conflict surrounding the various national projects is growing. Value conflicts or compound conflicts, as well as simple interest conflicts occur frequently, and conflict is expanding nationwide scope. This study selected the case of amendment of Sejong city among various national projects as a case study, and tried to analyze conflict over the decision-making process of the case. Especially, this analyzed over the background and characteristic of conflict on the amendment of Sejong city, and appropriateness of the system of conflict management selected by the government in order to manage or solve the conflict through the frame of conflict management system under participative decision-making. This promotion is similar to the amendment during the next three kinds of large national projects in promoting the success of the implications for conflict management was expected to be drawn. Through this study, it is expected to reach to an implication for the successful conflict management on the similar case of the amendment of Sejong city. Chapter 1 explains the purpose, necessity, range and target of the research, and it defines a method of case study as well as the method of collecting data that are used for the case study. Chapter 2 explains the theory of participative decision making after introducing a theoretical review such as concept and kinds of public conflict, and establishes a framework of the study by referencing previous studies. Chapter 3 reviews the background and nature of conflict on the amendment of Sejong city, conflict issues and stakeholders, and development process of conflict. Chapter 4 analyzes the case by the factors of participative decision making and the political-environmental factors through the framework. The summary of main analysis is as follows: First of all, the case of amendment of Sejong city can be evaluated that the conflict management through participative decision making is insufficient, as a result of analysis by the factors of participative decision making. First, the 'collection of public opinion and provision of information' was insufficient. From the beginning, the government focused on a one-way decision-making and persuasion rather than collection of public opinion and provision of information, and it negatively influenced on conflict management. Second, the 'use of participative decision-making' was also insufficient. Even though various experts participated in the Sejong city committee, the composition was biased. Therefore it was one of the main cause of declining the reliability of the results. Third, 'participating rule' and 'factoring rule' were not sufficiently utilized. In terms of 'resource expanding rule', the government suggested more incentive of amendment plan than one of original plan, but it was not effective because of distrust of the government. Finally, in terms of announcement of the result and feedback of policy', amendment of Sejong city was openly publicized through giving a briefing. However the process of collecting extensive opinions was insufficient. The result of analysis by means of political-environment factor is as follows: First, the leadership of President was divided into supporting groups and opposition groups. Therefore the momentum of agenda-setting and policy-making was weakened. Second, the opposition party opposed to the amendment of Sejoing city without any condition. Third, the political timing of agenda-setting was not timely. The government missed the advantageous timing because the agenda was proposed during second year of a 5-year term of presidency. These adverse environmental factors negatively effected on conflict management of participative decision making. Chapter 5 summarizes the results of these studies, and the following implications were drawn. First, the method of conflict management should be selected according to the nature of conflict and the conflict parties, conflict type of issue. In particular, when the extreme conflict is anticipated and the result of the policy is wide, the government should pre-establish measures of conflict management through conflict effect analysis, and participative decision making should be actively utilized. Second, the specific means of conflict management should be selected by social construction of target populations. Third, the government should prepare the specific legal and institutional means for the use of participative decision making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 이승종. ; 민선 5기 지방선거 이후 우리나라 지방자치는 새로운 양상으로 진행되고 있다. 지방자치의 정치화, 지방정치의 중앙화가 가속화되었으며 특히 무상급식이라는 정책이슈가 지방자치의 주류 현안으로 등장하게 되었다. 이 논문은 무상급식 이슈가 대표적인 양대 지방자치단체인 서울시와 경기도에서, 유사한 정책 환경에도 불구하고 전혀 다른 정책결과를 낳은 점에 주목하였다. 이를 위해 서울시와 경기도의 무상급식과 관련된 정책 환경의 공통점과 차이점을 알아보고 어떤 요소에 의해 상이한 정책결과가 나타났는지를 분석하고자 하였다. 급식정책 실시 결과라는 종속변수에 영향을 주는 독립변수로는 지방선거 결과, 지방의회 특성, 자치단체 재정규모, 마지막으로 단체장의 특성을 설정하였다. 연구 결과 두 지방자치단체는, 단체장의 정당배경 및 무상급식에 대한 소신, 지방의회의 정당간 분점정도, 의회규모, 의원 보수, 자치단체 재정규모 면에서 극히 유사하였으나 단체장 특성 가운데 정당배경 및 성장배경 보다는 갈등해결 전략에서 차이가 있음을 알 수 있었다. 그 결과 경기도에서는 김문수 지사가 명분을 지키면서도, 의회와 타협하여 상생의 길을 모색하였고 서울시에서는 오세훈 시장과 의회가 강경대응으로 일관하여 시장 사퇴라는 나쁜 선례를 남기고 말았다. 또한 당초 설정된 '단체장의 특성에 따라 급식정책은 영향을 받을 것이다' 라는 가설이 확인되었다. 정책적 함의로 첫째는 '지방선거의 지방화'를 위해 정치권이 노력해야한다는 점을 들 수 있다. 6.2 지방선거에서는, 행정학자들이 우리나라 지방정치의 문제점으로 거론해 온 지방정치의 중앙화 현상이 더욱 극심해진 결과를 보여주었다. 중앙당은 지방선거를 중앙선거의 대리전 또는 전초전으로 간주하는 태도를 버려야 할 것이다. 둘째는 정당들이 더욱 정책개발에 노력할 필요가 있다는 것이다. 민선 5기 선거는 무상급식 이슈가 전국을 휩쓴 선거로서, 여야 정당들은 지방차원의 정책 개발보다는 선거이슈 선점에 따른 공세 및 방어에 급급한 모습을 보여 주었다. 교육정책에는 무상급식 외에 절실한 문제들이 많이 있음에도 불구하고 마치 과거 민주화항쟁 당시의 대통령 직선제 요구를 방불케 하는 양자택일 양상으로 진행되었다. 또한 근거 없이 무상급식 요구를 포퓰리즘으로 매도한다거나, 선별적 급식지원 정책이 아이들에게 눈칫밥을 먹이는 것이라고 선동하는 것은 지방선거에서 우선 승리하고 보자는 식의 후진성을 보여주는 사례라고 할 수 있다. 정치권이 더욱 성숙해질 필요가 있다. 셋째 복지정책은 개별 지방자치단체의 재정상황 여건에 따라 추진할 필요가 있다. 연구결과 복지 선진국들도 국가별, 지역별로 다양한 급식 정책을 실시하고 있음을 알 수 있었다. 또한 지방자치단체와 의회는 일방적인 '힘'의 논리만 앞세우지 말고 서로 화합하여 선진 지방자치 문화 정착에 기여하여야 할 것이다. ; After the 5th local election by popular vote, Korea's local autonomy is taking on a new aspect. Party politics and centralization of local politics are accelerating. Especially free meals policy has become the mainstream issue of local autonomy. This paper paid attention to the fact that free meals issue brought about different outcome in two big typical local governments such as Seoul city and Gyeonggi province. For this research, first I tried to discern similarities and differences related to free meals policy environment and to analyze what factors brought about different outcome. I set up the local election result, financial ability of local government, and characteristic of local government head as independent variables which have influence on school meals policy. This reserch finds out that there was significant difference in characteristic of local government head, particularly conflict solving strategy rather than political backgrounds although there were many similarities in their parties, belief on free meals policy, inter-party domination structure, size of assembly, annual salary, local finance of the two local governments. In Gyeonggi province, Governor Kim negotiated with local assembly for peaceful coexistence, in Seoul city Mayor Oh and city assembly called for tighter controls. Finally Mayor Oh resigned because of the low turnout in inhabitant's poll on free meals policy. This is a bad precedent in local autonomy history. Also the hypothesis that free meals policy will be influenced according to the characteristic of local government head was confirmed. This study implies, first, all politicians should make a greater effort for localization of local election. In the 5th local election by popular vote, centralization of local politics which many scholars have mentioned so far was intensified. Central parties have to come off regarding local elections as proxy war and skirmish of the central general election. Second, parties should develop policies. The 5th local election was only for free meals policy issue all over Korea. Most of parties manage to cope with electoral situation related to free meals issue rather than policy development of local level. Free meals policy was considered as the only matter like direct presidential election system issue in 1987 although there are other urgent matters except free meals policy in education policy field. Also the ruling party politicians denounced free meals policy as populism, otherwise the opposition party politicians condemn selective welfare policy for vulnerable groups as discrimination of the poor. These cases are backward behaviors which aim at short-term election victory. All politicians must be more mature. Third, welfare policy need to be carried out depending on each local government's financial conditions. As mentioned earlier, even advanced countries implement various school meals policy on a case by case basis. Also local governments and local assemblies should cooperate each other for establishing desirable local autonomy culture not depending on the unilateral power. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 외교학과, 2012. 2. 신범식. ; 본 논문의 핵심 질문은 색깔 혁명 발생으로 민주화에 성공한 그루지야와 우크라이나의 이후 민주주의 발전 양상은 왜 달랐는가이다. 색깔 혁명 이후, 우크라이나의 민주주의는 진전을 보였지만, 그루지야는 그렇지 못했다. 본 연구는 색깔혁명 이후 미국과 러시아의 갈등 구도와 양국의 대(對) 그루지야, 우크라이나 정책이 각국의 국내 엘리트-대중 관계에서 엘리트 자율성, 그리고 민주화에 미친 영향에 주목하였다. 9.11 테러 이후 미국과 러시아는 협력 체제에 있었지만, 색깔 혁명의 발생으로 인해 양국은 갈등 구도에 들어서게 된다. 그루지야와 우크라이나는 미․러 갈등 구도의 중심에 있었다. 활용가능성의 요인으로 인해, 그루지야는 우크라이나보다 전략적 가치가 더 큰 곳이었다. 미․러 갈등 구도 속에서 그루지야 집권 엘리트들은 높은 엘리트 자율성을 가질 수 있었다. 미국은 그루지야에게 큰 경제 원조, 정치적 지원을 하였다. 또한 그루지야-러시아 관계 악화와 2008년 전쟁 발발은 정권의 권위주의 정책을 정당화하고 국내를 결집시키는 기제로 작용하여 그루지야 집권 엘리트들이 높은 자율성을 갖게 해주었고, 이는 민주화 저해로 이어졌다. 우크라이나는 그루지야와 반대였다. 미․러 갈등 구도 속에서 우크라이나 엘리트들은 낮은 자율성을 가졌다. 우크라이나의 집권 엘리트들은 서방과 러시아 양측 모두로부터 확고한 정치적, 경제적 지원을 얻을 수 없었다. 오히려 러시아의 정책으로 인해 국내의 반 오렌지, 대항 엘리트가 공고해지면서, 집권 엘리트의 자율성은 낮아졌다. 엘리트들의 낮은 자율성과 대중에 대한 높은 의존성은 대중 영합주의 정책과 정국 불안의 결과를 낳았으나, 이는 오렌지 혁명 이후 우크라이나 민주주의의 발전을 제한적으로나마 가능하게 해주었다. 본 연구는 민주화 연구에서 그동안 비교적 주목을 덜 받아온 국제적 요인을 다루고, 외교 정책, 국내 엘리트-대중 관계, 민주화의 연계를 통합적으로 보여준다는 점에서 함의가 있다. 본고는 많은 기존 연구들이 상정해 온, 민주화에 대한 서구 민주화 증진 정책의 긍정적 영향과 권위주의 국가의 부정적 영향이라는 단순한 명제의 한계를 드러내주고 있다. 또한 민주주의 지원 정책에서 민주화 단계별로 정책을 달리할 필요성에 대해서 시사한다. ; What caused the difference in democratic trajectories between Georgia and Ukraine after the Color Revolutions? Since the occurrence of the Color Revolutions, Georgia's democracy has laid in tatters, whereas Ukraine has achieved a relatively successful democracy. Georgia and Ukraine share similar domestic determinants which have been discussed in previous democratization literature. This study, however, focuses on the international factor as an explanation for the different democratic fates of democracy between the two countries. Comparing both countries, this thesis uses a framework that integrates international factors, elite autonomy in domestic elite-mass relations, and democratization. The study argues that international factors, specifically the foreign policies of the US and Russia, provide an explanation for the difference in democratic outcomes for the two countries. Following the events of September 11, 2001, US-Russian relations improved. However, the occurrence of the Color Revolutions caused deterioration in the ties between the two countries, and both started to adopt different foreign policies towards the post-Soviet region. Caught in the middle of this conflict between the two great powers were Georgia and Ukraine. The unconditional US support for Georgia and Russia's assertive policy towards Georgia which culminated in the Russian-Georgian War in 2008 enabled the Georgian elites to attain high elite autonomy, thus resulting in democratic stagnation for Georgia. In contrast, Ukraine did not garner the support of either the US or Russia; rather, it was pressured by Russia. The anti-Orange elites in Ukraine were effectively supported by Russia, and, thus, were able to function as a forceful political opposition to the incumbent elites. Therefore, the Ukrainian elites only garnered low autonomy, which resulted in democratic progress in Ukraine despite domestic political chaos. This study contributes to further understanding of the impact of international factors upon democratization. In addition, this thesis creates implications for democracy promotion policy. The conclusion of the thesis challenges the predominant assumption that Western democracy promotion is conducive to actually democratization, and that authoritarian countries' authoritarian promotion policy is harmful to democratization. In the process of democracy promotion policy, policymakers and implementers need both careful monitoring of the process of democratic assistance and coordination with other countries. ; Master

학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 우지숙. ; 본 논문은 브라질의 인터넷권리보호법(Marco Civil da Internet)이 어떠한 전개과정을 거쳐서 지금에 이르게 되었는지 고찰한다. 각국이 인터넷의 자유와 규제의 딜레마 속에서 접점을 찾기 위해 노력하고 있는 가운데, 라틴아메리카의 브라질에서는 1990년대 이래 인터넷 규제에 관한 정책의제가 국가 내부에 존속하다가 오랜 논의 끝에 2014년 3월 25일 인터넷 이용자 표현의 자유, 개인정보보호, 망중립성(Net Neutrality) 보장 등을 골자로 하는 세계 최초의 인터넷 권리장전의 제정으로 이어진다. 연구는 '브라질의 Marco Civil은 어떠한 계기로 다른 정책들을 우선하여 정책결정자가 주목하는 주요 의제로 채택되어 제정으로 이어졌는가?'를 질문하고, 이러한 정책변동 사례를 Sabatier의 ACF 모형과 Kingdon의 MSF 모형의 결합모형에 적용하여 체계적으로 답을 모색하였다. 연구의 결과는 다음과 같다. 먼저, Marco Civil 정책은 각각 '평등주의'와 '시장주의'라는 상충하는 신념체계를 가진 찬반 옹호연합으로 분화되어 정책결정과정에서 첨예한 대립을 펼쳤으며, 정책학습의 기회에도 자신들의 신념체계를 견고화하였다. 둘째, 이들 옹호연합은 브라질 사회의 다양한 외적 변수에 직간접적인 영향을 받아 신념체계를 형성하였다. 셋째, Marco Civil은 수차례 입법 지연을 겪다가 Snowden 사건이라는 강력한 외부적 촉발기제에 의하여 정책의 창이 열리고 정책변동으로 이어질 수 있었다. 넷째, Marco Civil 정책결정과정에서 정책중개자와 정책선도자의 역할이 두드러진 것으로 나타났다. 특히 정책선도자인 Lula 대통령과 Dilma 대통령의 적극적인 역할은 Marco Civil 제정에 있어 결정적인 영향 요인이라고 판단할 수 있다. 연구의 함의는 다음과 같다. 먼저 이론적 함의로는 첫째, 연구는 ACF 모형과 MSF 모형의 적용 사례로서 비교적 새로운 분야인 인터넷 규제정책을 연구대상으로 삼았다. 인터넷 정책은 찬반 옹호연합의 첨예한 갈등이 나타나는 정책이라는 점에서 결합모형에 따른 설명력이 높게 나타났다. 둘째, 모형이 개발된 다원주의적인 서구사회가 아닌 권위주의와 엘리트주의가 뿌리 깊게 작용하고 있는 브라질의 사례를 분석함으로써 ACF 모형과 MSF 모형의 유용성을 입증하였다. 셋째, 일반적으로 대통령의 적극적 관심을 가질 경우 빠른 정책 대안의 마련으로 합리적인 대응 방안을 찾아낸다는 합리적 모형으로는 쉽게 설명되지 않는 사례로서, 룰라 대통령의 적극적인 지원에도 불구하고 임기 내 법안 제정에 실패한 원인을 추적할 수 있다. 넷째, 정책의 흐름이 열려 정책산출에 이르는 데 정치의 흐름은 정책의 창을 여는 데 결정적인 역할을 하지는 않았다. 호세프 정부 시기 정치의 흐름은 법안 제정에 부정적인 영향으로 작용하여 Marco Civil 폐지의 위기에까지 갔으나 외부적 초점사건에 의해 제정에 이르게 된다. 정책적 함의는, 먼저 정책선도자의 리더십과 정책 방향의 중요성을 함의한다. 국민의 인권 보장을 위한 룰라 대통령의 일관된 사회정책과 리더십은 우리나라에도 시사하는 바가 많다. 둘째, Marco Civil 법은 국가가 인터넷을 어느 범위까지, 어떠한 방식으로 규율해야 하는가와 관련된 가치충돌적이고 논쟁적인 쟁점을 되짚어보고 추후 유사한 인터넷 권리법 제정 논의에 적용할 수 있는 교훈적인 사례이다. 셋째, 본 정책은 참여민주주의를 실천한 사례로서 정부에 대한 국민적 신뢰를 반영한다. 마지막으로 한국과 브라질은 공통적으로 2006년도 인터넷상 사이버범죄 규제안을 제정하였으나, 한국의 경우 해당 법이 임기만료로 폐기된 이래 의미 있는 논의가 이루어지지는 않은 반면, 브라질은 사이버범죄법 발의라는 '초점사건'이 휘발되지 않고 정책선도자의 적극적인 의지 아래 인터넷권리법의 제정으로 이어진다. 브라질의 인터넷 정책결정과정에 대해 검토하고 구체적인 법안의 추진 동기, 과정, 정책의 결정요인 등을 모색함으로써 우리나라의 인터넷 규제정책이 어떠한 위치에 놓여 있는지 비교해볼 수 있을 것으로 생각한다. ; One of the most significant policy goals in the internet arena in the last decade has been striving to seek a reasonable balance between freedom and regulation of the Internet. Brazil, as Latin America's economic giant, has also spent a long time finding the balance point between creating economic profits and protecting human rights under the pressure of mediating the conflicting values of regulating and protecting users' behaviors from circumstances of the internet. And it is one of the key policy initiatives associated with this shift to pass the world's first Internet Bills of Right which is called Marco Civil da Internet on March 25, 2014 after years of discussion, which calls for freedom of expression for the Internet users, protection of personal information and guarantee of network neutrality. This case study explores the policymaking process of the Marco Civil da Internet in Brazil. It examines specifically how Brazilian internet policy came into being applying the combination frameworks of Sabatier's Advocacy Coalition Framework and Kingdon's Multiple Streams Framework, in order to learn more about the linkages between research and policy. The study began with a relatively simple question, 'On what occasion was Brazilian Marco Civil da Internet adopted as a major agenda for policymakers, prioritizing other public policies and being eventually enacted after long debate' and systemically sought an answer applying the example of this internet policy change through these policymaking process frameworks. The results of the study are as follows: First, the stakeholders in the policymaking of this legislation were divided into the a pro-MCI coalition and an anti-MCI coalition with a conflicting belief system between 'Equalityism' and 'Marketism' and strengthened their own belief system even in the opportunities of policy learning. Second, these advocacy coalitions formed these belief systems, directly or indirectly being influenced by various external variables in Brazilian society. The Snowden event in 2013 worked as a powerful external trigger mechanism of this policymaking process, as a strong variable that opened the window of policy and lead to policy changes after going through several legislative delays. Third, it was indicated that the role of a policy broker and a policy entrepreneur in MCI policymaking process was shown to be outstanding. In particular, the active role of policy entrepreneurs, the two Brazilian Presidents, Lula da Silva and Dilma Rousseff, could be judged as a decisive factor in enacting this legislation. Next, the implications of the study are twofolds. Firstly, the theoretical implications are as follows. First, the study targeted the Internet regulatory policy which is a relatively new field as an example of the application of the ACF and the MSF. The Internet policy might be highly adequate research topic, given that it is a policy that showed a strong conflict between a pro-MCI and an anti-MCI advocacy coalitions. Second, the study proved the usefulness of the ACF and the MSF by analyzing Brazilian case where authoritarianism and elitism have been deeply rooted rather than a pluralistic western society in which these theoretical frameworks were developed. Third, the study could track the causes for failure to enact this legislation within his term, despite President Lula's active support, which is not reasonably explained with a rational model supposing if the president has a active interest, he could find a reasonable and quick policy alternative. Fourth, Political Stream in this policymaking process did not play a crucial role in opening the window of policy. The political stream during the Rousseff administration had influenced a negative effect on enacting the legislation and reached the crisis of the abolition of the MCI, but an external focus event led it to be enacted in the conclusion. Political and practical implications are as follows: first of all, this study implies the importance of leadership and policy direction of policy entrepreneurs. President Lula's consistent social policy and leadership to ensure the human rights of Brazilian people provide a lot of implications for Korean administration. Second, the MCI is an instructive example that could be applied later in the discussion of enacting an Internet Bills of Right in other countries, which reflects on the value-conflicting and contentious issues concerning how the country should regulate the Internet. Third, as an example of practicing participatory democracy, the MCI policymaking process reflects public trust about the government. Finally, although each Korea and Brazil enacted regulations of cybercrime on the Internet in 2006, no meaningful discussion had been made in Korea since the law was scrapped at the end of its term, while Brazil's 'focus event' of trying to introduce the cybercrime law eventually led to the enactment of the Internet Bills of Right under the active will of policy entrepreneurs.
