围龙屋是客家人聚族而居的传统建筑,集中分布于广东东北部。它蕴含一套独特的空间构造和象征体系,体现了客家人的社会结构和性别观念。空间作为一项技术,在物质领域和精神领域上划分了两性的界限,并维护着性别关系结构。集体化时期国家对围龙屋进行了全面性改造,女性抓住机会获取村落公共空间的话语权,并在今天成为宗教活动的主导。改革开放之后,经济改革促使当地人搬出围龙屋住进新式楼房,家庭关系也随之改变。 ; 本文以梅州一座围龙屋为研究对象,以客家妇女的日常生活实践为核心主题,通过分析围龙屋聚落的历史脉络、空间构造及其社会意义的转变,探讨空间生产过程中女性个体、国家力量和传统文化观念之间的互动与角力,从而理解中国建国后的社会、政治、经济变迁。国家通过改造围龙屋来达成管制目的,客家女性在国家话语下发挥能动性获取更多的生存空间,同时也受到传统文化观念的约束。今天,国家力量借助市场经济以非正式的方式渗透农村,彻底改变了家庭权力结构,并使传统文化滋生出新的表现形式。 ; The weilong houses serve as the dwelling places for the Hakka people in Northeast Guangdong. Each weilong house contains elaborate spatial arrangements and a symbolic system that embodies the social order and gender relations of the Hakka. Space draws the boundaries between men and women in both the material and spiritual spheres, maintaining the gender structure of the Hakka society. During the collectivization period when the state reorganized the weilong house, women seized the opportunity to gain power for the control of village public space, and later they became religious leaders, even to the present. The economic reforms since 1978 have induced the villagers to leave the weilong house and move into new double-storey buildings, changing the family relations in the household. ; This research is a study of a weilong house in Meizhou, with focus on the daily practices of Hakka women. Taking into account of the history of the weilong house, its spatial structure and the changes in its social meanings, I seek to explore the production and reproduction of space in relation to women, tradition and the state, leading to a deeper understanding of the social-economic and political changes since 1949. 在过去十年间里,中国立法机关及政府机关已制定颁布了大量新的法律法规。这些法律从数量和质量上而言,和过去相比都有了很大飞跃,公司法和证券法领域尤为如此。 法律从业人员数量的增多满足了人们多元化的法律需求。财经媒体的迅速发展使得大众对商业和市场运行、以及相关法律法规产生了更加深刻的认识。 然而,这些方面的改善并不意味着中国上市公司小股东保护也得到了相应的加强。 ; 本文主要围绕以下三部分内容进行了探讨:1.中国现行法律下规制小股东保护的法律原则及规则;2.从政治环境的角度分析政治对部分规则形成的影响以及一些规则在实践中未能达到其立法旨意的原因;及3.小股东积极通过诉讼保护自身权利的现状及困境。作者评估了法律在小股东保护方面的实际效果,并分析中国的当代政治对法律达到其原本立法旨意的影响。虽然保护小股东及上市公司治理的法律框架已越来越全面,但实践中,小股东通过诉讼途径来有效实现自身权利却仍困境重重。本文认为,法院拒绝受理针对政治背景深厚的公司提起的诉讼、小股东面临的举证困难、法院收取的高额诉讼费用等因素都是小股东在实践中所要克服的障碍。 ; 本文认为,影响众多中国上市公司治理的最大问题以及小股东通过诉讼途径保护自身权益的最大障碍正是党国体制对经济活动的干预,尤其是对于部分上市公司和法律程序的干预。为论证该观点,文本首先分析了党国是如何参与并影响中国上市公司的治理。文章发现,党组织在那些由国家直接或间接控股的上市公司发挥了重要的决策及监督作用。此外,文章还分析了民营性质的上市公司是如何受到地方政府的干预。文章认为,针对上市公司的政治干预消弱了法律治理的作用,同时也损害了小股东的合法权益。为了实现对小股东的保护,法律不但要保护小股东不受私权的侵犯(比如私人或私人实体对小股东作出的欺诈或不当行为),更重要的是保护小股东权利不受到来自党国体制默许、支持、甚至实际参与的行为的侵犯。 ; In the past decade, China has experienced an exponential increase in the quantity and quality of new laws and regulations promulgated by the state and its agencies, especially in the area of company law and securities regulation. The legal profession grows and provides ever more diversified services to a public, whose awareness of business and market practices, as well as to some extent the legal rules and principles governing these, are being strengthened by the burgeoning financial media. Yet, these improvements do not necessarily translate into better protection for minority shareholders of Chinese listed companies. ; This thesis discusses the legal rules and principles governing minority shareholders' protection, the political realities that have shaped some of the rules and, as argued here, threaten to undermine some of the principles, and minority shareholders' activism to enforce their rights through litigation. 本文通过比较的视角来探索中共政权对中国天主教会包括官方与地下教会的特殊控制及其原因。自中共建国后,对比与其同宗同源,同为近代外来宗教的基督新教,中国天主教会长期以来受到中共严厉的控制。同时,近三十年来,基督新教在中国发展迅猛,成为当代中国发展最快的宗教,而在晚清和国民党政权下,基督新教在中国的发展一直远远落后于天主教。本文试图对这两个特殊现象进行研究。 ; 对于中共的严厉控制,学界的普遍观点是将其归结为天主教会强大的外国背景和与梵蒂冈的关系; 而近三十年来基督新教在华迅猛发展的原因被认为是它改良的教义和积极的传教模式。然而,基督新教同样具有强大的外国背景,它改良的教义和传教模式自晚清起在中国并没有本质改变,为何只在中共政权下得到迅速发展?本文试图通过对比天主教与基督新教在教义与组织结构、在华传播模式与发展速度、在华对政治的参与等方面的差异,以及天主教会在中国与中共政权在意识形态与组织结构上的异同,来探索中共对天主教会的特殊对待是否存在更深层次的原因,并探讨两者之间是否存在不可调和的矛盾。 ; 笔者认为,作为一个意识形态与组织高度合一的政权,中共害怕任何有严密统一全国性组织的宗教,不管它是否有外国背景。而作为有全国性统一严密组织的宗教组织,天主教会在中国之所以没有像"一贯道"和"法轮功"一样被中共消灭掉,是因为其与梵蒂冈的关系。作为"国际性合法宗教",天主教得以在中国生存。与基督新教相比,天主教会在中国,作为一种保守的,不倾向于革命或改良的宗教组织,在主观上从未试图挑战政权,但是其政教合一的严密组织以及建立在儒家伦理和宗族(家族)基础上的稳定的网络结构,在客观上构成对中共政权的有力竞争与潜在威胁,因此受到中共严密控制。中共利用"自选自圣"的策略,保持天主教会在中国的分裂, 从而达到"分而治之"的目的。同时,中共保持天主教地下教会在中国有限度的存在,以维持其对中国天主教会的有效控制。 ; My research focuses on church-state relations in contemporary China, to explore whether or not the Catholic Church in China constitutes a threat to the Chinese Communist Party (CCP) regime. I am undertaking a comparative study of the CCP's religious control over the Catholic and Protestant churches in mainland China through the approach of state-society relations, as well as a macroscopic view of political science with quantitative and qualitative analysis. ; As they are both foreign-originated parts of Christianity, the Catholic Church has been subjected to much stricter controls from the mainland CCP since 1949 than the Protestant Churches. Furthermore, the Protestant churches have been the fastest growing religion in China in past three decades, but it had once grown relatively very slowly under late Qing and the KMT regimes, compared with the Catholicism. 每個國家都有跨越時代廣為流傳的英雄傳說,思考這些歷史人物因何為人愛戴,他們的形象又是如何被塑造等問題無疑會幫助我們加強對這個國家的瞭解。在眾多日本英雄人物中,源義經(1159-1189)作為一個家喻戶曉的悲劇英雄不但一直受日本國民的懷念,而且給人們提供了無限的想像空間。從中世至現在,關於源義經的歷史記述及文藝作品多不勝數,從這些作品中我們可窺見其形象在不同時代的變遷。考察源義經形象的變遷,有助我們瞭解日本不同時代的思潮。本研究以德川時代源義經的人物歷史及文化想像為切入點,透過文獻及文藝作品看其形象如何被塑造及探討這種塑造背後的歷史意義。 ; 迄今為止,關於源義經的研究甚多,但這些研究多是針對源義經人物自身,集中在他的虛實以及人物傳說方面。本論文研究對象也是源義經,但考察的不僅是源義經這一獨立的人物形象,更想要通過源義經的人物形象變遷探究德川時代的政治思想及中日關係。透過對德川時期源義經形象的考察,筆者認為義經形象在德川時期的文學及文藝吸收許多中世時期的元素,同時有了更多元化的發展。而這時期義經形象在傳說中更是有了新的突破,從單純的民眾憐惜義經而產生的想像變相成為政治發聲的媒介。 ; 源義經形象在德川時期主要可分為三個方面:一是風流公子形象,二是智者仁君形象,三是征服外夷形象。而這三種形象背後的原因及歷史作用可分為四個方面:一是江戶時期町人文化及出版業的興盛,二是源義經形象中反映的日本對中國文化的吸收,三是幕府對外政策的催化作用,四是德川思潮與義經形象的緊密關聯。 ; Every nation enjoys widespread legends about heroes that have sustained through the history. To figure out how these heroes are created and how they won affections from general public would undoubtedly help us have a better understanding of a nation. ; As one of the well known heroes in Japan, Minamoto no Yoshitsune is one of the most missed ones and brings Japanese people endless reveries, which can be seen in lots of literary works and historic records. Minamoto no Yoshitsune's images have been changing during different periods. His pathetically tragic life and those imaginative legends about him both have attracted the scholarly attention in Japan and the beyond. However, his images during Tokugawa period have yet to be systematically explored and summarized. This paper aims at discussing the causes that create Minamoto no Yoshitsune 's image and probes into the social background and historical significance of the images by investigating the literatures and legends in Tokugawa period. ; Based on a great number of documents on Minamoto no Yoshitsune, researchers mostly concentrate further on the fiction and legend stories of this character. 自2003年始,反坝运动席卷中国,被誉为"第一次公众参与开始影响中国工程决策"。相关研究多将之归功于中国近年来迅猛发展的公民社会与NGO力量。但在金沙江边村落,却出乎意料地形成可持续的、无(正式)组织及去精英化、本土民众自主广泛参与的反坝集体行动,并成功令当地水坝建设中止至今。本个案的独特性,无法单独通过社会运动或底层抗争理论对中国集体抗争的分析,而得到解释。 ; 在中国特殊政治环境下,尤其在严重缺乏自组织空间的底层乡土社会,农民广泛参与的集体抗争如何得以成为可能?带着这一问题,本研究整合社会运动研究和底层抗争研究两种理论框架,以实践论引领下的拓展个案研究法为研究方法论,对金沙江-虎跳峡流域的反坝集体行动展开深入研究。 ; 论文首先还原当地反坝抗争的真实经历以及底层行动者的实践逻辑,并通过对抗争的政治机会空间拓展、组织动员、框架与意义建构等三个关键过程深入分析,探讨集体行动的内在特征及发生机制。 ; 本论文发现:在全国反坝热潮背后,金沙江边逐渐形成一类独特的、既由本土社区主导又与全国性的反坝社会运动接壤的、多元去中心化的新型底层抗争生成机制/模式。三种结构性生成力量在背后起到关键作用:一是本土性社会文化因素;二是介入本土社区并与之发生紧密互动的外界公民社会力量;三是国家力量(包括"抽象国家"与"具体国家")的影响及其与本土的互动。 ; 以上因素在型塑独特的本土集体抗争模式的同时,也在底层乡村社区催生一批本土中层集体行动者骨干,推动广泛、具有潜在秩序的草根民众的"公民性"参与,孕育出更富于弹性、更多元异质的社会力以及本土化的公民社会行动空间,由此产生的底层自下而上的变革动力,有可能超越此前公民社会组织主导的社会运动与封闭乡村社区内相对无组织无序的底层抗争的两分,为中国底层变迁乃至公民社会发展预示新的路向。 ; Recent anti-dam movements in quasi-authoritarian China have triggered unprecedented public debate. Most existing researches focus on professional NGOs, intellectuals, media and other high-profile civil society forces, and propose an exogenous elite-driven model for understanding the movement and ensued social changes. ; However, the Jinsha River anti-dam protest revealed a different picture: endogenously grown and widely participated activism is blooming in the local communities, in the absence of formal movement organizations and without the leadership of outside NGOs. It is such local activism, working together with civil society forces from outside, that successfully blocked the dam construction. ; How could such indigenous activism with broad participation emerge within the highly restricted political space of contemporary China? To answer this question, I propose an integrated approach combining the perspectives of the social movement literature and the resistance studies.
