From the publication of the French translation of a book by Peter Winch, the article reverted to the tendency of political science and, more broadly, of social sciences to adopt the naturalist view that the phenomena they deal with existed independently from the point of view of the members of society involved in their production. Classements des alternatives sociales et évaluation des politiques publiques Une nouvelle méthode d'évaluation des politiques publiques a été proposée récemment. Elle requiert que soient construits des ordres complets des allocations des ressources, basés sur des critères d'efficacité, de justice distributive et d'invariance par rapport à des modifications de variables irrelevantes. Ensuite, on déduit la politique publique appropriée en maximisant un tel classement sous les contraintes imposées par l'asymétrie d'information ou d'autres contraintes institutionnelles. The deep crisis of medical practices raises issues regarding the existing legal framework. The health costs are skyrocketing and the government are loosing grip to the social security system. The general practitioner ( GP) doctors are the first receivers of measurements which aim to control a social security system and the current legal framework means that GP's are be controlled by strict sanctions. The legal framework governing doctors has been designed to superwise them, however due to the enforced sanctions this leads to their repression. Addressing this challenge between the GP'S and the National Health System is essential for doctors and also other health professions. As doctors are tied and bound by this regulation contract they must also he protected by human rights when he is controlled. The law pursuits of doctors will be studied under the spectrum of growing influence of the European Human Right Court. ; Alors que la médecine libérale traverse une crise profonde, se pose la question du cadre juridique de l'exercice de l'activité des médecins libéraux. Dans un contexte d'explosion des dépenses de santé, les médecins libéraux apparaissent comme les premiers destinataires de mesures destinées à mieux contrôler un système de sécurité sociale qui échappe aux pouvoirs publics, au moins sur le plan économique en ce qui concerne les dépenses. La sanction devient dès lors le moyen d'action des instances chargées de contrôler les médecins libéraux. The "cults" were the subject of a strong media coverage following several tragedies that occurred abroad, then in France in 1995. Neither "sects" nor "cult", are defined in law, and those terms cover a concept which borders fluctuate according to the times and customs. Thus, the central question is that of the durability of a policy launched in response to a social and religious crisis. Can public policy to fight against sectarian excesses continue while its main object is unrecognizable? Does it undergo such transformations that, in the long run, it disappears to make room for new mechanisms more adapted to the evolutions of its initial objective?The theme is complex and fraught with conflicts, bringing into play the perception of the religious and the sacred, implying the conception of secularism specific to France. A first phase of problematization began in the 1970s, with the appearance in France of the Moon Church and associative mobilizations of parents of concerned followers. This setting on the agenda leads to the Vivien report in 1983, delivered to the Prime Minister, but does not lead to real action by the public authorities. The associative network, which is expanding rapidly, will become the spearhead of the struggle: both experts and actors in the field, "anti-cult", often committed activists, emotionally involved, are in a key position. In 1995, after the massacre of the Order of the Solar Temple in the Vercors, a real administrative apparatus is set in motion, attracting criticism from a part of the scientific community as well as from other nations, especially the United States, whose traditional conception of freedom of religion is bumped by this proactive policy.Subsequently, the policy knows a golden age, until 2005, once passed the "great fear of the year 2000" and the proliferation of apocalyptic movements.
