Gelişen dünyada uluslararası ilişkiler ve etkileşimler artmıştır. Bunun bir sonucu da yabancılık unsuru içeren uyuşmazlıkların ortaya çıkması olmuştur. Kural olarak yerel bir uyuşmazlık, uyuşmazlığın çıktığı ülkenin yargı organlarınca çözüme kavuşturulur. Ancak yabancılık unsuru içeren bir uyuşmazlık ulusal bir yargı organınca çözülse bile yargılama sonucu tesis edilen hükmün uyuşmazlığın tarafı olan kişilerin ülkelerinde de etki doğurması artık zorunlu bir hal almıştır. Yabancı yargı organlarınca tesis edilen kararların başka bir ülkede hukuki sonuç doğurması ise ancak o ülke makamlarınca tanıma ve tenfiz prosedürü işletildikten sonra mümkün olmaktadır. Bu tanıma ve tenfiz prosedürünün şartlarını ise kararın etki doğuracağı ülkelerin kendileri belirlemektedir ; In the developing world, international relationships and interactions have increased. As a consequence, disputes including foreign element arise between nations. As a rule, a domestic dispute has to be resolved by national courts. Despite, it is solved nationally, the solution also needs to result in parties countries. A foreign judgment can be effect as a "judgment" in another country, only after a process of recognition and enforcement and conditions of the recognition and enforcement of a foreign judgment can only be determined by the law of this country

Bir devletin, siyasi sınırları içinde işlenen suçları soruşturabilmesi ve kovuşturabilmesi, egemenlik hakkının bir sonucu kabul edilmektedir. Ancak bir ülkenin başka bir ülkede işlenen suçlarla ilgili yargı yetkisi kullanabilmesi ancak istisnai hallerde söz konusu olabilmektedir. Türk Ceza Kanunu'na göre esas itibariyle ülkesellik ilkesi kabul edilmiş olmakla birlikte evrensellik, şahsilik, ikame yargı ilkesi çerçevesinde vatandaşların hatta yabancıların bir başka ülkede işlediği bir kısım suçlarda Türk mahkemelerinin yargı yetkisine ve Türk kanunlarının uygulanabilirliğine imkân tanınmıştır. Bu çalışmada Türk Ceza Kanunu'nun yer bakımından uygulanması açısından kabul ettiği temel ilkelere değindikten sonra yabancı ülkede işlenen suçlarda Türk kanunlarının uygulanabilirliğinin koşulları ve Türk mahke melerinin yargı yetkisi üzerinde durulmuştur. ; A state can investigate and prosecute crimes that are committed within its political borders and it considered as a result of right of independence. However, exercising the judicial power for the crimes that are committed in other country can be possible in the exceptional circumstances only. According to Turkish Criminal Code, as well as the fundamental principal is the principal of territoriality, within the scope of the universality, personality, the principal of substitution jurisdiction, authority of Turkish Courts and the applicability of Turkish laws has been allowed in some crimes committed by citizens and even foreigners in a foreign country. In this study, primarily the fundamental principles of Turkish Criminal Code have been mentioned from the point of the application of Turkish Criminal Code in regard to the authority and then the applicability of Turkish Laws and the authority of Turkish Courts for the crimes that committed in foreign country has been emphasized.

Modern devletin vazgeçilmez unsurlarından biri olan egemenlik anlayışı önemli bir dönüşüme uğramıştır. Bugün Jean Bodin'in kurumsallaştırdığı; mutlak, bölünemez ve sürekli olarak nitelendirilen klasik egemenlik anlayışından bahsetmemiz mümkün değildir. Klasik egemenlik anlayışının geçirdiği dönüşümün çeşitli sebepleri bulunmaktadır. Bu sebepleri hukuk devleti, insan hakları, kuvvetler ayrılığı prensibi ve uluslararası kuruluşlar olarak ifade etmemiz mümkündür. Özellikle Birinci ve İkinci Dünya Savaşı sonrasında ortaya çıkan uluslararası kuruluşlar devletlerin egemenliğine müdahale konusunda oldukça dikkat çekicidir. Egemenlik anlayışının geçirdiği bu dönüşüm sırasında dünya birçok katliama ve savaşlara tanıklık etmiştir. Bu doğrultuda da önce ad hoc mahkemeler kurulmuş ardından da Uluslararası Ceza Mahkemesi'nin kuruluşuna giden süreç başlamıştır. 17 Temmuz 1998 tarihinde kabul edilip, 1 Temmuz 2002'de yürürlüğe giren Roma Statüsü ile de Uluslararası Ceza Mahkemesi kurulmuştur. Devlet egemenliğine önemli bir müdahale anlamına gelen Uluslararası Ceza Mahkemesi'nin yargılama yetkisi konusunda tamamlayıcılık ilkesinin kabul edilmesiyle, devlet egemenliğine yapılan müdahalenin daha aza indirgenmesi amaçlanmıştır. Aynı zamanda da Statü'ye taraf olacak devlet sayısını arttırmak amaçlanmıştır. ; Our understanding of sovereignty, which is one of the essential factors of modern state, has undergone a significant transformation in time. Today, it is impossible to mention a classical understanding of sovereignty which was institutionalized by Jean Bodin as; absolute, indivisible and perdurable. There are various reasons that caused the transformation of classical sovereignty; it can be said that these reasons are constitutional state, human rights, principle of separation of powers and international organizations. The international organizations, especially established after the First and Second World Wars, are quite significant instruments in the process of intervening to the sovereignty of states. During the transformation of understanding of sovereignty, the world had witnessed numerous massacres and wars. In this respect, firstly ad hoc tribunals had been established, after that the process towards the establishment of International Criminal Court started. International Criminal Court was established with Rome Statute which was acknowledged on July, 17, 1988 and inured on July, 1, 2002. Through the acceptance of complementarity principle in terms of International Criminal Court's jurisdiction, it is intended to minimize the intervention to the sovereignty of states. Also, it is aimed to increase the number of states parties to the Statute.

Çalışmaya konu olan Yargıtay Hukuk Genel Kurulu kararında, tanık ile taraf arasında söz konusu olan menfaat ilişkisinin tanığın beyanının güvenilirliğini ortadan kaldıracağı ifade edilmiştir. Tanık, tanığı olduğu olaylara ilişkin bilgilerini aktarırken aslında hâkimin zihninde olayı yeniden canlandırmakta ve olaya ilişkin bir kanaate ulaşmasına zemin hazırlamaktadır. Aksi yönde ciddi ve inandırıcı deliller ortaya konulmadıkça tanığın doğru söylediği kabul edilmektedir. Tanığın beyanının güvenilirliğinden kuşku duyulmasını gerektirecek bir husus var ise, taraflara bunu iddia ve ispat etme imkânı tanınmalı, hâkim de bu durumu göz önünde bulundurmalıdır. Bu açıdan tanığın davanın taraflarıyla iş ilişkisi içerisinde bulunması beyanının geçersizliği sonucunu doğurmamalıdır. Bir yandan tanık beyanının hukuk hayatında arz ettiği önem ve aynı işyerinde çalışmanın tanıklık bakımından kanuni bir engel sayılmaması, diğer yandan aksi yönde ciddi ve inandırıcı deliller olmadıkça tanığın doğruyu söylediğinin kabulü, çalışmanın konusunu teşkil eden Yargıtay Hukuk Genel Kurulu kararının bu hususlar çerçevesinde incelenmesini gerekli kılmıştır. ; The study is related to the evaluation of the General Assembly of the Supreme Court desicion which is about the witness of one of the parties made in the case of a business relationship. The witness actually reenact the event in the mind of the judge regarding the events when transferring information and the judge will provide the basis for reaching a conclusion regarding the incident. In this context that is accepted that, unless there is another evidence to the contrary, the witnesses being told the truth and also only a business relationship does not make the witness statement invalid. However, at this point the testimony of the witness is enough to raise doubt as to where the relationship is located, in that case, both parties to prove this claim and both judges considering these elements has authority to make the assessment. For this reason, the significance of the evidence and a witness that can be used in practical life and by lawing there is the lack of limitation about business relationship and also unlike both the serious and the adoption of the witness telling the truth unless there is convincing evidence necessitated reassessing the decision within the framework of the examination.

Avrupa Birliği Ortaklık Mevzuatı'nda gerçek kişilere tanınan serbest dolaşım özgürlüğü, Kurucu Andlaşma'da yer alan hükümler gereğince tüzel kişilere de uygulanabilir niteliktedir. Bu durumun sonucu olarak herhangi bir Birlik üyesi devlette kurulan bir ticari şirket, Birlik'e üye diğer devletlerde, herhangi bir kısıtlamaya maruz kalmaksızın ticari faaliyette bulunabilecektir. Serbest dolaşım ve yerleşme özgürlüğü tüzel kişilerde, şirket merkezinin bir ülkeden diğerine taşınması; ya da diğer ülkelerde şube veya bağlı şirket açılması yoluyla sağlanmaktadır. Üye devletler, serbest dolaşım ve yerleşme özgürlüğü ilkesi uyarınca yabancı şirketlerin, ülkelerinde ticari faaliyette bulunmasına kısıtlama getiren iç hukuk hükümlerinden kaçınmak durumundadır. Tüzel kişilere tanınan bu iki hakkın altında yatan temel gaye ise yerli-yabancı şirket ayrımının ortadan kaldırılması suretiyle sermaye akışının hızlandırılması ve ortak pazar ekonomisinin sağlanmasıdır. Ancak üye devletlerin iç hukuk hükümleri ve kanunlar ihtilafı mevzuatlarındaki farklılıklar, uygulamada büyük sorunlara yol açmaktadır. Çalışmanın konusunu da; uygulamada karşılaşılan bu sorunların Ortaklık Mevzuatı ve Avrupa Birliği Adalet Divanı kararları ışığında incelenmesi oluşturmaktadır. ; The freedom of mobility granted to natural persons in the European Union Association Legislation is also applicable to the member state legal persons as per the provisions in the Founding Treaty. As a result, a commercial established in an EU member state can conduct commercial activities without any limitations in other EU member states. Freedom of mobility and establishment in legal persons is realized through the relocation of the corporation headquarters from one country to the other or through establishment of branches or affiliated corporations in other countries. Member states are obliged to refrain from legislating national legal provisions which restrict the commercial operations of foreign corporations in their country pursuant to the principle of freedom of movement and establishment. The main purpose of these two rights granted to the legal persons is to increase capital flow and promote common market economy through the ablosihment of foreign – domestic corporation distinction. However, the differences between member states' national legislation and the legislation regarding the conflict of laws lead to crucial problems in practice. This study focuses on the examination of these problems in the light of Association Legislation and the decisions of the European Union Court of Justice.

Demokratik sistemlerin vazgeçilmez ve hayati unsuru olan siyasi partiler, temsili demokrasinin yerine getirilmesinin yanı sıra, çağdaş demokrasinin temel niteliği olan "çoğulculuk" ilkesinin hayata geçirilmesinde de önemli rol üstlenmiştir. Türkiye'de Anayasa ve kanunlarda birtakım yasaklarla sınırlandırılan siyasi partiler, söz konusu sınırların ihlali nedeniyle kapatma davaları ile karşı karşıya kalmış ve bu davaların sonucunda ilgili partilere pek çok kez kapatma yaptırımı uygulanmıştır. Hukukumuzda siyasi parti kapatma nedenlerine Anayasamızda açıkça yer verilmiştir. Bunlardan "Devletin ülkesi ve milletiyle bölünmez bütünlüğü" ilkesi nedeniyle verilen siyasi parti kapatma kararlarında Anayasa Mahkemesinin anılan ilkeyi çok katı uyguladığına ilişkin çeşitli eleştireler bulunmaktadır. Avrupa İnsan Hakları Mahkemesi de Anayasa Mahkemesi tarafından verilen kapatma kararlarıyla ilgili olarak çeşitli ihlal kararları vermiştir. Anayasa Mahkemesi kararlarında bir taraftan bölümez bütünlük ilkesinin korunmasına özen gösterirken, diğer taraftan da demokratik ilkelerin hayata geçirilmesini de gözetmelidir. Bu kapsamda ifade hürriyeti ve örgütlenme özgürlüğü hem 1982 Anayasası hem de Avrupa İnsan Hakları Sözleşmesi kapsamında korunan en önemli temel haklardın ikisidir. ; Political parties, which are indispensable and vital elements of democratic systems, have played an important role in the implementation of the principle of "pluralism", which is the basic feature of contemporary democracy, as well as the fulfillment of representative democracy. The limited number of political parties prohibited in the Constitution and law in Turkey, said that faced with due to the border closure cases of violations and closure many times the parties concerned as a result of this case was applied. The reasons for closing political parties in our law are clearly stated in our Constitution. There are various criticisms that the Constitutional Court applied the principle very strictly in the political party closure decisions made due to the principle of "indivisible integrity of the state with its country and nation". The European Court of Human Rights has also issued several violation orders in relation to closure decisions by the Constitutional Court. In the Constitutional Court decisions, while paying attention to the protection of the principle of indivisible integrity, on the other hand, it should also consider the realization of democratic principles. In this context, freedom of expression and freedom of association are two of the most important fundamental rights protected under both the 1982 Constitution and the European Convention on Human Rights.

Avrupa Birliği'nde, 6 ayda bir değişen rotasyon sistemiyle gerçekleşen dönem başkanlığı, ülke devlet ve hükümet başkanlarının kendilerini uluslararası alanda gösterebilecekleri bir sistemdir. Dönem başkanlığını yürüten üye ülke, trio olarak adlandırılan üçlü gruplar halinde bir arada çalışmaktadırlar. Trio, uzun vadeli hedefler belirlemekte ve 18 aylık bir süre boyunca ön planda olacak önemli konuları belirleyen ortak bir gündem hazırlamaktadır. Avrupa Birliği'nin başından beri var olan bu sistem, genişleme ve derinleşme süreçleriyle yenilenmiş ve daha verimli hale getirilmeye çalışılmıştır. Bu çalışma kapsamında, özellikle Lizbon Antlaşması'nın yürürlüğe girmesinden sonra dönem başkanlığı yapan ülkelerin politikaları analiz edilecektir. Bu çerçevede trionun ortak bir politika mı yürüttüğü yoksa her dönem başkanı ülkenin kendi önceliklerini mi uygulamaya çalıştığı araştırılacaktır. Sonuç olarak, politik öneme sahip olan bu sistemin, Avrupa Birliği'nde politika yapımına ne derece katkı sağladığı anlaşılmaya çalışılacaktır. ; The rotating presidency, which takes place every 6 months in the European Union, is a system in which the heads of states and governments can show themselves in the international arena. Member states which are holding the presidency work together closely in groups of three, called trios. The trio sets long-term goals and prepares a common agenda determining the major issues over an 18 month period. This system, which has existed since the beginning of the European Union, has been renovated and developed by processes of enlargement and deepening. In this study, especially after the entry into force of the Treaty of Lisbon, the politics of the countries that preside over the term will be analyzed. In this framework, it will be analyzed that whether the trio has a common policy or each president country tries to apply the country's own priorities. As a result, it will be attempted to understand the extent to which this system, which has a political prescription, contributes to policy-making in the European Union.

Tez çalışmasında Türkiye Cumhuriyeti Anayasası ile Rusya Federasyonu Anayasası'nda Cumhurbaşkanlarının statüleri ve yetkileri incelenmiştir. Mevcut devlet yapılarını etkileyen tarihsel durumun analizi yapılmıştır. Buna ek olarak, Rusya ve Türkiye'deki Сumhurbaşkanlığı seçim süreçleri ve Cumhurbaşkanlarının yetkilerini sona erdiren koşullar ard arda gözden geçirilmiştir. Bu çalışma, Rusya Anayasası'nda, ülkenin anayasal sisteminin temelleri ile ilgili birçok önemli değişikliğe yol açacak yeni anayasa reformu hakkında güncel bilgileri içermektedir. Karşılaştırma sırasında, 2017 yılında Türkiye'de yapılan anayasal reformuna dair gerekli açıklamalar da yapıldı. Söz konusu reform ile ülkedeki hükümet sistemi değişmiş oldu. Bu çalışma sırasında hükümet sistemleri ve faaliyetleri hakkında çok ayrıntılı bilgiler verilmiştir. Сumhurbaşkanlığı sistemlerinin tarihsel değişimleri detaylı olarak ele alınmıştır. Bu çalışma, iki ülke yönetim sistemlerinin tarihsel ve modern döneme dair benzer ve ayrımsal yönlerinin karşılaştırılmasına imkan sağlaması bakımından önemlidir. ; In this thesis, the Constitution of Turkey and the status and powers of the presidents of the Russian Federation are examined. An analysis of the historical situation affecting the current state structure was done. In addition, the presidential election process in Russia and Turkey and the circumstances under which the president could lose his authority were repeatedly reviewed. This work contains the most relevant information about the upcoming constitutional reform in the Russian Constitution, which will lead to many important changes to the foundations of the country's constitutional system. For comparison, a 2017 constitutional reform declaration was made in Turkey. The reform was the reason for the change of the system of government in the country. Very detailed information about government systems and activities is provided. The historical change of presidential systems is discussed in detail. This study is important in terms of enabling the comparison of similar and differential aspects of the two countries' management systems regarding the historical and modern period.

Türkiye'de siyaset, geçmişten bugüne her daim bir "merkez" temelinde şekillendirilmiştir. Merkez, hem yönetim gücünün belirleyicisi hem de idarenin uygulayıcısı konumunda olmuştur. Buna karşılık taşraya; merkezin hükümlerinin uygulayıcılığını yapmak ve merkezin askeri, tarımsal, beşeri ve bunun gibi birçok alandaki sermayeye dayalı ihtiyaçlarını karşılamak şeklinde roller biçilmiştir. Dolayısıyla merkez açısından taşra, siyasal sermaye bağlamında düşünüldüğünde, siyasal idareye ortak olabilme rüştüne haiz görünmemiştir. Bundan dolayı taşranın merkeze yönelik çeşitli refleksleri de ya görmezden gelinmiş ya da bastırılmaya çalışılmıştır. Böylelikle taşra; hem siyasal yönetim hem de toplumsal bağlamda, ötekileştirilen, dışlanan ve küçümsenen bir politikaya maruz kalmıştır. Oysa taşra, sadece merkezin iaşesini ve insan sermayesini karşılamakla mükellef coğrafi bir alan olmanın ötesinde bir rezerve ve pratiğe sahiptir. Taşra, gündelik siyasal yaşam pratikleri ve merkezi yakından takip etmesiyle, siyasetin önemli bir aktörüdür. Kaldı ki taşra, pasif ve güçsüz bir yapıya sahip gibi görünse de, esasında merkezi çepeçevre kuşatan bir yetkinlikte ve dirayettedir. Bu çalışmada, öncelikle merkez-çevre teorisi bağlamında taşranın tarihsel ve siyasal gelenek bakımından ne tür rollere sahip olduğu üzerinde durulacaktır. Bununla birlikte bir çevre olarak taşranın siyasal kültürdeki konumu ele alınacaktır. Ayrıca taşranın geçmişten günümüze temsiliyetlerine ve siyasette ve idarede taşranın ötekileştirildiğine dikkat çekilecektir. Son olarak ise, günümüz taşrasından insan manzaralarına, toplumsal tiplere, siyasal aktörlere ve politik ilişkilere yer verilerek merkez-taşra diyalektiğinin görünümleri üzerinde durulacaktır. ; Politics in Turkey has been always shaped on the basis of a "center" from the past to present. Center has been in position both as the determinant of government forces and the practitioner of political administration. In contrast to this, the country is given the roles that is being a practitioner of the central provisions and to satisfy the center's need based on capital such as the military, agricultural, human and in many areas like this. Thus, in the face of center, the country has been recognized as being unable to be included in political governance when it is considered within the context of political capital. Therefore, the country's various reflexes to the centre either have been ignored or have been tried to be suppressed. Thus, country has been exposed to a policy that is marginalized, excluded and despised in both political management and social context. However, the country, beyond being a geographical area that only supplies center's needs and human capital, has a reserved and practical side. The country, with her daily practices in political life and her close pursuit of centre, is a significant player in politics. Besides, although the country seems to have passive and weak structure, actually it has an ability and power in surrounding center circumferentially. In this study, primarily in the context of center-periphery theory, the focus will be on what kinds of roles the country keeps in terms of historical and political traditions. In addition to this, the position of the country as a periphery at political culture will be discussed. It will also draw attention to the country's representation from the past to the present and the country that is marginalized in politics and in administration. Finally, the appearances of dialectical structures among center and the country will be focused on by illustrating people living in the country, the social types, the political actors and political relations observed in the country.

Bu çalışmada, demokrasinin işleyişinde yargının rolü ve meşruiyeti tartışılmaktadır. Demokrasinin tarihi her ne kadar iki bin beş yüz yıl öncesine dayanıyorsa da, demokrasinin neyi ifade ettiği hususu bugün dahi tartışmalıdır. Bu durum, demokrasi üzerine yapılacak çalışmaların her dönemde güncel bir ihtiyaca cevap vereceği anlamına gelmektedir. İşte günümüzdeki demokrasi tartışmalarına güncellik katan en önemli unsur, demokrasi ve yargı ilişkisi olmaktadır. Özellikle İkinci Dünya Savaşı'ndan sonra, yargının demokrasilerdeki rolü değişime uğramıştır. Bu dönemle birlikte, siyasi iktidarları sınırlama ihtiyacına cevap verebilecek en uygun çözümün, yargı yoluyla denetim olduğu fikri kabul görmeye başlamıştır. Böylece Anayasa Mahkemeleri aracılığıyla, yargıya siyasi rolün biçildiği bir döneme girilmiş olmaktadır. Demokrasi-yargı ilişkisini incelemeye değer kılan tek unsur elbette Anayasa Mahkemelerinin varlığı değildir. Yargıda yaşanan bütün sorunların bir şekilde demokratik sisteme zarar verdiği söylenebilir. Aynı şekilde, sağlıklı işleyen bir yargı düzeninin varlığı da, demokrasinin sağlıklı biçimde işlemesi için zorunlu olmaktadır. Bu durum, yargıya ilişkin kurumsal düzenlemelerin ve uygulamadan kaynaklanan sorunların incelenmesi gerekliliğini ortaya koymaktadır. Bu incelemeler ışığında, demokrasilerde yaşanan yargı kaynaklı sorunların önüne geçilmesi mümkün olabilir. Öte yandan, yargı kaynaklı sorunların gerçekten yargı kaynaklı olup-olmadığının anlaşılması için de yargının geniş biçimde incelenmesi gerekmektedir. Çünkü yargı kaynaklı olduğu düşünülen bazı sorunların aslında, siyasi iktidarlardan veya ilgili ülkedeki siyasi kültürden kaynaklanması söz konusu olmaktadır. ; This study discusses the role and legitimism of jurisdiction in democracy. Although the history of democracy dates back to as early as two thousand five hundred years ago, it is not understood fully even today. This means that studies on democracy are to respond to a current need. Thereby the most significant component that makes democracy discussions up-to-date is the relation between democracy and jurisdiction. Especially after the World War II, the role of jurisdiction in democracies has changed. With the beginning of this period, the contemplation that the most appropriate way to meet the need to limit political powers is to use jurisdiction has become popular. Therefore, an era in which jurisdiction is casted a political role via Constitutional Courts has began. The existence of Constitutional Courts is not the only factor that makes the relation between democracy-jurisdiction worthy of studying. It can be argued that all problems in jurisdiction somehow give harm to proper operation of democracy. Similarly, a robust jurisdiction entails a sound democracy. This case entails the examination of the problems resulting from institutional regulations and applications in jurisdiction. In the light of these examinations, it can be possible to prevent jurisdiction related problems in democracy. On the other hand, jurisdiction is to be examined comprehensively so as to decide whether problems are really jurisdiction related or not because it is possible that some problems which are considered to be jurisdiction related can stem from political power or the political culture in the country.

Karmaşık yapıdaki kamu politikalarının çözümlenebilmesini sağlayan kamu politikası analizi, olguların açıklanabilmesi için geliştirilen basitleştirilmiş bakış açısını ifade eden kavramsal bir modelle yapılabilir. Farklı modellerin öngörülerinin beraberce kullanılmasını öngören "tamamlayıcı yaklaşım" Türkiye'deki devletin oyun alanına giren makro ve meso boyuttaki politikaların analizinin daha tutarlı olmasını sağlayan kavramsal zemini hazırlama potansiyeline sahiptir. Bu çalışmada, Türkiye'deki makro ve meso düzeydeki en önemli politika alanlarından birini oluşturan kamu yönetimi ve yerel yönetim reformlarının analizinde elverişli bir zemin oluşturacak Türk siyasal kültürünün şekillendirdiği tarihsel arka plan, sosyo-ekonomik koşullar, kurumsal yapı ve elitlerarası ilişkilerin dâhil edildiği farklı kamu politikası analiz modellerinin "tamamlayıcı yaklaşım" dâhilinde harmanlandığı çözümleme yaklaşımı benimsenmiştir. Türk siyasal kültürünün yansımasının net şekilde okunabildiği, siyasal sistemin çevresinden doğan girdi-taleplerin problemi doğurduğu ve tepeden inmeci yöntemle uluslararası kuruluşlar tarafından problemin tanımlanarak siyasal gündeme sokulduğu İller Bankası reorganizasyon politikaları, Türkiye'deki makro ve meso düzeydeki kamu yönetimi reform politikalarının analizi için uygun bir örnek teşkil etmektedir. "Tamamlayıcı yaklaşımın" sunduğu çerçeve dâhilinde İller Bankası reorganizasyon politikaları örnek olay olarak seçilmiş olup çözümlemede "Easton'ın siyasal sistemler analizi yaklaşımı", "Hofferbert'in nedensellik hunisi yaklaşımı", "kurumsal model, "elitist model ile Grindle ve Thomas'ın araştırması", "Kingdon'ın çoklu akış modeli" ve "süreç analizi modeli" beraberce kullanılmıştır. Politika çözümlemesi girişiminde, 1/371 sayılı Kanun Tasarısının ve 6107 sayılı Kanunun Genel gerekçesinde ve dahi İller Bankasının Stratejik Planlarında vurgulandığı üzere yatırım ve kalkınma bankasına dönüşme hedefi ele alınıp değerlendirilmiştir. ; Public policy analysis, a process enabling us to decipher complex public administrative policies, is conducted through a vulgarized conceptual model developed for elucidating phenomenon. The "complementary approach" which assumes mutual utilization from foresights of different models displays potential for paving more solid conceptual ground analyzing macro and meso policies that fall into government's area of interest in Turkey. In the present study, an analysis approach, the blend of relationships between administrative structure and elite groups, socio-economic conditions, and historical background, one of the most prominent politics domain at macro and meso level in Turkey, which would pave a solid ground for analysis public and local administration concepts is adopted. The reorganization policies concentrated on the "İller Bankası" from which Turkish political culture could be viewed, in which demands of political groups cause problems, from where problems are laid out by international institution through compulsory methods to bring into political agenda, cast a valuable example for further analysis of public administration reforms at macro and meso levels in Turkey. Within the scope of the "complementary approach", reorganization policies of "İller Bankası" were selected as the case study while "Easton's political systems analysis approach", "Hofferbert's funnel casualty approach", "institutional model", "elitist model and Grindle and Thomas's research", "Kingdon's multiple streams model" and "process (stages) analysis model" were utilized in the analysis process of the case jointly. In the policy analysis phase, as it is implied within the draft law with 1/371st serial number and the law with 6107 serial number as well inthe strategic corporate plans of "İller Bankası", the target of evolution into an investment and development bank was taken into consideration.

Demokratik yönetim sisteminde, kuvvetler ayrılığı teorisi gereği, yönetim yetkilen yasama, yürütme ve yargı arasında paylaştırılmaktadır. Ancak parlamenter yönetim sisteminde yürütme yasamadan çıktığından yasamaya karşı sorumlu konumdadır ve bu nedenle yasama ve yargı organları tarafından denetlenmektedir. Fiili uygulamada ise yasama yürütmeyi denetlemede yetersiz kalmaktadır. Çünkü yürütmenin başı olan başbakan, mecliste çoğunluğu oluşturan parti veya partilerin lideri konumundadır. Dolayısıyla Montesquieu'nün kuvvetler ayrılığı ilkesinde öngörülen denetim, sadece meclisteki muhalefet partisi veya partileri tarafından yerine getirilebilmektedir. Muhalefetin mecliste azınlıkta olması, meclis denetimini zayıflatmaktadır. Çalışma bu nedenle muhalefete önem atfederek muhalefetin tanımını, sistem içinde oynadığı rolü ve muhalefetçe oluşturulan Gölge Kabine 'nin önemini analiz etmektedir. Çalışma, parlamenter yönetim sisteminde, hükümetin denetlenebilmesi için muhalefetin Gölge Kabine oluşturarak düzenli ve sürekli muhalefet etmesini önermektedir. Çalışma bu kapsamda muhalefetin tanımını, muhalefet etme yöntemlerini ve kapsamlı bir muhalefet örgütlenmesini irdelemektedir. Etkin denetim için muhalefetin "rekabetçi ve işbirliğine dayanan"politikalar uygulaması gerekmektedir. Muhalefetin "rekabetçi ve işbirliğine dayanan " politikalarla iktidara ciddi bir alternatif olduğunu ispatlaması gerekmektedir. Bu kapsamda, muhalefet bir taraftan hükümeti yapıcı politikalarla uyararak iktidar partisine oy vermiş seçmenlerin beğenisi alınmalı, diğer taraftan toplumsal sorunlara alternatif çözümler üreterek iktidara hazır olduğunu gösterilmelidir. ; The Power in the Parliamentary System of Government, which is a type of democratic system of government, is divided between legislation, execution and jurisdiction. Since execution is formed out of legislation in the Parliamentary System of Government, it is liable to the legislation and as a result it is checked by legislative and juridical institutions. But, in application, it can be set forth that the legislation is not competent enough to check the execution. One of the indications of incompetence is the fact that the Prime Minister is selected by the party or parties which have the majority of members in the parliament. Consequently, the mission of inspection which Montesquieu put forward in the principle of division of powers can only be fulfilled by the opposition party or parties in the parliament. But, since the opposition constitutes only the minority of the parliament, the legislative inspection gets weaker. This study analyzes the definition of the opposition by attributing emphasis on it, the role that it plays in the Parliamentary System of Government, the importance of the Shadow Cabinet in the context of opposing and methods that can be applied for inspection of the execution. The opposition should be formed as Shadow Cabinet in the Parliamentary System of Government in order that the execution can be inspected effectively. For this reason, this study explicates the definition of the opposition, the methods of opposing, and a comprehensive opposition organization. In addition, it is pointed out thai the opposition can inspect the Power and the ruling party through the Shadow Cabinet. After the parliamentary elections and the lines of parties in the parliament become clear, as a requirement of Parliamentary System of Government, while the ruling party or parties are forced to work with the Power, the opposition party or parties form the opposition front against the Power, the ruling party or parties in the parliament and their applications. The opposition party should form the Shadow Cabinet in order to inspect and obserye the cabinet more effectively. The inspection and control of the Power by the opposition in the democratic system of government is of great importance in tenns of stability of the political regime and even the guarantees the regime to be democratic. While shaping its policies, the opposition should comply with the secular and democratic rules of the game. After all, the constitutional spirit gives the Power and the opposition the mission of representing the public best in the pluralist democratic system of government and enables them to compete with each other within the democratic game rules. For his reason, an effective inspection and check of the Power by the opposition makes the cabinet stick to laws and minimizes the misuses in the administration. "Competitive and cooperative" policies should be applied in the opposing methods. Tlie concept of only "Strict competitive" or "Over compromising cooperative" opposition doesn't bring positive results. Furthermore, the opposition's "Strict competitive" or "Over compromising cooperative" policies are not encouraged by the public. For this reason, the opposition should prove that it is a serious alternative to the Power with its "competitive and cooperative "policies. In this context, the opposition should warn the Power with constructive policies, receive the appreciation of the people who voted for the ruling party and show that it is ready to be Power-by producing alternative solutions to the social problems. The opposition should try to have an image of a party having a high comprising culture by tolerating the suggestions made by the Power or at least by not rejecting them. The opposition should avoid having an intransigent party image. It should include the needs of the majority of voters in the party program and should develop policies in accordance with them. In addition to offering a successful opposition, experienced staff should be brought up. The opposition will only be able to convincingly show that it is ready to undertake execution and it is an alternative to the Power by training such staff For his reason, after the defeat in the election, the party which becomes the opposition should restructure itself with an emergency assembly and should not insist on the leaders who weren't selected by the public. As a result, the intra-party debates will be resolved sooner without harming the party and the party mil set off with its new leaders confidently. The party should be made to reach new masses in the context of restructuring, the policies constructed should be directed to inspect and check the Power and they should focus on winning the forthcoming election. For this reason, the opposition will need a professional team which will make its program and policies effective. This team is called "Shadow Cabinet" in the British Parliamentary System of Government. The missions of the members of the Shadow Cabinet will be equivalent to those of existing cabinet. The ministers of the Shadow Cabinet will check the actions and applications of the ministers of the actual cabinet and have an inspection over them and will criticize them when needed. Accordingly, the number of the members in the Shadow Cabinet is equal to that of actual cabinet. In addition, the members selected for the Shadow Cabinet should be skillful, they should be let to work actively till the end of the opposition period and with the experience they gain, they should be appointed as ministers of an actual cabinet upon a victory in the elections. As a result, the program of the Shadow Cabinet or the opposition party should alternate to the applications of the ruling party and it should convince the social base. The primary missions of the oppositions are shortly checking and inspecting the Power, trying to affect and direct the Power, developing relations with great masses of the society, overcoming deficiencies in the party program through the experiences gained, getting ready for the elections and getting ready to undertake execution in case of crisis.

Lozan Muahedesi Türkiye Cumhuriyeti"nin kurucu bir metni olarak modern Türkiye"de tutum, düşünce ve politikaları şekillendiren bir algılar bütünüdür. 1920"ler ve 1930"lar boyunca devlet adamı ve aydınlar eliyle üretilen Lozan söylemleri, özellikle Sevr ile kurulan karşıtlık temelinde yeni devletin meşruiyetinin sağlanmasında, yeni siyasal seçkinlerin meşrulaştırılmasında, Türk dış politikasının şekillenmesinde, iktisat politikalarının belirlenmesinde ve nihayet ulus kimliğinin tanımlanmasında rol oynamıştır. Bu çalışmada bu söylemler analiz edilerek geçmişten günümüze Lozan algısı tanımlanmakta ve bu algının reel politik üzerindeki etkisi belirlenmektedir. ; As a constituent text of the Republic of Turkey, the Lausanne Treaty serves not only as a treaty but also as a guideline, which shapes attitudes, ideas and policies of modern Turkey. The Lausanne discourse, which was produced by the statesmen and intellectuals of the republic during the 1920s and 1930s, emerged as an opposition to the defunct Sevr Treaty. The Lausanne discourse played a role in ensuring the legitimacy of the new state, in legitimizing the new political elites, in the formation of Turkish foreign policy and economic policies, and finally in defining national identity. This study analyzes these discourses and defines the perception of Lausanne from past to present and exhibits its impact on real politics.
