El presente artículo analiza críticamente la jurisprudencia de la Corte Internacional de Justicia en relación con la interpretación y aplicación del artículo 36 de la Convención de Viena sobre Relaciones Consulares. Esta vez al hilo del reciente fallo en el caso Jadhav (India v. Pakistan), en el cual la Corte mantiene una línea jurisprudencialque se analiza en sus limitaciones en relación con los derechos humanos y que tiene antecedentes. Se pretende demostrar, mediante el análisis normativo y jurisprudencial como método esencial del trabajo, que todavía no se han producido avances decisivos en el reconocimiento del derecho a ser informado a la asistencia consultar como un derecho humano que disponga de autonomía en el plano jurídico. La Corte Internacional de Justicia no extrae todas las consecuencias en el campo de los derechos humanos en esta temática. Este trabajo tendría el valor de apuntar las líneas que debería seguir la jurisprudencia de la Corte para acoger la tendencia a ocuparse de los asuntos sobre derechos humanos.

The sphere of security plays an important role in the domestic and foreign policy of states. In this regard, the object of the study were security threats that determine stability in Ukraine and Pakistan. The authors used the method of comparative analysis to draw parallels between the security of Ukraine and Pakistan and identify possible ways to improve it. It is concluded that, both Ukraine and Pakistan are quite geopolitically distant, have different histories and state-building processes, but are affected by traditional and "non-traditional" security threats. Definitely, the main unifying factor for the states is the antagonistic or "enemy" state - India for Pakistan and Russia for Ukraine, which becomes a catalyst for the formation of national identity and unity of society. The conflicts in Pakistan (Kashmir, Baluchistan and Pashtunistan) and Ukraine (war in Donbass, illegal annexation of Crimea by the Russian Federation) have had common consequences and mechanisms for overcoming them, which are implemented in the context of the internal and state policy of both Kiev and Islamabad.

In this article, the author analyzes the long & stormy process of the Kashmir Conflict between India & Pakistan as well the search of a definitive resolution. The author emphasizes that this conflict, from its same origin, has been deeply shaped by power & influence mechanisms which shake the international arena, & explains how its structure is being directly affected by the course of world reorganization initiated on September 11th. She also examines the risks that international Islamist factions means in the resolution of the conflict in their attempt to gain the support of a population who basically aspires for peace. Se analiza el flujo migratorio de los refugiados afganos, su comportamiento historico, el entorno social al que se integraron en los paises receptores y las caracteristicas e intereses que han determinado la politica de Pakistan e Iran hacia la cuestion de los refugiados. El programa de repatriacion avanzo en los primeros cinco anos de la transicion postaliban, pero se estanco desde entonces. La nueva estrategia adoptada en la Conferencia de Ginebra de 2012 pretende reactivar el proceso, aunque existen factores inhibidores. Se analiza por fin como pueden influir en el proceso las variables politicas relacionadas con el escenario afgano luego de 2014 This paper analyzes the migratory movement of Afghan refugees and its historical evolution, the social context refugees moved into in the host countries, and the characteristics and interests that have impacted on policies for dealing with the refugees in Pakistan and Iran. The repatriation program made progress during the first five years of the post-Taliban transition, but has stalled ever since. The new strategy adopted at the 2012 Geneva Conference intends to reactivate the project, but faces numerous obstacles.
