Birleşmiş Milletler'in (BM), geç kalınmış olmasına ragmen ciddi bir yapılanmaya ihtiyaç duydugu günümüzde hemen hemen tüm ilgili çevreler tarafından kabul edilmektedir. Geniş kapsamlı yapısal reformları daha 2000 yılında ortaya çıkan Birleşmiş Milletler Barış Operasyonları Panel Raporu ("Brahimi Raporu") kapsamında örgütün kurumsal yapısı ve operasyonları alanlarında gerçekleştirme çabası içerisinde olunmakla birlikte, bu reformların şimdiden örgütün faaliyetlerine hissedilir bir şekilde yansımaya başladığı gözlenmektedir. Bu makalenin amacı, örgütün genel bir kurumsal yapılanması üzerinde durmaktan ziyade barış operasyonlarının yeniden nasıl yapılandırılmaya çalışıldığının analizini yapmak olacaktır. Ayrıca, Avrupa Birligi (AB) ve Türkiye'nin barış operasyonlarına yaptıkları kayda değer sivil personel katkıları ve sivil kriz yönetimi kapasiteleri ortaya konarak, BM kapasite ve etkinliğini artırabilmek için Brahimi Raporu tavsiyeleriyle birlikte paralel gelişmekte olan AB ve Türkiye içerisindeki oluşumlar degerlendirilecektir. ; At the present time, almost all relevant circles recognise that the United Nations (UN) - though it has been Iate - needs serious restructuring. Albeit it has yet been in the effort of struggling to realise a wide-range of structural reforms that have appeared in the year 2000 in the sphere of organisation's institutional structure and operations within the perspective of Report of the Panel on United Nations Peace Operations (the "Bmhimi Report"), these reforms have aıready began to observably be reflected on the activities of the organisation. The aim of this article is to analyse how peace operations are tried' to be restructured, rather than focusing on the institutional structuring of the organisation in general. Also, whilst the European Union (EV) and Turkey's promising civilian personnel contributions and civilian crisis management capacities to peace operations will be set forıh, the formations in the EV and Turkey that are developing in parallel with Brahimi recommendations to increase the capacity and effectiveness of the UN will be assessed.
The subject of this study is the strategic cooperation of the permanent members in the Security Council in the period 1946 2000. Because of their right of veto the cooperation of the permanent members has a significant influence on the functioning of the Council. The most important aspects of the cooperation that were investigated are the intensity of the cooperation and the ef-fectiveness of this cooperation in preventing and ending wars. To investigate these aspects, for both the intensity and the effectiveness measuring instruments were constructed. These measuring instruments were based on comprehensive sets of so-called 'leading indicators' and statistical methods and techniques. The intensity of the cooperation increased gradually from 1946 until 1990 (the end of the Cold War). Then it started to increase rapidly until 1996. From 1996 a slight decrease can be discer-ned. The strong increase in the strategic cooperation of the permanent members in the security Council can be established in all the majors forms of cooperation in the Council: the numbers of adopted strategic resolutions and presidential statements, the numbers of employed means (like peacekeeping missions and enforcement actions) and the amounts of money that were spent on peacekeeping activities. Further it was established that the response times of the Council regarding potential and waged wars dropped significantly since the end of the Cold War. The effectiveness of the cooperation of the permanent members in the Council was, insofar this was measurable with the applied method, not good for many years, but after the Cold War a clear improvement can be discerned. This goes for the prevention of wars, as well as for post war peacebuilding and the ending of wars. Also the numbers of potential and waged wars in which the Council not intervened dropped significantly since the end of the Cold War, as well as the use of vetoes. The large number of potential and waged wars in which the Council did not intervene during the Cold War was nearly exclusively caused by 'non decisions' (the non placing of wars on the agenda), and not by the use of vetoes by permanent members, as is often assumed in literature. Further, a comparison of two phase classifications of the Cold War showed that the great powers, even when there are great tensions among them, are prepared to cooperate in the Security Council to resolve strategic matters, if they consider this in their interest. Analyses of the adopted strategic resolutions during the Cold War revealed that cooperation here was nearly exclusively limited to issues that were not core issues of the Cold War. From this it can be concluded that cooperation against third party states was a basis of cooperation of the great powers in the Security Council. Finally, the results of this study show clearly that the Security Council was regarded and used to a large extent by the permanent members in the period 1946 2000 as an instrument of foreign policy to pursue their national interests, and not as an instrument of the world community to prevent and end wars.
Hans Schippers surveys the position of Hezbollah in Lebanese politics and its relations with Iran and Syria. Hezbollah is an organisation with two faces. Together with Amal it represents the Shia in Lebanon. It participates in elections and the government. However, in the Southern part of the country Hezbollah constitutes a state within a state, with a militia and a social and medical network of its own. Most of the costs of this structure are paid for by Iran. The Shia leadership of Iran also played a vital role in the establishment of the organisation in 1982. Syria acted as the protector of Hezbollah in its agitation against Israel. With the departure of Syrian troops following the Cedar Revolution in the spring of 2005 most non-Shia Lebanese wanted to see the Hezbollah militia, seen as a pro-Syrian force, dissolved. However, this was refused by leader Nasrallah. The militia protected Lebanon against Israeli aggression, he declared. It is unclear what motivated Hezbollah to kidnap the Israeli soldiers. This action seemed to be co-ordinated with Iran and Syria to divert attention from the Iranian troubles with the United Nations about Iran's uranium enrichment programme. However, also solidarity with Hamas and the personality of Nasrallah may have played a role. The War of Summer 2006 made it clear once more that the Israeli-Palestinian conflict maybe exploited by forces not directly involved, like Iran. The strong presence of European soldiers in the new peace force presents an opportunity for the EU to take the initiative for a restart of the peace process in the region. A new Madrid type conference may offer away out of the deadlock.

Özellikle ABD 1940'lı yıllardan beri bu silahlarlailgili her çalışmayı gizliyor, gizliliği kanunlarla koruyarak erişimi engelliyor. Yine de bu silahlarsavaşın, çatışmanın, kargaşanın vahşi ve de acımasız yüzleri için bir umuttur. En kapsamlı kullanımları1995 yılında Somali'de gerçekleşti. Avrupa Birliği, barışı korumak, ekonomik ve sosyal ilerlemeyi pekiştirmek amacıyla bir araya gelmiş 25 üye ülkeden oluşmaktadır. Avrupa Birliği ekonomik, sosyal ve siyasi birlik olmak ve bu durumu sürdürmek için çalışmaktadır. Ekonomik, sosyal ve siyasi Birlik olmak düşüncesi beraberinde üye ülkeler arasında yoğun analizleri gündeme getirmiştir. . Bu analizler Avrupa Birliği'nde üye ülkeler ve ülkeler içindeki bölgeler arasında, ciddi bölgesel farklılıkların olduğu sonucunu ortaya çıkarmıştır. Bunun üzerine Avrupa Birliği, üye ülkeler ve üye ülkeler içindeki bölgeler arasındaki farklılıkları gidermek için bölgesel politikalar oluşturmuştur. Bölgesel politikalar Avrupa Birliği bütçesi tarafından finanse edilmektedir. European Union consists of 25 countries which come together with the goal of protecting peace, and reinforcing the economoic and social developments. European Union attempts and to be a social and a political union and tries to maintain this situation.The thought of being an economic, social and political union brings with itself intense analysis among the member countries. These analysis showed that there are important regional differences both among the member countries and among the regions in a member country. With that European Union created regional policies to eliminate these differences. Regional policies are financed by the European Union Budget. Structural Funds are the main tools to establish these regional policies. Structural Funds become more important every other day and they are constantly revised. These structural funds utilize 6 different funds. These are the European Regional Development Fund, the European Social Fund, the European Agricultural Guidance and Guarantee Fund, the Financial Instrument for Fisheries Guidance, the Cohesion Fund and the Community Initiatives.The least developed member countries benefit the most from the sources of structural funds. Turkey gained the right of being a candidate country of European Union after the Helsinki Summit. When we observe Turkey in terms of regional policies, the situation is not quite different. There are deep levels of instability among regions in Turkey.In the event that Turkey becomes a member country to the European Union, it is clear that Turkey will benefit extensively from the Structural Funds.
ÖZETÜÇÜNCÜ ORDU KOMUTANLIĞININ BÖLGE KALKINMASINA ETKİLERİSosyal ve ekonomik kalkınma faaliyetleri,Türk Silahlı Kuvvetlerinin görevlerini başarmada büyük fayda sağlamaktadır. Çünkü, bir ülkenin ekonomik ve sosyal kaynakları o ülkenin askeri güç kaynaklarını oluşturur. Bu yüzden gelecekteki savaşlar ancak milli ekonomilerin destekleyebilmesi ile kazanılabilecektir.Türkiye gibi gelişmekte olan bir ülkenin ekonomik ve sosyal kalkınma gayretlerinin aleyhine olarak, büyük ölçüde askeri masraflara girişmesi de uygun değildir. Bu sebeple Silahlı Kuvvetler, hem kalkınma faaliyetlerini desteklemek ve hem de kendi harekatı için gerekli tesisleri biran evvel kurmak maksadıyla,bu çalışmaya kendi yönünden aktif olarak katılmak durumundadır. Otherwise most part of the unfinished business, with the declaration of mobilization, will appear the real duty of the Armed Forces and they will catch unprepared.It is known that East Anatolia region which is in the responsibility zone of 3rd Army is not enough developed compared to other regions of the country from the point of progress and peace due to geographical, social, cultural construction of it.The 3rd Army has been a close follower of the progress in military, economical, and also issues about social ease. By encouraging other organs of the government, bring together the citizens and the government, in accordance with this strengthen the national unity and cooperation. This has always been one of the main functions of the 3rd Army Commandship Headquarters. In this context 3rd Army Commandship, besides the activities on security in the region, has found out that the basis of the existing problems is education so they also consider education important.
Su canlıların yaşamı için vazgeçilmez bir doğal kaynaktır, fakatdünyadaki kaynakların sadece %3'ü kullanılabilir niteliktedir. Bu miktardagezegene eşit olarak dağılmamıştır. Ortadoğu gibi su kaynaklarının yetersizolduğu bölgeler ciddi problemlerle karşıkarşıyadırlar. Bölgedeki sukaynakları iklim koşullarındaki değişiklikler, yanlış kullanımlar, endüstriyelgelişmeler, aşırı ve yanlış sulama teknikleri nedeniyle giderek azalmaktainsan yaşamını tehdit eder noktaya gelmektedir. Bu su savaşlarısöylemlerinin çıkmasın ayol açarken, Ürdün, Litani, Nil Nehirleri'nden farklıolarak Fırat ve Dicle havzalarına ilişkin bu tür söylemler gerçekçigörünmemektedir.Suriye ve Irak, Türkiye'nin su zengini olduğunu GAP projesiyleonların haklarını gasp ettiğini iddia etmektedirler. Bölge dışıgüçler sorunu kullanarak bölgeyi kendi içinde parçalayarak güçlenmesiniönlerken,Suriye ve Irak da Türkiye'nin lider olmasını engellemeyiamaçlamaktadırlar.Sorun güney komşularımız ve İsrail ilişkilerimizi olumsuzetkilemektedir. Özellikle 1990'larda İsrail'le gelişen ilişkilerimiz sorurununkarmaşıklaşmasına yol açmaktadır. İsrail ve güney komşularımızlailişkilerimizde amaçlanan denge politikası gerçekleştirilememekte bu dakayıplara sebep olmaktadır. Aslında iyi olmayan ilişkiler su sorununualevlendirmekte bu da tüm tarafların aleyhine olmaktadır. ; Water is an inevitable naturel source for living. Hovewer only 3% ofthis source is being used. The amount used is not equally distributed for eachpart of earth. The regions suffering water scarcity, like Middle East , arefacing with serious problems. Water sources are declining and threateninghuman life due to some reasens, such as change in climate , erronaous usage ,industrial developments ,widely application and wrong irrigation techniques.These result in rumour of water wars. The rumours don't seem realistic withEupharetes and Tigris basins , whereas it is the case for Jorden , Nile andLitani Rivers. Syria and Irag claim that Turkey is rich in water sources andseizing their water usagerights by the (GAP) Project.Eventhough the water problem seems to be a couse of war , it mightturn into a consensus that could bring peace to the region . The refusel of theprojects offered by Turkey for economic , actually for political reasens resultin contiunity of the problem. Turkey's southearn neighbouurs, actingaccording to the demands of non-regional actors , want to guarantee usage ofthe water sources in future and bring the problem into light as an artificialproblem that could be used as a political tool.Although non-retional actors employ the problem as a political tool,to make instable the region, to direct the region according to their demandsand to maintain their economic interests, Turkey's southern neighbours tryto keep the artificial problem alive for both economic and political reasens.As non-regional powers are preventing the region to become stronger byusing the problem to break the region into small communities , Syria andIraq are trying to prevent turkey to become a regionel leading position. Theproblem has negative affect on Turkey's relations with southearn neigboursand Israel.Turkey-Israel relations , improved during 90's, caused problem tobecome more complex. The aimed balanced politics between Turkey and it's southern neighbours and Israel could not been realised causing major losses.The relations that is not evaluated as good neighbourship inflamate theproblem and influnce negatively all sides.
ABSTRACTFORCE PROJECTION IN INTERNATIONAL LAW AND SOVEREIGNTY BY MEANS OF UNITED NATIONS PEACE SUPPORT OPERATIONSIn the threshold of a new era, starting from early 1900's all nations began to appear dependent on each other in an ever-accelerating global world where the concept of classical total sovereignty transitions itself into a new understanding discribed as partial soverignty, especially by financial means.Threats, today are described mainly at economical level but yet not succesfully resolved without use of force projection. After devastating centuries of wars and conflict all around the globe, nations found themselves in a common urge to unite under the flag of International Organizations in the hope of ensuring a safe platform to negotiate over conflicting subjects and find solutions at political level , thus, preventing the painfull history repeat it self again. " United Nations" (U.N.) is inarguably the most widespread of all international organizations with the participation of almost evey country as amember.This dissertation aims to examine how U.N. finds legal grounds to interfere with governmental issues and under what circumstances U.N. resolutions affect national sovvereignty. Althought the unity is suppossed to be founded upon existence of equal members, U.N. unfortunately has acted more like an oligarchical club so far.This situation brings a lot of criticism especially about the special rights and authority of five permanant members of the Security Concil. It is a fact that thronghout decades, many conflicts have arisen in deffrent parts of the global map just because these privileged members used their authority in favour of their foreign policies. It is also this fact why U.N. today can be described anything but thrustworthy, apart from the motives of its foundation. Küreselleşme ile şekillenen yeni dünya düzeninde artık tüm devletler birbirlerine muhtaç duruma gelmişlerdir. Yeni dünya düzeninde tehditler daha çok ekonomik düzeydedir. Ancak devletlerin birbirlerine karşı kuvvet kullanmaları engellenememiştir. Muhtemelen bundan sonrada engellenemeyecektir. Dünyanın artık tek isteği barış ve huzur içinde yaşamaktır. Devletler barış ve huzur içinde yaşamak ve geçmişte yaşanan acıların tekrarını önlemek maksadıyla uluslararası örgütler kurma yoluna gitmişlerdir. Yüzyılımızın bu anlamda en etkin örgütü olarak Birleşmiş Milletler kurulmuştur. Bu gün hemen hemen bütün devletler bu örgüte üye durumundadır.Bu çalışmamızda Birleşmiş Milletler Örgütünün devletin egemenliğine hangi nedenlerle müdahale edebildiği anlatılmıştır. Günümüzde özellikle Birleşmiş Milletler Örgütü devletin egemenliğine İnsani amaçlarla müdahale etmektedir. Kendisine ait bir askeri gücü olmayıp, üye devletlerin gönüllü yardımlarıyla oluşturulan Birleşmiş Milletler maalesef büyük devletlerin güdümü altındadır. Haklı olarak bugünkü yapısı eleştirilmektedir. Bu eleştirilerin büyük bir bölümü Güvenlik Konseyinin beş daimi üyesinin statüsü ve bunların veto yetkileri ile ilgilidir. Bu devletler veto yetkilerini hep kendi ülkelerinin dış politikaları yönümde kullanmışlardır. Bu yönden de dünyanın birçok yerinde çatışmalar devam etmektedir. Bu durum Birleşmiş Milletlerin güvenirliğini zayıflatmıştır. Birleşmiş Milletler Örgütünü, devletlerin gerçek anlamda eşit olarak söz sahibi olduğu yapıya kavuşturmak zorunlu bir hal almıştır. Ancak bu durumda Birleşmiş Milletler güvenilir bir örgüt olabilir.
Batı Trakya Yunanistan'ın Kuzey Doğusunda bulunmaktadır. Evros (Meriç) ile Nestos (Karasu) nehirleri arasında kalan 8578 kilometre karelik bir alanı kapsamaktadır. Lozan Barış Konferansında Türkiye ile Yunanistan arasında varılan bir antlaşma gereği iki ülke arasında zorunlu ahali mübadelesi yapılmıştır.Ancak İstanbul'un Rum nüfusu ile Batı Trakya'nın Türk nüfusu zorunlu mübadelenin dışında tutulmuş ve bulundukları ülkedeki devletin güvencesi altında dinsel azınlık konumunda bırakılmıştır. Söz konusu azınlıkların azınlık ve yurttaşlık hakları tanınmıştır.Bununla beraber Yunanistan kendi vatandaşı olan bu insanları hiçbir gerekçeye dayanmaksızın ulusal bütünlüğü tehdit olarak görmekte ve bu insanlara karşı uluslararası ve ikili antlaşmalarla belirlenen sorumluluğu yerine getirmediği gibi azınlık üzerinde baskı ve asimilasyon politikasını devlet denetiminde planlı,kararlı ve sürekli bir şekilde uygulamaktadır. Avrupa Birliği'nin temel dayanağına baktığımızda;hukukun üstünlüğü,insan hakları,demokrasi kavramını görmekteyiz.Yunanistan 1981 yılında Avrupa Birliği'ne tam üye olmuştur. 1990'ların ikinci yarısına kadar Batı Trakya Türk azınlığının durumunda herhangi bir değişiklik görülmemekte,1990'ların sonunda azınlık haklarında kısmen iyileştirmeler yapılmıştır. Ancak hassas ve hayati konularda herhangi bir değişikliğe rastlamak mümkün değildir. Avrupa Birliği azınlık hakları konusunda Yunanistan'ı bir çok defa uyarmış ve kınama kararları vermiştir.Ancak sorunların giderilebilmesi için Avrupa Birliği'nin daha etkİli yaptırımlar uygulaması gerekmektedir.Yunanistan kendi vatandaşı olan Batı Trakya Türkleri'nin ikili antlaşmalardan doğan haklarını iade etmeli ve kendi taraf olduğu uluslararası antlaşmaların gereklerini yerine getirmelidir. Ancak bu sayede Batı Trakya Türkleri'nin sorunlarının çözümü mümkün görünmektedir. ; West Thrace is located in the northeast of Greece,moreover,it comprises 8578 square kilometre open space between the rivers Evros (Meriç) and Nestos (Karasu).As a result of Lozan Peace Pact an obligatory exchange agreement had done betweenthe two countries,Turkey and Greece.However, Istanbul's Greek population and WestThrace's Turk population had been kept out of this obligatory exchange,furthermore,Turk's and Greek's in the country where they existed they left in the position of religion minorityunder the name of government assurance.Also,to the minorities above mentioned had givencitizenship and minority rights.Neverthless,Greece sees Turks,who they are his own citizens,as a threat to thenational integrity without based on at any justification,what is more,not only doesGreececarry out the responsibility which was mentioned by the bilateral agreements,but alsocarries out a permanent,determinend,designed policy plan under the governments control overto the minorities,for to assimilate and press them.When we look for the basic mainstay of European Community we are confrontedwith the concepts the superiority of laws and the democracy of human rights. Greecebecame an entire member to European Community in 1981.We hadn't seen any changes at thesituation of West Thrace Turk's minority until 1990's second half but in the and of 90's Greece had partially done improvements.In spite of this,it is not possible to come across toany changes in vital and sensible matters.European Community has warned Greece manytimes for the minority rights,moreover,Greece has been given many disapproval resolutions.However European Community have to apply more effective sanctions to remove theproblems.Greece should return the rights of the people who are his own citizens West ThraceTurks had arisened from the bilateral agreements,moreover,Greece should carry out thenecessities of the international agreements that are from his own side.As a result of this, WestThrace Turks problems solution is seen possible.
Su yasantımızda alternatifi olmayan ender kaynaklardan birisidir. Bunun anlamı su bittiğinde hayat bitecektir. Son zamanlarda etkisini daha çok hissettiren su sıkıntısı çoğu ülke gibi Türkiye'yi de yakından ilgilendirmektedir. Son yıllarda ekonomik ve sosyal gelismesini belirli bir düzeye getirmek için sınır asan sularından faydalanma yönünde yoğun bir çaba içine giren Türkiye bir çok projeyi uygulama alanına koymustur. Bu projeler, komsu devletler ile bir takım uyusmazlıkların doğmasına neden olmus, bunların bir kısmı anlasmalarla çözüme kavusturulurken, önemli bir kısmına çözüm getirilememistir. Öte yandan Türkiye'nin de yer aldığı Orta Doğu coğrafyasında su kaynaklarını elinde bulunduran ülkelerle su kaynakları kıt olan ülkeler arasında sürekli sürtüsmeler meydana gelmekte, konu ile ilgili uluslar arası hukuk kurallarının olmayısı da sorunların çözümünü daha da zorlastırmaktadır. Su sorununun uluslar arası bir mahiyet alması, ülkeleri bu sorunun çözümü için ortak kavram ve hukuk anlayısı arama çabalarına itmistir. Özellikle sınır asan sularla ilgili olarak ortaya çıkan sorunların çözümüne katkı sağlayacak ve tüm ülkeler tarafından da kabul görecek bir hukuk sisteminin olusturulması için değisik platformlarda çalısmalar baslatılmıstır. Ancak, yaklasık 40 yıl önce baslatılmıs olan bu çalısmalardan günümüze kadar belirgin bir sonuca ulasılamamıstır. Türkiye, 1986 yılında, iyi niyetle, Orta Doğu'daki su sorununa çözüm bulmak ve susuzluk çeken ülkelerin ihtiyacını karsılamaya yönelik olarak Barıs Suyu Projesi'ni ortaya atmıstır. Türkiye bu proje ile ekonomik getirinin yanında bölge ülkeleri arasında isbirliği ve güven ortamı yaratarak, bölgenin istikrar ve güvenliğine katkı sağlamayı amaçlamıstır. Özetle; günümüzde suya olan talep küresel iklim değisikliklerinin de etkisiyle birlikte tüm Dünya'da ve Orta Doğu'da artmaktadır. Dünya nüfusunun artması ve kaynakların bilinçsizce kullanılması da suyu daha önemli hale getirmektedir. Türkiye bulunduğu topraklar itibari ile çok önemli bir bölgededir. Türkiye'nin su konusunda izleyeceği politika ve atacağı adımlar, yakın gelecekte Türkiye'nin Orta Doğu'daki konumunu daha belirgin hale getirecektir. ; Water is one of the unique sources which have no other alternatives in our lives. That is to say, life will end when the water ends. Poverty of water which makes its effect felt much more recently concerns Turkey closely, as well as most of the countries. Turkey, who gets into an intensive struggle in the direction of taking advantage of her transboundary waters in order to bring her social and economic developments to a specific level, in recent years, puts lots of projects into practice. These projects cause some disagreements to arise with the neighbouring states, an important part of disagreements is not solved while some of them reach solutions with treaties. On the other hand, there appear continuous disputes between the countries having the rich water resources and the countries deprived of these resources, in Middle East geography in which Turkey has also a place; in addition, non-existence of international laws about the matter makes it difficult to solve the problems. Water problem?s getting an international quality leads the countries to struggle for search of a common concept and understanding of law in order to solve this problem. Studies has been started in different fields of the world so that a law system, which is to contribute to the solution of the problems especially appeared related to transboundary waters and to be admitted by all the countries could be formed. However, these studies having been started 40 years ago has unfortunately no certain outcome till today. Turkey puts forward Water of Peace Project with good intention to find a solution for water problem in Middle East and meet the need of the countries suffering aridity.In 1986 Turkey aims at providing contribution to security and stability of the region by creating an atmosphere of cooperation and trust between the countries in this region, along with economic benefits with this project. To sum up; today, demand for water increases with the global warming all around the world and Middle East. In addition, increase in world population and unconscious use of the resources make the water important. Turkey is a very significant region regarding the soil she stands. Turkey?s policy to follow and steps to take about the matter of water will make Turkey?s position in Middle East more evident
