En este artículo, nos proponemos reflexionar acerca del modo en que se presentan las discusiones y las intervenciones en torno al problema de la "inseguridad" en Argentina y, a partir de allí repensar la pertinencia de la noción de "populismo penal". ; In this paper, we propose to reflect on how are presented the discussions and interventions on the problem of "insecurity" in Argentina and, from there, to rethink the relevance of the concept of "penal populism".

All penal institutions in the US have recreation programs, though they vary in extent because of limitations of space & facilities. Prison admin'tors recognize that well-directed recreation is vital to an adequate program for effecting the rehabilitation of the inmate. Progress toward securing sufficiently extensive recreation lags because of inadequate financing & is hindered because the public is apathetic to institutional needs in this respect. AAAPSS.

Following the USA, in many Western countries over the last decade, prisons rates have increased while crime rates have been declined. This key book examines the role played by penal populism on this and other trends in contemporary penal policy.
This article examines aspects of penal reform within our present criminal justice system. The author advocates application of a systems analysis approach to penal problems in order to provide predictive knowledge concerning effects that arise when changes or reforms are made within the penal system. He also suggests certain practical improvements that can be made in the present system and proposes that an agency be established by the Florida legislature to study the criminal justice system.

El artículo 34 inciso 1° del Código Penal Argentino contempla distintos supuestos en los cuales el hecho cometido por el agente no será punible. Uno de ellos es la inimputabilidad, entendida como la incapacidad de culpabilidad en sentido estricto. Este trabajo analiza brevemente los antecedentes legislativos relacionados al tema, el Derecho comparado, el concepto de imputabilidad y su evolución, los métodos para evaluar la imputabilidad, sus presupuestos biológicos (madurez mental, salud mental, conciencia), los efectos psicológico-valorativo-normativo (imposibilidad de comprender la criminalidad del acto, imposibilidad de dirigir las acciones), la llamada actio libera in causa, la capacidad de culpabilidad disminuida, los efectos de la inimputabilidad y, por último, cita jurisprudencia ilustrativa de la materia.AbstractThe article 34.1 of the Argentine Penal Code contemplates different suppositions in which the act committed by the agent will not be punishable. One of them is the unimputability understood as the disability of guilt in strict sense. This work analyzes brief the legislative precedents related to the topic, the compared Law, the concept of imputability and his evolution, the methods to evaluate the imputability, his biological budgets (mental maturity, mental health, conscience), the psychological-appraisive-normative effects (inability to understand the criminality of the act, inability to direct the actions), the call actio libera in causa, the capacity of diminished guilt, the effects of the unimputability and, finally, mentions illustrative jurisprudence of the matter.Key words: Legislative precedents; Compared Law; Concept and evolution; Budgets; Actio libera in causa; Capacity of diminished guilt; Effects; Jurisprudence

Aborda a tipificação penal da violência praticada contra o professor da educação básica atuante na rede pública de ensino, no exercício da função ou em razão dela. Através de pesquisa bibliográfica de natureza documental, aplicada e estratégica, fundamentada no conhecimento real do objeto analisado, evidencia o atual panorama de atuação profissional e os danos à higidez laboral do professor, em decorrência da violência sofrida, ressaltando as consequências à sua saúde mental. Analisa os projetos de lei em tramitação no Congresso Nacional, com vistas ao problema deste estudo. Finalmente, apresenta as considerações finais desta pesquisa, confrontando os objetivos propostos ao universo real de sua temática, enfatizando a necessidade de se tipificar penalmente a violência praticada contra o professor da educação básica.
