For a long time, the Arctic has been regarded as a stable region with low tension. However, even though low tension prevails, it is a fact that the circumpolar region also encompasses some of the world's most capable and potent military capabilities. The key role of the Arctic regarding security issues, international relations and geopolitics, is sometimes underplayed or not fully understood. These aspects of security are investigated in this thematic issue of Arctic Review on Law and Politics.
The Arctic region has been the focus of considerable attention in recent years, often concerned with maritime claims and an alleged race for the region's resources. Against this narrative, the article focuses on the practices of Canada and the Russian Federation with respect to their maritime jurisdictional claims and the delimitation of maritime boundaries with their Arctic neighbours. The article provides an overview of the Arctic region and the international law of the sea with an emphasis on the baselines and maritime claims of the Arctic coastal states. Discussion then turns to the maritime boundary agreements that have been concluded in the Arctic region before overlapping claims to areas of continental shelf underlying the central part of the Arctic Ocean are appraised. The article concludes that Canada and the Russian Federation have enjoyed considerable success in resolving overlapping maritime claims and their pragmatic and innovative approaches coupled with existing regional cooperation bode well for finding peaceful solutions to Arctic Ocean governance challenges in the future.
The global human influence on the climate is growing at an alarming pace. This trend appears doomed to continue. Polar regions are feeling the effects first. This means that if the impacts of climate change serve to motivate effective policies, polar regions could be a good place to look for climate policy innovation. It is within this context that this article considers Arctic climate policy in Russia and Canada. The basic question posed is whether the unique and immediate threat climate change presents in the Arctic is reflected in progressive laws and policies with respect to four key areas: mitigation, adaptation, impacts and vulnerability, and development.
The Arctic region has attracted the interest of Arctic and non-Arctic states, as well as non-state actors, for decades. Corresponding with the growing attraction towards the region, the number of conferences attending to Arctic issues has expanded. This article provides an historical mapping of the Arctic conference sphere, and demonstrates how the establishment of Arctic conferences has both paralleled central events in Arctic affairs and can be linked to important international developments. Firstly, there is a notable peak conforming with the "second state change" in 2005, brought about by developments opening the Arctic to global concerns: the impacts of climate change and the spread of the socio-economic effects from globalization to the Arctic. Secondly, the expanding number of conferences around 2013 can be seen in relation to the growing interest in the region from non-Arctic states. As such, this article builds the argument for conferences as a central element within the Arctic governance architecture, creating linkages among units in the regime complex. The article devotes particular attention towards the two largest international conferences on Arctic issues – Arctic Frontiers and Arctic Circle Assembly – to illustrate how the necessity for hybrid policy-science-business conferences arose from a more complex governance system, and challenges requiring cross-sectoral, interdisciplinary, and international collaboration.
In western China's Xinjiang Uighur Autonomous Region, development is characterized by a difficult political & social situation. Huge state investments, as well as the development of large oil & cotton industries, have led to economic growth & a standard of living that ranks among the highest of China's western provinces & regions. Despite this, groups among the region's inhabitants show great discontent with the Chinese administration. Separatism, terrorism, human rights violation & ruthless exploitation of the region's resources are equally important parts of Xinjiang's recent history as economic development & the improved standard of living. In the midst of this situation Xinjiang's Bingtuan, a group of state-run, formerly military, farming units, plays an important role as a regional development agent & as a Chinese controlling body. 1970s military dictatorship in Latin America was followed by a democratization process in the 1980s, at a point when military powers had devastated the economy & more than doubled foreign debt. Now, in the beginning of the twenty-first century, the region finds itself in a period marked by governments that, perhaps more than ever before, are characterized by their reaction to the neo-liberal policies of the 1990s. Of particular concern in this respect is the changing relationship between the region & the United States, which in turn opens opportunity for the involvement of other international actors in the sphere. This brings about a high degree of uncertainty both for Latin America itself as well as for the international community. As the Earth's changing climate has deepened into a climate crisis, the Arctic region has emerged as one of the clearest indicators of the scale and pace of that change. As the ice melts, opportunities are expanding to exploit the Arctic's oil and gas reserves, precious metals, fish stocks and maritime routes. Increased access and development will inevitably generate "system-wide environmental impacts" and will pose novel management challenges for the Arctic states. In the quest to find an effective balance between competing ocean activities and actors, marine protected areas (MPAs) and other effective area-based conservation measures (OECMs) have emerged as indispensable tools to achieve ocean health, including in the Arctic. After first introducing these concepts, this article will discuss the Canadian and Russian domestic regimes for the establishment of MPAs and OECMs. The conclusion will then offer some insights into the key challenges confronting both states in the creation of effective networks of MPAs and OECMs in their Arctic regions.
The following article revisits existing scholarship on human-centric approaches to security in cyberspace and argues that a holistic understanding of cyber security in the Arctic must include discussion of the use of cyber technology in the everyday lives of individuals and communities, addressing both the ways such tools enable and undermine human security. Simultaneously, the article contextualises the Arctic as a region undergoing rapid change as a result of climate change and increased digitalisation and seeks to understand the consequent implications for human security. In light of these considerations, the article analyses the existing constraints and possibilities that cyber security and digitalisation pose for human security and revisits them from a humancentric perspective of cyber security. It also seeks to contextualise such security influences in relation to the role of climate change and its influence on the region. Finally, several examples are discussed to underline the interdependent implications of digitalisation and climate change from a human-centric perspective of cyber security in the Arctic.
New uncertainties in international relations have presented several states in the West with important choices regarding their national strategies for the Arctic. This article analyzes security challenges in the Arctic and North Atlantic region, as understood by some key North-Atlantic states, namely: the USA, Canada, Denmark, Norway, the UK, Germany and France. By analyzing how, or to what degree, the colder east-west security landscape since 2014 is reflected in these selected North Atlantic states' Arctic security strategies, this article seeks to improve our understanding of how the security situation in the northernmost part of the world is developing and being understood. Through applying a traditional understanding of security, the article identifies similarities but also significant differences among the Arctic and North-Atlantic states. Most notable when comparing the strategies is the rather unique global perspective laid out in the US security strategy for the region. The British, Norwegian, Danish and Canadian perspectives, on the other hand, stand out as more regional in nature. Germany displays a rather low profile in its approach to international security in the Arctic, considering its economic status in Europe. France reveals a strong concern for Arctic shipping and freedom of navigation, a perspective similar to the USA's, but with less global ambition.
The Arctic is one of the largest regions on the globe, and is regarded as a vast storehouse of potential resources, including minerals. Both mining and tourism are rapidly growing economic sectors in the region. While the variety of tourism activities supported and offered is extensive, all of these activities are essentially forms of nature-based tourism.
Land-use conflicts between mining and tourism are likely to emerge when a new mine is opened close to a tourist area, because mining activities may dramatically change the landscape, which is essential for tourism. The impact greatly depends on the location of mining facilities, the physical size of the mining project, the mining processes used, logistics and how well the image of the mine and its end product fits in with the image of the tourist destination. While tourism and the mining industry may benefit from each other, the relationship between a mine and tourism is often asymmetrically counterproductive; where such a relationship exists, a need for regulation arises.
In this article, we assess the legal means available for resolving conflicts between the mining and tourism industries and discuss possibilities to improve these means. The two key regulatory instruments for governing such conflicts are land-use planning and mining permit processes. We illustrate the nature of conflicts and various decision-making procedures with reference to the Finnish legal framework and a case study on an ongoing mining project in the town of Kolari.
