International audience ; In this study the author analyzes the relationship between the individual body and the body politic in a region of the north Indian state of Uttarakhand, in connection with social changes occurring at the local and trans-local level, which are impacting the status of the different healing systems. By investigating these issues, this paper aims to shed light on some of the complex ways in which practitioners and patients who take part in a local method of healing, in this case ritual healing through possession, respond to the expansion of biomedicine.The first part of the study analyzes the local landscape of medical pluralism, with particular attention to the local ritual system, which has been for a long time the dominant healing technique and which serves as a political regime for the control of bodies. The second part sets out the therapeutic itineraries and experiences of the actors engaged in these journeys. Finally, attention turns to the way in which changes that have occurred in the wider society as well as in the local landscape of medical pluralism are conceptualized by individuals through discourse about the body that reveals a perception of physical enfeeblement. ; Les pages de cet article ont pour objectif d'analyser les discours tenus par les acteurs locaux dans la haute vallée du fleuve Baghirati, en Uttarakhand, à propos de la diffusion de la biomédecine dans la région et de ses effets sur l'efficacité des rituels de possession, sur le pouvoir des divinités locales ainsi que sur les corps des personnes. The revolutionaries of the period spanning 1789 – 1799 abolished the corps intermédiaires between the State and the People. According to the Declaration of the Rights of Man, no organisation or individual must step between the power and the plebeians. Thus, the Le Chapelier laws (among others) abolished the guilds, and successive governments attempted to eradicate the opposing forces of the regions and local « feudalisms ». However, when Napoleon Bonaparte took charge of the ship of State in November 1799, the country was in search of new references. The chief of the new government installed in February 1800 aimed to lay « masses of granite », that is to say stable institutions, on the soil of France.The creation of the Bank of France, of the Prefects, of the Lycées, Baccalaureate and Legion of Honour are well-known examples among many others. But the subject of this thesis is less famous, except perhaps for students and teachers of law. For in the heart of the new Civil Code of the French, there is the « spirit of fraternity » expressed in the Declaration of the Rights of Man and of the Citizen, and in the Constitution of the 5th of Fructidor. The Catholic Church no longer being – since the Concordat – the official State religion, but the religion of the majority of Frenchmen, the State replaced the duty of charity with civil fraternity. The First Consul (who was soon to be Emperor) added a clause to the Civil Code stipulating that parents must provide for their children, even as adults, if the latter are unable to do so (and vice versa).Throughout the era of the Consulate and First Empire, this thesis aims to show the development of structures of social solidarity, particularly via legislation, but also in relation to the institutions and policies of the State during this period. We will study (among others) the Civil Code in its context, the Maisons d'Education de la Légion d'Honneur, legislation on labour (particularly in relation to child labour), mutual aid societies (predecessors of the mutual insurance companies and trades unions of our times) and the welfare administrations. We will also cast an eye, in conclusion, over the unfinished projects developed under later regimes. In order to better situate this era in its context in relation to the 21st Century.The period of the Consulate and Empire was a great period for the creation of retirement pension funds, and the Emperor Napoleon even set down the principles which were to regulate this « right » that he wanted to extend to all trades. Die öffentliche und bildungspolitische Diskussion um Werteerziehung und Verantwortungslernen in Schule und Unterricht hat in den vergangenen Jahren wieder verstärkt Aufmerksamkeit erfahren. In welcher Weise allerdings Lehrerinnen und Lehrer ein (berufsspezifisches) Ethos aufweisen, wurde bislang überwiegend im wissenschaftlichen Diskurs zum Gegenstand. Dieser Band versammelt solche unterschiedlichen disziplinären Perspektiven und zeigt so ein breites Spektrum an Zugängen zum Berufsethos von Lehrpersonen auf. Diesen mehrperspektivischen und im Ergebnis offenen interdisziplinären Diskurs zum komplexen Gegenstand des Ethos von Lehrerinnen und Lehrern hat Martin Drahmann im Rahmen seiner begonnenen Habilitation "am runden Tisch" initiiert. Die Autorinnen und Autoren dieses Bandes würdigen ihn im Anschluss an seinen viel zu frühen Tod mit den hier versammelten Beiträgen.

Die Bewältigung religiös-konfessioneller Differenz gehört zu den großen gesellschaftlichen und politischen Herausforderungen der europäischen Neuzeit. Angesichts der sich zuspitzenden religiös-konfessionellen Spannungen, die häufig Anlass zu gewaltsamen Konflikten gaben, bedurfte es politisch abgesicherter Verfahren der Konfliktlösung und der Differenzbewältigung. Bei näherem Hinsehen erweisen sich solche Verfahren als ebenso vielfältig wie die religiöse Landschaft Europas selbst. Neben der Befriedung der Konflikte durch Wiederherstellung der religiösen Einheit innerhalb eines Territoriums, was zumeist Repression und Vertreibung als gewaltsame Formen der Konfliktbewältigung einschloss, lassen sich Strategien erkennen, die eine weitgehend friedliche Koexistenz der unterschiedlichen religiös-konfessionellen Gruppen gewährleisteten. Dies konnte durch obrigkeitliche Duldung qua "Toleranzedikt" geschehen, aber auch durch Frieden, der zwischen gleichberechtigten Vertragsparteien geschlossen wurde. Auf dieser Grundlage konnten sich formelle Verfahren entwickeln, die politische Gleichberechtigung und Parität garantierten. Nicht weniger charakteristisch für die Bewältigung religiös-konfessioneller Differenz im neuzeitlichen Europa waren aber auch Verfahren, die informeller Natur waren und deren friedensstiftendes Potential gerade darin bestand, dass sie die bestehenden Differenzen verwischten und so Raum für Ambiguität ließen. Der Band, der auch Einsichten für die Gegenwart eröffnet, nimmt diese Phänomene in breiter europäischer Perspektive in den Blick.
Den Spuren deutschsprachiger Juden nachzugehen, bedeutet in mehr als 60 Ländern die Suche aufzunehmen. Ihr Einfluss wirkt in vielen Heimat- und Exilländern fort, ohne dass dies im kollektiven Bewusstsein angemessen repräsentiert wäre. Die 41 Beiträge zu den übergreifenden Themen Identität, Literatur, das 'Jüdische' und das 'Deutsche', Ursprungs-, Transit- und Emigrationsländer, sowie 'Was übrig blieb' laden dazu ein, das deutsch-jüdische Kulturerbe in den vielen Immigrationsländern zu entdecken und den Verlust zu begreifen, der mit der Emigration des deutsch-jüdischen Bürgertums einher ging. Im umfangreichen Anhang werden Archive, Bibliotheken, Forschungszentren, Gemeinden, Museen, Universitäten und Vereine in aller Welt aufgeführt und beschrieben, die zur deutsch-jüdischen Thematik arbeiten oder wichtige Sammlungen beherbergen. In this book I investigate the necessary structure of the aether – the stuff that fills the whole universe. Some of my conclusions are. 1. There is an enormous variety of structures that the aether might, for all we know, have. 2. Probably the aether is point-free. 3. In that case, it should be distinguished from Space-time, which is either a fiction or a construct. 4. Even if the aether has points, we should reject the orthodoxy that all regions are grounded in points by summation. 5. If the aether is point-free but not continuous, its most likely structure has extended atoms that are not simples. 6. Space-time is symmetric if and only if the aether is continuous. 7. If the aether is continuous, we should reject the standard interpretation of General Relativity, in which geometry determines gravity. 8. Contemporary physics undermines an objection to discrete aether based on scale invariance, but does not offer much positive support.
Das Recht einer Gesellschaft reflektiert und konditioniert ihren dialektischen Selbstwiderspruch in der Gestalt der in ihr vorhandenen Macht/Ohnmacht-Verhältnisse. Da Macht nicht nur Recht, sondern auch Unrecht macht, vermag das Recht die inner- und zwischenstaatlichen Antagonismen höchstens zu domestizieren. Es stabilisiert die in einer herrschaftsförmig organisierten Gesellschaft vorhandenen strukturellen Gewalten. Die Ungleichheit unter dem Gesetz wird, wenn die Gleichheit vor dem Gesetz sie ignoriert, bestandgeschützt. Mit dem Recht wird menschliches Verhalten legalisiert und illegalisiert. Wodurch aber wird das Recht legitimiert und illegitimiert? Auch darauf wird hier eine Antwort versucht. Besonders bedeutsam in Zeiten, da dem Rechtsstaat von einem »Unsozialstaat« und dem Völkerrecht vom Faustrecht Gefahr droht.
