Using the contemporary system theories, the author primarily points to the asymmetry of the constitutional law and the political processes it so rarely regulates. Then he goes on to analyse the historical process of separating the custom law, oral law and written law, of the court and the courtroom, the law and the constitution, the constitution and its interpretation, the constitution's interpretation and the constitutional theory, and concludes his study with a description of the difference between constitution and democracy in the postmodern categorial optics. The author explores the legitimating roots of the constitutional state. In his opinion, they can be found in moral universalism and national democracy. Both principles undoubtedly belong with the fundamental tenets of the constitution of modern constitutional state. While the former implies the universality of its postulates which are accepted by every constitutional state, the latter represents the restrictive principle of this universalness. The author links these two principles and defines a people as a group of individuals who, regardless of their ethnic, cultural, and religious station may, in line with the principles of freedom and equality of individuals create a successful political community. By the universality of its legality, the defence of human rights and power-sharing, constitutional state is a necessary prerequisite for the prospect of fashioning a people as a group of responsible individuals in establishing universal will. The author analyzes two famous critiques of the bourgeois state: Marx's thesis on the withering away of the state as an instrument of force of the economicall dominant bourgeois class which, by means of the quasi-neutral state as the higher third instance controls the the class antagonisms whose disappearance will make the state as an instrument of repression obsolete; and Carl Schmitt's thesis that the state will become unnecessary in the world in which there are no longer any enemies, only offenders who violate humanistic norms and human rights. The study is a contribution to the discussion on the definition of war in modern era and focuses on contemporary debates. By exploring the essence of politics and nation, in line with Carl Schmitt's theory of politics and by taking into consideration the forms of national liberation wars, the author points to the inadequacy of von Clausewitz's instrumental/political definition of war and lists most critical remarks to this theory. The author describes other theories, such as the pure war theory (war separated from politics) and the existential war theory (a political entity is being shaped and coming into being). Then he systematically lays out the modern concept of the nation and the corresponding definition of war. In defining wars, the author relies on the modern philosophy of the subject, particularly by G.W.F. Hegel, and on Scheler's theory of nation and war. Finally, the study shows that international relations are still to a large extent determined by the nationally-based politics, and that contemporary wars include many features of international and national-liberation wars. The author poses the question about the fate of neoconservatism, in the 1980s the official political orientation in the USA. Twenty years later, one can see how anti-communism and anti-modernism, neoconservatism's fundamental ideological premises, have changed the political practice and awareness, both (and equally) in American foreign and national policy. Though conceptually incoherent, neoconservatism has proved to possess exceptional clout. This has led the author to conclude that neoconservatism, despite the claims by neoconservatives themselves that it is dead, still has much leeway, since voters' awareness has been changed: they have got used to the new political context, they vote for well-balanced "mixtures" of rightist and leftist ideologies. In his study, the author analyses two different views of nationalism: Arendt's and Kedourie's. Hannah Arendt focuses on the link between racism, nationalism, and imperialism. According to her, nationalism differs from totalitarianism, which represents a more recent development. Kedourie sets out from Acton's critique of the French revolution and concludes that radical nationalism is a product of Franco-German national tensions. Finally, the author offers both concepts as his contribution to an easier understanding of the antagonisms which brought about the war on the territory of the former Yugoslavia. (SOI : PM: S. 151)

The article is dedicated to Professor Richard Wisser. It is a critical analysis of Husserl's essay "The crisis of European sciences and transcendental phenomenology". The author first outlines Husserl's diagnosis of the crisis of science, philosophy and culture, followed by the elements and the mechanisms of that crisis. The root of the crisis of European science and culture lies in foregoing the genuine productive humanity. The authentic humanity cannot be based nor explained from its objectivizations but solely through the analysis of its productive imagination. The author also deals with the crisis of spiritual sciences, which he claims have brought about the loss of insight into the ultimate purpose of the existence of Europe as a brainchild of the historical humanity.
