Quarterly letter from Espaces Marx Aquitaine (January-March 2010: 41-61). The purpose of this article is to identify how the specificities of the current crisis express the structural contradictions of capitalism. First, we are discussing the hypothesis that the onset of the crisis is paradoxically based on the components of the relatively long growth period between 2002 and 2006, the specificity of which is that it was not based on an increase in general well-being. We present the way in which the explosion of the property bubble in the summer of 2007 turned into a financial crisis and then into a global economic downturn, as an expression of a phenomenon of capital over-accumulation and devaluation and the downward trend in the rate of profit. We then look at the measures taken by the various actors to respond to this crisis. Finally, we question the relevance of the speeches presenting an economic recovery, stressing that the relative stabilisation of economic indicators was first based on public intervention. ; Lettre trimestrielle d'Espaces Marx Aquitaine (janvier-mars 2010 : 41-61). The article proposes a critical reflection on the import of the concept of organisational identity — especially in the form modelled by Hatch and Schultz (2002) — from the field of organisational and management theory, where it is currently a certain success, in the field of sociology of education and schools. In view of the theoretical unfounded status of the establishment as a sociological category, the author considers the relevance of such a transfer. It discusses the socio-political, institutional and organisational conditions necessary for the development of organisational identities in the case of schools. In particular, the discussion shows that current developments in education policies and regulation favour differentiation between schools and thus the production of school identities. ; International audience This article propose a critical discussion on the importation of the organizational identity concept – in particular the Hatch and Schultz (2002) model about the dynamics of organizational identity – from the organization theory and management fields, where this concept currently encounters a certain success, to the sociology of education and schools field. The article, after a review of the structural and communicative criticisms of the concept of idiolect, offers a literativo-interactional analysis of idiolect as a representation of idiolecty (the speaker who is the subject of idiolectal treatment) by an idiolector (the speaker who is the agent of that treatment). These two bodies may be assumed by two different speakers, but they may also concern the same speaker. Idiolect consists of a typical set of language traits and encyclopaedic data about an speaker. In this sense, idiolect, which is deeply dialogical, exists only by and against others. Idiolectal representation may take continuous or discontinuous, singularising or classifying forms, depending on the aims of the idiolector, thus confirming the importance of cognitive, symbolic and interactional dimensions from which the idiolect does not escape, nor the sociolect, moreover, largely subject to similar interactional tensions. ; Idiolect and re-presentation of others' speech in one's own speech After reviewing structuralist and communicative approaches to the notion of idiolect, the article proposes an enunciative-interactional analysis of idiolect as the re-presentation of the idiolected (the speaker who is the subject of idiolectal treatment) by an idiolecter (the speaker agent of this treatment). This round table of 9 June 1992 aimed to take stock of the economic reforms and political repositions in Czechoslovakia since the beginning of the decade. J. Rupnik (CERI/FNSP) raised the question of adapting a Western democratic model in a post-communist context, analysing the shift to pluralism and then political fragmentation in parallel with the transition to a market economy and the economic culture of privatisation. Mr Novák (Charles University) wondered about the role of economic reform in the emergence of political parties with the example of the Civic Forum. Kabele (Charles University) is interested in political actors and in particular the new form of confrontation between right and left in the form of typical ideals (democratic/non-democratic opposition or left/centre/right hierarchy). Bútorová (Komensky University) discussed the June 1992 elections from the point of view of Slovakia, anticipating a major political destabilisation in Slovakia, accompanied by major economic problems and "moral chaos". Artificial Intelligence (AI) has been embraced enthusiastically by Africans as a new resource for African development. AI could improve well-being by enabling innovation in business, education, health, ecology, urban planning, industry, etc. However, the high expectations could be little more than pious wishes. There are still too many open questions regarding the transfer required, and the selection of appropriate technology and its mastery. Given that the 'technology transfer' concept of modernization theories of the 1960s utterly failed because it had not been adapted to local needs, some scholars have called for an endogenous concept of African AI. However, this caused a lot of controversies. Africa became a battlefield of 'digital empires' of global powers due to its virtually non-existent digital infrastructure. Still, African solutions to African problems would be needed. Additionally, the dominant narratives and default settings of AI-related technologies have been denounced as male, gendered, white, heteronormative, powerful, and western. The previous focus on the formal sector is also questionable. Innovators from the informal sector and civil society, embedded in the local sociocultural environment but closely linked to transnational social spaces, often outperform government development efforts. UNESCO also warned that the effective use of AI in Africa requires the appropriate skills, legal framework and infrastructure. As in the past, calls by African politicians for a pooling of resources, a pan-African strategy, were probably in vain. AI may develop fastest in the already established African technology hubs of South Africa, Nigeria and Kenya. But promising AI-focused activities have also been identified in Ethiopia and Uganda. Gender equality, cultural and linguistic diversity, and changes in labour markets would also be required for AI to enhance rather than undermine socioeconomic inclusion. In addition, ethical questions related to a specific African identity have been raised. The extent to which African ideas of humanity and humanitarianism should be taken into account when developing an African AI remains an open question. In short, calling for the rapid deployment of AI in Africa could be a double-edged sword.
National hearing Five judgments delivered by the Commercial Chamber of the Court of Cassation at the beginning of 2018 illustrate the difficulties faced by guarantors seeking the liability of creditor banks for lack of custody. International audience This article focuses on adaptation and revival strategies of an agricultural cooperative (CAPLAME) in West Cameroon following the coffee crisis and their impacts on its performances. The study is based on a survey using questionnaires with 74 producers and 12 employees. Our results show that the strategies set up include: diversification of incomes sources and the signature of conventions' with the government. These strategies are insufficient and inadequate for a revival though they permit a reduction of the cooperative financial deficit. Likewise, they have not improved its social performances and within the coffee sector. CAPLAME has to rethink its identity and activities. She has also to rethink its relationship with members and set up new strategies in order to impulse a positive dynamics at the level of its performances. ; Cet article porte sur les stratégies d'adaptation et de relance de la Coopérative Agricole des Planteurs de la Menoua (CAPLAME) à l'Ouest Cameroun suite à la crise caféière, ainsi que sur l'évolution de ses performances. L'étude repose sur des enquêtes par questionnaires auprès de 74 producteurs et 12 employés. Les résultats montrent que les stratégies développées incluent une diversification des sources de revenus et la signature de conventions de soutien avec l'Etat. Ces stratégies s'avèrent insuffisantes et inadaptées pour une relance quoiqu'ayant permis une réduction du déficit financier de la coopérative. De même, elles n'ont en rien amélioré ni ses performances sociales, ni ses performances au sein de la filière café. La CAPLAME devrait repenser son identité, son projet, et partant son objet et ses activités. Elle doit aussi revoir sa relation avec ses adhérents et mettre en place des stratégies novatrices et ambitieuses afin d'impulser une dynamique d'amélioration significative de ses performances.
The difficulties encountered in the fight against trafficking in human beings mean that it is necessary to question the normative force of the texts that have emerged. Normative force encompasses the value, scope and normative guarantee. The normative value of the texts is real as many of them have a superior authority than national law. The scope is evident in the influence of the texts on each other. On the other hand, the legislative guarantee has limits, at least at national level, resulting in the difficulties faced by individuals in having the rights recognised at international level applied by domestic courts. ; Les difficultés rencontrées dans la lutte contre la traite des êtres humains, difficultés impliquent de s'interroger sur la force normative des textes parus. La force normative recouvre la valeur, la portée et la garantie normative. La valeur normative des textes est réelle puisque bon nombre d'entre eux ont une autorité supérieure à la loi nationale. La portée se manifeste de manière patente dans l'influence des textes les uns sur les autres. En revanche, la garantie normative présente des limites, au moins au niveau national, se traduisant par les difficultés des justiciables à voir appliqués par les tribunaux internes les droits reconnus au niveau international.
Research programme of the Ministry of Territorial Planning and the Environment on "The economic and institutional challenges of climate change". As part of the discussions on the potential of tradable emission permits (NECs) to reduce the overall environmental damage caused by fossil fuel consumption, the work of the LET consists of exploring the possible applications of NECs in the transport sector. The work programme has two main axes: exploring the introduction of NECs at various levels in the transport sector (refiners and importers, car manufacturers, travel centres such as shopping centres or workplaces, local authorities, motorists); — on the other hand, the aim is to define how the effectiveness of the permit system could be improved in the context of packages of measures including other regulatory instruments, such as various regulations, charging (particularly road charging), investment, under the responsibility of actors such as public transport operators and local authorities responsible for transport. In the transport sector as such, quota system applications are quite rare, with the exception of the programme to eliminate lead in petrol in the USA and the auctioning of car import licences in Singapore. This is why, in terms of methodology, the approach chosen is to draw mainly on experience in the other sectors in the USA and the theoretical debates which have or have fed into these events. We will therefore start in the second section with (a) a reminder of what is a tradable permit system, (b) identifying the main problems associated with their implementation, and (c) concluding on the criteria for the success of the NEP systems. This analysis will be carried out on the basis of the results of their implementation in different sectors other than transport. In the third section we will elaborate on the possible applications of NECs in the transport sector. On deliberation in the public debate, Rawls' approach known as "justice as fairness" has been much more commented that the "difference principle" emerged from there as a major result: even though based on an equal initial position, "justice as fairness" paradoxically justifies an essential benchmark in the debate on inequalities. Indeed, the difference principle compresses many issues: distinguishing between naturel and social matters which both contribute to inequalities, defining a level of permitted inequalities we should have to tolerate not as just but effective ones, preserving market incentives in so far they contribute to value creation, which has later to be redistributed. The paper explores all these questions, that concern the philosophical-economic rationality of the principle and its political-societal applicability as well. In conclusion, its contribution to the debate on inequalities, which is beyond all doubt, seems rather economic than philosophical and is based on a liberal presupposition, which is rarely identified and recognised. ; Sur la délibération dans le débat public, la démarche de Rawls, dite de la « justice comme équité », a été beaucoup plus amplement commentée que le « principe de différence » qui en est pourtant un résultat majeur : bien que fondée sur une position initiale d'égalité, la «justice comme équité» justifie non sans paradoxe un repère essentiel dans le débat sur les inégalités. for almost 25 years of European accounting harmonisation has been achieved through the adoption of directives. In the mid-1990s, the European Commission announced that it was abandoning this form of accounting harmonisation for listed companies publishing consolidated accounts in order to opt for an international standard accounting process under the auspices of the then IASC. Much work has already been published on the reasons for this change of strategy. In this research, we would like to understand why the European Commission's criticisms of the directives have been so violent. On the basis of the archives available around the negotiation of the Seventh Directive and building on the work of Diggle and Nobes (1994) and Van Hulle and Van der Tas (1995), we highlight the stigma left by the negotiation of the Seventh European Directive, the challenge to the effectiveness of the options inherent in the directives and the influence of the International Organisation of Values Commissions, encouraging rapprochement with the international standard setting body. This article thus contributes to a better understanding of developments in accounting regulation methods. ; International audience For nearly twenty-five years the European accounting harmonization is reflected in the adoption of directives. International audience The current concern, in the number of local or international conflicts, where there are problems of reconciliation, collective identity, political, security, economic and environmental interdependencies is in favour of a closer look at these issues, which can only encourage such international negotiations. International negotiation is a complex and specific decision-making process in which people tend to find a common agreement instead of acting unilaterally. A privileged tool of exchange between people, of the adjustment of their points of view, of the coexistence of their social identities and of the resolution of their conflicts, international negotiation is one of the most fundamental springs of life. Moreover, international negotiation of all types (diplomatic, political, commercial, cultural, economic, and environmental) is affected by cultural phenomena: the differences in goals and objectives that separate negotiators are added here, a cultural difference, which can make them difficult and opaque. Culture greatly influences the process, communication, cognition, motivation and actions of the protagonists. Knowledge of the cultural peculiarities of the opposing party could have a positive effect on the perception of the country and on the communication of negotiators and the search for solutions, on the other hand, its ignorance or negligence can lead to complications, risks of disagreements or interruptions of negotiation, etc. Moreover, the international negotiator is in a position of the interface of two relations that with his own country and that with the opposing party. His dilemma here, caught between conflicting objectives, is to defend the positions of his own country, his own interests and reach an agreement with the opposing party. Par le truchement d'une enquête qualitative riche de 30entretiens semi-directifs, les auteurs révèlent la contribution essentielle de l'expression, du partage et de l'écoute des émotions à l'inclusion sociale des collaborateurs. Ils en explorent l'impact en termes de développement des sentiments d'appartenance et d'authenticité. Contribution à une heuristique de l'inclusion, le présent article esquisse le portrait d'un style nouveau de leadership : le leadership inclusif.Annie CORNET, Paul MATAMBA et Christine TOMAT proposent un éclairage original, sous forme de bilan critique, de vingt ans de médiation interculturelle dans les hôpitaux publics belges francophones. Embrassant une approche Business Case de la Diversité, dont Annie Cornet a été l'une des pionnières mais aussi l'une des premières analystes critiques dans le champ francophone, l'article explore avec finesse les motifs ayant inspiré la création de la fonction de médiateurs interculturels dans les hôpitaux belges francophones. Après avoir rappelé les objectifs assignés à la fonction, il donne à voir sa contribution à la gestion des situations critiques qui parsèment le parcours de soin des patients d'origine étrangère (migrants, réfugiés, etc.), qu'elles renvoient à des problématiques linguistiques/communicationnelles ou à des divergences axiologiques. Traducteurs interculturels naviguant entre les cultures (celle du pays d'origine et celle du pays d'accueil), les registres (administratif et médical vs personnel et familial…) et les logiques (économiques vs sociales), les médiateurs sont au cœur des politiques de gestion de la diversité en milieu hospitalier. Tiers d'intermédiation et de confiance, ils se placent à équidistance entre l'institution et le patient et ont pour mission d'améliorer la qualité des services tout en assurant une plus grande égalité devant les soins. Contribution à une heuristique de l'inclusion en secteur hospitalier, cet article invite à penser le lien entre santé et inclusion, à l'heure où nos nations confrontées à la pandémie COVID-19 redécouvrent leur vulnérabilité, les inégalités sociales dans l'accès au soin… et la centralité (trop souvent déniée) du système public hospitalier. À la frontière entre la philosophie des sciences de gestion et le management des ressources humaines, Camille RICAUD propose une analyse critique des liens entre diversité et rationalité managériale, au travers du paradigme du neutre. Comme le souligne à juste titre l'auteur, « la diversité est porteuse de possibilités tout comme elle suppose également de potentielles difficultés pour l'organisation. Les discours et les pratiques des politiques managériales de diversité forment ainsi un ensemble cohérent qui cherche à saisir les différences individuelles en les identifiant defaçon à les gérer et les accorder avec les buts de l'organisation ». Cependant, la catégorie de neutre semble échapper à l'emprise du management. Distincte de la notion de neutralité, elle s'enracine dans la tradition philosophique. Discordante des paradigmes rationalistes (instrumentaux) traditionnels, elle échappe aux taxonomies simplistes. Ingérable, elle permet de renouveler la perception de la diversité dans les organisations.Ce faisant, cet article théorique inaugure un champ de recherche inédit et des plus prometteurs. Hacène LAÏCHOUR et Jean-François CHANLAT explorent, avec finesse, les dynamiques d'inclusion socio-professionnelle des salariés issus de territoires urbains défavorisés métropolitains. Les angles d'approches (distincts mais complémentaires) embrassés dans l'article- soit le recrutement et l'intégration en entreprise - donnent à voir l'emboîtement de l'économique et du social dans les mécaniques d'inclusion/d'exclusion dans les zones urbaines désavantagées. L'article offre, ainsi, un éclairage original sur l'encastrement réciproque de la question sociale - appréciée au regard du prisme de la diversité sociale - et de la question territoriale. Ainsi, c'est l'entrelacement entre fracture sociale et fracture territoriale qui constitue la trame de fond de l'analyse qui se fait, volontiers, multi-niveau et intersectionnelle. Sont ainsi décortiqués les motifs, tour à tour socio-économiques, institutionnels, managériaux et écosystémiques, qui poussent (ou non) les grandes entreprises à se rapprocher des territoires et à faire trésor de la diversité de talents qu'ils recèlent. Cet article adopte son cadrage théorique gestionnaire bien qu'il embrasse, à bon escient, une approche interdisciplinaire (faisant appel à la sociologie classique, de l'immigration, de l'intégration aussi bien qu'à l'anthropologie des organisations) pour éclairer d'un jour nouveau les ressorts (brisés) de la cohésion sociale. Deux varia et un essai complètent ce numéro.Soufyane FRIMOUSSE, Yves LEBIHAN, Mireille BLAESS, Abdelaziz SWALHI et Thierry FABIANI s'interrogent sur la remise en question du rôle du leader au sein de l'entreprise. Par le biais de la psychologie positive, ils tentent de répondre à la question : le leader positif favorise-t-il le développement de la passion et du bien-être au travail ? Ils illustrent la dynamique de ce développement avec le cas d'une société du secteur de la santé, l'OCP. Anne Goujon BELGHIT et Olfa Gréselle-ZAÏBET étudient les apports d'un outil pédagogique innovant dans le domaine de la gestion des ressources humaines. Pour savoir comment les étudiants s'approprient une nouvelle connaissance (le capital humain), elles ont adopté une approche de pédagogie inversée à l'aide de cartes conceptuelles, en s'appuyant sur le cycle d'apprentissage de Kolb. Leurs résultats montrent que l'efficacité de l'outil des cartes conceptuelles dépend des besoins cognitifs des élèves, des objectifs de l'enseignant et surtout du niveau de participation des élèves (grandeur demeurant difficile à évaluer avec précision). L'utilisation des cartes conceptuelles par les enseignants, en montrant aux élèves comment structurer leurs connaissances de manière continue, leur permettra de progresser aussi bien dans l'apprentissage à l'université que dans leur future vie professionnelle. Enfin, dans un essai consacré aux transformations organisationnelles en cours, François SILVA et Charles-Philippe MOURGUES proposent une typologie des managers au vu des nouveaux objectifs assignés aux entreprises, moins centrés sur la rentabilité à court terme que sur des valeurs non financières partagées avec des parties prenantes autres que des actionnaires. Le « manager mercenaire» serait mû par une idéologie rivée sur la rémunération tandis que le « manager missionnaire » chercherait à imposer une vision nouvelle au monde de l'entreprise. Les auteurs considèrent qu'un troisième type, le « manager légionnaire », serait le plus à même de faire face aux bouleversements du contexte économique en portant des valeurs de respect de la diversité, de tolérance et d'ouverture sur le monde.
