Yet those 'places where animals appear', just like many other latent issues or undeclared problems, such as many tools that have not yet been identified, as they are buried or embedded in the deep drawers and dusts of his fantomatic boite'outils, have created new roots in the very diverse soil of contemporary thought. Der Begriff δαίμων ist semantisch äußerst vieldeutig, was seine Definition erschwert. In der vorplatonischen Antike war er nicht an einen bestimmten Kult oder an Feste und Rituale gebunden: Homer benutzt die Begriffe δαίμων und θεός ohne Unterschied, und in der Antike steht er auch für das Schicksal der Individuen (μοῖρα, τύχη), für ein Rachewesen (ἀλάστωρ) oder für die Seele der Verstorbenen. Im ersten Teil dieser Arbeit wurde der Bedeutungswandel dieses Begriffes analysiert. Diese Analyse erfolgte nicht in rein chronologischer Ordnung, sondern orientierte sich vielmehr an der Bedeutung des Begriffes innerhalb verschiedener literarischer Gattungen (in der Epik homerischer Zeit und bei Hesiod, in der Tragödie und in der Komödie) und der vor- und nachplatonischen Philosophie. Die Schriften Platons wurden in diesem Teil nicht berücksichtigt. Um sie geht es im zweiten Teil der Arbeit. Die Einleitung sollte zeigen, auf welchem religiösen und kulturellen Hintergrund Platon seine Lehren entwickeln konnte und wie sich die Vorstellung des Dämonischen nach Platon gewandelt hat. Er entwickelt eine Idee, auf der zuerst die Philosophen der Alten Akademie und später die des mittleren Platonismus ihr Lehrgebäude der so genannten "Platonischen Dämonologie" errichtet haben. Gemeint ist die Idee der vermittelnden Funktion des dämonischen Elementes, das zwischen zwei ansonsten unvereinbaren Elementen vermitteln kann: zwischen dem Sterblichen und dem Unsterblichen, zwischen dem Menschlichen und dem Göttlichen – Platon selbst sagt im Symposion: «Die Gottheit verkehrt nicht unmittelbar mit Menschen» (θεὸς δὲ ἀνθρώπῳ οὐ μείγνυται: Pl., Symp., 203a1-2). Das zweite Kapitel des ersten Teiles untersucht die immer schematischer werdende Ausarbeitung einer Dämonologie, die von den Dreiecken des Xenokrates bis zu den starren Katalogisierungen bei Apuleius und in den Reden von Maximus von Tyros führt. Die vorliegende Arbeit geht nicht über diese Autoren hinaus. Denn sie soll zeigen, wie die unmittelbaren Nachfolger Platons, die Mitglieder der Alten Akademie, und später die Philosophen des mittleren Platonismus ihre Theorien ausgearbeitet haben, indem sie das, was bei Platon verschiedenartige Andeutungen waren, strukturierten, und indem sie das in ein Konzept bringen wollten, was bei ihm unbestimmt blieb. Dabei wurden sie vielleicht von der Darstellung des Dämonischen (und speziell des δαιμόνιον des Sokrates) in zwei Dialogen zweifelhafter Authentizität beeinflusst: durch den Alkibiades I und den Theages. Im mittleren Platonismus werden die Dämonen fest in das gesamte kosmologische System eingebunden, und auch das δαιμόνιον des Sokrates hört auf, das unbegreifliche und undefinierbare dämonische Zeichen zu sein, von dem Platon in seinen Dialogen spricht: Es wird von dort an wie ein δαίμων dargestellt. Um diesen interpretatorischen Vorschlag zu bekräftigen, wurden im zweiten Teil dieser Arbeit die verschiedenen Termini untersucht, die Platon für das Dämonische verwendet. Diese wurden in vier "Kategorien" eingeteilt, die aber dennoch kein starres Schema darstellen sollen, sondern ineinander übergehen, weil sie alle die platonische Idee der vermittelnden Natur des Dämonischen gemeinsam haben: 1) Die δαίμονες als beschützende Mächte, Hirten für die Menschen in der Erzählung eschatologischer Mythen im Phaidon und in der Politeia, in derjenigen des Zeitalters des Chronos im Politikos und in den Nomoi; 2) Der δαίμων, der dem höheren Teil der Seele bzw. der rationalen Seele entspricht, die vom Demiurgen geschaffen wurde, von dem Platon im Timaios spricht; 3) Das δαιμόνιον des Sokartes, auf das Platon in zahlreichen Schriften verweist; 4) Eros, wie er in der Rede der Priesterin Diotima von Mantinea im Symposion als δαίμων μέγας beschrieben wird. In den zwei unterschiedlichen Darstellungen des Mythos des Chronos bei Platon im Politikos und in den Nomoi sind die δαίμονες göttliche Wesen, die über den Menschen stehen. Sie wachen über die Lebewesen wie göttliche Beschützer und Hirten, und stellen ihnen alles Lebensnotwendige zur Verfügung. Während sie im Mythos des Politikos für die Menschen sorgen, indem sie lediglich deren primären und körperlichen Bedürfnisse befriedigen – hier ist der Mensch als ein Lebewesen unter vielen dargestellt –, beziehen sich die Aussagen in den Nomoi nur auf die Menschen, die sich von den Tieren unterscheiden. Hier sorgen die δαίμονες dafür, dass die Menschen miteinander in einem Zustand leben, der sowohl durch Eigenschaften gekennzeichnet ist, die dem Goldenen Zeitalter entnommen sind (wie z. B. Frieden und Prosperität), als auch durch politisch konnotierte Begriffe wie sittliche Scheu, Gesetzlichkeit und die Fülle der Gerechtigkeit (Leg., IV 713e1-2). In den Nomoi findet sich daneben auch eine andere Vorstellung der δαίμονες, die nicht an einen mythologischen Kontext gebunden ist, sondern an einen religiösen. Gemeint ist die Beschreibung der kultischen Handlungen im Prototyp einer idealen Stadt, wie er von den drei Protagonisten des Dialoges, dem Kreter Klinias, dem Spartaner Megillos und einem anonymen Athener präsentiert wird. Hier sind die δαίμονες in ein hierarchisches System göttlicher Wesen eingegliedert, das aus Göttern, Dämonen und Helden besteht. Der Dämon wird als positives göttliches Wesen dargestellt (entsprechend der platonischen Vorstellung, dass das Göttliche nie Ursache für ein Übel bei den Sterblichen ist), das jeden einzelnen Menschen begleitet und die Aufgabe hat, dessen Lebenssituation zum Guten zu wenden, indem es ihn manchmal von bestimmten Handlungen abhält (Leg., V, 732c1-6). Diese Stelle erinnert einerseits an den apotreptischen Charakter des δαιμόνιον des Sokrates. Andererseits ist der δαίμων in den Nomoi nicht nur eine verhindernde, sondern auch eine aktive Macht. Wie bei Hesiod (Op., 121-123) und in den platonischen Darstellungen im Phaidon und in der Politeia, werden die δαίμονες hier als Wächter (φύλακες) beschrieben , die den Menschen begleiten und ihn durch sein Leben führen. Im Timaios gibt es dagegen nicht die Vorstellung, dass der Dämon eine äußere Macht ist, die für die menschlichen Seelen sorgt und sie führt; diese Funktion übernehmen dagegen die Sterne, die in der Anzahl den Menschenseelen gleichen bzw. die niedrigeren Götter, die den sterblichen Teil der Seele erschaffen und die Aufgabe haben, das Lebewesen zum Bestmöglichen hin zu lenken (Pl., Tim., 42e2-4): Sie ziehen den Menschen auf, ernähren ihn, und empfangen ihn nach dem Tod schließlich wieder (Tim., 41d1-3), so wie es die δαίμονες in den Mythen im Politikos, in den Nomoi, im Phaidon und schließlich teilweise auch in der Politeia tun. Im Timaios ist der δαίμων dagegen eine innere Kraft, weil er mit der Seele selbst gleichzusetzen ist. In diesem Punkt könnte er auch mit dem Eros des Symposion verglichen werden, der, wie im letzten Teil dieser Arbeit gezeigt wurde, mit einem Impuls der Seele in eine bestimmte Richtung hin gleichzusetzen sein könnte: Er strebt zum Hohen, zur Idee des Guten, bringt also auch die Seele dazu, sich zu vergöttlichen; wenn diese allerdings zum Niederen strebt, kann der Dämon nicht verhindern, dass sich der Mensch auf einen fast tierischen Zustand herabbegibt. Im eschatologischen Mythos des Phaidon (107d-108b; 113b) wird der δαίμων als eine Art Schutzgeist dargestellt, der einem Menschen bei der Geburt durch das Schicksal zugeteilt wird (λαγχάνω: 107d6), ihn im Laufe seines Lebens begleitet und seine Seele nach dem Tod zum Ort des Gerichtes führt. Aus dieser Darstellung geht nicht klar hervor, wie viele δαίμονες dabei beteiligt sind und welcher Art sie sind: Handelt es sich um zwei Dämonen gleicher Art, um zwei verschiedener Arten (der ἑκάστου δαίμων in 107d6 und der ἡγεμών in 107e1 und 108b2, der eine Art Jenseitsdämon darstellt) oder um drei δαίμονες zweier unterschiedlicher Arten (wenn man davon ausgeht, dass der ἄλλος ἡγεμών in 107e3 nur die Aufgabe hat, die menschliche Seele aus dem Hades zu seiner Reinkarnation zu führen)? Alle drei Interpretationen sind nach Platons Text denkbar. Sicher ist, dass die δαίμονες in diesem Mythos als schützende Wesen dargestellt werden, die mächtiger als die individuellen Seelen sind und als überpersönliche Kräfte auf die Einzelseele im Dienst der Gerechtigkeit einwirken. Eine analoge Funktion hat der δαίμων auch im Mythos von Er in der Politeia, doch mit dem entscheidenden Unterschied, dass er nicht durch das Schicksal einer Seele zugeteilt wird, sondern von der Seele selbst ausgewählt wird. Dadurch wählt die Seele zugleich die Art des zukünftigen Lebens aus. Das stellt eine Innovation im traditionellen religiösen Glauben dar, dem zufolge die Götter und die Notwendigkeit über das Schicksal eines Menschen entscheiden. Die δαίμονες tragen hier keinerlei Verantwortung für die Wahl, die das Individuum trifft. Aus diesem Grund dürfen die Sterblichen die Schuld für ihre eigenen Leiden nicht bei den Göttern oder Dämonen suchen, sondern nur bei sich selbst. Anders als bei Hesiod beschützt der δαίμων hier nicht den Menschen, sondern beschränkt sich darauf, das Schicksal zu überwachen, das dieser sich selbst ausgesucht hat, (a) als Begleiter seines Lebens (Resp., 620d8-c1) und (b) als Garant für die Realisierung aller getroffenen Entscheidungen (620e1). Der δαίμων der Politeia ist also Ausdruck der Wahl einer Lebensform und des Schicksals, die vom Menschen selbst getroffen wurde. Der δαίμων, der den Menschen dazu zwingt, dem Schicksal zu gehorchen, das er sich ausgesucht hat, erinnert an das δαιμόνιον des Sokrates, das in apotreptischer Weise interveniert, um den Philosophen an falschen oder ungebührlichen Handlungen zu hindern und das immer an seine philosophische Mission gebunden ist. Könnte man also die Hypothese aufstellen, dass die Seele des Sokrates das Lebensparadigma des Philosophen gewählt hat und dass sein δαιμόνιον interveniert, um ihn daran zu hindern, sich von diesem gewählten Paradigma zu entfernen? Obwohl in der Politeia der "Philosoph" nicht zu den möglichen Lebensformen zählt, wäre auch diese Interpretation möglich. Denn auch das δαιμόνιον des Sokrates ist eine Art "schützendes Zeichen", eine göttliche Macht, die mächtiger als die menschliche Seele ist. Dies würde einen roten Faden darstellen, der das Bild der δαίμονες als Schutzgeister mit dem des δαιμόνιον des Sokrates verbindet. Dennoch darf nicht vergessen werden, dass das δαιμόνιον kein eigentlicher Dämon, sondern eben ein dämonisches Zeichen ist, weshalb Platon niemals den Begriff δαίμων in Bezug auf ein solches benutzt. Wenn Platon von diesem Zeichen spricht, bleibt er unbestimmt. Er nennt es φωνή (Stimme), dämonisches Zeichen (τὸ δαιμόνιον σημεῖον) oder einfach τι δαιμόνιον bzw. τὸ δαιμόνιον. Der Begriff τὸ δαιμόνιον, der eine elliptische Variante zu τὸ δαιμόνιον σημεῖον ist, suggeriert, dass es sich nicht um ein wirkliches, individuelles Wesen handelt, sondern um ein Zeichen von irgendetwas. Ein Zeichen muss eine Quelle bzw. einen Absender und einen Empfänger haben. Der Empfänger ist in diesem Fall Sokrates, und die Quelle ist mit Sicherheit eine Gottheit. Man kann nicht genau sagen, um welche Gottheit es sich handelt. Man könnte vermuten, dass Apoll der Ursprung des dämonischen Zeichens ist, weil an ihn Sokrates' philosophische Aufgabe gebunden ist und weil τὸ δαιμόνιον sich immer nur in einem philosophischen Zusammenhang zeigt. Das δαιμόνιον wäre also ein Zeichen (σημεῖον), durch das sich der Gott Sokrates auf indirektem Wege zu erkennen gibt, um ihn vom schlechten Handeln abzuhalten. Man könnte sich also fragen: Wenn die Götter, wie Platon sagt, uneingeschränkt gut sind, warum interveniert diese Gottheit dann nur zugunsten des Sokrates und nicht der anderen Menschen? Sokrates ist ein tugendhafter Mensch, das Beispiel des wahren Philosophen, und sowohl Platon als auch Xenophon stimmen überein, wenn sie sagen, dass er von den Göttern sicherlich geliebt ist. Dennoch wäre es möglich, dass der Gott seine Zeichen nicht nur ihm sendet, sondern auch allen gewöhnlichen Menschen, dass aber nur ein dämonischer Mensch (δαιμόνιος ἀνήρ: Pl., Symp., 203a5) wie Sokrates sie empfangen kann. Die Einzigartigkeit des δαιμόνιον, von der Platon in der Politeia spricht (τὸ δ' ἡμέτερον οὐκ ἄξιον λέγειν, τὸ δαιμόνιον σημεῖον· ἢ γάρ πού τινι ἄλλῳ ἢ οὐδενὶ τῶν ἔμπροσθεν γέγονεν: Pl., Resp., VI 496c3-5), hängt also von Sokrates' Atopie ab, der als einziger Mensch die Eigenschaften besitzt, das Zeichen des Gottes zu empfangen und zu interpretieren. Eine ähnliche Idee kommt auch bei Plutarch zum Ausdruck, der als erster mittelplatonischer Autor versucht hat, das δαιμόνιον des Sokrates in eine dämonologische Lehre zu integrieren. In der Schrift De genio Socratis lässt er Simmias sagen, dass das δαιμόνιον im Grunde genommen nicht nur Sokrates gehört, sondern dass tatsächlich nur er und sehr wenige weitere Personen, die frei von Leidenschaften sind, die Gedanken der Dämonen wahrnehmen können (Plut., De Gen., 588 E; 593 D). An diesem Punkt darf man fragen: Warum greift Platon in seinen verschiedenen Darstellungen auf das Konzept des Dämonischen zurück, um sich sowohl auf die Seelen derjenigen Toten, die sich in Dämonon verwandelt haben (Resp., V 469a; VII 540c; Crat., 397e-398c) als auch auf die Schutzgeister, auf göttliche Hirten im Zeitalter des Chronos, auf den höheren Teil der Seele im Timaios, auf das δαιμόνιον des Sokrates oder auch auf Eros zu beziehen? Was ist das Element, das solch unterschiedliche Bilder miteinander verbindet? Die Antwort auf diese Frage ist in der Definition des Dämonischen zu suchen, die im Symposion enthalten ist: «Alles Dämonische ist zwischen Gott und dem Sterblichen » (καὶ γὰρ πᾶν τὸ δαιμόνιον μεταξύ ἐστι θεοῦ τε καὶ θνητοῦ: Pl., Symp., 202d13-14). Das Charakteristische dieses dämonischen Elementes ist in allen Darstellungen Platons seine vermittelnde Funktion. Das haben bereits die Philosophen der Alten Akademie und des mittleren Platonismus verstanden, die ihr immer schematischer werdendes dämonologisches System entwickelt haben, das als "platonische Dämonologie" bekannt ist und das auf eben jener Textstelle basiert. Doch haben sie außer Acht gelassen, dass die verschiedenen Darstellungen des Dämonischen bei Platon trotz des roten Fadens, der sie verbindet, nicht identisch sind: Eros, der "vermittelnde Dämon", entspricht weder den δαίμονες der platonischen Mythen noch dem δαίμων, der im Timaios die rationale Seele darstellt, noch dem sokratischen δαιμόνιον. Der Eros des Symposion kann ferner als ein wirklicher δαίμων gelten (ähnlich den traditionellen δαίμονες oder den Schutzgeistern der kosmologischen und eschatologischen Mythen bei Platon), doch nur in einem allegorischen Verständnis. Innerhalb der Vorstellung des Dämonischen, die, wie gezeigt wurde, in allen platonischen Dialogen eine Verbindung zwischen dem Menschlichen und dem Göttlichen darstellt und eine Kommunikation zwischen diesen entgegengesetzten Wesen ermöglicht, versinnbildlicht Platon einerseits auf der epistemologischen Ebene, andererseits auf der kosmologischen und psychologischen Ebene den Begriff des μεταξύ, d.h. die Theorie des Mittleren. Diese kommt nicht nur in der Darstellung des Eros zum Ausdruck, sondern auch in anderen Bereichen: Mittleres sind die δόξα und der θυμός; in der politischen Theorie gilt die Aristokratie als Mittelweg zwischen der Demokratie und der Monarchie; in der Ethik ist Mittleres das Konzept des βίος μικτός, das von Platon im Philebos ausgearbeitet wurde, und im Timaios stellt das Bild der Weltseele etwas Mittleres dar. Aber wofür ist der platonische Eros eine Allegorie? Auf der einen Seite repräsentiert er die Philosophie, personifiziert durch Sokrates und verstanden als μεταξύ zwischen Weisheit und Unwissenheit, auf der anderen Seite ist er die Personifizierung der βούλησις, der Sehnsucht nach dem, was ihm fehlt und was er besitzen möchte. Es handelt sich also nicht um ein individuelles Wesen, sondern um eine personifizierte Eigenschaft der Seele: Er ist das Bild einer formenden Kraft der Seele und ihres Strebens nach der Idee des Guten, die durch Betrachtung der immer reiner werdenden Erscheinungen des Schönen (τὸ καλόν) erreicht werden kann. Durch die Betrachtung des Schönen erinnert sich die Seele an ihre Verwandschaft mit den Ideen und erhebt sich zu ihnen und dadurch zur Unsterblichkeit. Die vorliegende Untersuchung ergibt somit das Bild einer grundlegenden Vorstellung von der Natur und von der vermittelnden Funktion des Dämonischen, einer Vorstellung, die sich in vielfältigen Facetten zeigt, in Bildern, die sich mal überlagern, mal unterscheiden, jedoch ohne Brüche, auf eine natürliche und harmonische Art und Weise.
This volume results from the works of the international day of studies on «Effects of truth: documents and images between history and fiction» («Effetti di verità: documenti e immagini tra storia e finzione»), which took place on the 19th of March 2015, at the Department of Philosophy, Communication and Entertainment of the University of Rome Three, in collaboration with the program Politiques des images of the Fondation Maison des Sciences de l'Homme in Paris. The axis linking the contributions contained in the volume is the survey on the status that documents and photographic images have in relation to the texts and their intentionality, namely the philosophical consequences arising from the massive use of photography in texts that can, in various ways, be ascribed to the field of literature. The essays gathered here contain several interpretive trails - all of a theoretical nature - all undertaken on the basis of a direct encounter with authors and texts ranging from Benjamin to Proust, from Warburg to Sebald, from Barthes to Modiano, from Kracauer to Mendelsohn. Their plot helps to outline not only the epistemic function of photography in relation to writing, but also the profile of a fiction literature, nor mere fiction or mere historical biography, which can provide us, thanks to the photographic medium, a new way to express our experience of time and memory. ; Ce volume découle des travaux de la journée internationale d'études sur «Les effets de vérité: documents et images entre l'histoire et la fiction» («Effetti di verità: documenti e immagini tra storia e finzione»), qui a eu lieu le 19 mars 2015 au Département de Philosophie, Communication et Spectacle de l'Université de Rome Trois, en collaboration avec le programme Politique des images de la Fondation Maison des Sciences de l'Homme à Paris. Les contributions contenues dans le volume composent une enquête sur le statut que les documents et les images photographiques assument par rapport aux textes et à leur intentionnalité. Elles étudient ainsi les conséquences philosophiques dérivant de l'utilisation massive de la photographie dans des textes pouvant être, de manière variable, attribués au domaine de la littérature. Les essais ci-rassemblés présentent des pistes interprétatives – toutes ayant une nature théorique – entreprises sur la base d'une rencontre directe avec des auteurs et des textes allant de Benjamin à Proust, de Warburg à Sebald, de Barthes à Modiano, de Kracauer à Mendelsohn. Il testo è incentrato su una riflessione intorno agli approcci filosofici che hanno maggiormente influenzato la prospettiva educativa e pedagogica di Paulo Freire e con i cui rappresentanti egli ha intrattenuto un intenso dialogo teorico. È stato notato come la sua lettura delle filosofie europee e nordamericane del Novecento sia stata sempre mediata da un riadattamento alle esperienze e alle problematiche dell'America Latina. Freire s'ispira alla fenomenologia e all'esistenzialismo, traendo da tali filosofie molti elementi che concorrono a configurare la sua teoria della conoscenza e la sua visione del rapporto uomomondo. La sua non è, tuttavia, una lettura pedissequa o dogmatica, ma declinata verso gli 240 obbiettivi del suo approccio pedagogico, che è orientato a sviluppare una compiutezza umana là dove essa sia limitata da situazioni di oppressione e di immersione in contesti inumani. Freire è un pensatore cristiano, nel senso che la spiritualità religiosa ne accompagna il percorso sin dagli esordi, ma anche del cristianesimo coglie soprattutto il messaggio liberatore e rivoluzionario, dialogando in modo intenso con i teologi della liberazione; egli raccoglie, altresì, dal personalismo cristiano, il tema dell'unicità della persona e dell'emergere della sua peculiarità all'interno di un movimento di emancipazione comune. L'autore brasiliano, sin dalla sua opera maggiore, La pedagogia degli oppressi, coglie del marxismo lo schema generale di interpretazione della società, della distribuzione del potere in essa e della divisione in classi. Anche in questo caso, Freire predilige l'afflato utopistico piuttosto che l'indagine strutturale di questa forma di pensiero e anche la sua "adesione" al marxismo è mediata in termini geografici, nel senso che contiene lo sforzo di adattare una visione del mondo nata in Occidente a un contesto ambientale differente, quale quello sudamericano e anche storici, nel senso che si avvale del contributo ispiratore di autori novecenteschi che hanno reinterpretato il marxismo alla luce di nuove esigenze storiche. Tra di essi si dedica particolare attenzione a Gramsci, che influenza la visione freireiana del rapporto tra intellettualità e movimenti sociali e politici. Il profilo marxista dell'opera di Freire appare, tra tutti, quello che ha ispirato maggiormente gli studiosi che ne hanno colto l'eredità, particolarmente gli autori della critical pedagogy negli Stati Uniti. Freire, inoltre, intrattiene un dialogo teorico con la cultura pedagogica americana, attraverso una sua interpretazione del pragmatismo/attivismo di Dewey. L'importanza attuale di un'indagine sulla dimensione più filosofica del pensiero freireiano potrebbe risiedere non tanto e non solo nella riflessione sui contenuti degli approcci a cui egli ha fatto riferimento, ma nella riflessione sulla capacità di raccogliere il messaggio più autenticamente educativo, che in Freire coincide con liberatorio e trasformatore, di ciascuno di essi. Tale messaggio va colto in vista di una nuova stagione storica, nella quale l'oppressione sociale, politica, psicologica si presenta in forme e sfaccettature molto differenti da quelle dell'epoca di Freire e la lotta educativa ad essa, che ha occupato l'impegno esistenziale di questo autore, deve dotarsi di strumenti di lettura e d'intervento inediti. ; The chapter is about Paulo Freire's major influences in terms of proponents he is more likely linked with on a theoretical basis, showing which perspectives played a significant role in the shaping of his educational and pedagogical view. His interpretation of European and North American philosophies of the nineteenth century melts with the experiences and issues of South American history. Freire is remarkably inspired by phenomenology and existentialism, so he draws from these perspectives many aspects that shape his own knowledge theory and his view upon the man-world connection. His view, however, is neither passive nor dogmatic, but pursues the achievement of his pedagogical goals, which tend to human completeness in circumstances of oppression and inhumanity. Paulo Freire is a Christian thinker, in so far as his religious spirituality accompanies him since the beginning, but he draws as well from Christianity first and foremost the liberating and revolutionary message, intensively dialoguing with Liberation theologists; furthermore he gathers from Christian personalism the subject of the individual's uniqueness and the surfacing of their particularity amongst a community emancipating movement. The Brazilian author, since his major text, entitled to The Pedagogy of the Oppressed, draws from Marxism the general interpretation scheme of society, of its internal power arrangement and class division. Here, also, Freire shows how he favours the utopic afflatus to the structural inquiry of this philosophy and his Marxist adhesion, is filtered both through a contextual readjustment and through the inspiring contributions of some Marxists of the nineteenth century like Antonio Gramsci, who greatly influenced Freire's view of the link between intellectuals and social and political movements. The Marxist profile of Freire's oeuvre appears to be, among other aspects, the most inspiring one for his followers, in particular for the critical pedagogy thinkers in the United States. Furthermore, Freire maintains, through his interpretation of Dewey's pragmatism/activism, a deep theoretical dialogue with North American pedagogical culture. The current interest in the philosophical dimension of Freire's thought might lay not as much in the consideration of the contents, as rather in the author's ability to pick up the most authentic pedagogical message of each single approach. This teaching has to be seized in sight of an historical season, in which social, political and psychological oppression displays itself in many forms that are different from the past, and the educational fighting against these must be provided with innovative interpretation and intervention tools.
In agreement with the title of this article, the essay is divided into two basic parts: one which is historical and the other philosophical. In the first part, the author examines at the beginning the classical latin etyma of the term uiolentia (uis, uiolare, uiolator, etc . . ). After that comes the acclaration of the philosophical concept of «violence» in Aristotle and Saint Thomas, and in continuation an indication of the application of the same concept to the field of ethics, and finally to the juridical field within classical roman law. In another sphere of considerations -ethical and political- the author points out the opinions of some characters which Plato introduces in his dialogues Gorgias and The Republic, due aboye all to the resonance which these works hace had in the history of the Western World until the present time. The subject of bloody violence, which is inherent to the action of the tyrannicide, is treated here briefly with references to the works of Cicero, John of Salisbury, Saint Thomas, Marsilius of Padua, Coluccio Salutati, Juan de Mariana, etc. Phenomena of midieval history suchaas the Crusades and the trials of the Inquisition could not be silenced in this case because both phenomena legitimized morally the use of violence directed towards infidels and heretics. The historical excursus on the topic of the legitimacy of violence in the hands of those who govern passes in successive orden, through Machiavelli, to the political literature on the areasson of state», jusnaturalism, etc . To be underlined is the fact that since the end of the Eighteenth Century -and in an even much more important way in the realm of hegelian Idealism- the concept of violence has undergone a process of amplification as much within the field of Philosophy as within the experimental sciences: Darwin, Malthus and Hegel form the framework. This concept, which in Hegel's dialectic transformed itself into the dynamic principie of the antithesis, and which, therefore, affirmed the structure of the metaphysical movement of history, was passed on as a legacy to the successive hegelian trend, which was in itself so complex and so full of ramifications. The figure of Marx stands out in these pages not so much for his ties with the hegelian left, and with Feuerbach in particular, but rather because of one of the basic concepts of historical materialism -the struggle of the classes- which Marx underlined in his Communist Manifesto as the motivating force of history. The author then considers on the one hand the relationships which exist between the different european nationalisms of the last Century and the ones actually existing today, and, on the other, the Marxist ideology; he analyzes in passing the profound influence exercised by the Aufk/arung of the Eighteenth Century upon the deChristianization of man wrapped up first in his rationalism, and, later on, as a compensation, in new forms of religion and the cult of the world. From here on several names appear: Lenin, Stalin, Sorel, Mussolini, Hitler, etc., men who were very different one from the other and even opposed with regard to their respective political philosophies , but who set the pace for violence of a revolutionary and counter-revolutionary nature during short years or lasting decades. After a few more considerations, the first part of this essay ends with the author underlining the interest which experimental psychology and psycho-analysis have dedicated to the study of human aggressiveness and its mechanisms. In the second part of this work the author tries to establish gUidelines for the study of the relationships between the multiple phenomena of individual and collective violence in the present, and the mass civilization of our time. In the first place, the author makes a series of admonitions with relation to the words used: «violence-, .mass civilization- instead of «tnass society-, «civilization- instead ot «culture-, etc. He also recommends the need for not classifying en masse as a result of a reactionary mentality, the discontent which the intellectual contemplation of the present times produces in the observer, because if our state of animation could be termed as nothing else but «reactionary», then the same could be said to define a great part of the best literature of this Century, as well as the figurative arts of this modem age. The expression «mentality of violence- is applied in the historical context of cultural regression, from Friedrich Nietzsche to our day. After this, the author makes a summary description of the mental coordinates of massified man, as well as of certain particular features of the actual «organization- of culture, which is increasingly impregnated by political and economical ideas, in agreement with the fundamental methodology of historical materialism. The nucleus of these considerations is made up of a philosophical definition of the actual conditions of culture in Europe. This definition rests upon the conviction that the ideology of Marxism-Leninism, although it may by in a stage of partial historical modification, directs not only the political evolution of important sectors of , occidental society, but also that it has known how to model. thanks again to the coming-together of circunstances, the forma mentis of the contemporary intellectual. In the final part of the essay, the author dedicates special emphasis on the influence of Marxism upon wide sectors of modem Catholicism. He then adds several wamings in order to avoid , on the part of the reader, interpretations which might be inopportune or false.
In this contribution I intend to analyse the legal aspect of the miniature illustrating Book 41, item 1 of the Digesture and the second book of the institutions of Justinian in a group of manuscripts now kept at the Bibliothèque nationale de France, dated between the xiii and the xiv Century. These two books, which are closely linked to each other, have similar iconographies: the acquisition of original ownership through the occupation of res nullius. Wildlife and aquatic animals — ferae bestiae, volucres and PISCES — were, in Roman and just law, an important example of res nullius, hunting and fishing leading to the acquisition of those goods. It is precisely these activities that are used to illustrate Book 41, Title 1 of the Digesto et Book 2, Title 1 of the Institutions. They are of course subject to changes, both technical and regulatory, over time. I will try to show how images that have over time depicted the occupation of res nullius reflect and help shed light on these changes. ; In this paper, I will analyse the legal aspect of the miniatures that illustrate book 41.1 of the Digest and the second book of Justinian's Institutions as a group of manuscripts dating from the thirteenth and fourteenth century and currently kept in the Bibliothèque nationale de France. La tesi si compone di 5 capitoli: Il primo presenta le emergenze sanitarie più importanti verificatesi nel corso della storia moderna, in modo da introdurre gli effetti che esse hanno avuto sulla società, portando alla necessità di una solida regolamentazione che permetta in futuro delle reazioni maggiormente coordinate e strutturate. Nel capitolo successivo vengono esposti i casi in cui non è stato possibile garantire alcuni diritti, ritenuti fondamentali per l'uomo. In particolare, le peculiari situazioni estreme hanno costretto, per mancanza di risorse, a dover rinunciare addirittura a ciò che in condizioni normali è ritenuto un diritto assolutamente inalienabile: il diritto alla salute. Nel terzo capitolo si affronta più approfonditamente nella fattispecie europea, quelle che sono state le misure di contenimento del virus attraverso la sospensione del trattato di libera circolazione di Schengen. Inoltre, viene approfondito il delicato equilibrio ricercato dalla Commissione europea tra la cautela nella prevenzione di una nuova impennata dei contagi e la necessità impellente di riprendere gli scambi, soprattutto di merci, all' interno dell'Unione per evitare che i danni economici possano raggiungere o superare la portata di quelli sanitari. Nel penultimo capitolo, invece, si presentano gli strumenti telematici messi a disposizione dai vari Stati membri dell'Unione europea marcando le differenze tra un approccio accentrato (dove i dati vengono gestiti ed elaborati da un server) e uno decentrato (dove gli stessi sono elaborati autonomamente dai singoli device). Infatti, le direttive degli organi legislativi europei sottolineano quanto queste due filosofie progettuali possano approdare ad approcci diversi nella privacy compliance, evidenziando una sicurezza intrinsecamente superiore nei sistemi decentrati. Inoltre, nello stesso capitolo si mostrano alcuni approcci adottati da paesi esteri, in particolare la Cina, che, oltre a proporre delle app per dispositivi mobili, ha varato delle misure di sorveglianza coercitiva, tanto opprimenti nei confronti del diritto alla riservatezza personale quanto efficaci nel garantire che le leggi finalizzate alla riduzione dei contagi fossero rispettate, portando a successi innegabili. Nel quinto e ultimo capitolo si approda all'argomento del fine vita. L'odierna pandemia, unico caso registrato nell'era della globalizzazione, ha portato ad una serie di situazioni dove è stato necessario adottare misure drastiche, impensabili in situazioni normali. Infatti, ci sono stati casi in Francia dove si è arrivati ad una sorta di eutanasia causata dalla necessità di selezionare chi poteva accedere alle cure sanitarie e chi non era ritenuto idoneo a poter usufruire di una delle limitate postazioni di terapia intensiva a disposizione. In generale, oltre alla Francia, vengono esposti altri casi nel mondo in cui i criteri utilizzati per la selezione delle persone da curare sono talvolta barbari, ben lontani da una regolamentazione strutturata e all'altezza di una situazione superlativamente critica. A rispondere a questi casi esasperanti viene citata, nella fattispecie italiana, la SIAARTI (società italiana di anestesia analgesia rianimazione e terapia intensiva), la quale fornisce indicazioni specifiche indirizzate al personale tecnico sanitario per una maggior consapevolezza circa la priorità da assegnare ai pazienti in attesa, basandosi su criteri scientifici e oggettivi che tendono a far prevalere in primo luogo la maggior aspettativa di vita. Si conclude con una riflessione sul fine vita per ragioni di necessità e su come si prospetti in futuro una ampia regolamentazione in merito per rendere la risposta al problema della pandemia più forte nell'immediato e più consolidata nel tempo. The following thesis is divided in 5 chapters: The first one is an overview of the most important sanitary emergencies happened in the modern history, introducing the aftermaths of these events in the society and bringing to the necessity of a strong regulation allowing more coordinated joint reactions in the future. The next chapter presents some cases in which it was not possible to enforce some rights taken as fundamental for the mankind. In particular, due to the lack of technical resources in extreme situations, people were forced to resign to something that in regular circumstance is considered the most unalienable one: the right to health. The third chapter faces in detail the containing measures of the virus adopted by Europe through the suspension od the Schengen treaty. Moreover it deals extensively with the delicate balance chased by the European Commission between the caution in the prevention of new infections and the worrying necessity of rebuilding free exchanges, especially of goods, among the Union, in order to avoid that economical damage would take hold, even exceeding the proportion of the sanitary disaster. In the fourth chapter, instead, there are introduced the telematic tools offered by the European Union, remarking the differences between a centralized approach (where data is managed and processed by a central server) and the decentralized approach (where data is elaborated autonomously by single devices). In fact, the guidelines of the European legislative board underlines how much these two design philosophies can land into different approaches in privacy compliance, highlighting an intrinsically superior security in the decentralized systems. The same chapter shows the responses of some foreign countries (China in particular), which, in addition to propose apps for mobile devices, enforced measures for coercive surveillance as oppressive for the personal privacy as effective in forcing people to abide the law meant to slow down the spread of the epidemy, bringing to an unneglectable successes. The fifth and last chapter concerns the life ending. The current pandemic, the unique one registered in the globalisation era, brought to plenty of situations where drastic measures where the only choice, unimaginable in normal conditions. In fact, some cases were registered in France where a sort of euthanasia was applied, caused by the need of selecting who could access sanitary cures and who was not eligible for using one of the limited intensive therapy assets available. In general, in addition to France, other cases are exposed where the criteria used for patient selection are considered barbarian and far from a structural regulation and proper for an immensely critical situation. Italy answers to these overwhelming examples through the SIAARTI organization (the Italian society for analgesia, anesthesia, revival and intensive therapy) which gives precise directives to technical medical personnel for a better awareness about the priority to assign to patients in line, based on scientific and objective criteria which tend to give major regard to the life expectancy. The thesis ends with a meditation about the life end for necessity reasons and forecasts future specific regulation responding to the pandemic issue, stronger in the present and more solid in time.
In general, the concept of 'model' may refer to a person, thing, or organisation that refine one or more features in one or more fields, and also to the ability of that person, thing, or organisation to build a model that can be reproduced according to these characteristics. It then designates the character of what is exemplary, of what can be mapped. In the more specific context of monastic Buddhism in contemporary China, the "model" issue influences the strategies adopted by temples to come to the world, and their positioning within a regulatory system defined by both religious and political. This environment drives a "model" Buddhista temple to spread the values defined as being specific to contemporary Chinese society, and to embody them in accordance with the expectations of the institutions. The focus of this contribution is the ethical and legal analysis of legal acts governing genetic analysis in various contexts, such as medical research, therapy, forensic medicine and so saying. The aim is to highlight the values on which some regulatory responses have been shaped. Therefore, after a survey of the various types of genetic analysis and their possible uses, this work compares international, European and national legislation (Austria, France, Germany, Switzerland) in order to identify the way forward and to safeguard as far as possible certain values considered to be fundamental to the preservation of both individual autonomy and equality between its affiliates. It will be concluded that not all rules governing genetic analysis can be considered as respecting the fundamental rights guaranteed to all individuals. ; Al centro di questo contributo vi è l'analisi etico-giuridica degli atti normativi disciplinanti le analisi genetiche in vari contesti, ad esempio, ricerca medica, terapia, medicina legale e così dicendo. Lo scopo è di mettere in evidenza i valori ai quali sono state improntate alcune risposte normative. Pertanto, dopo una ricognizione delle varie tipologie di analisi genetiche e dei loro possibili impieghi, il presente lavoro confronta i testi normativi internazionali, europei e nazionali (Austria, Francia, Germania, Svizzera), al fine di individuare la strada percorsa e da percorrere per salvaguardare il più possibile certi valori ritenuti fondamentali per la preservazione sia dell'autonomia individuale, sia dell'eguaglianza tra i consociati. Si concluderà che non tutte le norme che disciplinano le analisi genetiche possono considerarsi rispettose dei diritti fondamentali garantiti a tutti gli individui.
The germ of this work has been the content of a previous congressional presentation whose abstract is at the address https://hal.archives-ouvertes.fr/hal-01136444 The main aim of this paper is to show that, following (Orsi 2012), the notion of order allows to carry out an historical-critical comparison among certain philosophy of politics ideas of Max Weber, Carl Schmitt and Jurgen Habermas. Then, if this same analysis is also pursued from the standpoint of the methodology of philosophical research according to Martin Heidegger, then further comparisons among these authors may be also realized. ; Seguendo l'esposizione data in (Orsi 2012), riguardante una comparazione fra alcuni aspetti dell'opera di Carl Schmitt e di Jürgen Habermas in filosofia politica, centrata sulla nozione di ordine ed inquadrata, nelle sue basi, entro la sociologia delle religioni di Max Weber, sarà possibile, oltre l'individuazione in essa di un comune punto di convergenza fra il pensiero dei questi autori nella nozione di ordine, portare avanti, su un piano teoretico di livello superiore, un ulteriore raffronto più orientato verso la metodologia della ricerca filosofica così come intesa da Martin Heidegger, la quale permetterà tra l'altro di vedere sia Schmitt che Habermas da un altro possibile punto di vista prospettico. Infine, si vuol altresì ribadire come, dall'intera trattazione qui svolta, risulterà peraltro rimarcata l'estrema rilevanza gnoseologica svolta dalla generale nozione di ordine nella storia del sapere.
