It is from the experience of not understanding that we will develop the outline of a reflection on what it is understanding. This experience reveals to us the desire to understand that is extended into the dialectic between the will to understand and the desire to be understood. Insofar talk is mainly to communicate with others, dialogue will serve here as a guide: it not only enables us to recall the conditions of possibility of understanding, but it highlight the nature of the duty to understand. In a second step, we will leave this pragmatic and ethical dimension of the act of understanding and its implications and we will show that the reflection about the intersubjective nature of understanding, finds its meaning in political reflection. Indeed, if it is true that language is essentially understood from the background knowledge shared by individuals, groups or communities of interpretation in a society, then the simple coexistence of a plurality of these interpretive communities requires the consideration of the claims of recognition of each of them claim in a politically structured space. There too the dialogue will be central to the experience of negativity that inhabits the act of understanding. ; C'est à partir de l'expérience de la non-compréhension que nous développerons les grandes lignes d'une réflexion sur ce que c'est que comprendre. Cette expérience nous découvre le désir de comprendre qui se prolonge dans la dialectique entre la volonté de comprendre et la volonté d'être compris. Dans la mesure où parler est essentiellement communiquer avec d'autres, le dialogue nous servira ici de fil conducteur : il nous permettra non seulement de rappeler les conditions de possibilité de la compréhension, mais encore de mettre en lumière la nature du devoir de comprendre. Dans un second temps, nous partirons de cette dimension pragmatique et éthique de l'acte de comprendre et de ses implications pour montrer que la ré exion sur le caractère intersubjectif de la compréhension, où l'on se laisse dire quelque chose par quelqu'un d'autre, ne trouve son sens que dans une réflexion politique. En effet, s'il est vrai que le langage ne se comprend pour l'essentiel qu'à partir de connaissances d'arrière-plan partagées par des individus, des groupes ou des communautés d'interprétation dans une société, alors la simple coexistence d'une pluralité de ces communautés d'interprétation exige que soit pensée la reconnaissance que peut revendiquer chacune d'entre elles dans un espace politiquement structuré. Là aussi le dialogue s'avèrera central dans l'expérience de la négativité qui habite l'acte de comprendre.

Socrates (469-399 B. C.), first philosopher of Athenian birth and socially plebeian origin, inaugurates a new wisdom in which the teacher teaches nothing and what he "teaches" he does through dialogues and ridiculing his occasional fellow members; demonstrating that daily life offers the possibility of philosophizing, loving the simplicity of living and the corresponding verbal expression. Socrates philosophized walking with friends, eating with them, going to war, fulfilling his political duties and finally drinking hemlock, assuming all the consequences of his particular way of life.Socrates in doing so and not teaching from the top of his chair, reminded his fellow citizens that philosophy is a way of life and not a speech or speculation about the nature and existence. This article analyzes the agambian figures of homo sacer and muslim, state of exception and concentration camp as paradigms to explain the superfluity of contemporary life under a process of degradation and human disintegration which is continuous and increasingly accentuated and perfected. Human life, ethically and politically qualified as just life, is now replaced by the simple life, bare life, biological or vegetative life, stripped of all political, moral, legal attribute. In the meantime the citizen is confused with the homo sacer, Muslim, non-man, whom anyone can kill without committing murder, because life has already been dehumanized by the exclusion, exception and abandon. And the cities become similar to the concentration camps, which rather than places for death, are spaces in which man is transformed into a living-traveling Cadaver, mummy, Muslim by impoverishment, overcrowding, starvation and abandon. This implies that, today, the task of the philosophy of law is not only to consider the best theory of power or justice, but claim and vindicate forms of life understood in all its potentiality, in their ability to live long and specially as potential. Simultaneously with the conception of other philosophical and legal issues relating to contemporary forms of life, we must assume, of course, other theoretical references and also other answers that allow the opening of new horizons of understanding of human life in its relation to law, justice, and community. In this sense, the work of Giorgio Agamben represents a necessary epistemological and methodological framework to understand aw in all its complexity today and address the most pressing problems of our times ; Este artículo pretende analizar las figuras agambianas de homo sacer y musulmán, esta­do de excepción y campo de concentración como paradigmas ejemplares que sirven para explicar la superfluidad de la vida contemporánea, en virtud de un proceso de degradación y desintegración humana que es continuo y cada vez más acentuado y perfeccionado. La vida humana, ética y políticamente cualificada en tanto vida justa, es sustituida ahora por la mera vida, nuda vida, vida biológica o vegetativa, despojada de todo atributo político, moral, jurídico; el ciudadano se confunde entre tanto con el homo sacer, musulmán, no-hombre, a quien cualquiera puede matar sin cometer homicidio, porque la vida ha sido previamente deshumanizada por la exclusión, la excepción y el abandono. Y las ciudades resultan análogas a los campos de concen­tración, los cuales antes de ser lugares de muerte, son espacios en que el hombre se transforma en cadáveres viviente-ambulante, hombre momia, musulmán mediante el empobrecimiento, el hacinamiento, el hambre y el abandono. Esto implica que la tarea de la filosofía del derecho hoy no es únicamente la de considerar la mejor teoría del poder o la justicia, sino reivindicar formas de vida entendidas en toda su virtualidad, en su posibilidad de vivir siempre y sobretodo como potencia. Simultáneamente a la concepción de otros problemas filosóficos y jurídicos relacionados con las formas de vida contemporánea debemos asumir, por supuesto, otros referentes teóricos y, asimis­mo, otras respuestas que permitan abrir nuevos horizontes de sentido respecto a la vida humana en su relación con el derecho, la justicia, la comunidad. En este sentido, el trabajo de Giorgio Agamben representa un marco epistemológico y metodológico obligado para entender el derecho en toda su actualidad y complejidad frente a los problemas más acuciantes de la época. ; Cet article analyse les chiffres agambianas homo sacer et Etat musulman d'unités d'urgence et des camps qui servent de paradigmes pour expliquer le superflu de la vie contemporaine, en vertu d'un processus de dégradation et de la décomposition humaine qui est continue et de plus en plus plus accentué et perfectionné. La vie humaine, éthique et la vie politique qualifiée tout comme il est maintenant remplacé par la vie simple, la vie nue, la vie biologique ou végétative, dépouillé de tout, morale, juridique attribut politique; le citoyen est confuse entre les deux l'homo sacer, mu­sulmane, non-homme, que n'importe qui peut tuer sans commettre assassiner, parce que la vie a déjà été déshumanisés par l'exclusion, exception et de négligence. Et les villes sont similaires aux camps de concentration, qui, avant lieux de la mort sont des espaces où l'homme se transforme en vie cadavres-pied homme momie, musulmane par l'appauvrissement, la surpopulation, la famine et de la négligence . Cela implique que la tâche de la philosophie du droit aujourd'hui est non seulement considéré comme le meilleur théorie du pouvoir ou de la justice, mais affirment modes de vie compris dans toute sa puissance, dans leur capacité à vivre aussi longtemps pouvoir pardessus. Simultanément à la conception d'autres questions philosophiques et juridiques rela­tives aux formes contemporaines de la vie, nous devons supposer, bien sûr, d'autres références théoriques et aussi d'autres réponses qui permettent d'ouvrir de nouveaux horizons de sens à la vie humaine dans sa relation avec le droit , de la justice, de la communauté. En ce sens, le travail de Giorgio Agamben est un must pour comprendre la loi dans toute sa complexité aujourd'hui et régler les problèmes les plus pressants de l'épistémologique de temps et cadre méthodologique.

Throughout the article the philosophical assumptions necessary for the construction of a conception of law are analyzed from the work of Albert Camus. Thus two tasks: first, an approach to the concepts of philosophy and philosophy of law; second, an analysis of the stage of denial or the absurd, where special attention to the Myth of Sisyphus and The Stranger is provided. The method used in the article is documentary. The validity of Camusian thought in the field of ethics and political philosophy, to find the germ of a conception of law able to problematize around various themes of the philosophy of law. ; A lo largo del artículo se analizan los presupuestos filosóficos necesarios para la construcción de una concepción del derecho desde la obra de Albert Camus. Así, se realizan dos tareas: en primer término, una aproximación a los conceptos de filosofía y filosofía del derecho; en segundo término, un análisis de la etapa de la negación o de lo absurdo, donde se presta especial atención al Mito de Sísifo y El Extraño. El método utilizado en el artículo es documental. La vigencia del pensamiento camusiano, en el ámbito de la ética y la filosofía política, permite encontrar el germen de una concepción del derecho capaz de problematizar en torno a diversas temáticas de la filosofía del derecho. ; Tout au long de l'article, les hypothèses philosophiques nécessaires à la construction d'une conception du droit sont analysés à partir de l'œuvre d'Albert Camus. El artículo se propone analizar los lazos teóricos tanto de Nietzsche a Butler como de Butler a Nietzsche en lo concerniente a la temática de la constitución de subjetividades. ¿En qué medida podemos decir que Butler es heredera de la deconstrucción de la subjetividad moderna efectuada por Nietzsche? ¿Es posible generizar el pensamiento nietzscheano, leyéndolo en clave butleriana? ¿Y es posible pensar en algo así como los aportes nietzscheanos a ciertas problemáticas planteadas por la obra de Butler? En primer lugar, desarrollamos la crítica del filósofo alemán a la noción moderna de subjetividad; en segundo lugar, nos abocamos a la interpretación butleriana de dicha crítica para introducir su concepción de "performatividad"; finalmente, en un tercer momento, nos dedicamos a examinar el vínculo entre subjetividad y política, y si la categoría de "sujeto" es necesaria para abordar la posibilidad de agencia y subversión plateada por Butler. ; The paper analyse theoretical rapport from Nietzsche to Butler as well as from Butler to Nietzsche, concerning the subject of the constitution of subjectivities. To which extent can we say that Butler inherits the deconstruction of modern subjectivity accomplished by Nietzsche? It is possible to genderize Nietzsche's thinking, by reading it in terms of Butler? And it is possible to think in something like Nietzsche's contributions to some of the problems considered by Butler?
