Bioethics tackles the most vexing problems in health care and the biological sciences: from reproductive technologies to euthanasia, the AIDS epidemic, mapping the human genome, human subjects research, and health care reform. Yet surprisingly little attention has been paid to the special problems faced by women and to feminist analyses of current health care issues other than reproduction. This breakthrough volume of original essays authored by leading figures in bioethics and feminist theory moves beyond the areas of reproduction and nursing, taking bioethics into new territory. The book starts with an investigation of the relationship between feminism and bioethics and introduces different approaches to the problem. This paper relates human rights to public health ethics and policies by discussing the nature and moral justification of human rights generally, and the right to health in particular. Which features of humanity ground human rights? To answer this question, as an alternative to agency and capabilities approaches, the paper offers the "fundamental conditions approach," according to which human rights protect the fundamental conditions for pursuing a good life. The fundamental conditions approach identifies "basic health"—the adequate functioning of the various parts of our organism needed for the development and exercise of the fundamental capacities—as the object of a human right. A human right to basic health entails human rights to the essential resources for promoting and maintaining basic health, including adequate nutrition, basic health care, and basic education. Duty bearers include every able person in appropriate circumstances, as well as governments and government agencies, private philanthropic foundations, and transnational corporations.

The global reproductive justice community has turned its attention to the abuse and disrespect that many women suffer during facility-based childbirth. In 2014, the World Health Organization released a statement on the issue, endorsed by more than 80 civil society and health professional organizations worldwide.1 The statement acknowledges a growing body of research that shows widespread patterns of womens mistreatment during labor and delivery-physical and verbal abuse, neglect and abandonment, humiliation and punishment, coerced and forced care-in a range of health facilities from basic rural health centers to tertiary care hospitals. Moreover, the statement characterizes this mistreatment as a human rights violation. It affirms: 'Every woman has the right to the highest attainable standard of health, which includes the right to dignified, respectful health care throughout pregnancy and childbirth.'2. This article presents conceptual bridges that exist between the philosophy of G.W.F Hegel and a feminist ethics of care. To do so, it engages with Slavoj Žižek's contemporary reading of Hegel in concert with existing feminist interpretations of Hegel's thought. The goal of doing so is to demonstrate how both Žižek and a selection of critical feminist thinkers interpret Hegel's perspective on the nature of subjectivity, intersubjective relations and the relationship between the subject and the world it inhabits, in a way that can further our thinking on the feminist ethics of care as a relational and contextualist ethics that foregrounds vulnerability as a condition of existence. These readings of Hegel highlight the radical contingency of human subjectivity, as well as the relationship between human subjectivity and the external world, in a way that is compatible with the feminist ethics of care's emphasis on the particularity, fluidity, and interdependency of human relationships. I argue that this confrontation between care ethics and mainstream philosophy is valuable because it offers mutual contributions to both care ethics as a moral and political theory and the philosophy of Hegel and Žižek.

Codifying, and then implementing, an international right to health, health care, or protection is beset with serious roadblocks - foremost among them being contentious issues of indeterminacy, justiciability, and progressive realization. Although advanced - and to some degree recognized under the rubric of a social or cultural entitlement within the law of human rights and, more particularly, the U.S. Declaration on Human Rights, together with International Covenant on Economic, Social and Cultural Rights (ICESCR), the International Covenant on Civil and Political Rights, the European Convention on Human Rights, and presently UNESCO's Draft Declaration on Universal Norms on Bioethics - attainment of such a universal right to health remains at best dubious. The central impediment to the recognition of such a right is determining the extent to which a sustained level of economic stability must be chartered before a state can be seen as either recognizing or enforcing a right to health of any kind and at any level of magnitude. Indeed, under the ICESCR, realization of economic social and cultural rights is to be effected only under a standard of progressivity. In other words, so long a states move "progressively" toward the realization of these rights, no actionable violations will be sustained. This, then, results in a flawed enforcement mechanism which allows any state signatory to this foundational covenant to pace enforcement of the rights under the ICESCR according to national standards of political will and differing levels of economic development and sustainability. Economic self-interest - not transnational principles and lofty aspirational goals - will determine ultimately, the extent to which health care protections are recognized as a integral part of social, cultural, political, or human rights.
