Acte de violence, inégalités de genre et bien-être : modèles basés sur une enquête de capacités individuelles et taux de crime pour l'Angleterre et le Pays de Galles A l'aide d'une enquête sur les capabilités individuelles couvrant diverses dimensions de vie, l'article étudie les inégalités de sexe en ce qui concerne les causes, l'expérience et les conséquences des aggressions violentes. En mesurant non seulement la violence vécue, mais aussi les sentiments de peur et de vulnérabilité aux aggressions futures, nous essayons de montrer comment ces deux types de variables interagissent et affectent le bien-être. Les caractéristiques socio-démographiques, économiques, de personnalité et d'environnement sont prises en compte. Les principaux résultats empiriques sont les suivants: l'identification d'un groupe spécialement vulnérable en utilisant les données concernant les hommes et les femmes séparément; des inégalités entre sexes relatives à la propensité à subir différentes formes de violence; des inégalités entre sexes relatives à l'impact de factors importants comme le nombre d'enfants à charge, le statut d'emploi, le revenu (de ménage et personnel) et l'éducation, sur la probabilité de subir des violences; un lien fort entre la violence domestique subie et la vulnérabilité à la violence domestique future, pour les femmes; et un impact négatif très net de la vulnérabilité ressentie sur le bien-être.

The criminalization of aggression and the establishment of the International Criminal Court's jurisdiction over this crime make it necessary to provide a definition for this crime, and to determine the conditions under which the Court shall exercise its jurisdiction over this crime. However, this task is not an easy one given the ''particular nature'' of the crime of aggression. The major challenge we are faced with lies in the difficulty to define and circumscribe the crime of aggression while abiding by the cardinal rules of international criminal law on the one hand, and the requirements of the law of the Charter or the law of the international Peacekeeping on the other. A thesis devoted to the fight against organized crime in the United Arab Emirates may seem rather surprising. Security in this country is at a very high level and the authorities maintain a very strong control over a 90% foreign population. Generally regarded as one of the safest countries in the world, organized crime has no place in the UAE. But the subject is justified because the fight against organized crime can only be conceived in a global framework that puts countries in advanced economies at the forefront. The UAE is a major partner in the strategy and international cooperation that has been developing steadily for more than 30 years to reduce criminal organizations. These still active organizations have been joined by terrorist organizations that finance themselves through trafficking and illegal activities. This junction between crime and terrorism, proven by field investigations, is a factor in worsening instability and a challenge for police forces. In the Gulf, there is a need to closely monitor trade flows that may conceal criminal activity. But it is also necessary to detect financial flows from criminal activities that are recycled in the prosperous economy of the UAE. On both counts, the UAE plays a decisive role because of its significant financial resources, surveillance technologies and the political will of its leaders. This thesis places the action of the Emirates in the normative and institutional framework established by treaties, relayed by national law. In this area, it is unreasonable to target the disappearance of organized crime, which is an activity linked to the globalization of world trade. The achievable objective of the Emirates is not to allow the implantation of organized crime on its territory. Apprehending the criminal colonial project and placing it in its implementation, from the criminal act or tort to the sanction, throughout prosecution and trial, are the purposes of this research taking place in Dahomey, a French West African territory, between 1894 and 1945. The principle of discrimination between European citizens and Natives on which is built the judicial mechanism extends all along the criminal path, with the perception of a specifically native criminality or the differentiated execution of the penalty according to the convict status. However, this repressive segregated process is not fully considered in its continuity. Whereas native justice is increasingly taken hold of by the colonial government, both ends of the repressive system are not thought of in terms of integration into civil society. The Police and prisons depend on an evolutionary political and economic order. The criminal police and the prison operations are largely left in the hands of local leaders and African auxiliaries, which leads to adjusting the repressive regime into a system of "domination without hegemony". The backbone of the native justice is at the heart of criticisms against the colonial order, but it is also the place where power relationships are renegotiated and where social conflicts related to the colonial situation are exposed. La police judiciaire et le fonctionnement carcéral sont donc largement laissés entre les mains des chefs locaux et des auxiliaires africains, ce qui conduit à aménager le régime répressif dans un système de « domination sans hégémonie ». La colonne vertébrale de ce système, la justice indigène, est quant à elle au cœur des critiques contre l'ordre colonial, mais elle est aussi le lieu où se renégocient les rapports de pouvoir et où s'exposent les conflits sociaux en situation coloniale. Le parcours pénal suivi par les Dahoméens au cours de la première partie du XXe siècle apparaît comme un reflet déformé, et même transformé d'un projet répressif dominé par le souci de maintien de l'ordre mais relativement informe.

Au cours du processus de socialisation, les enfants apprennent progressivement à résoudre les problèmes liés au fait qu'ils vivent avec d'autres personnes et par conséquent dépendent d'elles. Les infractions et les délinquants, la criminalisation et les peines constituent des problèmes de contrôle qu'ils doivent parvenir à comprendre. Les jugements moraux des enfants sur les infractions et les délinquants sont fondés sur la réalité. Cependant l'imagination est introduite en tant que moyen additionnel de contrôle social pour élucider les processus impliqués dans la socialisation juridique. Ces processus sont décrits comme l'incorporation d'un capital moral par la discussion de l'amalgame manifeste de connaissance et d'imagination concernant les infractions et les délinquants dans le contexte du capital moral. L'auteur soutient dans cet article comme dans d'autres publications que l'on doit ajouter le concept de capital moral aux trois types de capital ou de pouvoir symbolique - économique, culturel et social - introduits par Bourdieu. Ces arguments sont illustrés empiriquement par les jugements moraux formulés par des enfants (de 11 à 13 ans) sur les infractions et les délinquants. Les données utilisées, qui proviennent de compositions écrites ou de réponses à des questionnaires, ont été recueillies au cours de la première moitié des années soixante-dix et de la deuxième moitié des années quatre-vingt.
