ПОЛІТИЧНІ ПАРТІЇ ТА СВОБОДА ОБ'ЄДНАННЯ: ПРОБЛЕМИ ТЕРМІНОЛОГІЇУКРАЇНСЬКОЇ НАУКИ КОНСТИТУЦІЙНОГО ПРАВАЗміст конституційного права на свободу об'єднання в політичні партії в Україні є одним з елементів цьогосуб'єктивного права. Традиційно структура будь-якого суб'єктивного права аналізується за складом суб'єктівцього права, його об'єкта (об'єктів), а також змісту. При цьому конституційні суб'єктивні права не є винятком.Автор підкреслює, що такий підхід цілком виправданий і його слід дотримуватися.Досліджуючи зміст конституційного права на свободу об'єднання в політичні партії в Україні, постає питан-ня щодо розмежування понять «об'єднання» та «асоціація». Актуальність теми дослідження полягає в тому, щонаразі в Україні тривають євроінтеграційні процеси, які передбачають гармонізацію національного законодав-ства зі стандартами прав людини, прийнятими в ЄС. Саме в межах цих процесів автор аналізує та обґрунтовуєнеобхідність переходу до ширшого застосування поняття «асоціація» в національному законодавстві та україн-ській юридичній літературі.Дотепер фахівці з конституційного права не аналізували питання розмежування понять «асоціація» та «об'єд-нання» в контексті дослідження права на свободу об'єднання в політичні партії в Україні. З огляду на це, під часнаписання статті використано праці, присвячені загальним питанням теорії держави і права (зокрема, розробціпрофесорів Крестовської, Матвєєвої), а також загальним питанням конституційного права з точки зору суб'єктив-них прав (зокрема, розробки професорів Шаповала, Мішиної).Автор аргументує, що необхідно розрізняти поняття «асоціація» та «об'єднання» стосовно конституційногоправа на свободу об'єднань у політичні партії щодо України.Автор рекомендує відмовитися від використання поняття «об'єднання громадян» на користь поняття «асо-ціація» у ст. 36–37 Конституції України та привести у відповідність до Конституції України інші закони та під-законні акти, зокрема Закон «Про політичні партії в Україні», де у ст. 2 «Поняття політичної партії» надаєтьсятаке визначення. Перспективами подальших досліджень є використання того ж тезаурусу, який використовуютьіноземні науковці, які працюють у країнах ЄС, вивчаючи право на свободу об'єднання в політичні партії. ; The content of the constitutional right to freedom of association in political parties in Ukraine is one of the elementsof this subjective right. Traditionally, the structure of any subjective right is analyzed in the composition of the subjectsof this right, its object (objects), as well as the content, and constitutional subjective rights are not an exception to thisrule. It should be emphasized that this approach is fully justified and should be followed. In studying the content of theconstitutional right to freedom of association in political parties in Ukraine, the question of distinguishing between theconcepts of "union" and "association" arises.The relevance of the research topic is that European integration processes are currently underway in Ukraine,which provide for the harmonization of national legislation with human rights standards adopted in the EU. It is withinthese processes that the author analyzes and substantiates the need to move to a wider application of the concept of"association" in national legislation and Ukrainian legal literature.So far, experts in constitutional law have not analyzed the issue of distinguishing between the concepts of "union"and "association" in the context of the study of the right to freedom of association in political parties in Ukraine. Inthis regard, in writing the article used works devoted mainly to general issues of the theory of state and law (primarilythe development of professors Krestovskaya, Matveeva), as well as general issues of constitutional law in terms ofsubjective rights (primarily developed by professors Shapoval, Mishyna). We should also take into the account thedissertation for the degree of Candidate of Law, devoted to the constitutional right to unite in political parties, that wassubmitted by A.M. Moiseev on the materials of foreign law and case law.The author argues that the need to distinguish between the concepts of "union" and "association" in relation to theconstitutional right to freedom of association in political parties in Ukraine.The author recommends to abandon the use of the concept of "association of citizens" in favor of the concept of"association" in Art. 36-37 of the Constitution of Ukraine and bring other laws and bylaws in line with the Constitutionof Ukraine, first of all – the Law "On Political Parties in Ukraine", where in Art. 2 "The concept of a political party"gives this definition. Prospects for further research are to use the same thesaurus used by foreign scholars working inEU countries when studying the right to freedom of association in political parties in Ukraine

Das Engagement von Christen in politischen Parteien

Dafür, dass Christen sich auch in Parteien organisieren sollen, so der Verfasser, spricht, dass Parteien die zentrale Verbindung zwischen der Zivilgesellschaft, in der Kirchen und christliche Organisationen vorwiegend wirken, und dem staatlichen Bereich von Parlamenten und Regierungen darstellen. Zivilgesellschaftliche Akteure können zwar durch Beeinflussung der öffentlichen Meinung, politisches Lobbying, Demonstrationen oder Petitionen auf die politische Willensbildung Einfluss nehmen, der tatsächliche Einfluss hängt aber wesentlich davon ab, ob zivilgesellschaftliches Engagement auch von Parteien und im staatlichen Sektor rezipiert wird. So haben lokale Bürgerinitiativen im Umweltbereich die Erfahrung gemacht, dass nicht nur eine überregionale Zusammenarbeit auf der nationalen politischen Bühne ausreicht, um ihre Ziele zu erreichen, sondern dass man die Gründung von Parteien (Die Grünen), die Mitarbeit in Parlamenten und darüber hinaus in Regierungen benötigt, um eigene Ziele durchzusetzen. Für Christen bleibt Politik, so die These, immer etwas Vorläufiges und Relatives. Sie werden daher politische Ideologien mit umfassendem Weltanschauungscharakter und Erlösungsanspruch zurückweisen. Solche Ansprüche können sie aufgrund der christlichen Anthropologie, die um die Anfälligkeit der Menschen für sachliche und moralische Irrtümer weiß, nicht annehmen. Weiterhin sollte der christliche Glaube politisch handelnde Christen ermuntern, über die Vertretung ihrer eigenen Interessen hinauszugehen und sich durch einen Gerechtigkeitssinn auszuzeichnen, der die Interessen anderer, auch von Nichtwählern, z. B. kommender Generationen, Ausländer, der 'Dritten Welt', einbezieht. Das Handeln von Christen in der Politik steht unter dem Selbstanspruch, einen Beitrag zu größerer Gerechtigkeit in der Gesellschaft zu leisten. (ICF2)

New Political Parties as Innovators - Formation and Success
This cumulative dissertation investigates the formation and success of new political parties in developed democracies from the perspective of the programmatic competition between parties (see. introduction in chapter 1). It starts by arguing that the current state of the programmatic supply by existing parties is a central determinant for the likelihood of new party formation (chapter 2). A low programmatic diversity of existing parties creates scope for programmatic innovations by new parties. The dissertation establishes a connection between the literature on new parties and niche parties by analyzing the latter as typical cases of innovating new parties (chapter 3). For this purpose, the author combines two concepts with corresponding measures in order to capture the programmatic profiles of parties. Nicheness refers to differences in the emphasis of topics between a given party and its counterparts while programmatic concentration shows the narrowness of a given policy profile. Chapter 4 investigates how the variation in the programmatic profiles of niche parties affect their long-term electoral performance. Previous studies on niche parties have not fully taken into account the evolutionary aspect of the programmatic profiles of these parties. Acknowledging the variation in programmatic profiles between niche parties and over time, the article argues that the electoral effects of nicheness and programmatic concentration as programmatic features of niche parties vary over their lifecycle. The literature on new parties assumes that they can benefit from the poor representation of parts of the electorate by existing parties. This strand of research provides plausible results, but it operates on the macro level, which is problematic for theoretical and methodological reasons. The study in chapter 5 overcomes these problems through a multilevel analysis of the vote choice between new parties, existing parties and abstention.

LEGAL PRINCIPLES OF PARTICIPATION OF UKRAINIAN POLITICAL PARTIES IN THE ELECTION PROCESS
It has been found that in the 21st century, political parties play an important role in the political processes of society, forming political power in a representative democracy. Qualitative development of political parties is possible with proper legal support, which allows ruling and opposition political parties to participate in electoral processes on a democratic basis. It is determined that crucial for a proper understanding of the basic principles of political party participation in electoral processes is that they should in no way be seen as a means of imposing excessive restrictions on political parties respecting the right of citizens to hold political office, personally or as political party representatives. It is substantiated that political parties perform an important representative function during their activity. The main task of political parties is to participate in the formation of the political will of the people through the electoral process and the implementation of a certain political course. It is proposed to consider political parties as organizations that have united certain individuals, one of whose goals is to participate in the management of public affairs through the nomination of candidates in free and democratic elections. It was found that in countries where national law does not require the registration of political parties, a political party is still subject to certain requirements for their participation in the electoral process. There is a tendency towards a more liberal approach to the requirements of the functioning of political parties of power to developed classical European democracies. At the same time, the democracies of Central and Eastern Europe are characterized by greater bureaucratization and formalized requirements for state registration and participation of political parties in the electoral process.

Die politischen Parteien in der Schweiz verfügen über einen beträchtlichen Einfluß auf die direkte Demokratie. Die Untersuchung wird in systematischer Analyse und zehn empirischen Fallstudien über Volksinitiativen und Referenden durchgeführt. Die vergleichende Studie zeigt, daß die Parteien im Initiativ- und Referendumsprozeß in den US-Bundesstaaten fast bedeutungslos sind, während sie in den Volksbegehren und Volksentscheiden in den deutschen Bundesländern eine wichtige Rolle spielen. ; Political parties in Switzerland exert a considerable influence on direct democracy. The examination is carried out in systematical analysis and ten empirical case studies on popular initiatives and referendums. The comparative study indicates, that parties are insignificant in the initiative and referendum process in the US states, whereas they play an important role for initiatives and referendums in the German states.
