Femicide, is a type of crime prescriptive at the Law 1761 of 2015, whose purpose is to punish the deaths of women for reasons of gender. The promulgation of this Law, obeyed the need to create mechanisms to protect women, who were being murdered only because they belong to the female gender. However, in some sectors of the doctrine, national and international, they see this figure as another case of punitive populism, since they state that it was not necessary to create a new type of crime, since it existed as an aggravating for the murder, within the internal legislation. On this way, the general objective of this article is to explain why the criminal type of femicide is not a case of punitive populism; this will be achieved by evidencing the advances of Colombian criminal legislation regarding the sanction and treatment of issues related to gender-based violence, as well as identifying the causes that cause the crime of femicide to denote its importance within the legislation beyond any punitive populism. ; El feminicidio, es un tipo penal consagrado en la Ley 1761 de 2015, cuyo propósito es el de sancionar las muertes de mujeres por motivos de género. La promulgación de esta Ley, obedeció a la necesidad de crear mecanismos que protegieran a las mujeres, que estaban siendo asesinadas simplemente por el hecho de pertenecer al género femenino. No obstante, en algunos sectores de la doctrina, nacional e internacional, ven esta figura como un caso más de populismo punitivo, puesto que, manifiestan que no era necesario crear un tipo penal autónomo, ya que existía como agravante del homicidio, dentro de la legislación interna. En vista de ello, el objetivo general de este artículo es explicar por qué el tipo penal del feminicidio no es un caso de populismo punitivo; esto se logrará evidenciando los avances de la legislación penal colombiana en cuanto a la sanción y tratamiento de temas concernientes a la violencia basada en género, asimismo identificar las causas que ocasionan el delito de feminicidio para denotar su importancia dentro de la legislación, para demostrar que no se está frente a otro caso más de populismo punitivo.
The growth of the so-called punitive populism and symbolic criminal law in Colombian legislation, the lack of effectiveness in drawing up the State's criminal policy and the sterility of the results in the reduction of crime are analyzed, with the correlative hardening of penalties and their instrumentalization. The aim is to determine whether there is legal certainty with symbolic criminal law and punitive populism, and whether they respond to the functions of punishment. The method used is descriptive, bibliographic in scope and uses secondary sources of information, selected from reliable databases. After compiling all the information, it is concluded that the implementation of these two concepts does not guarantee a reduction in the crime rate, due to the fact that they are based on legislative irresponsibility, which do not serve to prevent and control crime, but do generate a feeling of tranquility and illusion in the community, and do not respond to the functions of the penalty outlined in the Colombian legal system. ; Se analiza el crecimiento del llamado populismo punitivo y derecho penal simbólico en la legislación colombiana, la falta de eficacia a la hora de trazar la política criminal por parte del Estado y la esterilidad de los resultados en la disminución de la criminalidad, con el correlativo endurecimiento de las penas e instrumentalización de las mismas. Se busca determinar si existe seguridad jurídica con el derecho penal simbólico y el populismo punitivo; así como si los mismos responden a las funciones de la pena. El método utilizado es de alcance descriptivo, bibliográfico y se utilizan fuentes de información secundarias, seleccionadas de bases de datos confiables. Una vez recopilada toda la información se concluye que, con la implementación de estos dos conceptos no se garantiza la baja en el índice de criminalidad, debido a que se parte de una irresponsabilidad legislativa, las cuales no sirven para prevenir y controlar la criminalidad, pero si generan un sentimiento de tranquilidad e ilusión en la colectividad, no respondiendo los mismos a las funciones de la pena trazadas en el ordenamiento jurídico colombiano.

Los distintos movimientos que hoy en día conocemos como nacionalpopulistas han estado marcados, desde sus inicios, por un particular vínculo con el discurso conspirativo. En realidad, la relación entre las teorías de la conspiración y la extrema derecha tiene una larga historia. Sin embargo, en tanto que estos movimientos representan, como esta comunicación pretende sostener, un fenómeno de tipo nuevo y en relación con tendencias de gran actualidad, el discurso conspirativo toma en su interior un papel igualmente actualizado en relación con las reivindicaciones nacionalpopulistas y el contexto de abstracción e irrepresentabilidad de las fuerzas del capital global actual. De la mano del concepto de "mapas cognitivos" de Fredric Jameson, esta comunicación tratará de mostrar por qué el discurso conspirativo se ha mostrado tan resiliente y eficaz al interior de estos movimientos, y a qué desafíos de representación e imaginación política nos aboca ; The variety of movements that nowadays we call national populism has been tainted, since their beginnings, by a particular link with conspiracist discourse. Actually, the relation between conspiracy theory and the far right is one with a long history. However, given the fact that this movements represent, as this intervention aims to defend, a phenomenon of a new kind and tied up with present tendencies, conspiracy discourse plays a role equally updated in relation with National Populism's claims and the context of abstraction and irrepresentability of present global capital forces. Using Fredric Jameson's concept of "cognitive mapping", this intervention will try to show why conspiracy discourse has proven itself this resilient and efficient among this kind of movement, and what challenges of political representation and imagination it conveys
Abstract:Nobody doubts that present populism has spurred sentiments of hope and concern. Even among those who react hopefully, it seems necessary to take others´ concern seriously. In effect, present populism shakes a state of affairs that once seemed unmodifiable. It is therefore worth trying to understand it.In this context, this work aims at a double purpose. In the first place, we will afford the problem of conceptualizing populism, through a two-fold strategy. On the one hand, we will approach the main historical instantiations of populism, in view of displaying its heterogeneous nature. On the other hand, this heterogeneity reveals itself in a variety of intents of conceptualization, which explains the convenience of focusing our own conceptualization on only some of its main features: its causes, its reactive nature, the charismatic leader, and the people underlying it. This two-fold strategy will allow us to prove that discussions concerning populism have reached a dead end, and we propose a way of surpassing it. The second purpose of this study is to understand the way in which populism threatens present liberal democracies. After discussing some of the available levels of analysis, we present an alternative methodology, intending to reach the core of the problem: populism is, above all, a sign of the problems of our own understanding of the realm of politics, that which is a part of our imaginary and takes root in modern thought. ; Resumen:Nadie duda que los actuales fenómenos populistas han generado esperanza en unos y preocupación en otros. Incluso entre quienes genera esperanza parece necesario tomarse en serio la preocupación ajena. En este punto, el populismo actual supone negar un estado de cosas que parecía inconmovible. De ahí que valga la pena hacer un esfuerzo por comprenderlo. En este sentido, el propósito de este trabajo es doble. En primer lugar, vamos a afrontar el problema de la conceptualización del populismo. Para eso se sigue un doble acceso. Por un lado, se pretende mostrar la heterogeneidad de los populismos mediante una aproximación, a través de los estudios más canónicos, a sus principales manifestaciones históricas. Por otro lado, dicha heterogeneidad se manifiesta también en los intentos de caracterizarlo. A este respecto, la literatura académica es tan abundante y los rasgos que se le han dado son tan numerosos, que nos centraremos en algunos elementos fundamentales. En concreto, la cuestión de sus causas, su condición de fenómeno reactivo (o anti), la figura central del líder carismático populista y la comprensión del pueblo que subyace. Con esta doble vía de acceso al problema se pretende mostrar que el debate ha llegado a un callejón sin salida y se propone una manera operativa de evitarlo. Las dificultades de su conceptualización dan la medida del segundo propósito de estas líneas. Y es que como parece inasible, se hace más perentorio comprender bien cómo el populismo presente desafía las democracias liberales contemporáneas. Este reto ha sido analizado de nuevo de manera abundante. Tras mostrar algunos ejemplos de los distintos niveles de análisis posibles, se presenta uno propio que intenta llegar al fondo de la cuestión: el populismo es ante todo un síntoma de las dificultades de nuestra comprensión de lo político, de esa que forma parte de nuestro imaginario y que hunde sus raíces en el pensamiento moderno. Desde la llegada al poder de Rafael Correa, Ecuador ha experimentado una serie de cambios sustanciales en su régimen político. Algunos de esas transformaciones así como elementos discursivos del presidente, sugieren que se trata de un gobierno populista. Tomando en cuenta que Ecuador es una joven democracia en vías de consolidación, resulta relevante indagar acerca del populismo como vehículo legítimo para la consolidación del régimen democrático. Por ello, el artículo presenta una reflexión acerca de la forma como el populismo tiende a convertirse en un eje de la consolidación democrática ecuatoriana al margen de las acepciones peyorativas que el término suscita. ; Ecuador has experienced a set of substantial changes in his political regime since Rafael Correa administration from 2007. Some of these transformations, as well as some aspects from his speech, make him a populist government. Taking in consideration that Ecuador is a "young democracy" in consolidation process, it is important to analyze how populism could be a tool for democratic consolidation. Therefore, this article studies how populism tends to become an axis for democratic consolidation in Ecuador, beyond the controversy that the term populism provokes.
Populism is a concept that has gained much relevance in the daily discussion and in academic research in recent years. The present paper is a meta-theorical analysis of recent literature in comparative politics on populism. It is found that defining populism generates ample debate in the literature. This debate may have increased during the last five years, due to recent events around the world, e.g.: the presidency of Donald Trump in the United States. It is argued that the main difficulty of defining, and from there, operationalizing and measuring this concept is found in its ideational natures, which is subjective and intersubjective. The study of ideas is very common from the perspective of those who identify themselves with hermeneutics. Instead, empiricist studies have found it difficult to adapt that nature to their analysis schemes. However, recent research on populism in comparative politics seems to be moving towards the study of its complex and ideational nature. ; El populismo es un concepto que ha ganado mucha relevancia en la discusión diaria y en la investigación académica en años recientes. El presente es un análisis metateórico de la literatura reciente en política comparada sobre populismo. Se encuentra que definir qué es populismo genera un amplio debate en la literatura. Este debate puede haber aumentado durante el último lustro, a partir de eventos recientes alrededor del mundo, como la presidencia de Donald Trump en Estados Unidos. Se argumenta que la principal dificultado para definir y, a partir de allí, operacionalizar y medir este concepto se encuentra en su naturaleza ideacional; es decir, subjetiva e intersubjetiva. El estudio de las ideas es muy común desde el punto de vista de quienes se identifican con la hermenéutica. En cambio, los estudios empiristas han encontrado difícil adaptar esa naturaleza a sus esquemas de análisis. Empero, la investigación sobre populismo en política comparada parece enrumbarse hacia el estudio de su naturaleza compleja e ideacional.
Este artículo se ocupa del fenómeno contemporáneo de los "nuevos populismos" y trata de esclarecer la lógica que comparten las correspondientes formaciones políticas. A tal fin, en primer lugar se exploran los orígenes históricos del populismo en los albores de la primera globalización. En segundo lugar, se analiza la confusión populista actual a partir de la contraposición de "ciudadano" y "súbdito", así como del concepto de representación parlamentaria. Por último, se compara la tradición republicana de defensa de la política con la idiocia -en sentido griego- tanto del neoliberalismo como de los nuevos populismos y sus diversas manifestaciones ; This paper deals with the contemporary phenomenon which the concept "new populisms" refers to and examines the logic shared by the corresponding political formations. Firstly, I explore the historic origins of populism in the dawn of globalization. Secondly, the current populist confusion is analysed through the contrast between the figure of the citizen and that of the subject, as well as from the point of view of parliamentary representation. En el marco de los debates sobre los procesos políticos actuales en América Latina, este trabajo presenta un análisis crítico del artículo «La democracia en América Latina: la alternativa entre populismo y democracia deliberativa» de O. Guariglia. La lectura del trabajo nos permite mostrar las limitaciones de la argumentación. Por un lado porque no confronta una posición normativa de la democracia deliberativa contra otra concepción normativa que defendería el populismo (en la obra de E. Laclau). Por otro lado, porque las evidencias empíricas sobre los populismos realmente existentes son escasas e imprecisas. Estos límites sin embargo contribuyen al debate porque reavivan la controversia sobre ¿qué democracia? Y habilitan distintas preguntas como ¿Qué conceptos normativos de democracia están presentes en la región? ¿cuáles han sido los alcances de los procesos políticos en América Latina bajo gobiernos «populistas» en el siglo XIX? ¿Qué posibilidades reales hay de democratizar órdenes sociales atravesados por profundas desigualdades como las de los países latinoamericanos?. Las respuestas a estos interrogantes pueden elaborarse desde distintas miradas que aportan pluralidad al debate. ; In the context of discussions on political processes in Latin America, this paper presents a critical analysis about the article «Democracy in Latin America: between populism and deliberative democracy» by O. Guariglia. Reading the work allows us to show the limitations of argumentation. On the one hand because it no confronts a normative position of deliberative democracy against other normative conception would defend populism (in the work of E. Laclau). Furthermore, because the empirical evidence on populism actually existing are few and imprecise. These limits however contribute to the debate because it revived the discussion about what democracy? And open several questions such as: What are normative concepts of democracy in the region? What have been the implications of political processes in Latin America under governments «populist» in the xxi century? Are there real possibilities of democratizing social orders that are crossed by deep inequalities as Latin American? The answers to these questions can be made from different perspectives.
Se reconstruye uno de los debates acerca de las independencias hispanoamericanas, en torno a las doctrinas populistas de soberanía. Para ello se rastrea la primera obra que postuló la tesis de su influencia (el trabajo de Manuel Giménez Fernández) y luego se revisan los textos que se preguntaron por las influencias teóricas en los procesos independentistas, así como otros trabajos que hicieron énfasis en la discusión teórica de las doctrinas y sus alcances. Por último, se revisa la historiografía actual que prioriza el análisis de las culturas políticas y los imaginarios colectivos, en lugar de retomar el debate en torno a influencias ilustradas o escolásticas. ; This work analyses one of the debates concerning the Spanish-American independences, that one around the philosophical influences of them, especially, of the populist doctrines of sovereignty. We seek the work of Manuel Giménez Fernandez's, the first who postulated the above mentioned thesis; then we analyses the texts that studied the independence processes, and asked about the influences, as well as other works that inside the same record, did emphasis in the theoretical discussion of the doctrines. The article examines the populist tradition in Peru's political development over the last fifty years, seeking to draw attention to some of the continuities in the political practice of successive regimes, albeit ones of different ideological orientations. In so doing, it seeks to define 'populism' as a style of government which links the rulers with the ruled bypassing representative systems of political mediation. Whilst typically populism emerges at moment of economic and political crisis, when representative institutions fail lo provide solutions lo popular demands, it also reflects the longstanding weakness of such institutions in Peru this century. Despite the very different orientation of their economic policies, the political methods of the Garcia and Fujimori governments have more in common than is often believed. These continuities reflect, in part, the chasm dividing the state and the rest of society. ; Este artículo examina la tradición populista en el desarrollo político del Perú durante los últimos 50 años. Resalta algunas de las continuidades m la práctica política de los regímenes correspondientes, a pesar de sus distintas orientaciones ideológicas. En este afán, busca definir el 'populismo' como un estilo de gobierno que vincula a los gobernantes con los gobernados, ignorando los sistemas representativos de mediación política. Aunque el populismo suele emerger en momentos de crisis económica y política, cuando las instituciones representativas dejan de proveer soluciones a las demandas populares, también refleja la debilidad permanente de estas instituciones en el Perú a lo largo del siglo. A pesar de las distintas orientaciones de las políticas económicas de los gobiernos de García y Fujimori, la forma de hacer política de ambos es más similar de lo que convencionalmente se cree. Estas continuidades reflejan en parte, el gran abismo que existe entre el Estado y el resto de la sociedad.

Actualmente hay un uso recurrente del Derecho Penal como instrumento estatal para enfrentar conflictos sociales variados. Modificaciones legislativas son hechas sin consideración a su necesidad y eficacia y se busca satisfacer intereses particulares, no la solución de conflictos sociales. Un actor de primer orden, aunque no el único, en el uso excesivo del Derecho Penal está constituido por los políticos, que, en busca de prestigio político con fines electorales, continuamente formulan propuestas de reforma legal que aumentan el campo de acción del Derecho Penal. Este aumento genera consecuencias negativas como sobrecarga de trabajo y un mayor desprestigio a una ya congestionada y bastante desacreditada justicia penal. Esta tendencia, denominada populismo penal, será estudiada en relación con su existencia en Colombia y la delincuencia sexual. ; Nowadays there is an overuse of criminal law as a state mechanism to confront social conflicts of diverse nature. Changes on legislation are being made without taking into account its necessity and efficacy and such reforms mean to satisfy particular interests and not to resolve social conflicts. Politicians are main actors in this growing process, although not the only ones, who in seek of political prestige in order to obtain electoral benefits continuously propose legal modifications that are broadening the social area subject to criminal law. This overuse of criminal law has negative consequences such as more work overload to a currently overburdened system and an increase in the bad reputation of at the present discredited branch of justice. This legislative tendency, named as penal populism, will be studied in regard to its existence in Colombia and sexual delinquency.
