En 1980 se daba a conocer el nombre de una red de vigilancia masiva e indiscriminada, centrada en las comunicaciones del ámbito civil, y operada principalmente por la Agencia Nacional de Seguridad de los EE.UU: ECHELON. En los años siguientes, en parte gracias a una investigación oficial realizada por el Parlamento Europeo, se corroboró su existencia, se detalló su funcionamiento y extensión y se cuestionó su legitimidad. En 2001, tras los atentados de las Torres Gemelas y la aprobación de la ley USA PATRIOT, esta red alcanzó una magnitud que tan sólo se ha comenzado a vislumbrar al divulgarse algunos de los documentos de Snowden. Ante la probable existencia de otros sistemas similares operados por otros países, posiblemente con intereses globales más lesivos, es imperativo reflexionar sobre su necesidad, su eficacia y su encaje con la defensa de los derechos básicos de privacidad ; In 1980, an indiscriminate mass surveillance system specialized in intercepting civil communications, was disclosed to the public under the name ECHELON. The following years, in part due to an official investigation led by the European Parliament, this system was deemed as real, being its operating mode further detailed while calling onto question its legitimacy. In 2001, following the World Trade Centre terror attacks and the subsequent passing of the USA PATRIOT Act, the mass surveillance system reached a magnitude that has only just begun to appear in sight after the disclosure of several Snowden documents. Given the probable existence of similar systems run by other countries, perhaps with more harmful intentions, it is imperative to consider appropriately the real need for these systems, their effectiveness and monitor the protection of the right to privacy
This article is an analysis of three journalistic accounts of the leaking of documents from the United States National Security Agency, done by Edward Snowden: a book, a movie, and an interview. The goal is to bring to light some ethical and political dilemmas underlying the case. First, a paradoxical tension between the demand for transparency versus the state's secrecy and the need of personal secrecy for the right to privacy, which nowadays reflects the publicity versus secrecy dialectic in early modernity. Second, the hack-activist ethic facing the conflicts between anonymity and visibility. Third, the journalists trusted by Snowden confront the dilemma between the obligations of information and the protection of source confidentiality. The Snowden affair is thus an opportunity to learn some lessons about the ethics of communication in the digital age. ; Este artículo es un análisis de tres relatos periodísticos de la filtración de documentos de la Agencia Nacional de Seguridad (NSA) de Estados Unidos, llevada a cabo por Edward Snowden: un libro, una película y una entrevista. El objetivo es sacar a la luz algunos dilemas éticos y políticos que subyacen al caso. Primero, una tensión paradójica entre la exigencia de transparencia frente al secreto estatal y la necesidad del secreto personal para el derecho a la privacidad, que refleja en nuestros tiempos la dialéctica publicidad / secreto en la modernidad temprana. Segundo, la ética hack-activista enfrenta los conflictos entre anonimato y visibilidad. Tercero, los periodistas en que Snowden confía afrontan el dilema entre los deberes de la información y la protección de la confidencialidad de las fuentes. El asunto Snowden es, pues, una oportunidad para extraer algunas lecciones sobre la ética de la comunicación en la era digital.
We seek to illustrate, from Mexican contemporary context, how some women use their bodies as a way to protest against various forms of oppression. The exhibitionism of female intimacy becomes a way of empowering to say "NO" to the prevailing obscurantism and to shout what their desire to live freely. Is through activism both in the virtual space and public places we will analyze these acts of rebellion that link the intimate space to the political actions. ; A partir del contexto contemporáneo mexicano se busca ilustrar cómo a través de su cuerpo algunas mujeres van protestando en contra de diversas formas de opresión. El exhibicionismo de la intimidad femenina se vuelve un estilo de empoderamiento para decir "NO" desde las entrañas al oscurantismo imperante y para gritar su deseo de vivir libre. A través del activismo tanto en el espacio virtual que en las plazas públicas analizaremos estos actos de rebeldía que unen lo íntimo a lo político.
El artículo publicado en 1890 por Warren y Brandeis en la Harvard Law Review bajo el título «The Right to Privacy», es considerado el ensayo fundacional de la protección de la privacidad en los Estados Unidos y el artículo doctrinal más influyente de la literatura jurídica norteamericana. Sin duda su influencia ha sido incuestionable, ha originado la preocupación colectiva por el reconocimiento y garantía de la esfera privada, ha generado al menos cuatro acciones civiles para su protección y ha encuadrado y fundamentado el discurso constitucional del derecho a la privacidad en los Estados Unidos durante todo el siglo XX. Sin embargo, en la concepción formulada por Warren y Brandeis en «The Right to Privacy»no cabe reconocer exclusivamente una dimensión individual o subjetiva, antes al contrario, su defensa de la privacidad presenta igualmente una dimensión colectiva y social que coadyuva al mantenimiento y avance del sistema democrático, pues, en última instancia, la privacidad contribuye a establecer los límites del control estatal sobre los individuos y a definir el atributo esencial de la ciudadanía.The article published in 1890 by Warren and Brandeis in the Harvard Law Review entitled «The Right to Privacy», is considered the foundational essay of the protection of privacy in the United States and the most influential law review article of the American legal literature. Indeed, its influence has been unquestionable, has led to the collective concern for the recognition and guarantee of privacy, has generated at least four civil actions for their protection and has framed and substantiated the constitutional discourse of the right to privacy in the United States throughout the twentieth century. However, in the design made by Warren and Brandeis in «The Right to Privacy» can be recognized not only an individual or subjective dimension, but also a collective and social that contributes to the maintenance and advancement of the democratic system, since, ultimately, privacy helps set the limits of state control over individuals and to define the essential attribute of citizenship.
As Pavis (2016) argues, privacy has resurfaced in different forms and names in the current theatre. This work breaks down some of these forms of privacy and emotion in theatre studies, and then analyse their presence and articulation in the monologists of two works by Sasha Marianna Salzmann (n.1985): Muttersprache Mameloschn (2011) and Meteoriten (2016). The examination of Salzmann's modestes — who is one of the representatives of the so-called post-migrant theatre in Germany — shows that privacy in their works is not only about reversing the economy of the representativeness of minorities in a multicultural society. The emotion here abandons its traditional association with 'pathos' and 'inability to act' (Didi-Huberman 2016) and represents a form of political activism, building theatre as the smallest cell of a fairer society (Salzmann 2015). The regulation of the British press is undergoing a major process of reform after the biggest scandal of phone hacking carried out by journalists from the tabloid News of the World broke in July 2011. This finding has uncovered a complex network of connections among the press, the police and politicians in the UK. After several months of investigation, the Leveson Inquiry into the culture, practices and ethics of the press has made numerous proposals in order for the press to be covered by a new independent self— regulatory regime leading to the ethical practice of journalism and guaranteeing the rights of persons who draw the attention of the media. ; La regulación de la prensa británica se halla en pleno proceso de reforma a raíz del descubrimiento en julio de 2011 del mayor escándalo de escuchas ilegales practicadas por los periodistas del tabloide News of the World. Este trabajo posee el objetivo de analizar las medidas legislativas implementadas por Colombia en torno al amparo de los datos personales en Internet. La metodología está desarrollada en un enfoque cualitativo y bajo un método descriptivo en el cual se estudia un fenómeno jurídico actual. Por otro lado, los resultados indican que existen diferentes medidas legislativas como por ejemplo las tipologías de datos y la Ley 1581 de 2012 es la que reglamenta y desarrolla este derecho constitucional a excepción de lo consagrado en los literales del artículo 2 de la misma ley y la de lo estipulado en la Ley 1266 de 2008 y 79 de 1993. Así mismo, se concluye que en cuanto a la obtención de los datos personales por Internet se debe a procesos informáticos como la captura, mercado, el consumo que generan las empresas e instituciones que se dedican al tratamiento de la información ya sea como datos públicos o de mercadeo. Igualmente, Colombia tiene diferentes desafíos como la práctica internacional, pues en este campo es un factor importante y complementario en la formulación de directrices para la supervisión de los datos de protección personal, el derecho a la Información y privacidad personal. ; This work has the objective of analyzing the legislative measures implemented by Colombia regarding the protection of personal data on the Internet. The methodology is developed in a qualitative approach and under a descriptive method in which a current legal phenomenon is studied. On the other hand, the results indicate that there are different legislative measures such as data typologies and Law 1581 of 2012 is the one that regulates and develops this constitutional right except for what is enshrined in the literals of article 2 of the same law and that of what is stipulated in Law 1266 of 2008 and 79 of 1993. Likewise, it is concluded that in terms of obtaining personal data over the Internet it is due to computerized processes such as capture, market, consumption generated by companies and Institutions that are dedicated to the treatment of information either as public or marketing data. Likewise, Colombia has different challenges such as international practice, since in this field it is an important and complementary factor in the formulation of guidelines for the supervision of personal protection data, the right to Information and personal privacy.
While drone technology (from now on Unmanned Aircraft Systems or UAS) is not a novelty in the military world and it has been broadly documented, during the last years there has been an unexpected sales increase in this kind of equipment, now for civil, recreation and entertainment purposes. This has generated unprecedented legal problems, especially from the privacy point of view, which has made countries like United States to limit the use of UAS. This article aims to analyze the intimacy and privacy rights in the use of UAS from the United States and Colombian point of view, stating conclusions and possible paths to follow. ; Si bien la tecnología de los drones (desde ahora Unmaned Aircraft Systems o UAS) no es nueva en el mundo militar y se encuentra ampliamente documentada, en los últimos años se ha dado un inesperado incremento en la venta de este tipo de equipos, ahora destinados a actividades civiles o para recreación y entretenimiento. Esto ha generado problemas jurídicos sin precedentes, especialmente desde el punto de vista de la privacidad, que han hecho necesario que países como Estados Unidos limiten el uso de UAS. El presente artículo tiene como objetivo hacer un análisis del derecho a la intimidad y la privacidad en el uso de los UAS desde la óptica estadounidense y colombiana, planteando conclusiones y posibles caminos a seguir.
This paper refers to genetic testing in the workplace. From the perspective of the worker´s fundamental rights, genetic testing is debatable. It provides information that is relevant for the prevention of labour-related risks and thus contributes to the protection of the worker´s rights to life and limb and mental health. However, genetic testing may violate the worker´s rights of privacy and to non-discriminatory treatment. Also, it is necessary to assess the effects of genetic testing in the rights of other right-holders, like the employer and the State. Considering the lack of specific legislation on this matter in Chile, the author, building on the ex-isting law on fundamental rights, proposes some ways of protecting and integrating these rights. ; Este trabajo se ocupa de las exploraciones genéticas en el ámbito laboral. Desde la perspectiva de los derechos fundamentales del trabajador, el uso de los análisis genéticos resulta ambivalente: ofrece información relevante para la prevención de riesgos laborales, lo cual favorece la protección del derecho a la vida y a la integridad física y psíquica del trabajador; pero puede lesionar su derecho a la intimidad y su derecho a no ser discriminado. Además, involucra intereses y derechos de otros titulares, como el empresario y el Estado, que es preciso articular. A falta de legislación que establezca un sistema específico de garantías, se desbrozan algunas vías a través de las cuales se podría instrumentar esa protección y articulación de derechos, a partir de una relectura en clave de efectividad de los derechos fundamentales del ordenamiento jurídico vigente.

El origen y evolución del derecho a la protección de datos personales tiene una inequívoca impronta europea. El impacto mundial de esta normativa originariamente europea ha supuesto la proliferación de leyes nacionales de protección de datos en el resto de los continentes y ha obligado a los servicios tecnológicos globales —independientemente de su origen geográfico— a adecuarse a la normativa europea de protección de datos. En particular, estos servicios tecnológicos han tenido que adaptarse a la jurisprudencia del Tribunal de Justicia de la Unión Europea sobre protección de la privacidad en Internet. Este artículo evidenciará el impacto global de esta jurisprudencia y la inevitable fuerza expansiva extra europea de tres renombradas sentencias recientes del TJUE: Caso Digital Rights (Directiva conservación de datos), Caso Google (derecho al olvido) y Caso Facebook (Safe Harbour). Estas sentencias marcan un hito en la evolución de la protección de los datos personales por su impacto mundial y, en consecuencia, por la expansión de los estándares europeos de protección al resto del planeta. ; The origin and evolution of the data protection right has a clear European leadership. The global impact of this originally European legislalion has led to the proliferation of national laws for the protection of data in the rest of the continents and has forced global technology services —regardless of their geographical origin— to adapt to European data protection standards. In particular, these IT services have been adapted to the jurisprudence of the Court of Justice of the European Union on the privacy protection on the Internet. This article will demonstrate the extra European impact of three renowned recent judgments of the Court of Justice of the European Union: Case Digital Rights (Data Retention Directive), Case Google (Right to be Forgotten) and Case Facebook (Safe Harbour). These rulings are a milestone in the evolution of the data protection because of its global impact and, consequently, by the transference of the European standards of data protection to the rest of the planet.
Learning Analytics processes student data, even for students under 18. The analytical cycle consists of collecting data, storing it for long periods and using it for analysis and visualization. The more data, the better the analysis. This analysis can be descriptive, predictive and, even, prescriptive, which involves the management, processing and use of personal data. The educational context is, thus, very sensitive, unlike individual contexts where analysis is used at will. It is not clear how student data are being used by technology companies serving education and who is actually benefiting, how this will affect students in the short and long-term future, or what level of privacy or security is applied to protect student data. Therefore, and in relation to the above, analyzing educational data implies a sensitive and fragile context in the management and analysis of personal data of students, including minors, in which precautions must be maximized. This systematic review of the literature explores the importance of personal data protection and security in the field of education through the emerging promises of those interested in using blockchain technology. The results show that it is important to understand the implications and risks derived from the use of emerging technologies in education, their relationship with society and the current legislation. ; La Analítica del Aprendizaje (proveniente del término en inglés Learning Analytics) procesa los datos de los estudiantes, incluso los estudiantes menores de edad. Introducción: En el presente trabajo realizamos un análisis de la forma en que se ha regulado legalmente en España y sus CCAA el derecho del paciente a la intimidad. El estudio realizado nos lleva a pronunciarnos sobre la norma/s más acertadas en este propósito, para lo cual hemos fijado dos parámetros: en el primero se incluyen aquellas normativas que recogen la protección de la privacidad en base a la confidencialidad de los datos referidos a la salud del paciente, y la protección de la intimidad en lo referido a la esfera corporal del paciente en todo el proceso asistencial, y en el segundo, las garantías que las propias normativas disponen para hacer cumplir los aspectos citados. Hemos valorado en las normativas estudiadas, cual expresa con mayor precisión y garantías la protección de la Intimidad, y si lo ha establecido en base a los dos aspectos propuestos o solo a uno de ellos. En concreto, en razón a la confidencialidad de los datos, o a aspectos como el respeto a los valores culturales, morales y convicciones religiosas, así como la limitación de la presencia de otros profesionales, estudiantes o investigadores, circunstancias, junto a otras, que configuran la protección de los datos de salud personales y la protección de la esfera corporal del paciente. Material y métodos: Hemos realizado el estudio tomando como Ley de referencia La Ley 41/2002, de ámbito estatal, y 17 normas autonómicas, de aquellas Comunidades Autónomas que han legislado al respecto. Se han seleccionado los extremos relativos al contenido en cada normativa del Derecho a la Intimidad, como son la protección de los datos asistenciales y la protección de la esfera corporal y los medios para garantizar la protección del derecho motivo de estudio. Resultados: El resultado ha sido establecer una jerarquía cualitativa respecto a la idoneidad con que se ha redactado la regulación de la intimidad, respecto a los dos parámetros propuestos. Se valora qué norma/as son más efectiva tanto en la claridad y contundencia de su texto, como en la forma en que exigen el cumplimiento del mismo, como derecho fundamental del paciente. Discusión: Se discuten las normas legales entre sí, con los criterios ya expuestos en el apartado anterior. Aunar la protección ambos criterios ofrece mayores garantías de cobertura a este importante derecho fundamental. Conclusión: Como conclusión, consideramos que todas las normas analizadas garantizan de forma suficiente y adecuada el derecho a la intimidad, en general. Pero en los resultados hemos señalado aquellas que lo hacen de una manera más completa, al extender la protección a los dos criterios considerados y a más o menos aspectos de estos criterios. ; Introduction: In this study we analyze how it is legally regulated in Spain and its Autonomous Regions the patient's right to privacy.The study leads us to rule on the standards most successful in this purpose, for which we have set two parameters: the first includes those regulations set out the privacy protection based on the confidentiality of data relating to patient health and protection of privacy with regard to the patient's corporal sphere, throughout the care process, and second, the guarantees have their own regulations to enforce the above elements. We evaluated in the regulations studied, which expresses more accurately and guarantees the protection of Privacy Act, and if it has been established based on two aspects proposed or only one of them. Specifically, due to confidentiality of data, or issues such as respect for cultural values, moral and religious convictions, and limiting the presence of other professionals, students or researchers, circumstances, along with others, making up the protection of health and personal data protection sphere of patient body. Material and Method: We conducted the study taking as reference the statal Law 41/2002, and 17 regional regulations, of those Autonomous Communities that have legislated on the matter. We have selected for the content on each rule of the Right to Privacy, the data protection care and the protection of the corporal sphere to ensure protection of the law being studied Results:The result has been to establish a qualitative hierarchy regarding the adequacy with which it is issued the regulation of privacy with respect to the two proposed parameters. It assesses how standard is more effective in both clarity and forcefulness of his text, as in the way that require compliance with it as a fundamental right of the patient. Discussion: We discuss the legislation with one another, with the criteria already set out in the previous section. The sum of these two criteria provides greater protection guarantees of coverage to this important fundamental right. Conclusions: In conclusion, we believe that all analyzed standards ensure a sufficient and appropriate protection to the right to privacy in general. But the results have pointed out those that do a more complete, to extend protection to the two criteria considered as more or less aspects of these criteria.through this method. A stimulus pattern of 61 hexagons, with changes in luminance that subtends 60° of visual angle, was used. In all the patients, the densities of the recordings were lower than normal. Only in one patient, responses were obtained in all areas stimulated. In the rest, we found unresponsive areas that varied according to the type and severity of the disease. These results show the usefulness of multifocal electroretinography to determine the extent and location of the retinal degeneration of the patients.
El artículo analiza la repercusión en la actividad periodística de las medidas reguladoras aprobadas por parte de Estados Unidos y Europa para proteger la privacidad frente al uso de drones. Se estudian las similitudes y diferencias entre las disposiciones adoptadas. Se observa que en Estados Unidos se opta por recomendaciones, donde prevalece la voluntariedad del usuario del dron frente al derecho de terceros a la privacidad. Si bien hay excepciones, como los casos de los estados de Texas y California, donde se considera un delito contra la privacidad el uso de drones sin la debida autorización. En Europa, la normativa es aplicable a todos los países miembros, y el sistema es más garantista, considerando los principios de necesidad y transparencia. ; This article analyzes the repercussions on journalistic activity of the regulatory measures adopted by the United States and Europe to protect privacy in the use of drones. Similarities and diffe-rences between the adopted regulations are evaluated. It is observed that in the United States recom-mendations are generally chosen, in which drone user´s willingness prevails over third parties´ right to privacy. However, there are exceptions, such as the cases of the states of Texas and California, where the use of drones without proper authorization is considered a violation of the right to privacy. In Europe, the regulations are applicable to all member countries, and the system provides more guarantees, con-sidering the principles of necessity and transparency.
En la era en la que nos encontramos, las nuevas tecnologías suponen un gran progreso y ayuda para la sociedad en todos los sentidos; no obstante, cada avance tecnológico supone un paso hacia atrás para la privacidad y la intimidad de los usuarios. Es por ello que en el presente trabajo no nos centraremos en el usuario como consumidor de tecnología, sino en aquel que además reúne las características necesarias para ser denominado «trabajador», pues, pese a que los avances tecnológicos crezcan a ritmo acelerado, la legislación en materia laboral en torno a ellos ha ido quedando obsoleta, obteniendo como resultado decisiones empresariales intrusivas en la esfera privada del trabajador. De este modo, a través de este trabajo y del análisis normativo y jurisprudencial en materia de intimidad, protección de datos y, en suma, privacidad, lo que se pretende exponer son las posibles soluciones a los conflictos entre los poderes del empresario y los derechos del trabajador. ; In the era in which we are, new technologies represent great progress and help for society in every way; but each technological advance is a step backwards for the privacy and intimacy of users. That is why in this project we will not focus on the user as a consumer of technology, but rather on the user who also has the necessary characteristics to be called a "employee", since, despite technological advances growing at an accelerated rate, legislation in labour material around them has become obsolete, resulting in intrusive employer decisions in the private sphere of the employee.
