German Biotech-Companies and their Innovativeness in International Comparison – an Institutionalist Analysis 1 Introduction In the mid-1990s, legal changes and policy initiatives in Germany led to the rapid emergence of a biotechnology industry. Initially, German biotech companies focused on the market segment of platform technologies, characterized by incremental innovations. In recent years however, many companies have shifted their strategic focus on the market segment of therapeutics, char-acterized by radical innovations. Since an active involvement in such a segment is untypical for German companies the central research question of this thesis was, if the German institutional framework allowed biotech companies to be internationally competitive in a radical-innovative market segment. The findings are particularly relevant for the literatures on "Varieties of Capi-talism", "National Innovation Systems" and for the sociology of technology. The British and the US biotech industry served as a comparison for the validation of the German case study. 2 Theory The fact that German biotech companies have become active in the field of therapeutics, where both financial and technological risks are extremely high, contradicts an essential assumption of the "Varieties of Capitalism" (abbr. VoC) literature. The proponents of the VoC classify Ger-many as a coordinated market economy, dominated by non-market institutions and long-term relationships. In addition, they presume that such a type of market economy is not compatible with competitiveness in a market segment characterized by radical innovations. Biotech-companies that are active in the field of therapeutics are in need of a large and professional ven-ture capital industry (abbr. VC industry) as well as a very flexible labour market for scientists and managers, given that most of the research projects fail. According to the VoC-approach, neither a flexible labour market for scientist and managers nor a professional VC industry is ex-istent in Germany. Instead, German biotech companies are predominantly financed by public or publicly subsidized venture capital. In contrast, the US and Great Britain are expected to be very competitive in high-risk segments like biotech-based therapeutics due to their institutional frameworks. They are classified as liberal market economies, dominated by market institutions and short-term relationships. Both a large and professional VC industry and a very flexible la-bour market are in place. Thus, the hypothesis of the VoC-approach is that liberal market economies like the US and Great Britain would clearly outperform the German coordinated market economy in the high-risk-segment of therapeutics. Unlike the "Varieties of Capitalism", proponents of the "National Innovation Systems" argue that German biotech-companies can compete with British biotech-companies in the high-risk segment of therapeutics because in recent years a professional VC industry has developed in Germany. At the same time, the flexibility of the labour market is not regarded as relevant for the competitiveness in high-risk segments. What is more, the two approaches have conflicting views concerning the competitiveness of the American and the British biotech industry. The main proponents of the VoC see both biotech industries as highly successful due to the existence of large capital markets as well as flexible labour markets. The representatives of the "National Innovation Systems" presume, in contrast, that the US-biotech industry clearly outperforms the British biotech-industry given the massive governmental funding it receives. Within the field of sociology of technology, Sorge suggested a relationship between the specific institutional configuration of the German society and its handling of technical innovation. He presumes that new technologies mature over time and hence the first phase of radical innova-tions is followed by a second phase of incremental innovations. According to Sorge, if there are first signs of the latter phase, German companies become involved in new fields of technology. Such an attitude towards new technologies originates from the professional socialisation of the German engineers where theory and practice is much more intertwined than in many other countries. As a consequence, we can deduce as a hypothesis that the development of biotech-based therapeutics has passed through a process of maturation and is now dominated by incre-mental innovations. Thus, German biotech-companies have shifted their focus to this market segment because it has proven to be of practical value. 3 Research Design The competitiveness of the German biotech-industry in the market segment of therapeutics was assessed by a comparison with the British biotech industry, as the largest industry in Europe and the second largest in the world. The key indicator for competitiveness was the amount of thera-peutics in clinical trials by biotech-companies in each country. Therefore, all biotech companies with therapeutics in clinical trials were surveyed. Moreover, to analyze the impact of national institutions on the competitiveness of therapeutics companies, more than 40 interviews were conducted with company representatives and experts. This was complemented by the evaluation of publicly available statistics. For the comparison with the US-biotech-industry, relevant litera-ture and publicly available sources were analysed. In addition, some interviews were conducted with venture capital managers investing internationally in biotech companies. 4 Competitiveness in the Market Segment of Therapeutics In a first step, the competitiveness of German and British biotech-companies in the segment of therapeutics was compared. The difference with regard to therapeutics in clinical trials is sub-stantial but far smaller than expected. According to Der Spiegel, in 2003 British biotech compa-nies had many more therapeutics in clinical trials than the German ones: 200 (GB) compared to 15 (GER). In contrast, my investigation showed that in 2004 British biotech companies had only 122 therapeutics in clinical trials and the German ones 68. Taking into consideration that the German biotech-industry emerged 15 years after the British biotech-industry and that the devel-opment of therapeutics is very time-consuming (12 years, until clinical trials about 5 years), I conclude that the British compared to the German biotech-companies are similarly competitive in the field of therapeutics. This interpretation is corroborated by the fact that the amount of bio-tech-companies with therapeutics in clinical trials is identical between Germany and Great Brit-ain (34). 5 Change of Strategy due to a Process of Maturation? The result of the empirical analysis was that hardly any of the German biotech companies which had therapeutics in clinical trials have shifted their strategic focus in recent years. Most of them were already founded with the intention of developing therapeutics. Nonetheless, there was a strategic shift in the biotech industry from platform technologies to therapeutics, not only in Germany but worldwide. But presumably, the therapeutics of the companies that changed their strategy are still in preclinical trials. A real process of maturation in the development of therapeutics has not taken place so far, there are only first steps which could lead to maturation in the future. Only a minority of the German biotech companies develop therapeutics that are incremental innovations. However, this was not due to technological breakthroughs in the bioscience but rather caused by the risk aversion of investors and could be observed internationally. But meanwhile, around 2000/2001, many ac-tors of the industry had the expectation that advances in the biosciences would significantly re-duce the percentage of therapeutics failing in development – even though this turned out to be a misguided expectation eventually. So for a certain period of time there was a perceived or sub-jective process of maturation. But nevertheless, it is rather unlikely that this subjective process of maturation was the main reason for a change of strategy since many industry experts have described the attitude of German biotech managers towards the development of therapeutics as totally naïve and not as precautious. It is more likely that changed preferences of global phar-maceutical corporations and investors were the driving force of the strategic change. 6 German and British Biotech Companies and their Access to Venture Capital and the Stock Exchange In the access to VC, British biotech companies have a small advantage. Since 2003, the VC in-vestments in the British biotech were approximately 250 Mio. Euro and the investments in the German biotech industry stabilized slightly above 200 Mio. Euro. For Great Britain the figures were startling given that it has a large venture capital industry. However, it turned out that only a small percentage is actually invested in the biotech industry. Besides, the German biotech in-dustry has seen a change in kind and origin of investors take place. After the worldwide slump of the valuation of biotech companies in 2001 most German investors withdrew from this indus-try. But to a considerable extent, this was offset by the influx of international investors. Since 2003, international investors have been in the majority in financing German biotech companies. Apart from that, it turned out that German biotech companies with therapeutics in clinical trials are predominantly funded by private and professional venture capital companies and not by public and inexperienced ones. In recent years, initial public offerings (IPOs) of biotech companies were easier to obtain at the London Stock Exchange (LSE) than at the Deutsche Börse. However, most of these IPOs in Britain were very small, so that the companies raised modest amounts of equity. Medium-sized IPOs of biotech companies succeeded in both countries, but were rare. Thus, no advantage of any country was observed. Finally and somewhat unexpectedly, the market capitalization of biotech companies at the Deutsche Börse slightly exceeded the LSE`s. Yet again, it was rather low in both cases. In sum, in the access to venture capital and the possibility of IPOs Great Brit-ain does have at the moment an advantage over Germany, but it is only a minor one. 7 Governmental Funding of British and German Biotech Firms In both countries, governmental funding of biotech companies exists and to a certain extent its level and kind has converged recently. In Germany, public funding declined after the downturn of the biotech industry in 2001. In Great Britain, in the end of the 1990s the government pro-vided some seed funds for young biotech companies to improve their financial situation. At the same time, public funding of biotech companies is still better developed in Germany than in Great Britain. This is also corroborated by a comparison of the therapeutic companies in both countries. However, it is important to note that the public funding German therapeutic compa-nies have received, is only a small percentage of their entire funding. So there is only a small competitive advantage for German biotech companies and it is hardly possible to argue that these companies develop therapeutics because of governmental funding. 8 The Labour Market for German and British Biotech Companies In the biotech-related disciplines there is abundance of highly qualified scientists in the biotech-related disciplines in both countries. An advantage for Great Britain is the larger pool of experi-enced biotech managers, which is not surprising since the British biotech industry emerged 15 years earlier. Apart from that, German biotech companies employ fewer managers with past ex-perience in the pharmaceutical industry for different reasons. Firstly, the long-term employment security in the German pharmaceutical industry reduces the incentives for managers to change to a biotech start-up whose long-term future is not assured. Secondly – and for Anglo-Saxon VC managers this reason was more relevant – a process of consolidation in the pharmaceutical in-dustry occurred in Great Britain ten years ago. As a consequence, many managers were re-leased. In Germany, this process has just started. Thirdly, and this is related to the first point, due to the head-start of the British biotech industry, there are more mature biotech companies in Great Britain. This implies in turn that mature biotech companies are more attractive to pharma-ceutical managers because these companies have on average a better viability. Irrespective of this mentioned, there is a notable amount of managers with a pharmaceutical background, espe-cially in strongly funded and advanced German biotech companies. Another difference between both countries is that lay-offs in German companies are slightly more expensive and bureau-cratic than in Great Britain. But again, it is only a minor difference. If a project has failed, Ger-man biotech companies are able to dismiss employees relatively easily. Finally, co-determination in the form of works councils or employee-representatives in the supervisory board is of no importance because of the small size of this industry but also the low interest of employees. 9 US and Great Britain – Liberal Market Economies Compared The overall conclusion of this comparison was that the US biotech industry is much more com-petitive than the British one. Only very few British biotech companies are of international im-portance, a finding that is transferable to different high-tech industries like semi-conductors or software. A central cause for the dominance of the US in the biotech-industry is the annual amount of invested venture capital which is more than ten times higher than in Great Britain. Even if we consider that the size of both market economies differ significantly this reveals an important advantage to the US. However, a lack of highly qualified scientists as a reason for the low venture capital investments in British biotech firms could be ruled out. Apart from that, a second central cause for the worldwide dominance of the US biotech-industry is the tremendous governmental funding not only of academic science but also of companies. There are strong in-dications that the massive funding of young biotech companies in the US attracts subsequent venture capital investments in these companies. The product development in the biotech indus-try – particularly in the segment of therapeutics – is very time-consuming and often exceeds the time-horizon of venture capital companies. Public funding of young companies makes it possi-ble for them to move their products forward, up to the point at which they become interesting for investors. The public funding of British biotech companies which has started only recently and is still on a low level, is probably a main reason for scarcity of venture capital in the British biotech industry. 10 Conclusion The central result of the British-German comparison was that the German biotech companies are internationally competitive in the market segment of therapeutics that is dominated by radi-cal innovations. This assessment is supported by the analysis of the institutional frameworks in which German and British biotech companies are embedded. Differences exist between the relevant national institutions in both countries – British biotech companies have easier access to venture capital and experienced managers, German biotech companies have better access to governmental funding - but these differences negligible. Moreover, some of these differences – like for example the lack of experienced biotech managers - are not a result of unfavourable in-stitutions at present but mirror a time-lag, that is, the delayed establishment of institutions, and they should diminish over time. This empirical result clearly contradicts the "Varieties of Capitalism" approach which maintains that companies in a coordinated market economy cannot be competitive in a market dominated by radical innovations. The institutional context in which German biotech companies operate differs in core respects: they have access to professional venture capital companies; only a small percentage of their total funding is from public sources; lay-offs due to failed projects are in-deed possible; many therapeutic companies employ former pharma-managers; co-determination is virtually non-existent. Also the comparison of the American and the British biotech-industry and their institutional embeddedness revealed weaknesses of the "Varieties of Capitalism" approach. The US biotech industry is much more competitive than the British one and one main cause for this is the mas-sive public funding, especially of young biotech companies, which does not fit the view that the US is a clear-cut liberal market economy. At the same time, despite these outcomes the proponents of the "Varieties of Capitalism" are not entirely wrong. Metaphorically speaking, the German biotech companies are not embedded in a coordinated market economy but rather located at their fringes. The German biotech com-panies can be successful in the high-risk segment of therapeutics because there is a relatively flexible labour market and access to professional venture capital companies. With a rigid labour market and bank loans it would not be possible and if the typical features of the coordinated market economy were interfering with the biotech industry, like for example the long-term dis-missal protection in the German pharmaceutical industry, the effect would be negative. By the same token, the dominance of the US biotech industry stems not only from public funding but also from a large capital markets and flexible labour markets. A process of maturation based on Sorge has not occurred yet in the biotech-based development of therapeutics even if there have been some advances that could lead to maturation in the fu-ture. The "National Innovations Systems" approach was confirmed for the most part: German biotech companies are internationally competitive in the high-risk segment of therapeutics and the institutional frameworks in which German and British biotech companies are embedded do not differ significantly. Besides, massive public funding explains to a considerable extent the superiority of the US to Great Britain in biotech. Notwithstanding, I argue that the "Varieties of Capitalism" is still the best approach for analysing the relations between institutions and innova-tions provided that three insights are taken into account: (1) the dominant institutions in a mar-ket economy do not have an effect on all sectors in a similar and decisive way; thus, radical in-novations can also be possible in a so-called coordinated market economy (2) one central pre-condition for the success of a market economy in a high-tech industry like biotech is massive public funding of young companies; (3) new technologies change over time in their innovative character due to processes of maturation and it is important to distinguish between subjective and objective processes of maturation. The "Varieties of Capitalism" approach is preferable to the "National Innovation Systems" ap-proach because the latter is not really a theoretical approach, as it does not strive for general conclusions and has an underdeveloped analytical framework. The strength of this approach emanates rather from the detailed empirical descriptions of specific innovation systems.

Bei der Entlassung von Mitarbeitern sind Interessenkonflikte vorprogrammiert. Gut begründete Positionen stehen sich bei diesen folgenreichen Personalentscheidungen oft unversöhnlich gegenüber. In den letzten Jahren waren vermehrt Kündigungen aufgrund von Bagatelldelikten in den Medien präsent. So wurde einer Kassiererin fristlos gekündigt, weil sie zwei Pfandbons unterschlagen haben sollte. Angesichts der Finanz- und Wirtschaftskrise, in der Banken Milliarden fehlinvestierten die Bankmanager jedoch kaum zur Rechenschaft gezogen wurden, verstärkte sich der Eindruck unbotmäßiger Härte und Ungerechtigkeit. Aber ist dieser Eindruck gerechtfertigt? Unterschiedliche Urteile der Instanzgerichte zu Bagatellkündigungen zeigen, dass im Arbeitsrecht nicht abschließend geklärt ist, wie in solchen Bagatellkündigungsfällen verfahren werden soll. Zudem stellt die Rechtskonformität einer Kündigung ohnehin kein abschließendes Kriterium dafür dar, ob sie auch aus ethischer Sicht gut ist. Das Ziel der Arbeit ist daher die Frage zu beantworten, wie Bagatellkündigungen moralisch zu bewerten sind. Ethisch relevante Aspekte werden zur Unterstützung von Personalentscheidungen in der Praxis identifiziert. Zunächst werden als Überblick die Ergebnisse einer Medienrecherche zu den Bagatellkündigungen dargestellt. Im ersten Untersuchungsschritt wird gefragt, warum eine Kündigung als Auflösung einer privaten Vertragsbeziehung rechtfertigungsbedürftig ist. An Praxisbeispielen wird dargestellt, welche Regelungen zum Kündigungsschutz bestehen und wie diese durch die Spezifika der Arbeitsbeziehung anhand ethischer Aspekte begründet werden. Bezugnehmend auf die Stakeholder-Sicht auf Wirtschaftsunternehmen und Überlegungen der Agenturtheorie wird gezeigt, dass die Beziehung im Arbeitskontext Spezifika aufweist, die übergebührliche Rechte und Pflichten begründen und auch in der psychologischen impliziten Vertragsbeziehung ihren Ausdruck finden. Es wird gezeigt, dass sich – insbesondere bei langjährigen Vertragsverhältnissen – ein prima-facie-Recht der Arbeitnehmer nicht gekündigt zu werden begründen lässt. Dieses Recht liegt im Status der Arbeitnehmer als rationalen moralfähigen Personen mit Anspruch auf Achtung ihrer Würde begründet. Aus der Personenhaftigkeit der Mitarbeiter entspringt der legitime Anspruch, rationale Gründe für Entscheidungen, welche sie betreffen, genannt zu bekommen. Es wird argumentiert, ein Arbeitgeber dürfe die Arbeitsbeziehung nur aufkündigen, wenn es hierfür objektiv gute Gründe gibt – ein grundsätzlicher Kündigungsschutz ist also nicht nur rechtlich sondern auch moralisch geboten. Daher schließt sich die Frage an, ob das Bagatelldelikt als Vertragspflichtverletzung ein guter objektiver Grund ist, welcher eine Kündigung rechtfertigt. Von Seiten der Kündigungsbefürworter wird argumentiert, das Vertrauensverhältnis sei durch die Tat zerstört. Daher wird geprüft, ob der Vertrauensverlust aufgrund des Bagatelldiebstahls ein guter Grund für die Kündigung ist. Ob das Bagatelldelikt als objektiver Grund für den Vertrauensverlust gewertet werden kann, hängt nun davon ab, ob der Mitarbeiter das Vertrauen tatsächlich missbraucht hat. Daraus folgt, dass sich die moralische Bewertung des Delikts an Prinzipien orientiert, die auch im Strafrecht gelten (Schuldprinzip, Unschuldsvermutung, Rechtsprinzips, Ultima-Ratio-Prinzip). Das Ergebnis der Untersuchung ist: Bagatelldelikte können aufgrund ihrer Spezifika anhand dieser gültigen Prinzipien schwerlich als objektiver Grund angesehen werden, der eine fristlose Kündigung ohne vorherige Abmahnung rechtfertigt. Abschließend wird gezeigt, dass auch die vermeintliche präventive Wirkung der Kündigung nicht als guter Kündigungsgrund gelten kann. Mit spezialpräventiven Gründen kann die Kündigung ebenso wenig wie mit positiver als auch negativer generalpräventiver Wirkungen begründet werden. Insbesondere stellt eine Kündigung aus generalpräventiven Zwecken eine illegitime Instrumentalisierung des Mitarbeiters als Person dar. Zwar können Kündigungen bei Bagatelldelikten durchaus nicht nur arbeitsrechtlich, sondern auch moralisch gerechtfertigt sein. Aufgrund der Spezifika der Bagatelldelikte und der Vertrauenskündigung ist die fristlose Kündigung in den meisten vorliegenden Fällen aus ethischer Sicht aber nicht akzeptabel. Hohe Anforderungen an die Objektivität des Vertrauensverlustes, der als Kündigungsgrund dienen soll, sind aufgrund der schwächeren Machtposition der Mitarbeiter notwendig und klug im Sinne der Wahrung des betrieblichen und gesellschaftlichen Friedens. Es wird daher für ein grundsätzliches Abmahnungsgebot bei Bagatelldiebstählen plädiert, welche weitergehend durch eine Wertgrenze definiert werden können. Weitere Maßnahmen, mit denen man missbräuchlichen Bagatelldeliktkündigungen vorbeugen oder auf Bagatelldelikte reagieren kann werden im Ausblick genannt. ; When employees are dismissed, conflicts of interest are almost inevitable. In these cases of momentous personnel decisions, well-founded points of view are often inexpiably confronted. In recent years, dismissals due to minor offences were increasingly mediatised. A cashier for example was dismissed without previous notice, because she had supposedly embezzled two deposit receipts. Given the financial and economic crisis, where banks misplaced Billions whilst bank managers were rarely held accountable, the impression of insubordinate rigour and injustice was reinforced. But is this impression justified? Different judgments of the lower courts regarding the dismissals have shown that employment legislation does not clearly state how to proceed in cases of dismissals on grounds of petty offence. In addition and in any case, the legal conformity of a dismissal does not constitute a final criterion for whether it is good from an ethical point of view. The aim of this paper is to answer the question of how to morally evaluate dismissals on grounds of petty offence. It identifies ethically relevant aspects, which provide assistance when addressing responsible decision-making in personnel matters in practice. First, the results of a media research concerning dismissals on grounds of petty offence are displayed, in order to give the reader an overview of the different cases and the arguments of the opponents, the courts and the professionals. Then, in the first step of analyzing, the paper deals with the question of why a termination, when seen as the cancellation of a private contractual relationship, is in need of justification at all. Examples taken from practice illustrate the existing regulations concerning dismissal protection and how these are justified by the specifications of the work relationship based on ethical aspects. Also referring to the stakeholder view of business companies and the considerations of the agency dilemma, the paper shows that relationships in business contexts are specific, which justifies supererogatory rights and duties and which is also reflected in the psychological and implicit contractual relationship. The paper furthermore demonstrates that a prima facie right of employees not to be terminated can be justified, in particular in long-term contractual relationships. This right originates in the employees' status as rational, conscious persons, with their entitlement to have their dignity respected. From the fact that they are persons emanates the legitimate claim of the employees to be told rational reasons for decisions that affect them. It is argued that an employer may terminate the employment relationship only if there are objectively good reasons for this - a fundamental protection against dismissal is therefore not only legally but also morally necessary. This leads to the question whether petty offence as a breach of contract is a good objective reason to justify a dismissal. Dismissal proponents argue that the mutual trust is destroyed by the act. It is therefore necessary to check whether the loss of mutual trust due to the petty theft is a good reason for a dismissal. Whether the petty offence can be seen as an objective reason for the loss of mutual trust now depends on whether the employee has actually abused the trust. Consequently, the moral evaluation of the offence is based on principles that also apply in criminal law (nulla poene sine culpa, presumption of innocence, legal principle, ultima ratio principle). The result of the investigation is that due to their specifications based on these valid principles, petty offences can hardly be considered an objective reason justifying a dismissal without prior warning. Finally, the paper shows that the alleged preventive effect of the dismissal cannot be a legitimate argument for a good cause of dismissal. The dismissal can neither be justified by special-preventive reasons nor by having positive and negative general preventive effects. In particular, a dismissal as means of general preventive purposes constitutes an illegitimate instrumental use of the employee as a person. Although a dismissal due to minor offences may well not only be justified legally, but also morally, the termination without notice is unacceptable from an ethical point of view in most present cases, due to the specificities of the petty offences and the lost in trust. On the grounds of respecting the peace within companies and society and because of the weaker position of employees, it is necessary and wise to stick to high exigencies towards the objectivity of the loss of trust, which will serve as grounds for dismissal. The paper therefore argues for a generalization of written warnings in cases of petty thefts, which can be further defined by a maximum amount. Other possible measures which may prevent abusive dismissals for petty offences or be a response to minor offences are dealt with in the prospect part.

According to Nietzsche, the fundamental problem between a man and a woman is rooted in the denial of antagonism between them. The man believes that their relationship must be that of eternal hostile tension and unavoidable injustice. Nietzsche asserts that there must be a rank order, where scaling is related to the actions of taking, accumulating and becoming greater by gaining power and overcoming narrower interpretations. This rank scaling does not allow for identicalness and equality, which are signs of the shallowness of instinct and the loss of one's identity. Nietzsche endorses the difference and celebrates the otherness. Flourishing of an individual can never be interfered by the concept of equal relations. Nietzsche is convinced that people are different, and he advocates for agon (a power struggle) as a model of cultural and political relations. Since equality of human beings must consist of an equal amount of the same feature, Nietzsche sees this equality as being represented in the general will to power. Furthermore, the gender difference is also a socially constructed way of being. It is a creation of man's image of how the world should look like. If included in a therapeutic approach, this perspective can shed new light on possible interventions methods in psychotherapy and philotherapy alike. Sex and sexual relationships can be singled out as key problems that prevail in the core of motivation for seeking professional therapeutic help (psychotherapy), no matter what therapeutic approach is used in such practice. It is a topic that has insufficiently drawn on Nietzsche's legacy. Ovo rangiranje ne dopušta istovjetnost i ravnopravnost, što su znakovi plitkoće instinkta i gubitka identiteta. Nietzsche podržava različitost i slavi drugotnost. Uspijevanje pojedinca nikada ne može biti ometano pojmom jednakih odnosa. Nietzsche je uvjeren da su ljudi drugačiji i zagovara agon (borba moći) kao model kulturnih i političkih odnosa. Budući da se jednakost ljudskih bića mora sastojati od jednakog iznosa istog svojstva, Nietzsche tu jednakost vidi kao predstavljenu u općoj volji za moć. Nadalje, rodna je razlika također društveno konstruiran način bivanja. To je kreacija muške slike o tome kako bi svijet trebao izgledati. Ako se uključi u terapijski pristup, ova nam perspektiva može baciti novo svjetlo na moguće intervencijske metode u psihoterapiji i filoterapiji podjednako. Spol i spolni odnosi mogu biti izlučeni kao ključan problem koji prevladava u jezgri motivacije za traženje profesionalne terapijske pomoći (psihoterapija), bez obzira na to koji se terapijski pristup u takvoj praksi koristi. Tema je to koja nije dovoljno vukla iz Nietzscheove tradicije. Cilj je rada ponuditi argumente za to da se Nietzscheova perspektiva na »rat spolova« postavi kao produktivan kontekst za psihoterapijsku intervenciju i filozofijsko savjetovanje. ; Nach Nietzsches Ansicht schlägt das grundlegende Problem zwischen Mann und Frau ("Weib") seine Wurzeln tief in der Leugnung des Antagonismus zwischen ihnen. Ein Mann glaubt, dass ihre Beziehung eine ewige feindselige Spannung und eine unabwendbare Ungerechtigkeit sein muss. Nietzsche stellt die Behauptung auf, dass es eine Rangordnung geben muss, in der die Skalierung mit den Aktivitäten des Nehmens, Akkumulierens und der Verbesserung durch Machtgewinnung und Überwindung engerer Interpretationen zusammenhängt. Diese Rangfolge duldet keine Ausgleichbarkeit und Gleichheit, die Anzeichen für einen flachen Instinkt und einen Identitätsverlust sind. Nietzsche unterstützt die Verschiedenheit und feiert die Andersheit. Der Erfolg eines Individuums kann niemals durch den Begriff der gleichen Beziehungen beeinträchtigt werden. Nietzsche ist überzeugt, dass Menschen anders sind, und befürwortet den Agon (Wettkampf) als Modell kultureller und politischer Beziehungen. Da die Gleichheit der menschlichen Wesen aus einer gleichen Menge derselben Eigenschaft bestehen muss, sieht Nietzsche diese Gleichheit als vertreten im allgemeinen Willen zur Macht. Fernerhin ist der Genderunterschied gleichfalls eine sozial konstruierte Art des Seins. Es ist die Kreation eines männlichen Bildes davon, wie die Welt aussehen sollte. Falls diese Perspektive in den therapeutischen Ansatz einbezogen wird, kann sie neues Licht auf potenzielle Interventionsmethoden innerhalb der Psychotherapie und Philotherapie gleichermaßen werfen. Geschlecht und Geschlechtsverkehr können als Schlüsselproblem herausgeschält werden, das im Kern der Motivation dominiert, professionelle therapeutische Hilfe (Psychotherapie) aufzusuchen, ungeachtet dessen, welcher therapeutische Ansatz in einer solchen Praxis verwendet wird. Es ist ein Thema, das nicht zureichend aus Nietzsches Tradition stammt. Die Intention dieses Papers ist es, Argumente dafür zu liefern, Nietzsches Perspektive des "Geschlechterkrieges" als produktiven Kontext für psychotherapeutische Interventionen und philosophische Beratung aufzustellen. ; Selon la pensée de Nietzsche, le problème fondamental entre les hommes et les femmes est profondément enraciné dans le déni de l'antagonisme qui leur est propre. L'homme considère que leur relation repose sur une éternelle tension hostile et une inévitable injustice. Nietzsche affirme qu'un ordre de classement doit exister dans lequel la mise à l'échelle est liée à l'action de s'emparer, d'accumuler et de devenir meilleur en gagnant en puissance et en dépassant les étroites interprétations. Ce classement ne permet pas d'identité et d'égalité, signes d'un instinct superficiel et d'une perte d'identité. Nietzsche soutient la diversité et célèbre l'altérité. La réussite d'un individu ne doit jamais être perturbé par le concept d'égalité des relations. Nietzsche est convaincu que les gens sont différents et défend l'agôn (lutte pour le pouvoir) en tant que modèle pour les relations culturelles et politiques. Étant donné que l'égalité des êtres humains doit contenir une quantité égale de propriétés identiques, Nietzsche conçoit cette égalité comme présentée dans la volonté générale de puissance. En outre, la différence des genres est également un mode d'être construit socialement. C'est la création masculine d'une image sur le monde. Si on l'introduit au sein d'une approche thérapeutique, cette perspective éclaire d'un jour nouveau les possibles méthodes d'intervention en psychothérapie et philothérapie de manière égale. Le genre et les relations de genres peuvent être dégagés comme un problème clé qui prend le dessus au cœur de la motivation visant à rechercher une aide thérapeutique professionnelle (psychothérapie), quel que soit l'approche thérapeutique utilisée dans une pratique de ce genre. Ce thème n'a pas suffisamment été puisé dans la tradition nietzschéenne. L'objectif de ce travail et de proposer des arguments afin que la perspective nietzschéenne de « la guerre des genres » s'établisse dans un contexte productif pour l'intervention psychothérapeutique et la consultation philosophique.

Die Untersuchung setzt sich auseinander mit der Tatsache, dass die an sich mögliche und vom Gesetzgeber zum Zwecke der Resozialisierung in das StGB eingefügte Weisung : Ordnung der wirtschaftlichen Verhältnisse von den für die Strafaussetzung zur Bewährung zuständigen Strafrichtern in den letzten 3 ½ Jahrzehnten nur äußerst sporadisch erteilt wurde. Diese Weisung steht im Kontext der Strafrechtsreform in den 50er und 60er Jahre des 20. Jahrhunderts und hier vorzugsweise unter Beachtung des Rechtsinstituts Bewährung / Bewährungshilfe . Im Rahmen der Normen der Art. 20 und 28 GG sowie der Vorschriften des (Jugend-) Strafrechtes sollte u. a. auch die theoretische Vorarbeit geleistet werden. Es wurden die im Zusammenhang mit der wirtschaftlichen Sanierung stehenden Rechtsinstitute, wiebearbeitet. Als Grundlage der Schulden bedingten Resozialisierung wird u. a. § 56 c I, II Nr. 1 StGB gesehen. Warum diese gesetzlich eingeräumte Möglichkeit nur in so geringem Maße eingesetzt wird, ist so weit ersichtlich, bisher nicht bearbeitet worden. Aus verschiedensten Quellen und Untersuchungen wurde versucht, die Ursache herauszuarbeiten. Dazu wurde auch eine Fragebogenaktion durchgeführt. Alle dazu gefundenen Angaben gehen davon aus, dass die allgemein als notwendig angesehenen Sanierungsmaßnahmen sehr arbeitsintensiv sind und dass normalerweise die dafür erforderlichen Arbeitskapazitäten nicht vorhanden sind. Alle Aussagen gehen dahin, dass die für die Durchführung solcher Weisungen erforderlichen Mittel von der Politik nicht bereitgestellt werden und aus diesem Grunde die Spruchkörper Abstand nehmen, solche Weisungen zu verhängen. Alle zu diesem Thema erschienene Literatur, die vorzugsweise bis vor etwa zwei Jahrzehnten erschienen ist (in den letzten fünf Jahren sind nur soweit ersichtlich vier Monographien erschienen), lässt erkennen, dass der Einsatz der fraglichen Weisungen ein multidimensionales Problem darstellt. Aus der Thematik dieser Studie lassen sich bewährungsrelevante Bereiche der Probanden ableiten, wie: Die erfolgte Sozialisation, einschließlich schulischer und beruflicher Bildung, die körperlich seelische Verfassung, die wirtschaftlichen, arbeitsmäßigen und wohnungsmäßigen Verhältnisse sowie die sozialen Beziehungen (Partnerschaften) und Delinquenz, einschließlich deren Aufsicht und der sozialpädagogischen Betreuung. Der Weisungseinsatz ist von Richtern auf der kleinsten Einsatzquote festgelegt, so dass folgerichtig nur ein geringer Erfolg zu erwarten ist. Dieser Misserfolg überrascht daher wenig, eher schon die Tatsache, dass Führungsaufsichtsprobanden dabei nochmals unterrepräsentiert sind und dass die Bewährungserfolge aufgrund der einschlägigen Weisungen immer mehr absinken. In dem Zusammenhang fällt auf, dass das Verhältnis zwischen Probanden und Bewährungshelfer, obwohl ambivalent, sich doch als relativ stabil, vertrauensvoll und resistent gegen die Widerrufskriterien zeigt. Obwohl das Vertrauen der Probanden zum Bewährungshelfer Grenzen zeigt, stellt sich das Verhältnis unter Berücksichtigung der insgesamt extrem schwierigen Situation doch als günstig dar und die Probanden, die teilweise zu Beginn der Bewährungszeit über die Beiordnung eines Bewährungshelfers recht verärgert waren, dann doch erkannten, dass der Bewährungshelfer seinen Beitrag dazu leistete, sie vor einem Widerruf zu bewahren. Auch scheinen die Probanden ihre Autoritätskonflikte im Verhältnis zum Bewährungshelfer im Laufe der Zusammenarbeit abzubauen. Die in den vergangenen Jahrzehnten propagierten Thesen über den Einfluss der Schulden auf die Straffälligkeit haben sich nicht nachweisen lassen. Weder haben die bisher vorliegenden Studien ergeben, dass die Anhäufung von Schulden zwangsläufig zu (erneuten) Straftaten führen, noch ist das Gegenteil der Fall gewesen. Die vorliegenden empirischen Ergebnisse fremder und eigener Arbeiten verdeutlichen, dass die Nichtanwendung der Weisungen über die Regelung der wirtschaftlichen Verhältnisse durchaus kritisch zu betrachten sind und über ihren Ausbau einschließlich dem tatsächlichen Veränderungsbedarf zu diskutieren sein wird. Dieser Ausarbeitung war es angelegen, die Möglichkeiten der Praxis zum Schuldenabbau zu erörtern und eine Lanze dafür zu brechen, dass die Weisungsmöglichkeit in § 56 c I, II Nr. 1 StGB in Zukunft nicht weiterhin als Stiefkind der Strafrechtspflege behandelt und trotz angeblicher Prioritätseinräumung durch die Politik in Wirklichkeit vernachlässigt und bewusst ungenutzt in der Kodifizierung versteckt gehalten wird. In diesem Zusammenhang ist es bisher nicht gelungen, die Kriminalitätsprobleme von verurteilten Straftätern einzuschränken. Dabei kommt es nicht darauf an, ob die erkannte Ahndung mit oder ohne Freiheitsentzug erfolgt. Beide Reaktionen wirken offensichtlich kaum prophylaktisch und werden von der Strafrechtspflege deshalb auch bei der Bestrafung in der Regel schon mehrfach deviant auffällig gewordener Täter eingesetzt, wobei nach der Statistik in der großen Mehrheit der Verurteilungen eine Geldstrafe verhängt wird. Die Bewährungshilfe wird selten, abgesehen von Jugendlichen, Heranwachsenden und Jungerwachsenen, bei Ersttätern bzw. bestraften eingesetzt. Nach der Justizwirklichkeit erfolgt bei zu Geldstrafen Verurteilten keine über einen Minimalbereich der Sozialarbeit hinausgehende Betreuung. Dabei könnte die Verknüpfung von Freiheitsentzug und betreuender Aufsicht bei rechtzeitigem und personalmäßig ausreichendem Einsatz so manche kriminelle Karriere aushebeln und neue Delikte verhindern. ; The research deals with the fact that the Order for the purpose of rehabilitation and settlement integrated into the StGB and which is possible as such: Order of the economic relations was granted only very sporadically by the judges responsible for the suspension of sentence on probation within the last three and a half decades. This Order is to see in context of the reform of the penal code in the 50ies and 60ies of the 20th century and here preferably while respecting the legal institutes probation / probation service . Within the scope of the norms of the article 20 and 28 GG (German Basic Law) as well as in the regulations of the (Youth) Penal Code a theoretical pre-Work should be done among others. The legal institutes standing in connection with the economic renovation, such aswere worked on. Among others the § 56 c I, II No. 1 StGB is seen as a basis of the debts conditional rehabilitation. The reason why this legally granted possibility is applied only to that minor extent, as far as this is evident, has not been worked on up to now. The attempt was made from various sources and researches to find out the cause. For this purpose a questionnaire survey was carried out. All indications found emanate from the fact that the sanitation measures, in general assessed as required, are very work-intensive and normally the necessary processing capacities are not available. All statements indicate that necessary means for the realization of such Orders are not provided by the politics and for that reason the administrative bodies refrain from imposing such Orders. Any literature published regarding this issue, which was especially published until two decades ago (within the last five years as far as evident four monographs were published), lets recognize that application of the aforesaid Orders represent a multi-dimensional problem. From the themes of this study probation-relevant area of the probationers can be deduced, such as: the socialisation carried out, including school-related and professional education, the physical mental state, the economic, work-related and resident-related conditions as well as the relationships (partnerships) and the delinquency, including their monitoring and the social-pedagogic counselling. The application of the Orders has been determined to the lowest application quota by the judges, so that as a consequence only small successes can be anticipated. This failure therefore does not actually surprise, rather than the fact, that the leading surveying probationers are by the way again under-represented, and therefore the successes of probation continues to sink because of the relevant Orders. In this context it attracts attention that the ratio between the probationers and probation officer, though ambivalent, turns out to be relatively stable, trustful and resistant against criteria of revocation. Although the confidence of the probationers to the probation officer comes to its limits, the relationship is still favourable while considering under extremely difficult situation and the probationers who were quite annoyed by the appointment of a probation officer at their side at the beginning of the probation time, have then recognized, that the probation officer ma! de his contribution to avoid a revocation. Also it seems that the probationers reduce their clash with authority in their relationship to the probation officer in the course of the cooperation. The theses propagated in the past decades regarding the influence of debts on the liability to punishment could not be proved. Nor the studies presented up to date gave the result that the accumulation of debts necessarily leads to (new) offences, nor has the contrary been the case. The current empirical results of foreign and own studies make clear that the non-application of the Orders regarding the regulation of the economic conditions can be though considered critically and about their extension including the actual need for change has to be discussed. It was the goal of this study to discuss the possibilities in practice for a redemption of debts and to take up the cudgels for someone, that the possibility of Order in § 56 c I, II No. 1 StGB in future will no longer be treated as a stepchild of the penal judicature and despite of the alleged grant of priority it is in realty neglected by the politics and consciously hidden unused in the codification. It this context there has been no success to restrict the criminality problems of the convicted offenders. Here it is not important, whether the given punishment is carried out with or without imprisonment. Both reactions do obviously not have a prophylactic effect and are therefore it is applied by the administrative judicature also for the punishment of offenders normally who were noticed repeatedly deviant, whereas according to statistics the large majority of the judgments are punished with fines. The probation service is seldom applied, apart from juveniles, teenagers an! d young adults, for first offenders respectively for the persons already punished. According to the reality in justice there is no counselling of offenders sentenced to a fine which exceeds a minimum of social work. However, the combination of detention and counselling supervision with timely and sufficient staffed application could be taken off some criminal career and prevent new offences.

Im Rahmen der vorliegenden Studie sollte der Versuch unternommen werden, Einsicht in die aktuellen Lebensprobleme und Bewältigungsstrategien der Österreicher zu erhalten. Von besonderem Interesse war dabei der Stellenwert, den die Psychotherapie als professionelles Hilfsangebot einnimmt. Befragt wurden ausschließlich Personen mit niedrigem Schulabschluss, die nicht im psychosozialen Bereich tätig waren. Unter den Lebensproblemen dominierten Arbeitsplatzprobleme und Existenzängste, gefolgt von intrafamiliären Beziehungs- und körperlichen Gesundheitsproblemen. Jeder Problemkreis hat erwartungsgemäß sein spezifisches Lösungsmuster, dennoch zeichnen sich über alle Problemkreise hinweg drei bevorzugt genannte Strategien ab: Selbsthilfe, private Aussprache sowie das Aufsuchen diverser öffentlicher Beratungsstellen. Die grundlegende Einstellung zur Psychotherapie war fast durchwegs ambivalent bis negativ. Bei Zuhilfenahme von Psychotherapie scheint für viele das soziale Image wie auch das Selbstbewusstsein gefährdet, zudem werden häufig zu hohe Kosten beklagt. In den weniger häufigen positiven Statements zur Psychotherapie wird diese als Lebenshilfe, als Hilfe zur Persönlichkeitsentwicklung oder einfach als Aussprachemöglichkeit gesehen. Insgesamt belegt die Studie die Notwendigkeit von Maßnahmen, die den Zugang zur Psychotherapie erleichtern. Weitere Untersuchungen zur Klärung der Frage, warum weite Kreise der Bevölkerung der Psychotherapie noch immer mit großer Reserviertheit begegnen, werden angeregt.Schlüsselwörter: Lebensprobleme, Bewältigung, Psychotherapie, Psychotherapieforschung, Image der Psychotherapie. ; This study is intended to gain an insight into the problems Austrians experience in their lives and the strategies developed to overcome them. One of the most intriguing questions was how psychotherapy is assessed as a method for giving professional help. All the persons polled had no higher education and did not work in the psychosocial field. Life-related problems turned out to be, first and foremost, problems at work and existential anxiety, followed by problems concerning relationships within families and physical troubles. As could be expected, each problem area has its own specific solution pattern; however, there seem to be three preferred strategies applied in all areas: self-help, personal talks, and seeking advice at public counselling centers. The underlying attitudes to psychotherapy were almost invariably ambivalent or even negative. Resorting to psychotherapy is perceived by many people as a threat to their social image and self-confidence. What is more, those surveyed frequently complained about costs being too high. Positive comments on psychotherapy were made less often and referred to psychotherapy as something that helps people cope with their lives or develop their personality, or simply as an opportunity to talk. One of the study's main findings is that measures facilitating access to psychotherapy are needed. Further studies on elucidating the question why there is still so much suspicion about psychotherapy among the population are encouraged.Keywords: Life-related problems, coping, psychotherapy, psychotherapeutic research, image of psychotherapy. ; La présente étude constitue une tentative \ d'évaluer les problèmes existentiels dont souffre actuellement un échantillon de la population autrichienne et d'examiner les stratégies utilisées pour les gérer. Nous nous sommes particulièrement intéressés à la valeur attribuée à la psychothérapie en tant qu'offre professionnelle de soutien. Le groupe étudié est constitué de 87 personnes ayant un bas niveau de scolarité et ne travaillant pas dans le domaine psychosocial.Des difficultés mentionnées par les participants, ce sont les problèmes liés au monde du travail, l'angoisse face à l'insécurité matérielle et des problèmes de relations au sein de la famille qui dominent, suivies de problèmes de santé (niveau somatique). Concernant les deux premiers aspects, l'étude indique clairement que la situation actuelle sur le marché du travail n'est pas seulement problématique aux niveaux économique et politique ; elle a déjà des conséquences sérieuses sur le plan psychosocial : peur du chômage, pressions croissantes et dégradation du climat dans les entreprises provoquent des tensions et peuvent entraîner des symptômes tels la fatigue, l'épuisement et des troubles psychosomatiques. L'individu risque de «perdre le contrôle», dans le sens où il a de moins en moins le sentiment de pouvoir influer sur ce qui se passe - et ceci peut provoquer une sensation d'impuissance ou des réactions inadéquates. Quant aux problèmes familiaux, ils s'accompagnent toujours d'un sentiment d'impuissance, de résignation et de blocage et comportent une forte composante affective.Chacun des types de problèmes examinés tend à être résolu de manière spécifique; il reste qu'on peut cerner trois stratégies qui sont mentionnées le plus fréquemment par rapport aux différents types : la personne concernée tente de s'aider elle-même, elle parle de son problème avec des connaissances ou elle s'adresse à un service public de consultation. Ce n'est qu'en bas de liste que sont mentionnés d'autres moyens de trouver un soutien, entre autres : psychologue/psychiatre/psychothérapeute, hôpital/foyer, politiciens, médecin de famille. Lorsque les problèmes sont en rapport avec le monde du travail ou l'insécurité matérielle la majorité des personnes interrogées cherche à s'aider elle-même. Certaines d'entre elles pensent que seule une modification des conditions sociétales, dans le cadre des lois ou de la politique sociale, pourrait apporter un changement positif. Par contre, pour gérer des problèmes de relation au sein de la famille on compte beaucoup moins sur ses propres ressources et s'adresse souvent à des connaissances. C'est aussi dans ce domaine que les personnes concernées sont le plus disposées à rechercher un soutien professionnel. Dans l'échantillon inclus dans l'étude, personne n'a fait l'expérience personnelle d'un traitement psychothérapeutique. Mais le tiers environ des répondants connaît quelqu'un (connaissance ou parent) qui a fait une psychothérapie. Les expériences vécues par d'autres ne suffisent pas à faire évoluer l'attitude que ces personnes ont envers la psychothérapie - du moins lorsque celle-ci est clairement définie. Toutes sont en fait fondamentalement ambivalentes à son égard ou vont jusqu'à la considérer comme négative. De plus, lorsqu'on analyse les réponses, on constate que celles qui expriment un point de vue positif ne le font pas avec beaucoup de conviction : on pense d'une part que la psychothérapie peut apporter un «soutien dans la vie», qu'elle peut offrir des expériences et un certain savoir-faire ou «des conseils». On perçoit les thérapeutes comme des professionnels compétents qui, le cas échéant, vont apporter un soutien au niveau social ou familial. De nombreuses personnes indiquent que le secret professionnel et la « neutralité» du psychothérapeute constituent des aspects positifs. D'autre part, certaines réponses mentionnent que la psychothérapie peut fournir un soutien au niveau du « développement de la personnalité ». Le thérapeute est compétent, on peut lui parler de soi et de ses problèmes et ceci peut apporter une amélioration de la « qualité de vie ». Parmi les réponses exprimant un point de vue négatif, l'argument le plus fréquent est celui selon lequel la psychothérapie n'est utile que lorsque quelqu'un souffre de «troubles psychiques », de «maladie mentale» ou de «gros problèmes ». On ne peut s'empêcher de penser que les répondants font parfois de la psychothérapie une démarche très spéciale pour s'en démarquer aussi nettement que possible. Ils construisent une sorte de barrière : « bien sûr j'ai des problèmes plus ou moins importants, mais tant qu'ils ne sont pas potentiellement 'mortels' consulter un psychothérapeute ne se justifie pas ». La prophylaxie ou la prévention d'évolutions possibles ne semblent pas appréciées. De plus, accepter un soutien psychothérapeutique paraît s'accompagner pour de nombreuses personnes d'une perte de prestige social ou de confiance en soi. Un obstacle supplémentaire sur la voie conduisant au cabinet du thérapeute est constitué de gêne - on n'ose pas confier à un «parfait étranger» ses «secrets» personnels et intimes. «Le divan » est encore souvent mentionné en tant qu'association; il symbolise sans doute le traitement de longue durée que seuls les membres des classes supérieures peuvent s'offrir. Dans ce sens, les thérapeutes comme leurs clients sont perçus comme appartenant à un milieu social plus élevé que celui des répondants. Nombreux sont d'ailleurs ceux qui considèrent que les traitements psychothérapeutiques sont trop chers. Dans l'ensemble, l'étude confirme qu'il est indispensable de mettre en œuvre des mesures qui faciliteraient l'accès aux traitements. Il serait également souhaitable que d'autres études soient menées qui permettraient de mieux définir les raisons qui font que de larges couches de la population ont une attitude très réservée par rapport à la psychothérapie. ; unknown ; publishedVersion

Jeder Problemkreis hat erwartungsgemäß sein spezifisches Lösungsmuster, dennoch zeichnen sich über alle Problemkreise hinweg drei bevorzugt genannte Strategien ab: Selbsthilfe, private Aussprache sowie das Aufsuchen diverser öffentlicher Beratungsstellen. Die grundlegende Einstellung zur Psychotherapie war fast durchwegs ambivalent bis negativ. Bei Zuhilfenahme von Psychotherapie scheint für viele das soziale Image wie auch das Selbstbewusstsein gefährdet, zudem werden häufig zu hohe Kosten beklagt. In den weniger häufigen positiven Statements zur Psychotherapie wird diese als Lebenshilfe, als Hilfe zur Persönlichkeitsentwicklung oder einfach als Aussprachemöglichkeit gesehen. Insgesamt belegt die Studie die Notwendigkeit von Maßnahmen, die den Zugang zur Psychotherapie erleichtern. Weitere Untersuchungen zur Klärung der Frage, warum weite Kreise der Bevölkerung der Psychotherapie noch immer mit großer Reserviertheit begegnen, werden angeregt.Schlüsselwörter: Lebensprobleme, Bewältigung, Psychotherapie, Psychotherapieforschung, Image der Psychotherapie. ; This study is intended to gain an insight into the problems Austrians experience in their lives and the strategies developed to overcome them. One of the most intriguing questions was how psychotherapy is assessed as a method for giving professional help. All the persons polled had no higher education and did not work in the psychosocial field. Life-related problems turned out to be, first and foremost, problems at work and existential anxiety, followed by problems concerning relationships within families and physical troubles. As could be expected, each problem area has its own specific solution pattern; however, there seem to be three preferred strategies applied in all areas: self-help, personal talks, and seeking advice at public counselling centers. The underlying attitudes to psychotherapy were almost invariably ambivalent or even negative. Resorting to psychotherapy is perceived by many people as a threat to their social image and self-confidence. What is more, those surveyed frequently complained about costs being too high. Positive comments on psychotherapy were made less often and referred to psychotherapy as something that helps people cope with their lives or develop their personality, or simply as an opportunity to talk. One of the study's main findings is that measures facilitating access to psychotherapy are needed. Further studies on elucidating the question why there is still so much suspicion about psychotherapy among the population are encouraged.Keywords: Life-related problems, coping, psychotherapy, psychotherapeutic research, image of psychotherapy. ; La présente étude constitue une tentative \ d'évaluer les problèmes existentiels dont souffre actuellement un échantillon de la population autrichienne et d'examiner les stratégies utilisées pour les gérer. Nous nous sommes particulièrement intéressés à la valeur attribuée à la psychothérapie en tant qu'offre professionnelle de soutien. Le groupe étudié est constitué de 87 personnes ayant un bas niveau de scolarité et ne travaillant pas dans le domaine psychosocial.Des difficultés mentionnées par les participants, ce sont les problèmes liés au monde du travail, l'angoisse face à l'insécurité matérielle et des problèmes de relations au sein de la famille qui dominent, suivies de problèmes de santé (niveau somatique). Concernant les deux premiers aspects, l'étude indique clairement que la situation actuelle sur le marché du travail n'est pas seulement problématique aux niveaux économique et politique ; elle a déjà des conséquences sérieuses sur le plan psychosocial : peur du chômage, pressions croissantes et dégradation du climat dans les entreprises provoquent des tensions et peuvent entraîner des symptômes tels la fatigue, l'épuisement et des troubles psychosomatiques. L'individu risque de «perdre le contrôle», dans le sens où il a de moins en moins le sentiment de pouvoir influer sur ce qui se passe - et ceci peut provoquer une sensation d'impuissance ou des réactions inadéquates. Quant aux problèmes familiaux, ils s'accompagnent toujours d'un sentiment d'impuissance, de résignation et de blocage et comportent une forte composante affective.Chacun des types de problèmes examinés tend à être résolu de manière spécifique; il reste qu'on peut cerner trois stratégies qui sont mentionnées le plus fréquemment par rapport aux différents types : la personne concernée tente de s'aider elle-même, elle parle de son problème avec des connaissances ou elle s'adresse à un service public de consultation. Ce n'est qu'en bas de liste que sont mentionnés d'autres moyens de trouver un soutien, entre autres : psychologue/psychiatre/psychothérapeute, hôpital/foyer, politiciens, médecin de famille. Lorsque les problèmes sont en rapport avec le monde du travail ou l'insécurité matérielle la majorité des personnes interrogées cherche à s'aider elle-même. Certaines d'entre elles pensent que seule une modification des conditions sociétales, dans le cadre des lois ou de la politique sociale, pourrait apporter un changement positif. Par contre, pour gérer des problèmes de relation au sein de la famille on compte beaucoup moins sur ses propres ressources et s'adresse souvent à des connaissances. C'est aussi dans ce domaine que les personnes concernées sont le plus disposées à rechercher un soutien professionnel. Dans l'échantillon inclus dans l'étude, personne n'a fait l'expérience personnelle d'un traitement psychothérapeutique. Mais le tiers environ des répondants connaît quelqu'un (connaissance ou parent) qui a fait une psychothérapie. Les expériences vécues par d'autres ne suffisent pas à faire évoluer l'attitude que ces personnes ont envers la psychothérapie - du moins lorsque celle-ci est clairement définie. Toutes sont en fait fondamentalement ambivalentes à son égard ou vont jusqu'à la considérer comme négative. De plus, lorsqu'on analyse les réponses, on constate que celles qui expriment un point de vue positif ne le font pas avec beaucoup de conviction : on pense d'une part que la psychothérapie peut apporter un «soutien dans la vie», qu'elle peut offrir des expériences et un certain savoir-faire ou «des conseils». On perçoit les thérapeutes comme des professionnels compétents qui, le cas échéant, vont apporter un soutien au niveau social ou familial. De nombreuses personnes indiquent que le secret professionnel et la « neutralité» du psychothérapeute constituent des aspects positifs. D'autre part, certaines réponses mentionnent que la psychothérapie peut fournir un soutien au niveau du « développement de la personnalité ». Le thérapeute est compétent, on peut lui parler de soi et de ses problèmes et ceci peut apporter une amélioration de la « qualité de vie ». Parmi les réponses exprimant un point de vue négatif, l'argument le plus fréquent est celui selon lequel la psychothérapie n'est utile que lorsque quelqu'un souffre de «troubles psychiques », de «maladie mentale» ou de «gros problèmes ». On ne peut s'empêcher de penser que les répondants font parfois de la psychothérapie une démarche très spéciale pour s'en démarquer aussi nettement que possible. Ils construisent une sorte de barrière : « bien sûr j'ai des problèmes plus ou moins importants, mais tant qu'ils ne sont pas potentiellement 'mortels' consulter un psychothérapeute ne se justifie pas ». La prophylaxie ou la prévention d'évolutions possibles ne semblent pas appréciées. De plus, accepter un soutien psychothérapeutique paraît s'accompagner pour de nombreuses personnes d'une perte de prestige social ou de confiance en soi. Un obstacle supplémentaire sur la voie conduisant au cabinet du thérapeute est constitué de gêne - on n'ose pas confier à un «parfait étranger» ses «secrets» personnels et intimes. «Le divan » est encore souvent mentionné en tant qu'association; il symbolise sans doute le traitement de longue durée que seuls les membres des classes supérieures peuvent s'offrir. Dans ce sens, les thérapeutes comme leurs clients sont perçus comme appartenant à un milieu social plus élevé que celui des répondants. Nombreux sont d'ailleurs ceux qui considèrent que les traitements psychothérapeutiques sont trop chers. Dans l'ensemble, l'étude confirme qu'il est indispensable de mettre en œuvre des mesures qui faciliteraient l'accès aux traitements. Il serait également souhaitable que d'autres études soient menées qui permettraient de mieux définir les raisons qui font que de larges couches de la population ont une attitude très réservée par rapport à la psychothérapie.

Management in der Sozialwirtschaft hat eine besondere Bedeutung im Sinne eines Alleinstellungsmerkmales für soziale Organisationen und Unternehmen, dies soll analog selbstverständlich auch für ein Management der Achtsamkeit in sozialwirtschaftlichen Unternehmen gelten. Wenn Führungskräfte in der Sozialwirtschaft eine erhöhte Selbstaufmerksamkeit und Selbstregulation besitzen, dann strahlt dies auch in die Organisation hinein und steigert insgesamt die "kollektive Achtsamkeit" im Unternehmen. Insofern ist ein Management der Achtsamkeit eine Lern- und Entwicklungsaufgabe für Führungskräfte in der Sozialwirtschaft. Ergebnisse und Perspektiven für ein Management der Achtsamkeit im Rahmen einer qualitativen Führungskräftebefragung von Spitzenmanager/Innen in der Sozialwirtschaft Der sozialwirtschaftliche Bezugsrahmen ist immer auch einer "Ökonomie des Sorgens" (CAREÖkonomie) verpflichtet, die einerseits selbstorganisiert und andererseits staatlich oder kommunal orientiert im Sinne einer Daseinsvorsorge zu organisieren ist. Es geht in sozialwirtschaftlich tätigen Unternehmen immer auch darum, dass Verwirklichungschancen von Menschen realisiert, gefördert und vermehrt werden, es geht um Partizipation, Gerechtigkeit und gesellschaftliche Teilhabe. Führungskräfte in der Sozialwirtschaft benötigen zur komplexen Tätigkeit im Management eine Bandbreite von unterschiedlichen Kompetenzen, sie müssen Probleme im Unternehmen frühzeitig erkennen, dazu gehört, dass sie Problemlösungsprozesse initiieren und sachgerechte Lösungen erarbeiten und bewerten können, dass sie Akzeptanz bei den Beteiligten und Betroffenen begründen und Erfolge, Resultate und Wirkungen ihrer Maßnahmen kontrollieren und evaluieren. Bei der Beschreibung von ethischen Kompetenzen sind die Herausforderungen an das Management besonders komplex. Ethik und Ökonomie befinden sich in einem strukturellen Spannungsverhältnis. Für die Entwicklung von ethischer Kompetenz muss den Führungskräften in der Sozialwirtschaft neben dem Handwerkszeug der Betriebswirtschaft und der Sozialen Arbeit auch eine ethische Orientierung vermittelt werden. Zur ethischen Orientierung müssen sich Führungskräfte in der Sozialwirtschaft Fragen nach einem guten Leben und sozialer Gerechtigkeit stellen. Welche Werte sind zu schaffen (sinnvolles Wirtschaften), wie wollen wir in Zukunft leben (attraktive Lebensformen), ist unser Wirtschaften uns selbst zuträglich (gutes Leben, individuelle Lebensqualität), sind wir als Führungskräfte in der Sozialwirtschaft nicht zu einem Management der sozialen Gerechtigkeit verpflichtet und wie sieht eine auf Sorge und Achtsamkeit ausgerichtete Ethik aus? TIETZE definiert in seiner Dissertation: "Management der Achtsamkeit –ethische Kompetenz von Führungskräften in der Sozialwirtschaft" Management der Achtsamkeit wie folgt: "Handeln in Führungspositionen ist immer ein bewusster Akt, der von Führungskräften in sozialen Kontexten eine besondere Selbstaufmerksamkeit und Selbstreflexion einfordert. Achtsamkeit unterbricht in vielen Alltagssituationen routinisierte Gedanken- und Gefühlsabläufe und führt bei Führungskräften in sozialen Organisationen, die in ihren Entscheidungsprozessen Glaubwürdigkeit, soziale Werte und ökonomische Zweckrationalitäten ausbalancieren müssen, zu mehr Feingefühl, Konzentration und Offenheit für Innovationen und nachhaltige Veränderungen. Insofern ist die Achtsamkeitsorientierung eine qualitativ hochwertige Managementstrategie in der Sozialwirtschaft – sie ist untrennbar verknüpft mit der spezifischen Ethik Sozialer Arbeit." So verstanden ist ein Management der Achtsamkeit ein Alleinstellungsmerkmal für soziale Organisationen und Unternehmen. Soziale Gerechtigkeit, CARE-Ethiken, "gute Kaufmannschaft", nachhaltige Unternehmenskonzepte und Achtsamkeit im Umgang mit den natürlichen Ressourcen, mit den anvertrauten Adressaten und mit sich selbst dürfen keine Gegensätze sein, sie müssen Ausdruck einer neuen ganzheitlichen Sichtweise für ökonomisches Handels in sozialen Unternehmen sein. Die Aussagen einer qualitativen Studie mit Expert/Inneninterviews von Spitzenmanager/Innen der Sozialwirtschaft, die TIETZE im Rahmen seiner o.g. Dissertation durchgeführt hat, bestätigten: Führungskräfte in der Sozialwirtschaft sind "Schlüsselpersonen" für Werte und ethische Grundüberzeugungen und sie haben eine besondere Vorbildfunktion für achtsames Führungsverhalten. Die öffentliche Reputation eines sozialwirtschaftlichen Unternehmens und sein gutes Image kann dagegen durch Unachtsamkeit in der ethischen Orientierung gefährdet werden. Nach den aktuellen Erfahrungen der weltweiten Wirtschaft- und Finanzkrise ist in seiner Studie auch bei Führungskräften der Sozialwirtschaft eine neue ökonomische "Nachdenklichkeit" festzustellen. Im Rahmen des Forschungsprozesses konnte ein allgemeiner Wandel in den Einstellungen der Führungskräfte in Richtung Nachhaltigkeit festgestellt werden. Diese positive Entwicklung kann dazu beitragen, dass zukünftig die Integration der unterschiedlichen Handlungskonzepte von Sozialer Arbeit und, Management in der Sozialwirtschaft in der Praxis sozialwirtschaftlicher Unternehmen besser gelingen kann. Ein weiteres Ergebnis der Studie besagt, dass ein Management der Achtsamkeit zukünftig Werteprozesse analysieren und auf überprüfbare und wirksame Instrumente setzen muss, um ethische Reflexion und gelebtes Wertemanagement im Alltag in Entscheidungs- und Führungsprozessen zu steuern. Ethik wirkt dort, wo es gilt unterschiedliche Auffassungen oder Wertepluralitäten auszubalancieren. Die Anteilnahme von Führungskräften am Alltag der Belegschaft in sozialen Organisationen hat dabei eine hohe Bedeutung und ist eine besondere Form der Wertschätzung, gerade in der Mitarbeiterführung müssen sie nach Meinung der Expert/Innen weitaus emphatischer agieren als in anderen Dienstleistungsbranchen. Achtsamkeit stellt einen Wert für sich dar und will in jeder Situation vollständig präsent zu sein. Achtsamkeit verfolgt das Ziel, die Mitarbeiter/Innen sowohl untereinander als auch in Bezug auf die Kunden beziehungsfähiger zu machen. Asymmetrische Beziehungen müssen frühzeitig erkannt, reflektiert und integriert werden. Zu einer Kultur der Achtsamkeit, so die Studie, gehört ein gelebtes Unternehmensleitbild, das immer wieder in praktischen Leitbilddiskursen erarbeitet werden und erneuert werden muss. Führungskräfte haben für eine Kultur der Achtsamkeit eine Vorbildfunktion und sind sich ihrer Wirkung und Verantwortung für ein gelebtes Unternehmensleitbild bewusst. Zu ethischen Fragen und zu Fragen der Moral gehört eine hohe Reflexionsfähigkeit und Reflexionsbereitschaft, die sich im Alltagshandeln der Führungskräfte täglich beweisen muss, d.h. das Leitbilder auch im persönlichen Führungsverhalten der Führungskraft transparent werden müssen. Achtsamkeit ist dabei ein besonderer Ausdruck von Wertschätzung aller am Prozess Beteiligten. In der gegenwärtigen Finanz- und Wirtschaftskrise kann und soll die Sozialwirtschaft eine Initialfunktion übernehmen, so das Fazit des Autors der Studie. Sie ist unbelastet im Hinblick auf die Verursachung der derzeitigen Krise – ist Opfer und nicht Täter. In der Zukunft geht es um eine Rückbesinnung auf Werte wie Vertrauen, Ehrlichkeit, Solidarität, gute Kaufmannsschaft, Achtsamkeit und soziale Gerechtigkeit. In der Zukunft geht es im Management der Sozialwirtschaft um eine neues nachhaltiges Ökonomieverständnis, es geht um die Stabilisierung von sozialen Werten, um soziale Verpflichtungen, Anreizsysteme für wertekonformes Verhalten, Förderung von eigenverantwortlichem Handeln, wertebezogene Karrieremuster und entsprechende Weiterbildungsmaßnahmen. Achtsamkeit, bzw. achtsamer Umgang mit Menschen, der Umwelt und sich selbst ist ein zentrales und innovatives Thema für die Sozialwirtschaft. Der Grad der Achtsamkeit ist entscheidend für die Zukunftsfähigkeit einer humanen und gerechten Gesellschaft. Ein Management der Achtsamkeit stellt daher zukünftig eine zentrale Lern- und Entwicklungsaufgabe für Führungskräfte in der Sozialwirtschaft dar. ; Management in social economy has a special meaning in terms of unique selling points for a social organization or enterprise. This should apply of course analog to Management of Mindfulness in social economic businesses. When social economy executives have an elevated self consciousness and self regulation, it is reflected in the organization and boosts the "collective mindfulness" within the company altogether. In this respect, the Management of Mindfulness is a learning assignment and developmental task for executives in social economy. Results and prospects for a Management of Mindfulness in the context of a qualitative survey of top managers in social economy The social economy frame of reference is always obligated to an "Economy of Care", which is on one hand self organized. On the other hand it is orientated governmentally or communally, and it is organized in terms of a provision for existence. Among other things, social economic businesses put an emphasis on realizing, supporting and increasing its employees' chances of self-fulfillment. It is about justice and social participation. Social economy executives require extensive expertise in the complex management of operations. They have to be able to identify arising problems in the organization at an early stage and initiate the process of solving them by developing, and reviewing appropriate solutions. Further more, they have to ensure acceptance among the involved persons and they should be able to evaluate and control the achievements, results and effect of their arrangements. When describing ethical competence, the expectations towards the management are complex. Ethics and economy are in a structural stress ratio. To develop ethical competence the social economy executive has to be imparted with an ethical orientation, along with the basic principles of business administration and social work. For a better ethical orientation, social economy executives have to ask themselves questions about a "good life" and social justice, What values are to be added (reasonable economic activity)? How do we want to live in the future (attractive life style)? Is our economic activity supporting our well-being ("good life", individual quality of life)? Are we not, as executives in social economy, compelled to a management of social justice? What does care and mindfulness oriented ethics look like? In his dissertation: "Management of Mindfulness – Ethical competence of executives in social economy" TIETZE defines Management of Mindfulness as follows: "Acting in executive positions is always a conscious act, and in social contexts it requires a particular self-consciousness and self-reflection of the executive. Mindfulness interrupts routinized thought and emotion processes in many everyday situations. For social organization executives, who are balancing their credibility in decision making processes, their social values and their economic instrumental reason, it leads to more sensitiveness, concentration and openness for innovation and lasting changes. In that respect, the orientation on mindfulness is a high-quality management strategy in social economy – it is inextricably connected to the specific ethics of Social Work." This being said, Management of Mindfulness is a unique selling point for social organizations and enterprises. Social justice, CARE – Ethics, "good mercantile community", lasting corporate concepts and mindfulness when dealing with natural resources, with the entrusted clients and with oneself must not be contradictory. They have to be expressions of a new, integrated perception for economic actions in social businesses. The conclusion of a qualitative survey with interviews of top managers from the social economy, which TIETZE conducted in the context of his dissertation, confirms: Executives in social economy are "key personalities" for values and ethical basic beliefs and they have a particular function as a role model for attentive leadership. The public reputation of a social organization and its good image can be endangered by inattentiveness towards its ethical orientation. With the world wide economic and financial crises prevailing, TIETZE recognizes a new economic "reflectiveness" in the mindset of executives in social economy. In the context of the scientific process, a general change towards sustainability was detected in the attitude of the executives. This positive development can contribute to a better integration of different concepts of action of social work and social economy management within social organizations. Furthermore, the study shows that a management of mindfulness has to analyze its valuation tasks and needs to focus on checkable and effective instruments in the future. This is inevitable to successfully control ethical reflection and lived value management in the everyday life in decision making and leading processes. Ethics is effective when balancing different perceptions or different values. The participation of executives in the everyday life of their staff in social organizations is of great importance and a special form of appreciation. In the experts' opinion, the management has to react more emphatically than in any other service sector when it comes to leadership. Mindfulness is a value for itself and wants to be fully present in every situation. Mindfulness has the goal of supporting the staff in their ability to form and maintain a good relationship towards each other as well as towards the clients. Asymmetrical relationships have to be identified, reflected and reintegrated at an early stage. According to the survey, a lived corporate mission is essential for a culture of mindfulness, and it should be developed and renewed in practical debates. Executives are a role model for the culture of mindfulness and ought to be aware of their influence and responsibility for a lived corporate mission. A strong ability and willingness to reflect is significant when facing ethical and morally questions, and it is assessed in the daily action of an executive, i.e. the missions have to be transparent in the leadership behavior. Mindfulness is thereby a special expression of appreciation of all participants in the process. According to the result of the author's survey, the social economy could and should start an initiative in the ongoing financial and economic crisis. It has not caused the momentary crisis but it is a victim. The future is about returning to values like trust, honesty, solidarity, good mercantile community, mindfulness and social justice. Furthermore the future in social economy management lies in a sustainable economic understanding. It is about stabilizing social values, about social commitment, incentive systems for value compliant behavior, encouragement of self dependent actions, value orientated career pattern and corresponding professional development programs. A central and innovative matter in the social economy is mindfulness respectively mindful dealing with people, the environment and oneself. The degree of mindfulness is crucial for a sustainable, human and fair society. Hence, the Management of Mindfulness provides a central learning assignment and developmental task for social economic executives.
