Lo studio del lato soggettivo del rapporto è centrale nella teoria dell'obbligazione. Ci si chiede se la modificazione di una o anche di entrambe le parti del rapporto determini sempre la sua estinzione o se, invece, si conservi la sua unitarietà oggettiva. La risposta a questo interrogativo è stata diversa a seconda delle diverse epoche storiche. Nel diritto romano si riteneva che la variazione di qualunque soggetto determinasse l'estinzione del rapporto e la costituzione di una nuova obbligazione (novazione soggettiva). Tale soluzione è stata osteggiata dai codificatori moderni per i quali, in caso di modifica delle personae non si ha estinzione del rapporto, ma solo il mutamento di uno dei suoi elementi. Quanto ai diritti di garanzia, in particolare l'ipoteca, i principi generali essenzali sono la specialità e l'accessorietà. Quest'ultima caratteristica è dirimente in caso di modificazione soggettiva del rapporto e ciò emerge in sede di trattazione delle singole fattispecie del Codice Civile che la determinano, sia quanto al creditore sia quanto al debitore. Per velocizzare il subentro nel credito, nel 2007 è stato approvato il decreto Bersani (sulla portabilità del mutuo) che ha consentito di rimuovere vincoli a tale circolazione, nell'ambito dei rapporti bancari. Le caratteristiche della modificazione del rapporto obbligatorio, tuttavia, possono minare l'efficacia della riforma Bersani. Questo è il motivo per il quale taluni studiosi ritengono necessario procedere a un'ampia rivisitazione dell'intero diritto ipotecario, eliminando, sulla scia di quanto accaduto in altri ordinamenti europei, il requisito dell'accessorietà del vincolo. Nonostante ciò, a causa dei rischi connessi a questa riforma, si ritiene preferibile affinare il meccanismo di perfezionamento della portabilità, eliminandone le criticità, senza però pregiudicare le sicurezze dell'attuale sistema giuridico, di cui l'accessorietà dell'ipoteca rispetto al credito costituisce un importante caposaldo. ; The study about the subjective side of the legal relationship is pivotal in the theory of the obligation. The question is whether the modification of one or even both parts always entails its extinction or whether its objective unity is preserved. The answer has been different depending on historic ages. In the Roman law, the variation of any subject entailed the extinction of the relationship and the constitution of a new obligation (subjective novation). Such solution has been opposed by modern legislators, for whom, in case of modification of the personae, not the extinction of the relationship, but only the change of one of its elements happens. As for the property secutities, especially the mortgage, the essential general principles are the specialty and the accesority. The latter feature is crucial in case of subjective modification of the relationship, and this emerges in the dissertation about the singles typologies of the Italian Civil Code that determines it, in both active and passive point of view. In order to quicken the transfer of the credit, in the 2007 the "Bersani Decree" (on the portability of the loan), that allowed to remove the ties of the credit circulation in the banking relationships area, was approved. The features of the modification of the obligatory relations, however, can undermine the effectiveness of the Bersoni reform. This is the reason why some scholars support a vast review of the whole mortgage law, removing, in the light of what occurred in other European systems, the requirement of the acessority of the tie. Nevertheless, due to the risks related to this reform, refining the mechanism of improvement of the portability is considered preferable, while removing the criticalities without compromising the certainties of the present system, of which the acessority of the mortgage is an important foundation.

Il presente lavoro mira a una ricostruzione della condizione giuridica del fondo comune di investimento, definito come "patrimonio autonomo e distinto", su cui il legislatore non ha preso alcuna posizione espressa sul piano della titolarità, lasciando all'interprete il relativo (e tormentato) compito. A tal fine, l'esame critico della disciplina, alla luce di ulteriori forme di separazione patrimoniale rinvenibili nell'ordinamento giuridico, richiede un approccio metodologico teso sì a una ricostruzione in retrospettiva della questione ma anche a una sua analisi sistematica. La prima parte prende avvio dall'analisi della disciplina dei fondi comuni di investimento e della gestione collettiva del risparmio, ripercorrendo i tratti salienti della normativa al fine di acclararne la ratio. Rifuggendo da una redazione meramente compilativa, tale analisi risulta necessaria ai fini dell'esame degli aspetti problematici concernenti la natura giuridica dei fondi comuni di investimento, che non può essere avulso dal relativo contesto normativo. La seconda parte è dedicata al tema della qualificazione giuridica del fondo e della relativa titolarità alla luce della risalente dottrina, dell'evoluzione normativa e della giurisprudenza pronunciatasi sul punto. Sotto questo profilo, la prospettiva di indagine mira ad approfondire alcuni degli spunti emergenti dalle riflessioni teoriche concernenti la natura e la titolarità del fondo, avendo riguardo non solo alla classiche categorie civilistiche ma anche alla reale essenza della struttura e della disciplina dei fondi comuni di investimento e alle specifiche finalità di tutela degli interessi degli investitori perseguite dalla disciplina. Seguendo questo percorso, l'ultima parte volge uno sguardo doveroso alle tematiche concernenti le funzioni della separazione dei patrimoni nell'ambito dei mercati finanziari e del diritto positivo, senza pretermettere le categorie civilistiche, di diritto interno e di diritto straniero, sottese alle fattispecie considerate. ; The work aims to reconstruct the legal status of investment fund, on which law has not taken any position expressed in terms of ownership. The first part focuses on an analysis of the regulation of investment funds and collective investment management. The second part focuses on the problematic aspects concerning the legal nature of funds and its ownership. In this light, the prospective aims to explore the leading cases regarding the investment fund and some of the theories emerging in the doctrine, with particular attention with the traditional categories of civil law and the real essence of the regulation of investment funds. The last part examines the functions of the separation and segregated liability in financial markets and in the positive law.

L'elaborato si occupa della disciplina penalistica dei diritti di proprietà intellettuale, analizzando la vasta e stratificata legislazione in materia di marchi, denominazioni d'origine, Made in Italy e diritto d'autore. Alla luce delle trasformazioni dei fenomeni contraffattivi e in ossequio al principio di sussidiarietà lo studio si propone di vagliare l'efficacia delle molteplici misure di carattere repressivo recentemente introdotte in un ambito soggetto ad intense spinte di criminalizzazione, promuovendo altresì una maggiore razionalità dell'intervento punitivo unitamente ad una più spiccata sensibilità tanto sui confini dei comportamenti penalmente rilevanti, tanto sulla prevedibilità delle decisioni giudiziarie. Tra le research questions del lavoro si pongono anche la necessità di verificare l'esistenza di uno statuto penale degli Internet Service Provider, nonché la valutazione della posizione del singolo consumatore/acquirente grazie a un approccio "giurisprudenziale" e casistico. Un ampio interesse è inoltre dedicato alla comprensione dei modelli di common law e in particolare del diritto federale statunitense favorendo un'analisi comparatistica e orientata alle fonti sovranazionali oramai ineludibile, specialmente nella materia in esame. ; The paper deals with the criminal regulation of intellectual property rights, analyzing the huge and layered legislation on trademarks, appellations of origin, "made in Italy" and copyright. Having considered the transformations of counterfeiting phenomena and in accordance with the principle of subsidiarity, the study aims to investigate the effectiveness of various repressive measures recently introduced in an area subject to intense pressures of criminalization, in order to encourage greater rationality in punitive intervention together with a more marked sensibility on the predictability of judicial decisions. Among the research questions of the work, and thanks to a 'case law' approach, there are: the need to verify the existence of a criminal statute of Internet Service Providers, as well as an evaluation of the individual consumer / buyer position. A broad space is also devoted to the understanding of the common law models and in particular the US federal law encouraging comparative analysis between Italian and European standards.

Public policies on libraries and copyright are aimed at fostering knowledge and protecting everyone's freedom of expression. However, in the digital environment, copyright policies acquired a major role on library services resulting in severe constraints to their normal operation. While EU strategies in support of libraries are mainly based on incentives and non-binding recommendations, exclusive intellectual exploitation rights are very strictly regulated, with the result of preventing the natural spread of knowledge both at a national and international level. As a consequence of these policies, libraries today face complex negotiations to get licence agreements often inadequate to their mission.The paper points out the major problems to be solved, and clarifies the reasons behind the reforms that have been proposed in WIPO and in the European Union in order to harmonize, expand and strengthen the limitations and exceptions to copyright: to promote access to cultural and creative content and foster the production of new knowledge. ; Nell'ottica dei diritti fondamentali, le politiche pubbliche in materia di biblioteche e di diritto d'autore rispondono a finalità di promozione culturale e di tutela della libertà di manifestazione del pensiero. In ambiente digitale, i diritti di privativa hanno però assunto un peso preponderante sui servizi bibliotecari, determinando forti condizionamenti al loro normale esercizio. Mentre le strategie dell'Unione Europea a sostegno delle biblioteche, confidando nella capacità di autoregolazione del mercato, si basano prevalentemente su incentivi e raccomandazioni non vincolanti, i diritti esclusivi di utilizzazione economica di autori e loro aventi causa fanno leva da decenni su una produzione normativa intensa e incessante che ha finito per condizionare pesantemente la diffusione della conoscenza a livello nazionale, europeo e internazionale. Per effetto di queste politiche le biblioteche oggi devono affrontare complesse negoziazioni per ottenere contratti di licenza d'uso spesso non soddisfacenti in rapporto alla loro missione di servizio.L'articolo evidenzia le principali criticità da risolvere e le ragioni a sostegno delle riforme che sono state proposte – sia in ambito OMPI sia nell'Unione Europea – al fine di armonizzare, ampliare e rafforzare il sistema delle «eccezioni e limitazioni» al diritto d'autore, in modo da garantire un accesso più ampio possibile alla produzione culturale e incoraggiare la produzione di nuova conoscenza favorendo il confronto culturale e creativo.

La tesi di dottorato ha come oggetto di studio gli aspetti sostanziali della vendita giudiziale da un punto di vista comparatistico tra Spagna e Italia. Si tratta di un tema che non è stato analizzato profondamente dalle più recenti dottrine spagnola e italiana, che è caratterizzato da una notevole complessità tecnica visto il suo forte carattere interdisciplinare (in particolare, processuale-sostanziale) e la cui vigenza attuale è stata intensificata dalla grande quantità di processi di esecuzione che in questo periodo di instabilità economica sono una constante nei Tribunali spagnoli e italiani. Il fatto che costituisca un'istituzione giuridica inquadrata nell'ambito del processo di espropriazione forzata fa sì che questa possieda un accentuato carattere processuale e, infatti, è il legislatore processuale che si occupa per la maggior parte del suo regime giuridico. Tuttavia, al di là di questa sua natura evidentemente processuale, essa produce una serie di effetti sostanziali di enorme importanza, che sono proprio l'oggetto della tesi di dottorato, nello specifico ambito dei beni immobili (considerando la grande importanza economica e pratica dei diritti di questa natura nella nostra realtà socio-economica). ; The PhD thesis seeks the study of the civil aspects of the judicial sale from a comparative point of view between Italy and Spain. It is a subject which hasn't been deeply analyzed by the recent Italian and Spanish doctrine, and which is characterized by a considerable technical complexity due to its interdisciplinary nature (mainly, procedural and civil). It is also a current issue in this period of economic crisis in which foreclosure processes are a day by day reality of our Courts. The fact of being an institution framed in the foreclosure process outlines its procedural nature, but that cannot hide the fact of producing important civil effects of great importance which are precisely the aim of the PhD thesis.

L'elaborato prende in considerazione la persecuzione patrimoniale avvenuta a Bologna e Ferrara, le due città con le Comunità ebraiche più numerose dell'Emilia-Romagna e che subirono i danni e le perdite più ingenti. Attraverso i fondi della prefettura e della questura, conservati presso i locali Archivi di Stato, è stato possibile ricostruire il meccanismo burocratico e le procedure amministrative con cui la normativa fu applicata nelle singole realtà locali. La persecuzione patrimoniale contro gli ebrei italiani fu uno degli assi portanti della legislazione razziale emanata dal regime fascista nel 1938, che colpì attività professionali, aziende, e proprietà immobiliari e rurali. Il passare dei mesi e il peggiorare della situazione politica, complice anche il conflitto mondiale, portarono ad un progressivo inasprimento delle requisizioni, che nei territori della Repubblica sociale italiana raggiunsero il culmine. Il tema delle requisizioni è legato a quello delle restituzioni, che iniziarono immediatamente dopo la Liberazione e proseguirono per lungo tempo tra inciampi burocratici, lacune legislative e vicende giudiziarie che segnarono la ripresa materiale e identitaria degli ebrei e dell'ebraismo italiano nel dopoguerra. ; This study takes into consideration the persecution that took place in Bologna and Ferrara, the two cities with the largest number of Jewish communities in Emilia-Romagna and which suffered the most damage and losses. Through the funds of the Prefecture and the Police Headquarters, preserved in the local State Archives, it was possible to reconstruct the bureaucratic mechanism and the administrative procedures with which the legislation was applied in each local area. The persecution of Italian Jews was one of the cornerstones of the racial legislation enacted by the Fascist regime in 1938, which affected professional activities, businesses, and real estate and rural properties. The passing of the months and the worsening of the political situation, also due to the world conflict, led to a progressive tightening of requisitions, which reached their peak in the territories of the Italian Social Republic. The theme of requisitions is linked to that of restitution, which began immediately after the Liberation and continued for a long time amidst bureaucratic stumbling blocks, legislative gaps and judicial events that marked the material and identity recovery of Jews and Italian Judaism after the war.
