在網絡上,資訊技術及其使用改革了版權作品的使用方式。因特網根本性改變了版權市場。本文試圖論證,中國內地法律必須給予資訊技術足夠的發展空間,同時不能不合理地損害版權所有人的利益。 ; 本文認爲,在中國版權立法和適用中,版權功利主義理論起著根本性作用。根據功利主義,版權法的目標是促使社會文明的最大化發展。而且中國政府必須發展數字經濟,且須保證其版權法合理地促使網絡中間商運行和投資中國數字經濟。中國版權法需爲資訊技術提供足夠的發展空間。 ; 基於為資訊技術發展尋求足夠發展空間的目的,本文分析了Sony案抗辯,通知-删除避風港,誘導侵權和合理使用。中國必須合理解釋中國現有制度,從而避免給網絡中間商加以不合理的責任。關於版權侵權抗辯,中國應該引入美國的 Sony抗辯,作為衡量是否侵犯版權的一個因素。且避風港保護的範圍應該被擴展至包含所有網路中間商,以保證未來技術的未知發展擁有足夠的呼吸空間。而且,至少,中國應該採用某些善意轉換性使用的窮盡式合理使用抗辯,以促進現有技術的運行。且更合適的是,採用非窮盡式的合理使用抗辯,其範圍包括所有對社會有用的網路中間服務的必須運營活動,並通過確保資訊技術發展的方式。 ; 一個好的法律框架可以對人類的進步有著積極的影響,不然它會對社會發展起著阻礙作用。我們需要的法律框架應該同時促進版權和信息傳播技術的發展。這意味著,在保證版權産業正常運行的同時,該法律框架應爲技術發展提供肥沃的成長土壤。 ; Information technology and its usage on the internet have revolutionized the way in which various copyrighted works are captured, stored, copied and distributed. By expanding the breadth, diversity and sheer number of copyrighted works in existence, the internet has fundamentally changed the nature of copyright markets. ; This thesis attempts to argue that the laws in Mainland China should reserve enough space for information technologies to develop, without unreasonably prejudicing the interests of copyright holders. ; This thesis contends that the utilitarian justification for copyright plays an underlying role in both Chinese copyright legislation and judicial application. Under the utilitarian model in China, fostering a maximization of culture development is the aim of the copyright law. As such, in the era of information overload, the Chinese government should aim to develop the Digital Economy. In order to achieve this aim, it needs to start by ensuring that its copyright law appropriately enables Internet Intermediaries to operate and to invest in creating Chinese Digital Economy. These social movements have been interwoven with local critiques of the urban renewal projects and heritage conservation policies implemented by the government. The critiques point out that the government policies overweigh economic development and further increase social disparity and marginalization of disadvantaged groups. The community museum in this study was established in a capitalistic model of urban development in Hong Kong. Various stakeholders construct their own discourses of "community and local culture" in the community museum in order to oppose official discourses about urban development and maximize their own interests. Thus the making of the "community and local culture" in this community museum reveals a negotiation among the parties of different social background. ; This research argues that the establishment and operation of the community museum enable groups from different social segments to negotiate and construct their own discourses based on their interpretations of local history and culture. Unauthorised use of the trademark logo on social media on a massive scale has led to frequent legal conflicts between trademark holders, social media providers and internet users and legal uncertainty. The thesis concludes that trademark infringement and dilution laws in the U.S. and EU are inadequate to solve this problem. The trademark logo on social media should be protected against unauthorised use, even though it is not used to sell the good or service the trademark indicates, but is used in a commercial environment. Two premises for any solution are that first the enforcement should be made automatic, since litigation on a case-by-case basis is not scalable, and second that the safe harbour provisions for online service providers, that aggravate the problem, should be substituted for strict liability. The trademark logo can be seen as the personification of the trademark holder, and one can argue that the stability of the trademark logo is not only in the interest of the trademark holder but also of society at large. One can argue that trademark dilution already provides a kind of moral right of integrity for the trademark logo. However, this right is limited to trademark logos that are considered famous or have a reputation, and, moreover, that are used in a commercial way. This thesis argues that also the trademark logo that did not reach the requested level of fame or reputation and is used in a non-commercial way should also be protected against unauthorised use on social media. Therefore the moral right of integrity is proposed for the trademark logo. Until the law will be amended to include a moral right of integrity for the trademark logo, this thesis suggests to implement proactive solutions in the walled gardens of social media as a testing ground for potential legislation. This automated solution is scalable, makes intellectual property protection and enforcement not only effective but also more calibratable to social policy goals and will inevitable lead to an algorithmic justice. ...

本研究以土樓為案例,引入了跨學科的方法考察社會政治機制對中國鄉土建築的變化產生的作用。針對目前認為土樓視為客家族群特有的家族性防禦建築的觀點,我指出了土樓建築形式具有異質性,而這一異質性必須從業主的產權結構出發去理解。通過結合分析社會結構和空間組成,我提出大部分的土樓形式是由相對貧困並且貧富分化不明顯的社區成員合資建造的一種低造價的合作社住宅。我進而以1958至1983年間的建造高峰為例,揭示了土樓地區的居民如何策略性地利用社會主義集體共有的農村產權關係大量建造合作社住宅。 ; 論文從建築的空間結構與建造過程、業主的社會組織以及政治環境的歷史變化三個方面考察土樓。第一章回顧現有的土樓研究,提出從業主的角度研究鄉土建築的方法,並介紹了本研究的資料來源。第二章提出了一個從業主社會結構考察鄉土建築的分析架構。通過考察集合住宅中的兩個層次的社會團體,家庭與集體,我提出了一組將社會結構與空間構成相聯繫的表達式。第三至五章分別從建築學、社會學和歷史學的角度具體證明與業主有關的各種因素如何將土樓塑造成住宅合作社,並展示了政治制度的轉變如何影響到建築形式的變化。最後一章總結了本研究的貢獻。 ; 本研究運用了多學科的研究方法,通過結合建築形式與建造過程的分析、人類學的調研方法、社會學的社區分析理論以及地方史的研究,探討鄉土建築的形成原因與演變邏輯。此外,本研究也試圖在研究土樓的基礎上探討多層面的問題,包括對地方建築形式的定義方法、鄉土建築的研究方法論以及如何從社區在住宅建造上的策略性選擇理解地方與國家的關係。 ; This dissertation is an interdisciplinary research on the socio-political system to explain the transformation of Chinese vernacular architecture within the context of tulou, an architectural form in Fujian Province, Southeastern China. I challenge the myth that tulou are Hakka clan houses or fortresses and argue that most tulou are affordable cooperative houses. I further suggest that these cooperatives were adapted to the People's Commune property system and hence, experienced construction peak from1958 to 1983. ; This dissertation examines the architectural form of tulou, the social structure of its proprietors, and the socio-political changes that occurred during China's socialist transformation. Chapter 1 opens with a review of the tulou literature, which also introduces a socio-political approach in studying Chinese vernacular architecture. In Chapter 2, I propose a set of symbolic expressions and models to analyze the property structure and spatial configuration of collective houses. The next three chapters engage in different perspectives of tulou built in the 1958-1983, including the architectural issues in Chapter 3, the social issues of the proprietors in Chapter 4, and the political issues in Chapter 5. 香港在主流革命史學的敘述中一般被認為是推動辛亥革命的「搖籃」,但在革命黨人之外的社會大眾,對「革命」究竟有怎樣的取態?《香港華字日報》是這段時期香港銷量最大的華文報紙,仔細考察該報創辦的歷史及其1909-1913年的政治取態,可見該報是華商陳氏家族的一份現代產業,並無黨派認同,報紙內容與宗旨也頗具現代傳媒的新聞專業主義色彩,強調「中立」而較少傳統「文人論政」情懷。 ; 本文選取1909-1913年的《香港華字日報》,剖析這五年的報紙中與「革命」相關的內容細節,認為這份報紙對「革命」並非積極推動,取態反而偏於保守,並順應時勢而調整:辛亥前報紙展現的「革命」介於傳統和現代之間,既是「犯上作亂」的傳統造反,又是謀求民族獨立、政治改良的現代革命;而辛亥之後,報紙不滿意革命黨建立的地方政府,轉而支持中央而強烈反對革命黨的「二次革命」。這樣的取態既反映了部份以往未得到充分審視的社會輿論,也與報紙自身的立場及處境有關。 ; Hong Kong is understood as the "birthplace" of the 1911 Revolution in mainstream studies of the Chinese Revolution. But besides the revolutionaries, how did ordinary people understand "revolution"? Wah Tsz Yat Po was the most widely circulated Chinese language newspaper in Hong Kong during the period concerned. The thesis is an in-depth study of the newspaper's founding history and its political stance during 1909-1913. It is found that the newspaper was a modernised property owned by the Chan family in Hong Kong. It did not have political affiliations. Its content and objectives showed the newspaper's emphasis on journalistic professionalism that was similar to that held by modern day mass media, preferring "neutrality" over the tradition of providing political comments. ; The thesis closely examines the content of Wah Tsz Yat Po that was related to revolution during 1909-1913. It proposes that the newspaper did not play an active role in promoting revolution. Its stance was rather conservative instead and changed in accordance with political developments. Before the revolution of 1911, the newspaper regarded "revolution" as something between tradition and modernity. It was understood as a "rebellion against the authorities" in the traditional sense and also as a way to attain national independence and political reform in the modern sense. After 1911, the newspaper was against the local government set up by the revolutionists. 經歷十三年風雨,香港樓價再創歷史新高。有云:「禍兮福所倚」,業主得益於財富增長的同時,亦擔心高速增長埋下泡沫爆破的伏線。因樓價高企,年青人置業困難,社會不滿亦日漸升溫。 ; 在國際貨幣基金組織出言警告後,香港金融管理局連同財政司相繼推出措施如額外印花稅,以及收緊不同物業種類的按揭上限,希望保持樓市健康及穩定發展。一石激起千重浪,政策推出後輿論不絶,但至今仍未有人以嚴謹的邏輯推論分析新政策的影響。本文以Stein (1995)的模型作藍本,稍作修改,以分析新政對樓價的影響。 ; 按照文中模型計算,於當前經濟環境下,新措施確能維持樓市健康及穩定發展。額外印花稅能壓抑樓價時,收緊不同物業種類的按揭上限能保持樓價平穩。理論模型同時指出,兩樣政策都不是萬能丹,政府於調控樓市時應先評估當前經濟基礎,否則有機會事與願違。 ; House price in Hong Kong is reaching its historical high. People start to worry a sudden drop of house price as what they had experienced in year 1997. Social disputes emerged and the Hong Kong government has taken several measures in reaction. Policies such as the Multi-down payment constraint by the HKMA and special stamp duty by the Financial Secretary are implemented in response to the soaring house price. The Media and the general public are keen to explore the effects and the consequences of the policies. However, little effort has been done to study the impact of the enacted policy in a systematic way. ; This thesis augmented the model developed by Stein (1995) to examine the housing price behavior of Hong Kong. Simulation results justified the government's policies. SSD helps to lower the house price while multi-down payment policy helps to stabilize the house price.
