Das Verhältnismäßigkeitsprinzip ist in Taiwan geltendes Verfassungsrecht, aber seine Rezeption, insbesondere im taiwanischen Steuerrecht, verbleibt letztlich im Groben und Allgemeinen. Um die Anwendung des Verhältnismäßigkeitsprinzips zu verfeinern und konkretisieren, wird in der Arbeit das gesamte Steuerrecht unter dem Gesichtspunkt des Verhältnismäßigkeitsprinzips unter Unterscheidung von Fiskalzwecknormen, Lenkungsnormen, Umverteilungsnormen, Vereinfachungszwecknormen und Vollzugsnormen untersucht. Im Anschluss wird das Verhältnis zwischen den verschiedenen steuerrechtlichen Normgruppen und den Verhältnismäßigkeitserfordernissen, die auf der grundrechtlichen Ebene Freiheits- und Gleichheitsrechte unterscheiden, begutachtet. Durch die systematische Zusammenschau des Verhältnismäßigkeitsprinzips in der Besteuerung bietet diese Arbeit einen Wegweiser für die taiwanische Verfassungs- und Steuerrechtswissenschaft. / »The Principle of Proportionality in Taxation. A Research on German Constitutional and Tax Law, and Its Application to Taiwanese Cases« -- The Taiwanese reception of proportionality principle, particularly in the field of tax law, has been unduly general and superficial. Therefore, based on proportionality principle, this research adopts a holistic approach to examine and distinguish various tax law norm groups i.e. fiscal purpose norms, control norms, redistribution norms, simplification purpose norms, and enforcement norms. The refined and clarified tax law norm groups may serve as a model for Taiwanese constitutional law and tax law's further research.
Autorice analiziraju praksu Europskog suda za ljudska prava povezanu sa zaštitom prava na poštovanje doma iz članka 8. Europske konvencije za zaštitu ljudskih prava i temeljnih sloboda s obzirom na pitanje razmjernosti. Kategorija razmjernosti promatrana je kao kriterij osiguravanja zaštite i kao materijalna pretpostavka za odlučivanje o razmjernosti miješanja države ugovornice u pravo na poštovanje doma. Istaknuti su predmeti kod kojih je iseljenje podnositelja zahtjeva uslijedilo u postupcima prisilnog namirenja stvarnopravno osiguranih tražbina i u tom je kontekstu istražena geneza kategorije razmjernosti od njezina nužnog ispitivanja do odluke prema kojoj nema potrebe za ispitivanjem razmjernosti. ; The authors discuss and analyse case law of the European Court of Human Rights regarding the right to respect for home under Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms and with respect the issue of proportionality. In the paper, the proportionality category was viewed as a criterion for securing protection and as a material precondition for deciding whether the State party's interference with the right to respect for home was proportionate. The cases in which the applicant's eviction occurred after national proceedings for the enforcement of mortgages were addressed. Es fällt auf, dass sich im Polizeirecht viele unbestimmte Rechtsbegriffe und »Regeln« finden, obwohl es zu grundrechtseingreifenden Maßnahmen ermächtigt, die durch das Gesetz an sich hinreichend vorgezeichnet sein müssen. Der Autor vertritt die These, dass sich der Inhalt mancher Facetten des unbestimmten Rechtsbegriffs der Gefahr allein aus ihrem normativen Kontext erschließen lässt. Im Übrigen nimmt er an, dass die Prüfung der Rechtmäßigkeit einer polizeilichen Maßnahme und die Ausfüllung aller damit verbundenen Wertungsspielräume durch den Verhältnismäßigkeitsgrundsatz geprägt sind. Der Autor zeigt, dass der Grundsatz der Verhältnismäßigkeit nicht nur die Ermessensausübung durch die Polizei determiniert, sondern dass die rechtlichen Anforderungen an polizeiliche Maßnahmen insgesamt auf einem durch den Verhältnismäßigkeitsgrundsatz bestimmten System von Abwägungsentscheidungen beruhen. / »The Police Law as a System of Weighing up Decisions Determined by the Principle of Proportionality« -- The author shows that the content of many facets of the indefinite legal concept of »Gefahr« can be developed solely from a normative context. Moreover, he demonstrates that the principle of proportionality not only determines the police's exercise of discretion, but that the legal requirements for police measures as a whole are based on a system of weighing up decisions determined by the principle of proportionality.

Die »Überwachungsgesamtrechnung« wird als »doppelte Verhältnismäßigkeitsprüfung« verstanden. Damit ist gemeint, dass neben den von Überwachungsmaßnahmen ausgehenden Belastungen für Betroffene auch die Folgen berücksichtigt werden müssen, die die Gesellschaft insgesamt treffen. Die Arbeit geht der Frage nach, ob eine solche »Rechnung« auf der Grundlage des verfassungsrechtlichen Verhältnismäßigkeitsgrundsatzes möglich ist. Dabei werden in einem ersten Teil grundlegende methodische Probleme der Güterabwägung und Leitlinien der verfassungsgerichtlichen Rechtsprechung zum Sicherheitsrecht analysiert. Im zweiten Teil der Untersuchung wird ein Vorschlag entwickelt, auf welche Weise eine Überwachungsgesamtrechnung operationalisiert werden kann. Die Erstellung einer »Überwachungsgesamtrechnung« ist Bestandteil der Sicherheitsagenda der neuen Bundesregierung und hat Eingang in den Koalitionsvertrag gefunden. / »The Total Surveillance Account«: The ›total surveillance account‹ is understood as a ›double proportionality test‹. The paper examines whether the constitutional principle of proportionality is suitable as a basis for such an ›account‹. For this purpose, methodological problems of balancing interests and guidelines of constitutional court jurisprudence on security law are analyzed. At the end, a proposal for the operationalization of a surveillance account is developed.

In May 2020, for the first time in its history, the Federal Constitutional Court (FCC) of Germany declared Union acts as being ultra vires. According to the FCC, the European Central Bank (ECB) and the Court of Justice of the European Union (CJEU) had acted beyond their mandates because they did not apply strong proportionality standards to the ECB's Public Sector Purchase Programme (PSPP). The resulting stalemate within constitutional pluralism has revived the discussion about the possible introduction of an Appeal Court with the "final say" over constitutional conflict. As the analysis of the PSPP conflict shows, such a judicial authority would reach its limits the more we move from the surface to the core of the struggles between European and national constitutional law. The different readings of proportionality are difficult to bridge, and the mutually exclusive claims about the nature of the supremacy of European law are not accessible to compromise at all. We should therefore not expect too much from an Appeal Court, if it were introduced.

Discusses Grundrechtsentfaltung im Gesetz (Development of Basic Rights within the Law) by Matthias Jestaedt (1999), which deals with the development & theories of basic rights, & takes a stand against the dismantling of concise boundaries & differentiations. In the center of his examination stands the increased prominence of basic rights, the principle of proportionality, & the method of weighing. Jestaedt presents a theory of law & uses a methodology that adequately captures the given object -- basic laws -- & provide a legally binding interpretation. The author contends that today the traditional concept of a source of law & a hierarchy of rights, as well as the idea of a sole original law-generating source are long outdated. E. Sanchez
This country report describes the reduced need for reform of the public initiative procedure in Switzerland. It also analyzes the implementation of a number of initiatives criticized for their violation of public international law. The report finds that parliament ameliorates the harshness of the initiatives by introducing hardship clauses safeguarding the proportionality of the initiative's application. As an initiative expressly targeted against the supremacy of public international law, the sovereignty initiative is closely scrutinized. Finally, the government's problem in reforming corporate taxation is evident in the clear majority of votes (59%) against the third version of the reform.

Crises are not only a test for society, they also pose a challenge to the legal order. This is revealed by the worldwide handling of the Coronavirus SARS-CoV-2 and the COVID-19 disease with a clarity that until recently probably nobody thought possible. Even in liberal democratic states, far-reaching restrictions on personal freedoms have been imposed, including lockdowns.
In addition to questions of proportionality, the scope of the parliamentary prerogative in the Corona crisis has been under discussion in Germany since March 2020. Contrary to some voices in legal literature, even serious encroachments on fundamental rights can be justified, at least temporarily, by executive orders based on the general clause under infection control law and its cursory clarifications. Though, as the duration and complexity of crisis management increases, so too does the constitutional exigency for fundamental decisions by the legislature.
The question of parliamentary prerogative also arises in the discussion about compensation payments, for example, for closure of businesses and other establishments during the lockdown. Since special provisions of infection control law often do not apply, some advocate a recourse to unwritten state liability law. However, this law is only geared to selective compensation and does not usually provide a legal basis for state liability in the Corona crisis. Here, too, the legislature must make improvements, if encroachments on fundamental rights – namely on the freedom of property – are no longer deemed proportionate without financial compensation. When assessing proportionality, however, the numerous aid programs must be taken into account.

In der verwaltungsgerichtlichen Rechtsprechung ist in jüngerer Zeit die Tendenz zu beobachten, eine Prüfung der Verhältnismäßigkeit im Einzelfall auch bei gesetzlich zwingend angeordneter Rechtsfolge durchzuführen. Das wirft grundsätzliche Fragen der Gesetzesbindung und Gewaltengliederung auf.Das Werk arbeitet diesen Befund systematisch auf und entwickelt insbesondere Kategorien, die es ermöglichen, Scheinprobleme von solchen Fällen zu unterscheiden, in denen ein von den Gerichten angenommener, verfassungsrechtlich begründeter Verhältnismäßigkeitsvorbehalt tatsächlich in Konflikt mit der gesetzgeberischen Regelung tritt. Weiterhin werden die Typisierungsbefugnis des Gesetzgebers sowie die Norm des Art. 100 GG als wichtige Schaltstellen identifiziert, die bestimmen, wie weit ein Verhältnismäßigkeitsvorbehalt bei gebundenen Entscheidungen reichen kann.
Unlike its US counterpart, the German Constitution offers all-encompassing protection; in American jargon German law thus is in the Lochner era. But this generosity only applies to individual freedom, not to private governance. There are select guarantees of governance too, as for the churches and the universities. But according to general wisdom, these guarantees are enumerative. This paper challenges the general wisdom. It claims two things: there is a general protection of private governance, enshrined in article 9 Basic Law. And a constitutional guarantee of governance is fundamentally different from the guarantees of freedom. Both classes of guarantees have in common that they protect against governmental intervention. Consequently, they also share the basic doctrinal properties. A governmental act must intervene into in an activity coming under the heading of the constitutional provision. And it must fall foul of the test of proportionality. But governance is protected as an activity. Government intervenes if private governance is prevented or impeded. Such intervention can be indirect, and therefore encompass internal organisation of the private governance body, or its access to resources. Yet neither the body's property nor its potential for making money are protected directly by the pertinent constitutional freedoms. Moreover, the proportionality principle has to be applied in a way that pays due respect to the fact that private governance by definition encroaches upon the individual freedom of its addressees.

The novel part of this paper is a model of the principle of proportionality, as the cornerstone of the doctrine of fundamental rights. German law, and with some modifications also the law of the European Community and the European Convention on Human Rights, do not categorically outlaw interventions into fundamental freedoms and human rights (as, in principle, the US doctrine). Rather a state measure that is classified as an intervention comes under the scrutiny of the Constitutional Court, the European Court of Justice or the European Court of Human Rights. All courts clear interventions only if government can show that they serve a legitimate aim, and that the concrete measure is conducive to this aim, is least intrusive, and appropriately balances the importance of the legitimate aim with the severity of the intervention. While the doctrine on all these elements is rich, many questions are unsettled. This paper uses simple concepts from microeconomic theory to formalize the steps, and thereby to clarify the doctrine.
