How has the teaching of public international law evolved in the regions that make up Switzerland as of today? Are there any peculiarities that have influenced this development, and who have been the proponents and teachers that have educated Swiss lawyers? To what extent has the development of a proper tradition in this area been influenced by the academic traditions outside the territory of Switzerland? This article tries to give a first overview of these questions in order to allow future research in this still understudied field of law. Most of Switzerland has been a latecomer regarding university education and in particular theoretical legal education. While the intensification of Switzerland's international relations in the 19th century leads to the (slow) introduction of courses in public international law, the special role in the aftermath of the two world wars has certainly led to a stronger tradition in this field than in many other States of similar size, initially with a strong interaction with neighbouring States, in particular Germany and France.

Die Arbeit beschäftigt sich mit dem Einfluss des Völkerrechts auf das deutsche Genehmigungsverfahren für den Export von Kriegswaffen und Rüstungsgütern. Der Handel mit Waffen und Rüstungsgütern ist ein Milliardengeschäft, mit weitreichenden politischen Konsequenzen. Wie sämtliche militärische Fragen bildet der internationale Waffenhandel einen sensiblen und schwer zu regulierenden Rechtsbereich, da viele Nationen schnell einen Eingriff in ihre staatliche Souveränität befürchten. Der internationale Waffenhandel ist jedoch mit vielen Problemen behaftet – so erscheint insbesondere die Lieferung von Waffen in Krisengebiete als kritisch, weil diese die Eskalation von Konflikten und Gewalt bewirken können. Ebenfalls können die Waffen von autoritären Regimen zur Unterdrückung der eigenen Bevölkerung missbraucht werden. Insgesamt ergaben sich aus dem Fehlen von internationalen Standards und Regularien für den globalen Handel mit konventionellen Rüstungsgütern bisher gravierende negative Folgen. So entstehen aus den nicht oder lediglich rudimentär vorliegenden Exportkontrollsystemen, namentlich bei Kleinwaffen, Leichtwaffen und Landminen, u.a. eine intensivere und schnellere Eskalation von Konflikten, anwachsende und ausufernde illegale Waffenmärkte sowie die Erhöhung des Risikos des Missbrauchs von Waffen gegen die Zivilbevölkerung. In diesem Kontext sollen idealerweise die internationalen und die nationalen juristischen Gestaltungsmittel der Kontrolle der Rüstung und des internationalen Waffenhandels ein übergreifendes politisches Konzept zur Herstellung von stabilen zwischenstaatlichen Beziehungen und zur Gewährleistung der internationalen Sicherheit bilden. Im Spannungsfeld zwischen den internationalen und den nationalen Interessen und Bestimmungen wird hier die Bedeutung des deutschen Grundgesetzes und des internationalen Rechts im Bereich des Waffenhandels für das deutsche Genehmigungsverfahren für Rüstungsexporte relevant.
Nicht nur Waren und Kapital überschreiten in einer arbeitsteiligen internationalen Wirtschaft regelmäßig die Landesgrenzen, sondern zunehmend auch die Arbeitskräfte. Hier stellt sich dann die Frage nach dem auf diese Arbeitsverhältnisse anwendbaren Recht. Aus der Perspektive des Völkerrechts geht es dabei um die Schaffung internationaler arbeitsrechtlicher Standards. Da es diese aber, etwa im Rahmen der ILO, nur punktuell gibt und zudem nur Staaten und nicht einzelne Vertragsparteien verpflichten, sind für das jeweils anzuwendende Recht die nationalen Kollisionsrechte (irreführenderweise als Internationales Privatrecht bezeichnet) zentral. In der folgenden Abhandlung werden die Grundstrukturen des deutschen Arbeitskollisionsrechts im EGBGB (Einführungsgesetz zum BGB) aufgezeigt. Im Mittelpunkt steht das Verhältnis zwischen dem Grundsatz der freien Rechtswahl und den vielfältigen Einschränkungsmöglichkeiten dieses Prinzips. Anhand des Beispiels eines Arbeitsvertrages mit Bezügen zum deutschen, britischen und USamerikanischen Recht wird aufgezeigt, wie die Wertungen des nationalen Kollisionsrechts die Anwendbarkeitsentscheidung beeinflussen. ; In today's global economy, international borders are crossed by not only goods and capital, but increasingly by workers as well. This raises the question of the law governing these employment relationships. From the point of view of public international law there is a need to create international labour standards. However, since only certain areas are already covered by public international law, for example in the form of the ILO Standards and, in any case, these only bind States and not individual parties, national conflict of laws rules become essential for determining the applicable law. The following paper explores the basic structures of the German conflict of laws rules in the field of labour law. These rules are contained in the Introductory Act to the Civil Code (Einführungsgesetz zum Bürgerlichen Gesetzbuch). The paper focuses on the relationship between the freedom of choice principle and the many ways of limiting its scope. Through examining an employment contract which has connections with German, British and US law, the author shows how the different approaches taken by different national conflict of laws rules can influence the decisions as to the applicable substantive law.
Dieses Papier setzt sich mit den wesentlichen Prägungen der Globalisierung auf die Entwicklung des Internationalen Investitionsrechts auseinander; es fragt, inwiefern der grenzüberschreitende Investitionsschutz durch internationale Schiedsgerichte die Rolle des Staates bei der Bereitstellung des öffentlichen Gutes Rechtssicherheit verändert hat und verdichtet die Schlussfolgerungen in 4 Thesen. Erstens läßt sich die Verbreitung der bilateralen Investitionsschutzverträge als Ausdruck des umfassenderen Trends begreifen, Verträge als grundlegendes völkerrechtliches Gesetzgebungsinstrument' zu nutzen (treatification) und als einen weiteren Ausdruck der zunehmenden Verrechtlichung internationaler Beziehungen in der Globalisierung sehen. Indem moderne Investitionsschutzverträge Investoren materielle Rechte und komplementär formelle Durchsetzungsverfahren gewähren, tragen diese zweitens zu einer wesentlichen Veränderung im Völkerrecht bei: Dem Individuum bzw. der juristischen Person des Privatrechts werden durch völkerrechtlichen Vertrag unmittelbar Rechte zugewiesen und es wird damit zum partiellen Völkerrechtssubjekt aufgewertet. Drittens hat im Internationalen Investitionsrecht die Globalisierung die Rolle des Staates als Garanten für Rechtsstaatlichkeit und Rechtssicherheit verändert: Staaten setzen bei grenzüberschreitenden Investitionsstreitigkeiten Recht und Ordnung nicht mehr alleine durch, sie gewährleisten und garantieren jedoch die Herstellung des Rechtsfriedens durch die Vereinbarung von Investor-Staat-Schiedsverfahren. Viertens schließlich kann das moderne internationale Investitionsrecht in einem übergreifenden Sinn als eine Art Rückkehr - oder anders gewendet - als Aufbruch zu einem umfassenderen und breiteren Verständnis des Völkerrechts begriffen werden. ; This paper presents an analysis of the most significant effects of globalization on the development of international investment law; it asks how the protection of cross-border investment by international arbitral tribunals has transformed the states' role of providing the public good of legal certainty and summarizes the conclusions in four theses. First, the proliferation of bilateral investment treaties (BITs) is an expression of the wider trend of treaties being used as basic international "legislative" instruments and represents a further movement towards the juridification of key relationships in the global economy. Second, insofar as modern bilateral investment treaties assure investors material rights along with associated formal enforcement procedures, they contribute to a fundamental change in international law-the individual or legal person in private law is assigned individual rights through a treaty in international law and thus upgraded to the status of a partial subject of international law. Third, in international investment law globalization has caused the states to transform their role as the guarantors of legal certainty: States no longer establish law and order on their own, but rather provide for and guarantee the establishment of law and order through the provision of investor-state dispute settlement procedures. Fourth and last, in a more comprehensive sense, modern international investment law can be viewed as a sort of "return" to or else potential dawning of a much more inclusive and broader notion of public international law.

(Harvard), and took place at the Institute in Hamburg on 7 and 8 June 2013.New private international law (PIL) legislation enacted in the two Chinese jurisdictions – namely, mainland China and Taiwan – has adopted terminology and a structure that is oriented on continental European conceptions, often on German approaches. Moreover, the new legislation makes apparent the two jurisdictions' increasing integration into the global economy. This is particularly relevant for legal problems that arise in business activities and require PIL for their solution. The sale of goods and personal relationships find themselves woven together at an international level and issues that arise include: Which court has jurisdiction over a given dispute? Whose law is applicable? Die Arbeit befasst sich mit dem mandatum iuris gentium und der völkerrechtlichen Treuhand. Im ersten historischen Teil werden die rechts- und ideengeschichtlichen Wurzeln beider Institute nachvollzogen. Im zweiten Teil werden problematische Fälle des modernen Völkerrechts dargestellt, in denen das Mandats- bzw. Treuhandrecht in völkerrechtlichen Streitfragen besondere Relevanz hatte und z. T noch hat, z.B. Südwestafrika/Namibia, Israel/Palästina und Nauru. Im dritten und letzten Teil wird die Zukunft der völkerrechtlichen Treuhand untersucht, insbesondere in besonders aktuellen Fällen wie Kosovo, Afghanistan und Ost-Timor, die de facto mit der völkerrechtlichen Treuhand vergleichbar sind. In diesem Teil werden auch Vorschläge zu Wiederbelebung des UN-Treuhandsystems, auch im Umweltvölkerrecht, und ähnliche Vorschläge aus der Völkerrechtslehre diskutiert. Insgesamt wird festgestellt, dass der Treuhandgedanke seit seiner Entstehung im Völkerrecht nicht an Aktualität eingebüßt hat. ; This thesis deals with the concepts of mandate and trusteeship in international law. In the first historical part of the thesis the legal and historic roots of both concepts are reviewed. In the second part controversial cases of modern international law in which the concept of mandate respectively trusteeship was or still is of particular importance are discussed, for example South West Africa/Namibia, Israel/Palestine and Nauru. In the third and last part the possible future of trusteeship in international law is dealt with, in particular recent cases like Kosovo, Afghanistan and East Timor which are at least de facto comparable to the concept of trusteeship in international law. Also, proposals to revive the UN-Trusteeship System, even in environmental law, and similar proposals among experts are reviewed. The conclusion in general is that the concept of trust or trusteeship is still of importance in recent questions of international law, although its roots trace back a long time.

Seit 2003 hat sich das politische Bild des Irak stark verändert. Dadurch begann der Prozess der Neugestaltung der irakischen Rechtsordnung. Die irakische Verfassung von 2005 legt erstmalig in der Geschichte des Irak den Islam und die Demokratie als zwei nebeneinander zu beachtende Grundprinzipien bei der Gesetzgebung fest. Trotz dieser signifikanten Veränderung im irakischen Rechtssystem und erheblicher Entwicklungen im internationalen Privat- und Zivilverfahrensrecht (IPR/IZVR) im internationalen Vergleich gilt die hauptsächlich im irakischen Zivilgesetzbuch (ZGB) von 1951 enthaltene gesetzliche Regelung des IPR/IZVR im Irak weiterhin. Deshalb entstand diese Arbeit für eine Reformierung des irakischen IPR/IZVR. Die Arbeit gilt als erste umfassende wissenschaftliche Untersuchung, die sich mit dem jetzigen Inhalt und der zukünftigen Reformierung des irakischen internationalen Privatrecht- und Zivilverfahrensrechts (IPR/IZVR) beschäftigt. Die Verfasserin vermittelt einen Gesamtüberblick über das jetzt geltende irakische internationale Privat- und Zivilverfahrensrecht mit gelegentlicher punktueller und stichwortartiger Heranziehung des deutschen, islamischen, türkischen und tunesischen Rechts, zeigt dessen Schwachstellen auf und unterbreitet entsprechende Reformvorschläge. Wegen der besonderen Bedeutung des internationalen Vertragsrechts für die Wirtschaft im Irak und auch zum Teil für Deutschland gibt die Verfasserin einen genaueren Überblick über das irakische internationale Vertragsrecht und bekräftigt gleichzeitig dessen Reformbedürftigkeit. Die Darstellung der wichtigen Entwicklungen im deutsch-europäischen, im traditionellen islamischen Recht und im türkischen und tunesischen internationalen Privat- und Zivilverfahrensrecht im zweiten Kapitel dienen als Grundlage, auf die bei der Reformierung des irakischen IPR/ IZVR zurück gegriffen werden kann. Da die Kenntnisse des islamischen Rechts nicht zwingend zum Rechtsstudium gehören, wird das islamische Recht dazu in Bezug auf seine Entstehung und die Rechtsquellen dargestellt. Am Ende der Arbeit wird ein Entwurf eines föderalen Gesetzes zum internationalen Privatrecht im Irak katalogisiert, der sich im Rahmen der irakischen Verfassung gleichzeitig mit dem Islam und der Demokratie vereinbaren lässt. ; The political framework of Iraq has remarkably transformed since 2003. Hence began the process of reshaping the Iraqi legal system. For the first time in the history of Iraq, the Iraqi Constitution of 2005 determines Islam and democracy as two essential principles to be followed in legislation side by side. Despite this substantial development within the Iraqi legal system and current considerable development of international private and civil procedural law in international comparison, the legal regulation of the Iraqi international private and civil procedural law, which contained mainly in the Iraqi Civil Code of 1951 still applies. This thesis wants to sketch a possible reform of the Iraqi international private and civil procedural law. This work is considered the first comprehensive scientific work dealing with the current content and the future reform of Iraqi international private and civil procedural law The author gives a general overview of the current Iraqi international private and civil procedural law, indicates its weak points and makes appropriate reform proposals. The German, Islamic, Turkish and Tunisian international private and civil procedural law are used occasionally and in keywords in this passage. Due to the special significance of international contract law for the economy in Iraq and partly for the German economy as well, the author gives a more detailed overview of the Iraqi international contract law and at the same time reaffirms its need for reform. The outline of the main aspects of German-European law, of traditional Islamic law and of Turkish and Tunisian international private Law and civil procedure law in the second chapter serves as a basis that can be used to reform the Iraqi international private Law and civil procedure law. Because the knowledge of Islamic law is not necessarily part of the law studies, Islamic law is presented additionally in relation to its origin and the sources of law. At the end of the work, a draft of a federal law on private international law in Iraq is catalogued, which is compatible with Islam and democracy within the framework of the Iraqi constitution.
Ziel dieser Untersuchung der Schulreformen und ihrer Umsetzung ist die Erkundung des Zusammenspiels zwischen der länderübergreifenden Ideologie des New Public Management und den lokalen politischen Systemen und professionellen Kulturen. England und die Schweiz erlauben einen besonders interessanten Vergleich, weil sich ihre politischen Systeme stark unterscheiden – zentralisiert und im Majorzsystem in England, dezentralisiert und auf parteienübergreifenden Konsens bauend in der Schweiz (Pollitt & Bouckaert, 2000). Dieser Artikel geht der Frage nach, wie sich die Zusammenarbeit unter den Lehrpersonen und die Rolle der Schulleitung verändern. Die Ergebnisse aus vier Fallstudien weisen darauf hin, dass das politische System die Ausprägung der Schulreform nicht nur auf der Ebene des Bildungssystem beeinflusst, sondern auch auf der Ebene der einzelnen Schule, besonders in den schulischen Entscheidungsprozessen und im Machtgefüge zwischen Schulleitung, lokalen Schulbehörden und Lehrpersonen. (DIPF/Orig.) ; The analysis of new managerial policy change in two different countries enables the exploration of the interplay between an ideology dominant across many countries and the local political system and professional culture. England and Switzerland provide an interesting comparison because of the differences of their political system - majoritarian and centralised in England, consensual and decentralised in Switzerland (Pollitt & Bouckaert, 2000). In this article changes in teachers' teamwork and in the headteacher's role are examined. Based on a research project involving four case studies, it is argued that the political system influences the enactment of new managerial reform not only at the level of the education system but also at the level of the local school, in particular in relation to the decision making processes and the power relations between management, school governing body and teachers. An der Sprache des Rechts wird Kritik geübt, seit die Aufklärung die Verständlichkeit der Gesetze zu ihrem Anliegen gemacht hat. Mit den großen Kodifikationen des Rechts im ausgehenden 19. Jahrhundert hat die Kritik am angeblich schlechten, unverständlichen Juristendeutsch eine besondere demokratietheoretische Legitimation bekommen. Diese Sprachkritik sucht seit den siebziger Jahren vermehrt bei der Linguistik Rat, wie denn eine bessere Allgemeinverständlichkeit von Rechtstexten verwirklicht werden könnte. Der Band versammelt systematisch aufeinander bezogene Beiträge ausgewiesener Linguisten, Juristen und Schriftsteller zur Problematik des Verständnisses juristischer Sprache, zur Methodik empirischer Verständlichkeitsmessung und zu den Möglichkeiten transdisziplinärer Kooperation zwischen Rechts- und Sprachwissenschaftlern.
Mónica García-Salmones Rovira hat ihr – mittlerweile preisgekröntes – Buch als "The Project of Positivism in International Law" betitelt. Das klingt etwas schmissig und zugleich verlockend rätselhaft. Wessen Projekt war es, wann gab es das und was ist davon zu halten? Die Verfasserin setzt keinen Untertitel dazu, der dem Leser einen erläuternden Hinweis geben könnte. Die eigentliche Überraschung ist, dass sich nach Lektüre der rund 400 Seiten beide Eindrücke sogar verstärkt haben: Das Buch-Ende wartet im Anschluss an die völkerrechtshistorische Darstellung mit einer persönlichen Positionierung der Autorin gegenüber ihrem Gegenstand auf, die eine akzentuiert kritische Haltung offenlegt und den Leser nochmals zum Nachdenken bringt. .

Der Einfluss Internationaler Organisationen reicht angesichts der Herausforderung, für globale Probleme Lösungen zu finden, mittlerweile so weit, dass sich die Frage nach den in ihnen vorhandenen Machtbegrenzungsmechanismen stellt. Doch wie kann die Macht Internationaler Organisationen kontrolliert werden, wenn das aus dem nationalen Verfassungsrecht bekannte Gewaltenteilungsprinzip nicht auf die internationale Ebene übertragen werden kann? Die Arbeit analysiert die dazu innerhalb der Vereinten Nationen (UNO) und der Welthandelsorganisation (WTO) existierenden formalisierten Mechanismen anhand ihrer Gründungsverträge. Dabei werden drei Kategorien von Machtbegrenzungsmechanismen identifiziert: Kompetenzzuweisungen und -abgrenzungen, organinterne Mechanismen und schließlich Interaktion zwischen den Organen. Die in der Praxis bedeutsamsten Mechanismen stellen zum einen das Vetorecht im UN-Sicherheitsrat sowie der negative Konsens im Streitbeilegungsgremium der WTO dar, die zur Gruppe der organinternen Mechanismen gehören. Zum anderen besteht in der Kontrolle der Streitbeilegungs-Panel der WTO durch den Appellate Body eine wichtige Machtbegrenzung durch Interaktion. Die Untersuchung dokumentiert das paradoxe Phänomen, dass die Mechanismen zur Begrenzung der Macht in vielen Fällen auch eine machtsteigernde Wirkung haben, indem sie die Effizienz, Akzeptanz und Legitimation der Organisation erhöhen. Die Verfasserin erklärt dies damit, dass das Augenmerk der Gründungsstaaten in der Entstehungsphase auf dem Funktionieren der Organisation als Gegengewicht zu ihren jeweiligen Mitgliedsstaaten lag. Dass Internationale Organisationen in der Zwischenzeit so stark an Einfluss gewonnen haben, dass ihre Macht nunmehr begrenzt werden sollte, ist eine neue Entwicklung, die jedoch in Zukunft deutlich an Bedeutung gewinnen wird. ; In light of the challenge to find answers to global problems, the influence of international organizations nowadays goes so far that the question of existing checks and balances within these organizations arises. But how can power be controlled when the principle of separation of powers originating from national constitutional law cannot be transferred to the international stage? The purpose of this thesis is to analyze existing formalized internal mechanisms within the United Nations and the World Trade Organization on the basis of their founding treaties. The author identifies three categories of checks and balances: allowing and limiting competencies, mechanisms within the organs and finally interactions between the organs. In practice, the most important mechanisms of these organizations are on the one hand the power of veto within the UN Security Council and the negative consensus within the WTO dispute settlement body, which belong to the category of mechanisms within the organs. In addition, the control of the WTO dispute settlement panels by the Appellate Body is an important form of checks and balances through interaction. The analysis shows the paradoxical phenomenon, that checks and balances in many cases have the effect of increasing power by augmenting the efficiency, acceptance and legitimacy of the organization. The author explains this by reference to the intentions of the founding states during the developing phase to strengthen these organizations as a counterbalance to their respective member states. It is a new development that international organizations have now increased their influence so much that their power should be limited, but this will become significantly more important in the future.
