Influence of the Coronavirus Pandemic on the Development of Higher Education: Expert Opinion

The article examines the opinion of international experts on the impact of the COVID-19 pandemic on the transformation of the higher education sector. Analyzed the data presented in publications that were posted on the international news resource University World News from 1st of March to 15th of October 2020 in the "coronavirus crises" section. It is noted that the most discussed topic is the strategy for the future development of higher education (26% of the analyzed texts were devoted to strategic issues). Attention is focused on the fact that the pandemic revealed that the concept of direct learning is not adapted to crisis situations like the COVID-19 pandemic (despite its undoubted advantages) when teachers and students do not have the opportunity to communicate directly in the classroom. It is emphasized that, despite the variability of experts' opinions on the future for the development of higher education in a global context there are significantly fewer negative assessments than could be expected: 33% of experts positively assess the changes in higher education initiated by the pandemic, suggest considering the pandemic crisis as a catalyst that accelerates solving existing problems, in particular the need to form a new vision of the strategic development of the education sector taking into account the future advantages of distance and online forms of education. The topic of financing turned out to be the most painful. Most experts negatively assess the prospects associated with a significant decrease in public funding without which it is difficult for universities to survive not only in the crisis conditions of the pandemic but also in the post-covid future. Insufficient funding has led to the reduction amount of teachers which will subsequently harm the entire system of higher education because it is the teachers who must fill the courses built in the format of augmented learning with content, develop an appropriate pedagogical design and accompany students in the educational process.
PUBLIC ATTITUDES TOWARD EDUCATIONAL REFORMS: A STUDY OF THE PROBLEM OF OPEN-MINDEDNESS

The article reviews the problem of contradictory public attitude to educational reforms in connection with the phenomenon of open- mindedness. Based on the review of case studies, two major areas of conceptualization of openness of judgments have been identified. The first direction studies the openness of judgments in the context of interpersonal interaction, as a lack of prejudice against members of groups that are interpreted as "others", willingness to tolerate "otherness" and productively interact with other people in conflict of opinions and positions. In the second direction, openness of judgment is seen primarily as a cognitive attitude to the perception of new ideas, tolerance of diversity of opinion and willingness to think outside the box ("out of box"). A sample of 230 respondents allowed to examine the relationship between cognitive (dogmatism) and personal (openness to new experiences) aspects of openness of judgment with a subjective attitude to educational reforms. Dogmatism is related to the tough judgments about educational reforms. More dogmatic respondents tend to have negative evaluations of reforms, less dogmatic ones are more likely to have no established evaluative judgments. Openness to new experiences determines the modality of assessments of educational reforms: more "open" respondents tend to be more positive about the changes that occur as a result of reforms than less "open" ones, which are characterized by a certain pessimism. It has been found that dogmatism and openness to new experiences manifest themselves in different ways in relation to educational reforms among professionals engaged in the field of education and non-professionally related to the education of respondents.
Socially Responsible Business as a Requirement of Time: Individual and Organizational Dimension

The article explores the logic of the emergence and differentiation of the paradigm of socially responsible business. Both individual and organizational measurements of the problem are highlighted. The explicit and latent factors of influence on the problem situation on a global scale and possible options for its solution, taking into account the experience of developed countries, are considered. It is noted that an effective solution of social and environmental issues involves the application of joint efforts of representatives of the state, business, civil society, scientific community, leaders of public opinion, etc. The expediency of typology of socially responsible business is substantiated, in particular, the American, European and Asian models are highlighted. At the same time, it is noted that there is also the possibility of singling out other universal system-forming criteria for typologization of socially responsible business, namely external and internal. The relevance and heuristic potential of these approaches for the sustainable development of modern Ukrainian society is indicated. Taking into account socially differentiating factors, the generational dimension of this problem is briefly covered i.e., the perception of socially responsible business through the prism of mass consciousness, especially youth. It is noted that in a global society, such practices are especially favored by millennials, perhaps due to their somewhat romantic worldview and developed social marketing, which is quite common in countries with a high human development index. At the same time, the paradigm under study emphasizes successful practices in the application of event marketing as certain derivatives for the implementation of social marketing. Particular attention is paid to social, scientific, legislative practices on research and implementation in the daily life of environmental marketing, the content and characteristic derivatives of which in the developed world have become a "visit card" of modern socially responsible business. The situation regarding socially responsible business in Ukraine is analyzed. It is noted that both external and internal businesses of this kind are of the utmost importance in Ukrainian society. Such initiatives allow, on the one hand, partially solving the most pressing social, environmental, economic problems of national and global scale, to focus on them the attention of the public opinion, and on the other – to effectively capitalize a commercial brand, but only if its representatives will sincerely and systematically use the basic principles and values of socially responsible business.
POSITION OF THE UKRAINIAN-CANADIAN SCIENTIST JAROSLAV RUDNYTSKYJ IN THE SETTELMENT OF THE LANGUAGE CONFLICT OF IMMIGRANTS

The article analyzes one of the problems of personal relations belonging to the ethnic minority of the immigration community and the English- and French-speaking majority of the elite nation of the country of new immigrants, highlights the problem of preserving the national identity of Ukrainians in the Canadian diaspora through persistent, consistent and tolerant steps. Ukrainian linguist, folklorist, Slavist, librarian, organizer of science, teacher, public figure, Professor J. Rudnytsky in opposition to the linguistic assimilation of his own people; the principledness of the scientist in resolving the linguistic conflict, which gave a positive solution for both parties - Canada and the Ukrainian diaspora. The importance of the civic position and significant potential opportunities to influence the official circles of the country, government commissions, committees, international organizations and public opinion of authoritative intellectual work in society and academia, which, using historically sound evidence, proves the objectivity of his point of view. in this way he protects the national dignity of his people, their ancient and rich culture and defends his moral principles and beliefs. A bibliographic review of J. Rudnytsky's scientific work was carried out, where on the basis of historically balanced facts, historical-political, linguistic analysis he investigated the essence of language assimilation, which is equal to the destruction of national identity. It is shown that lexicographical works, conclusions from them gave the scientist a basis to win the struggle for the Constitutional recognition of the Ukrainian language in Canada, which supported the policy of official languages and multiculturalism in the country. It is emphasized that scientific conclusions gave the scientist the opportunity to summarize and summarize the research and became the basis for the introduction into public circulation of a capacious definition - linguocide (language murder), which is now widely used in scientific works.
Changes in the Ukrainian Educational Field in the Conditions of Social Uncertainty

The article is devoted to the consideration of changes and tendencies in the Ukrainian educational field. The focus is on secondary education, in particular, the growing trend of private secondary education. It is noted that in 2020-2021 academic year the number of students in private schools increased by 174,5% compared to 2014-2015 academic year, teachers – by 89,6%. The situation in the field of private distance education is analyzed. The role of private schools is emphasized, which today play the role of pioneers in expanding opportunities for the entire educational field. It is noted that the growth of options in the range of educational opportunities is a positive trend. Data on the dynamics in the sector of pedagogical education are given. It has been suggested that the demand for certified teachers will increase, however, there will be a shortage of young teachers in public schools. The statistics of admission to higher education institutions are analyzed, which show that pedagogical specialties are not always the choice of the best school graduates. Growth in the field of online education is considered – from individual educational projects such as Youtube channels to government initiatives (All-Ukrainian online school). It is emphasized that the authors of private educational Youtube channels are an example of agents of change, whose perseverance not only increases adolescents' interest in science, but also inspires others to create educational projects, which creates a favorable environment for the development of educational innovations. The course of an important educational reform – «New Ukrainian School», in particular its content and actual implementation is analyzed. Examples of successful reform and difficulties of its implementation in primary school are given; considered threats to further reform due to a change in political leadership; public opinion on secondary education reform is analyzed. It is concluded that the political perturbations and quarantine restrictions caused by the pandemic, in the conditions of unstable institutionality, lead to the fact that in Ukraine both progressive innovations and inhibition of changes are possible.
The Essence and Features of Democracy in the Interpretation of A. de Tocqueille

The article analyzes the backbone markers of democracy identified by A. Tocqueville against the background of a comparison of aristocratic systems and effective democracy. The essential signs of democratic transformations are presented: a gradual but noticeable increase in the material well-being of an average citizen; effective central government with effective local self-government and significant influence on their decisions of universal human values; public opinion as one of the full-fledged branches of power; a quantitatively limited apparatus of officials/civil servants, as accessible as possible for communication with the population; lack of connection between an ascending political career and personal enrichment; subordination of citizens not to an official, but to the current legislation; education of patriotism by involving as many citizens as possible in the government of the country; mass will expressing with the help of political rights and freedoms. It is noted that such signs, according to A. Tocqueville, include the absence of political censorship, the presence of freedom of speech; the unimportance of the political struggle against the background of solving, first of all, the problems of the country's material life support; public activity; enlightenment of the people; respect for production work; intensive communication within the country with the help of a developed social infrastructure; constant formation of new goals of social development, as well as a permanent desire for their implementation; psychological youth of the average person; optimistic outlook on the future; dynamism of professional opinion regarding the solution of social problems; the rule of law, the equality of all citizens before the law; opportunities for citizens, thanks to the results of their own work, to compete for social success on an equal footing. It is emphasized that the "enemies" of democracy, according to A. Tocqueville, are unlimited, uncontrolled power; desire for its usurpation; use of excessive force; despotism, which is especially harmful to the production of material wealth; political absenteeism; social apathy; inaction; destructive traditionalism; the authority of the individual, associated only with hereditary status and wealth. The attention is focused on one of the paradoxes of A. Tocqueville, in which he saw the advantage of the democratic process. According to the philosopher, among the ruled there are many outstanding people who, as a result of the processes of electoral democracy, for some reason did not find themselves in the circle of the elite. It is emphasized that A. Tocqueville explained this by a wide range of available opportunities for personal self-realization outside of a political career. At the same time, the coming to power of an average person, according to the thinker, contributes to the growth of mass education, social activity, social responsibility, and rational thinking on a societal scale. All this forms a huge public energy for positive socio-political and economic changes. Particular attention is paid to the mutual influence of political freedom and economic prosperity, recorded by A. Tocqueville.
Socio-demographic factors of Ukrainians' attitude to the judiciary

The article analyzes the socio-demographic determinants of Ukrainian citizens' attitude to the judiciary identified on the basis of a nationwide survey. The sociological specifics of the analysis provided for the verification of the influence of those factors that reflect the consequences of social stratification in a particular society — its socio-economic, political and socio-cultural dimensions. In different countries of the world, the influence of socio-demographic factors on the attitude to the judiciary has been uneven and unequal. In many European countries, the experience of cooperating with the courts leads to a negative attitude towards justice. The attitude to the judiciary is considered through four indicators: 1) trust in the courts; 2) assessment of the chances of winning court case, regardless of the wealth of the citizen; 3) assessment of an independence of judges; 4) assessment of an integrity of judges. Despite social optimism observed in Ukrainian society after the 2019 presidential and parliamentary elections, the study found a low level of trust and negative assessments of Ukrainian justice. Using the method of multiple linear regression, it was found that public opinion about justice is formed regardless of gender, level of education and region of residence. It was found that Ukrainians' attitude to the judiciary is largely determined by age, settlement type, language of communication at home and experience of participation in the trial. Confidence and positive assessments assessments of the judiciary are mainly manifested as the age and size of the settlement decrease, as well as among Russian speakers and those who have experience of participating in the trial. The influence of the respondents' financial situation on their assessment of the independence of judges was unexpectedly dependent: as the financial situation of the family decreased, the tendency to consider judges independent increased.
Sociology in Ukraine: institutional status and research agenda

The article provides a comparative review of the history, current status and areas of scientific activity of the Sociological Association of Ukraine (SAU), its creative ties with the European and world sociological community, in particular, joint research with Polish scientists. It emphasizes that most of the Ukrainian sociologists SAU members work in universities, the Institute of Sociology of the National Academy of Sciences of Ukraine, and public opinion research centers. Numerous sociological (theoretical and empirical) studies on various issues of vital activity of modern Ukrainian society are carried out by their efforts. It is noted that in addition to studying the issues of social transformation in its political, economic, legal, social and cultural aspects, that have become traditional for Ukrainian sociology, in recent years Ukrainian sociologists have turned to the analysis of such problems as external and internal migration (the problem of internally displaced persons); military conflict in the east of Ukraine and the volunteer movement; social inequality, including in its new manifestations, including those caused by the digitalization of public life. It is emphasized that today the most pressing issue of sociological reflection is the changes that occur in Ukraine after the last presidential election. Attention is focused on the fact that the victory of the political rookie in these elections was due to the huge social disappointments of the Ukrainians, since their expectations provoked by the Revolution of Dignity were not fulfilled. The first and most important disappointment, according to sociological studies, is the fact that peace has not reigned in the country. Second, the living standards of Ukrainian citizens have not improved. Third, the fight against corruption did not bring significant results. Fourth, social inequality deepened: the rich became richer, and the poor became poorer. The fifth disappointment is the inefficiency of the declared reforms: judicial, medical, educational, customs, electoral, etc. It is emphasized that the effectiveness of the new government depends, among other things, on its consideration of such features of the mass consciousness of the Ukrainian population as a critical level of distrust of all institutions of power; value and ideological ambivalence and uncertainty. The conclusions are formulated about the unlikeliness of return of Ukraine to the orbit of Russian political and economic influence, as well as the victory of radical nationalist ideology in our country.
FEATURES OF ADDICTIVE PERSONALITY

We surveyed 50 people between the ages of 18 and 25, most of respondents are college students. We used the following assessment tools: SMOL (abbreviated adaptation of MMPI), Heim's test for coping strategies, Mendelevich's methodic, Michigan Alcohol Test (MAST), Urgent Dependence Questionnaire in Shibko's adaptation. Respondents show some signs of predisposition, or even a clear presence of addictive behavior. Choosing a way to escape from reality was a cultural phenomenon, that is, the choice of an addictive agent is more dictated by advertising, public opinion, and art products. This data confirms the close direct relationship between alcohol dependence (according to MAST) and psychopathy — a correlation coefficient of 0.27. According to the regression analysis, the data of this scale strongly depend on the indicators of the hysteria scale (P-value = 0.01). This indicates that expressing alcohol and the consequences of such abuse can make a person protesting, uncomfortable, and seeking to exaggerate their problems and attract attention. The results of the study confirmed the literature data about self-centered, depressive, and anxious fetures of addictive personality. We can assume that the higher the emotional lability, anxiety and depressive personality, the greater the likelihood of addiction to computer games. It is worth noting that this dependency is different from the other vivid virtual world, which gives the person the opportunity to hide in him from the troubles. For people with adaptation disorders and computer addiction, clinical manifestations of anxiety and depression, severe depressive and anxiety episodes are common; high levels of situational and personal anxiety, excessive nervous and mental stress. That is, we can conclude that both computer addiction and gaming addiction are strongly linked to anxiety and depression. We assume that these dependencies are very closely related and that it is difficult to draw a clear boundary. In addition to health problems, psychoactive substance use, and addiction to procedural addiction, it causes significant social and economic damage to individuals and society as a whole.
UKRAINIAN SCIENTIST PAVLO CHUBYNS'KYY IS A REPRESENTATIVE OF THE NATIONAL ELITE

On the example of the way of life and scientific work of P. Chubyns'kyy, the article raises the question of the role of the national-intellectual elite and its influence on the social and political life. The importance of the scientific heritage of the outstanding Ukrainian scientist, folklorist, ethnographer, poet and public figure Pavlo Chubyns'kyy is highlighted. It is emphasized that Pavlo Chubyns'kyy's scientific achievements became a model for many researchers in studying the national culture of Ukrainians and laid the foundation for Ukrainian studies. P. Chubyns'kyy was the bearer of national-cultural ideas and values of Ukrainians. It is noted that Chubyns'kyy is the author of the Ukrainian source fund of ethnography, folklore studies and jurisprudence. The scientist wrote a poem, which later became the National Anthem of Ukraine. It is concluded that the scientific value of his legacy is that for the first time, on the basis of complete and comprehensive studies, Pavlo Chubyns'kyy made a comprehensive analysis of the Ukrainian people in all its manifestations - social, family, spiritual, cultural and linguistic contexts. P. Chubyns'kyy scientifically substantiated the integrity of Ukraine and the identity of the Ukrainian people. Pavlo Platonovych showed by his work the originality and richness of cultural heritage of Ukrainians, the uniqueness and beauty of the folk word. The scientific publication of Chubyns'kyy's "Proceedings of the Ethnographic-Statistical Expedition in the West-Russian Region" is the result of many years of titanic work. His public speeches, printed articles, substantiated scientific positions are capable of effectively influencing public opinion. After all, Chubyns'kyy belonged to the national-intellectual Ukrainian elite, who comprehended the greatness of folk culture and the uniqueness of the national life of Ukrainians. А real patriot could work so persistently and selflessly, a man of high culture and a civic position, enthralled with his idea. No wonder that his publications and publications became a model in scientific researches of the XIX century and are a huge contribution to the study of Ukrainian national culture. The scientist-Ukrainian connoisseur was aware of the value of what he was doing, and therefore his words were prophetic: "I will not waste my strength / And I will see my harvest." These words prove that he, with his life, professionalism, life position, sacrificed and persistently worked for the self-affirmation of Ukrainians as a self-sufficient nation with its unique culture and language. The great figure of Pavlo Chubyns'kyy, his life path, organizational skills, patriotism, scientific work is an example of the majestic figure of his time and a worthy representative of the Ukrainian national elite.
EUROPEAN STANDARDS FOR THE RIGHT TO FREEDOM OF MOVEMENT AND RIGHT TO FREE CHOICE OF RESIDENCE

The article examines the system of standards for the right to freedom of movement and the right to free choice of residence that exist in the European Union. A wide range of general and special legal methods and techniques of scientific knowledge are used, in particular: comparative law, systemstructural and formal- dogmatic research methods, as well as the methods of scientific knowledge (analysis and synthesis, induction and deduction, classification, etc). As a result of the study, the author substantiates the scientific position that the existing system of standards for the right to freedom of movement and the right to free choice of residence in Ukraine only partially meets the standards of these rights that exist in EU member states. The difference between these standards exists on the level of specifics of legal regulation for the implementation of these human rights by family members of citizens of EU member states, as well as the goals pursued by the implementation of relevant standards. Bringing Ukrainian standards of these human rights in line with European counterparts involves rule-making activities of public administration. The source of such rule-making should be Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC (2004). The effectiveness of bringing Ukrainian standards for the right to freedom of movement and the right to free choice of residence in line with EU standard will be increased significantly if the public administration has standards for legal regulation of relations between it and individuals in the process of exercising these rights by the latter. In our opinion, the Allgemeine Verwaltungsvorschrift zum Freizügigkeitsgesetz / EU (AVV zum FreizügG / EU) (General Administrative Code of the Law on Freedom of Movement of Citizens) can be considered as such a standard, as it is created in strict accordance with the EU Directive and other EU legal acts
Intellectual property: theorizing and empirical analysis

The authors of the article based on the understanding of intellectual property as an immanent component of the innovative economy, an important factor, resource and mechanism of innovation environment and development, note the actualization of this phenomenon in nowadays society of revolutionary technological changes. The article deals with the brief overview of the some features and characteristics of the process of reforming the institute of intellectual property in Ukraine, including regulatory framework, and also is based on the analysis of data gathered in sociological survey «Intellectual property through the eyes of university lecturers and high school teachers», conducted during May-December 2019, method – interview; n = 356. Based on the research results, the authors analyze high school teachers' and university lecturers' attitudes to the intellectual property, the factors and mechanisms of protection of intellectual property rights. What are the attitudes towards violation of intellectual property rights in the field of education? How acute is the problem of intellectual property rights (IPR) violation for the participants in the educational process? Is the impact of intellectual property rights violation noticeable on their (high school teachers and university lecturers) day-to-day activities? Who, what institution (organization) should make efforts to protect IPR? These and some other issues are analyzed in the paper. The authors note, among other, that, in general, the problem of IPR violations perceived as quite acute for many (relative majority) of university lecturers and high school teachers, the impact of this problem on respondents' daily activities is mostly negative. Opinions of respondents on the institution(s), which should make efforts to protect IPR were clarified. Analysis of possible ways (inner and external factors, mechanisms) to enhance the level of protection, public management of the protection process, as well as the development of a culture of IPR is presented also. The authors propose the prospects for further research of the problem.
RESEARCHES OF IVAN OHIJENKO IN UKRAINIAN STUDIES FROM THE POINT OF VIEW OF HIS SCIENTIFIC POSITION IN EMIGRATION

The article raises the issue of the importance of Ukrainian studies by Ivan Ogienko, as a representative of the Ukrainian intellectual elite in emigration, because his works influenced the progress of cultural, educational and spiritual life of Ukrainians both in our country and abroad. It is known that he is one of the founders of Ukrainian science and education and an outstanding Ukrainian educator of the twentieth century.
The role of preserving national identity, spiritual values, patriotism of the outstanding scientist, teacher, linguist, culturologist, public and church figure, Ivan Ogienko, through the prism of hard work, incredible diligence, stability and consistency in scientific research is emphasized. Attention is focused on the fact that the Ukrainian scientist was the bearer of national and cultural ideas and spiritual values of his people. The opinion is confirmed that the world recognition of I. Ogienko / Metropolitan Ilarion was brought by fundamental works on the history of Ukrainian culture, language, history of the church, which have not lost their scientific significance even today. The scientist-researcher made dictionaries, headed the Ministry of Education of the Ukrainian People's Republic, and being in emigration – headed the Ukrainian autocephalous Orthodox Church. It is worth mentioning the most common and used translation of the Bible into Ukrainian, on which Ivan Ogienko worked for more than 45 years.
The article analyzes I. Ogienko's scientific achievements during the emigration, which significantly strengthened Ukrainian studies, and also considers the works "Pre-Christian Beliefs of the Ukrainian People", "Ukrainian Culture", "Serve the People - Serve God: Theological Studio" and others. The book "Our Life Abroad: Ideological and Historical Essays" by Ivan Ogienko, published in Winnipeg (Canada), where the author spoke about the difficult life of Ukrainian emigrants abroad, deserves attention and listening. I. Ogienko describes how important it is to preserve one's national identity, culture and native language in a foreign country.
It is concluded that national culture has great potential for the establishment of Ukraine in the world cultural space, and the life and scientific and educational work of Ivan Ogienko became an example for many researchers in studying the socio-cultural heritage of the Ukrainian diaspora.
LEGAL DOCTRINE AS A SOURCE OF LAW FOR CONSTITUTIONAL LAW

Any branch of law, private or public, has a system of sources of law, which is somewhat standard. This system became "set in stone" for many law systems around the world, starting with Constituion, legal acts of goverment and ending with brief overview of legal traditions in some branches of law. However, this system completely forgets about legal doctrine. But after legislation took over, legal doctrine lost meaning which it had before and was cast aside into shadow of legislation and basic system of sources of law. Furthermore, legal doctrine was an instrument which provided unity for any law system. The idea in its core is simple – greatest and most known legal works of different authors became rulebooks for diffenret branches of law, which were used not only for education, but as a source of law to resolve dispute, when there was missing link in legislation and when judge cannot settle dispute using law of state. This is the case, when doctrine was used as a source of law and a source for regulation. Same can be said about legal doctrine, as core for any law, passed by a parliament. In ideal case, scientists and authors of legal dontrine works should consult lawmakers regarding theoretical and doctrinal basis of any decision or action they are planning to take. So, any legal action will have strong core in it and won't be decided only on experience and opinions of lawmakers, but also with strong theoretical background for such decision. In conclusion, we think that legal doctrine requires further analysis and this topic is very important for legal studies in Ukraine. Core of legal doctrinal works becomes bigger and bigger with increasing number of scholars in this sector of science. From the nature of legal doctrine, it is clear that it can provide better understanding of law and improve connection between scientists and lawmakers.
