The community-based public oral health program in public health centers was launched in 1993 to promote oral health of the community. This program is considered to be more important after local autonomous government and the passage of national health promotion law. The aims of this study were to evaluate this program and propose adequate guidelines for future public oral health program in public health center. For this study, the mail questionnaire survey was carried out from the 18 public health center. The sample is consist of the 23 dentists and 57 hygienests who work in oral health center of public health center now. Facilities, equipments, manpower and finance of public oral health center, task recognition of dentists and hygienests were investigated. Multiple regression analysis were performed to identify the factors which influence on the outcome of the program. Dependent variable is outcome of program and the independent variables are population size, financing, equipments, motivation of dentist., an extent of work. And also chi-square test were performed to compare the task recognition between dentists and hygienests. The major findings are summarized as follows. 1. Average space of oral health centers are 26.4 �렊 and only 33.3% of the centers have space in the facilities for tooth brushing and mouth rinsing and 45% have no dental unit chair. Oral examination instruments and education equipments are very poor. 2. Program population size (p<0.01), motivation of dentists (p<0.01), finance (p<0.05), an extent of work(P<0.05) and equipment (p<0.05) variables showed statistical significance at the multiple regression analysis, so these variables have an influence on the outcome of the program. 3. The dentists recognized that the priorities of mojor task have to be given to oral examination (57.9%), organizing the health promotion event (57.9% and planning and evaluation of program (57.9%), but hygienests recognized this task are performed in cooperation with the dentists. Recognition of planning and evaluation of program (p<0.01), budget planning (p<0.05), organizing of oral health promotion event (p<0.01) and propagation of program (p<0.05) variables showed statistically significant difference between dentists and hygienests. From the above results, adequate facility, space, basic instruments and education equipments, motivation of dentist, an extent of work and financial supporting are the essential factors to implement the successful public oral health center program. And also required are the job analysis of hyginests and dentists for the reallocation of tasks. ; open

Between 1995 and 2011, Peruvian GDP grew by 4.9% each year, driven by exports and private investment's increase. However, it only grew by 3.3% in 2015 and by 4% in 2016 due to a reduction in the international price of metals that the country exports. In this scenario, the government elected in 2011 faced the challenge of replacing private investment with public investment as a growth engine. However, this decision revealed two structural problems of the Peruvian economy: 1) the limited spending capacity of central and regional governments; and 2) the difficulty of increasing tax collection due to a very significant informal sector in the country. However, trade liberalization, stability in domestic prices and reforms in public management are strengths of the Peruvian economy, which would enable it to return in the next few years to growth rates of around 4% or more.

본 논문은 대외정책 분야에서 드러나는 미국 대통령제의 운용원칙인 권력분립을 미국식 민주주의의 사각지대로 접근하는 시각을 제시하여 선행연구와 차별성을 추구한다. 구체적으로 헌법이 천명하는 권력분립 원칙에도 불구하고 오히려 그 권력분립의 기제인 상호간 독자적 선거제에 의해 미국의 유권자 전체가 선출한 대통령은 각 지역구에서 선출된 입법부 구성원이 내세우는 집합적 통치 위임과 확연하게 구별되는 유일한 공공리더십(public leadership)을 정책결정과정에서 독점할 수 있다는 점을 주시하고자 한다. 결국 미국 대통령제의 과제는 미국식 민주주의의 주요 통치원칙인 권력분립을 중시하는 동시에 성공적 통치를 위해 권한공유의 묘(妙)를 찾는 부단한 노력을 경주해야만 가능하다는데 있다. 특히 국내정책 분야보다 대외정책 분야에서 이 난제의 해법을 모색하는데 있어서 법제도적 및 정치적 장애물이 가로막혀 있다. 게다가 선거결과와 무관하게 통치 위임을 생성하는 정치의 사법화가 입헌 대통령제의 근간을 흔들 수 있는 위험성을 목격했다. 이에 본 논문은 대외정책 분야의 미국 대통령제에 대한 평가를 권력분립의 양면성, 즉 권력분립은 권력공유를 전제로 한다는 패러독스에 중점을 두고 대통령의 우위에 대한 주장을 가능하게 하는 헌법적 및 정치적 근거를 대조하면서 미국식 민주주의의 사각지대를 재조명하고자 한다. ; In this paper, I argue that the principle of separation of power in foreign policy under presidentialism invites a blind spot in American democracy. Although the Constitution specifies separation of power both in the conduct of domestic and foreign affairs, independent elections of President and legislators differentiate the kind of collective mandates on Capitol Hill from the unitary mandate bestowed upon President, thus prompting him to proclaim public leadership. The key to a successful governing, then, lies in the art of pursuing "separated institutions sharing powers" persistently. However, the realm of foreign affairs poses a more challenging task, both constitutionally and politically, than its counterpart in domestic policy. Furthermore, we came to witness a modern presidency whose relentless claim on mandate, or what is dubbed as judicialization of politics, was found irrelevant to the electoral outcome itself, thus creating a peril in constitutional presidency. 학위논문(석사)--서울대학교 대학원 :보건대학원 보건학과(보건정책관리학전공),2019. 8. 유승현. ; 본 연구는 건강증진사업에서 보행활동증진사업에 참여하고 있는 조직들의 특성을 파악하고 조직 간 협력관계를 네트워크 구조를 기반으로 분석하여 사업운영맥락과 현안을 파악하는데 목적이 있다. 이를 위해 4월 말부터 5월 초까지 A구 보행증진사업의 이해관계자 17명을 대상으로 사회네트워크분석과 개인심층면접조사를 통한 주제분석을 활용하였다. 본 연구의 주요 결과는 다음과 같다. 도시보행증진을 위한 네트워크구조는 시민조직과 공공조직의 조직에 대한 인식의 차이가 협력관계형성에 영향을 주는 것으로 나타났다. 전체 네트워크 구조에서 시민조직은 재정적 독립을 기반으로 활동의 자율성을 확보하여 자발적으로 복지분야로 관계를 확장하였다. 이와 반대로 공공조직 내에서 보행증진을 위하여 협력하는 관계는 사업의 필요에 따라 단기적으로 이루어지며, 타 분야와의 협력은 구조적인 갈등으로 인해 필요 이상의 협력은 발생하지 않는 것으로 확인되었다. 본 연구결과를 바탕으로 지역사회 건강증진의 전략으로서 A구 보행증진에 관여하고 있는 조직들 간 협력을 구조적으로 설명하였다. 그리고 보행증진사업에서 구조적으로 나타나는 공공조직과 시민조직의 역할에 맞는 지원을 위한 정책을 제안하기 위하여 A구 보행증진사업의 주요 현안에 대한 시사점과 구조적인 접근방안을 제시하였다. ; The object of this paper is to identify the characteristics of organizations participating in the promotion of walking activities in health promotion projects and to analyze the cooperative relationship among organizations based on the network structure. For this study, Social Network Analysis and in-depth interviews were used for 17 stakeholders in A district of Seoul. The main results of this study are as follows. First, the network structure for the promotion of urban walking showed that the difference in perception of civic organizations and public organizations influence the formation of cooperative relationship. In the entire network structure, civic organizations voluntarily expanded their collaborative relationship to the organizations of the welfare field by securing the autonomy of activities based on financial independence. On the contrary, it is confirmed that the relationship that cooperates for the promotion of walking in the public organizations take place in the short term according to the need. Cooperation with other fields in the public organizations has been confirmed that there is no more cooperation than necessary due to the structural conflict of public organization and the interests of the work. Based on the results of this study, the researcher structurally explained the cooperation among the organizations involved in the promotion of walking in A district of Seoul as a strategy of community health promotion. 학위논문 (석사)-- 서울대학교 대학원 : 환경계획학과, 2012. 2. 전상인. ; 경주지역의 고도보존법 개정과정 사례는 사회구조의 변화에 따른 문제점과 갈등의 원인을 공공부문과 시민들이 함께 인식하고, 다양한 이해관계자들이 참여와 협력을 통한 상호작용으로 합의를 도출한 협력적 계획사례로 평가할 수 있다. 따라서 경주사례를 협력적 계획의 구성요소를 통해 분석해 보는 과정은, 지방 환경에서 협력적 계획이론의 적합성과 현실에서의 적용에 있어 발생하는 문제들을 어떻게 개선하여 보완해야 하는지에 대하여 시사점을 제공한다. 협력적 계획이론에 대한 탐구를 바탕으로, 협력적 계획의 네 가지 구성요소들인 '제도적 맥락', '상호작용의 장', '사회적 학습', '참여 및 합의형성'을 도출하였고, 그중 제도적 맥락을 중심으로 분석을 진행하였다. 경주지역 고도보존법 개정과정에는 공공부문과 시민부문을 중심으로 하는 다양한 이해관계자들이 네트워크를 형성하고 있으며, 공유된 이해에 따라 네트워크는 변화하는 양상을 나타냈다. 개정과정의 이해관계자들은 공청회와 주민설명회를 중심으로 하는 상호작용의 장에서 유통되는 정보를 바탕으로 사회적 학습을 하고 있었으며, 이를 바탕으로 계획과정에 참여하여 개정안의 도출이라는 합의를 형성하였다. 분석의 결과를 종합하면, 경주의 사례는 협력적 계획의 외형은 갖추어져 있다고 평가할 수 있지만, 실제 과정에 있어서는 공공부문의 제한적인 정보공개 범위와 접근성의 문제, 참여자의 대표성과 권력의 비차별성이 부족, 상호작용의 장에서 공동학습이 이루어지기보다 소통의 방향이 일방적이라는 문제점을 가지고 있었다. 제도적 맥락으로 종합하면, 경주지역에 있어 위 문제들은 이해관계자들 간 신뢰저하의 원인으로 작용하였다. 경주지역의 이해관계자들은 정책의 목표달성을 위해 표면적으로 협력하고 있지만 서로를 신뢰하지 않았다. 지방환경에서 발생하는 공공부문과 시민들 간의 신뢰의 문제는 지속적인 합의형성의 학습에서 그 해답을 구할 수 있기에, 정책적 제언을 통해 제도적 보완과 사유재산권 제한에 대한 해법을 모색하고자 하였다. ; Gyeongju-city's preservation law revision process is evaluated as collaborative planning practices. On this case, first the public sector and citizens recognize social problem and conflicts, then various stakeholders are produced agreement with participation and interaction. Therefore, this analysis of cooperative Gyeongju case through the components of the collaborative planning theory provides implications for suitability of collaborative planning theory. It also provides the application of local environment and how to improve and supplement in real life problems. To precede the analysis, first I studied on collaborative planning theory and then derived four components of the collaborative planning theory that 'institutional context', 'field of interaction', 'social learning', 'participation and consensus-building'. Among these components, analysis was performed mainly on the institutional context. Various stakeholders to form a network and a shared understanding of the network showed a changing pattern in this revision process. Stakeholders are conducting social learning, based on the information that delivered by public-hearings and presentations around field of interaction. Based on this information, they involved in the planning process and derived the agreement. In sum, this case evaluated as collaborative planning case superficially. But there are some problems in process that information, participation and mutual understanding. Problem that listed above acts as the cause of deterioration of trust between stakeholders. On the surface, to achieve the goals of the policy is working, but stakeholders are did not trust each other. Through policy proposal, I tried to seek a solution on deterioration of trust problem. Continuous learning on public consensus is encouraging a social capital, such as trust. Study institutional complements on regional commission and find solution in private property limitation problem, are able to derive consensus making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김상헌. ; 중앙정부는 지방정부의 부족한 재원을 지방교부세, 국고보조금과 같은 지방재정조정제도를 통해 보전하고 있다. 우리나라의 경우 지방 재정조정제도의 하나인 지방교부세에 보통교부세와 특별교부세가 있 다. 특별교부세는 보통교부세의 경직적 산정에 따른 배분의 한계를 보완하여 각 지방재정력의 격차를 고려하여 보전한다는 방침으로 행 정안전부에서 운영하고 있다. 그러나 특별교부세는 배분의 기준과 결 정이 모호하고 불투명하여 그 결정이 정치적으로 이루어진다는 문제 점을 지적하는 연구가 있다. 선행연구로 이루어진 특별교부세 배분에 관한 실증분석에서는 배분의 결정에 영향을 미친다고 상정한 정치적 행위자를 국회 행정안전위원회 소속, 지역구 국회의원 수 등 의회의 영역으로만 한정하였다. 본 논문은 정치적 요인에 의회의 행위자뿐만 아니라 정부의 행위자 를 포함시켜 분석하였다. 본 논문은 전국 234개 시‧군‧구의 2003~2006년도 4개년도의 특별교부세 자료를 이용하여 특별교부세 배분의 결정에 영향을 미치는 요인들에 대해 정부 정무직 공직자를 포함하여 실증분석을 시도하였다. 그 결과 정부 정무직 공직자로 상 정한 변수가 배분의 결정에 영향을 미친다고 파악되었고, 정부 정무 직 공직자 중에서도 국무총리와 국무조정실‧차장이 다른 정무직 공직 자에 비해 더 큰 영향을 미친다고 파악되었다. 특별교부세 배분에 정무직 공직자가 자기 출생지에 더 많이 배분하 려 결정 과정에 영향을 미치는 것뿐만 아니라 정무직 공직자가 임기 후 선출직에 출마할 경우 특별교부세 배분의 결정에 더 큰 영향을 미 친다는 것을 보았다. 이로써 특별교부세 배분의 결정에 정부의 정무 직 공직자가 영향을 미친다는 것을 확인할 수 있었다. ; The national government makes up for any shortfall in finance of the local governments by the local finance coordination system, which includes local revenue sharings and national subsidies. The local revenue sharing, as a kind of the local finance coordination system, consists of an ordinary revenue sharing and a special revenue sharing. The latter is introduced to remedy the shortcomings of the former's allocation system caused by the rigidity of its calculation, and is currently operated by the Ministry of Public Administration and Security. There are some literature criticizing the problem that the SRS allocation is decided politically due to the fact that the principles for its allocation are equivocal and the decisions are arbitrary and not transparent. In previous studies analyzing the SRS allocation empirically, the scope of the political actors who are assumed to exert influences on the allocation decision is limited to the legislative area, such as the members of the National Assembly Public Administration and Security Committee and the number of lawmakers in each electoral district. This study presents a further analysis with a new political factor, the government actors, in addition to the existing legislative actors. Specifically, using the SRS data for the period of 2003 ~ 2006 for the entire 234 cities- counties-districts in the country, the present study attempts to analyze the factors, which affect SRS allocation decisions, including the new variable, the government's political masters. The results demonstrate that the new variable indeed affects the allocation decisions and that, among the political masters, prime ministers and directors generals and deputy directors in the Prime Ministers Office are shown to exert greater influences than others. Moreover, it is also shown that they exercise their power in the SRS allocation decision making process to provide more sharings to their places of birth, and in particular, their intervention is even greater when they decide to run for an elective office from their places of birth after the termination of their government offices. As such, this study verifies that the government's political masters exert influences on the SRS allocation decision. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 사회가 민주화되고 가치가 분화됨에 따라 각종 국책사업을 둘러싼 공공갈등이 심화되고 있다. 단순한 이익갈등뿐만 아니라 가치갈등 또는 복합갈등이 빈번하게 발생하고 있으며, 갈등범위도 전국적으로 확대되고 있다. 본 연구는 국책사업 중에서 '세종시 수정안'을 사례로 선정하여 정책결정 과정을 둘러싼 갈등에 대해 분석하고자 하였다. 특히 세종시 수정안 정책결정을 둘러싼 갈등의 배경과 성격은 무엇이고, 그 갈등을 관리 또는 해결하기 위해 정부에서 선택한 의사결정 방안이 적정하였는지 등을 참여적 의사결정 하의 갈등관리시스템의 틀로 분석하였다. 이를 통해 향후 세종시 수정안 추진과 유사한 대형국책사업 추진에 있어서의 성공적인 갈등관리를 위한 시사점을 도출할 수 있을 것으로 기대하였다. 제1장에서는 연구의 목적과 필요성, 연구의 대상과 범위에 대해서 설명하고 연구에서 사용한 사례연구방법과 자료수집방법에 대해 밝혔다. 제2장에서는 공공갈등의 개념과 유형 등 이론적 논의를 한 후, 참여적 의사결정이론을 소개하였다. 이러한 이론적 배경과 선행연구 등을 바탕으로 연구의 분석틀을 설정하였다. 제3장에서는 세종시 수정안 갈등의 발생배경과 갈등의 성격, 갈등의 쟁점과 이해관계자 분석, 갈등시기별 전개과정 등을 살펴보았다. 제4장에서는 연구의 분석틀에 따라 참여적 의사결정 요인과 정치 환경 요인에 따라 세종시 수정안 사례를 분석하였다. 주요 분석결과를 요약하면 다음과 같다. 우선 참여적 의사결정 요인에 따른 분석결과, 세종시 수정안 사례는 전반적으로 참여적 의사결정 방법에 의한 갈등관리가 미흡하였다고 평가할 수 있다. 첫째, '여론수렴 및 정보제공'이 미흡한 것으로 나타났다. 초기부터 여론수렴 및 정보제공 보다는 정부주도의 일방향적인 의사결정 추진 및 설득에 치중함으로써 갈등관리에 부정적인 영향을 미쳤다고 볼 수 있다. 둘째, '참여적 의사결정 활용' 측면 또한 미흡한 것으로 나타났다. 관련분야의 학식과 경험이 풍부한 전문가들을 민간위원으로 포함시켜 '세종시 민관합동위원회'를 구성ㆍ운영하였으나, 인적구성에서 찬성의견과 반대의견에 대한 균형을 이루지 못하여 활동결과에 대한 신뢰도를 저하시키는 원인이 되었다. 셋째, '협력규칙의 적용 여부'를 살펴보면, 우선 참여규칙, 분해규칙 적용 측면에서 미흡하였다. 그리고 자원확대규칙 측면에서는 원안보다 큰 경제적 보상이라는 인센티브를 제공하였으나, 이해관계자들에게 정치적 신뢰를 얻지 못함으로써 큰 효과를 발휘하지 못하였다. 마지막으로 '결과의 공개 및 정책에의 반영 여부' 측면에서 볼 때, '세종시 발전방안'을 언론 브리핑 형태로 발표함으로써 결정결과의 공개 자체는 투명하게 이루어졌다고 할 수 있으나, 수정안 마련 과정이나 발표 이후 국민의견수렴 절차를 거치는 과정은 미흡했다고 볼 수 있다. 정치환경 요인에 따른 분석결과는 다음과 같다. 우선, 여당내 대통령의 리더십이 수정안 찬성집단과 반대집단으로 분절된 결과, 정책의제 설정 및 정책결정과정의 추진력이 약화되었다. 둘째, 야당이 타협의 의사 없이 세종시 수정 추진에 무조건 반대하는 방식으로 진행되어 갈등이 증폭되었다. 셋째, 핵심 어젠다 제기의 정치적 타이밍과 관련, 5년 단임제의 특성을 고려할 때 집권 2년이 다 되어 갈 무렵 세종시 수정이라는 어젠다가 공식 제기됨으로써 유리한 타이밍을 놓쳤다고 볼 수 있다. 이와 같이 불리한 환경적 요인들은 참여적 의사결정에 의한 갈등관리에 부정적인 제약요인으로 작용하였다고 볼 수 있다. 제5장에서는 이와 같은 연구결과를 요약하고, 다음과 같은 시사점을 도출하였다. 첫째, 갈등과 갈등 당사자의 특성, 갈등이슈 유형 등에 따라서 갈등관리방식의 선택 또한 달라져야 한다는 것이다. 특히, 극단적인 대립과 갈등이 예상되고 그 파급효과가 매우 큰 세종시 수정안과 같은 사례일수록, 사전에 갈등영향분석 등을 통해 갈등의 요인을 사전예측ㆍ분석하여 관리대책을 마련하고, 정책의제설정 및 정책결정과정에서 참여적 의사결정 수단의 적극적인 활용이 필요하다고 볼 수 있다. 둘째, 정책대상집단과 이해관계자에 대한 사회적 인식(social construction of target populations)에 따라 갈등관리의 구체적인 수단 또한 달라져야 한다는 점을 알 수 있다. 따라서 향후 유사한 갈등사례에 있어서 정부의 갈등관리 전략 마련시 대상집단에 대한 사회적 인식에 대한 관심을 바탕으로 유ㆍ무형의 인센티브를 적절히 활용하는 것이 필요하다고 할 수 있다. 셋째, 참여적 의사결정기법 활용을 위한 구체적인 법적ㆍ제도적 장치 마련이다. 세종시 수정안 사례에서 전반적으로 참여적 의사결정방법의 구체적인 수단 활용이 미흡했던 것은 이러한 방안을 준비하고 실행할 수 있는 제도적 뒷받침이 부족했던 점에서도 그 원인을 찾을 수 있다. ; As society is democratized and the value is divided, public conflict surrounding the various national projects is growing. Value conflicts or compound conflicts, as well as simple interest conflicts occur frequently, and conflict is expanding nationwide scope. This study selected the case of amendment of Sejong city among various national projects as a case study, and tried to analyze conflict over the decision-making process of the case. Especially, this analyzed over the background and characteristic of conflict on the amendment of Sejong city, and appropriateness of the system of conflict management selected by the government in order to manage or solve the conflict through the frame of conflict management system under participative decision-making. This promotion is similar to the amendment during the next three kinds of large national projects in promoting the success of the implications for conflict management was expected to be drawn. Through this study, it is expected to reach to an implication for the successful conflict management on the similar case of the amendment of Sejong city. Chapter 1 explains the purpose, necessity, range and target of the research, and it defines a method of case study as well as the method of collecting data that are used for the case study. Chapter 2 explains the theory of participative decision making after introducing a theoretical review such as concept and kinds of public conflict, and establishes a framework of the study by referencing previous studies. Chapter 3 reviews the background and nature of conflict on the amendment of Sejong city, conflict issues and stakeholders, and development process of conflict. Chapter 4 analyzes the case by the factors of participative decision making and the political-environmental factors through the framework. The summary of main analysis is as follows: First of all, the case of amendment of Sejong city can be evaluated that the conflict management through participative decision making is insufficient, as a result of analysis by the factors of participative decision making. First, the 'collection of public opinion and provision of information' was insufficient. From the beginning, the government focused on a one-way decision-making and persuasion rather than collection of public opinion and provision of information, and it negatively influenced on conflict management. Second, the 'use of participative decision-making' was also insufficient. Even though various experts participated in the Sejong city committee, the composition was biased. Therefore it was one of the main cause of declining the reliability of the results. Third, 'participating rule' and 'factoring rule' were not sufficiently utilized. In terms of 'resource expanding rule', the government suggested more incentive of amendment plan than one of original plan, but it was not effective because of distrust of the government. Finally, in terms of announcement of the result and feedback of policy', amendment of Sejong city was openly publicized through giving a briefing. However the process of collecting extensive opinions was insufficient. The result of analysis by means of political-environment factor is as follows: First, the leadership of President was divided into supporting groups and opposition groups. Therefore the momentum of agenda-setting and policy-making was weakened. Second, the opposition party opposed to the amendment of Sejoing city without any condition. Third, the political timing of agenda-setting was not timely. The government missed the advantageous timing because the agenda was proposed during second year of a 5-year term of presidency. These adverse environmental factors negatively effected on conflict management of participative decision making. Chapter 5 summarizes the results of these studies, and the following implications were drawn. First, the method of conflict management should be selected according to the nature of conflict and the conflict parties, conflict type of issue. In particular, when the extreme conflict is anticipated and the result of the policy is wide, the government should pre-establish measures of conflict management through conflict effect analysis, and participative decision making should be actively utilized. Second, the specific means of conflict management should be selected by social construction of target populations. IPA분석을 통해 한정된 자원을 좀 더 효율적으로 투입할 수 있는 방안이 생겼는데 이는 중요도와 만족도를 함께 조사하기 때문에 가능한 일이다. 그러나 '성과'를 '시민 만족도 조사' 로 치환하여 사용할 수 있는지, 그 방법에는 어떠한 것이 있는지 등 '만족도'에 대한 논의는 활발함에도 불구하고 아직까지 '중요도'에 대한 논의는 국내에서 미미한 실정이다. 이러한 이유에서 본 연구는 개별 행정서비스의 '중요도' 를 좀 더 정확하고 설명력있게 파악하기 위한 작업으로 사부문에서 활용되는 Derived importance를 소개하고 직접 설문을 통한 결과를 도출하여 기존에 활용되던 Stated importance 와는 어떤 점에서 다른 특성을 갖는지 살펴보았다. Derived importance 는 개별행정서비스에 대한 만족도를 독립변수로, 전체 행정 만족도를 종속변수를 두고 다중회귀분석을 통하여 나온 설명변수값(Beta)으로 중요도를 도출해내는 통계학적인 수치이다. 이는 Stated importance 보다 더 설명력이고 예측성이 있으며 심층적인 시민의 의식을 엿 볼수 있다는 점에서 실질적인 중요도로서의 가치가 증대되고 있다. 직접 설문조사를 통하여 각각의 중요도 값을 도출해낸 결과 24개의 개별 행정서비스의 중요도로 Stated importance 에서는 '공원과 여가활동시설'의 중요도는 12순위 밖에 되지 않았으나 Derived importance 에서는 1순위임을 확인할 수 있었으며, '공중보건 및 의료' 항목도 Stated importance 는 14위이나 Derived importance 에서는 2순위의 값을 가지는 등 여러 차이를 확인할 수 있었다. 이는 일반인들이 '실업문제 해결 및 경제활성화'나 '주택가격안정 및 주택공급' 과 같이 상대적으로 범주가 크고 사회적으로 이슈가 되는 문제해결을 위한 행정서비스 개선이 중요하다고 표면적으로 응답하나 실질적, 심층적으로 서울시의 전체 행정 만족도의 개선을 증진시키는 가장 중요한 서비스는 자신의 주변에 '공원과 여가활동시설' 이 얼마만큼 있는지, 자신이 아플 때 이용하는 '공중보건 및 의료'에 대한 행정이 잘되어있는지의 여부라는 것을 의미한다. 즉, 개인이 중요시 여기는 실질적인 개별 행정서비스의 개선은 자신의 피부에 직접 와닿고 자신이 느낄 수 있는 범주의 것이라는 점이다. 정책결정자의 최종 목표는 전반적인 만족도의 향상이다. 시장의 경우 전체적인 시의 운영 및 시 행정에 대한 만족도가 올라가는 것을 가장 첫 번째 목표로 삼을 것이며 시민들이 실질적으로 원하는 곳에 자원을 투입해야 한다는 측면에서 Derived importance 의 활용은 획기적인 시도라 할 수 있다. Derived importance 에 따라 개별 행정서비스 부문 중 높은 중요도를 가진 부문에 예산과 자원을 투입한다면 지방정부의 가장 첫 번째 목표인 지방 정부의 전체 만족도의 상승 효과를 예상할 수 있어 매우 효과적인 지표로써 활용될 수 있을 것이다. ; New Public Management lead consistent attention of introducing market economy principle to administrative institutions. As index of measuring such administration, there is a growing tendency of studying 'citizens' level of satisfaction'. Survey on citizen's level of satisfaction has the implication that finding out to what extent citizens are satisfied with municipal administration and apply it to administrative performance. Previous survey on the level of satisfaction, however, previous index only had a role of measuring 'past' performance but had limitation in guiding which policy should be promoted in the 'future' as well as where limited resources should be inputted. For such reasons, so as to figure out 'the level of importance' of each administrative service more accurately and in a more explanatory manner this study introduces Derived importance which is utilized in private sector and takes results through direct survey to find out which features are different from Stated importance which is utilized previously. Derived importance is statistical figure of which independent variable is the level of satisfaction on each administrative service and dependent variable is the level of satisfaction on general administration, and derives the level of importance through multiple regression analysis in the form of explanatory variable (Beta). As the result of the level of importance through direct survey, among 24 individual administrative services, it is found out that the rank of 'park and leisure facility', which is only 12th in Stated importance, is the first in Derived importance; the rank of 'public health and medical treatment', which is only 14th in Stated importance, is the second in Derived importance. This result means that citizens ostensibly answer that it is important to enhance administrative services concerning subjects, which are relatively big and receive attention from society, such as 'solution of unemployment and economic revitalization' or 'stabilization of housing price and housing provision', however, the most important service to them in substance and in depth, which enhances the level of satisfaction on Seoul city administration in whole, is 'park and leisure facility' around the neighbor and 'public health and medical treatment' which they can use when they are sick. That is, the substantial enhancement of individual administrative service which is important to individuals is about categories which people click and feel. The final goal of policy maker is to raise overall level of satisfaction. In case of mayor, it may be fairly said that the utilization of Derived importance is epoch-making attempt from the aspect that the first priority will be enhancement of general municipal operation and satisfaction on municipal administration and resource should be inputted where citizens want in substance. Background: Bankrupted households have recently been increased due to excessive medical expenditure in Korea. They have not been protected from economic risk when household's member has severe diseases that need a lot of money for treatment. Purpose of this study examines policy effect by comparing unmet needs' change of policy object households and non-object groups. Methods: We used Korea Health panel 2nd 4th data collected by Korea Institute for Health and Social Affairs and National Health Insurance Service. Analysis subjects were 381 households (pre-policy) and 393 households (post-policy) that had cancer and cardiovascular and cerebrovascular diseases. Since it was major concern that estimates benefit strengthening policy started by certain time, we setup comparing households which had diabetes, hypertension disease. Comparison subjects were 393,247 households, respectively and we evaluated policy effect using difference in difference (DID) model. Results: Although unmet needs of policy object households were higher than non-object groups, policy execution variable affected negative direction. But interaction-term which shows pure effect of policy was not statistically significant. We utilized multi-DID model to examine factors affecting unmet needs causes. Copayment assistance policy did not significantly affect households that responded to 'economic reason,' and 'no have time to visit' for unmet needs causes. Conclusion: The second copayment assistance policy did not significantly give positive effect to beneficiary households than non-beneficiary groups. When we consider that primary purpose of public insurance guarantee high medical expenditure occurred by unexpected events, it needs to deliberate on switch of benefit strengthening policy that can assist vulnerable people. Also, we suggest that government forward a policy covering non-reimbursable medical expenses as well as switch of benefit strengthening direction because benefit policy do not affect non-covered medical cost which accounts for quarter of total health expenditure. ; open

학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 이승종. ; 본 논문은 우리나라의 주민소환투표에 있어 소환결정과 부결에 영향을 주는 요인이 무엇인지 보여준다. 동일한 지역에서 동일한 사유가 적용된 소환 대상자에 대해 투표구에 따라 소환투표 결과가 달라지는 것에 착안하여 어떤 요인이 작용할 때 소환투표에 주민들의 참여가 잘 일어나는지가 본 연구의 동기가 되었다. 기존 주민소환 관련 연구들은 주로 제도 운영상의 쟁점을 도출하고 그에 따른 정책대안의 제시 또는 주민소환제의 개선방안에 대한 논의가 주를 이루고 있다. 주민소환투표 사례에 대한 연구는 양적으로 부족하다. 더욱이 소환결정, 부결 결과에 영향을 미치는 요인에 관한 직접적 연구는 찾아보기 힘들다. 따라서 본 연구는 시민참여의 관점에서 어떤 요인이 작용할 때 주민소환투표 참여가 잘 일어나는지에 대해 주목하였고, 이를 밝히기 위해 투표결과에 영향을 미치는 요인을 연구하였다. 이를 위해 '하남시 주민소환투표 사례'를 대상으로 단일 사례연구 방법을 시도하되, 사례 안에서 두개의 투표구의 상이한 투표결과를 비교하여 결과에 영향을 미치는 요인을 식별하였고, 그 요인들 가운데 소환결정 혹은 부결을 결정짓는 요인이 무엇인지 분석하였다. 분석결과 소환 사유, 소환 추진 주체, 소환에 대한 소환대상자의 반응, 소환대상자의 수 요인은 주민소환투표 결과에 제한적으로 영향을 미치는 요인임을 확인하였다. 이 네 가지 요인은 하남시 주민소환투표 결과를 볼 때, 소환 결정된 투표구에서는 영향요인으로서 작용하였지만 소환 부결된 투표구에서는 영향요인으로서 작용하지 못했음을 관찰할 수 있다. 즉, 투표구에 따라 차별적이고 제한적인 영향 요인으로 작용하였다. 한편, 소환지역의 경제적 여건 요인은 영향요인이라고 하기에는 불분명해 보였고, 거주지 특성, 소환 지역의 정치적 여건, 인구밀집정도 요인 등은 소환투표 결과에 영향을 줄 수 있는 직접적 요인임을 확인하였다. 거주지 특성 요인의 경우 자기집 거주 비율이 높은 투표구는 투표 참여율이 높게 나타났고, 전‧월세, 무상 주택이 많은 투표구는 주민소환투표 참여율이 낮은 현상을 관찰하였다. 또한 투표구별 유력한 정치세력의 존재 여부와 인구밀집 요인은 주민소환투표 결과의 요인일 뿐만 아니라 투표구별 소환 결정, 부결 결과에 영향을 미치는 주요 요인임을 확인하였다. 본 연구를 통해 얻을 수 있는 정책적 함의는 다음과 같다. 정책을 추진하려는 지방자치단체의 선출직 공직자에게 지역주민과의 의사소통은 매우 중요한 요소라는 것이다. 공론화 과정 없이 정책을 추진시 주민들은 이를 '독단적 행정'이라고 여길 수 있고, 이는 주민소환으로 이어질 수 있다. 따라서 지방자치단체의 선출직 공직자는 정책을 시행하기 전에 지역주민을 대상으로 공론조사나 이슈포럼 등 토의의 과정을 거치는 것이 필요하다. 정책을 추진함에 있어 정보가 충분하게 제공되고 토의의 기회가 마련되는 등 찬성 또는 반대단체가 지방자치에 관여할 수 있는 장치가 충분하다면 지방자치단체장의 정책추진 자체만을 이유로 소환투표단계까지 진행되기 어려워 보이며, 아직까지 정책추진 자체가 문제가 되어 소환투표를 실시한 사례도 없다. 한편, 주민소환과정에서 소환대상자의 사법적 대응은 소환대상자 측과 소환 추진 세력 간 갈등을 고조시켜 결국 지역에서 주민소환의 판을 키우는 결과를 초래한다. 본 연구는 기존의 연구가 직접적으로 다루지 않았던 주민소환투표 결과의 영향요인을 도출하고 아울러 동일한 지역 내 동일한 사유로 소환된 대상자에 대해 소환결정, 부결이라는 상이한 결과에 대한 원인이 무엇인가 밝히려는 시도를 했다는 점에서 그 의의가 있다. ; This paper shows the cause of affecting the decision to recall and veto in terms of Recall of our country. Looking at the fact that the result of Recall differs in accordance with the occurrence of objectives of summon in the same region, detecting certain factors which increases Participation becomes the motivation of this study. Current studies regarding Recall mainly drag the disputed point of administrative policy and suggest alternative plan or discuss improvement option for Recall system. Researches of recall precedent are insufficient in numbers. Moreover, there is no experiment aimed at factor which affects result of deciding summon and veto. Therefore, this investigation focuses on certain points where participation of recall occurs well in the perspective of participation and researches the factor affecting vote outcome to reveal the point. For this, single case study investigation using 'Ha-nam city's precedent of recall applied, but compared different vote result of two districts within the precedent and found the factors affecting the product, and analyzed the factors affecting recall decision or veto among those causes. As the result of analysis, reason for recall, group promoting recall, reaction of target who got recalled, number of objectives who could be recalled were the restricted causws identified which could affect the result of a recall. These four reasons regarding the result of Ha-nam city's Recall, affected the region as affecting factors where recalling was accepted, but did'nt affect the area where recalling was denied. There for, according to the region, these were applied as restricted affecting factors. On the other hand, it was not certain that the economic condition of area recalled was an affecting factor. Characteristics or residence, political circumstance of area recalled, population density were factors directly affected the result of Recall. Considering the traits of residence, the turn rate was high for the district where the rate of household who lives in their own houses was high. For the areas where leasing, monthly rent and gratis house prevail, however, showed low participation rate. Also, the existence of powerful political group of each district and population density were not only the factors affecting the result of Recall, but also the crucial factors affecting the accepting of Recall or denying the Recall. Following is the policy implication could be acquired from this investigation. Communication with local civilian is extremely crucial element for elected public official of a local government of a region which tries to promote a policy. Promoting a policy without publicizing, residents might regard this as 'arbitrary administration' which could lead to the recall. Therefore, it is necessary to go through the discussion process for elected public official such as conducting a deliberation poll or issue forum before a implementation of policy. If there was enough mechanism for agreeing and denying groups to participate in local autonomy such as providing information and opportunities of discussion when promoting a policy, the process of recall would not have to be advanced only for the reason of chief of local government's policy promotion and still, there was no precedent of recall due to the policy promotion itself as a catalyst. On the one hand, judicial confrontation during the process of summoning resident only elevates the conflicts between the objectives of summon and the powers trying to call which eventually foster the situation of summoning resident. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 국문 초록 본 연구에서는 고구려연구재단과 동북아역사재단의 설립과정을 역사적 사회 환경적 관점, Allison의 정부정치 모형적 관점, 그리고 Kingdon의 정책흐름 모형적 관점에서 비교 분석하여 두 기관의 설립, 두 기관의 제도적 성취 및 역할 범위의 차이를 가져온 요인이 무엇인가를 밝혀보고자 하였다. 일반적으로 조직설립을 다루는 이론으로서 역사적 사회 환경적 관점에서는 조직 환경론, 특히 구조적 상황이론과 조직생태이론이 유용한 분석도구로 활용되어져 왔다. 이러한 이론들은 조직설립이 그것을 둘러싼 맥락 또는 상황에 의존한다는 결정주의적 입장을 취하고 있기 때문에 특정 상황적 요인의 존재 또는 발생으로 조직이 설립되었다는 것을 설명하는 데는 유용한 관점인 것으로 인식되어져 왔다. 하지만, 본 연구에서는 조직 환경론적 관점만으로는 왜 특정 공공조직은 특정 상황 또는 맥락의 존재에도 불구하고 설립 또는 사멸되지 않으며, 왜 유사한 공공조직간 제도적 성취의 차이가 발생하는 가를 설명하는 데는 한계가 있다고 보고 조직설립과 관련된 조직 환경론적 관점의 한계를 적시함과 동시에 준 정부조직 설립과정의 특수성을 감안하여 정부정치모형과 정책흐름 모형을 추가로 적용함으로써 고구려연구재단 및 동북아역사재단 설립과정에 대한 비교분석을 시도하였다. 먼저, 역사적 사회 환경적 관점에서는 구조적 상황이론과 조직 생태이론을 적용하여 두 기관의 설립을 가져온 역사적 배경이 무엇이며, 동북아역사재단 설립과 더불어 이에 흡수 통합된 고구려연구재단의 사멸 요인이 무엇인지를 밝혀보고자 하였다. 동 연구 결과에 의하면, 고구려연구재단의 사멸은 낮은 신뢰성 및 예측가능성, 신생조직의 불리, 작은 조직 규모 및 예산, 핵심적 조직 변화의 시도 및 동북아역사재단의 설립에 기인한 것으로 나타났다. 두 번째로, Allison의 정부정치 모형을 통하여 두 기관 설립을 둘러싸고 벌어진 참여자들의 흥정과 타협을 분석하여 이들의 입장·선호·인식·기대이익 등의 차이가 두 기관의 설립 및 제도적 성취에 어떠한 영향을 주었는가를 설명하였다. 그 결과 두 기관의 설립 및 제도적 성취의 차이 발생은 핵심참여자로서의 대통령과 행정기관의 인식 및 선호의 차이에 의해 크게 영향을 받은 것으로 나타났다. 다시 말해, 고구려연구재단 설립과 관련된 대통령 및 행정기관의 인식 및 입장은 한·중 양국의 외교관계 등을 의식해서 상당히 유화적이었던 반면, 일본의 역사교과서 왜곡 및 독도 영유권 도발로 시작된 동북아역사재단 설립과 관련하여서는 대통령과 행정기관의 인식이 매우 단호하였던 것으로 밝혀졌다. 세 번째로, Kingdon의 정책 흐름 모형을 적용하여, 두 기관 설립을 둘러싼 문제 및 정책의 흐름의 차이가 어떠하였는지를 비교 분석하였다. 먼저, 문제 흐름의 측면에서 고구려 역사 왜곡 문제에 대한 정책 당국자 또는 학계의 인식은 약했으며, 정책의 흐름도 시민단체 주도로 이루어져 일관성 및 강도가 약했다는 것을 확인하였다. 반면, 일본의 역사 교과서 왜곡 및 독도 영유권 도발로 촉발된 동북아역사재단 설립을 둘러싼 문제의 흐름은 강하고 일관성이 있었으며, 정책 흐름 역시 대통령과 행정기관의 주도하에 하향식으로 이루어져 일관되고 강하게 진행되었다. 이러한 두 가지 흐름상의 차이가 두 조직간 제도적 성취의 차이를 가져온 또 다른 설명 요인이었다고 할 수 있다. 본 연구의 결과, 발견된 시사점은 다음과 같다. 먼저, 역사적 사회 환경적 관점만으로는 공공조직 설립과정을 명확히 이해하는 데는 한계가 있다는 것을 확인하였다. 다시 말해, 역사적 사회 환경적 관점은 조직의 구조나 기능을 결정하는 요인으로 특정 환경 혹은 맥락을 강조해왔지만, 동 관점만으로는 왜 특정 환경의 존재에도 불구하고 왜 특정시점에는 조직 설립 또는 사멸이 이루어지지 않다가 다른 시점에 와서야 이루어지는가에 대해서는 명쾌한 해답을 제공하지 못하는 한계가 있다는 것이다. 두 번째, 준 정부조직은 민간조직과는 달리 법적·행정적·제도적 제약 조건하에서 설립되는 경우가 많기 때문에 준 정부 조직의 설립과정을 보다 명확히 이해하기 위해서는 보다 다양한 관점 즉, 정부 정치적 관점 및 정책 흐름적 관점 등을 통한 기존 이론의 보완 또는 대체가 필요하다는 것이다. 특히 우리사회가 다원화된 사회로 진행되어감에 따라 공공조직 설립과정을 이해하기 위해서는 참여자의 정치적 흥정과 타협을 다루는 정부정치적 관점에 대한 고려가 필요할 것으로 본다. 주요어: 역사적 사회 환경적 관점, 구조적 상황이론, 조직 생태이론, Allison의 정부정치 모형, Kingdon의 정책흐름 모형, 준 정부조직 ; ABSTRACT A Comparative Analysis of the Establishment Processes of Two Quasi-Governmental Organizations: The Cases of the Koguryo Research Foundation and the Northeast Asian History Foundation Si Yung Jung Department of Public Administration Graduate School of Public Administration Seoul National University The purpose of this study is to analyze through a comparative approach the establishment processes of the Koguryo Research Foundation and the Northeast Asian History Foundation from the perspectives of historical-social environment, Graham Allison's Governmental Politics Model, and John W. Kingdon's Policy Streams Model in order to clarify the establishment processes of these two organizations and to identify which factors determined their institutional achievements. Generally, both contingency theory and organizational ecology theory have been widely used as tools for analysis of organizational establishment. These theories have strengths for explaining the contingencies and contexts which determine the establishment of organizations. However, these theories have weaknesses in explaining the reasons why an organization fails to be established in the presence of a certain contingency or why there are differences of institutional achievements between certain similar organizations. To further the understanding of organizational establishment and the incidence of differences of institutional achievement between the two organizations, this study adopted the Governmental Politics Model and the Policy Streams Model. In the perspective of the historical-social environment, both contingency theory and organizational ecology theory were adopted as tools for analysis. Contingency theory assumes that the structure or management style of an organization depends on the environment which surrounds the organization. In the perspective of contingency theory, the creation of the Koguryo Research Foundation was initiated by the Chinese distortion of Koguryo history, while the Northeast Asian History Foundation was created by the Japanese distortion of history and sovereignty provocation over Dokdo. The perspective of organizational ecology theory was adopted to explain the reasons why the Koguryo Research Foundation was closed and then merged into the Northeast Asian History Foundation after two and one-half years of activity. Through this perspective, this study found that the closure of the Koguryo Research Foundation resulted from such factors as lower reliability and accountability, the liability of newness, the small size of its organization and budget, the attempt of essential organizational change, and the creation of a new organization, the Northeast Asian History Foundation. In the perspective of the Governmental Politics Model, this study examined how the political resultants, the Koguryo Research Foundation and the Northeast Asian History Foundation, were drawn through bargaining and negotiation by the players involved in the game. This study revealed that the differences in the institutional achievements between the two quasi-governmental organizations resulted from the differences of the players' perceptions, preferences, and stands on the issue. In terms of perception, the perception of key players such as the president of the Republic of Korea and his administration on the issue of the Chinese distortion of Koguryo history was pacificatory, while the perception of the president and the administration on the issue of the Japanese distortion of history and the issue of Dokdo was quite determined. Through this lens, this study also found that the players perceived the issue not only on the basis of national interests, but also on the basis of their organizational interests and personal concerns. Finally, through the viewpoint of the Policy Streams Model, this study examined how the streams of problems and policy alternatives proceeded along the processes of the founding of the two quasi-governmental organizations. According to the analysis, the streams of problems surrounding the founding of the Koguryo Research Foundation were weaker than the streams of problems concerning the Northeast Asian History Foundation. In the perspective of policy streams, those concerning the founding of the Northeast Asian History Foundation were consistent and strong due to the determined stand of the president on the issue, while the policy streams regarding the Koguryo Research Foundation were incremental, inconsistent, and mutated due to the lack of presidential support and the passive attitude of the administration toward the issue. The first implication of the study is that a variety of aspects of organizational establishment should be reviewed to understand the process of organizational founding more clearly. Though organizational environment theories have assumed that environment or context determines the structure or function of the organization, the theories can not clearly explain why the birth or closure of an organization occurred in a specific time in spite of the presence of previous contingencies. The second implication is that policy makers or researchers should consider such factors as politics, administration, and the legality of the issues regarding the establishment of a quasi-governmental organization, because quasi-governmental organizations are governed by legal, administrative, and other institutional constraints unlike private organizations. The third implication is that, as Korea society is growing more pluralistic, the relevance of the Governmental Politics Model is likely to become higher in explaining the establishment processes of quasi-governmental institutions in the Republic of Korea. 학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 우지숙. ; 본 논문은 브라질의 인터넷권리보호법(Marco Civil da Internet)이 어떠한 전개과정을 거쳐서 지금에 이르게 되었는지 고찰한다. 각국이 인터넷의 자유와 규제의 딜레마 속에서 접점을 찾기 위해 노력하고 있는 가운데, 라틴아메리카의 브라질에서는 1990년대 이래 인터넷 규제에 관한 정책의제가 국가 내부에 존속하다가 오랜 논의 끝에 2014년 3월 25일 인터넷 이용자 표현의 자유, 개인정보보호, 망중립성(Net Neutrality) 보장 등을 골자로 하는 세계 최초의 인터넷 권리장전의 제정으로 이어진다. 연구는 '브라질의 Marco Civil은 어떠한 계기로 다른 정책들을 우선하여 정책결정자가 주목하는 주요 의제로 채택되어 제정으로 이어졌는가?'를 질문하고, 이러한 정책변동 사례를 Sabatier의 ACF 모형과 Kingdon의 MSF 모형의 결합모형에 적용하여 체계적으로 답을 모색하였다. 연구의 결과는 다음과 같다. 먼저, Marco Civil 정책은 각각 '평등주의'와 '시장주의'라는 상충하는 신념체계를 가진 찬반 옹호연합으로 분화되어 정책결정과정에서 첨예한 대립을 펼쳤으며, 정책학습의 기회에도 자신들의 신념체계를 견고화하였다. 둘째, 이들 옹호연합은 브라질 사회의 다양한 외적 변수에 직간접적인 영향을 받아 신념체계를 형성하였다. 셋째, Marco Civil은 수차례 입법 지연을 겪다가 Snowden 사건이라는 강력한 외부적 촉발기제에 의하여 정책의 창이 열리고 정책변동으로 이어질 수 있었다. 넷째, Marco Civil 정책결정과정에서 정책중개자와 정책선도자의 역할이 두드러진 것으로 나타났다. 특히 정책선도자인 Lula 대통령과 Dilma 대통령의 적극적인 역할은 Marco Civil 제정에 있어 결정적인 영향 요인이라고 판단할 수 있다. 연구의 함의는 다음과 같다. 먼저 이론적 함의로는 첫째, 연구는 ACF 모형과 MSF 모형의 적용 사례로서 비교적 새로운 분야인 인터넷 규제정책을 연구대상으로 삼았다. 인터넷 정책은 찬반 옹호연합의 첨예한 갈등이 나타나는 정책이라는 점에서 결합모형에 따른 설명력이 높게 나타났다. 둘째, 모형이 개발된 다원주의적인 서구사회가 아닌 권위주의와 엘리트주의가 뿌리 깊게 작용하고 있는 브라질의 사례를 분석함으로써 ACF 모형과 MSF 모형의 유용성을 입증하였다. 셋째, 일반적으로 대통령의 적극적 관심을 가질 경우 빠른 정책 대안의 마련으로 합리적인 대응 방안을 찾아낸다는 합리적 모형으로는 쉽게 설명되지 않는 사례로서, 룰라 대통령의 적극적인 지원에도 불구하고 임기 내 법안 제정에 실패한 원인을 추적할 수 있다. 넷째, 정책의 흐름이 열려 정책산출에 이르는 데 정치의 흐름은 정책의 창을 여는 데 결정적인 역할을 하지는 않았다. 호세프 정부 시기 정치의 흐름은 법안 제정에 부정적인 영향으로 작용하여 Marco Civil 폐지의 위기에까지 갔으나 외부적 초점사건에 의해 제정에 이르게 된다. 정책적 함의는, 먼저 정책선도자의 리더십과 정책 방향의 중요성을 함의한다. 국민의 인권 보장을 위한 룰라 대통령의 일관된 사회정책과 리더십은 우리나라에도 시사하는 바가 많다. 둘째, Marco Civil 법은 국가가 인터넷을 어느 범위까지, 어떠한 방식으로 규율해야 하는가와 관련된 가치충돌적이고 논쟁적인 쟁점을 되짚어보고 추후 유사한 인터넷 권리법 제정 논의에 적용할 수 있는 교훈적인 사례이다. 셋째, 본 정책은 참여민주주의를 실천한 사례로서 정부에 대한 국민적 신뢰를 반영한다. 마지막으로 한국과 브라질은 공통적으로 2006년도 인터넷상 사이버범죄 규제안을 제정하였으나, 한국의 경우 해당 법이 임기만료로 폐기된 이래 의미 있는 논의가 이루어지지는 않은 반면, 브라질은 사이버범죄법 발의라는 '초점사건'이 휘발되지 않고 정책선도자의 적극적인 의지 아래 인터넷권리법의 제정으로 이어진다. 브라질의 인터넷 정책결정과정에 대해 검토하고 구체적인 법안의 추진 동기, 과정, 정책의 결정요인 등을 모색함으로써 우리나라의 인터넷 규제정책이 어떠한 위치에 놓여 있는지 비교해볼 수 있을 것으로 생각한다. ; One of the most significant policy goals in the internet arena in the last decade has been striving to seek a reasonable balance between freedom and regulation of the Internet. Brazil, as Latin America's economic giant, has also spent a long time finding the balance point between creating economic profits and protecting human rights under the pressure of mediating the conflicting values of regulating and protecting users' behaviors from circumstances of the internet. And it is one of the key policy initiatives associated with this shift to pass the world's first Internet Bills of Right which is called Marco Civil da Internet on March 25, 2014 after years of discussion, which calls for freedom of expression for the Internet users, protection of personal information and guarantee of network neutrality. This case study explores the policymaking process of the Marco Civil da Internet in Brazil. It examines specifically how Brazilian internet policy came into being applying the combination frameworks of Sabatier's Advocacy Coalition Framework and Kingdon's Multiple Streams Framework, in order to learn more about the linkages between research and policy. The study began with a relatively simple question, 'On what occasion was Brazilian Marco Civil da Internet adopted as a major agenda for policymakers, prioritizing other public policies and being eventually enacted after long debate' and systemically sought an answer applying the example of this internet policy change through these policymaking process frameworks. The results of the study are as follows: First, the stakeholders in the policymaking of this legislation were divided into the a pro-MCI coalition and an anti-MCI coalition with a conflicting belief system between 'Equalityism' and 'Marketism' and strengthened their own belief system even in the opportunities of policy learning. Second, these advocacy coalitions formed these belief systems, directly or indirectly being influenced by various external variables in Brazilian society. The Snowden event in 2013 worked as a powerful external trigger mechanism of this policymaking process, as a strong variable that opened the window of policy and lead to policy changes after going through several legislative delays. Third, it was indicated that the role of a policy broker and a policy entrepreneur in MCI policymaking process was shown to be outstanding. In particular, the active role of policy entrepreneurs, the two Brazilian Presidents, Lula da Silva and Dilma Rousseff, could be judged as a decisive factor in enacting this legislation. Next, the implications of the study are twofolds. Firstly, the theoretical implications are as follows. First, the study targeted the Internet regulatory policy which is a relatively new field as an example of the application of the ACF and the MSF. The Internet policy might be highly adequate research topic, given that it is a policy that showed a strong conflict between a pro-MCI and an anti-MCI advocacy coalitions. Second, the study proved the usefulness of the ACF and the MSF by analyzing Brazilian case where authoritarianism and elitism have been deeply rooted rather than a pluralistic western society in which these theoretical frameworks were developed. Third, the study could track the causes for failure to enact this legislation within his term, despite President Lula's active support, which is not reasonably explained with a rational model supposing if the president has a active interest, he could find a reasonable and quick policy alternative. Fourth, Political Stream in this policymaking process did not play a crucial role in opening the window of policy. The political stream during the Rousseff administration had influenced a negative effect on enacting the legislation and reached the crisis of the abolition of the MCI, but an external focus event led it to be enacted in the conclusion. Political and practical implications are as follows: first of all, this study implies the importance of leadership and policy direction of policy entrepreneurs. President Lula's consistent social policy and leadership to ensure the human rights of Brazilian people provide a lot of implications for Korean administration. Second, the MCI is an instructive example that could be applied later in the discussion of enacting an Internet Bills of Right in other countries, which reflects on the value-conflicting and contentious issues concerning how the country should regulate the Internet. Third, as an example of practicing participatory democracy, the MCI policymaking process reflects public trust about the government. Finally, although each Korea and Brazil enacted regulations of cybercrime on the Internet in 2006, no meaningful discussion had been made in Korea since the law was scrapped at the end of its term, while Brazil's 'focus event' of trying to introduce the cybercrime law eventually led to the enactment of the Internet Bills of Right under the active will of policy entrepreneurs. 학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 박찬욱. ; 본 연구는 1970년대 이후 미국의 통상정책 결정과정에서 주된 절차적 기제로 작용해온 신속처리절차(Fast-track procedures)가 2002년 무역법을 통해 무역증진권한(Trade Promotion Authority; TPA)으로 재입법되는 과정의 동학을 의회-행정부 관계를 중심으로 설명하는 것을 목적으로 한다. 신속처리절차는 대통령이 비관세장벽 관련 내용이 포함된 무역협정을 체결하고 이행법안을 의회에 제출하면 양원은 수정안 제출 없이 가부만을 결정해서 90일내에 처리해야 한다는 규정으로 1974년 무역법에서 처음 도입된 이래 30년 간 미국의 무역정책결정과정에서 중요한 위치를 차지해왔다. 하지만 자유무역정책에 대한 양당의 합의가 약해지면서 1994년 만료되었고, 2002년 8월 6일 부시 대통령이 법안에 서명을 하면서 8년 만에 통상정책결정과정에 다시 등장했다. 그렇다면 어떠한 맥락에서 클린턴 행정부 시기에는 부결되었던 연장 법안이 부시 행정부 때는 성공할 수 있었을까? 기존의 연구들은 1997년과 2001년 표결 분석을 통해 의원 차원에서 이익집단ㆍ유권자들과의 관계, 정당 차원에서 단점정부를 그 요인으로 지적한다. 하지만 입법과정에서 의회의 행태는 의원 개인, 정당 두 차원 외에도 행정부와의 관계에서 입법부로서의 의회를 강화하고자 하는 유인의 영향을 받는데 본 논문은 마지막 차원에 주목한 설명을 제시하고자 한다. 즉 의회는 국내외 경제적 상황, 유권자와 이익집단에 대한 고려, 행정부 등 다양한 요구에 대응하는 과정에서 입법부로서의 지위 강화를 위해 행정부와의 관계에서 개입을 증대하는 동시에 실패했을 경우에 부담해야 하는 비난, 지지기반의 이탈과 같은 손실을 최소화하는 방향으로 정책을 입안하려고 했고, 그 결과로 2002년에 무역증진권한이 다시 입법되었다는 것을 보이고자 한다. 입법 과정을 보면 초기에는 기존 연구 결과에서 나타나듯 의원 개인의 차원에서는 재선을 위해 유권자와 이익집단을 고려했고 정당 차원에서는 다수당이 되려는 선거 정치에 대한 고려와 이익집단과의 관계에서 통과와 저지의 공을 주장하려는 의도에서 정당 간 대립이 나타나기도 했다. 하지만 입법과정이 본격화되고 상원에서 안데스 산맥 국가들에 대한 무역특혜협정, 무역조정지원과 포괄법안의 형태로 입법되는 것으로 논의되면서 양당의 지도부는 의회가 미국의 전반적인 무역정책의 수립에 어떻게 개입해야 하는가에 대한 고민을 시작했다. 의회는 무역개방이 필요하다는 방향성에는 전반적으로 동의하고 있었고 WTO Doha Round가 임박해오고 있는 상황에서 행정부에 권한을 위임하지 않았다가 미국의 무역과 경제 상황이 악화된다면 그에 대한 책임을 온전히 부담해야 하기 때문에 무역증진권한의 입법을 통해 책임을 공유할 필요가 있었다. 이 경우 직접적인 권한 행사 주체는 행정부이기 때문에 실패했을 때는 행정부에 책임을 전가할 수 있는데다 권한의 위임범위와 재량권을 더욱 축소하고 적극적으로 개입해 무역 정책을 수립할 수 있기 때문에 의회의 입장에서는 결과에 대한 직접적인 책임을 회피할 수 있다. 동시에 절차의 적용 요건을 강화하고 감독기구를 늘리고 등의 조치를 통해 협상과정에 의회가 능동적으로 개입할 수 있는 통로를 확대하고, 행정부가 의회의 의사와 반하는 협상을 할 여지를 줄이기 위해 재량의 범위를 제한했다. 하지만 2002년 무역법에서 의회의 무역정책수립에 대한 적극적인 개입 의지가 가장 강하게 드러난 부분은 주도적으로 무역개방으로 인해 피해를 입은 부문에 대한 보상정책을 수립했다는 점이다. 무역조정지원에서 규정한 정책들은 분배정책적인 특성으로 인해 수혜자들에게 공을 주장하기는 쉽지만 비난을 받거나 실패할 확률은 낮기 때문에 의회의 입장에서는 헌법상 수임기관으로서 무역정책을 적극적으로 수립하는 의무를 다하고 있다고 주장하기에 효과적인 조치였다. 의회는 이처럼 무역조정지원 법안을 통해 적극적으로 개입해 직접 무역정책을 수립하고 무역협정체결과정에서 개입을 증대하는 동시에 권한을 위임하지 않았을 경우 WTO Doha Round에서 미국의 협상지위 약화로 미국의 무역과 경제 상황이 악화될 수 있다는 우려 때문에 개입의 정도를 자제하고 행정부에 직접적인 무역협정체결권한을 위임하는 내용의 무역증진권한을 입법한 것이다. ; The purpose of this study is to analyze the dynamics of legislating the Trade Act of 2002 which granted Trade Promotion Authority, previously called fast-track negotiating authority, to the President of the United States focusing on the relations between the executive and Congress. Fast-track procedures were set forth in the Trade Act of 1974, stipulating that once the president formally submits a bill implementing a trade agreement concerning non-tariff barriers, both houses must vote on the bill without any amendments or filibusters. Being continuously in effect for 30 years, they have acted as a principal procedural mechanism for enacting trade agreements since 1970's. As the bipartisan consensus on free trade was eroded by the emergence of social issues like labor and environment in trade talks, however, they expired in 1994 due to failure to reach an agreement on how these issues should be handled. In 2002, a long and enthusiastic debate in both houses finally ended and the procedures were restored after a 8-year hiatus during the Bush presidency. If that is the case, in what circumstances was it possible for president Bush to regain the authority that president Clinton failed to win? The existing studies which conducted a comparative analysis on the roll-call voting that took place in 1997 and 2001 pointed out that representatives' consideration of constituents including pressure from interest groups and divided government had a noticeable effect in the different consequences. But besides these two, the respective members and party, a motive to reinforce the legislative branch as an institution has a impact on the behavior of Congress. This study aims to propose an explanation focusing on the third dimension from a view of interbranch politics. Then, responding to both domestic and international economic condition, demand from interest groups and constituents, and request from the executive branch, Congress approved the measure as a consequence of reflecting the intention to improve its status by increasing engagement with the process of decision making in the executive branch and minimize the loss such as the blame from the public or decrease in support accompanying failure of certain policy at the same time. In the early stage of legislation congressmen's consideration of constituents for winning reelection and partisan rivalry prevailed as other studies predicted. But as the actual legislative process progressed, the situation changed. With the Senate Democrats insisting on enactment of the omnibus trade bill incorporating TPA and two other bills, Andean Trade Preference Act and Trade Adjustment Assistance, concern over how Congress should engage with the establishment of generic trade policy spread throughout the party leaders. Congress agreed with the executive branch on the need of trade expansion and delegating the power to negotiate trade agreements for imminent WTO Doha Round because it would make them share the responsibility for possible deterioration in economy and trade in the future. The fact that the direct agent of exerting the authority was the executive branch had Congress make up its leeway as it could shift all the blame onto the other branch. Furthermore, when the economy got worse Congress could curtail the limit of the delegation and discretionary power given to the executive and establish trade policy firsthand. Delegating the authority, Congress expanded the means to actively involve in negotiating process by reinforcing its role of oversight, downsizing the discretionary power to prevent the executive from concluding the agreement despite congressional opposition, and tightening up the conditions to meet for the application of the fast-track procedures. But the most impressive part of the Trade Act of 2002 is TAA which reflected Congress's intension to play a leading role in making compensation policy for the people who got injured by trade. In conclusion, a broad agreement that TPA should be extended spread over Congress as it would consolidate the firm standing of the United States in trade talks including the upcoming WTO Doha Round. Moreover, Congress did not want to take full responsibilities or blame for the potential deteriorating economy. But at the same time Congress wanted to increase its engagement with trade policy making with the authority originally given to it by Constitution and its grown capabilities. The effort to restore the fast-track negotiating authority; TPA during the Bush presidency was feasible as it was linked to TAA bill, a measure taken by Congress to expand its involvement in trade policy making, and some steps to increase its engagement with the process of negotiation were taken. In other words, the Trade Act of 2002 was legislated as a result of Congress' struggle to balance between two motives, desire to avoid blame and increase its engagement with policy making. ; Master

Bearing in mind the distinctive features of prepetition claims and postpetition claims where the former are generally classified as insolvency claims subject to restrictions as per insolvency procedures while the latter as administration claims granted the rights to be paid irrespective of insolvency procedures, one may well assert that the actual amount of realized payment will consequently be different by a significant margin. Thus, it does matter to classify straddle claims before and after the order for relief. In South Korea, the part-fulfillment test(일부구비설) is widely accepted as a common view. In pursuant to the part-fulfillment test, once a particular debt in question is affirmatively established as insolvency claims, other claims that do not fall into the category of insolvency claims but nevertheless fulfill the requirement of administration claims are deemed administration claims. Even if the claims are unliquidated, contingent, unmatured, disputed, they can be classified as insolvency claims when the significant part of the claims are fulfilled prepetition. It seemingly is due to the reception of the Japanese insolvency acts which has eventually resulted in South Korean insolvency frameworks adopting the relevant Japanese legal theories and precedents that developed on the basis of the part-fulfillment test. But the word 'the significant part of the claims' is too vague to establish a clear and consistent criterion. Among the cases of the Supreme Court of South Korea, some cases contradict each other. In Japan, a scholar following the part-fulfillment test even admits that the test has its defects as some cases of the Supreme Court of Japan are inconsistent. The 'theory of deduction(控除説)' in Japan, based on the study of history of theories about classifying claims, criticizes the present common view in Japan, the part-fulfillment test, and suggests that the claims subject to insolvency risks be insolvency claims and the claims free from insolvency risks be administration claims. It may sound like a tautology, but it pinpoints that the present part-fulfillment test is far from realizing the essence of treatment and disposition of claims, using the word 'the significant part of the claims'. However, the theory of deduction also leaves much to be desired to set a clear and consistent criterion. In the United States, timing problems of claims in insolvency have been an important research theme, making use of a substantial balancing test. Thus, the arguments in the United States serve as a good reference. The theories of the United States do not apparently dichotomize, but virtually distinguish contractual claims from non-contractual claims. When it comes to contractual claims, the claimants voluntarily enter the contracts considering insolvency risks, so it is easy to determine whether the claimants bear the insolvency risks in accordance with their intention. In contrast, as of non-contractual claims, the claimants often get the claims involuntarily. It is hard to determine, based only on the claimants' intention, whether they should be burdened with insolvency risks. Therefore, dichotomy is desirable. In case of contractual claims, almost all federal courts of appeals and scholars adopt the performance test in the United States. As of non-contractual claims, there are the accrued state law test, the conduct test, the relationship test, and the fair contemplation test in the United States. Most of federal courts of appeals follow the relationship test, while most of scholars support either the conduct test or the fair contemplation test. For contractual claims, including the ones based on executory contracts, we can accept the performance test as it is. The part contributed to a debtor prepetition by a claimant abandoning exceptio non adimpleti contractus is subject to the insolvency risks and should be treated as insolvency claims. The part induced to do business with a debtor postpetition is beneficial for the estate and thus should be treated as administration claims. For efficiency, prepetition claims should be cut off from post-insolvency as sunk costs, while postpetition claims should receive priority to induce entities to enter new business with a debtor so as to foster reorganization. In case of non-contractual claims, it is hard to tell whether the claims are supposed to bear insolvency risks or not. It is a matter of policy. Unless it is the case where Debtor Rehabilitation and Bankruptcy Act in South Korea excludes explicitly the non-contractual claims from insolvency claims, prepetition claims should be classified as insolvency claims and postpetition claims administration claims. While the meaning of 'claims' for insolvency is defined in a unique sense under the United States Bankruptcy Code so as to put a great weight on that specific point of time, Debtor Rehabilitation and Bankruptcy Act in South Korea yet omits to define the meaning of 'claims' for insolvency, making it unnecessary to be obsessed with as to when a claim arises. For insolvency in South Korea, I hereby propose the relationship test that does not stick to the point when a claim arises. Rather, I suggest a more flexible solution that allows bifurcation of claims. If the part of the claim occurring before the order for relief creates a relationship, such as contact, exposure, impact, or privity, between the claimant and the debtor, then the part of the claim is insolvency claim. At the same time, the purposes of the acts on which the claim is based, the entity benefitted by the expense, and so forth, should be considered. Prepetition claims should be cut off to encourage a fresh start of the debtor, but that does not mean that the debtor is free to commit torts or gain unjust enrichments. Though it is quite theoretical, postpetition claims that the claimant gains involuntarily because the debtor fails to block a relationship between them should be treated as administration claims so that the estate shoulders the expense. As a result, insolvency can proceed with efficiency and equity. The representatives and the social insurance programs for future claimants can satisfy due process concerns. Background Low-quality services of emergency medical institutions, unclear function of institution classification, and overcrowding of emergency departments (ED) of regional emergency medical centers (regional centers) have been major problems in the Korean emergency medical services system (EMSS). In 2015, the Middle East Respiratory Syndrome (MERS) outbreak spread from patients waiting for hospitalization in the overcrowded ED. The MERS outbreak was an event that revealed the vulnerability of EMSS and opened the policy window to solve the problem of EMSS in Korea. Several policies for EMSS improvement were implemented after the 2015 MERS outbreak focusing the improvement of emergency medical services (EMS) delivery system and ED infection control. This study investigates the policy processes for improving emergency EMSS and infection control program after the MERS outbreak. The purpose of this study was to examine the policy processes regarding EMSS from the view of policy actors and draw lessons for improving the EMSS in Korea. 2. Methods A mixed method was utilized to identify and explain the complex subject of the policy processes of Korean EMSS during and after the MERS outbreak in 2015. As a quantitative study, changes in EMSS after MERS were investigated according to the WHO's model of a national health system infrastructure. Literature review and data analysis of Korean Health Insurance Service (NHIS) database were conducted. In Korea, the NHIS covers all citizens. A quantitative analysis was performed on 16,965,755 cases using ED during 2014-2016. In-depth interviews were conducted on 30 experts, who were involved in the emergency medical policy process, including clinicians, policy experts, and hospital management experts. The total interview time was 55 hours and 4 minutes. Changes in EMSS and the policy process after the MERS outbreak were evaluated from the view of policy actors. In this study, quantitative data was interpreted qualitatively, and independent qualitative evaluation was conducted, as well. Therefore, this research is a mixed-methods study focusing on qualitative research. SAS version 9.4 was used for the quantitative analysis and NVivo 12.0 was used for the qualitative analysis. 3. Results The quantitative analysis results showed that in the area of EMS delivery system, the human resource of ED and number of regional centers have been increased and facility, equipment, and manpower standards have been revised in order to expand emergency medical resources. As a result, the number of medical personnel and emergency intensive care units in regional centers increased and profitability of ED improved as well. The number of monthly ED visits temporarily decreased during the MERS outbreak but then recovered afterward. As ED overcrowding indicators were emphasized in the evaluation of EMS institutions, monthly mean ED length of stay of regional centers was decreased. However, despite the emphasis on providing critical care, transfer rate of severe emergency patients was not decreased. In the policy processes of EMS, experts evaluated that EMS delivery system was set up as a pseudo-agenda and exploration and comparison of policy alternatives were not sufficiently carried out. As a result, the physicians did not comply with the policy implementation and policy goals were not achieved. In the area of ED infection control program, the human resources for infection control and the number of isolation unit of ED were increased. Budgets for emerging infectious disease management were increased and profitability of infection control was also improved. The EMS Act was revised to respond to emerging infectious diseases and indicators related to infection control were strengthened in evaluation of EMS institutions. In the qualitative research, experts said that since the ED infection control program was such an intuitive and obvious problem, it was easy to become a policy-agenda. Despite the resistance of small hospitals, ED infection control program was implemented by powerful policy measures such as the revision of the Law. As a result, policy goals of expanding the infection control resources and improving the infection management environment were able to be achieved. From results of observing EMS policy process, the following characteristics of policy actors were found. First, there was difference of opinions within the physician subgroup as well as between government and medical professionals. ED staff, other department staff, and hospital executives, who have different views on policy alternatives could have all served as veto points in the policy process. Second, while the EMSS expert organization, which was an unofficial participant in the emergency medical policy process, could have played both roles of cause group and sectional group in the policy process, their sectional position has been emphasized, thereby weakening their insider status during policy process. Third, policy actors understood the publicness of EMS differently in terms of its ownership and function. The ED staff insisted that government support is needed because emergency medical care is based on public interest, however, some staffs were unwilling to provide less profitable cares, leading to conflict. Main characteristics of the emergency medical policy process that made it difficult to successfully implement are as follows: First, there was lack of consideration regarding variation of EMSS in Korea, such as distribution of medical resources among different regions, incentives to hospitals, and understanding of functional variations in ED. Second, the problem of the EMS delivery system was a problem of the low quality of emergency medical care. Third, the lack of professionalism in some physicians has lowered the capacity of emergency medical care, as well as trust between patient and doctor, therefore made the problem more difficult to solve. 4. Discussion Based on the analysis of the policy processes of the EMSS after the MERS outbreak in Korea, following lessons are suggested. First, setting the goals of EMS from the perspectives of citizen is warranted. The final performance goal should focus on improving health status of citizen and satisfaction with emergency medical care. Second, to close the gaps among policy actors in understanding policy content and policy process, actors should work together to explore the root causes of the problems and establish a policy agenda together. Third, a policy alternative should be causal in solving the problems in EMSS considering variation of EMS. Fourth, compliance with policies could be secured by internal persuasion among policy actors with proper incentives and reasonable punishment, especially EMSS expert organization. Fifth, policy outcomes should be evaluated based on both policy output and side effects together to identify policy impact. Sixth, policy governance regarding EMSS should be established and the roles of EMSS expert organization should be strengthened as the cause group rather than sectional group. This study examined the emergency medical policy processes from the view of policy actors through the 2015 MERS outbreak in Korea. The improvement of EMSS should be based on understanding of the emergency medical policy process and policy actors. ; 1. 서론 응급의료기관의 응급환자 진료 역량부족과 불명확한 종별 기능 구분, 일부 응급실의 과밀화는 한국 응급의료체계(emergency medical services system, EMSS)의 고질적인 문제였다. 2015년 과밀화된 상급종합병원 응급실에서 입원대기 중이던 환자로부터 메르스(Middle East Respiratory Syndrome, MERS) 유행이 확산되었다. 메르스 유행은 우리나라 응급의료체계의 취약성이 드러난 사건이자 응급의료 문제를 해결할 수 있는 정책의 창이 열린 사건이었다. 정부는 메르스 유행 이후 여러 가지 응급의료 개선정책을 추진하였다. 이 연구는 취약한 응급의료 전달체계 하에서 응급환자 감염관리의 실패로 인해 메르스 유행이 발생했다는 점에 문제의식을 두었다. 그래서 응급의료 전달체계와 응급환자 감염관리 영역에서 메르스 유행 이후 이루어진 정책과정과 그로 인한 변화를 분석하였다. 응급의료 정책행위자의 관점에서 정책과정과 정책결과를 분석함으로써, 향후 응급의료 개선을 위한 정책과정에서 고려해야 할 점을 도출하는 것이 이 연구의 목적이다. 2. 연구방법 메르스 유행 이후 응급의료 정책과정 분석이라는 복잡한 주제를 파악하고 설명하기 위하여 혼합연구방법(Mixed methods research)을 사용하였다. 양적연구로 문헌고찰과 국민건강보험공단 자료 분석을 통해 메르스 유행 이후 응급의료체계의 변화를 보건의료체계의 구성요소별로 조사하였다. 한국은 1989년 전국민 의료보험제도를 도입하여 전 국민이 국민건강보험에 가입되어 있는 국가이다. 메르스 유행 전후 응급실 이용 변화를 조사하기 위하여 국민건강보험공단 DB의 2014-2016년 응급실 이용 진료건 16,965,755건을 분석하였다. 질적연구로 응급실 의료진, 정책 전문가, 병원 경영진 등 응급의료 정책과정의 관련 전문가 30명을 대상으로 심층면접을 수행하였다 전체 심층면접 분량은 55시간 4분이었다. 심층면접을 통해 정책 행위자의 관점에서 메르스 이후 이루어진 응급의료 정책과정을 고찰하고, 응급의료체계의 변화를 조사하였다. 양적연구 결과를 질적연구로 해석하고 질적연구로 독자적인 분석을 수행하여, 이 연구는 질적연구가 중심이 된 혼합연구로 볼 수 있다. 양적연구의 분석에는 SAS version 9.4를 사용하였고, 질적연구 분석은 NVivo 12.0을 사용하였다. 3. 연구결과 응급의료 전달체계 영역에서 응급의료 자원을 확대하기 위해 권역응급의료센터(권역센터)가 확대되고 시설·장비·인력기준과 관련 수가가 개정되었다. 그 결과 권역센터의 의료인력과 응급중환자실 병상 수가 증가하고 수익성이 개선되었다. 달빛어린이병원 사업을 확장한 결과 달빛어린이병원 수도 증가하였다. 응급실 과밀화를 완화하기 위해 응급의료기관 평가에 재실시간 지표를 수가연동지표로 도입하고 응급의료에 관한 법률에 응급의료센터 24시간 이상 재실환자 관리 규정을 넣었다. 그 결과 응급실 월별 방문환자 수는 2015년 메르스 유행 당시 일시적으로 감소한 후 지속 증가 추세이나, 권역센터 응급환자의 월별 재실시간 평균은 2014-2016년 기간 동안 감소 추세를 보였다. 응급의료기관의 응급환자 진료역량을 강화하기 위해 응급의료기관 평가에 중증해당환자 최종치료 제공 관련 지표를 강화하였으나 2017-2018년 기간 중증응급환자의 전원율은 개선되지 않았다. 전문가들은 응급의료 전달체계 개선은 위장의제(pseudo agenda)로 설정되어 정책대안 탐색과 비교평가가 충분히 이루어지지 않았으며 점중주의적으로 쓰레기통 모형의 정책결정이 이루어졌다고 평가하였다. 그 결과 정책대상집단인 의사들은 정책집행에 순응하지 않았고, 정책은 집행 후에도 정책목표를 달성하지 못했다. 응급환자의 감염관리 영역에서 권역센터 시설·장비·인력기준과 감염관리실 설치기준 및 인력기준이 개정되어 응급실 감염관리 자원이 확대되었다. 정부는 응급실 방문객 관리를 도입하고, 감염예방관리료 등 감염관리 관련 건강보험 수가를 신설하였으며, 신종감염병 대응 관련 법률 등 감염관리 관련 법률을 개정하여 응급실 감염관리 여건을 개선하였다. 전문가들은 응급환자 감염관리는 직관적이고 명확한 문제라는 특성이 있어 병원 내 감염관리 강화로 의제화되기 쉬웠다고 평가하였다. 감염관리 개선정책은 보호적 성격을 가진 규제정책으로 집행 과정에서 중소병원을 중심으로 일부 병원의 반발이 있었다. 그러나 응급의료에 관한 법률 개정과 같은 강력한 정책수단을 사용하여 집행된 결과, 응급실 감염관리 자원확대와 감염관리 환경개선이라는 정책목표를 달성하였다. 응급의료 정책행위자들의 관점에서 응급의료 정책과정을 관찰한 결과 다음과 같은 정책행위자의 특징을 발견하였다. 첫번째, 정부 전문가와 의료진 전문가 사이뿐 아니라 의사 하위집단 내에서도 견해 차이가 존재하였다. 정책대안에 대해 다른 견해를 가지고 있는 응급실 의료진, 배후진료과 의료진, 병원 경영진은 정책과정에서 모두 거부점(veto point)으로 작용할 수 있었다. 두번째, 응급의료 정책과정의 비공식적 참여자인 응급의료 관련 전문학회는 정책과정에서 대의집단이자 파벌집단의 역할을 동시에 수행할 수 있으나, 정책과정에서 파벌집단의 역할이 강조됨으로써 내부자의 지위가 약화되었다. 세번째, 응급의료의 공공성에 대하여 소유주체 기준에 따른 공공성과 기능에 따른 공공성 개념이 혼재되어 사용되며 서로 다른 공공성 개념에 따른 정책행위자간 갈등이 발생하였다. 응급실 의료진은 응급의료가 공공의 이익을 실현하는 의료영역이므로 정부 지원이 필요하다고 주장했으나 일부 의료진은 수익성이 낮은 진료를 기피하는 모습을 보여 정부 전문가와 의견 차이를 보였다. 응급의료 정책과정의 성공적 추진을 어렵게 한 정책과정의 특징은 다음과 같다. 첫번째, 응급의료 정책과정에서 지역간 의료자원 분포, 병원에 작용하는 유인, 병원 내 응급실의 역할과 같은 응급의료에 존재하는 변이에 대한 고려가 부족했다. 두번째, 응급의료 전달체계 문제는 곧 응급의료기관의 취약한 응급환자 진료 역량의 문제였다. 세번째, 일부 의사들의 전문직업성(professionalism) 부족이 응급의료기관의 응급환자 진료 역량을 취약하게 하고, 환자-의사 사이 신뢰를 저하시켜 대형병원 쏠림현상을 악화시켰다. 4. 고찰 메르스 유행 이후 이루어진 응급의료 개선정책의 정책결과 분석과 정책과정에 대한 연구 결과를 근거로 하여 향후 응급의료 정책과정에 대하여 다음과 같이 제언한다. 첫번째, 국민의 관점에서 응급의료체계의 개선목표를 설정할 필요가 있다. 건강수준 향상과 응급의료 서비스에 대한 만족도 향상이라는 최종 성과목표가 개선정책의 목표로 설정되어야 한다. 두번째, 정책행위자의 인식 차이를 좁히기 위하여 여러 행위자가 함께 문제의 원인을 탐구하고 정책의제를 설정하는 과정이 필요하다. 세번째, 문제 해결에 인과성 있는 정책대안이 결정되어야 한다. 인과성 없는 정책대안은 정책이 집행되어도 정책문제를 해결하지 못한다. 네번째, 정책대상자의 순응을 확보할 필요가 있다. 유인과 처벌 이전에 전문가이자 정책대상자인 의사들에 대한 내면적 설득 과정이 필요하다. 다섯번째, 정책산물과 부수작용을 포괄하는 정책결과 평가가 필요하다. 여섯번째, 응급의료 정책 거버넌스를 확립하고 응급의료 관련 전문학회를 정책과정에 참여시켜 대의집단의 성격을 강화할 필요가 있다. 이 연구는 2015년 메르스 유행이라는 사건을 통해 응급의료 정책행위자들의 관점에서 우리나라 응급의료 정책과정을 고찰하였다. 응급의료 정책과정과 정책행위자에 대한 이해를 바탕으로 응급의료체계 개선을 추진해나가야 한다. ; I. 서 론 1 1. 연구 배경과 필요성 1 1) 한국 응급의료체계의 문제 1 2) 2015년 메르스 유행과 응급의료체계 4 3) 연구의 필요성 6 2. 연구 목적 10 II. 이론적 배경 12 1. 보건의료체계의 평가 12 1) WHO 보건의료체계의 구성요소 12 2) 보건의료체계 개혁을 위한 조종손잡이 14 2. 정책론 18 1) 정책과정의 이해 18 2) 응급의료 정책과정의 이해 25 III. 연구방법 35 1. 혼합방법 연구설계 35 2. 양적연구 방법 43 1) 양적 연구의 자료 수집 43 2) 양적 연구의 자료 분석 46 3. 질적연구 방법 54 1) 연구팀 구성 54 2) 심층면접 설계 55 3) 분석 방법 67 4. 혼합방법 연구의 통합 70 IV. 연구 결과 72 1. 양적연구 결과 72 1) 응급의료 전달체계 72 2) 응급환자의 감염관리 121 2. 질적연구 결과 134 1) 심층면접 참여자의 특성 134 2) 응급의료 전달체계 137 3) 응급환자의 감염관리 249 3. 연구결과의 종합 297 1) 2015 메르스 유행의 응급의료체계에 대한 의의 297 2) 메르스 유행 이후 응급의료 정책과정 분석 298 3) 응급의료 정책과정의 특징 340 V. 논의 363 1. 응급의료 정책과정 고찰 363 2. 연구의 한계 380 3. 연구의 의의 383 1) 방법론적 의의 383 2) 정책적 의의 384 4. 연구의 결론 385 1) 메르스 유행 이후 응급의료 전달체계와 응급환자 감염관리의 변화 385 2) 응급의료 정책과정 고찰 386 3) 응급의료체계 개선을 위한 정책과정에의 시사점 388 VI. 참고문헌 390 ; Doctor
