Introduction. The experience of state regulation in resource management issues proves that the executive authorities do not provide a sufficient level of influence on the efficiency of use of resources by economic entities. The main objectives of these bodies are to implement public policies to ensure economic growth in the sector or region concerned. However, the issue of resource management by these bodies is not sufficiently addressed. That is why the issue of researching the regulatory framework in the field of resource management is quite relevant today.Purpose. The purpose of the article is to identify and analyze the main indicators of resource efficiency of Ukraine, to compare these data with indicators of other countries of the world, to systematize the legal framework governing the issue of resource management at the micro and macro levels both in Ukraine and in the leading countries of the world.Results. The analysis of energy intensity indicators of GDP of Ukraine and other countries of the world, which have minimum and maximum values of this indicator, calculated the growth rate in recent years, graphically shows the dynamics of this indicator relative to the global average. In addition, the dynamics of energy production and consumption indicators in Ukraine for the years 2010-2018 was determined. As a result of this study, Ukraine was found to be ranked 1st in the world in terms of GDP energy intensity. The leaders in GDP energy intensity are also Russia, Kazakhstan, Canada, etc. The lowest rate is observed in EU countries as well as Turkey and Japan. One of the important means of reducing the state's resource dependency and improving the efficiency of resource use is state regulation. In today's economic context, the need to improve the current regulatory framework becomes even more important. That is why the article focuses on the study of the regulatory framework in the field of regulation of resource conservation management in Ukraine and EU countries, as these countries have the best indicators of GDP energy intensity.Originality. The influence of regulatory support of issues of resource saving management on the state resource efficiency indicators has been determined. The legal and regulatory framework of Ukraine and other countries of the world was generalized and compared. Deficiencies in the legal support that exist in Ukraine have been identified.Conclusion. Ukraine is the leader in terms of GDP energy intensity. In addition, there is a significant shortage of energy resources, which weakens the country's energy security. Ukraine does not provide a systematic approach to addressing resource management issues. The problems of resource efficiency, which are key in the implementation of the policies of many developed countries of the world, have not been the subject of constant attention at the state level in our country. The EU, Japan, and the US, with impressive energy-saving success, have focused on more complex tasks - implementing resource efficiency programs that have led to a gradual decline in resource consumption and GDP. In addition to government regulation, the overall state of resource conservation and resource efficiency is also significantly influenced by corporate policy in this area of individual entities. For all enterprises trying to implement an effective resource management and resource-saving development policy, it is important to create an organizational and economic mechanism for managing the resource-saving development of the enterprise, which includes the regulatory framework governing these issues. Therefore, prospects for further scientific research are to create an effective organizational and economic management mechanism in the direction of resource saving and resource-saving development of the enterprise.
The purpose of the article is based on the analysis of the legislative and regulatory documents and modern practice of the research and pedagogical workers' professional development to identify the trends of its implementation and to study out the compliance with its real state to the norms set out in the state documents. Methodology. The methodological basis of the study is a system approach. The main research methods: the analysis of the legislative acts, regulations, study of the current state of the research and pedagogical workers' professional development in the universities of Ukraine, comparison, generalization, systematization of theoretical and empirical data, terminological analysis, content-analysis. Scientific novelty. The article deals with topical issues of securing the rights of the passenger. As violations of this kind of rights are frequent and the means of protection of their rights, except for air transport, are virtually absent under the transport law of Ukraine, except for the possibility of compensation for non-pecuniary damage, the presence and amount of which is determined by court procedure, there is an urgent need to determine and regulate this civil rights, how it is under EU law on new civilizational approaches; securing regulatory safeguards to enforce and exercise their rights. The authors conclude that according to the legislation of Ukraine there are practically no guarantees for the exercise of the rights of the passenger, which is unacceptable at this stage of civilization development. As the mechanism for securing this kind of civil rights under EU law, which is based on the concept of creating a competitive environment, regulating and securing the rights of passengers, establishing negative consequences for the carrier in the event of a violation of the passenger's rights in the form of compensation amounts, despite the fact that he is debatable and imperfect, however, it can be implemented into the national legislation of Ukraine. In addition to the right to require the carrier to deliver it to its destination, the basic rights of the passenger must be legally enshrined and guaranteed: security, human rights, mobility, non-discrimination, assistance in transportation, accessibility, full and reliable information, on the use of remedies, on compensation in case of violation of rights, etc.

The Program carries out modernization of air transport infrastructure, certification of airports taking into account the legislation of the European Union, Eurocontrol documents, Standards and recommendations of the International Civil Aviation Organization ICAO. One of the most important elements of the airport's infrastructure is its coverage, designed for takeoff and landing of aircraft - the runway, taxiing - taxiways and aircraft parking lots. The safe transportation of passengers and cargo largely depends on their condition, and especially on the condition of the runway coverage. Therefore, it is necessary to constantly monitor the condition of aerodrome surfaces. It is necessary to know the requirements for the qualitative and quantitative characteristics of airfield surface defects to choose one or another method of geodetic monitoring. The latest open access publications, which are devoted to the regulatory requirements for the equality of aerodrome surfaces, which were applied to the introduction of the current regulatory document were considered. The search for regulatory documents on the equality of aerodrome coverage led to the current certification requirements for aerodromes of Ukraine, dated 22.09.2020. The main purpose of this article is to analyze the current regulations of Ukraine and ICAO on the characteristics of the equality of aerodrome coverage. The current order of the State Aviation Service of Ukraine №1346 dated 22.09.2020 on certification requirements for civil aviation aerodromes in relation to aerodrome surfaces is considered. The part of the document on coating defects sets quantitative requirements for these defects for the runway, taxiways, aircraft parking areas, platforms, sidewalks, the ground part of the airfield. These requirements overlap with similar requirements of the previous regulatory document. The technology for determining meso-irregularities of the soil field using a level instrument is presented. The other part of this document discusses the quantitative requirements for the equality of the hard surface of the runway in accordance with the requirements of ICAO. As a result of the analysis of the current normative document on aerodrome certification in terms of aerodrome coverage requirements, qualitative and quantitative characteristics of defects are grouped in tabular form: artificial and soil runways, taxiways, parking lots and airport platforms. There is a discrepancy between the allowable value of the excess between the faces of adjacent slabs of the runway pavement, which is 25 mm and 17.5 mm, specified in the part of the document that meets the ICAO requirements for the equality of aerodrome surfaces. The regulatory provisions for forming and developing capable territorial communities are analyzed, the content of problems that need legislative solutions for the successful continuation of reforms is determined. Directions and measures of improvement of regulatory provisions for forming capable territorial communities are outlined.Problem setting. The concept of reforming of local self-government and territorial organization of power in Ukraine was approved by the order of the Cabinet of Ministers of Ukraine № 333-r dated April 01, 2014 and aimed at the effective reform of local self-government. The implementation of the Concept implies strengthening of the legal, organizational and material capability of territorial communities, able to solve issues of local importance.The adoption of regulatory provisions on ensuring the process of formation of capable territorial communities within the framework of implementation of the Concept of reforming of local self-government and territorial organization of power in Ukraine allowed to intensify the reform implementation. Practical steps towards implementing the reform have shown that there is a number of problems that need legislative resolution.Recent research and publications analysis. The issues of territorial organization of power, the formation of effective local self-government and the research of legislative provisions on the formation of united territorial communities were considered in the works by such native scientists as M. Baimuratov, O. Batanov, I. Drobot, V. Kampo, A. Kovalenko, V. Kuibida, V. Mamonova, M. Pukhtinsky, O. Sushinsky and many others. Highlighting previously unsettled parts of the general problem. The contribution of the researchers mentioned above is significant, but special attention should be paid to the need for the further research in this field. The purpose of the study is the analysis of the regulatory provisions on the formation of united territorial communities, the identification of problems that need the improvement of legislative provisions.Paper main body. Based on the fact that the local self-government system does not meet the needs of the society at present, the reform of local self-government through decentralization has been in Ukraine since 2014.The reasons for the started reform were:– the resource failure of the vast majority of local governments to exercise their own and delegated powers;– worsening demographic situation in most territorial communities;– excessive centralization of powers of executive authorities and distribution of financial resources;– resolving issues in the field of land relations without involving territorial communities.The tasks to be solved in the process of decentralization were outlined in the Concept of reforming of local self-government and territorial organization of power in Ukraine, approved by the order № 333-r of the Cabinet of Ministers of Ukraine on April 01, 2014.The Sustainable Development Strategy "Ukraine – 2020", approved by Presidential Decree № 5/2015 dated January 12, 2015, reaffirmed the importance of implementing a local self-government reform through decentralization and included it to the top priority.The important regulatory acts were adopted during 2014 – 2015 regarding the voluntary association of territorial communities. These are the Laws of Ukraine "On Cooperation of Territorial Communities", "On Voluntary Association of Territorial Communities" as well as the Methodology of forming of capable territorial communities approved by the Resolution of the Cabinet of Ministers of Ukraine № 214 dated April 08, 2015.The key legislative acts "On Amendments to the Constitution of Ukraine (on Decentralization of Power)" and "On the Principles of Administrative and Territorial System" have not been adopted by the Verkhovna Rada of Ukraine yet.Taking into account the incompleteness of adopting of amendments to the Constitution of Ukraine (regarding the decentralization of power), other laws, the shortcomings of the current regulatory provisions on implementing the local governmental reform and territorial organization of power in Ukraine, and the lack of certainty of further reforms, it seems doubtful to accelerate the voluntary association of territorial communities.Conclusions of the research and prospects for further studies. Based on the fact that the development of local self-government in Ukraine did not meet the requirements of the time, the process of local self-government reform through decentralization was initiated in Ukraine in 2014.The tasks that need to be solved in the process of decentralization were outlined in the Concept of reforming of local self-government and territorial organization of power in Ukraine approved by the order № 333-r of the Cabinet of Ministers of Ukraine dated April 01, 2014, and the Plan of actions for implementing the Concept dated June 18, 2014.Considering a number of objective reasons for the aggression of the Russian Federation, the implementation of stages of the reform was not fully fulfilled. In previous years, less than half of the territorial communities was united, which casts doubt on the completion of the unification process in 2020. The adoption of amendments to the Constitution of Ukraine (on the decentralization of power), the submission and consideration of all necessary regulatory acts is a long process that will also affect the timing of the reform completion. The further analysis and research require regulatory provisions on the problem of decentralization that have already been adopted and will be adopted by the Verkhovna Rada of Ukraine in a new convocation in future. ; Проаналізовано нормативно-правове забезпечення формування та розвитку спроможних територіальних громад. The corruption criminal court is an institution that is given the authority to examine and decide corruption cases. The purpose of this study was to determine the juridical implications of the principle of the independence of the judicial power. This study uses a normative approach with quantitative analysis. The existence of a corruption court established on judicial power states that a special court can only be formed by a separate law. Then the corruption court is an institution that has the authority to examine and decide corruption cases. In its implementation, the composition of judges in the corruption court is divided into two, namely career judges and ad hoc judges. In its implementation, there are several things in the legislation that are contrary to the principle of independence of judicial power and violate the principle of freedom of judicial power, especially for ad hoc judges in the criminal court of corruption.
The article is devoted to the study of the state of regulatory support in the field of waste management in Ukraine and the search for proposals to improve national legislation, which is an indicator of national security at both environmental and economic levels.Also, the scientific article provides a detailed analysis of legislation in the field of waste disposal in Ukraine and examines the impact of legal doctrine on the development of national legislation in this area.As for the improvement of regulatory support in this area, in the process of research we provide examples of already effective international standards, which as a result of their implementation in Ukraine have the opportunity to improve the situation in the field of waste management and disposal.Conducting research on the state policy of Ukraine in the field of waste management, it is determined that it is based on the principles of openness, accountability, transparency of public authorities; public participation in the formation of public policy; observance of ecological rights of citizens; encouragement to conduct environmentally responsible business and environmentally conscious behavior of citizens; prevention of environmental damage; international cooperation and European integration.It should be noted that the situation with waste disposal is uncontrolled, to confirm this there is a large number of illegal landfills, which is a threat of environmental catastrophe. The reason for this situation, in our opinion, is outdated, partially ineffective legislation and problems of implementation of European standards, which aim to regulate the legal basis in the field of waste management in Ukraine.Accordingly, the establishment of clear rules and the introduction of influential sanctions in case of their violation is a component of the ecological balance and economic development of the country.Keywords: waste disposal, landfills, environmental status, European integration ; Стаття присвячена дослідженню стану нормативного забезпечення у сфері поводження з відходами в Україні та пошуку пропозицій щодо вдосконалення національного законодавства, що є показником безпеки країни як на екологічному так і на економічному рівнях.Також, у науковій статті проведений детальний аналіз законодавства, у сфері утилізації відходів в Україні та досліджено вплив правової доктрини на розвиток національного законодавства у цій сфері.Що стосується вдосконалення нормативного забезпечення у цій сфері, то в процесі дослідження нами надаються приклади вже дієвих міжнародних норм, які внаслідок їх впровадження в Україні мають можливість поліпшити ситуацію у сфері поводження та утилізації відходів.Проводячи дослідження державної політики України в сфері поводження з відходами, визначено, що вона ґрунтується на принципах відкритості, підзвітності, гласності органів державної влади; участі громадськості у формуванні державної політики; дотримання екологічних прав громадян; заохочення до ведення екологічно відповідального бізнесу та екологічно свідомої поведінки громадян; запобігання екологічній шкоді; міжнародної співпраці та євроінтеграції.Варто відмітити, що ситуація з утилізацією сміття є не контрольованою, на підтвердження цього існує велика кількість не легальних сміттєзвалищ, що є загрозою для екологічної катастрофи. Причиною, даної ситуації на нашу думку є застаріле, частково не дієве законодавство та проблеми впровадження європейських стандартів, які мають за мету врегулювати правове підґрунтя у сфері поводження з відходами в Україні.Відповідно, встановлення чітких правил та запровадженим впливових санкцій в разі їх порушень є складовою екологічного балансу та економічного розвитку країни.Ключові слова: утилізації відходів,сміттєзвалища, екологічний стан, євроінтеграція
The formation of the modern Ukrainian natural gas market is accompanied by profound transformations of the national gas infrastructure: the creation and operation of new market operators, the redistribution of infrastructure facilities, the development and implementation of new requirements for the effective functioning of the entire system. At the same time, this requires from all parties a verified and balances strategy for the optimal implementation of all the obligations that Ukraine has undertaken to fully implement the requirements of the EU Third Energy Package, which aims to create an effective natural gas market based on the principles of free competition, proper consumer protection and security of supply. Despite the fact that the capacity of the Ukrainian gas transmission system and gas storages is one of the largest in Europe, the unbanding process has caused a number of threats in the area of regulatory support for production activities, requiring the consolidation of specialists' efforts to form optimal solutions to the problems that have arisen. In addition, the lengthy process of reforming and reorganizing the Ukrainian gas distribution system has led to a situation where the work of a natural gas distribution operator is facing a risk of imbalance in terms of inefficient standardization of the main areas of operation to meet the EU legislation requirements implemented in Ukraine. Therefore, to develop basic directions for the future work of gas infrastructure operators, it is necessary to take into account the acting capabilities of existing system for transportation, underground storage and gas distribution (taking into account the significant number of standardized indicators defined by the existing normative documents of the former USSR) and in accordance with the trends in the development of the European gas infrastructure introduce economically and technically feasible measures to standardize performance activities. Such works have to be incorporated into integrated research programs, during which regional and international trends are to be taken into account and adapted, the results of which will be the basis for future roadmaps and programs for the development of natural gas supply and distribution systems. ; Становлення сучасного українського ринку природного газу супроводжується глибокими трансформаціями національної газової інфраструктури: створення та діяльність нових операторів ринку, перерозподіл об'єктів інфраструктури, розроблення та впровадження нових вимог щодо ефектного функціонування всієї системи. Водночас це вимагає від усіх сторін зваженої та виваженої стратегії щодо оптимальної реалізації усіх зобов'язань, які взяла на себе Україна для повноцінної реалізації вимог Третього енергетичного пакету ЄС, метою якого є створення ефективного ринку природного газу на принципах вільної конкуренції, належного захисту прав споживачів та безпеки постачання. Не зважаючи на те, що потужності української газотранспортної системи та газосховищ є одними із найбільших в Європі процес анбандлігу спричинив ряд загроз у сфері нормативного забезпечення виробничої діяльності, які потребують консолідації зусиль фахівців для формування оптимальних шляхів розв'язання проблем, що виникли. Крім того, тривалий процес реформування та реорганізації української газорозподільної системи призвів до ситуації, коли робота оператора розподілу природного газу стоїть перед загрозою розбалансування у частині неефективного ведення робіт зі стандартизації основних напрямів виробничої діяльності щодо виконання вимог імплементованого Україною законодавства ЄС. Тому для розроблення базових напрямів подальшої роботи операторів газової інфраструктури необхідно враховувати існуючі можливості діючих систем транспортування, підземного зберігання та розподілу газу (враховуючи значну кількість нормованих показників, визначених ще чинними НД колишнього СРСР) і відповідно до тенденцій розвитку європейської газової інфраструктури планувати, організовувати та впроваджувати економічно та технічно доцільні заходи зі стандартизації виробничої діяльності.

The changes have created a more business-to-business like contracting methodology, via commercial item designation streamlined procedures, for the conduct of Federal procurements meeting specific criteria defined in statutory authority provided under the Federal Acquisition Streamlining Act (FASA), the Federal Acquisition Reform Act (FARA), and the Services Acquisition Reform Act (SARA). The aforementioned legislation allows for the utilization of Simplified Acquisition Procedures for all commercial item designated goods and services up to and including $5 million. The legislation was passed in order to improve the efficiency and effectiveness of Federal contracting processes. However, based on informal review of the business decision protocol at many acquisition and contracting centers, and as a result of similar research conducted in the Fall of 2004, contracting activities may not be effectively utilizing the legislative authority to garner efficiencies and effective service provision that may be possible under the new legislation. Objective: The objective is to determine the extent to which DoD activities are capitalizing on the legislative provisions of FARA, FASA, and SARA, and to make specific recommendations for improving the full utilization of the commercial item designation provisions. This objective is critical to contracting and acquisition commands (as well as those they support) to achieve reduced acquisition lead times, reduce transactional costs, and generally, garner efficiencies and effectiveness not possible without the legislative provisions.
