Explores the law of marital rape and arguments for at least a partial marital rape exemption; US. Arguments include implied consent, lack of harm, marital preservation, familial privacy, likelihood of abuse, and difficulty of proof.
In 1975 the House of Lords held that if a man believed a woman was consenting to intercourse he could not be found guilty of rape, no matter how unreasonable his belief (DPP v Morgan ). This may be regarded as part of the retreat from the theory of objective liability embraced in DPP v Smith (1966) but it is argued that it is an overreaction, that though defendants with unreasonable beliefs in consent may not intend rape, they are nonetheless reckless regarding consent, not merely negligent, as the Lords assumed. Incorporating an objective element in the standard of liability would not be a radical departure from the traditional mens rea doctrine. The Morgan decision is not likely to have a significant effect on conviction rates; other changes in the law are more important. Recent work on the jury system suggests juries are unduly influenced by the victim's behavior prior to the offense. An appropriate lesser offense giving explicit weight to factors like assumption of risk & contributory fault, might produce fewer unwarranted acquittals. An appendix discusses evidence that rape is subject to unusually high rates of unwarranted acquittals & convictions. AA.
Durch das neuste Album von K.I.Z Rap über Hass (2021) wird nicht nur innerhalb des HipHops vermehrt über Hass im Rap diskutiert, sondern auch in den Feuilletonteilen überregionaler deutschsprachiger Zeitungen. Dabei stellt sich die Frage, ob dieser Hass neu ist und welche Funktion er einnimmt. Und ist das, was im Rap als Hass bezeichnet und produktiv gemacht wird, überhaupt Hass oder viel eher Wut? Um diesen Fragen nachzugehen, wird untersucht, woher der Rap stammt, wieso dieser genuin politisch ist und welcher Zusammenhang zwischen dem Rap, dem Politischen und dem Hass überhaupt besteht. Anhand einiger deutschsprachiger Rap-Songs wird dargestellt, dass Hass als existenzielles Gefühl unter anderem eine grenzüberschreitende Wirkung hat und damit beispielsweise affirmativ, zur Lenkung von Aufmerksamkeit und zur Abgrenzung genutzt werden kann.

Der Beitrag untersucht die Sprecherposition des deutschen Gangsta-Rappers mit Migrationshintergrund aus kultursoziologischer Perspektive und lotet den inszenatorischen Spielraum des Subjekts in einem normativen Szenediskurs aus, der umschlossen ist von soziokulturell bedeutsamen, übergeordneten Diskursen. Gangsta-Rap wird als popkulturelle Bühne und umkämpfter Ort betrachtet, an dem sich die Protagonisten vor dem Hintergrund gesellschaftlich kursierender Stereotype und Zuschreibungen positionieren. In diesem Sinne interpretieren wir die bild- und textbasierten Inszenierungen als Produkte der Verhandlung von Kategorien wie Geschlecht, Ethnizität und Klasse. In ästhetisierter Form wirken die Performances auf die Gesellschaft zurück - mit dem Effekt einer polarisierenden Diskussion.

O presente artigo analisa como os rappers foram reunindo elementos, selecionando indícios, capturando traços/rastros de experiências para consolidar uma perspectiva de explicação histórica para certos processos sociais e investiram na construção de uma leitura para o rap (especialmente como é praticado no Brasil a partir de finais dos anos 1980) que, mais do que situá-lo como prática musical, fez sobressair sua existência como campo de valores e modo de vida. Esses valores e modos de vida foram fundamentais para a maneira como esses sujeitos lidaram com o espaço urbano, ressignificando em muitas composições, por exemplo, a periferia.
