In 1927 the Palestine Government commissioned us to prepare a statement of the Land Law then in force in Palestine for the use of Officers engage in the work of Land Settlement. The statement then prepared has been given a wider circulation than was, perhaps, at first intended and copies had been made for sale, it has proved useful both to practitioners and students. Circumstances appear to call for a republication of the statements in a more convenient form and this has been made possible with the consent of the government. We have taken the opportunity revising the original statement very thoroughly and adding chapters upon the protection of agricultural tenants expropriation , town planning, Taxation of land, etc. These are matters of interest to the students and practitioners though less relevant to the work of Settlement Officers for whom the original statement was designed We have also inserted a chapter dealing with the Cadastral Survey and the setting forth the law under which Land Settlement operations take place. References to legislations and as far as possible to court decisions , have been brought up to date. Unfortunately no adequate reports of decided cases are published in Palestine . Use have been made of the reports given in Palestine Post for which all persons interested are very grateful, and also of some other sources of information. A Volume of Reports under the editorship of His Honour the Chief Justice has been published and it is to be hoped that the practice of official publication once established will be maintained. Unfortunately the publication of the Volume of Reports took place at too late a date to allow of reference in the text of cases included in the Volume. The most important of the land cases is the Volume of reports has been summarized for references in an Appendix to this book.

The General Assembly made several minor changes affecting property law in Virginia. The most significant of these changes was the amendment of the Code's provisions regarding a spouse's dower and curtesy interests in the separate estate of a deceased spouse. In addition to this legislation, the Virginia Supreme Court decided several cases dealing with varied property issues. The decisions discussed below are those which should have the most interest to the general practitioner. The real estate specialist, no doubt, is already aware of most of them. In the majority of the cases which follow, the Virginia Supreme Court affirms and reinforces long-standing judicial precedent in Virginia. The most significant development deals with zoning regulations and residential restrictive covenants which affect group homes for the mentally handicapped. In another decision, the court had the opportunity to recognize tortious interference with a prospective contract for the sale of real estate as a cause of action for the first time.

Direct voting by property owners is a widespread but controversial tool for resolving disputes over local collective goods. Direct voting has powerful advantages, in that it can harness the superior knowledge of many local minds, resolve controversies in a way that is perceived to be legitimate, and eliminate corrupt dealmaking. But it also has serious pitfalls, if local voters are poorly informed, or if they ignore external effects on other communities, or if the process is distorted by majoritarian or minoritarian bias. To capitalize on the advantages of local voting, and minimize the risks, this Article proposes that direct voting be limited to local property owners, in a one-owner, one-vote fashion. The issues chosen for resolution by direct voting should also be ones with uniform high stakes for property owners, and minimal spillover effects outside the voting community. Applications to controversies over the creation of local historic districts and the use of eminent domain for economic development are discussed.

AbstractThis essay outlines how the German Unification Treaty comprehends real property merely as a problem of transition provisions and of restitution. The Treaty therefore does provide for a small set of transition provisions similar to those provided for in 1900 for the introduction of the German Civil Code and for a restitution Act. More by instinct than by reflection or knowledge the Treaty also comprises a clause reserving later legislation on reorganizing property law. Soon after Unification having come into force this clause proved to be essential. Literally day by day, the gap between the written German Democratic Republic (GDR)-law and the real practice became more and more apparent. The difference between rights in rem and contractual rights had vanished in the GDR-law to an extent that, in the end, in hundreds of thousands of cases people did not provide at all for the necessary legal fundament for building small houses, big housing blocs, factories or public highways. Nearly every day people wrote letters to the Federal Ministry of Justice describing cases that could not or at least not satisfactorily be resolved with the instruments of the existing law. Therefore, the German parliament had to close these gaps and reorganize the rights and obligations of the people and enterprises using other persons' real property.It accomplished this by enacting in a quick sequence a series of statutes reorganizing property law. Then it was up to the public notaries and the courts, especially the civil senate of the German Federal Court of Justice and the 7th and 3rd revision senate of the Federal Administrative Court to make these laws in practicable. Although the more difficult cases on reorganizing real property relations come up for decision recently, the vast majority of cases have been finalized. This has also been a challenge for law libraries. First, they had to withstand the general trend to throw away their old stocks, which at a second glance could be very useful, both for creating the necessary reorganizing provisions and for assisting the decisions of the courts on these new rules. Then they had to decide how to provide to their Courts, lawyers or professors the necessary periodicals, commentaries and monographs. Now these transient stocks continue to be necessary for the decisions of the courts in the actual cases – and the preparatory work on writing the legal history.

As legal years go, action on the 1996 legislative and judicial fronts was relatively quiet in the area of property law. The legislative activity which spawned most of the interest was bills addressing the definitional limits of the unauthorized practice of law in real estate closings. These bills were not enacted and have been carried over for the next legislative session. Several judicial decisions, although none could be described as landmark determinations, are of interest and clarify points of law. These cases, as well as selected items of legislation which are believed to be of the most practical interest to the practitioner, are what follow.

Over the past two decades, "fracking" has led to a revolution in shale gas production. For some, shale gas promised economic opportunities, cheaper energy bills, and an alternative to coal. For others, shale gas was fool's gold. Critics contend that the shale boom has occurred in a regulatory Wild West, that the response has been fractured and ineffective, or that the harmful environmental and health consequences exceed the benefits from shale gas production. The Political Economy of Fracking argues that the criticism of the shale revolution has been misplaced. The authors use insights from a diversity of perspectives in political economy to understand why the shale boom occurred, who won in the race for shale, and who was left behind. The book explains how private property rights and entrepreneurs led to the shale boom. It contends that polycentric governance, which encourages a diversity of regulatory responses, is a virtue because it generates knowledge about the most appropriate ways to regulate shale development. Private property rights and political institutions that provide for local self-governance also helped to ensure that the benefits of shale gas production exceeded its costs. The authors make the case for fracking shale gas using evidence from shale-producing countries from around the world, comparing them to those that have fallen behind in the shale race. They show that private property rights and markets have been a source of innovation and dynamism and that a diversity of regulatory responses is appropriate to govern shale gas development. This book is insightful reading for academics and professionals interested in the shale boom, the fracking industry in general, and regulatory policy.
