This is a study of what it is to write up a piece of research. That is, a study of the power of writing. Postmodernism has had its sway over social psychology as such as over the other social sciences. It has set a query against established forms of scientific writing, and what they imply. Social studies of science and technology have debunked the fiction of scientific method, especially in the allegedly 'hard' sciences. Equally, in the so-called 'soft' sciences, New, experimental forms of ethnography, done by postmodern anthropologists, have doubted the very idea of the ethnographer's authority. Whether qualitative or quantitative, all methods are now in question. This article reviews new literary forms which might offer a way to both challenge the ever-present issues of power, while at the same time keeping true to the social scientist's fundamental aim - to promote society's reflection on itself. To do so, one will have to break fee from such limiting, but unconscious, binaries as the divide between object and subject, reality and fiction, and between form and content. Auto-ethnography, as Creative Analytical Practice presents itself as one such promising literary form.

El articulo analiza tres novelas de autores cubanos contemporaneos residentes en los Estados Unidos desde una perspectiva antropologica, subrayando la construccion simbolica y la expresion literaria de la identidad etnica. El ensayo concluye que los escritores cubanoamericanos mas recientes estan haciendo la transicion entre una literatura del exilio y una literatura de la inmigracion que se acerca a la experiencia de otras minorias etnicas, especialmente los hispanos en los Estados Unidos. Mit der hohen Anzahl an Geflüchteten in den Jahren 2015 und 2016 kam auch eine Vielzahl unbegleiteter Kinder und Jugendlicher nach Deutschland. Dies brachte eine Reihe an Herausforderungen sowohl für die jungen Geflüchteten selbst als auch für die zuständigen Behörden, Organisationen, Schulen und Betriebe mit sich. Die EMN-Studie beleuchtet, wie die verschiedenen Lebensbereiche unbegleiteter Minderjähriger in Deutschland gesetzlich geregelt sind und wie sich das auf ihre Lebensumstände auswirkt. Im Mittelpunkt stehen dabei die Bereiche Inobhutnahme, Unterbringung, Versorgung und Betreuung, Integration in Schule und Ausbildung sowie Fragen der Rückkehr, des Verschwindens und der Familienzusammenführung. Ebenso werden die wichtigsten statistischen Erkenntnisse zu unbegleiteten Minderjährigen präsentiert. Prinzipiell steht im Umgang mit unbegleiteten Minderjährigen stets das Kindeswohl an erster Stelle. Die Unterbringung, Versorgung und Betreuung der unbegleiteten Minderjährigen verläuft daher größtenteils unabhängig von ihrem Aufenthaltsstatus. Nichtsdestotrotz spielt dieser eine große Rolle, etwa bei der Integration in den Arbeitsmarkt oder für die Möglichkeiten der Familienzusammenführung oder des Familiennachzugs. Mit der Volljährigkeit sind Unterbringung und Integration dann wesentlich vom aufenthaltsrechtlichen Status geprägt.

Fix-Fierro comments that Rene Millan has written a book that he would like to have written himself. Millan has attempted something that seems very difficult: he has appropriated a theoretical apparatus of great complexity -- German sociologist Niklas Luhmann's theory of social systems -- to propose, in combination with other theoretical elements & concerns, an innovative vision of social change over recent decades in Mexico. This paper examines the current challenges in copyright enforcement online in a case from Germany, concerning the Project Gutenberg Literary Archive Foundation.
Project Gutenberg was found liable for a breach of German copyright law and access to certain items was blocked by Germany. Gutenberg believes that the German court has no jurisdiction over the matter, but will comply until the issue is resolved on appeal.
The paper illustrates possible alternatives for jurisdiction and applicable law in the EU. Current choice-of-court and choice-of-law rules are argued to be unsuitable for copyright claims for the online environment. Further, the paper focuses on the latest case law of the Court of Justice of the European Union (CJEU) concerning the liability of intermediaries and the safe harbour regime. "Hosting" safe harbour is supposed to be rejected when a platform is directly liable for copyright infringement jointly with its users.
Furthermore, the paper will describe how the same conclusions would also apply to the Google Books Library Project. Both cases illustrate the current problems of territorial copyright laws in the online environment.
The challenges in enforcing copyright online encourage copyright holders to seek protection within just one jurisdiction so that one single law can be applied. This weighs heavily when deciding upon a litigation strategy for copyright claims. The lessons learnt in this field show how cross-border enforcement of copyright online is tremendously unpredictable for defendants and unaffordable for copyright holders, and thus, benefits nobody.

Rene Millan's book brings a breath of fresh air to discussion on the changes that have taken place in Mexico in recent years. As one can see from the title, the reading of a few pages, & the ample bibliography, the text is strongly influenced by one of the most important German sociologists of the second half of the 20th century, Niklas Luhmann. This excellent work makes no concessions to the reader, but rather demands an attentive & reflective reading to understand Luhmann's theory as applied to Mexican society. Among Socrates & other intellectuals & philosophers of ancient Greece, it was the norm to (1) present the conclusions or results of their studies; then (2) put forth what they presumed to have understood or discovered; (3) present arguments & illustrations that sustained their theories; & (4) organize & institute a reasonable order among those theories. The result was the birth of a literary genre surprisingly similar to the modern treatises written by thinkers such as Descartes, Kant, & others. However, there was a later formidable group of thinkers in ancient Greece, Plato among them, who conceived the exercise of philosophical reflection & the proposal of philosophical themes in public, in the form of dialogues. Based on theoretical references (theses, dissertations, literary chronicles), the text provides an overview in the form of a reflection on the problem of inequality in education in Brazil during the pandemic period. The focus is on secondary school youth (mainly affected by the National High School Examination - ENEM) and their mental health. The article has three main objectives; 1) Reflection and critical reading 2) Thinking about the importance of effective actions and practices 3) Showing the relevance of quality education (as opposed to conservative political thinking in vogue in Brazil). With the analyses, it was possible to notice an intensification of inequalities in the Brazilian political scenario in the year 2020.

This paper studies Carl Schmitt considerations on the so-called "third power" of the State. First, with the help of the jurist own it outlines the general doctrine of the separation of powers and its political significance. Then, his book Law and judgment serves as a starting point for analyzing the Schmittean criticism on Kelsen's normativism. In a third stage, it will examine the author's invective against the liberal State of Law and its ideal of achieving a "State of Justice".
