Die sichere Energieversorgung in Europa hängt von mehreren Akteuren ab. Dies sind neben der EU und ihren Mitgliedstaaten die Energieunternehmen und deren Lieferanten aus Drittstaaten. Dabei stellen sich mehrere Probleme: Während für die Beschaffung von Energie völkerrechtlich geregelt ist, ist für die Verteilung Regulierungsrecht einschlägig. Zudem verfolgt das Energierecht neben der Energiesicherheit auch die Ziele der Marktintegration und des Umweltschutzes; diese Ziele beeinflussen einander und müssen zu einem Ausgleich gebracht werden. Die vorliegende Arbeit stellt zunächst die Faktenlage dar; danach werden die Handlungsformen der EU und das Solidaritätsprinzip untersucht, bevor das Regulierungsrecht, die Grundfreiheiten und das Wettbewerbsrecht auf ihre Relevanz für die Versorgungssicherheit analysiert werden. Ein besonderes Augenmerk wird auf die Artikel 122 und 194 AEUV gelegt. Abschließend werden die völkerrechtlichen Rahmenbedingungen für die Beschaffung von Energie dargelegt

Der auf Deutsch und Polnisch erscheinende Sammelband behandelt in zehn Beiträgen namhafter Staatsrechtler:innen und Verfassungsrichter:innen grundlegende Fragen des deutschen und polnischen Verfassungsrechts. Im Vordergrund stehen dabei die verfassungsrechtlichen Grundwerte, also Grundrechte, Rechtsstaat und Demokratie. Einen roten Faden, der viele der Beiträge durchzieht, bilden die aktuell zunehmenden Bedrohungslagen, denen sich der europäische Verfassungsstaat – sowohl in Deutschland als auch in Polen – ausgesetzt sieht. Das aus zwei Hauptteilen bestehende verfassungsvergleichende Werk ist den Grundrechtsordnungen in Polen und Deutschland gewidmet. Der erste Teil enthält eine längere Studie zur Struktur der Grundrechtsordnung beider Staaten, ihrer Bedeutung für die jeweilige Verfassungsordnung und den historischen, kulturellen und politischen Grundlagen im Kontext eines Ius Publicum Europaeum.Der zweite Teil bietet eine Reihe von Einzeluntersuchungen aus Wissenschaft und Praxis, darunter zehn Beiträge von ehemaligen und amtierenden Richtern der Verfassungsgerichte beider Länder sowie des EuGH. In der Bundestagsrede 2011 hat Benedikt XVI. das Schlagwort »Ökologie des Menschen« in Verbindung mit dem Naturrecht gebracht. Letzteres steht für die Integration des Menschlichen und wird aktuell, wo der Mensch über sich selbst verfügen will.Die Zeit des Naturrechts als System ist vorbei, unabweisbar aber bleibt die Frage nach Leben und Sein des Menschen »im Recht«. So wird z. B. bei biomedizinischen Eingriffen in das menschliche Genom die Frage nach der künftigen Identität der Menschennatur gestellt. Kein anderer Philosoph hat den konstitutiven Zielbezug des Naturrechts auf die Person des Menschen als allem Denken vorausliegendes Sein so deutlich herausgearbeitet wie Robert Spaemann. Die Erschließung der Entsprechung von Sein und Sollen, wie sie in jeder Person schon präsent ist, und die Umsetzung in eine grenzbewusste Ethik sind entscheidende Anstöße zur Erneuerung naturrechtlichen Denkens.

This book explores the issue of environmentally-induced migrations from the point of view of international human rights law, international humanitarian law, international refugee law and international law of statelessness. Last few years have become a period of unprecedented growth in the number of studies devoted to the forced migration caused by climate change. The book by professor Jane McAdam, published by Oxford University Press, differs significantly from previous studies in this area. The focus of the author became a state responsibility for the situation of climate-change induced displaced people with a particular focus on legal aspects of this problem. The basis of the author`s considerations are four particular areas of public international law: international human rights law, international humanitarian law, international refugee law and international law of statelessness. The issue of climate change-induced displacement is now becoming a growing challenge for public international law. The growing number of climate change migrants becomes a challenge for the international istitutions dealing with humanitarian assistance. Sea level rise become a factor of specific legal problems, such as climatic deterritorialization of the state, state succession on the new territory, the status of people forced to leave their country submerged under the waters of ocean (forced migrants?, refugees?, stateless people?, citizens of the former country continuing its status within a new territory?).

There are about 2.2 million prisoners in the USA. It is generally viewed that this number is a result of a too severe penal system connected with the introduction of the absolute intolerance for drug crimes policy. But not only gang members and drug dealers are doing time in prison, this system also applies to war veterans. In 2012, there were 181,500 veterans behind bars, especially participants of the recent wars. Most of them face problems with addiction or struggle with permanent unemployment, homelessness or psychological disorders. This phenomenon is alarming because veterans as a privileged group have a social, medical, education cover and all capabilities not to break the law. Veterans as former soldiers, disciplined and well familiar with criminal law, who received ethics and international humanitarian law training courses, from practical point of view should not break the rules stated by the legal system. The image of former veterans who served their country, totally disagree with penitentiary statistics. Recent years have shown that military service, especially in the area of conflict, may become a double-edged sword, and in fact veterans may pose a threat to society.

This article is a comparative analysis of the legal nature and the rights and obligations of parties concluding property insurance contracts under the provisions of the Maritime Code and the Civil Code. When navigating a ship, the shipowner conducts a business commonly referred to as the operation of a ship, which includes, inter alia, its use for business purposes. The shipowner business is therefore an economic activity and the owner is the entrepreneur who runs his business which s/he is liable for. It is his/her broad interest to insure permanent assets of his/her company against damage as well as his/her civil liability. As the text indicates, s/he is treated by the legislature more severely than a person conducting a standard property insurance. In addition, the legal nature of the policy, due to the requirements of maritime traffic, differs from that from the Civil Code. The purpose of this study is to identify the key differences between the two regulations.

The article discusses the problem of the reform of the system of the protection of personal data in the context of changes, new tasks and challenges faced by the European data protection authorities, in particular the European Data Protection Supervisor, Article 29 Working Group or the national supervisory authorities. The proposals of regulations and directives submitted in recent years by the European Commission related to data protection in general, as well as the specific rules governing the functioning of the EU agencies involved in the fight against crime clearly show that the proposed changes are intended to increase the role of these bodies at both the E. U. and the national level by ensuring a more effective implementation of the new rules. The planned strengthening of the relationship between the national authorities as well as the coordination of their activities also aims to meet this objective.

Traditionally, the quality of law is associated with observing certain principles of law making, the so-called principles of good legislation. Such a way of thinking, however, seems to be an over-simplification. Thus, the author indicates that the high-quality of legislation and the principles of good legislation are not the same. Law passed on the basis of good legislation procedures does not automatically result in the high-quality law, in particular, if one makes an assumption that the quality of law depends, above all, on legal certainty being ensured. The reflections presented here express an opinion on the immediate connection between the quality of law and the theory of law. In this perspective, thoughts on the quality of law resulted in an opinion how firmly the process of improvement in law quality is associated with the development of the theory of law. As regards the studies on the quality of law as a measure of legal certainty, three issues are pointed out in the material: 1. the quality of law from the point of view of its formation in reference to certain general social phenomena, 2. the quality of law relating to a person, 3. the quality of law in judicial activities.
