Bibliographic guide of French language publications on refugee law, asylum, forced migrations and related disciplines.This bibliography highlights French-language works relating to refugees and migrants that were published over the last 25 years. The entries are divided by type: books, reports and studies; journal articles and book chapters; scholarly journals; web sites in French; and finally, relevant organizations based in France. Each entry is followed by an indication in parentheses of the type of migrant discussed in the resource. While not a comprehensive bibliography, the first two sections list approximately 1800 references.

We study the process of asylum legislation and its impact on refugees. The preliminary chapter presents the history of refugee flows and asylum policies, the reasons for migration and the philosophical stakes of the subject. The second chapter studies the influence of asylum policies on refugee flows. We analyse the impact of different types of asylum law restrictions on decisions of refugees choosing their country of destination and whether to apply for asylum. The use of traffickers indirectly influences the size of the immigration flows and the number of asylum claims. The third chapter describes the choice of the level of asylum standard chosen by different levels of government. This choice is made as a result of the expected result of a standard on refugee flows. Chapter four compares different institutional choices for asylum legislation in the European Union. Taking objectives concerning illegal immigration into account, it compares the level of standards that would be adopted by national governments, by the Council of the European Parliament, and in co-decision. The fifth chapter studies the structure of grants given Member states by the European Refugee Fund (ERF). The ERF grants both fixed funds and subsidies that complement project funding. Taking transaction costs into consideration, we study the impact of different grant structures on spending on refugees. ; Nous étudions le processus de création de droit d'asile et son impact sur les réfugiés. The Refugee Act of 1980 : what have we learned ?

« This article discusses the objectives of legislation enacted in 1980 that incorporated into US law the international definition of a refugee. It examines the political climate that existed when the legislation was debated and how sudden, unforseen events affected the implementation of the new law. Particular attention is directed at understanding the difficulty the US has experienced in achieving a nationality-neutral refugee program and in establishing a political asylum system that is fair but resistant to abuse. The writer closes with some speculation future directions in US refugee policy and law as a resuit of the thaw in US Soviet relations and possible changes in US policy toward Central America ».

Two interconnected dimensions of this regime are dealt with: the internal dimension, which is related to the refugees' status within the Arab host societies; and the international dimension, which envisions the refugee issue as a negotiation chip within the framework of the peace process with Israel and the funding of international assistance. ; Cet article examine dans une perspective historique le système juridique et politique élaboré par les Etats arabes afin de gérer la question des réfugiés palestiniens. This thesis examines the category of people known as "refugees" and the impact this categorization has on the creation of an identity in the limited framework of Delhi, space of convergence, space of dispersion. The refugee category includes people of different ethnic groups, religions, and nationalities. I shall attempt to determine whether their image of themselves and the types of action they engage in are common to them all, which would indicate that their identity is based on their situation as refugees. Deconstructing the refugee category functions on three levels: the regulatory bodies that give substance to the refugee "label"; the people who support refugees politically and socially; and religious groups (Christian groups) who are also key players in the "refugee system". A transversal approach leads to the conclusion that a civil society emerges, carrying the expression of a heterogeneous identity along with community dynamic through which one can defines the refugee identity. ; La problématique de cette thèse est d'interroger la catégorie « réfugié » et son impact dans le processus de construction identitaire à Delhi, lieu de convergence et espace de dispersion. Se dégage-t-il, parmi des personnes de divers groupes ethniques, religions, nationalités et aux origines sociales variées, des représentations et des modes d'action communs, témoins de l'existence d'une identité basée sur la condition de réfugié ? La déconstruction de la catégorie « réfugié » s'opère à trois niveaux : celui des organisations de tutelle des réfugiés qui donnent corps à ce « label » réfugié ; celui des acteurs politiques et sociaux qui apportent leur soutien aux réfugiés ; et celui des acteurs religieux (chrétiens) qui, eux aussi, sont partie prenante du « système-réfugié ». Un regard transversal permet de conclure à l'émergence d'une société civile portant l'expression d'une identité hétérogène et d'une dynamique communautaire par laquelle peut se définir l'identité « réfugié ».

La crise des réfugié·e·s et des migrant·e·s qu'a connu l'Europe a été une des questions politiques les plus importantes et les plus conflictuelles de son histoire récente. Depuis ses débuts au moment du Printemps Arabe en 2011 puis de son intensification en 2015, elle a été présentée comme une crise des migrant·e·s. Cependant, la réalité est bien plus complexe et il s'agit bien plutôt d'une crise « mixte », touchant tout à la fois des migrant·e·s et des réfugié·e·s. Cet article défend l'idée selon laquelle la réponse de l'Union européenne à cette crise peut largement être expliquée, d'une part, par la nature asymétrique de la crise elle-même et, d'autre part, par la structure inégale de l'Union. L'asymétrie est présente sous trois aspects différents qui sont analysés consécutivement dans cet article. Premièrement, la crise est asymétrique dans la mesure où elle affecte beaucoup plus certains États membres que d'autres. Deuxièmement, la structure-même de l'UE, avec ce qu'elle produit en termes de différenciation horizontale, de clauses d' opting-out et de partage inégal du fardeau, tend à conduire l'institution à produire des réponses asymétriques. Troisièmement, la position de l'Allemagne en tant qu'acteur-clé ajoute à la nature inégale de l'UE et a fortement influencé la manière dont la crise a été gérée en 2015-2016. Ces trois aspects de l'asymétrie permettent d'expliquer pourquoi trouver une solution commune s'est révélé si difficile.

La "crise" des réfugiés a été présentée comme un échec de la politique d'asile de l'UE. Pourtant, de quel type d'échec parlons-nous en réalité ? S'agit-il d'un échec à faire face aux pressions extérieures qui ont vu le nombre de demandeurs d'asile augmenter considérablement ou plutôt d'un échec à mettre en place un système d'asile commun pleinement opérationnel ? Cet article examine les stratégies des décideurs politiques pour cadrer la crise soit comme une menace, soit comme une opportunité, en se concentrant sur l'échec de la proposition de relocalisation des demandeurs d'asile à travers les États membres de l'UE. L'analyse examine si les causes de cet échec sont considérées comme exogènes ou endogènes à l'UE et la faute est principalement attribuée. Elle cherche à développer les modèles existants d'échec des politiques et à mieux les adapter au cadre institutionnel particulier de l'UE en s'appuyant sur les modèles de cadrage stratégique et le Multiple Streams Framework . Cette nouvelle approche nous permet d'approfondir les causes des "crises" et de mieux comprendre les mécanismes qui relient les "crises" aux solutions politiques.

Nous présentons dans ce travail les éléments qui permettent de constituer à nos yeux la spécificité de la catégorie de « réfugié ». Nous nous basons pour cela sur la monographie de deux camps de réfugiés. Le premier est le camp de Dadaab, qui se situe au Kenya et accueille en grande majorité des réfugiés somaliens. Des Ethiopiens, des Erythréens, des Soudanais et des personnes d'autres nationalités y ont également trouvé refuge. Le deuxième camp est le camp de Nkondo, en République Démocratique du Congo et héberge des personnes ayant fui l'Angola au moment de la reprise des combats en 1998 dans les provinces du Zaïre et de Uige. Tous deux sont gérés par le H.C.R. Nous avons complété ces études par une analyse du processus de rapatriement des réfugiés angolais qui a commencé en juin 2003 pour se terminer officiellement le 27 mars 2007. Le camp constitue un territoire particulier. Ni ville, ni lieu d'enfermement, il se définit par les pratiques des agents sociaux qui y sont à l'œuvre, c'est-à-dire les réfugiés et les agents des agences humanitaires. Deux dimensions permettent de l'appréhender plus justement : sa temporalité spécifique, c'est-à-dire perçue différemment en fonction du statut de la personne, et sa transterritorialité multiscalaire, nous entendons par là le fait que les agents agissant dans le camp représentent des échelles territoriales différentes. Le territoire du camp permet de définir la catégorie de « réfugié » telle qu'elle est utilisée non seulement par les personnes appartenant à cette catégorie mais aussi par les employés des agences humanitaires. La manière dont cette population est ensuite découpée en groupes pour en faciliter la gestion participe aussi de son interprétation par les acteurs sociaux. Par ailleurs, les documents issus autour de cette catégorie de « réfugié » et qui en prouvent l'appartenance contribuent à former cette catégorie. Ainsi, non seulement cette dernière a une validité « anthropologique », pourrait-on dire, mais également légale puisque les papiers prouvant le passage dans un camp géré par le H.C.R. et délivrés par les agences d'aide permettent d'accéder à des identités parfaitement légales sur le plan juridique. Les observations effectuées autour de la frontière, au moment du rapatriement des réfugiés angolais mais également au cours de la vie quotidienne dans le camp, renforcent l'idée d'une construction de la catégorie de « réfugié » non seulement sur un emplacement précis mais aussi lors du/des déplacement/s. ; In this work, we present the elements which in our eyes authorize the constitution of the specificity of the category of 'refugee'. For this, we base ourselves on the monograph of two refugee camps. The first one is camp Dadaab, which is situated in Kenya and mainly hosts Somali refugees. Ethiopians, Eritreans, Sudanese and people from other nationalities also find shelter there. The second one is camp Nkondo, in Democratic Republic of Congo, and mostly hosts people having fled Angola when war broke out again in 1998 in the provinces of Zaire and Uige. Both are managed by U.N.H.R.C., different humanitarian organizations taking in charge the implementation of the infrastructures and the activities as decided by the U.N. agency. We completed these studies by an analysis of the process of repatriation of Angolan refugees which started in June 2003 and officially ended on March 27th 2007. The camp constitutes a particular territory. Neither city nor shutting-in place, it is defined by the practices of the social agents at work, that is the refugees and the agents of the humanitarian organizations. Two dimensions can help understand the camp more precisely: its specific temporality, as perceived differently according to the status of the person, and its multiscalar transterritoriality, referring to the fact that agents at work in the camp represent different territorial scales. The territory of the camp allows us to define the category of "refugee" not only as used by people belonging to this category but also by the employees of the humanitarian agencies. The way the former population is then divided into groups to facilitate its management also participates to its interpretation by social agents. Documents issued in reference to this category of 'refugee', and which prove one fits the description, also contribute in the production of this category. The latter therefore not only has "anthropological" validity, but it also has a legal dimension since the papers proving the passage in a U.N.H.C.R camp and issued by aid agencies enable access to completely legal identities on the juridical plan. Observations made around the border, during the repatriation of Angolan refugees but also during everyday life in the camp, reinforce the idea of a construction of the category of "refugee" not only in a specific locality yet also during the displacement/s.

It examined the Refugee problem in Africa and recommended how it can be solved and look for ways and means of maintaining refugees in their country of asylum.

Laurence Prempain dedicates her PhD (History) to the study of the Poles and Polish Jews who came to live in Lyon (France) between 1935 and 1945. In the first part, she presents the geographical framework (Lyon), her methodology (Gender approach, microhistory and silence as a source) and her will to understand their voices and place them to the heart of her work. For that purpose, upon the examination of approximately 600 administrative files amassed by the « bureau des étrangers » (préfecture du Rhône), the letters they wrote have been then systematically collected to shed light on their authors' struggle to live and survive. The historian starts from the postulate that Poles and Polish Jews in France make up a heterogeneous population, only sharing a common citizenship, nonetheless they remain economic, political and war refugees. Thus, once considered welcomed, all Polish nationals are , at their life, considered as unwanted, « indésirables ». Therefore, the second part investigates the processes used by the Third Republic and then the Vichy Regime to get rid of them: expulsions, driving back, exclusions, internments or deportation. Moreover, the author raises the question of the war ends and demonstrates that purges have a gendered dimension, which can be seen as an attempt of reappropriation of the authority. She also focuses on the foreign deportees repatriation's organisation. Finally, in a third part, she asserts that far from being subjected, these men and women have acted and developped evolutive strategies. Through the letters they wrote, through what is said and what is silenced, she establishes that those strategies are a matter of what she names sidestep and transgression. The first one adapts itself with the limits while the other is deliberately opposed to it. Sidestep and transgression complete each other.
