The defeat of the Confederacy, the prospect of military occupation and Republican state government, and the financial collapse of many plantations and businesses sent a number of white southerners in pursuit of life in a foreign land during the late 1860s. Between 1865 and the early 1870s approximately five thousand white and black southerners trekked to Mexico (28, 37).1 Todd W. Wahlstrom examines this resettlement by studying colonies in the Texas border state of Coahuila. Much of The Southern Exodus to Mexico chronicles the rise and fall of ambitious colonization plans of such ex-Confederates as Matthew Fontaine Maury (scientist and naval officer from Virginia) and former Louisiana governor Henry Watkins Allen (12, 22). Wahlstrom revises earlier histories, engaging Andrew Rolle's The Lost Cause: The Confederate Exodus to Mexico (1965) that describes Confederate flight as "an attempt to snatch some sort of victory out of defeat"2 and as an expression of delusional efforts to preserve Dixie in the Mexican highlands. Wahlstrom seeks to revise Rolle's contention that the southern exodus was a "failure" through revealing "the scope of the vision behind it" (xv). Although Rolle largely ignores the northern Mexican borderlands, Wahlstrom also emphasizes colonization in Coahuila, arguing that border states contributed to a "hemispheric south" where planters and railroad promoters envisioned business and trade networks across the Mexican borderlands and into Latin America during the last third of the nineteenth century (xxvii). Wahlstrom also considers the experiences of African Americans and non-slaveholding whites. Contra Rolle's account, southern emigrants to Mexico did not solely represent a "Lost Cause" flight of renegade whites, but a commercial vanguard. Economic interests yielded unlikely collaborations between Confederate exiles and Mexican liberals who returned to power in 1867 (85). Most of these commercial efforts involved agricultural enterprises, ranging from grand schemes for cotton plantations to the homesteads of black and white yeoman settlers who saw Mexico as an "agricultural paradise just waiting for southern migrants to build up its economy" (23). Mexico might seem an unlikely destination for defeated Confederates, as its government formally abolished caste distinctions and chattel slavery after it gained independence in 1821. Additionally, Mexico had engaged in a war with pro-slavery Anglo settlers in Texas during the 1830s, and was still reeling from the effects of US invasion and occupation from 1846 to 1848. Nevertheless, a unique set of political circumstances made settlement appear promising in the summer of 1865. Under the imperial rule of Maximilian, the republican opposition forces of Benito Juárez were at low ebb, despite growing US pressure for France to decrease its presence in Mexico. Even after Mexico's loss of its northern territory to the US in 1848, vast areas remained beyond government control. Imperial forces, republican resistance, local strongmen, and indigenous peoples all contested Mexico's shifting borderlands.3 Over three centuries after Álvar Núñez Cabeza de Vaca and Estevanico traversed the region, nineteenth-century Coahuila remained a "middle ground" between Apache, Comanche, and Kickapoo Indians, indigenous peoples who migrated into the area to either avoid white settlement or raid white settler outposts. Readers of James Brooks, Pekka Hämäläinen, and Brian DeLay will recognize the "network of violence, theft, and trade" that characterized Coahuila's society during much of the nineteenth century (63–68).4 Wahlstrom does not go as far as these three historians in describing Indian nations as primary powers of this territory, as he finds their sway over Coahuila to be somewhat diminished by the 1860s (64–66). These indigenous groups figure primarily as vexatious raiders in The Southern Exodus to Mexico, not as existential threats to ex-Confederate settlements. Confederate migration to Mexico is one point in a longer arc of Spanish and Mexican efforts to attract settlers to their northern borders in order to control the region. Andrés Reséndez documents the motives that led Mexican officials and, particularly, an ambitious northern Mexican commercial class to attract US settlement and trade during the first half of the nineteenth century.5 Wahlstrom's research makes clear that the US-Mexico War did not diminish economic and settlement patterns. Instead, ex-Confederate migration mapped onto earlier patterns of migration from southern US states to the borderlands of Texas, New Mexico, and the adjacent areas of Tamaulipas, Nuevo León, Coahuila, and Chihuahua. There, white southerners from a slaveholding society found familiar class and labor dynamics. While Mexico was a multiracial nation that espoused the equality of all citizens before the law, it retained sharp divisions between Spanish-descended creoles, mestizos, and indigenous groups. Throughout the nineteenth century, Mexican liberals "argued that white immigration would bring economic advancement," modernization, and a whitening of the Mexican population (21). For their part, many white colonists brought a "racial exclusivity that only included elite Mexicans in the colonization plans." These transplants did not share the goal of transforming their host nation through assimilation or absorption (85). For many African Americans who escaped slavery or the new forms of bondage that emerged after the Civil War, Mexico often represented freedom from racial oppression.6 Sean Kelley, in a study of runaway slaves before the Civil War, vividly describes how Texan African Americans viewed Mexico as the land of liberty.7 While employment by white colonists—often former slave owners—brought an unspecified number of black southerners to Mexico, Wahlstrom argues that their migration "corresponds with other forms of African American agency in the postwar period" (133). However, Wahlstrom also states that black southerners often relocated "under duress" with their former masters (39). In such instances, this agency involved escaping the oversight of former slave owners, as was the case of Thomas C. Hindman, an ex-Confederate general who witnessed the flight of former slave Charlie and the "defection" of other former slaves to Mexico (39). A desire to acquire land and earn economic independence attracted blacks to Coahuila, even though many white colonists envisioned for them only a subservient role on estates that recreated southern plantation life (46, 132, 133). At times, black southerners attempted to form their own colonies. Wahlstrom describes the efforts of William Ellis, whose short-lived 1894 colony in the Laguna area of Durango stands outside the temporal scope of his study but warrants consideration as an emblematic representation of both Mexico's potential and peril to blacks. The settlers experienced "exploitation" as agricultural workers as well as a "swath of yellow fever." Ultimately, when the settlement disbanded, the seventy remaining blacks left the Laguna colony to work in nearby mines. Wahlstrom simply asserts that "seventy of these colonists picked up their hopes and went to the mining town of Mapimí to continue their pursuit of freedom" (46). However, William Beezley's discussion of mining in northern Mexico during this period casts a stark shadow on these optimistic notes; miners endured grueling labor conditions in unlit, poorly ventilated shafts, working with simple hand tools and suffering from exposure to mercury and other toxic compounds.8 Relocation to Mexico offered freedom from Jim Crow; nevertheless, opportunities for economic advancement were often limited for African American emigrants. Wahlstrom's emphasis on leading colonizers such as Matthew Maury, and the political machinations between elite southerners and Mexican officials, obscures insights into the everyday experiences of black and white southern emigrants. While Mexico's leaders found "common ground" with former Confederates in their quest for white immigration, popular Mexican reactions to this influx of American settlers, aside from frequent references to "banditry," do not appear in The Southern Exodus to Mexico (21). An overall impression emerges that white southern colonists created isolated, self-contained enclaves characterized by a southern Protestantism in sharp relief to Mexican Catholicism (143). Wahlstrom's study affords little insight into the competing concerns over religion, language, legal procedure, intermarriage, and schooling that marked the settlement of other Mexican colonies. Aside from passing references to marriages and women and children held as captives, this history centers almost entirely on male settlers. Nancy Brigham, a widowed woman who settled with a group of Texans in the Córdoba colony of central Mexico, is one of the few women mentioned. Wahlstrom ventures that "her involvement reflects the appeal of Mexico as grounds for economic revival, a way to resuscitate her family's future" (24). Nevertheless, beyond ambitions for new farmland and speculative business prospects, Wahlstrom does not investigate how settlers attempted to recreate Dixie on the Mexican borderlands in cultural or spatial terms. Instead, Wahlstrom traces US investment in Mexican railways, contending that economic interests were central to early efforts to link the two nations. He documents the competing efforts of former Union general William S. Rosecrans, who promoted a Mexico Pacific and Rio Bravo Railroad from New Orleans to Mazatlán, and Edward Lee Plumb, who planned to connect Laredo to San Blas on Mexico's Pacific Coast (115–117). As both proposals ultimately failed, Wahlstrom can only make limited claims about the "bilateral benefits of trade and economic development to Mexico and the South" (117). He nonetheless argues that these promoters "helped instill new pathways of prosperity and steer[ed] a course of transnational connections between the United States and Mexico during the second half of the nineteenth century" (127). Such glowing descriptions aside, the efforts of Confederate exiles in Mexico produced few tangible results in railroad and industry in the decade following the Civil War. The final chapter of The Southern Exodus to Mexico makes a more convincing case that southern emigration to Mexico was a harbinger of a "New South" where white leaders embraced industry, finance, and commerce to progressively diversify an agrarian economy, while maintaining a conservative approach to labor and race relations (124–125). At a general level, Mexico's leaders shared these conservative tendencies (21). The transition from imperial rule to liberal governance made economic interests paramount in Mexico's immigration efforts. Several of the Mexican officials who brokered for southern colonists in the 1860s later worked to forge a borderlands economy through the promotion of railroads, mining, and commercial agriculture under Porfirio Díaz. Santiago Vidaurri, a regional strongman and ally of Díaz who exercised political and military dominance over Coahuila, facilitated these emerging trade connections (71–72). Wahlstrom details how this particular migration period anticipates a coming era of US empire-building, where extensive commercial interests, especially in agriculture, created semi-colonial regimes in Mexico and Central America. Importantly, however, Confederate migration does not mark the beginning of US or imperial interest in Mexico. Juan Mora Torres, who also explores the emergence of a transnational economy in northeastern Mexico, dates the foundation of this "hemispheric" economy to the cotton trade that flourished before and during the Civil War.9 The Southern Exodus to Mexico makes a more convincing case that white southerners endeavored to promote cross-border business after the Civil War and that the increased publicity of Mexico's economic potential strengthened the case for foreign investment and more direct transportation linkages (111–112, 127). Ultimately, Wahlstrom provides few examples of lasting economic success or significant social transformations within these attempted southern colonies.
Povijest nastanka i djelovanja građanskih udruga u Lici može se pratiti još od 1835. godine kada je osnovana Narodna čitaonica u Senju. Ipak, tek su krajem 19. stoljeća stvoreni svi preduvjeti za brojnije osnivanje svih vrsta građanskih udruga u Lici te je od tada njihov broj u stalnom povećanju. Iako je nesumnjivo da su razne vrste udruga u Lici svojim djelovanjem pozitivno djelovale na ličko društvo, taj fenomen društvene mikro-povijesti nije bio predmet sveobuhvatnog proučavanja. Ovaj doktorski rad kronološki prati stvaranje prvih građanskih udruga (društava, zaklada, štedionica, klubova i podružnica) u Lici u vrijeme Vojne krajine, njihovo naglo povećanje u vrijeme Ličko-krbavske županije i promjene koje su ih zahvatile u vrijeme Kraljevine Jugoslavije te završava početkom Drugoga svjetskog rata kada su građanske udruge u Lici naglo nestale s povijesne pozornice. U radu je prikazano političko, gospodarsko i kulturno stanje u Lici koje je uvelike utjecalo na brzinu i kvalitetu nastanka novih udruga. Također su obrađene i građanske udruge izvan prostora Like jer je njihova kulturna i ekonomska interakcija bila važan element u razvoju ove regije. Stoga je cilj ovog doktorskog rada po prvi put u našoj historiografiji dati, ne samo sumarni prikaz građanskih udruga, već i razloge, uzroke te posljedice njihovog postojanja na prostoru Like i Senja, a sve u svrhu boljega razumijevanja kompleksnih i nedovoljno razjašnjenih povijesnih procesa u hrvatskoj povijesnoj regiji Lici. ; The beginings of organizations set up in Lika region reaches far into the past, in the time of medieval brotherhoods; however, the first civil organizations in Lika did not arise until the Military Border systems have been abolished and until the break through of the modernization processes that originated in the Civic Croatia. The city of Senj had partially different but also earlier organizations' development. The first known civic organization on the area that has been the subject of this doctoral dissertation was The National Library in the city of Senj, founded in 1835. Withal, this civil organization is the first one in Croatia. In Lika region, the first civil organizations were not founded until the abrogation of the Military Border which, at the same time, has been the starting point for the progression of one of the most important forms of modernization. In the first part of this scientific work, social stratification and differentiation in the everyday life of Lika's residents has been depicted, whereas the usage of an argumented research approach has served to explain complex political, military, economic and other mutual influences between Lika's peasants-soldiers and the authorities that have dominated during that time. Multiple conflicts, unsafe and economically marginalized area, unsettled property laws and so called 'cooperative phenomena' are just a part of the numerous reasons why Lika region has entered Croatian and Habsbourg Monarchy's cultural and social processes relatively late. An emphasis is on the development of education, literacy and culture as basic determinants of future development of the civil organizations. Second major group of the research questions deals with an emersion of the organizations on the Croatian and European area, as a result of new global political processes. This part of the disertation tries to answer the question 'which were the reasons for the organizations' establishment in the first place', so as 'to what extent the organizations have influenced the residents of Wienna, Zagreb and other cities of the Habsbourg Monarchy'? Special emphasis is put on the law regulations, that is, so called 'Imperial Decree' which has helped the organizations to establish and work. Also, this group of the research questions discusses the inherited differences that existed in an administration, mentality and the development itself between the former Military Border and the Civic Croatia. Comparative research has provided an evidence that the development of a new district – Lika-Krbava county – when compared to the other districts, has been minor. Also, the questions that have been the matter of this scientific work were 'which kind of the organizations were there in the first place, 'what is the nature of the organizations' and 'which is the real level on which these organizations have fulfilled their purposes and goals'. This kind of analysis is very important in order to understand Lika's history from the beginning of the 20th century; in this period economic and cultural life of the Lika's residents is highly inflenced by a new regime of the Kingdom of SHS and, later on, the Kingdom of Yugoslavia. This group of questions especially makes an exception of the city of Senj, as a kind of border exception, but also explains which political and economic circumstances and perplexities resulted in prosperity and stagnation of the city beneath the Nehaj Fortress. The third group of the research questions, using the archive sources of the civil organizations' rules, gives an overview of more than one hundred and fifty civil organizations according to the territorial regions (districts) that existed during the Lika-Krbava county and the Kingdom of Yugoslavia. This section reveals the purposes, goals and the activities of administrative councils and assemblies of all major civic organizations (associations, clubs, affiliates, commities, foundations) found in the districts that existed during that time – Brinje, Donji Lapac, Gračac, Gospić, Korenica, Otočac, Perušić, Udbina and the cities Senj and Karlobag. In spite of major illiteracy, political and national antagonism and the fact that Lika was at the periphery in the Austrian-Hungarian Monarchy, until the beginning of the World War I, a great number of the organizations has been established in Lika region. When talking about this in the first place, we must mention some proffesional societies, libraries, 'falcon' organizations, music organizations and economic organizations, although there were also some historical occurences such as the first theatrical group in Otočac, or one of the oldest tennis clubs in Croatia, the one in Gospić. Thereby, in the second half of the 19th and the first half of the 20th century, Lika is the region of the numerous changes, but even more is the region of the extreme contradictions. In the same (research) way, the attention has been dedicated to history of Lika's organizations outside Lika's area. Throughout this group of questions not all civic organizations outside Lika have been elaborated, only those whose members actively participated in the development of the possibilities for the future economic prosperity of Lika region. Therefore, this part of the paper tries to show the connection between Lika region and the other parts of the countries that existed during that time, where the descendants of Lika's residents have lived. This scientific work tries to answer the questions of the real connection of Lika's people outside Lika with the real problems which were perceived by them in a different way than by those who remained living in the homeland. The Society of Lika's people in Zagreb was Lika's major emigrant organization which intensively helped its agile members and offered a solution for a hard life in Lika region. The Society for the preservation of the Plitvice Lakes was one of the best known organizations in Croatia, however, its class and narcissistic behaviour could not have been accepted by most of Lika's residents. In spite of individual interests of a great number of members of Lika's civic organizations, what does remain is a constatation that the organizations, especially those whose members were peasants, have obtained a huge success when it comes to development of cooperatives, crafts, agriculture, but also education and culture. Also, what is notecable is the fact that efficiency of the numerous affiliates of federate economic organizations has increased, what leads to the conclusion that the overall progress in Lika was connected with the political and economic centres outside Lika. A key influence onto the organizations' development in Lika was the one by certain individuals such as Buda Budisavljević, Ivan Devčić, Dragutin Trstenjak, Ante Cividini, Ivan Krajač, Ivan Gojtan, Ante Lončarić, so as many other culturaly and publicly known people. In that way, this doctoral thesis has scientificaly confirmed an actual similarity of the associations and organizations in Lika with those in the rest of Croatia, but also that these similarities were, in fact, quite limited. Civic organizations are an important factor in every community, so as, of course, for Lika's identity which is historically saturated in turbulent ways. This work tries to make a contribution not just to better understanding of the civic organizations in Lika, but to contribute to understand the overall environment, that is, the atmosphere in Lika region. This gives new knowledge regarding micro-historical elements of one culture that has been a carrier of social, cultural, political and economic development of the region between the Kapela mountains in the north and South Velebit and the river Zrmanja stream in the south. This doctoral thesis is the first scientific contribution to better understanding of the civic organizations and their importance in the region under consideration. Although this thesis, through the depiction of work of the civic organizations in Lika, has tried to give an answer regarding broader social, political, economic, cultural and religious life of Lika and Senj's residents in the period of turbulent and modernisation processes, some questions remain only partially answerable. If we take into consideration the broadness, possibilities and influence of the organizations, this observation is logical, too. Also, here we can talk about a vast area which makes a closed whole only in certain segments. That is the reason why this overview of the work of the civic organizations in Lika asks for further research attention, especially when it comes to the analysis of economic changes which have occurred in Lika during the second part of the 19th and the first part of the 20th century. In order to accomplish this, besides the archival research, a potential researcher must pay attention to the statistical analysis. Moreover, this scientific work gives just a model of how to evaluate certain types of the civic organizations and how to compare them with the organizations similar to them. Although this doctoral thesis had to be done within a canonical time frame, it will be praiseworthy if we compare the civic organizations in Lika which exist today to those which have existed during the period of Austrian-Hungarian Monarchy and the Kingdom of Yugoslavia. Of course, this kind of research calls for plenty of time, as well as considerable material assets, hence it can be done sometime in the future. Despite the fact that the tragic events during the World War II lead to the abolition of the civic organizations outside Lika region, the constitution of the Republic of Croatia has created the conditions for the reestablishment of the organizations. Nowadays, more than twenty organizations outside Lika work very actively and responsibly in order to interconnect Lika's emigrants and their descendants with their homeland, from where their ancestors arrived more than one hundred and fifty years ago.

Litigation is no longer solely framed by legislative requirements, but ever more by private standards such as GlobalGAP, BRC, IFS, SQF and ISO. Private standards incorporate public law requirements, thus embedding them in contractual relations and exporting them beyond the jurisdiction of public legislators. Private standards are used to remedy shortcomings in legislation, to reach higher levels of consumer protection than the ones chosen by the EU legislature, to impose new obligations on contracting parties, to manage risks and liability beyond the traditional limits of food businesses and inally to give substance to corporate social responsibility. Private standards also play a role in deining speciic markets of growing importance and in self-regulating the commercial communication/advertising for foods and beverages. Organic standards have found an interesting symbioses with public law. Halal standards express the demands of some two billion consumers worldwide. Food businesses are inspected more often by private auditors than by public inspectors. Effects in terms of receiving or being denied certiication often far outweigh public law sanctions. In short, based on private law, an entire legal infrastructure for the food sector emerges, in parallel to, and sometimes complementing, the public law regulatory infrastructure. ; Durante la última década, las iniciativas a nivel mundial en el sector privado se han convertido el entorno jurídico y reglamentario para las empresas de alimentos al revés. Throughout its history, many were the times the European project was pronounced dead. From 1992 Danish blockage to the Maastricht Treaty to the French and Dutch "No"s to a European Constitution in 2005, the spectre of faltering political institutions for shaping an integrated economy seems to rise stronger every time. The hypothesis of this dissertation is that the European project is well captured by Polanyi"s thesis of the Double Movement. The institutional architecture of European integration, it is argued, triggers a process of market disembeddedness. This architecture is characterized by an asymmetry between negative integration advanced by supranational enforcement of the Single Market and intergovernmental governance of positive (market-shaping) integration. As a result, particularly after the Maastricht Treaty, domestic institutions have been pressured to comply with market requirements. At the same time, however, protective countermovements arose to reembed a disembedded economy. This dissertation is structured as follows: Chapter 1 explores Polanyi"s thesis of the Double Movement; chapter 2 builds on the Varieties of Capitalism approach to identify distinct market embedding institutions in Europe (according to these differences, a set of countries is chosen in order to monitor the process of market disembeddedness); chapter 3 outlines the hypothesis of asymmetric integration; chapter 4 identifies institutional arenas in which market is disembedded; chapter 5 assesses the impact upon market-embedding institutions of the selected economies and identifies protective countermovements. The dissertation concludes by drawing implications that may contribute to the ongoing debate over European integration. ; A construção de um Mercado Europeu foi, desde cedo, uma questão muito mais popular e exequível do que a da construção de uma integração política. Desde cedo, contudo, que os mais proeminentes europeístas como Delors ou Schuman defenderam que uma União económica não seria possível sem instituições políticas à escala Europeia que salvaguardassem a coesão social dos efeitos do mercado livre. Ao longo da sua história, o aprofundamento da integração económica foi marcado por bloqueios e convulsões que iam denunciando a resistência das sociedades relativamente a um Mercado Único Europeu sem uma Europa Social. Do "não" Dinamarquês ao Tratado de Maastricht, em 1992, à rejeição da Constituição Europeia nos referendos populares em França e na Holanda, em 2005, muitas foram as vezes que o projecto Europeu foi tido por condenado, traído por um mercado que tinha ido longe demais e pelo espectro da questão política. Esta dissertação parte da intuição inicial de que a arquitectura institucional da integração Europeia consubstancia uma determinada economia política que Polanyi (1947) designa por Obsoleta Mentalidade Mercantil. A Obsoleta Mentalidade Mercantil traduz a ideia de que a maximização do lucro individual e o princípio do laissez-faire correspondem a uma natureza humana e ordem social espontânea, sobre a qual instituições não mercantis (políticas, regulatórias, etc.) exercem constrangimentos artificiais; criar condições para a instalação de um mercado competitivo e sem distorções ("artificiais") no sistema de formação de preços com base na oferta e na procura seria, portanto, condição suficiente (e ideal) para a coordenação dos actores sociais e económicos. Nada há, contudo, segundo Polanyi, de mais contrário à realidade. A Economia assenta em instituições histórica e culturalmente determinadas, e o mercado deve ser compreendido como um padrão de relacionamento parametrizado por essas estruturas social e historicamente determinadas e incrustado nelas. O que é artificial é, portanto, a desincrustação do padrão de mercado dessas estruturas. Particularmente, a ingenuidade e utopia de um tal projecto residem em que ele ignora a realidade daquilo que Polanyi designa por Mercadorias Fictícias. Trabalho, terra e moeda não foram produzidos para serem vendidos e organizados segundo o mecanismo do mercado. Isto é muito intuitivo relativamente ao trabalho humano: se o valor da mercadoria é definido pela interacção entre procura e oferta, então a mercadoria trabalho tem de estar sujeita a ser deixada de parte, sem nenhum valor atribuído, na circunstância de não haver procura e utilização para ela; isto, como é evidente, não pode ser feito sem arriscar a vida do indivíduo que é o "portador" dessa mercadoria. A mercadoria fictícia trabalho (nesta dissertação, iremos apenas focar-nos na desincrustação do mercado do ponto de vista da mercadorização do trabalho) é desmercadorizada por instituições colectivamente determinadas que definem noções de vida e de oportunidades de bem-estar que devem ser reconhecidas aos indivíduos dessa sociedade, independentemente do funcionamento do mercado. Ao mesmo tempo, contudo, estas instituições limitam a completa organização do trabalho num mercado, produzem atrito a que o seu valor reflicta a interacção entre a oferta e a procura. Reside aqui o paradoxo do mercado, ao mesmo tempo que estas instituições garantem que o seu funcionamento não resulta na destruição do indivíduo e na desagregação do tecido social, é o próprio mercado que pede que o trabalho (elemento essencial da actividade económica) esteja disponível e organizado num mercado competitivo. A criação desse mercado, contudo, ao contrário do que a Obsoleta Mentalidade Mercantil do laissez-faire quer fazer parecer, não tem nada de natural, não corresponde a nenhuma característica ou tendência essencial do mercado para se instalar como mecanismo de coordenação dos indivíduos em sociedade; antes corresponde a um processo altamente artificial de remoção dos parâmetros instalados pelas instituições referidas que colocam obstáculos e produzem atritos. Esse processo artificial de remoção de entraves à organização social num mercado competitivo, importa frisá-lo, é um processo de decisão de remoção desses parâmetros: o mercado é criado legislativa e judicialmente. A artificialidade desta construção resulta em que o mercado nunca pode ser inteiramente desincrustado das estruturas sociais que o parametrizam e que, em particular, que desmercadorizam a actividade humana. Ao mesmo tempo que decisões políticas e judiciais criam e fazem avançar o princípio organizacional do mercado, reacções espontâneas surgem sob as mais variadas formas para recalibrar o tecido institucional de forma a puxar o mercado de volta para uma posição incrustada. É este o fundamental da economia política polanyiana do Duplo Movimento que irá informar a nossa análise: o mercado é criado; a reacção social para reincrustá-lo é espontânea – "o laissez faire foi planeado; o planeamento não" (Polanyi, 2001[1944]: 147, minha tradução) A hipótese que esta dissertação se propõe a investigar é, neste quadro, a seguinte: A história da integração Europeia pode ser contada nos termos da narrativa polanyiana do Duplo Movimento. Para tanto, esta dissertação estruturar-se-á da seguinte forma: (1) o primeiro capítulo desenhará a economia política polanyiana do Duplo Movimento que servirá de quadro teórico à leitura do projecto Europeu, aqui serão identificados elementos conceptuais estratégicos que estruturarão e orientarão toda a dissertação (a noção de uma perspectiva da economia como um processe assente em instituições; o conceito de instituições de incrustação do mercado e desmercadorização do trabalho – relações industriais e Welfare States -, a artificialidade da desincrustação do mercado e o carácter defensivo e desarticulado do segundo movimento). O (2) segundo capítulo partirá da abordagem à economia enquanto processo institucional e da noção de instituições de desmercadorização do trabalho trabalhadas no capítulo 1), e identificará que configurações estas instituições assumem de facto nas economias políticas europeias (deste trabalho, um conjunto de países será seleccionado, pelas suas especificidades institucionais, com vista a uma mais próxima monitorização do processo de desincrustação, ao longo de toda a dissertação). O (3) terceiro capítulo exporá a arquitectura institucional que desencadeia a desincrustação do mercado nas economias políticas europeias; esta arquitectura caracteriza-se por configurar uma assimetria fundamental entre os modos de governação das liberdades de mercado (supranacional-hierárquico) e os modos de governação da construção de instituições de incrustação do mercado à escala Europeia (negociações intergovernamentais). Em particular, identificar-se-á o período pós-Maastricht como o ponto marcante da habilitação desta estrutura de integração assimétrica, que marca a transição, na história da integração Europeia, para uma fase em que esta passa a adereçar as instituições domésticas de desmercadorização do trabalho; assinalar-se-á também o papel estratégico desempenhado pelo Tribunal de Justiça da União Europeia nesta estrutura, assim como no processo de criação do Mercado único e, sobretudo, no processo da sua desincrustação das instituições domésticas. O (4) quarto capítulo exporá como esta estrutura de integração assimétrica se traduziu em actos específicos de criação de mercado. Focar-nos-emos nas liberdades económicas que foram consolidadas com Maastricht: o princípio da livre provisão de serviços, o princípio de liberdade de estabelecimento e princípio da livre circulação de capitais. Estas garantias configuram a criação de um mercado único para a provisão de serviços e para a governação corporativa desincrustado das estruturas colectivas de relações industriais. Este quarto capítulo mostrará também como as liberdades de Mercado, no contexto de integração assimétrica, ameaçam os arranjos institucionais domésticos para desmercadorização do trabalho que se baseiam no financiamento colectivo (no modelo continental de segurança social, baseado em contribuições relacionadas com a participação no trabalho) e/ou no financiamento público (baseado nas receitas fiscais); no contexto de integração assimétrica exposto no terceiro capítulo, o mercado único desencadeia uma "concorrência de regime" (Scharpf, 2001, 2006), traduzida em pressões sobre os custos não salariais do trabalho (o que afecta particularmente os modelos de segurança social baseados nas contribuições do trabalho), e em concorrência fiscal (Ganghof and Genschel, 2007, Genschel et al. 2009). Finalmente, este capítulo prestará ainda atenção às pressões adicionais sobre as instituições dos países da zona euro pela União Económica e Monetária; especificamente, dando conta de como o paradigma subjacente ao Pacto de Estabilidade e Crescimento constrange ainda mais a opção de financiamento público dos Welfare States. Finalmente, o quinto (5) capítulo divide-se em três momentos cruciais. O primeiro identificará tendências de mudança institucional nos campos das instituições de incrustação do mercado (i.e. relações industriais e Welfare States) das economias políticas escolhidas no capítulo 2, que são consistentes com os elementos identificados no quarto capítulo. O segundo momento identificará tendências de reincrustação ao nível de cada uma destas economias, no quadro da distinção polanyiana entre a artificialidade do primeiro movimento de criação de mercado e o segundo movimento defensivo, composto por iniciativas desarticuladas e focadas em dar uma resposta de reincrustação a estímulos de mercadorização particulares. O terceiro momento identificará sinais do segundo movimento à escala Europeia, e avaliará criticamente o seu alcance, no âmbito da integração assimétrica. Finalmente, desta análise da integração europeia como hipótese polanyiana serão retiradas conclusões que possam constituir contributo à construção de uma solução europeísta e democrática para os actuais problemas e estrangulamentos da construção Europeia, não só relativamente à actual crise das dívidas soberanas, mas, mais profundamente (e porque se considera que esta é muito mais uma crise de configuração institucional do que uma crise localizada nos problemas de endividamento externo de algumas economias), relativamente ao problema estrutural da integração assimétrica.
L'obiettivo di questa ricerca è stato quello di definire attraverso l'analisi di studi specialistici che coprono più ambiti disciplinari il significato della conservazione dei paesaggi vulcanici nei suoi diversi aspetti, in altre parole quel complesso di conoscenze (culturali, storiche, semantiche, metodologiche, teoretiche e tecniche) che concorrono alla formazione della cultura del progetto paesistico per gli operatori chiamati a recuperare, riqualificare, pianificare e progettare questi territori vulcanici ad alta specificità ambientale nell'ambito del secondo Novecento. La tesi si articola in quattro capitoli principali, organizzati in sottoparagrafi. Mentre nel primo di questi capitoli si analizza il rapporto in termini giuridici fra il territorio ed il paesaggio, nel secondo si vuole dare una "lettura" alla controversa nozione di paesaggio in quanto di difficile definizione perché la parola paesaggio esprime insieme la cosa e al tempo stesso l'immagine della cosa e pertanto facilmente criticabile a causa della sua ambigua doppiezza. Per poi affrontare nel terzo capitolo le specificità dei paesaggi vulcanici risultati di strette interconnessioni tra numerose variabili fisiche e biologiche. Fondamentale come in qualunque intervento di conservazione è la conoscenza e l'analisi del paesaggio e la comprensione delle relazioni funzionali che storicamente si sono determinate e che hanno dato luogo ai paesaggi che ci sono pervenuti. L'osservazione del paesaggio trascendendo ogni valenza estetica, può interpretarsi come chiave di comprensione del linguaggio del territorio: comprendere tale linguaggio diviene un processo intuitivo, che si concretizza decifrando e capendo le regole interne che caratterizzano la grammatica e la sintassi del territorio. Ma è possibile leggere il paesaggio? Solitamente quando si parla di lettura ci si riferisce a un insieme di segni di cui si conoscono i significati e grazie ai quali si trasmette un pensiero. Il paesaggio formato da tanti segni riconoscibili può essere "letto", interpretato. Una interpretazione che non riguarda però semplicemente i singoli elementi, isolati attraverso una operazione di scomposizione, ma il loro significato in quanto parti di un insieme, come e perché sono connessi nello spazio. La varietà degli elementi visibili può essere tale da rendere estremamente complicata la lettura, senza contare tutto ciò che nel paesaggio resta celato, impercettibile. Le numerose aree disciplinari impegnate negli studi e nelle riflessioni sul paesaggio testimoniano la complessità della questione paesistica, dove gli approcci operativi interdisciplinari hanno permesso di superare la complessità di molti problemi e di guidare in modi sostenibili le trasformazioni del paesaggio. In questa ottica, la conservazione del paesaggio mira ad approfondire la conoscenza, l'etimologia, la genesi ed ad individuare le forme di tutela. La nostra società riconosce nella tutela del patrimonio culturale una necessità inderogabile, connaturata all'essenza stessa del bene, che fonda nel proprio valore intrinseco il suo diritto ad essere tramandato alle generazioni future; dove la stessa Costituzione Italiana all'articolo 9 dichiara che "La Repubblica promuove lo sviluppo della cultura e la ricerca scientifica e tecnica. Tutela il paesaggio e il patrimonio storico e artistico della Nazione". In questa ottica legislatori e soprintendenze hanno operato ed operano per la conservazione dei beni culturali con strumenti come vincoli, cataloghi, archivi, anche se poi avviene che il riconoscimento di un valore ed un regime vincolistico non sono sufficienti a preservarli. Questo perché il vincolo nel senso stretto del termine, può comportare la "cristallizzazione" di una entità vitale, che spesso finisce per danneggiare ciò che voleva proteggere. Nel quarto capitolo analizzando dei casi specifici effettuando un confronto tra gli strumenti di tutela e urbanistici di dette aree vulcaniche ho dedotto che per poter proteggere e conservare il nostro patrimonio non basta individuare e bloccare le azioni potenzialmente dannose, magari conservando le testimonianze più preziose con una sorta di "congelamento" che in ultima analisi negherebbe la più elementare fruizione potenzialmente nociva, ma occorre avere un atteggiamento propositivo fermo restando il rispetto dello stesso. Anche perché da non molti anni il dibattito sui temi paesistici ha imboccato una svolta, dalle preoccupazioni conservative e vincolistiche alla ricerca di metodologie d'intervento e norme attive, che consentano lo sviluppo del territorio compatibile con il mutare delle esigenze collettive. In questa ottica la progettazione paesaggistica che richiede un complesso di conoscenze (culturali, storiche. semantiche, metodologiche, teoriche e tecniche) che concorrono alla formazione della cultura del progetto paesistico può rappresentare un valido strumento per il raggiungimento di questo obiettivo. La svolta è stata sancita dalla Convenzione Europea del Paesaggio che ammette tra gli obiettivi delle politiche del paesaggio anche la creazione di nuovi paesaggi per soddisfare le aspirazioni della popolazione interessata. Leggiamo nella presentazione della Convenzione: "Il testo prevede un approccio operativo articolato in relazione ai diversi paesaggi. Le specifiche caratteristiche di ogni luogo richiederanno differenti tipi di azioni che vanno dalla più rigorosa conservazione, alla salvaguardia, riqualificazione, gestione, fino a prevedere la progettazione di nuovi paesaggi contemporanei di qualità". In questo modo viene ad essere superato l'approccio settoriale al Bene Culturale, con la usuale azione di tutela puntuale concentrata sui singoli "oggetti": il Bene è ora messo in relazione con il contesto, in una visione di sistema. Il Codice dei Beni culturali e del paesaggio ha riconosciuto i Beni paesaggistici come parte del patrimonio culturale superando la vecchia dicotomia che vedeva da un lato i Beni culturali e dall'altro i Beni paesaggistici e ambientali. Il testo di legge ha cosi recepito i nuovi orientamenti che distinguono il concetto di paesaggio e quello di ambiente, il primo risultante dell'opera dell'uomo e dagli agenti naturali sul territorio, il secondo come sistema degli elementi fisico-chimici fondamentali (suolo, acqua, atmosfera) e biologici. Il paesaggio è infatti definito dall'art.131 del Codice come "una parte omogenea di territorio i cui caratteri derivano dalla natura, dalla storia umana o dalle reciproche interrelazioni" in una visione quindi improntata di storicità e in grado di recuperare quella dimensione estetica che sembrava perduta. La legge 9 gennaio 2006, che ha ratificato la Convenzione Europea del paesaggio costituisce una sorte di "rivoluzione copernicana" nella politica paesaggistica italiana. Per la prima volta nel nostro ordinamento giuridico compare una definizione univoca di paesaggio e di politiche paesaggistiche. Dopo decenni d'incertezze viene affermato in modo chiaro che il paesaggio è costituito essenzialmente dalla percezione del territorio che ha chi ci vive o lo frequenta a vario titolo e viene altresì detto che le persone hanno il diritto di vivere in un paesaggio che risulti loro gradevole. Infine si è giunti al recente Decreto Rutelli 26 marzo 2008 n.63, nel quale si afferma ancor di più che il paesaggio è un valore primario e assoluto che va tutelato, Decreto subito battezzato dagli organi di stampa "salva paesaggio". Quest'ultimo ha innescato una stagione di nuovi conflitti fra Stato e Regione per la determinazione delle rispettive attribuzioni, in tema di paesaggi, con conseguenti motivi di incertezza e confusione sul piano applicativo. Secondo il Decreto Rutelli la materia della tutela del paesaggio spetta alla competenza legislativa esclusiva dello Stato, in forza degli artt. 9 della Costituzione. Le Regioni, invece mirano a far ricadere la "materia" nell'ambito del governo del territorio o della "valorizzazione dei beni culturali ed ambientali"(art. 117 Cost.), convinti che il paesaggio sia solo un aspetto del governo del territorio, che rientra nella potestà legislativa concorrente delle Regioni. L'intrinseca ambiguità della questione paesaggistica emerge peraltro fin dalla questione teorica sull'argomento a causa dell'ambivalente capacità del termine di definire insieme l'oggetto e le sue rappresentazioni. Né consegue che i paesaggi sono tanti quanti sono le modalità di percezione-proiezione che di volta in volta vengono messe in azione, dando luogo a inevitabili frizioni interpretative. Questo perché sia paesaggio che territorio sono termini che si riferiscono a concetti, sono cioè paradigmi che servono ad estrarre da una realtà non definita alcuni caratteri significativi rispetto alle intenzioni del soggetto, conseguentemente non esistono concetti univoci e consolidati, bensì relativi e variabili a secondo delle epoche, degli apparati disciplinari, della cultura e delle pratiche reali all'interno dei quali il termine viene concretamente definito. La scelta dei vulcani della Sicilia e della Campania, è dovuta anche al fatto che essi sono stati d'eccezionale richiamo per gli artisti e gli scienziati d'ogni tempo, ed in particolare degli anni dell'illuminismo e del romanticismo, hanno rappresentato motivo d'ispirazione nella letteratura, nel teatro, nella pittura, nella scienza della terra. Pertanto restano una risorsa per il turismo internazionale culturale sempre più interessato ai problemi dell'origine della terra e della sua evoluzione, nel tentativo anche di dare una risposta alle domande essenziali dell'uomo, una risorsa da valorizzare ed utilizzare per il cammino della scienza, che noi tutti abbiamo il dovere di conservare; essi sono il risultato di strette interconnessioni tra numerose variabili fisiche e biologiche, luoghi dove la natura e la storia hanno plasmato il paesaggio, dove gli scenari naturali fanno da sfondo alle vicende umane, in un susseguirsi di avvenimenti che hanno costruito il patrimonio storico, la sua identità culturale. La ricchezza dei paesaggi vulcanici è testimoniata dalla loro evoluzione geologica, la cui valutazione è complessa e spesso di non immediata percezione a causa dei segni e caratteri complessi che si sono succeduti nel tempo. Valorizzare il patrimonio rappresentato dai vulcani ed i loro paesaggi, un'eredità tangibile dell'intera umanità, per le sue capacità di attrarre l'immaginario collettivo mondiale, costituisce una importante risorsa economica che se gestita con accortezza, può contribuire a sostenere lo sviluppo del territorio. Tutelare e sviluppare le potenzialità di questi giganti del fuoco significa salvaguardare tutto il patrimonio culturale, sociale del luogo. Il paesaggio vulcanico per la sua natura, presenta situazioni paesaggistiche particolari: dove valori naturalistico-storico-culturali coesistono con grandi sistemi antropici; l'uso residenziale del suolo ha prodotto le più rilevanti alterazioni dal punto di vista paesaggistico, generando pressioni sul territorio. Alla forza della presenza vulcanica, che modella il paesaggio, si contrappone la forza creatrice dell'uomo, che paradossalmente distrugge. La pressione antropica comporta la perdita semiologica e quindi la perdita d'identità del paesaggio; alla distruzione operata a vario titolo nel passato, possono e devono contrapporsi processi di ricostruzione; tra questi interventi mirati alla salvaguardia e valorizzazione dell'immagine, col massimo rispetto delle dinamiche evolutive naturali connesse al vulcanismo. Uno studio del paesaggio diretto alla formulazione di un contributo per la definizione generale ed operativa di suggerimenti inerenti alla tutela e l'uso del territorio nell'ambito individuato: cioè siti ad alta specificità vulcanica. Considerando il paesaggio non come "risorsa" ma come "patrimonio" Territoriale, cioè come un sistema costituito da strutture di lunga durata con regole inerenti la loro conservazione. Per ciò che concerne gli obbiettivi della ricerca: premesso che il paesaggio è, insieme fenomeno e concetto, entità reale e rappresentazione; esiste in presenza di elementi fisici, i quali prendono senso per le relazioni reciproche, mi sono proposto di fornire suggerimenti ai fini della conservazione dei beni protetti (paesaggi vulcanici), che non si riducono a porre ulteriori parametri di controllo del territorio, ma devono promuovere i valori paesaggistici, con la conseguente valorizzazione degli stessi.
Desde finales del año pasado se han ido sucediendo una serie de levantamientos civiles en gran parte del mundo árabe. Estos levantamientos, que desde Túnez se han expandido con poderoso efecto dominó, conforman una importante etapa en la vida de la región que se ha convenido en llamar, haciendo alusión a las experiencias europeas de 1848, "La primavera árabe". No se trata de revueltas espontáneas y caprichosas, son revoluciones, movimientos que reaccionan contra comportamientos político-sociales mantenidos durante décadas, masas civiles que bregan por alcanzar mayores derechos y el pleno respeto de los ya logrados. Por su parte, es también la búsqueda de democracia, como aseguran muchos involucrados y analistas del caso. Se ha señalado el levantamiento tunecino de diciembre de 2010 como el inicio del efecto dominó. La ex colonia francesa ha sido gobernada desde 1989 por Zine El Abidine Ben Ali, quién alcanzó el poder mediante un ejercicio formal del sufragio. El partido de Ben Ali (Néo-Destour) logró mantener atomizada a la oposición y gobernó en forma corrupta, utilizando el tráfico de influencias y el nepotismo. La desigual distribución del ingreso ha ido profundizándose entre la cúspide de la pirámide y cerca de 3 millones de desempleados (de un total de 11 millones de habitantes) en el otro extremo. El detonante del levantamiento fue una importante suba del precio de los alimentos básicos en diciembre de 2010. El levantamiento pedía la inmediata dimisión de Ben Ali y todo su plantel político.A Túnez le siguió Egipto, donde Hosni Mubarak gobernó casi 30 años desde el asesinato de Anwar el Sadat. Mubarak también ejerció el poder en forma arbitraria y corrupta, teniendo un férreo control sobre las expresiones independientes. Tanto en el caso de Túnez como en el de Egipto, las revueltas lograron la pronta dimisión de sus mandatarios.Esto no sucedió en Libia. Allí, el conflicto interno comenzó en febrero de este año y dividió al país entre los que pugnaban por la renuncia del histórico líder, Muamar El Kadafi, y quienes lo apoyaban y aún hoy apoyan. El efecto continuó difundiéndose por Siria, Yemen y Bahrein y ha tenido importante influencia en Jordania e incluso Arabia Saudita, aunque sin el mismo grado de violencia.No es posible acercarse a este complejo drama socio-político sin antes realizar una breve mención de algunos acontecimientos históricos que le han dado sustento. Desde el fin y escisión del Imperio Otomano, hacia finales de la Primera Guerra Mundial, pasando por el período de los "Mandatos Orientales", hasta la creación del Estado de Israel y las subsiguientes guerras sino-árabes, se ha reflejado un proceso que ha derivado en la creación de Estados organizados de forma piramidal, cuyo vértice ha generado un enorme peso estructural.La caída del imperio Otomano tras la primera guerra mundial, hacia 1920, significó una importante victoria para el Panarabismo. Por su parte, también significó el inicio del colonialismo franco-británico a partir del tratado Sykes-Picot, durante el período llamado "Mandatos Orientales".El apoyo a los aliados por parte de los árabes durante la primera guerra pretendía lograr la égida británica ante cualquier enemigo extranjero y posibilitar la creación de un gran territorio árabe unificado, que comprendiera desde Arabia y los actuales Siria, Líbano e Israel, hasta los Territorios Palestinos, Jordania e Irak. Pero la influencia británica terminó por ser un elemento negativo para el panarabismo. No sólo por el hecho de la no concreción de la unificación y la posterior creación del Estado de Israel, sino porque esa relación promovió aún más el fortalecimiento de los clanes en el poder y las diferencias entre chiítas y sunitas.El período colonial de entreguerras acarreó el fortalecimiento de la relación económico-comercial entre occidente (más específicamente Gran Bretaña y Francia) y los escalafones más altos de las sociedades árabes, las clases regentes, que comenzaban a formarse en oligarquías poderosas. Éstas consiguieron hacerse con el poder y mantenerlo dentro de su círculo.El gran vuelco de Gran Bretaña a la hora de apoyar a los territorios árabes contra cualquier ataque enemigo y ayudarlos a concretar el sueño panarábico de un único reino, asestó el golpe final al promover la creación del Estado de Israel, manteniendo la Declaración de Balfour de 1917. La ofensa para los movimientos nacionalistas árabes que significaba la creación del Estado de Israel y las subsiguientes guerras sino-árabes, terminó por crear un elemento de legitimación de las clases dominantes: la existencia de un enemigo en la región, elemento que funcionaba como una suerte de amalgama de los pueblos árabes.No obstante cualquier elemento unificador, existe el gran problema de la división socio-política entre sunitas y chiítas. Las dos ramas más importantes del mundo musulmán difieren por su visión de cómo deben seguirse las enseñanzas de Mahoma. No se trata de una simple diferencia en la interpretación. En cambio, se trata de una fuerte competencia a lo largo de toda la banda que se extiende desde El Líbano hasta Pakistán, con Irán como principal representante de los chiítas y Arabia Saudíta como principal abanderado de los sunitas. En el trasfondo del conflicto puede distinguirse nuevamente la intervención de las metrópolis europeas durante la colonia, ya que se le daba a las minorías religiosas una mayor representación en los gobiernos y las fuerzas de seguridad coloniales. Ello hoy se traduce en reiteradas persecuciones y purgas de minorías religiosas. Según muchos analistas, es el conflicto "interarábigo", entre sunitas y chiítas, el principal enemigo del proceso hacia lograr más derechos y, eventualmente, la democracia. Sin embargo, el proceso parece continuar con fuerza y ya ha dado sus primeros frutos.De manera irónica, en Turquía ha surgido una figura que es celebrada desde Túnez hasta Ramallah como defensor del orgullo árabe. El primer ministro turco, Recep Tayyip Erdogan, se muestra como fuerte defensor de los derechos palestinos y de los derechos individuales de los jóvenes árabes y se ha manifestado en contra de los sistemas unipartidistas. Es importante destacar que el primer ministro turco se muestra como una figura que alienta el diálogo entre el mundo árabe e Israel, además de tener en cuenta a los kurdos y armenios en su discurso sobre derechos y política de buena vecindad.Otra de las novedades que ha traído esta primavera árabe es que ha dado cierto lugar a la mujer. Por ejemplo, en Libia muchas mujeres participan activamente en células rebeldes contra el régimen de Kadafi. Algunas en carácter de encubiertas, todas ellas ocupando un rol que nunca habrían imaginado ocupar. Más sorprendente aún, según declaraciones del rey Abdalá en Arabia Saudita (país donde las mujeres no pueden conducir automóviles ni pasear solas sin la compañía de un hombre) las mujeres podrán votar en las elecciones municipales a partir del 2015 y tener representación en el Majlis al Shura, una asamblea consultiva cuyos miembros son designados por las autoridades.Para los analistas del resto del mundo, esta primavera es un episodio que genera un gran desconcierto. En palabras de la Secretaria de Estado de los Estados Unidos, Hillary R. Clinton: "Nos encontramos ante un despertar árabe que nadie podría haber imaginado y pocos habrían pronosticado hace apenas unos años… Eso está eliminando mucho de los antiguos preconceptos".Uno de los mayores desafíos será como transitar el camino hacia la democracia. Cabe preguntarse qué deparará ese camino. Considerando la trayectoria de regímenes autoritarios que caracteriza la vida política de los países implicados, la sola idea de instaurar un sistema democrático supone el absoluto derrumbe y reconstrucción del sistema organizacional. Sobre este punto recordemos lo que destacaba el jurista, filósofo y politólogo italiano Norberto Bobbio: "Hago la advertencia de que la única manera de entenderse cuando se habla de democracia, en cuanto contrapuesta a todas las formas de gobierno autocrático, es considerarla caracterizada por un conjunto de reglas (primarias o fundamentales) que establecen quién está autorizado para tomar las decisiones colectivas y bajo qué procedimientos" (1). Para que la organización democrática pueda darse, es irremediable partir de una base individualista, esto es, la sumatoria de todas las voluntades de los individuos que desean convivir juntos en una sociedad.Pensar en un mundo árabe democrático, partiendo desde la voluntad del individuo, genera un gran interrogante desde el punto de vista de la relación entre ese individuo y el mundo que lo rodea. Según Bobbio, el contractualismo de los siglos XVII y XVIII puso de cabeza la concepción medieval de una estructura previa al individuo. El hecho de que sean los individuos, libres e iguales, quienes desde el estado de naturaleza construyen el sistema social, nos pone a pensar en cómo deberá posicionarse un individuo "resignado a la voluntad de un dios único" (concepto tras la palabra islam), al que su gobierno también gusta de "someterse". La no secularización de los Estados islamitas supondría, a priori, un obstáculo a la necesaria voluntad individual previa al sistema de organización social, condición necesaria para construir, según Bobbio, un camino hacia la democracia. Claro que, a diferencia de lo que la mayoría de los teóricos democráticos del siglo XIX creía, la democracia es ahora considerada un valor universal y, por tanto, alcanzable por cualquier civilización. Esto queda claro en Bobbio, donde lo importante es la voluntad de los individuos y no se hace referencia a ningún otro requerimiento. Es posible que los países árabes alcancen la democracia pero para eso, nuevamente tomando a Bobbio, es necesario seguir el camino paralelo del liberalismo, en tanto es necesario el respeto de ciertas libertadas para el correcto ejercicio del poder democrático. En este y otros procesos la completa abolición de la oligarquía es sólo una utopía, así como también lo es el completo respeto de las libertades. El alcance real de ambos depende, en estos momentos, de las masas civiles y los gobiernos transitorios (en aquellos países cuyos gobernantes ya han sido removidos).El peor de los escenarios posibles es uno en el que las revueltas civiles no cesen y los grupos extremistas aprovechen el caos para conducir a las masas a más violencia. El mejor de los escenarios esperables sería uno en que la violencia cesara y los gobiernos transitorios condujeran la organización social según la voluntad de los individuos. La democracia liberal ha enfrentado 3 etapas definidas en apenas 50 años. La primera etapa se consolida en las décadas del 50´ y 60 y tuvo su proceso final en los 80´. Supuso el fin del comunismo como alternativa posible. La breve segunda etapa comienza en 1989 después de la implosión soviética y encuentra un punto de quiebre el 11 de septiembre de 2001. La posterior guerra en Irak refleja el límite del proyecto en marcha. Ese proyecto ha sido el intento de EE.UU. de exportar la democracia liberal como valor universal. La tercera etapa acaba de comenzar. Expresa y consolida los límites del liberalismo. Sin embargo, la pregunta central es si reconocer la existencia de límites supone un fracaso o, en cambio, una oportunidad. Primero nos preguntaremos por qué sería un fracaso. Luego nos preguntaremos por qué sería una oportunidad.¿Por qué la imposibilidad de pensar la democracia liberal como valor universal sería (solamente) un fracaso? Porque, siguiendo a John Gray, una parte esencial del liberalismo consiste en definir la existencia de derechos individuales a-temporales. Paso seguido, si se demostrara la imposibilidad de esa a-temporalidad, luego, esa concepción filosófica política no podría ser local. Es decir, o sería universal o no sería nada. En esta lógica, el liberalismo como expresión solamente local devendría una contradicción u oxímoron. Si bien Gray ha desarrollado esta posición en su última etapa analítica, anteriormente había desarrollado mas convincentemente una alternativa. Las dos caras del liberalismo estarían expresadas en dos filosofías opuestas: la tolerancia como medio o la tolerancia como valor en sí mismo. En palabras de Gray: "El Estado liberal se originó en la búsqueda de un modus vivendi. Los regímenes liberales contemporáneos son floraciones tardías de un proyecto de tolerancia que se inició en Europa en el siglo XVI. La tarea que heredamos consiste en reacondicionar la tolerancia liberal para que pueda guiarnos en la búsqueda de un modus vivendi en un mundo más plural. La tolerancia liberal ha contribuido inconmensurablemente al bienestar humano. No estando en parte alguna tan profundamente arraigada como para darla por descontada, es un logro cuyo valor no podría ser más alto. No podemos prescindir de ese ideal tardomoderno, pero tampoco puede ser nuestra guía en las circunstancias tardomodernas actuales porque el ideal de tolerancia que hemos heredado encarna dos filosofías incompatibles. Vista desde un ángulo, la tolerancia liberal es el ideal de un consenso racional sobre el mejor modo de vida posible. Desde el otro, es la creencia en que los seres humanos pueden florecer en muchas formas de vida. Si el liberalismo tiene un futuro, este reside en el abandono de la búsqueda de un consenso racional sobre el mejor modo de vida posible…" (1)El liberalismo y sus límites como programa de investigación supuso para Gray dos etapas diferenciadas. Por un lado, la crítica a la pretensión liberal-iluminista de poseer una filosofía política con valor universal y su posterior re-significación local. Sin embargo, la segunda etapa supuso el intento de desarrollar un programa de investigación que revelara no sólo la imposibilidad del liberalismo como valor local sino, mas aún, lo positivo de ese fracaso definitivo (tanto local como universal). Mientras la primera etapa de la crítica de Gray al liberalismo era rigurosa y necesaria, la segunda etapa ha carecido de la rigurosidad de la primera y, consecuentemente, ha devenido polémica por lo dogmática (2).¿Cómo podría explicarse este derrotero intelectual y analítico? En parte, por el papel histórico que, para Gray, ha tenido el iluminismo en la construcción de la idea de Occidente. Occidente, el liberalismo y la democracia liberal han expresado contemporáneamente "buenos" valores. Sin embargo, el racionalismo iluminista ha generado tragedias que han devenido inconmensurables (3). Es decir, la magnitud de las modernas tragedias, consecuencias tardías del iluminismo, han hecho moralmente imposibles la posibilidad de sopesar los "éxitos y fracasos" del mencionado proyecto iluminista. Para Gray, el liberalismo como proyecto universal es hijo moral del iluminismo europeo y, por ende, es en parte responsable de la tragedia (moral) de la Europa contemporánea. Es secundario que esta tragedia haya sido expresada por el fascismo y el comunismo, dos corrientes políticas en las antípodas del liberalismo. Mas aún, para Gray sería importante pero secundario que ambos totalitarismos hayan sido derrotados por la tácita colaboración inter-temporal de democracias liberales.En segundo lugar, nos preguntamos: ¿Por qué la imposibilidad del liberalismo como proyecto universal sería una oportunidad? Porque generaría los incentivos para pensar las bondades analíticas y políticas de distintos desarrollos locales. Si el liberalismo es uno entre otros (entre tantos) modus vivendi, la real dimensión de su valor local lo dará la capacidad de esas expresiones de prosperar. Desde otro ángulo, podemos intentar responder la misma pregunta: la imposibilidad de realizar la aspiración universal no refleja los limites del liberalismo sino del iluminismo. En la misma lógica, podemos pensar que la imposibilidad de concretar la aspiración universal ayudará al liberalismo a percatarse que algunas particularidades locales tienen manifestaciones regionales inéditas en la historia moderna. El proyecto europeo es una de ellas. Por el momento, es la mas sofisticada expresión política de las virtudes humanas. La necesaria mención de las carencias y miserias que también posee el proyecto europeo probablemente lo haga, en parte, aún mas humano. El proyecto europeo y la idea de Europa se han convertido en un desafío analítico relevante para la filosofía grayeana: siguiendo su propia lógica, el liberalismo no solo demuestra tener vida local después de su muerte universal sino que, mas aún, se encamina, con avances y retrocesos, a consolidar una forma de buena vida regional.La democracia liberal versus los Estados Unidos de NorteaméricaLa democracia liberal ha tenido refugio político y analítico en aquello que denominamos Occidente. Mas particularmente, Europa, Norteamérica (EE.UU. y Canadá), Japón, Australia y Nueva Zelanda. El Primus inter pares ha sido EE.UU. Sin embargo, la democracia liberal como noble tradición filosófica-política ha encontrado un adversario en la calidad de las instituciones contemporáneas de los EE.UU.Como ejemplos relevantes, podemos mencionar la ley patriótica o "Patriotic Act" (4), las violaciones a los derechos humanos en Guantánamo, los abusos en la cárcel iraquí de Abu Ghraih y el discurso xenófobo y provinciano del ala conservadora del Partido Republicano. El movimiento populista Tea Party ha sido la principal innovación político partidaria en la etapa posterior al 11 de septiembre de 2001. Después del triunfo de Barack Obama en noviembre de 2008, el Tea Party se ha consolidado como una opción de la coalición conservadora para, tanto desde dentro como desde fuera del Partido Republicano, influir en la dinámica del debate público. Particularmente, el movimiento ha sido exitoso en las elecciones de medio término en 2010, donde sus candidatos alcanzaron 60 escaños de un total de 435 (5). Dado que los republicanos han logrado la mayoría en la Cámara de Representantes, estos 60 votos son decisivos en las negociaciones. Ello se ha reflejado en el duro debate de julio y agosto de 2011, donde se alcanzó con mucha dificultad un acuerdo para elevar el tope de la deuda pública.Independientemente de la coyuntura, es posible sostener que la calidad del debate en la democracia mas antigua del mundo continuará empobreciéndose. Para ello, influyen principalmente dos problemas estructurales: la captura que los grupos de interés han realizado del proceso económico y la creciente captura que los sectores radicales han realizado del proceso político.Si esta dinámica es correcta y estable, la democracia liberal se enfrenta a la necesidad ética y política de redefinir el papel y significado que en el "Liberal Project" ha poseído y posee la inédita experiencia americana. Si la democracia liberal pudiera ser analíticamente asociada mas a la idea de Europa que a la realidad americana, podría recuperar parte del prestigio perdido en el irresponsable proyecto del siglo americano pensado por la administración Bush (2001-2009) (6), en el cual la aventura en Irak ha sido la expresión mas cabal.La difícil realidad política y moral que enfrenta EE.UU. es una buena oportunidad para el liberalismo: esta noble tradición de pensamiento no tiene una obligación analítica de hacerse cargo de la incapacidad de uno de sus modus vivendi. Si bien puede haber sido, en el pasado cercano, un modus vivendi particularmente relevante para el liberalismo contemporáneo, ha dejado de tener un valor analítico sustancial. Esto se explica por dos motivos: por un lado, en el camino de lo universal a lo local, la experiencia americana ha perdido preponderancia en tanto una de sus principales virtudes era, precisamente, informar al resto del mundo de las supuestas bondades únicas de una forma de vida particular. Por otro lado, una vez asumida la incapacidad de transformarse en una filosofía universal, la forma de vida local que ofrece América ha reflejado y refleja, sorprendentemente, demasiadas carencias.EE.UU. ha dejado de expresar una aspiración universal. Una sorpresiva secuela de ello ha sido que su forma de vida local ha devenido también poco atractiva. Ello es una mala noticia para esa experiencia particular pero no necesariamente debe serlo para el liberalismo.(1) Gray, John (2001): "Las dos caras del liberalismo. Bei der Sächsischen Längsschnittstudie handelt es sich um eine sozialwissenschaftliche Längsschnittstudie. Sie wurde 1987 begonnen und untersucht über die Vereinigung der Deutschen Demokratischen Republik (DDR) und Bundesrepublik hinweg den politischen Einstellungswandel junger Erwachsener in den neuen Bundesländern. Seit der 16. Welle (2002) wird das Thema Arbeitslosigkeit und Gesundheit intensiv untersucht. Einen weiteren neuen Schwerpunkt stellen Fragen zu Partnerschaft und Persönlichkeit dar.

At all times, people had to adapt to processes of ecological change. But the strategies and mechanisms of the adapting of livelihoods to those processes have certainly gained more and more global attention since the effects of climate change are said to be one of the most crucial topics (not only) in the field of development studies and development practice in the 21st century; even though there always has been critique on the accuracy and the underlying methodological approaches of the estimated dramatic consequences of global warming and its alleged implications for adaptation measures (e.g. Dessai et al. 2009) or its interference with certain political agendas, respectively (e.g. Lomborg 2007). However, the worldwide substantial growth rates of industrialization, motorization and urbanization within the last decades and centuries have (at least) contributed to a global process of climate change, which is expected to become a fundamental challenge of mankind in the 21st century. Its assumed short-term consequences in form of natural disasters, such as floods, droughts or cyclones, as well as its long-term consequences like dramatic shifts of rainfall patterns, rising temperatures, desertification or rising sea levels, have the potential to significantly affect agricultural production worldwide. In particular the livelihoods of millions of agricultural small-scale producers in the developing countries in the tropics and sub-tropics are considered to be endangered by environmental degradation and its effects, which are not necessarily and solely caused by results of climate change. Especially for the poor rural population in these countries, processes of ecological degradation are a predicted threat to their livelihoods, which manifests itself in the form of rising levels of poverty and food insecurity. Within the last two decades, the international debate concerning the main challenge of the alleged consequences of global environmental change shifted from attempts of mitigation these changes to finding means and ways of adapting to them. Wide parts of the literature mainly perceive the adaptation of livelihoods in rural areas of the developing world as a procedure which is or has to be initiated by NGOs, governmental organizations or international donor agencies (e.g. Agrawal 2008; Reid and Vogel 2006). However, this 'mediating' perception on adaptation does not address processes which are solely based on the initiative of local people and pushed forward by them, respectively. In the following, these local developments will be understood as activities where individuals or communities on site generate adaptive measures that are spread without the mediation or interference of donors or agencies. This study will prove that local processes of livelihoods adaptation can be mainly based on existing local knowledge, local institutional settings and local patterns of social organisation. In contrast to that, the mediating perception on livelihood adaptation aims at establishing new regimes for adaptation related resources. Secondly, this thesis wants to deal with the adaptation of livelihoods in a holistic perspective. This means that it does not only cover climate or other ecological parameters since several studies on farmers in Sub-Saharan Africa (e.g. Ponte 2002; Bryceson 2002) underline that within the last decades, besides climate change, also many political, demographic or economic processes like the structural adjustment programmes in Sub-Sahara Africa during the 1980s have severely affected peasant livelihoods and have 'called into play a multitude of diverse and dynamic activities geared towards making a secured livelihood' (Yaro 2006: 126). Although many authors from the mid 1990s onwards have diagnosed a trend towards deagrarianisation in Sub-Saharan Africa , subsistence farming is still the central element of a large majority of African rural people's livelihood portfolios. At the same time, peasant or small-scale agriculture is increasingly being perceived as a future rather than a phase-out model for the agricultural development in Africa in times of severe ecological, political and economic changes and challenges - contrary to the traditional modernization theory driven view on small-scale agriculture (Toulmin and Guèye 2005). This thesis has been written in the framework of the GLOWA Volta Project (GVP). The German Federal Ministry for Education and Research (BMBF) has launched several research projects, whose foci are on global climate change and its interference with local hydrological and socio-economic conditions. The GLOWA Volta project was initiated as one of these projects. The overall objective of this project is the analysis of the socio-economic and physical determinants of the hydrological cycle in the West-African Volta Basin in the face of global environmental change. The project's main aim is the establishment of a scientifically sound Decision Support System (DSS) for all relevant stakeholders and actors in the area of water resource management. Particularly, the availability and the management of water under changing environmental conditions is one of the most important objectives of the GLOWA Volta Project. Within the overall project, different types of irrigation and their livelihood-adaptive potential were studied from the beginning of the project onwards. The specific hydrological and socio-economic impacts of different irrigation systems represented an important element in the research agenda of the project. In order to understand the impacts and drivers of the expansion of irrigation farming, also the expansion of shallow groundwater irrigation (hereafter SGI) in Ghana's Upper East Region - a purely farmer driven expansion process - became one of the project's research focuses. SGI can be perceived as an income earning strategy to reduce vulnerability: besides other ecological changes, the Upper East Region, Ghana's second-poorest region, is expected to be affected by processes of climate change like enhanced rainfall variability leading to an increased vulnerability of the local peasant population towards harvest insecurity and thus also towards food insecurity. These predicted effects of ecological change are no longer 'still up in the air' but can be already felt at present by many small-scale farmers. SGI is an irrigation form that is based on the use of near-surface groundwater close to small riversides, which usually fall completely dry during dry seasons in Northern Ghana. The groundwater is either pulled up with buckets out of wells on riverside plots or it is pumped out of dugouts in the riverbeds via motor pumps. This small-scale irrigation kind is practiced during the dry season to an increasing degree in several places in North-Eastern Ghana. Where until the early 1990s this irrigation form was practiced by only a few farmers, a heavy boom of dry season SGI farming could be observed in the last one-and-a-half decades. There are several driving forces for that: SGI is not hard to learn for the local farmers and this knowledge can be easily shared among the farmers. Furthermore, the initial investment costs - at least for the farmers who do not use an irrigation pump - are comparatively low. Usually, there is no problem in accessing the necessary farm land and additional labour due to a high degree of local solidarity. Finally, infrastructural improvements have contributed to more attractive market channels for SGI farmers in the study region, where many of them cultivate tomatoes during the dry season. It can therefore be assumed that currently several thousand farmers in Ghana's North have adopted this cultivation method. On the other hand, labour migration, which - although highly interlinked with patterns of regional underdevelopment - traditionally has been the most important way for peasant households in Northern Ghana to cope with natural disasters like floods or droughts but also to mitigate the consequences of food shortages or epidemics, is on the decline. Initially forced by the British colonial administration and later on a voluntary basis, many young 'Northerners' left in the dry season, where in the North no rain-fed cultivation is possible, to the Southern part of (pre-independent) Ghana to work in the goldmines or on cocoa farms. The peasant communities in the North started to appreciate this form of migration to an increasing degree as it did not only reduce the pressure on the home households' food stocks when one or more of its members went to the South to work during the dry season. But also cultural implications play an important role. Travelling to the south rose in the Northern population's esteem because it introduced their young men to concepts of modernity. Furthermore, the experiences and knowledge migrants could gain during their labour migration stays were widely regarded as very valuable for the home communities. Migration, also in its more permanent forms, has thus become a daily routine for wide parts of the North-Ghanaian population. But especially in the areas where dry season farming has become more important within the last years, migration flows have decreased. At this point, the question is: why has SGI developed into such an attractive livelihood (adaptation) strategy in Ghana's North within the last years whereas seasonal migration as a strategy to mitigate the consequences of events threatening small scale farmers' livelihoods dropped significantly despite its traditionally high economic and cultural appreciation? Or to be more precisely: what are the underlying social, political, cultural or economic factors leading to an increase in SGI and to a decrease in seasonal migration? This question will be the central research question for this thesis whereas not the decision making process on both livelihood strategies - SGI and seasonal migration - will be in the focus of the analysis but rather the specific developments of both adaptive processes in their historical, political, cultural and economic contexts. The complexity of households and further social structures which form livelihoods and their specific compositions make the adapting or non-adapting of certain strategies to more than just a simple 'either-or' decision as the title of this thesis - irrigate or migrate - involuntarily might imply. Seasonal migration and SGI can both be regarded as livelihood strategies as well as livelihood adaptations at the same time. Based on the findings and suggestions of the relevant recent literature, a livelihood strategy can be understood as a process in which people access necessary assets via a complex setting of institutions, social relations or organisations. Therefore, an adaptation of a livelihood strategy is an adjustment or modification of the whole process, which is usually caused by certain triggers in the context of the livelihood system, e.g. changing ecological patterns affecting farming outcomes or changes in the economic framework conditions. Livelihood adaptation and livelihood strategy thus constitute a close nexus. To operationalize the central research questions, the theoretical construct of livelihood strategy/ adaptation and its theoretical and causal implications are the base for the analysis framework. The developed framework is the starting point for the further analysis of this thesis. In a second step, the region the study is covering will be introduced. Particularly, the current processes of ecological change and the traditional adaptive economic and cultural meaning of migration patterns as well as the interference of labour migration with regional underdevelopment will be described. Furthermore, the description of the local patterns of social organisation will be an important part of this thesis due to their crucial importance in the adaptation context. Based on that, an empirical part analyzes the processes of irrigation farming and seasonal migration within the described framework. Based on that, the research questions will be answered in the conclusion part.
En 1989 John Williamson utilizó por primera vez la expresión "Consenso de Washington" para referirse a una serie de pautas que el modelo económico occidental (los Estados Unidos, el FMI, el Banco Mundial) proponía como receta para el desarrollo. Se trataba de 10 principios asociados al liberalismo económico: disciplina presupuestaria, reorientación del gasto público (de subsidios ineficientes e indiscriminados a inversiones productivas en enseñanza, salud e infraestructura), reforma fiscal, liberalización financiera, tipo de cambio competitivo, apertura comercial, liberalización de la inversión extranjera directa, privatización de empresas públicas, desregulación (principalmente eliminación de trabas no arancelarias), y seguridad jurídica para los derechos de propiedad intelectual.Los países en vías de desarrollo han interpretado en algunas ocasiones tales principios como una nueva forma de dominación de los países desarrollados. En parte debido a que las grandes instituciones del orden internacional han exigido a los países del sur aplicar políticas económicas guiadas por estas pautas y los resultados, en muchos casos, no han sido los esperados.En cambio, quien sí ha obtenido resultados impresionantes con sus lineamientos económicos ha sido China. Desde finales de la década de los 70, cuando su economía comenzó el proceso de reforma, y mucho más intensamente en la última década, su espectacular crecimiento ha logrado que el resto del mundo se detenga a intentar comprender y analizar los aciertos y errores de su modelo de desarrollo. Su evolución económica, manteniendo un crecimiento de dos cifras por un período tan prolongado (algo inimaginable por estos tiempos en las economías occidentales), combinado con una política exterior por momentos desafiante y desconcertante, lleva a los analistas internacionales a observar con atención su estrategia de crecimiento y a examinar los motivos por los cuales, en varias ocasiones, China no suele aceptar las reglas del orden internacional creado por las potencias occidentales –principalmente, Estados Unidos. En el año 2004, Joshua Cooper Ramo popularizó el término "Consenso de Beijing" (en contraste con el "Consenso de Washington") procurando explicar el modelo chino de desarrollo. La comparación entre los resultados de ambos casos ha provocado en el análisis internacional la siguiente interrogante: "¿Es el Consenso de Beijing una alternativa viable para los países en vías de desarrollo?" Este cuestionamiento ha cobrado especial relevancia a partir de la última gran crisis económica internacional que impactó profundamente en las principales economías mundiales.Para poder responder esta pregunta es necesario entender cuáles son los conceptos que están por detrás del Consenso de Beijing y que han permitido, en última instancia, que China se convierta en la segunda economía más grande del mundo.Si bien el Consenso de Beijing no tiene pautas específicas como el Consenso de Washington, existen ciertas características que los analistas destacan como diferenciales del modelo chino de desarrollo.En primer lugar, se destaca la innovación y la experimentación constante. Según Andrés Oppenheimer: "Deng Xiaoping diría que no importa el color del gato, sino que atrape ratones: esa frase es la que te repiten los chinos cada dos minutos, y es de un pragmatismo absoluto" (1). Sin lugar a dudas, es este pragmatismo y capacidad de adaptarse a las situaciones lo que ha permitido que hoy China siga teniendo un régimen comunista de partido único, y a la vez sea el paraíso de las grandes empresas multinacionales. En este sentido, se puede destacar el modo en que China ha gestionado la última crisis mundial reestructurando parte de su economía, potenciando sectores tecnológicamente avanzados, de forma que la economía se mueva hacia segmentos de valor añadido en la cadena productiva.Otra característica muy importante es la autodeterminación: el gigante asiático ha logrado conjugar su nuevo protagonismo internacional con una constante independencia en todos los órdenes del funcionamiento del orden global. A diferencia de lo que sucedía en el pasado con los países en vías de desarrollo, China se ha parado ante el mundo como un actor preparado para participar en las discusiones de igual a igual, sin acatar las órdenes de ningún otro estado y poniendo sus intereses en primer plano.Sin embargo, esta característica ha dado lugar a ciertos reparos del resto de los principales actores del orden internacional ya que por momentos la actitud de China parece desconcertarlos. Un claro ejemplo de este tipo de escenario es la inserción china en el continente africano. Desde el comienzo de la última década, África ha tenido para China una importancia estratégica y económica fundamental (facilitándole ayuda económica, asistencia financiera y militar). Esta estrategia en el manejo de su política exterior desafía las expectativas occidentales de un continente africano gobernado por Estados de Derecho, democracias basadas en el respeto a los derechos humanos, y una estrategia económica de libre mercado. Estados Unidos se encuentra entonces con un poder que no lo enfrenta directamente sino que lo eclipsa; legitima y asiste sin condiciones ni exigencias a regímenes autoritarios africanos lo que hace que la influencia o ayuda que pueda ofrecer Estados Unidos o Europa hacia esa región (fuente de recursos y energía) no despierte interés.Esta situación, no sólo se ve favorecida por la crisis internacional sino que además para Occidente se hace difícil promocionar un proceso de democratización a escala global que se encuentra, luego de esta última década, bastante deslucido: las guerras en Irak o Afganistán en buena medida se han llevado a cabo en nombre de la democracia. China por su parte alega que está jugando con unas reglas que no creó, realizadas en otro tiempo y para otra estructura de poder mundial. Mejorar la sociedad era uno de los objetivos de los países en desarrollo hasta que en los años noventa fue dejado de lado por el Consenso de Washington; el Consenso de Beijing lo toma como uno de sus principios fundamentales. Esta sería la única manera de evitar el caos en una sociedad tan compleja que está viviendo un crecimiento tan vertiginoso. En contraste, muchos países de Latinoamérica que durante fines del siglo XX también aumentaron su PBI, agrandaron la brecha social. Hace un tiempo las tapas del People's Daily solían mostrar a los líderes locales inaugurando grandes y ostentosas obras. En cambio, hoy en día es normal ver a esos mismos líderes reclamando ayuda para algún área rural pobre: las autoridades Chinas saben que mejorar el nivel de vida de sus gobernados es esencial para que la situación no se vaya de las manos. China tiene una historia milenaria y conoce a la perfección las consecuencias nefastas que un levantamiento popular puede tener para las autoridades.Ahora bien, el Consenso de Beijing no puede ser comparado con el Consenso de Washington como diseños del mismo tipo. Mientras que el segundo presenta diez principios puntuales que pueden ser adoptados o no por las autoridades, la principal característica del Consenso de Beijing es justamente la falta de reglas cerradas. Indudablemente, las pautas que propone pueden ser de utilidad para los países en vías de desarrollo, pero no pueden ser equiparadas, analíticamente, a los postulados del Consenso de Washington.Creemos que la pregunta más relevante que cabe preguntarse a partir del análisis del modelo es, ¿se convirtió China en un modelo relativamente maduro para aplicar en otro país? Si hay una lección que dejó el Consenso de Washington, es que no hay ningún modelo de desarrollo universalmente aplicable, pues los países tienen diferentes situaciones económicas y sociales y es imposible crear un modelo que de antemano que pueda asegurar su éxito. China tiene una serie de particularidades que serían imposibles de reproducir y que son base de su modelo: población, territorio, e historia milenaria. Asimismo, China cuenta con la ventaja de ser un miembro permanente del Consejo de Seguridad de la ONU y de contar con un sexto de la población mundial, lo que le permite defender sus intereses con más poder que el resto de los países subdesarrollados.Cuando comenzó su proceso de apertura económica, se pensaba que el modelo era imposible de mantener sin cambios a largo plazo. No se podría avanzar por un proceso de reformas económicas, decían los analistas, sin avanzar por un proceso de cambios políticos. Hasta hoy los fundamentos del sistema político no han cambiado, por lo que hay analistas que cuestionan hasta que punto podrá continuar la prosperidad mientras se censuran y controlan los medios de comunicación y continúa el monopolio del poder político. Thomas Friedman, en su análisis acerca del mensaje que se había enviado hacia Beijing con el otorgamiento del premio Nobel de la Paz (obtenido por Liu Xiaobo) comenta que sin libertad los individuos no pueden desarrollar su potencial total y, en sí misma, la libertad es un ingrediente esencial para el progreso de la sociedad.La historia enseña que una vez que los hombres asimilan la libertad, ya sea económica o política, procuran obtenerla en todos los ámbitos de la vida. El régimen por lo tanto deberá estar preparado para enfrentar la posibilidad de que su población más tarde o más temprano, comprenda el verdadero valor de la libertad y exija la flexibilización del actual régimen político. As elsewhere in the ex-communist/socialist countries, the former planning system in Yugoslavia has been dismantled as from the beginning of 1990s, and the planning practice has from then onwards been steered by an apart mixture of old habits, few institutional innovations and the social, economic and political turbulence of the transition period. The previous system and practice of socioeconomic planning collapsed, so far not to be substituted for by new arrangements, to match the impact of the key factors of the transition period, i.e., political pluralization, privatization and marketisation. On the other hand, albeit the system of spatial/urban and environmental planning has been 're-touched' in the 1990s, the adjustments undertaken have not either been harmonized with the factors mentioned. What can now be recognized as the existing 'planning system' is, however, an strange mix of heterogeneous elements from a number of disparate modes, i.e., 'crisis-management-planning', 'planning-supported-wild-marketisation-and-privatisation', 'project-based-planning', etc. In effect, there is no overall professional and political consensus on the direction and content of reform in this field (which also applies to other key issues). In sum, the existing situation in the planning system and practice reads as follows: (1) The system has almost lost its legitimacy, partly because the majority of the former public interests collapsed, and new, indisputable public interests still not being established. Under such circumstances, new roles of planning are hardly known to the public at large, in part as a consequence of an overall anti-planning stance among the majority of political, economic and expert elites. (2) The inertia rules the professional landscape, since there has been a lack of new approaches and methodologies, to match the impact of new dominant factors and the miserable social and economic conditions in the country. Regarding the approaches and methodologies applied, the traditional ex ante planning evaluation still prevails, and more ex post and ex continuo evaluation is still missing. (3) The planning system is too centralized (within the two republics), since the radical recentralization of Serbia was undertaken in 1990, and subsequently the sub-national tiers were deprived of almost any effective planning instruments. In addition to this, the majority of regional entities ('districts') and communes lack a competent administrative machinery and expertise, as well as other support (e.g., research, planning information support etc.) for effecting autonomous planning policies. (4) There has been no more ambitious strategic planning (which is, however, somehow understandable vis-à-vis only now ended international sanctions and isolation of the country). On the other hand, the majority of the development documents that have been passed in the meantime, grossly lack elaborated implementation devices (policies and instruments). Especially in the field of urban planning, the detailed ('land use') schemes prevail over the more strategic development schemes for larger urban and regional areas. Specific development projects (and, only sometimes, more harmonized programmes) by far outnumber other planning schemes. (5) The integration and harmonization of various aspects of planning and policy, i.e., social, economic, spatial/urban, environmental, is very poor. In effect, physicalism still dominates the scene in spatial and urban planning, and the elements of socioeconomic development and environmental policy are scarce within this block. (6) The stipulated legal propositions pertaining to the openness, participativeness and transparency of the planning/policy procedures fall easily frail in the planning practice, resulting in the very poor content in this regard. (7) There has been a lack of planners and other experts experienced and knowledgeable in practicing planning under the new circumstance of political pluralism and radically changed structure of stakeholders and concomitant institutional arrangements. This also applies to 'educators' in general, because the prolonged international isolation of the FR Yugoslavia has caused the gross of their knowledge and capabilities irrelevant. In sum, it seems that many planners would not be able to assume new roles that they are expected to on the part of the society at large. (8)The planning/policy information, research, institutional and other support provided by the state and other agents often does not satisfy even the most basic needs in this fields, partly for a general scarcity of resources concomitant to the overall and deep social, economic and political crisis the society found itself in the 1990s. (9) Most frightfully, manipulation, paternalism and clientelism still represent dominant forms of power, which is a problem by itself in Yugoslavia being one of the most corruptive countries in the world. What is now most missing is a non-manipulative persuasion, as well as the authority of professional values, as the communication and interaction forms that seem only promising for and supportive to developing of a democratic, emancipatory and transformative planning mode. A number of attempts during the last decade to embark upon the preparation of the new 'Master Plan of the City Belgrade' (in the sequel: MP) came into realization not before the democratic political changes of October 2000 took place in Serbia. However, the so far undertaken steps do not seem promising, as they failed to satisfy a number of methodological and other standards, as well as to introduce necessary innovations. Unfortunately, the MP was commissioned to the Bureau of Urban Planning of the City of Belgrade (otherwise a 'faithful ally' of all non-democratic regimes in the City's urban planning and related matters over the last more than ten years now, during which there has been a so far unrecorded squandering and illegal privatization of public urban assets, mostly uncontrolled and not paid-for). Similarly, vested are to lead and complete the work mostly the experts/planners who 'controlled' and still 'control' the academic and professional scene in the same period (notwithstanding that were compromised and their abilities proved passé on many occasions), now recycled to perform new mission. Albeit the entire project had not been adequately prepared, already two interim documents have been elaborated now, viz., 'A Hypothesis of the Master Plan of Belgrade 2021', and 'A Concept of the Master Plan of Belgrade 2021'. In what follows, a brief review of the work done so far is presented: (1) The role of the MP is poorly defined, which is strange vis-à-vis the pronounced thesis on the 'insuperable role of market', which one renders puzzle about the veritable role of the MP. In addition to this, physicalism features as the key characteristic of this document: social and economic aspects of development are insufficiently present and poorly integrated into the MP, and so are the environmental aspects. The MP will however have to assume a part of socioeconomic development planning and policy as well, because the latter is predictably not likely to get recuperated in some time to come. Furthermore, the social, economic and environmental problems of Belgrade are so tremendous (e.g., extremely high rate of unemployment, probably around 40% of the total work force, obsolete technological, market and other structure of the larger part of Belgrade economy, prolonged crisis of economic growth, overall pauperization of the overwhelming majority of people, many hundred thousand refugees, few hundred thousand of young and educated people who left the country, disproportionate environmental pollution as compared to the level of economic development, etc.), that they must not be ignored in the development documents like the MP. (2) There is no sound conception on the public interests, particularly under the circumstances of a large number of legitimate individual interests fast emerging on the political scene, some of which also persisting to impose themselves as new and legitimate public interests. This results in a feeble notion on the existing and predictable future conflicts, as well as on the planning mechanisms and instruments that will be used in their control and management. (3) The concept of sustainable development has been only 'flirted with' in the MP, whereby a sound doctrine upon which development is to be directed and articulated is also missing (i.e., that which is of relevance for a territorial entity with the GDP of not more than some USD 1 500 per capita). (4) No efforts have been made to introduce more relevant methodological approach, i.e., those which would contrast the miserable socioeconomic and environmental fixities, viz.: (i) A more rigorous ex post evaluation of past decisions has not been performed, implying that future steps will be undertaken upon rather anecdotal insights in the existing power structure, institutional and organizational arrangements and dominant communication and interaction modes in planning. In the same context, the most significant problem of Belgrade area, i.e., how to approach the economic and ecological renewal and rehabilitation of its economy, has been hardly paid sufficient attention to. (This also applies to the position of Belgrade in the broader regional Euro-Asian context, which has terribly eroded over the last decade). (ii) Although the intention of the whole exercise is to work out a 'hard product', i.e., a urban development plan, no ex ante evaluation scheme has been produced so far, implying that the job is not being performed lege artis. Apart from other implications, this failure is particularly handicapping regarding the criteria of ex ante evaluation, leaving the professional audience and the public at large without the sound answers on key questions: What are the criteria upon which the evaluation has been undertaken? Whose are they? What interests stand behind them? Who decides on the criteria that will be applied? Apart from softening the rigour of the expertise, this flaw also allows for too ample 'maneuvering space' for the subsequent arbitrating to be performed by the politicians. (5) A trend-based extrapolation has been used as the key prognostic technique, which is absolutely unacceptable, keeping in mind the poor predictive power (I) and unstable institutional arrangements in planning and elsewhere (II). Instead, the political community would necessitate a number of veritable alternative scenarios of possible/desirable future development elaborated and presented for discussion, deliberation and decision-making in expert arenas and public forums. (6) Perhaps the weakest part of the MP goes to the issue of implementation of planning decisions, giving way to 'visioning' (in effect, to another planning 'phantasmagory'), which is again unacceptable vis-à-vis the pressing and burning realities of Belgrade and its broader surroundings. (7) Finally, an open, transparent and publicly verified 'offer to strategic partners' would also be needed, as the City does not have enough internal resources to cope with the problems of its economic, social, physical and environmental renewal. To conclude, major improvements are needed regarding the planning approach and methodology applied in the preparation of the Master Plan of the City of Belgrade 2021. As this project is likely to carry considerable demonstrational effects throughout the planning scene in Yugoslavia, its highly professional execution is of necessity, so that a major damage is avoided, i.e., that of a further loss of the legitimacy of planning and erosion of the planning profession.
One hundred per cent of the natural units of analysis will continue to be negatively affected, with a concomitant decrease in natures contributions to people, given current trends (business as usual), though the magnitude and exact mechanism of the individual drivers will vary by driver and unit of analysis (established but incomplete){5.4}. For example, tropical moist and dry forest and coastal mangroves will continue to exhibit a decline due to land use change regardless of the scenarios considered, but different local factors (agriculturalization and urbanization, respectively) will be involved (well established) {5.4.1, 5.4.11}. Additionally, some drivers will affect units of analysis differently. Empirical evidence indicates differential effects of climate change: boreal forest is extending northward {5.4.2}, while tundra is diminishing in land area (established but incomplete) {5.4.3}. Thus, some drivers, and their relative roles, will need to be further refined on a local scale and with respect to their proximate factors.2. Multiple drivers will act in synergy and further produce biodiversity loss and impact nature?s contributions to people in most of the units of analysis for the Americas (established but incomplete){5.4}. Climate change, combined with other drivers, is predicted to account for an increasingly larger proportion of biodiversity loss in the future, in both terrestrial and aquatic ecosystems {5.3}. Forest fragmentation, climate change and industrial development increase risk of biodiversity and nature?s contributions to people loss i.e. dry forest unit of analysis {5.4.1.2}. Predictions on invasive species and climate change indicates an increase in habitable areas and their potential impacts on different units of analysis {5.3}.3. Changes in temperature, precipitation regime and extreme climate events are predicted to impact all units of analysis in the Americas (well established) {5.4}. Climate change and the potential impacts on tropical dry forests by changing the frequency of wildfires; change in forest structure and functional composition in the Amazon tropical moist forest; extreme drought events changing nature?s contributions to people in the Amazon region; insect outbreaks and changes in albedo are predicted to significantly impact temperate, boreal and tundra units of analysis, affecting society and indigenous communities and well-being {5.4}.4. Thresholds, or tipping points (conditions resulting in rapid and potentially irreversible changes) may have already been exceeded for some ecosystems and are likely for others (established but incomplete). For instance, it is considered more likely than not that such a threshold has already been passed in the cryosphere with respect to summer sea ice (established but incomplete) {5.4.12}. Model simulations indicate changes in forest structure and species distribution in the Amazon forest in response to global warming and change in precipitation patterns (forest die-back) (established but incomplete) {5.4.1}. So too, a 4oC increase in global temperatures is predicted to likely cause widespread die off of boreal forest due to greater susceptibility to disease {5.4.2} and global temperature increases may have already started persistent thawing of the permafrost {5.4.3}. Under 4°C warming, widespread coral reef mortality is expected with significant impacts on coral reef ecosystems {5.4.11}. Sea surface water temperature increase will cause a reduction of sea grass climatic niche: those populations under seawater surface temperature thresholds higher than the temperature ranges required by the species could become extinct by 2100 with concomitant loss of ecosystem services.IPBES/6/INF/4/Rev.15415. Changes in nature and nature?s contributions to people in most units of analysis are increasingly driven by causal interactions between distant places (i.e. telecouplings) (well established) {5.6.3}, thus scenarios and models that incorporate telecouplings will better inform future policy decisions. Nature and nature?s contributions to people in telecoupled systems can be affected negatively or positively by distant causal interactions. Provision of food and medicine from wild organisms in temperate and tropical grasslands, savannas and forests of South America is being dramatically reduced due to land-use changes driven by the demand of agricultural commodities (e.g. soybeans) mainly from Europe and China. Conservation of insectivorous migratory bats in Mexico benefits pest control in agroecosystems of North America, resulting in increased yields and reduced pesticide costs. Trade policies and international agreements will thus have an increasingly strong effect on environmental outcomes in telecoupled systems.6. Policy interventions have resulted in significant land use changes at the local and regional scales and will continue to do so through 2050. These policies have affected nature?s contributions to people both positively and negatively, and provide an opportunity to manage trade-offs among nature?s contributions to people (well established) {5.4}. Land use changes are now mainly driven by high crop demand, big hydropower plans, rapid urban growth and result in a continued loss of grasslands {5.4.4, 5.4.5}. However, strategies for establishing conservation units have helped in reducing deforestation in the Brazilian Amazon from the period of 2004 to 2011 (well established) {5.4.1}. Similarly, wetland protection policies and regulation have helped reduce the conversion of wetlands in North America {5.4.7}. Policies based on command and control measures may be limited in providing effective reduction in ecosystem loss and should be complemented with policies acknowledging multiple values {5.6.3}.7. Policy interventions at vastly differing scales (from national to local) lead to successful outcomes in mitigating impacts to biodiversity (established but incomplete){5.4}. For instance, long-established governmental protections of wetlands in North America have significantly slowed and may have stopped wetland loss based on acreage {5.4.7}. In South America, where mangrove loss continues at a rate of one to two per cent, different stakeholders such as local communities and/or governments have been successful in protecting mangroves based on empowerment and shared interests in their preservation {5.4.11}.8. Pressures to nature are projected to increase by 2050, negatively affecting biodiversity as indicated by a potential reduction of the mean species abundance index. However, the magnitude of the pressures by 2050 are expected to be less under transition pathways to sustainability in comparison to the business as usual scenario (established but incomplete), {5.5}. The Global Biodiversity model projected that under the business as usual scenario mean species abundance had decreased in the Americas by approximately 30 per cent by 2010 compared to its values prior to European settlement of the New World, with historical losses primarily attributed to land transformation to agricultural uses. Using the Global Biodiversity model, there is an additional projected loss of 9.6 per cent by 2050, primarily attributed to some additional land use changes , and especially to climate change, which will steadily increase relative to other drivers considered in the model. However, under the transition pathways to sustainability of global technologies, decentralised solutions, and consumption change pathways, the projected losses are 6 per cent, 5 per cent, and 5 per cent, respectively,IPBES/6/INF/4/Rev.1542achieving a relative improvement of approximately 30 per cent to 50 per cent compared to the business as usual scenario. Under these pathways, climate change mitigation, the expansion of protected areas and the recovery of abandoned lands would significantly contribute to reducing biodiversity loss.9. Participative scenarios have proven to be a successful tool for envisioning potential futures and pathways and to embrace and integrate multiple and sometime conflicting values and their role in promoting bottom-up decision making in the face of futures uncertainties (well established) {5.3}. The use of participative approaches to develop scenarios has increased during recent years in the Americas. The inclusion of different stakeholders and their knowledges in the process of constructing potential futures has promoted a better understanding of the complexity of the social-ecological systems in which they are embedded. This has enhanced co-learning processes between all actors involved, even those normally under-represented in decision-making activities. As a result, several participative scenario exercises have motivated community-based solutions and local governance initiatives all pointing towards the development of adaptive management strategies {5.3}.10. Pathways that consider changes in societal options will lead to less pressure to nature (established but incomplete) {5.6.3}. An example is the indirect impact that shifts in urban dietary preferences have on agricultural production and expansion, and food options that are expected to continue growing into the future. Therefore, not only is there a strong connection between urbanization and economic growth, but also between affluence (and urban preferences) and the global displacement of land use particularly from high-income to low-income countries.11. Available local studies informing regional futures of nature and natures benefit to people do not allow scalability as of yet (well established) {5.3}. The challenge in expanding the findings from local studies resides in the fact that a number of comparable local studies are still not available. Information is scattered throughout the region by the use of different units, methods and scales, which prevents a local-to-regional generalization. The list of nature indicators used in studies at local scales is large and heterogeneous (well established). Even for the same indicator (e.g. biodiversity), different metrics are used (e.g. species-area curve, mean species abundance) {5.5}. In other cases, multiple indicators are used to describe different aspects of biodiversity and ecosystem services. In this latter case, synergies and trade-offs are explicitly mentioned with a clear pattern in which increasing the provision of some indicators result in the detriment of others {5.3}. For example, agriculture expansion leading to loss in biodiversity illustrates a common trend from local studies expected to continue into the future.12. There is a significant research gap in the development of models and scenarios that integrate drivers, nature, natures contributions to people and good quality of life (well established){5.3}. Models and scenarios can be powerful tools to integrate and synthesize the complex dynamics of coupled human and nature systems, and to project their plausible behaviors into the future. Most existing models and scenarios focus on the link between drivers and its impacts on nature. Few cases exist in which models or scenarios integrate the relationships between changes in nature and changes in natures contributions to people and good quality of life {5.3}. Exakt 20 Jahre nach den Terroranschlägen vom 11. September 2001 kündigte der derzeit amtierende US-Präsident Joe Biden den Abzug aller amerikanischen Truppen aus Afghanistan an. "Es ist Zeit, Amerikas längsten Krieg zu beenden" (Böhm 2021, 92). Bereits vor dem Einmarsch amerikanischer und britischer Truppen am 7. Oktober 2001, bekannt als die Operation "Enduring Freedom", hatte Amerika Stützpunkte der in Afghanistan ansässigen Terrorgruppe Al-Qaida attackiert. Der Grund hierfür waren die durch Mitglieder der Gruppe geplanten und durchgeführten Anschläge auf amerikanische Botschaften in Tansania und Kenia im Jahr 1998. "Aber die Schwelle der Kriegserklärung gegen Terroristen wurde nicht überschritten, auch um Letztere politisch nicht aufzuwerten" (Böhm 2021, 94).Als Wendepunkt gilt der 11. September 2001. Neunzehn Terroristen der Terrorgruppe Al Qaida entführten vier Passagierflugzeuge. Zwei dieser Flugzeuge wurden in die Twin Towers des World Trade Centers gesteuert. Ein weiteres zerstörte den westlichen Teil des Pentagons in Washington. Das vierte stürzte in einem Feld in New Jersey ab. Insgesamt starben durch diese vier Flugzeuge fast 3000 Menschen aus 80 verschiedenen Ländern (vgl. Hoffmann 2006, 47).Die Anschläge veränderten die Wahrnehmung der durch den Terrorismus bestehenden Bedrohung. Bereits wenige Tage nach den Anschlägen verkündete der damalige US-Präsident George W. Bush den "Global War on Terror" (Böhm 2021, 92), eine Kriegserklärung an den Terrorismus. Damit definierte er die Auseinandersetzung mit dem Terrorismus als Krieg.Neben dieser Auslegung gilt auch die Interpretation des Verhältnisses zwischen terroristischen Gruppierungen und Amerika feindlich gesinnten Staaten als entscheidend. Unmittelbar nach den Anschlägen wurde zunächst nur die Bekämpfung der Terrorgruppe Al-Qaida und des Taliban-Regimes in Afghanistan priorisiert. In den darauffolgenden Monaten wurden neben diesen auch den Terrorismus unterstützende, autoritäre Staaten und Staaten mit Zugang oder Beschaffungsmöglichkeiten von Massenvernichtungswaffen zu möglichen Zielen von Militäraktionen zur Bekämpfung des Terrorismus (vgl. Böhm 2021, 92; Kahl 2011, 19).Durch die Anschläge am 11. September 2001 wurde neben der "seit längerem bekannte Dimension der internationalen Kooperation von terroristischen Gruppen […] die neue Dimension der transnationalen Kooperation, Durchführung, Logistik und Finanzierung terroristischer Gewalt deutlich" (Behr 2017, 147).Im Rahmen dieses Beitrags wird der Terrorismus als eine Herausforderung für die Vereinten Nationen vor und nach den Anschlägen vom 11. September 2001 thematisiert. In diesem Zusammenhang wird der Frage nachgegangen, inwiefern diese die Sicherheitspolitik der Vereinten Nationen beeinflusst haben. In einem ersten Schritt wird eine Klärung des Begriffs Terrorismus vorgenommen. Im Anschluss daran wird auf die Strategien der Vereinten Nationen zur Bekämpfung des Terrorismus vor dem 11. September 2001 eingegangen. Darauf folgt eine Darstellung der direkten Reaktionen der internationalen Staatengemeinschaft auf die Anschläge. In einem letzten Schritt werden die daraus resultierenden Folgen für die internationale Sicherheitspolitik näher beleuchtet.BegriffsklärungIn einem ersten Schritt gilt es nun, den Begriff des Terrorismus näher zu definieren. Der Begriff leitet sich von dem lateinischen Wort terror ab, das als Schrecken oder Furcht übersetzt werden kann (vgl. Pfahl-Traughber 2016, 10). Nach dem Terrorismusexperten Bruce Hoffmann wird unter dem Begriff des Terrorismus die "bewusste Erzeugung und Ausbeutung von Angst durch Gewalt oder die Drohung mit Gewalt zum Zweck der Erreichung politischer Veränderung" (Hoffmann 2006, 80) verstanden.Dementsprechend ist eine terroristische Tat zunächst einmal gekennzeichnet durch die Androhung oder die Ausübung von Gewalt. Im Hinblick auf die Intensität der ausgeübten Gewalt wird deutlich, dass keine humanitären Konventionen respektiert werden und terroristische Anschläge sich oft durch "besondere Willkür, Unmenschlichkeit und Brutalität" (Waldmann 2005, 14) auszeichnen."Die Gewalttat hat primär einen symbolischen Stellenwert, ist Träger einer Botschaft, die in etwa lautet, ein ähnliches Schicksal kann jeden treffen, insbesondere diejenigen, die den Terroristen bei ihren Plänen im Wege stehen" (Waldmann 2005, 15). Basierend auf dieser Tatsache bezeichnet der Soziologe Peter Waldmann den Terrorismus "primär [als] eine Kommunikationsstrategie" (Waldmann 2005, 15).Auf der psychologischen Ebene verfolgt der Terrorismus das Ziel, über die unmittelbaren Ziele und Opfer hinaus bei einer bestimmten Gruppe Furcht hervorzurufen, um für deren Einschüchterung zu sorgen. Als Zielgruppe kommt neben Staaten, Regierungen und einzelnen religiösen oder ethnischen Gruppen auch die allgemeine öffentliche Meinung in Frage (vgl. Hoffmann 2006, 80).Davon ausgehend verfolgt der Terrorismus mit der Erzeugung von Furcht und Schrecken auf der politischen Ebene das Ziel, das Vertrauen in eine bestehende politische Ordnung zu erschüttern (vgl. Waldmann 2005, 16). Im Hinblick auf die politische Dimension des Terrorismus grenzt Waldmann diesen bewusst vom Staatsterrorismus ab. Nach Waldmann kennzeichnen terroristische Anschläge ihre planmäßige Vorbereitung und ihre Aktivität aus dem Untergrund heraus.Im Gegensatz dazu handelt es sich bei Staatsterrorismus um ein Terrorregime, errichtet durch staatliche Machteliten. Von Seiten des Staates kann zwar Terror gegenüber seinen Bürgern ausgeübt werden, er ist jedoch nicht in der Lage, die genannten Strategien gegen die eigene Bevölkerung einzusetzen (vgl. Pfahl-Traughber 2016, 17; Waldmann 2005, 12).Bei den Akteuren handelt es sich um einen Zusammenschluss von Handlungswilligen, die sich in annähernd bürokratischen Strukturen organisieren, wobei Hierarchien und informelle Abhängigkeiten entstehen. In den meisten Fällen verfügen diese Gruppierungen über eine "geringe quantitative Dimension […] handelt es sich doch überwiegend um kleinere Personenzusammenschlüsse von wenigen Aktivisten" (Pfahl Traughber 2016, 12).Diese agieren im Untergrund, da sie weder über den erforderlichen Rückhalt innerhalb einer Bevölkerung noch über die erforderliche Kampfstärke verfügen. Am Beispiel von Al-Qaida in Afghanistan wird deutlich, dass ein Hervortreten aus dem Untergrund, beispielsweise durch die Errichtung von Lagern, das Risiko impliziert "angegriffen und vernichtet zu werden" (Waldmann 2006, 13).Hinsichtlich der Bezeichnung werden im Sprachgebrauch zwei Arten von Terrorismus, der internationale und der transnationale Terrorismus, unterschieden. In diesem Zusammenhang stellt sich die Frage, ob das Phänomen des Terrorismus eher als international oder transnational zu bezeichnen ist. Nach Steinberg zeigt sich aus historischer Sicht ein fließender Übergang von dem internationalen Terrorismus hin zum transnationalen Terrorismus.Der internationale Terrorismus zeichnet sich in erster Linie durch "zahlreiche grenzüberschreitende Aktionen [aus], bei denen häufig vollkommen unbeteiligte Bürgerinnen und Bürger fremder Staaten zu Schaden kamen." (Steinberg 2015). Ferner ist für den internationalen Terrorismus charakteristisch, dass die terroristischen Aktivitäten durch Staaten unterstützt werden. Zu den Unterstützerstaaten in der Vergangenheit zählten insbesondere Verbündete der ehemaligen Sowjetunion wie beispielsweise Syrien oder Libyen.Als historisches Beispiel für den internationalen Terrorismus gelten die Attentate auf israelische Sportler*innen während der Olympischen Spielen in München 1972 durch palästinensische Terroristen. Mit dem Fall der UdSSR verloren diese Staaten ihren Schutz vor Sanktionen westlicher Nationen. Damit endete nach und nach auch die Unterstützung terroristischer Gruppierungen. Es folgte ein fließender Übergang vom internationalen Terrorismus hin zum transnationalen Terrorismus.Der Unterschied besteht darin, dass die terroristischen Aktivitäten nicht mehr durch einen Staat unterstützt werden. Die Gruppierungen werden privat mit Geld und Waffen unterstützt oder bauen eigene, substaatliche Logistik- und Finanzierungsnetzwerke auf. Der Terrorismus gilt zudem als transnational, "weil sich die terroristischen Gruppen auf substaatlicher Ebene länderübergreifend miteinander vernetzen und sich dementsprechend aus den Angehörigen verschiedener Nationalitäten zusammensetzen" (Steinberg 2015).Basierend auf diesen Erkenntnissen ist ab den 1990er Jahren nicht mehr von internationalem Terrorismus, sondern vielmehr von transnationalem Terrorismus zu sprechen (vgl. Steinberg 2015). Dies hat auch Auswirkungen auf die Organisationsstrukturen terroristischer Gruppierungen. Sie zeichnen sich durch "Dezentralisierung, Entterritorialisierung und durch Überlagerung und Fragmentierung zwischen wechselnden, funktional orientierten Akteuren aus" (Behr 2017, 150).Ein Beispiel für den Übergang von einer internationalen Organisation hin zu einem transnationalen Netzwerk stellt die im Zusammenhang mit dem 11. September 2001 stehende Terrorgruppe Al-Qaida dar. Vor den Anschlägen galt sie als eine internationale Organisation, die über ein "recht einheitliches Gebilde" (Hoffmann 2006, 425) verfügt. In Folge der Reaktionen auf die Anschläge entwickelte sie sich als eine transnationale Bewegung "mit gleich gesinnten Vertretern an vielen Orten, die über ein ideologisches und motivierendes Zentrum locker miteinander verbunden sind, aber die Ziele dieses noch verbleibenden Zentrums gleichzeitig und unabhängig voneinander verfolgen" (Hoffmann 2006, 425).Nach Vasilache ist "der gebräuchliche Terminus des internationalen Terrorismus irreführend, da er keine gängige Strategie eines Staates gegen einen anderen, sondern ein transnationales Phänomen ist, das vor Staatsgrenzen nicht halt macht" (Vasilache 2006, 151). Als Begründung führt er an, dass terroristische Anschläge oftmals von einzelnen Gruppierungen ausgehen, wobei auf die unterschiedlichen Motive in einem nächsten Schritt eingegangen wird. Weiterhin begründet er seine Aussage mit der Tatsache, dass das Ziel von staatlich initiiertem Terrorismus nicht direkt ein anderer Staat ist, sondern vielmehr zivile Ziele verdeckt attackiert werden (vgl. Vasilache 2006, 151).Anders als Steinberg spricht Vasilache also nicht von einer historischen Veränderung vom internationalen Terrorismus hin zum transnationalen Terrorismus, sondern bezeichnet das Phänomen Terrorismus generell als transnational. Da beide in der Ansicht übereinstimmen, zum Zeitpunkt der Anschläge am 11. September 2001 handele es sich um die transnationale Form des Terrorismus, wird im weiteren Verlauf von transnationalem Terrorismus gesprochen.Im Hinblick auf die Motive terroristischer Gruppierungen können im Wesentlichen vier Motive benannt werden, die sich überschneiden oder einander angleichen können. In diesem Zusammenhang wird von der Tatsache ausgegangen, dass terroristische Gruppierungen mit ihren Zielen und ideologischen Rechtfertigungen nicht zufällig entstehen, "sondern einen bestimmten gesellschaftlich-historischen Hintergrund widerspiegelt, der seinerseits wieder durch ihr Vorgehen eine spezifische Aktivierung erfährt" (Waldmann 2005, 100).Der sozialrevolutionäre Terrorismus möchte die politischen und gesellschaftlichen Strukturen nach der Ideologie von Karl Marx verändern (vgl. Waldmann 2005, 99). Ein Beispiel hierfür stellt die Rote Armee Fraktion (kurz: RAF) dar, die in den 1970er Jahren in Deutschland terroristische Anschläge verübte.Wenn unterdrückte Völker oder Minderheiten das Ziel von mehr politischer Autonomie oder staatlicher Eigenständigkeit mit terroristischen Strategien verfolgen, handelt es sich um ethnisch-nationalistischen Terrorismus. Als Exempel hierfür kommt die baskische ETA infrage, die aus einer Studierendenorganisation heraus entstanden ist und sich in den 1960er Jahren zunehmend radikalisierte (vgl. Waldmann 2005, 103f.).Unter die dritte Form des Terrorismus, "der militante Rechtsradikalismus" (Waldmann 2005, 115), fallen unterschiedliche Gruppen wie beispielsweise die Ku-Klux-Klan-Bewegung in Amerika. Trotz der unterschiedlichen Ausprägungen können bei all diesen Gruppen im Wesentlichen zwei Merkmale ausgemacht werden: zunächst einmal kämpfen sie für den Erhalt bestehender Strukturen und wollen keine strukturellen Veränderungen hervorrufen. Zudem richtet sich diese Form des Terrorismus in erster Linie nicht gegen das politische System, sondern vielmehr gegen einzelne Gruppen der Gesellschaft (vgl. ebd., 115). Ferner kennzeichnet den rechtsradikalen Terrorismus auch eine andere Strategie und eine andere Erscheinungsform. Bei den Aktivisten handelt es sich um "Teilzeitterroristen" (ebd., 117), die typischerweise in ihrer Freizeit agieren. Ihre Aktivitäten sind nicht im Untergrund, sondern werden vielmehr offen durchgeführt. Hinzu kommt, dass die Anschläge teils geplant und teils spontan erfolgen, mit dem Ziel, die Opfer zum Verlassen des Ortes oder Landes zu bewegen (vgl. ebd., 117f.).Bei der vierten Form des Terrorismus handelt es sich um religiös motivierten Terrorismus. Beispiel hierfür ist die bereits mehrfach angesprochene Terrorgruppe Al-Qaida. Sie entstand als Reaktion auf den Angriff der Sowjetunion auf Afghanistan Ende der 1970er Jahre. Die Brutalität der Invasion sorgte für eine große Solidarität innerhalb der islamischen Welt und führte zu einem Zuzug von zahlreichen islamischen Glaubenskämpfer*innen aus anderen Ländern, darunter auch Osama Bin Laden. Dieser gewann im Laufe der 1980er Jahre immer mehr an Einfluss und gründete mit dem Abzug der Sowjets Ende des Jahrzehnts Al Qaida mit dem Ziel, an einer anderen Front weiterzukämpfen. Es erfolgte ein Strategiewechsel "des Djihads nach innen, gegen verräterische Herrscher in den islamischen Staaten, auf die Strategie eines Djihads nach außen, gegen den Westen" (ebd., 152).Ein definitorisches Problem von Terrorismus ergibt sich aus der Tatsache, dass auf der internationalen Ebene bislang keine einheitliche Definition gefunden wurde. Im Rahmen der Resolution 1566 aus dem Jahr 2004 definierte der Sicherheitsrat der Vereinten Nationen den Begriff Terrorismus wie folgt als "Straftaten […], die mit dem Ziel begangen werden, die ganze Bevölkerung, eine Gruppe von Personen oder einzelne Personen in Angst und Schrecken zu versetzten, eine Bevölkerung einzuschüchtern oder eine Regierung oder eine internationale Organisation zu einem Tun oder Unterlassen zu nötigen […]" (UN-Resolution1566 2004).Neben dieser existieren weitere nationale und internationale Definitionen, wie unter anderem die der Europäischen Union oder die Definitionen einzelner amerikanischer Behörden. Auf der politischen Ebene können die Schwierigkeiten hinsichtlich einer einheitlichen Definition anhand folgender Punkte näher beleuchtet werden: zunächst einmal werden Handlungen von unterschiedlichen Staaten unterschiedlich eingestuft. Für die einen handelt es sich um gewalttätige terroristische Angriffe; andere stufen die Aktivitäten als politisch legitimierte Handlungen in Ausübung des Selbstverteidigungsrechts während eines nationalen Befreiungskampfes ein.Ferner herrscht Uneinigkeit darüber, ob eine Definition auch den Staatsterrorismus umfassen sollte oder ob sie lediglich die motivationalen Hintergründe der Täter umfasst. Anhand der genannten Schwierigkeiten wird deutlich, dass die Einschätzung, ob es sich bei der Bedrohung um eine terroristische Bedrohung handelt und ob es sich bei der Organisation um eine terroristische Organisation handelt, dem nationalen Verständnis oder dem Verständnis der jeweiligen Institution unterliegt. Folglich könnte die Klassifizierung missbraucht werden, um ungewünschte innerstaatliche Gruppierungen oder andere mit dem Begriff zu stigmatisieren und deren Verfolgung zu rechtfertigen (vgl. Finke/Wandscher 2001, 168; Kaim 2011, 6).Abschließend gilt es noch zu klären, ob terroristische Aktivitäten als Kriegshandlungen bezeichnet werden können oder ob vielmehr eine Trennung der beiden Begriffe erforderlich ist. Als unmittelbare Reaktion auf die Anschläge des 11. Septembers bekundete Amerika immer wieder seinen Krieg gegen den Terror. Neben Präsident Bushs "global war on terror" sprach auch der amerikanische Verteidigungsminister Donald H. Rumsfeld im Zuge der Anschläge von einer neuen Kriegsart, "die sich vor allem neuer Technologien bedienen, asymetrisch verfahren und deswegen auch nicht leicht zu erkennen sein würde" (Czempiel 2003, 113).Diese Verwendung des Kriegsbegriffes in Verbindung mit terroristischen Anschlägen offenbart einen strategischen Zug der US-Regierung. "Dehnt man den Kriegsbegriff auf terroristische Akte aus, legitimiert dies den Angegriffenen auch zu Kriegshandlungen" (Geis 2006, 12). Der Regierung ist es infolgedessen möglich, über rechtsstaatliche Mittel hinaus Maßnahmen zu ergreifen und sie kann zudem von einer breiten Unterstützung innerhalb der eigenen Bevölkerung ausgehen (vgl. Geis 2006, 12). Bei der Frage, ob der transnationale Terrorismus als eine Form des Krieges bezeichnet werden kann, offenbart sich aus politikwissenschaftlicher Sicht eine erhebliche Kontroverse.Neben der Kategorisierung zwischen den alten und neuen Kriegen existiert auch die Unterscheidung zwischen großen und kleinen Kriegen. Diese "basiert auf der Art der Vergesellschaftungsform der Kriegführenden" (Geis 2006, 21). Im Fall des großen Krieges sind die Akteure in gleichem Maß vergesellschaftet, ein Staat kämpft gegen einen anderen Staat. Im Falle eines kleinen Krieges besteht eine "asymetrische Konfliktstruktur zwischen ungleich vergesellschaftlichen Akteuren: Staatliche Kombattanten treffen auf nichtstaatliche Kämpfer" (Geis 2006, 21).Ob unter die kleinen Kriege auch der Terrorismus zu subsumieren ist, ist jedoch umstritten. Zunächst einmal wird dagegen angeführt, dass der Preis auf normativer Ebene zu hoch sei. Eine Unterscheidung beider bedeutet einen Fortschritt des Völkerrechts, da die Trennung immer eine Unterscheidung zwischen politisch legitimierter Gewalt im Zuge einer Kriegshandlung und illegitimer Gewalt, ausgeübt im Zuge eines Verbrechens, ermöglicht.Hinzu kommen Bedenken "bezüglich der Folgen eines ungehegten Counterterrorismus der angegriffenen Staaten" (Geis 2006, 22). In einem permanenten Kriegszustand hätten demokratische Staaten die Möglichkeit, die Erweiterung des Sicherheitsapparates und Bürgerrechtseinschränkungen zu legitimieren (vgl. ebd., 21f.). Als weiteres Argument wird angeführt, dass eine Trennung beider Begriffe aus analytischer Sicht sinnvoll sei, da es sich beim Terrorismus primär um eine Kommunikationsstrategie handele. Dieser fehlen neben der territorialen Dimension auch die wechselseitig beständige Gewaltanwendung und das Charakteristikum eines Massenkonflikts (vgl. ebd., 23).Für eine Subsumierung des Terrorismus unter den Kriegsbegriff spricht insbesonders die Sichtweise der Vereinten Nationen, die im Zuge der Anschläge vom 11. September 2001 den Vereinigten Staaten von Amerika das Recht auf Selbstverteidigung gemäß Art. 51 UN-Charta zugesprochen hat (vgl. Resolution 1373 2001). Auf diese Tatsache wird zu einem späteren Zeitpunkt noch einmal eingegangen. Anschließend wird der Sichtweise der Vereinten Nationen gefolgt und folglich der Terrorismus unter den Begriff des Krieges subsumiert.Reaktionen der Vereinten Nationen auf Terrorismus vor dem 11. September 2001In einem nächsten Schritt gilt es, auf die Reaktionen der Vereinten Nationen auf das Phänomen des Terrorismus vor dem 11. September 2001 einzugehen. Hierbei wird zunächst auf das unterschiedliche Verständnis in Bezug auf den Sicherheitsbegriff näher eingegangen. Seit den 1970er Jahren gilt nicht mehr nur die politische Souveränität und die territoriale Integrität der einzelnen Staaten als das zu schützende Objekt der Sicherheitspolitik.Neben der zu schützenden staatlichen Sicherheit geriet auch die Gesellschaft, definiert als ein "Zusammenschluss von Individuen" (Kaim 2011, 3), in den Mittelpunkt sicherheitspolitischen Handelns. In den 1990er Jahren erfolgte die Aufnahme einer weiteren Dimension in Gestalt der menschlichen Sicherheit in den Diskurs rund um den Sicherheitsbegriff und die damit verbundenen Aufgaben. Nach diesem Verständnis ist die Sicherheit, die Freiheit und der Wohlstand des Individuums zu schützen. Es zeigt sich jedoch, dass die Dimensionen in der politischen Praxis nicht getrennt voneinander betrachtet werden können. Der Schutz des Individuums umfasst ebenso die Gesellschaft, in der es lebt, und letzlich auch den Staat (vgl. Kaim 2011, 3f.).Aus sicherheitspolitischer Perspektive gilt der "Terrorismus als entterritorialisiertes Sicherheitsrisiko" (Behr 2017, 151), das zu drei Konsequenzen führt. Zunächst einmal sind terroristische Aktivitäten nicht voraussagbar. Es besteht das Risiko, dass sie sich zu jeder Zeit an jedem Ort ereignen können. Hinzu kommt, dass die Akteure anders als Staaten keine politische Einheit darstellen. Vielmehr ereignen sich einzelne, verstreut zusammenhängende Handlungen ohne einen genau ausmachbaren Anfang oder Ende. Folglich kann auf das sicherheitspolitische Risiko Terrorismus nur reagiert werden, wenn die Maßnahmen "Handlungs- und Organisationslogiken transnationaler Politik erfassen und übernehmen" (Behr 2017, 151).Die Problematik des transnationalen Terrorismus als Herausforderung für die Vereinten Nationen und ihrer Sonderorganisationen führte zu einer Reihe von Abkommen mit der Intention der Beseitigung und Bekämpfung der Problematik. In diesem Zusammenhang kristallisierte sich ein pragmatischer Ansatz heraus. "[B]esonders häufig auftretende terroristische Aktivitäten [wurden] zum Gegenstand spezifischer Konventionen gemacht" (Finke/Wandscher 2001, 169).Nahezu alle von der Generalversammlung und den Sonderorganisationen verabschiedeten Abkommen können aufgrund bestimmter Kernelemente als Antiterrorkonventionen bezeichnet werden. Zu den besagten Kernelementen gehört zunächst einmal die Verpflichtung der Vertragsstaaten, die in dem jeweiligen Abkommen genannte strafbare Handlung in das jeweilige innerstaatliche Recht aufzunehmen und angemessen zu bestrafen.Hinzu kommt, dass verdächtige Personen entweder durch den Staat selbst zu verfolgen sind oder an einen anderen, verfolgungswilligen Staat ausgeliefert werden müssen. Eine Auslieferung kann nur dann verweigert werden, wenn das Auslieferungsgesuch aufgrund religiöser, ethischer, nationaler, rassistischer oder politischer Gründe erfolgt ist. Ferner sind die Vertragsstaaten dazu verpflichtet, untereinander zu kooperieren und sich gegenseitig Rechtshilfe zu gewähren (vgl. Finke/Wandscher 2001, 169).Das erste derartige Übereinkommen stellt das Haager Abkommen von 1970 zur Bekämpfung der widerrechtlichen Inbesitznahme von Luftfahrzeugen dar. Darauf folgte das Montrealer Abkommen von 1971 zur Bekämpfung widerrechtlicher Handlungen gegen die Sicherheit der Zivilluftfahrt (vgl. ebd., 169). Die besagten Abkommen ordnen bestimmten Aktivitäten zwar das Adjektiv terroristisch zu, stufen diese jedoch nicht als Bedrohung des Weltfriedens ein oder führen zu der Anordnung von Zwangsmaßnahmen gemäß Kapitel VII der UN-Charta durch den Sicherheitsrat.Dies änderte sich mit der Explosion einer Bombe an Bord des Pan-American-Flugs 103 über der schottischen Ortschaft Lockerbie im Jahr 1988. Hier wurden zwei Staatsangehörige Libyens für die Anschläge verantwortlich gemacht, und das Land von den Vereinigten Staaten und Großbritannien zu deren Auslieferung aufgefordert. Der libysche Staat verweigerte das. Als Reaktion darauf wurde der Terrorakt im Rahmen der Resolution 731 durch den Sicherheitsrat als Bedrohung des Weltfriedens gemäß Kapitel V Artikel 24 eingestuft.Durch Resolution 748, ebenfalls 1992 verabschiedet, wurde die Nichtauslieferung durch Libyen als "eine Bedrohung des Weltfriedens und der internationalen Sicherheit" (Finke/Wandscher 2001, 171) bezeichnet und Zwangsmaßnahmen gemäß Kapitel VII UN-Charta gegen das Land erlassen (vgl. Behr 2017, 147; Finke/Wandscher 2001, 170f.).Der Einsatz von Zwangsmaßnahmen gemäß Kapitel VII der UN-Charta erwies sich als wirksames Mittel der Terrorismusbekämpfung im Hinblick auf die Durchsetzung bestimmter Maßnahmen. Hierunter fallen insbesonders Maßnahmen, die zwar Gegenstand geltender Antiterrorkonventionen sind, diese durch die betreffenden Staaten jedoch nicht ratifiziert wurden oder die Konvention selbst noch nicht in Kraft getreten ist (vgl. Finke/Wandscher 2001, 171).Diese Strategie des Sicherheitsrates etablierte sich insbesonders hinsichtlich der Situation in Afghanistan. In Folge der Anschläge auf amerikanische Botschaften in Nairobi und Daressalam erließ der Sicherheitsrat mit der Resolution 1267 Individualsanktionen gegen die afghanischen Taliban. Der Grund hierfür war die Tatsache, dass diese den Verantwortlichen für die Anschläge, der Terrorgruppe Al-Qaida und ihrem Anführer Osama bin Laden, Unterstützung gewährte.Insbesonders durch das Einfrieren der finanziellen Mittel, aber auch durch ein Waffenembargo und ein Reiseverbot, sollten diese zur Auslieferung Bin Ladens gezwungen werden. Um die Umsetzung dieser Maßnahmen zu gewährleisten, setzte die Resolution zudem einen Unterausschuss des Sicherheitsrates ein (vgl. Kreuder-Sonnen 2017, 159).Direkte Reaktionen der Staatengemeinschaft auf den 11. September 2001Als erste Reaktion auf die Anschläge des 11. September 2001 wurde vom Sicherheitsrat bereits am Tag nach den Anschlägen die Resolution 1368 erlassen. In dieser wurde der Terrorismus einstimmig als "Bedrohung des Weltfriedens und der internationalen Sicherheit" (UN-Resolution 1368 2001) im Sinne von Art. 39 UN-Charta bezeichnet. Zugleich wurde auf das Recht zur individuellen und zur kollektiven Selbstverteidigung verwiesen (vgl. UN-Resolution 1368 2001).Noch im gleichen Monat, am 28 September 2001, wurde das Recht zur individuellen und kollektiven Selbstverteidigung mit Resolution 1373 bekräftigt und die internationale Staatengemeinschaft aufgefordert, "durch terroristische Handlungen verursachte Bedrohungen […] mit allen Mitteln im Einklang mit der Charta zu bekämpfen" (Resolution 1373 2001).Neben dem Sicherheitsrat der Vereinten Nationen reagierte auch der Nordatlantikrat umgehend. Am 12. September erklärte der damalige Generalsekretär George Robertson die Anschläge zum kollektiven Verteidigungsfall, wodurch Artikel 5 des NATO-Vertrages in Kraft trat. Nach diesem ist jeder Mitgliedstaat verpflichtet, mit von ihm ausgewählten Mitteln zu helfen (vgl. Robertson 2001).Aus amerikanischer Sicht dienten die Anschläge nicht nur dem Zweck der Tötung von amerikanischen Zivilisten, "Bush sah darin die gesamte westliche Zivilisation herausgefordert" (Czempiel 2003, 114). In seiner Rede am 20. September 2001 warnte der amerikanische Präsident alle Staaten hinsichtlich der Unterstützung und der Beherbergung von Terroristen. Innerhalb der Regierung wurde hinsichtlich der Bekämpfungsstrategie "offen von Präemption gesprochen" (Czempiel 2003, 115).Als Adressaten der amerikanischen Drohung kamen insgesamt 60 Länder mit aktiven terroristischen Organisationen in Frage (vgl. ebd., 114). Auch wenn die meisten Attentäter der Anschläge ursprünglich aus Saudi-Arabien stammten, erhärtete sich zunehmend der Verdacht, dass ihre Aktivitäten von Afghanistan aus gelenkt wurden. Im Zuge dessen wurde das Land als "Prototyp" (ebd., 115) für die Terrorismusbekämpfung ausgewählt. Mit der Operation "Enduring Freedom" starteten amerikanische und britische Truppen am 7. Oktober 2001 Angriffe auf Talibanstützpunkte wie etwa auf Regierungsgebäude in Kandahar und Kabul (vgl. Bruha/ Bortfeld 2001, 162; Czempiel 2003, 115).Der Umstand, dass sich am Tag nach den Anschlägen der Sicherheitsrat der Vereinten Nationen mit diesen befasste "ist ein erstaunlicher Beweis für die politische Klugheit der USA" (Tomuschat 2002, 20) hinsichtlich der Legitimation der Reaktion auf diese. In diesem Zusammenhang gilt es sich jedoch zu fragen, ob die genannten Resolutionen das Land tatsächlich zu einem Recht auf Selbstverteidigung gemäß Artikel 51 UN-Charta legitimieren.In Resolution 1368 findet sich in Bezug darauf ein entscheidender Widerspruch, welcher die rechtlich bedeutsamen Aussagen schwer greifbar macht. Dieser bekräftigt das Recht auf individuelle und kollektive Sicherheit im Sinne der Charta, bezeichnet die Angriffe jedoch lediglich als eine Bedrohung des globalen Friedens und der Sicherheit. Die bekundete Entschlossenheit, die Bedrohung "mit allen Mitteln zu bekämpfen" (UN 2001, 315), kann nicht als eine Ermächtigung für einzelne Staaten aufgefasst werden, sondern steht für die grundsätzliche Bereitschaft der internationalen Gemeinschaft.Anders als Resolution 1368 enthält Resolution 1373 mehr rechtlich eindeutige Aussagen. Bereits in der Präambel wird auf die Anwendung der Maßnahmen gemäß Kapitel VII UN-Charta verwiesen. Zudem bestätigt sie die Zulässigkeit des Einsatzes "aller Mittel" durch die Opfer von terroristischen Anschlägen (vgl. UN 2001, 316f.). Es zeigt sich also, dass eine Berechtigung zu der Ausübung des Selbstverteidigungsrechts gemäß Art. 51 UN-Charta durch die Vereinigten Staaten im Rahmen der genannten Resolution durchaus vorliegt (vgl. Tomuschat 2002, 20f.).Nun stellt sich die Frage, ob die Verbindungen zwischen den Anschlägen und dem Taliban-Regime derart offensichtlich waren, dass die militärischen Aktionen gegen die Taliban in Afghanistan unter die Ausübung des Selbstverteidigungsrechts fallen. In diesem Zusammenhang kann man sich nicht auf die genannten Resolutionen berufen, da diese nicht aufzeigen, "gegen wen Gegenwehr zulässig sein soll" (Tomuschat 2002, 21). Folglich gilt es, die Reaktionen des Sicherheitsrates und der Generalversammlung näher zu betrachten.Es zeigt sich, dass beide Institutionen die amerikanisch-britische Militärintervention nicht verurteilten. Vielmehr verabschiedete der Sicherheitsrat am 12. November 2001 einstimmig Resolution 1377. In dieser wurde der Terrorismus als "eine der schwerwiegendsten Bedrohungen des Weltfriedens und der internationalen Sicherheit im 21. Jahrhundert" (UN-Resolution 1377 2001) bezeichnet. Mit dieser Qualifikation wurde implizit der Einsatz von äußersten Mitteln gestattet, da die Resolution keine "Grenzen und Schranken von Gegenmaßnahmen enthält" (Tomuschat 2002, 21). Letztendlich kann man also davon ausgehen, dass die Vereinten Nationen die Ausübung des Selbstverteidigungsrechts gemäß Art. 51 UN-Charta durch die USA als Reaktion auf die Anschläge vom 11. September 2001 zumindest implizit gebilligt haben (vgl. Tomuschat 2002, 21f.).Als Reaktion auf die Anschläge wurden die bislang geltenden Individualsanktionen gegen die afghanischen Taliban und das Terrornetzwerk Al-Qaida mithilfe der Resolution 1390 zu allgemeinen, dauerhaft geltenden Maßnahmen gegen den transnationalen Terrorismus umgewandelt. Damit wurde nicht nur der Adressatenkreis erweitert, es wurde zusätzlich auch die räumliche und die zeitliche Begrenzung aufgehoben.Jede Person, die von einem Staat als Terrorverdächtiger genannt wurde, bekam ab diesem Zeitpunkt die Sanktionen im Hinblick auf das Privatleben, das private Eigentum, auf den Sozialstatus und das Unterhalten von geschäftlichen Beziehungen zu spüren. Fundierte Beweise für eine Aufnahme in die sogenannte "Schwarze Liste" (Kreuder-Sonnen 2017, 160) durch die Staaten waren ebenso wenig notwendig wie eine Begründung gegenüber dem Individuum (vgl. Kreuder- Sonnen 2017, 160).Folgen für die SicherheitspolitikAngesichts der aufgezeigten Gegenmaßnahmen als direkte Reaktion auf die Anschlage des 11. Septembers 2001 wird deutlich, dass man "bezüglich der Reaktion auf den Terrorismus von einer neuen Ära" (Waldmann 2005, 229) ausgehen muss. Es zeigt sich, dass sowohl bei diesen Anschlägen als auch bei terroristischen Anschlägen in den Folgejahren "die durchschnittliche Zahl der Opfer pro Anschlag […] kontinuierlich ansteigt" (Waldmann 2005. 16).Infolgedessen spricht auch Waldmann im Kontext von terroristischen Anschlägen von Kriegshandlungen. Seiner Ansicht nach hat das zunehmende Ausmaß der Anschläge dazu geführt, dass diese nicht mehr als `low intensity´ war, sondern vielmehr als `high intensitiy´ war eingestuft werden müssen. Der Grund hierfür ist seiner Ansicht nach die Tatsache, dass der Begriff des low intensity war neben dem fehlenden Einsatz von konventionellem Kriegsgerät und größeren Truppenverbänden auch einen begrenzten Personen- und Sachschaden impliziert (vgl. Waldmann 2005, 16f.).Auf der internationalen Ebene spiegelten sich die Reaktionen auf das zunehmende Ausmaß der Anschläge vor allem in den zahlreich erlassenen Konventionen und Resolutionen wieder. Hinzu kommt die Tatsache, dass terroristische Anschläge erstmals zu militärischen Interventionen in Länder geführt haben, die sich in erheblicher Entfernung von dem betroffenen Land befinden. Zumindest im Fall von der militärischen Intervention in Afghanistan herrschte eine seltene Einigkeit zwischen den Großmächten im Sicherheitsrat.Ferner führten die Ereignisse zu einem erheblichen Medieninteresse (vgl. Waldmann 2005, 229). Anhand dessen lässt sich "[d]ie neue Einschätzung des gewaltigen, vor allem dem internationalen Terrorismus zugeschriebenen Drohpotentials" (ebd., 230) feststellen. Diese führte zu drei als signifikant zu bezeichnenden Veränderungen im Hinblick auf die Politik und die Einstellung in Bezug auf den Terrorismus (vgl. ebd., 230).Zunächst einmal bewirkte der transnationale Terrorismus in den westlichen Nationen nicht nur einen "politischen Rechtsruck" (ebd., 230) aller regierenden Parteien. Er wirkte sich auch auf alle Ebenen der Gesellschaft aus. Dieser Wandel auf der nationalen Ebene wirkte sich auch auf die Entscheidungen internationaler Gremien aus. Die bislang vorhandene Balance zwischen der individuellen und kollektiven Sicherheit auf der einen Seite und den Grund- und Freiheitsrechten auf der anderen Seite hat sich zunehmend zugunsten des Sicherheitsaspektes verschoben (vgl. ebd., 230).Insbesonders um den Informationsaustausch zwischen den Staaten gewährleisten zu können und damit ein gemeinsames Vorgehen gegen die Bedrohung zu ermöglichen, wurden internationale Instanzen zur Koordinierung geschaffen (vgl. Behr 2017, 151; Waldmann 2005, 231). Ferner erfolgte eine erhöhte Aufmerksamkeit und Ressourcenbereitstellung für national und international agierende Behörden hinsichtlich terroristischer Aktivitäten und damit verbunden eine Reihe neuer, zu diesem Zweck erlassener Gesetze.Neben dem Informationsaustausch wurden auch die Möglichkeiten der Polizei und anderer Instanzen erweitert, um Anschläge bereits im Planungs- und Vorbereitungsstadium erkennen und verhindern zu können. Hierzu gehören beispielsweise Einreiseverbote für Mitglieder islamistischer Gruppierungen. Neben den erweiterten präventiven Maßnahmen wurden auch Notfallszenarien entwickelt, die im Fall eines Anschlags in Kraft treten (vgl. Waldmann 2005, 232).Im Hinblick auf die dargestellten Veränderungen stellt sich in einem nächsten Schritt die Frage, inwiefern weitere Maßnahmen aus der Sicht der Vereinten Nationen erforderlich sein könnten. Nach dem Terrorismusexperten Peter Waldmann "wird keine Unterscheidung zwischen Maßnahmen auf der nationalen und der internationalen Ebene getroffen, weil beide längst immer enger ineinander greifen und in die gleiche Richtung zielen" (Waldmann 2005, 239).Als zentrale Handlungsmaxime benennt Waldmann in diesem Zusammenhang die Tatsache, dass die Strategien gegenüber terroristischen Netzwerken beziehungsweise dem Terrorismus im Allgemeinen "klar, konsistent und glaubhaft" (Waldmann 2005, 239) sein sollen. Hinsichtlich des Umgangs mit dem islamistischen Terrorismus besteht die größte Problematik darin, dass westliche Nationen ihre Glaubhaftigkeit bezüglich ihrer Leitlinien teilweise verlieren. Insbesonders den Vereinigten Staaten von Amerika wird vorgeworfen, dass sie ihren Prinzipien der Demokratie, des Grundrechtsschutz und der Rechtsstaatlichkeit zugunsten von politischen und wirtschaftlichen Interessen teilweise nicht treu sind (vgl. ebd., 240)."Dass sie aus machtpolitischen Erwägungen jederzeit dazu bereit sind, mit Diktaturen Bündnisse zu schließen, und hinter ihrem quasi messianischen Diskurs, es gelte in der ganzen Welt demokratische Verhältnisse herzustellen, nun allzu deutlich das dringende Bestreben durchscheint, der eigenen Wirtschaft lukrative neue Erdölfelder zu erschließen." (Waldmann 2005, 240).Hinsichtlich der Maßnahmen auf der internationalen Ebene gilt es zunächst auf die Transnationalität näher einzugehen. Wie bereits erwähnt, handelt es sich bei terroristischen Gruppen in den meisten Fällen nicht um eine Gruppe aus einem Land, sondern um Angehörige unterschiedlicher Länder, die sich länderübergreifend miteinander vernetzt haben. Um dem begegnen zu können, erscheint es unabdingbar, dass auch Staaten grenzübergreifend miteinander kooperieren. Dies würde eine erhebliche Bereitschaft der Teilnehmenden zu einem Teilverzicht auf ihre staatlichen Souveränitätsräume und ihrer Souveränitätsrechte bedeuten.Hinsichtlich der nationalen und internationalen Rechtsordnungen im Allgemeinen verlangen transnationale Rechtsverstöße auch eine entsprechende Weiterentwicklung des Rechts auf internationaler Ebene. Transnationale Verbrechen können nicht durch an nationale Grenzen gebundenes Recht bekämpft werden, da aufgrund der unterschiedlichen Verfassungen rechtsfreie Sphären auf globaler Ebene entstehen. Folglich ist eine Ausweitung des transnationalen Rechts erforderlich. Hierfür müsste das Völkerrecht, bislang mit dem Staat als Rechtsperson und einer rechtlichen Bindung auf dem staatlichen Territorium, entterritorialisiert werden (vgl. Behr 2017, 151; Schmalenbach 2004, 266).Neben der Kooperation von Staaten und der Erweiterung des internationalen Rechts spricht Ernst-Otto Czempiel von einer "dreigeteilte[n] Strategie" (Czempiel 2003, 57) hinsichtlich der Verhinderung weiterer terroristischer Anschläge. Kurzfristig ist es die Aufgabe der Staaten, weitere Anschläge zu verhindern. In diesem Zusammenhang offenbart sich jedoch eine in demokratischen Staaten schwierige Güterabwägung hinsichtlich des Schutzes der kollektiven Sicherheit und der individuellen Freiheitsrechte (vgl. Czempiel 2003, 57).Die bürgerliche Freiheit stellt in demokratischen Staaten ein hohes Gut dar. Auf der anderen Seite würde der fortschreitende Ausbau des staatlichen Sicherheitsapparates eine "allmähliche Aushöhlung der individuellen Grund- und Freiheitsrechte um des Schutzes angeblich höherwertiger Güter willen" (Waldmann 2005, 242) bedeuten. Die Folge wäre eine Entwicklung des Rechtsstaates hin zu einem "präventiven Sicherheitsstaat" (Waldmann 2005, 242) mit einer teilweisen Abkehr von demokratischen Grundsätzen (vgl. Hofmann 2006, 446; Waldmann 2005, 242).Infolgedessen gilt es mittelfristig, sich mit dem Hintergrund der Akteure auseinanderzusetzen. "Als besonders fruchtbare Brutstätte gelten die zahlreichen `failing states´, also die gescheiterten oder zerfallenen Staaten" (Czempiel 2003, 58). Am Beispiel Afghanistans wird deutlich, dass der Westen einen erheblichen Anteil an dem Scheitern des Landes und an der Entstehung der dort ansässigen Terrorgruppe hatte.Im Zuge des Konflikts mit der Sowjetunion hatte Amerika die Kämpfer unterstützt. Mit dem sowjetischen Abzug endete auch die amerikanische Unterstützung, und das zerstörte Land wurde ebenso wie die von Amerika ausgebildeten Kämpfer sich selbst überlassen. Es gründete sich die Terrorgruppe Al Qaida mit dem neuen Feind in Gestalt der USA. Die Entwicklungen in Afghanistan haben gezeigt, dass bei jeder Einmischung von außen neben den kurzfristigen auch die langfristigen Konsequenzen zu bedenken sind und dass "das Objekt der Einmischung auch politisch und wirtschaftlich davon profitiert" (Czempiel 2003, 58).Aus langfristiger Sicht gilt es, die "Quellen des Terrorismus auszutrocknen" (ebd., 58) und eine Veränderung des Kontextes zu erwirken. In diesem Zusammenhang ist die Stabilisierung der "failing states" von entscheidender Bedeutung. Czempiel spricht von einer Neuordnung der Welt, "die immer mehr als ein Quasi-Binnenraum begriffen und mit entsprechender Strategie bearbeitet werden muss" (ebd., 59). Neben der Verringerung der Dominanz des Westens ist eine Änderung der Werteverteilung und ein Lösen der großen Konflikte erforderlich (vgl. ebd., 59).FazitDie Anschläge in den Vereinigten Staaten von Amerika am 11. September 2001 wirkten sich nicht nur traumatisch auf das "Selbst- und Machtbewusstsein der USA" (Czempiel 2003, 40) aus, sie versetzten auch den Rest der Welt in "Angst und Schrecken" (Czempiel 2003, 40). Zu Beginn des 21. Jahrhunderts erschien eine militärische Auseinandersetzung zwischen zwei Staaten unwahrscheinlich. Vielmehr stellte der Terrorismus als eine "neue Bedrohung von innen durch gesellschaftliche Akteure" (ebd., 57) das größte sicherheitspolitische Risiko insbesonders für westliche Industriestaaten dar. (vgl. ebd., 57). "Der Terror soll Angst und Schrecken verbreiten, ein Gefühl allgemeiner Unsicherheit erzeugen und offene Panik auslösen" (Hofmann 2006, 445). Hinzu kommt, dass mit dieser Form der psychologischen Kriegsführung das Vertrauen innerhalb der Gesellschaft in die politische Führung und in den Staat im Allgemeinen zerstört werden soll.Aus historischer Sicht existiert das Phänomen des Terrorismus seit mehr als 2000 Jahren. "Er hat überlebt, weil es ihm gelungen ist, sich immer wieder an die veränderten Bedingungen und Gegenmaßnahmen anzupassen und die verwundbaren Stellen seines Gegners ausfindig zu machen, um sie für seine Zwecke zu nutzen" (Hofmann 2006, 446). Entsprechend muss bei Gegenmaßnahmen "das gesamte Spektrum der verfügbaren Mitteln […], psychologische und physische, diplomatische und militärische, ökonomische und moralische" (ebd., 445) eingesetzt werden.Es gilt nun abschließend eine Antwort auf die Frage zu finden, inwiefern die Anschläge im Herbst 2001 die Sicherheitspolitik der Vereinten Nationen verändert haben. Kurzfristig führten diese zu einer seltenen Einigkeit der ständigen Mitglieder im UN-Sicherheitsrat, was sich in den zahlreichen erlassenen Resolutionen wiederspiegelt. Darunter fällt auch die Tatsache, dass die internationale Gemeinschaft die Militärintervention in Afghanistan nicht verurteilte, sondern vielmehr den Vereinigten Staaten ihr Recht auf Selbstverteidigung gemäß Art. 51 UN-Charta einstimmig zugestand.Es erwies sich jedoch hinsichtlich der internationalen Zusammenarbeit als problematisch, dass keine einheitliche Definition des Begriffs Terrorismus besteht. Das könnte dazu führen, dass wirtschaftliche Sanktionen oder militärische Aktionen zur Durchsetzung eigener Interessen fälschlicherweise als Terrorismusbekämpfung etikettiert werden.Generell zeigt sich, dass die Anschläge einen erheblichen innenpolitischen Rechtsruck bewirkten, der sich auch auf die Entscheidungen internationaler Gremien auswirkte. Das wurde durch erweiterte Befugnisse für die Polizei und andere Exekutivorgane in Fragen der nationalen und internationalen Sicherheit sichtbar.Mit der Resolution 70/291 stellte der amtierende UN-Generalsekretär Antonio Guterres am 22. Februar 2017 strategische Handlungsoptionen für die Terrorismusbekämpfung vor. Zunächst einmal soll die Effizienz der Vereinten Nationen im Bereich der Terrorbekämpfung allgemein gestärkt werden. Zudem soll die Qualität der Vereinten Nationen hinsichtlich der Unterstützung der Mitgliedsstaaten bei der Umsetzung der UN-Terrorismusbekämpfungsstrategien hinterfragt werden. Hinzu kommt der Anstoß zu einer Debatte hinsichtlich der regionalen und internationalen Zusammenarbeit von Staaten und UN-Sonderorganisationen.Außerdem wurde Wladimir Iwanowitsch Woronkow auf Vorschlag von Guterres zur Umsetzung und Koordinierung der Vorschläge am 21. Juni 2017 als Untergeneralsekretär eingesetzt. Diese strategische Neuausrichtung wird als eine strategische Aufwertung der Terrorismusbekämpfung im Rahmen der Vereinten Nationen verstanden (vgl. La ricerca si è proposta di analizzare dal punto di vista del diritto costituzionale le limitazioni al giudicato nazionale provenienti dall'ordinamento dell'Unione europea e dal sistema di protezione dei diritti fondamentali che fa capo alla Convenzione europea dei diritti dell'uomo. La scelta di trattare il tema assumendo la duplice prospettiva del diritto dell'Unione europea e della CEDU è apparsa necessaria per via dell'elevato grado di integrazione con l'ordinamento interno che i due fenomeni hanno raggiunto e che non è paragonabile, quanto meno relativamente allo specifico tema in esame, ad altre esperienze di diritto internazionale. Questa scelta ha imposto il metodo di studio, o meglio i metodi, necessari per non tradire la differente natura dei due fenomeni. Si è ritenuto doveroso, infatti, quanto all'Unione europea, assumere il punto di vista del diritto dell'Unione stessa e analizzare sostanzialmente la giurisprudenza della Corte di giustizia che ha delineato casi e modalità in cui il diritto dell'Unione impone, con effetti diretti, il superamento del giudicato. L'analisi del diritto interno si è invece limitata ad alcune considerazioni circa i problemi applicativi che tali effetti diretti producono. Quanto alla CEDU, viceversa, è apparso necessario assumere principalmente il punto di vista del diritto interno. In particolare, si è in un primo momento cercato di ricostruire il contenuto dell'obbligo internazionale di introdurre limitazioni al giudicato per come tale obbligo è emerso nella giurisprudenza e nella prassi degli organi del Consiglio d'Europa. Successivamente, tale obbligo è stato esaminato dal punto di vista del diritto interno ai fini del suo recepimento. In particolare, il problema delle limitazioni al giudicato è stato ricondotto alla collocazione del diritto convenzionale nel sistema delle fonti, alle questioni concernenti l'esegesi del diritto convenzionale e delle sentenze della Corte di Strasburgo, ai rapporti istituzionali tra le Corti. Questa differenziazione è sembrata imprescindibile per via della diversa natura dell'ordinamento dell'Unione europea rispetto a quello che ordinamento – almeno allo stato – non è, ovvero il sistema CEDU, per come questa diversa natura è venuta emergendo sia nella giurisprudenza delle Corti di giustizia e di Strasburgo, sia nella consolidata giurisprudenza costituzionale. Obiettivo della ricerca è stato lo studio delle limitazioni al giudicato volto a comprenderne la ratio e le implicazioni, da un lato, ordinamentali e, dall'altro, relative alla tutela dei diritti. Inoltre, si è inteso verificare se esista uno statuto costituzionale del giudicato e se tali limitazioni siano con esso compatibili. All'esito della ricerca è emerso che le limitazioni al giudicato provenienti dall'ordinamento dell'Unione europea e dal sistema della Convenzione europea dei diritti dell'uomo si muovono su strade fondamentalmente già percorse dagli ordinamenti statali all'indomani dell'introduzione delle Costituzioni del secondo dopoguerra. Anzitutto, né l'ordinamento dell'Unione europea né la CEDU impongono il superamento incondizionato del carattere di stabilità del giudicato. Le limitazioni all'irretrattabilità delle sentenze emesse dai giudici nazionali sono infatti puntuali e subordinate o al ricorrere di una serie di condizioni tutto sommato eccezionali o al riconoscimento, da parte dei competenti organi sovranazionali e convenzionali, dell'ineluttabilità di tale risultato in relazione alle specificità del caso concreto. Per quanto riguarda l'ordinamento dell'Unione europea, le limitazioni al giudicato nazionale godono dell'effetto diretto, perché mutuano tale carattere dalle norme dei Trattati da cui la Corte di giustizia le ricava in via ermeneutica in sede di rinvio pregiudiziale interpretativo. La loro efficacia erga omnes e la loro formulazione in termini generali e astratti permette di accostarle, a questi soli fini, a delle "norme" che intendano i) disciplinare in maniera più restrittiva di quanto previsto dal diritto interno le regole sulla formazione del giudicato e sulla sua estensione ovvero, direttamente, ii) travolgere i rapporti coperti da giudicato, imponendone un nuovo trattamento giuridico. Quanto alle limitazioni sub i), riconducibili alla disciplina del giudicato in sé considerata, l'opera della Corte di giustizia appare una sorta di limatura delle discipline processuali degli Stati membri. Essa è volta a eliminare le asperità dei singoli ordinamenti che non appaiono giustificabili alla luce di una rule of reason che intende soppesare le limitazioni alle possibilità di ripristino della legalità sovranazionale con l'effettivo perseguimento di ineludibili esigenze di certezza dell'ordinamento giuridico. In questo senso, la giurisprudenza della Corte di giustizia è certamente lontana dal possibile travalicamento dei cc.dd. controlimiti, se è vero, com'è, che un'ampia discrezionalità circa l'esatta conformazione dell'istituto del giudicato è pacificamente riconosciuta financo al legislatore ordinario. Quanto alle limitazioni sub ii), relative al giudicato non come istituto, ma come atto i cui specifici effetti devono essere espunti dall'ordinamento giuridico, la questione appare più delicata. Lo statuto costituzionale del giudicato impone al legislatore ordinario che il travolgimento intrinsecamente provvedimentale dei rapporti giuridici coperti dal giudicato debba trovare giustificazione nel perseguimento di ineludibili princìpi o valori di pregio costituzionale, nel rispetto del principio di proporzionalità tra il fine perseguito e i mezzi predisposti per la sua realizzazione. L'esigenza che il superamento dell'irretrattabilità delle sentenze definitive non costituisca esercizio arbitrario del potere pubblico è ascrivibile all'essenza stessa di uno Stato costituzionale di diritto ed è dunque opponibile anche al diritto dell'Unione europea. Infatti, la possibilità di individuare caso per caso quali specifici rapporti devono ricevere un nuovo trattamento giuridico sfocerebbe nell'arbitrio se non fosse saldamente ancorata al perseguimento di princìpi o valori di pregio costituzionale, nel rispetto del principio di proporzionalità. Il fatto di non riferirsi alla generalità dei consociati e dei rapporti giuridici, ma a fattispecie ben identificate nella loro individualità, è infatti massimamente lesivo della certezza del diritto, perché astrattamente qualsiasi rapporto giuridico, in qualsiasi momento, potrebbe essere rimesso in discussione per il solo fatto che il giudice di Lussemburgo non ne condivida il trattamento giuridico offerto nel merito dal giudice nazionale. Ciò calpesterebbe le legittime aspettative di stabilità che le parti hanno riposto nella perdurante efficacia delle norme sulla formazione del giudicato. In definitiva, l'essenza stessa del loro diritto di difesa sarebbe violato, perché l'agire o il resistere in giudizio sarebbe reso sostanzialmente vano dalla possibilità che il risultato raggiunto nel processo sia nuovamente messo in discussione. Occorre allora valutare se la Corte di giustizia si sia mantenuta entro gli stretti limiti entro cui la Costituzione tollera l'incidenza diretta su specifici rapporti coperti dal giudicato. La risposta, allo stato attuale, pare dover essere positiva, perché l'unica eccezione alla stabilità di un giudicato legittimamente formatosi è stata individuata nella grave violazione della ripartizione delle competenze tra Stati membri e Unione posta nei Trattati. Non vi è dubbio che, in un ordinamento che trova origine nell'accordo di un gruppo di Stati di creare un'entità giuridica sovranazionale cui demandare l'esercizio di alcune funzioni in cui tradizionalmente si esprime la loro sovranità, il rispetto del confine tracciato tra le competenze dei diversi livelli di governo è principio fondante. L'esigenza che il riparto di competenze sia osservato è insita nell'idea stessa di un sistema giuridico complesso in cui il potere pubblico è ripartito tra istanze locali e un'istanza centrale. Essa, inoltre, trova saldi appigli nell'esperienza storica, oltre che nel nostro diritto costituzionale positivo. La funzione svolta dalla Corte di giustizia è in questi casi assimilabile a quella di un giudice dei conflitti intersoggettivi. Poiché anche una sentenza definitiva può costituire oggetto di un ricorso per conflitto di attribuzione tra poteri dello Stato o di competenza tra lo Stato e le Regioni innanzi la Corte costituzionale, la limitazione al giudicato nazionale derivante dalla necessità di porre rimedio a gravi violazioni della ripartizione delle competenze tra Stati membri e Unione pare perseguire un principio di pregio costituzionale. Essa, inoltre, rispetta il principio di proporzionalità perché non è imposta dalla Corte di giustizia se non nel caso in cui sia lo stesso giudice nazionale a indicare, in sede di rinvio pregiudiziale, di non avere altri strumenti a sua disposizione per ripristinare la corretta ripartizione delle competenze. Un discorso a parte meritano le limitazioni al giudicato che la Corte di giustizia trae dalla necessità che sia pienamente assicurata l'operatività del meccanismo pregiudiziale di cui all'art. 267 TFUE. Tali limitazioni vanno a incidere, come quelle analizzate sub i), sulla disciplina nazionale del giudicato complessivamente intesa e non sul giudicato come atto, perché si rivolgono a una serie indefinita di procedimenti giudiziari, accomunati soltanto dalla circostanza, peraltro meramente accidentale, che il dubbio sulla corretta interpretazione da dare a una (qualsiasi) norma UE sorga in un momento in cui tale interpretazione non potrebbe essere rimessa in discussione dal giudice nazionale per il vincolo che il diritto processuale interno gli impone al rispetto di quanto statuito da un giudice di grado superiore. Diversamente dalle ipotesi esaminate sub i), queste limitazioni non sembrano poter essere accostate, dal punto di vista costituzionale interno, alla scelta in favore di una disciplina della formazione del giudicato più attenta alle esigenze della legalità rispetto a quelle della certezza, ma che si muove pur sempre all'interno di un ventaglio di soluzioni tutte astrattamente aperte alla legge ordinaria. La Corte di giustizia, infatti, non si limita a smussare quelle che potrebbero apparire delle eccentricità locali agli occhi di un giudice il cui sguardo si estende al funzionamento di una trentina di diritti processuali nazionali diversi. Il contrasto tra disciplina nazionale del giudicato e diritto UE è qui invece immediato e diretto e opera tra due norme funzionalmente equivalenti, l'art. 267 TFUE, da una parte, e la norma processuale nazionale che vincola il giudice alla statuizione del tribunale di grado superiore, dall'altra. In definitiva, si intende far prevalere il rapporto tra giudice nazionale e giudice sovranazionale a quello tra giudici nazionali di diverso grado. Se allora, nei casi indicati sub i) e ii), il superamento dell'irretrattabilità del giudicato nazionale era funzionale a un più ampio dispiegarsi della legalità sovranazionale, l'ipotesi qui specificamente in esame pare porsi più sul piano istituzionale che su quello meramente normativo. Il giudicato entra in tensione non tanto con la legalità sovranazionale, che in ipotesi potrebbe addirittura non essere stata violata nel merito dal giudice di grado superiore, quanto con la piena operatività di uno strumento di raccordo istituzionale tra ordinamento interno e ordinamento sovranazionale. Di qui, la giustificabilità sul piano costituzionale della limitazione, in quanto già l'introduzione della giustizia costituzionale impose nel suo momento una ridefinizione dei rapporti tra giudici comuni e la Corte di recente istituzione. Nel nostro ordinamento, in particolare, ciò è avvenuto anche in relazione al problema del riconoscimento in capo a qualsiasi giudice della facoltà di sollevare una questione di legittimità costituzionale, ancorché la norma indubbiata fosse stata già interpretata (e ritenuta esente da vizi di costituzionalità) da parte di un tribunale di grado superiore. Occorre adesso valutare le limitazioni emerse nell'ambito del sistema di protezione dei diritti fondamentali facente capo alla CEDU. In assenza di effetto diretto, tali limitazioni costituiscono oggetto di un obbligo internazionale che penetra nel nostro ordinamento pel tramite della legge di ratifica ed esecuzione. La disciplina del loro regime giuridico all'interno dell'ordinamento statale, pertanto, è posta dal diritto nazionale. Ne deriva che il parametro rispetto al quale valutare la legittimità di tali limitazioni è più ampio di quello che opera nei confronti del diritto UE, perché, a differenza di quest'ultimo, si estende alla Costituzione nel suo complesso, e non soltanto ai cc.dd. controlimiti. Ciò chiarito, si passa ad analizzare le due macro ipotesi in cui si possono dare limitazioni al giudicato nazionale da parte del diritto convenzionale. La prima attiene al possibile contrasto tra la configurazione che l'istituto assume nel diritto nazionale e il diritto di accesso al giudice ai sensi dell'art. 6, par. 1, CEDU. La sua conformità al dettato costituzionale non desta particolari perplessità. Infatti, anche la disciplina sulla formazione e sugli effetti giudicato deve, al pari di qualsiasi altra norma dell'ordinamento, garantire un minimum di protezione al diritto di accesso al giudice e rispettare i princìpi di ragionevolezza e proporzionalità. I risultati cui la Corte di Strasburgo è giunta in materia di processo in contumacia possono accostarsi a quelle pronunce con cui la Corte costituzionale ha allargato le maglie della disciplina processuale delle impugnazioni, ritenendo che in eccezionali casi la formazione del giudicato si ponesse in contrasto con i princìpi di ragionevolezza e uguaglianza e con il nucleo duro del diritto di difesa. La seconda ipotesi di limitazione al giudicato proveniente dal sistema convenzionale attiene al procedimento di esecuzione delle sentenze di accertamento di violazione emesse dalla Corte di Strasburgo nei confronti dell'Italia. In questi casi non è la configurazione astratta dell'istituto, ma la singola sentenza passata in giudicato a risultare incompatibile con la Convenzione, perché la sua perdurante efficacia impedisce la restitutio in integrum del diritto violato. Il superamento dell'irretrattabilità del giudicato è dunque necessario per porre rimedio i) a una violazione di un diritto fondamentale riconosciuto dalla Convenzione europea, ii) ove tale violazione sia stata accertata dall'organo preposto a giudicare i ricorsi individuali promossi ai sensi dell'art. 34 CEDU. L'ipotesi qui in esame si caratterizza dunque per l'intreccio inscindibile tra profilo normativo e profilo istituzionale. Non tutte le volte che sia argomentabile, sulla base della giurisprudenza della Corte EDU, la violazione del catalogo dei diritti convenzionali potrà essere invocata la "riapertura" o il "riesame" del giudicato, ma solo in quei casi in cui alla necessità di ripristinare la legalità convenzionale violata si accompagni l'esigenza di dare concreta esecuzione a una sentenza del giudice convenzionale resa nei confronti dell'Italia. La prima domanda da porsi è dunque se la previsione a livello legislativo di ipotesi di superamento dell'irretrattabilità delle sentenze definitive sia compatibile con lo statuto costituzionale del giudicato quando sia stato accertato, da parte di un tribunale internazionale la cui giurisdizione è riconosciuta dallo Stato italiano, che tali sentenze sono state emesse in violazione di un diritto fondamentale di una delle parti. La risposta è in principio positiva, ma con alcune precisazioni. Il limite che l'efficacia delle sentenze di accoglimento della Corte costituzionale trova nei rapporti esauriti deriva dalla peculiare natura dell'invalidità della norma dichiarata incostituzionale e non da un bilanciamento costituzionalmente necessario tra certezza e legalità costituzionale. Il legislatore gode infatti di un certo margine di discrezionalità in merito ai casi di cedevolezza del giudicato applicativo di norma incostituzionale. Similmente, deve ritenersi che rientri nel ventaglio di possibilità offerte al legislatore la scelta di prevedere ipotesi di superamento dell'irretrattabilità del giudicato per porre rimedio a gravi violazioni dei diritti fondamentali, i cui effetti lesivi non potrebbero altrimenti cessare. La tutela della persona e dei suoi diritti fondamentali nei confronti di un esercizio (convenzionalmente) illegittimo del potere pubblico costituisce infatti un valore di sicuro pregio costituzionale, che legittimamente il legislatore può perseguire introducendo nuove ipotesi di superamento del giudicato. Non solo. Nei confronti del giudicato penale è la Costituzione stessa a imporre che il bilanciamento tra legalità costituzionale e certezza del diritto sia risolto in favore della prima. Ciò in quanto la tutela della libertà personale e lo statuto costituzionale della pena non tollerano che le conseguenze assai pregiudizievoli sulla vita del condannato possano continuare a prodursi una volta che sia stato accertato che la condanna fu pronunciata sulla base di norma poi dichiarata incostituzionale. Ebbene: le medesime esigenze di tutela paiono sussistere con riferimento alla condanna pronunciata in violazione della legalità convenzionale. Tanto, con la duplice conseguenza che deve ritenersi costituzionalmente necessario i) prevedere ipotesi di cessazione degli effetti del giudicato penale di cui la Corte EDU abbia accertato il contrasto con la Convenzione e ii) estendere tale cessazione a tutti i soggetti che si trovino nella medesima situazione sostanziale del ricorrente vittorioso a Strasburgo. Sebbene non si siano concretamente verificate fino ad oggi violazioni dello statuto costituzionale del giudicato, è necessario riflettere su alcuni punti di tensione che potrebbero facilmente accendersi con l'ulteriore evoluzione della giurisprudenza della Corte di giustizia e della Corte EDU. Questi profili problematici riguardano essenzialmente la tutela dei terzi nei giudizi civili e amministrativi e la protezione dell'imputato nei giudizi penali. I "terzi" sono coloro che, pur avendo preso parte al giudizio civile o amministrativo all'esito del quale è stata pronunciata la sentenza definitiva, non hanno partecipato al contraddittorio innanzi alla Corte di giustizia o alla Corte di Strasburgo. Essi sono terzi, pertanto, soltanto rispetto al procedimento in cui emerge l'obbligo sovranazionale o convenzionale di superare l'irretrattabilità della sentenza nazionale. Il problema, per la verità, difficilmente potrebbe porsi nei confronti della Corte di giustizia. Di norma, il procedimento pregiudiziale è incardinato nel corso di un giudizio in cui la perdurante efficacia di un precedente giudicato è oggetto di controversia tra le parti. In principio, pertanto, ai sensi del diritto interno i partecipanti al primo processo sono contraddittori necessari del secondo. Di conseguenza, ricevono la comunicazione di cancelleria circa il deposito dell'ordinanza di rinvio e posso costituirsi nel giudizio innanzi la Corte di giustizia. Quando invece l'identità di parti non si verifica, perché, ad esempio, il rinvio pregiudiziale trova origine in un procedimento per il risarcimento del danno che vede contrapposti il privato leso da una violazione del diritto UE e lo Stato inadempiente, la Corte di giustizia non richiede la cessazione degli effetti del giudicato, che continuerà ad avere forza di legge tra le parti, ma soltanto il pagamento da parte dello Stato – appunto – del risarcimento del danno. Ben più problematiche sotto questo profilo sono le pronunce della Corte EDU, sia per il meccanismo processuale di accesso alla Corte, sia per la struttura del giudizio convenzionale. Il ricorso individuale, infatti, è proposto nei confronti dello Stato e ha ad oggetto l'accertamento della violazione da parte di quest'ultimo dei diritti fondamentali del ricorrente. Nessun obbligo di notificazione è posto in favore delle altre parti del processo nazionale che pure potrebbero subire le conseguenze di una restitutio in integrum che ne imponesse la "riapertura" o il "riesame". Il loro intervento è infatti rimesso, ai sensi dell'art. 36, par. 2, CEDU, alla valutazione discrezionale del Presidente della Corte, il quale "può invitare […] ogni persona interessata diversa dal ricorrente, a presentare osservazioni per iscritto o a partecipare alle udienze". Così stando le cose, deve ritenersi che la tutela del diritto di difesa di cui all'art. 24 Cost. impedisca che il superamento dell'irretrattabilità del giudicato sia opponibile a coloro che non hanno potuto contraddire nel giudizio innanzi la Corte di Strasburgo. Né varrebbe sostenere che tale contraddittorio potrebbe essere "recuperato" nella nuova fase nazionale del procedimento giurisdizionale, in sede di revocazione o revisione della sentenza (ormai non più) definitiva. Il problema, infatti, è dato dalla possibilità stessa della "riapertura" o del "riesame", possibilità che prende forma all'interno del giudizio convenzionale. A ciò si aggiunga che, anche dal punto di vista del merito della controversia, i margini di scostamento dalla soluzione elaborata a Strasburgo sarebbero per il giudice della revocazione o revisione estremamente ristretti, se non del tutto inesistenti. La partecipazione della controparte soltanto in una fase processuale che si limita a recepire puntuali indicazioni aliunde formatisi sarebbe pertanto poco più che decorativa e certamente insufficiente a ritenere tutelato il diritto di difesa. Anche la Corte costituzionale ha recentemente osservato che l'introduzione di una nuova ipotesi di revocazione delle sentenze civili e amministrative quale strumento di esecuzione delle sentenze della Corte EDU potrebbe realizzarsi soltanto attraverso "una delicata ponderazione, alla luce dell'art. 24 Cost., fra il diritto di azione degli interessati e il diritto di difesa dei terzi". In un ideale dialogo con i giudici di Strasburgo, la Consulta ha suggerito che "l'invito della Corte EDU potrebbe essere più facilmente recepito in presenza di un adeguato coinvolgimento dei terzi nel processo convenzionale" e che "una sistematica apertura del processo convenzionale ai terzi – per mutamento delle fonti convenzionali o in forza di una loro interpretazione adeguatrice da parte della Corte EDU renderebbe più agevole l'opera del legislatore nazionale". Il secondo nodo problematico è quello relativo alla tutela dell'imputato. Il problema del superamento del giudicato penale non si è ancora mai posto in relazione al diritto dell'Unione europea. Tuttavia non sembra potersi escludere che la Corte di giustizia venga chiamata a occuparsi anche di norme processuali nazionali sulla formazione del giudicato penale. La materia penale, infatti, è stata recentemente al centro del citato caso Taricco, relativo alla compatibilità con il diritto dell'Unione del regime italiano della prescrizione. Ivi la Corte ha applicato i princìpi di equivalenza ed effettività in chiave repressiva, nel senso cioè di chiedere al giudice nazionale di verificare se la disciplina italiana i) provocasse "in un numero considerevole di casi, l'impunità penale a fronte di fatti costitutivi di una frode grave, perché tali fatti risulteranno generalmente prescritti prima che la sanzione penale prevista dalla legge possa essere inflitta con decisione giudiziaria definitiva" o ii) attribuisse alla frode in materia di IVA un trattamento penale non equivalente, perché meno repressivo, di quello previsto per i "casi di frode lesivi dei soli interessi finanziari della Repubblica italiana". La medesima ratio decidendi potrebbe dunque essere utilizzata, mutatis mutandis, nei confronti della disciplina italiana sulla formazione del giudicato. Dal punto di vista del diritto convenzionale, invece, la necessità di "riaprire" o "riesaminare" le sentenze definitive si è posta anzitutto proprio nei confronti dei procedimenti penali. Ciò è avvenuto per consentire all'imputato, ricorrente vittorioso a Strasburgo, di veder cessare le conseguenze pregiudizievoli di condanne pronunciate in violazione dei suoi diritti fondamentali. Tuttavia, a fronte dell'emergere nella giurisprudenza della Corte EDU di obblighi positivi di tutela penale dei diritti sanciti dalla Convenzione e della progressiva diffusione del riconoscimento alle vittime (persone offese dal reato o costituitesi parti civili nei procedimenti penali) del diritto di ottenere nell'ordinamento interno una punizione dei colpevoli "proporzionata" all'offesa subita, non può escludersi che la Corte di Strasburgo arrivi a individuare la riapertura delle indagini e dei processi passati in giudicato quale modalità di esecuzione delle sentenze di condanna per difetto di tutela penale delle vittime. Deve ritenersi che il superamento della stabilità del giudicato penale a detrimento della posizione dell'imputato costituisca un risultato costituzionalmente precluso dal divieto di bis in idem. Nel caso del diritto convenzionale, inoltre, violato sarebbe altresì il diritto di difesa e il principio del giusto processo, giacché le sorti del processo penale subito dall'imputato sarebbero decise nell'ambito di un giudizio, quello innanzi alla Corte EDU, al quale egli non ha potuto neanche prendere parte. In definitiva, la tutela dei terzi nei procedimenti civili e amministrativi e la protezione dell'imputato nei procedimenti penali segnano i confini che la Costituzione impone alle nuove limitazioni al giudicato nazionale emerse nell'ambito dell'ordinamento dell'Unione europea e del sistema convenzionale. Sotto diverso profilo, deve ritenersi che le tensioni sul giudicato interno esaminate nel secondo e terzo capitolo vadano ricostruite come fenomeno tipico dell'introduzione di nuovi sistemi normativo-istituzionali, in assenza di adeguati meccanismi di pacificazione e razionalizzazione dei loro rapporti con il sistema giuridico sul quale vanno a innestarsi. In questo senso, si è cercato di dimostrare come le dinamiche osservate all'indomani dell'entrata in vigore della Costituzione siano in larga parte assimilabili a quelle cui si assiste oggi per effetto dell'evoluzione del diritto dell'Unione europea e della CEDU. Non può però sottacersi che, accanto al problema tecnico-giuridico di far convivere la stabilità degli accertamenti giurisdizionali con le esigenze della legalità di recente introduzione e con l'esercizio delle funzioni degli organi istituiti per l'interpretazione e applicazione del nuovo diritto oggettivo, emerge altresì, nella spinta verso il superamento dell'irretrattabilità del giudicato, il perseguimento dei fini latamente politici che ciascuno di questi sistemi normativo-istituzionali si propone. La definitività del giudicato costituisce infatti un limite all'esercizio del potere pubblico e può come tale essere percepito, dal detentore di quest'ultimo, come un ostacolo da abbattere. Il superamento del giudicato nazionale consente alla Corte di giustizia di perseguire l'uniformità e l'effettività dell'applicazione del diritto dell'Unione. Nel sistema convenzionale, tale superamento è strumentale a una più ampia protezione dei diritti fondamentali sanciti dalla CEDU e a una maggiore incisività negli ordinamenti interni del meccanismo di ricorso individuale.
