The article aims to define the sectoral legal tools that can be incorporated into the legislations of the countries of the world for the development of gender policies in social and labor relations. The research methodology included methods of general and special scientific character, which aim to ensure the unity of approaches. Attention has been paid to the justification of subjective differentiation of working conditions in the acts of the International Labor Organization. Legal conditions for the introduction of gender equality in legal systems were proposed in order to ensure the social and economic development of society. It is concluded that international standards of social and labor relations make it possible to implement gender equality policy in various variable models. Finally, among the special sectoral tools for solving gender problems, it is worth applying: subjective and social differentiation of working conditions; gender-neutral legislation; local acts as a method of raising the level of moral and ethical standards in professional groups, and; gender quotas and gender parity with differentiation in various spheres of economic activity.

Palestinian and Saharawi resistance to Israeli and Moroccan military occupation and colonization has taken creative forms, inevitably engaging internationally, while Palestinians and Sahrawis endeavor to disseminate their own narratives. For instance, alternative media and social networks are added to the means used to break both physical and informational siege, against editorial limitations or political alliances that dictate how news stories are framed or silenced and how struggles are legitimized or vilified, either they use violent tactics or not. This paper tackles Palestinian and Saharawi resistance as a dispute and expansion of spaces of international solidarity, and to address them it brings recent experiences. Such expansion happens especially through alternative means of communication, but also through growing political and academic engagement from various levels and disciplines, especially but not only from general social sciences, International Relations (IR) and International Law (IL). Moreover, state and international civil society actors get involved not only due to ethical concerns with human rights violations but also as a direct engagement in struggles for liberation. Hence, spaces in which Palestinian, Saharawi and international activists promote resistance are addressed here as an ongoing dispute for the international arena, drawing contributions from IR and IL. ; Las resistencias palestina y saharaui a las ocupaciones militares y colonizaciones israelí y marroquí han tomado formas creativas, inevitablemente internacionales, mientras palestinos y saharauis se esfuerzan por diseminar sus propias narrativas. Este texto aborda los "terrenos de resistencia" palestinos y saharauis y sus disputas por la expansión de espacios de solidaridad internacional, trayendo experiencias específicas. Dicha expansión ocurre especialmente a través de medios alternativos de comunicación, pero alcanza también un creciente compromiso político y académico desde varios niveles y disciplinas, especialmente, pero no apenas, de las ciencias sociales en general, las Relaciones Internacionales y el Derecho Internacional. Además, actores estatales y de la sociedad civil internacionales se involucran no solo debido a preocupaciones éticas con violaciones de los derechos humanos sino también como un compromiso real con las luchas por liberación. Por lo tanto, los espacios en los que activistas palestinos, saharauis e internacionales promueven la resistencia se tratan aquí como espacios disputados en la arena internacional, con un análisis desde las RRII y el DI.

In the nineteenth century, one of the essential conditions for obtaining recognition of the sovereignty of a state by the international community was the ability to maintain internal order and guarantee the lives and property of foreign nationals. Justice then becomes a major political element and the case of Spanish-Mexican relations is particularly significant. For Mexico, the aim is to preserve national independence, avoid military intervention and integrate into the international system. For Spain, it seeks to assert its status as a major power with the capacity to intervene in defence of its citizens and to obtain the necessary reparations. This work is then structured around three issues: the debt and financial claims of the Spaniards, the punishment of those guilty of the murders of Spaniards and the negotiation of an extradition treaty for offenders and deserters. ; International audience In the nineteenth century one of the key conditions for recognition of sovereignity of a state by the international community was the ability to maintain order and ensure the lives and properties of nationals abroad. In the last three decades, the world has experienced two large, fi rstly since the mid-seventies the advent of a new phase of accumulation in the capitalist system, fueled by the oil crisis and the crisis of the welfare state, among other factors. Furthermore with the fall of the Berlin Wall and the end of the Cold War, was launched a new era in international relations, commonly called the New World Order. This essay argues that the two phenomena are linked through the setup of a new social structure of accumulation of neoliberal character first is global and encompassing economic, social and political levels. ; En las últimas tres décadas el mundo ha vivido dos grandes transformaciones, de una parte desde mediados de los años setentas el advenimiento de una nueva fase de acumulación en el sistema capitalista, atizada por las crisis petroleras y la crisis del Estado de bienestar, entre otros factores. La solución de los conflictos de jurisdicciones y de leyes que pueda provocar el ejercicio extraterritorial de los derechos laborales colectivos carece de tratamiento por parte del legislador comunitario, al no haber introducido en las normas existentes en materia de determinación de la competencia judicial y de la legislación aplicable los criterios de conexión necesarios para determinar cuál pueda ser el órgano judicial competente para conocer del conflicto (conflicto de jurisdicciones) y qué ordenamiento jurídico nacional resulta aplicable al asunto (conflicto de leyes). Con este trabajo se busca aportar soluciones razonadas en los casos en los que no existen tales criterios de conexión, así como argumentar sobre la posible aplicación, en ciertos casos, de las normas comunitarias existentes en la actualidad. The solution to the conflicts of jurisdictions and laws caused by the extraterritorial exercise of collective labor rights lacks treatment by the EU legislator, since it has not introduced into the existing norms regarding the determination of judicial competence and applicable legislation the necessary connection criteria to determine which the competent judicial body may be to hear about the conflict (conflict of jurisdictions) and what national legal order is applicable to the matter (conflict of laws). This work seeks to provide reasonable solutions in cases where there are no such connection criteria, as well as to argue about the possible application, in certain cases, of the existing EU norms.

According to the nature of the Westphalian system, the independent state is the central actor in international relations. However, the discipline has not developed theoretical approaches regarding the independence process, which is considered more a concern of the international law and the political interests of state actors. Then, in this article, the issue of independence is analyzed as a basic step for political entities to access statehood, becoming a basisfor understanding the role of the independent state in the Westphalian order. It is necessary to observe the variations in the conception of independence, especially regarding self-determination and recognition principle, acknowledging the existence of deep changes in the international system. This principle has had greater relevance since the 1990s due to the disintegration processes of some countries, particularly the case of Kosovo. Taiwan is also a relevant experience. Another key point is the weakening process of the state, with the appearance of variants that question the status and existence of the state actor. At the end of this paper, a brief reference is made to the Latin and Central Americanexperience, which shows particularities since the 19th century. ; El actor central en las relaciones internacionales es el Estado soberano independiente, según la naturaleza del sistema westfaliano; sin embargo, en la disciplina no se han desarrollado enfoques teóricos sobre el proceso de independencia. Se considera más un asunto del derecho internacional y de los intereses políticos de los actores estatales. Por ello, se analiza en este trabajo, la cuestión de la independencia como un paso básico para que las entidades políticas accedan a la categoría de Estado, lo que sirve de fundamento para entender el papel del Estado independiente en el orden westfaliano. Al reconocer que hay cambios profundos en el sistema internacional, es necesario observar las variaciones en la concepción de independencia, sobre todo en relación con el principio de autodeterminación y el reconocimiento.Esto tiene mayor relevancia a partir de la década de 1990, por los procesos de desintegración de algunos países, en particular, el caso de Kosovo; otra experiencia relevante es Taiwán. A lo anterior, se suma el debilitamiento del Estado, con la aparición de variantes que cuestionan la estatidad y la existencia del actor estatal. Al final,se hace una breve referencia a la experiencia latinoamericana y centroamericana, que muestran particularidades desde el siglo XIX.
