Com a finalidade de reinserir Cuba na discussao dos problemas internacionais, publicam-se nesta secao tres documentos. O primeiro e um artigo de um sociologo cubano sobre as transformacoes que estao ocorrendo na economia e na sociedade cubanas e sobre as suas implicacoes. O segundo documento e um pronunciamento do arcebispo de Boston a proposito da visita do Papa a Cuba, e que contem uma lucida critica aos que pretendem impor uma mudanca politica no pais "de fora para dentro". O terceiro documento, finalmente, e um artigo solicitado ao embaixador de Cuba no Brasil sobre a posicao da ilha no cenario internacional e que reflete, como nao poderia deixar de ser, a posicao oficial dos dirigentes cubanos. A reforma operada no regime dos recursos cíveis pelo decreto-lei 303/2007, de 24 de agosto, introduziu um novo fundamento de recurso extraordinário de revisão. De acordo com o disposto na alínea f) do artigo 771.º do Código de Processo Civil português, uma decisão transitada em julgado pode ser objeto de revisão quando seja inconciliável com decisão definitiva de uma instância internacional de recurso vinculativa para o Estado Português. O presente texto constitui uma reflexão sobre a (in)conformidade com o direito da União Europeia da solução erigida pelo legislador português para conseguir o equilíbrio entre segurança jurídica e validade (aqui reconduzida à jurisprudência do Tribunal de Justiça da União Europeia), ao estabelecer para o recurso extraordinário de revisão um prazo de caducidade máximo de cinco anos, contado desde o trânsito da decisão a rever, nos casos em que esta decisão tenha sido tomada por órgão jurisdicional de última instância que não cumpriu a sua obrigação de reenvio prejudicial. ; The reform operated in the regime of civil appeals by the Decree-law 303/2007, from 24 August 2007, introduced a new basis for an extraordinary appeal for review. This paper states our views on the (in)conformity with EU law of the solution put forward by the Portuguese legislator in order to ensure, on the one hand, the legal certainty and, on the other hand, the validity (here entailed in the jurisprudence of the CJEU), by establishing for the extraordinary appeal for review a maximum preclusion time limit of five years from the moment the ruling under review is passed, in cases in which the decision was made by a court of last resort, that failed to fulfill its obligation to ask for a preliminary ruling.

With the words written here, we have the desire to reflect on what is Law, the so-called "Juridical Science". Observing that in the world "legal reason is posited as a reason without a body, or, if we wish as a narcissistic reason, insofar as it is the mirror-object body of itself" (SATIE, 2010, 637), our view of the Law has here a critical philosophical-sociological bias. We criticize the Law based on comments about what we believe to be the two main typologies of men that currently exist in our social environment: the "law man" and the "man of law." This is the legal professional and that is the common man, the one who declares himself faithful to obey the laws. The results of the bibliographical research on the subject reveal that the Law is not well the Science fomenting social peace, but only another ideological instrument responsible for controlling people, with the discriminating of being a state element, cogent, obligatory for all.

O objetivo deste artigo é discutir as origens, os desdobramentos e as permanências da prática de racialização dos corpos negros, por meio das políticas migratórias brasileiras, desde fins do século XIX até os dias atuais. Para tal, serão utilizadas as abordagens epistemológicas pós e decoloniais, com destaque para o pensamento afro-diaspórico. Esta investigação propõe a inclusão da "raça" como categoria analítica indispensável para o estudo das migrações no Brasil. A partir de uma abordagem inédita, será examinado como o Haitianismo deixou um legado que serviu de substrato para a formulação de legislações explicitamente racializadas sobre imigração. O primeiro tópico tematizará a nacionalidade e cidadania no Brasil a partir de sua independência, nos momentos iniciais de constituição do Estado imperial pós-colonial. O segundo tópico aborda as relações entre a raça e as normativas migratórias do século XX. Por fim, na última seção, será apreciada a atual Lei de Migração a partir das concepções de racismo estrutural e colonialidade do poder. ; El objetivo de este articulo es discutir los orígenes, los ramos y las permanencias de la practica de racialización de cuerpos negros, por medio de las políticas de migración brasileñas, desde fines del siglo XIX hasta los días actuales. Para esto, serán utilizadas los abordajes epistemológicos post y decoloniales, en especial el pensamiento o afro-diaspórico. Esta investigación propone la inclusión de la "raza" como categoría de análisis indispensable para el estudio de las migraciones en Brasil. A partir de un abordaje inédito, será examinado como el "Haitianismo" dejó un legado que sirvió de sustrato para la formulación de las legislaciones explícitamente racializadas sobre inmigración. El primer asunto traerá el tema de nacionalidad y ciudadanía en Brasil a partir de su independencia, en los momentos iniciales de su constitución del Estado imperial post colonial. El segundo tópico trata de las relaciones entre raza y las normativas migratorias del siglo XX. Por último, esta la sección en que será apreciada la actual "Lei de Migração" a partir de las concepciones de racismo estructural y colonialidad del poder. ; The aim of this article is to discuss the origins, expansion and permanences of the practice of racialization of black bodies, through brazilian migration policies, from the end of the 19th century to the present day. For this purpose, post and decolonial epistemological approaches, specially the afro-diasporic thinking, will be used. This research proposes the inclusion of "race" as an indispensable analytical category for the study of migrations in Brazil. From an unprecedented approach, it will be examined how Haitianism has left a legacy that served as a substrate for explicitly racialized legislation on immigration. The first topic will address the nationality and citizenship in Brazil starting from its independence, in the initial moments of constitution of the post-colonial Imperial State. The second topic addresses the relations between race and the migratory normatives of the 20th century. Finally, in the last section, the current Migration Law will be appreciated from the conceptions of structural racism and coloniality of power.

Law transforms our lives in the most important way: it changes how we act and because of this it gives rise to fundamental questions. One such question concerns legal authority and individual autonomy and asks; if we are autonomous agents how do legislators, judges and officials have legitimate authority to change our actions and indirectly change how we conduct our lives? The strategy of this article is to focus on the agent, i.e. the addressee of the legal command or directive who performs the action requested by the legal official. This strategy is bottom-up, from the level of agency and practical reason to the justificatory framework of authority.Key words: Individual Autonomy; Legal authority; Compliance Phenomenon. Resumo: O Direito transforma nossas vidas do modo mais importante: ele altera como nós agimos e, por causa disso, exsurgem uma série de questões fundamentais. Uma dessas questões se relaciona à autoridade do Direito e à liberdade individual, fazendo surgir a pergunta: se nós somos dotados de autonomia como indivíduos, como os legisladores, juízes e agentes públicos possuem autoridade legítima para mudar nossas ações e indiretamente alterar o modo como conduzimos nossas vidas? O objetivos deste artigo é focar no indivíduo, isto é, no destinatário do comando legal que pratica a ação requisitada pelo agente da lei. A estratégia, dessa forma, partir de baixo para cima, do nível do agente e da razão prática até o quadro justificador de autoridade. Inaugurating a new legislative discipline in public contracts, Law No. 14,133 of April 1, 2021 was enacted in good time, bringing important innovations compared to its predecessor. Among the novelties of the Law, stands out the prediction of the "competitive dialogue", a bidding modality through which the Public Administration and the bidders, after negotiations, jointly develop technical solutions capable of meeting the needs of the contractor that led to the opening of the bidding procedure. The present work is dedicated to this institute. Seeking to examine the origins of the new bidding modality and understand the path taken until itsinclusion in Brazilian legislation, the article begins by tracing an overview of administrative consensuality in contemporaneity and examining the theme in comparative law. Afterwards, the work moves on to its main objective, consisting in the specific study of the discipline conferred by the new Brazilian Bidding and Contract Law on the institute. At this moment, we investigate each respective phase of the new bidding modality and the peculiarities inherent to them. Finally, the article also examines the "competitive dialogue" compared to other existing participatory bidding modalities, highlighting the main differences that make it a truly innovative institute. ; Inaugurando uma nova disciplina legislativa em relação às contratações públicas, foi editada, já em boa hora, a Lei nº 14.133, de 1º de abril de 2021, que trouxe importantes inovações em relação à sua predecessora. DOI:10.1590/2179-8966/2020/49180ResumoA Lei n. 13.979, de 6 de fevereiro de 2020, regula medidas de saúde pública relacionadas à emergência do novo coronavírus com alto potencial restritivo de direitos fundamentais, inclusive a quarentena e o isolamento. Esta análise crítica aborda a dimensão internacional da emergência, além da tramitação casuística e antidemocrática da lei brasileira. Com base na legislação epidemiológica em vigor, escrutina estas medidas excepcionais e as salvaguardas à sua implementação.Palavras-chave: Quarentena; Coronavírus; Emergência InternacionalAbstract Law no. 13,979, of February 6, 2020, regulates public health measures related to the emergence of the new coronavirus with high potential to restrict fundamental rights, including quarantine and isolation. This critical analysis addresses the international dimension of the emergency, and the casuistic and anti-democratic procedure of the Brazilian law. Much of the moral and political debate about the rights of migrants has concerned their rights once admitted to a state. Although these issues around the rights of migrants once within the destination country are obviously of great importance, in this chapter I want to focus on the border itself and on the border posts and camps that spring up along the world's frontiers. It ishere that, in the name of national sovereignty and security, universal moral claims are disregarded and the rights derived from them glaringly ignored.
