The article presents the main principles of the French doctrine of the political representation. This doctrine refers to the concept of transference. According to her one entity transfers its rights and obligations to another entity. Transmission entity is represented (voter), while the entity for which the transfer is made is representative (member of parliament). Representation means so that the member of parliament speaks on behalf of the nation. The focal point of this concept is the belief of the fictional nation as a sovereign. As a result, the traditional doctrine of the French was of the view that the nation as something fictional can exist only in the parliament and can be expressed only by the parliamentarian. This position concluding cry that no nation outside of the representatives of the nation. The second element of the French approach was the assumption of a community dimension representation. Evidence of this was the representative mandate to exclude instructions, orders and command will vote. The Joint Committee of Government and Local Self-Government has been operating for over 25 years. It is an institution that was conceived as having an advisory capacity, as a unique instrument of dialogue between the government authority and local self-government. However, experience over the last four years has shown that the central authority has marginalized the role of the Joint Committee, ignoring it completely in the legislative process – the vast majority of changes in the powers of the self-government authorities were introduced through member bills, which do not require an opinion from the Joint Committee. In this article, the authors propose extensive reforms to empower local self-government through the empowerment of the Joint Committee. Its fundamental recommendations are to furnish the Joint Committee with the right of legislative initiative, the right to file a motion with the Constitutional Tribunal, and the introduction of a group legislative initiative to the governing authorities of local self-government units. ; Komisja Wspólna Rządu i Samorządu Terytorialnego funkcjonuje już od ponad 25 lat. Jest to instytucja, która z założenia miała mieć charakter opiniodawczo-doradczy, stanowiąc swoisty instrument dialogu między władzą rządową a samorządem terytorialnym. Praktyka ostatnich czterech lat pokazuje jednak, że władza centralna zmarginalizowała rolę Komisji Wspólnej, pomijając ją zupełnie w procesie legislacyjnym – zdecydowana większość zmian dotyczących kompetencji władz samorządowych była wprowadzano poprzez projekty poselskie, które nie wymagają opinii Komisji Wspólnej. W prezentowanym artykule autorzy proponują szeroko zakrojoną reformę mającą na celu upodmiotowienie samorządu terytorialnego poprzez upodmiotowienie Komisji Wspólnej. Podstawowymi jej postulatami są: wyposażenie Komisji Wspólnej w prawo inicjatywy ustawodawczej, prawo do występowania z wnioskiem do Trybunału Konstytucyjnego oraz wprowadzenie grupowej inicjatywy ustawodawczej dla organów stanowiących jednostek samorządu terytorialnego.

The conception of local self-government contained in the law of March 8, 1990, refers to the tradition of Polish self-government and yet meets the requirements provided for in the European Local Government Charter. The .atbove makes it possible, on the one hand, to return to the institutions previously known to the Polish law, and, on the other, to compare them with their European counterparts. The re-instatement of self-government has brought back to light the issue of duality of public administration and its division into government and selfgovernment administration. In view of the principle in force in the former political regime namely the principle of "unity of government on the level of a locality, the solution to the problem of duality is far from easy". New legislation creates grounds for a new, structurally diversified model of state administration. At the Województwo level (the highest unit of local organization), there operates a nominated official, Wojewoda, the organ of government administration, whereas at a local level — in gmina — the ,,basic form of organization of public activity" is local self-government. The duality of administration manifests itself in many legislative acts. The most important of them are: the Act on Local Self-Government and the Act on Government Administration; mention should also be made about the Act on division of tasks and powers between various organs representing basically different types of administration, etc. Some issues posed by the model require further amendments. Problems of particular gravity arise in connection with the question of regions as subsidiary units of basic administrative division of the country, created to further the tasks of government administration at a local level, the absence of deep structural reforms at a central government level, the absence of a clear determination of position of government administration vis-a vis self-government, disputable budgetary and financial solutions, etc. All this leads to the conclusion that the legislative conception of duality of state administration is not sufficiently clear. Rok 2020, rok pandemii, stał się symbolem nagłych zagrożeń zmieniających zasadniczo życie społeczne i gospodarcze. Jest on jednak tylko przykładem nowych nawarstwiających się niepewności, takich jak zmiany klimatyczne, które silnie wpływają na system administracji publicznej. Przedmiotem opracowania jest odpowiedź na pytanie, jaki ustrój administracji publicznej i jakie prawne formy działania będą sprzyjać zwiększeniu odporności państwa na wstrząsy i większej elastyczności działania jego administracji. Możemy tu ukazać trzy sposoby ujęcia posiadające swoich zwolenników również w nauce prawa, a więc: scentralizowanego państwa rozbudowującego wobec zagrożeń tylko struktury eksperckie i doradcze; państwa minimalnego, w którym wzmacnia się głównie sieć współdziałania z obywatelami, podmiotami gospodarczymi i administracją, takiego, które prowadzi ograniczone działania zarządzania kryzysowego, i trzeciej koncepcji współpracującego systemu modułów administracji rządowej i samorządowej przy dużej niezależności samorządu, dobrej koordynacji i otwarciu na innowacji społeczne. Autorka wypowiada się za wyborem trzeciego modelu dla stworzenia elastycznego, odpornego na wstrząsy państwa, ukazując zalety takiego rozwiązania oraz słabości modelu pierwszego, ku któremu dąży postępująca obecnie recentralizacja. ; The year 2020, the year of the COVID-19 pandemic, has become a symbol of sudden threats that fundamentally change social and economic life. However, the pandemic is only one example of the new accumulating uncertainties, such as climate change, which are strongly affecting the public administration system. The aim of the study is to answer the question of what kind of public administration system and what legal forms of action will contribute to increasing the resistance of the State to shocks, and fostering greater flexibility of its administration. Three approaches will be presented that have their supporters in the legal sciences, namely: a centralized state that only expands expert and advisory structures in order to counter threats; a minimal state, in which the network of interaction with citizens, business entities and the administration is mainly strengthened, being one that conducts limited crisis management activities; and, lastly, the concept of a cooperative system of central and local government administration modules, with local self-government having a high level of independence, good coordination, and openness to social innovation. The author advocates the choice of the third model to create a flexible, shock-resistant state, showing the advantages of such a solution and the weaknesses of the first model, towards which the current recentralization is striving.

The aim of this article is the presentation and the attempt to analyse such phenomena as: an excessive general government deficit and public debt in EU Member States over the past 3 years. For the European Union the years 2008-2010 were the time when public finances of most member countries worsened dramatically. The average budget deficit in the EU increased during that period to a value of almost 7% compared to gross domestic product and public debt reached almost 80% of GDP. Referring the numbers to the principles of the budgetary policy in the Treaty on the European Union (the deficit should not exceed 3% in relation to GDP and public debt – 60% of GDP), the observance of budgetary discipline has been significantly violated. In consequence, the excessive deficit procedure has been initiated. in relation to almost all the countries of the EU, Its purpose was to force the member countries to take concrete actions to stabilize public finances. The economic crisis that began in the second half of 2007 in the United States of America which resulted in a significant deterioration of the finances of all the EU member countries might be regarded as the major source of violation of their budgetary discipline. The reactions of most governments TO the harmful effects caused by the financial crisis were to stimulate national economies and stem the decline of domestic demand. The higher level of public expenditures was simultaneously the cause of increased budget deficits,. To develop and present the problem of an excessive budget deficit and public debt in the EU countries some statistical methods were used and the data source statistics were mainly carried out by the European Commission and the European Statistical Office. ; Celem niniejszego artykułu jest prezentacja i próba analizy zjawisk: nadmiernego deficytu budżetowego i długu publicznego w krajach członkowskich Unii Europejskiej na przestrzeni ostatnich 3 lat. This paper discusses guidelines for implementation of art. 107–109 of the Treaty on the Functioning of the European Union, from the perspective of tax aid. This should lead to verification of the thesis that due to economic recovery plan – in response to the effects of the financial and economic crisis – implemented at EU level, the support of the public authorities in the form of tax subsidies has become the most broadly used form of State aid due to the value among all the forms of aid granted by member states of the European Union. The adoption of such a thesis raises the question of the influence of state aid on the size of the general government sector debt in the EU member states, which have provided tax aid. This analysis was carried out based on the linear regression model. The response variable (dependent variable Y) is the size of the general government sector debt, and explanatory variable (independent variable X) is the expenditure on state aid. ; W artykule omówiono wytyczne dla wdrażania art. 107–109 Traktatu o funkcjonowaniu Unii Europejskiej, z punktu widzenia pomocy podatkowej. Prowadzi to do weryfikacji tezy, że ze względu na wdrożony na szczeblu UE – w odpowiedzi na skutki kryzysu finansowego i gospodarczego – plan naprawy gospodarczej, wsparcie ze strony władz publicznych w formie subsydiów podatkowych stało się najczęściej stosowaną ze względu na wartość formą pomocy publicznej spośród wszystkich form pomocy udzielanych przez państwa członkowskie Unii Europejskiej. Przyjęcie takiej tezy skłania do postawienia pytania o wpływ pomocy państwa na wielkość zadłużenia sektora finansów publicznych w państwach członkowskich UE, które udzielały pomocy podatkowej. Analiza ta została przeprowadzona na podstawie modelu regresji liniowej. Zmienną objaśnianą (zmienną zależną Y) jest wielkość długu sektora general government, a zmienną objaśniającą (zmienną niezależną X) są wydatki na pomoc państwa.
W gospodarce rynkowej podstawowym zadaniem instytucji państwowych jest ograniczenie niepewności przez wyznaczanie ram wpływających na podejmowanie działań i decyzji wszystkich podmiotów. Od efektywności instytucji, przyjętego przez nie systemu działania oraz jego spójności, zależy skuteczność realizacji wyznaczonych strategii i planów społeczno-gospodarczych. Nieskuteczne i nieetycznie działające instytucje mogą wywoływać narastanie zjawisk patologicznych i nie pozwolić z jednej strony na swobodny, bez narzucania niepotrzebnych ograniczeń rozwój wszystkich podmiotów w gospodarce, z drugiej natomiast – doprowadzić do sytuacji, w której odsłonią się niekontrolowane objawy zwierzęcej natury, skłaniające do nieracjonalnych, nazbyt ryzykownych czy wręcz szkodliwych zachowań. Wywołuje to potrzebę wypracowania przez państwo mechanizmów, które godziłyby wymogi efektywności ekonomicznej, społecznej i politycznej z jednoczesnym uszanowaniem norm etycznych. Celem opracowania jest wykazanie, że kwestie powiązań pomiędzy etycznie postępującymi reprezentantami instytucji państwowych a etycznym postępowaniem przedstawicieli biznesu są niedostatecznie dostrzegane i doceniane oraz że wprowadzenie systemu etycznego, złożonego z ocen obiektywnych, implikuje w efekcie etyczną samoregulację podmiotów społeczno-gospodarczych i rozwój ekonomiczny państwa. ; In a market economy, the main task of state institutions is to reduce uncertainty by setting frameworks that affect actions and decisions of all the actors in the market. The effectiveness of the implementation of socio-economic strategies and plans depends on the efficiency of the system adopted and its coherence. Ineffective and unethical institutions may lead to an accumulation of pathological phenomena. On the one hand they hinder the free, and not unreasonably restricted, development of all actors in the market, and on the other hand they may lead to a situation in which the uncontrollable symptoms of 'animal instinct' will come into play, provoking irrational, too risky or even harmful behaviours. This in turn raises the need to develop state mechanisms that reconcile the requirements of economic, social and political efficiency whilst at the same time respecting ethical standards. The aim of the study presented in this article was to demonstratethat the correlation between ethically acting of representatives of state institutions and the ethical behaviour of business representatives is not sufficiently recognised and appreciated, and that the introduction of a system of ethics, consisting of objective assessments, implies the ethical selfregulation of socio-economic entities and of the economic development of the state.
What we are witnessing now, not only in Great Britain, is that citizens are less and less interested in participation in politics. We see a crisis of representative democracy. One of the means used to fight those negative trends is the use of Information and Communication Technology. It not only enables citizens to gain a wide access to public information but also empowers them to take part in decision making. The article was written with the aim to analyze the political agenda of successive British governments pertaining to the use of the Internet in building more effective local government communication channels in English local authorities. The analyses of documents and secondary sources were conducted. Special attention was devoted to the introduction and development of electronic petition systems on the local level, as e-petitions are one of the most popular e-democracy mechanisms in Great Britain. Their use has also been laid down in law.
W wielu państwach europejskich w okresie ostatnich kilkudziesięciu lat zauważyć można transformację lokalnej demokracji przedstawicielskiej. Jest to zarówno wynikiem wdrożenia reform inspirowanych koncepcjami Nowego Zarządzania Publicznego (New Public Management), lokalnego współrządzenia (local governance), zmian o charakterze strukturalno-funkcjonalnym, jak i poszerzających się mechanizmów uczestnictwa obywatelskiego. Ostatnia z tendencji w sposób szczególnie wyraźny uwidacznia się w Polsce, w samorządach dużych miast. Celem artykułu jest przedstawienie stosunku radnych do idei i mechanizmów partycypacji obywatelskiej oraz określenie stopnia wpływu tychże na pozycję i rolę rad w procesie rządzenia. Artykuł opiera się na badaniach empirycznych przeprowadzonych w 18 miastach polskich. Wyniki badań wskazują, że radni miejscy generalnie popierają ideę szerszego angażowania mieszkańców w proces decyzyjny. Większość z nich uznaje jednak funkcjonujące w ich miastach formy uczestnictwa obywatelskiego za wystarczające, postulując jednocześnie usprawnienie ich działania. ; Over recent decades, many European countries have witnessed a transformation of local representative democracy. This has resulted both from the reforms inspired by the concepts of New Public Management, local governance, structural and functional changes as well as the expanding mechanisms of citizen participation. The latter trend is especially visible in large Polish cities. The main objectives of this article are to present the attitude of city councilors towards the concept and mechanisms of citizen participation and to examine whether this 'extended participation' influences the status and role played by city councils in the governing process. The article is based on empirical research conducted in 18 Polish cities. The results indicate that elected representatives, in general, support the idea of 'citizens' involvement in the decision-making process. Most of them, however, recognize the current mechanisms of civic engagement as sufficient, promoting the need to streamline their operation.
Over recent decades, many European countries have witnessed a transformation of local representative democracy. This has resulted both from the reforms inspired by the concepts of New Public Management, local governance, structural and functional changes as well as the expanding mechanisms of citizen participation. The latter trend is especially visible in large Polish cities. The main objectives of this article are to present the attitude of city councilors towards the concept and mechanisms of citizen participation and to examine whether this 'extended participation' influences the status and role played by city councils in the governing process. Jest to zarówno wynikiem wdrożenia reform inspirowanych koncepcjami Nowego Zarządzania Publicznego (New Public Management), lokalnego współrządzenia (local governance), zmian o charakterze strukturalno-funkcjonalnym, jak i poszerzających się mechanizmów uczestnictwa obywatelskiego. Ostatnia z tendencji w sposób szczególnie wyraźny uwidacznia się w Polsce, w samorządach dużych miast. Celem artykułu jest przedstawienie stosunku radnych do idei i mechanizmów partycypacji obywatelskiej oraz określenie stopnia wpływu tychże na pozycję i rolę rad w procesie rządzenia. Artykuł opiera się na badaniach empirycznych przeprowadzonych w 18 miastach polskich. Wyniki badań wskazują, że radni miejscy generalnie popierają ideę szerszego angażowania mieszkańców w proces decyzyjny. Większość z nich uznaje jednak funkcjonujące w ich miastach formy uczestnictwa obywatelskiego za wystarczające, postulując jednocześnie usprawnienie ich działania.
