EVIDENCE SUGGESTS THAT THE RESTORATIVE JUSTICE MOVEMENT SHOULD BE PURSUED VIGOROUSLY. THE CONVENTIONAL CRIMINAL JUSTICE POLICIES THAT EMPHASIZE DETERRENCE, RETRIBUTION, INCARCERATION, AND ADVERSIAL ENCOUNTERS HAVE NOT PROMOTED BETTER SOCIETIES. TO THE CONTRARY, IT IS HIGHLY PROBABLE THAT THEY MAKE THINGS WORSE. RESTORATIVE JUSTICE ALTERNATIVES NOW EXIST. WHEN COMMUNITIES BEGIN TO EMBRACE THEM, AND SHOW THEIR POSITIVE EFFECTS, ONE CAN HOPE THAT POLITCY MAKERS WILL FOLLOW SUIT.

Nach Ansicht des Autors kann in Polen nicht von einer Rückkehr des Kommunismus die Rede sein; vielmehr muß seiner Meinung zufolge vom Beginn einer "samtenen Restauration" im Gefolge der "samtenen Revolution" von 1989 gesprochen werden. In diesem Zusammenhang zieht der Verfasser in seinem Essay einen Vergleich zwischen der politischen Entwicklung Polens nach dem Zusammenbruch des Kommunismus und der Entwicklung der Französischen Revolution nach 1789. Es waren weniger die polnischen Postkommunisten, die die Parlamentswahlen gewonnen, sondern vielmehr die Nachfolgeparteien der "Solidarnosc"-Bewegung, die die Wahlen verloren haben. (BIOst- Mrk)

As conservator-restorers we should be "a voice of reason", an advocate that speaks for the cultural heritage values of our built heritage. However, we are often only one voice in a large group consisting of everything from structural engineers, geologists and carpenters to economic advisors and bureaucrats. Being a conservator-restorer in such settings often turns out to be a great balancing act. On the one hand, we are supposed to protect the buildings against any intervention that will compromise its authenticity and cultural values. On the other hand, we must allow as much protective work as possible to ensure the buildings' future. Questions that can arise for a conservator-restorer during and after discussions in multi-disciplinary groups are many. Questions that needs answering before work starts. Are the conservator-restorer and the master craftsperson really on each end of the scale in a project, or is it just that we use different words? Is it conservation ethics versus the practical view of the engineer, or can both sides be pragmatic and find a new and possibly better solution? Is it possible that the conservator-restorer and the funding body can meet in the middle, or can that jeopardize the project?
Responsibility, Restoration and Fault suggests how we could measure responsible behaviour. What criteria do our actions have to abide by to protect individuals and society? This is particularly relevant in a period where modern technology has not only multiplied the risks and degree of damage, but also created long causal chains that often make it difficult to see a connection between action and damage, and when the damaging effects on individuals or society only emerge decades later. The author argues that a person's behaviour is responsible if the following criteria are fulfilled simultaneously: (i) the person, whose behaviour could cause damage, would be able to restore the victim, (ii) the person, whose behaviour causes actual damage, restores the victim (both criteria of restoration) and (iii) the person is not at fault when determining and executing an act (criteria of fault). With its historical and legal philosophical perspective Responsibility, Restoration and Fault is a must read for every lawyer
