In a world marked by surging international conflicts, labour market globalisation, ever-widening economic inequities, steady improvement in the flow of information, and increasing possibilities for mobility over greater distances, the number of migrants on a worldwide basis is hardly likely to decrease in coming years. Immigration regulations are devised within a confluence of national interests, international laws, and attention to migrants' individual rights. The tension between these disparate considerations begs the question: How can we best safeguard both universal rights issues and European economic integration, as well as the Norwegian state's obligation, vis-à-vis the distribution of benefits, to its own citizens. We are moving into extremely complex ethical and legal territory, where there are no easy answers. In this book, the author puts Norway's immigration policy under a moral-philosophical loupe for a thorough analysis of various answers to key questions in the Norwegian immigration debate.
This book is aimed at anyone interested in immigration policy issues, but especially persons working professionally in the field, such as political philosophers, politicians, lawyers, case managers and political scientists. - I en verden der internasjonale konflikter stadig blusser opp, arbeidsmarkedet globaliseres, økonomiske ulikheter blir stadig større, informasjonsflyten kontinuerlig forbedres og mulighetene for å forflytte seg over store avstander er gode, vil antallet migranter på verdensbasis ikke bli lavere i årene som kommer. Innvandringsregulering finner sted i spenningen mellom statlige interesser, internasjonal rett og hensynet til migranters individuelle rettigheter. I lys av disse spenningene må vi stille spørsmålet om hvordan vi best mulig kan ivareta både universelle rettighetshensyn og europeisk økonomisk integrasjon, samt den norske stats forpliktelse overfor egne innbyggere i fordeling av goder. Vi beveger oss inn i et etisk og juridisk felt med stor kompleksitet, hvor ingen enkle svar er gitt. I denne boken legger forfatteren norsk innvandringspolitikk under en moralfilosofisk lupe, og drøfter grundig ulike svar på en rekke sentrale spørsmål i norsk innvandringsdebatt.
Boken retter seg mot alle med interesse for innvandringspolitiske spørsmål, men særskilt personer som arbeider profesjonelt innenfor feltet, slik som politiske filosofer, politikere, jurister, saksbehandlere og statsvitere.
Society's use and management of water relies on professional expertise spanning diverse fields: from biology and technology to economics and law. This book examines current issues related to regulating water through chapters summarizing various sets of regulation as well as chapters that take a scientific deep dive into selected themes. The diversity of professional expertise is also reflected in the law aspect. We explore such subjects as surface runoff, natural disasters, drinking water, groundwater, salmon, hydropower, and human rights, as well as general impact assessment requirements and duty of knowledge in environmental law administration. A key objective of the book has been to provide an interdisciplinary understanding of the legal circumstances associated with water, and in addition, deliberate the pros and cons of some of the current regulations.
This book will be particularly useful for those who in various ways support and facilitate procedures within the public sector at both the national and municipal levels. It will also be useful for private sector actors seeking familiarity with legal questions that can arise in relation to public administration and other private actors. From a broader perspective, we hope the book can help to throw light on conflicts between different interests and groups within society that occur, for example, when introducing fees, special injunctions against private actors, and requirements for knowledge basis.
This book project is the result of legal research conducted at the Norwegian University of Life Sciences (NMBU) and is supplemented by national expertise in several areas. It has been edited by Steinar Taubøll, a professor at NMBU's Department of Property and Law. Taubøll has a background in both law and the natural sciences, and extensive experience with interdisciplinary work. - Håndtering og bruk av vann i samfunnet krever et faglig mangfold fra biologi og teknikk til økonomi og juss. Denne boken drøfter aktuelle temaer knyttet til rettslig regulering av vann, både i form av oversiktskapitler om ulike regelsett og gjennom vitenskapelige dypdykk i utvalgte temaer. Den faglige spennvidden gjenspeiler seg også innen det juridiske. I boken finner man stoff om overvannshåndtering, naturfare, drikkevann, grunnvann, villaks, kraftutbygging, menneskerettigheter, samt om generelle utredningskrav og kunnskapsplikter i miljørettsforvaltning. Et sentralt siktemål er å bygge opp tverrfaglig forståelse av gjeldende juridiske forhold knyttet til vann, og dessuten sette noen av dagens reguleringer under debatt.
Boken retter seg særlig til de ressurspersonene som på ulike måter støtter saksbehandlingen i stat og kommune. Boken antas også å være nyttig for private aktører som vil gjøre seg mer kjent med rettsspørsmål som kan oppstå i forhold til forvaltningen og til andre private aktører. I et bredere perspektiv er det dessuten ønskelig at boken kan bidra til å belyse konflikter mellom ulike hensyn og grupper i samfunnet, for eksempel ved innføring av gebyrer, pålegg rettet mot private, innføring av tyngende vilkår og krav til kunnskap og faktagrunnlag.
Bokprosjektet springer ut av den juridiske forskningen ved Norges miljø- og biovitenskapelige universitet, og har i tillegg knyttet til seg nasjonal spisskompetanse på mange temaer.
Bokas redaktør er dosent Steinar Taubøll ved Institutt for eiendom og juss ved NMBU, som har naturfaglig og juridisk utdannelse, samt lang erfaring med tverrfaglig arbeid.
"This anthology examines and elucidates how variation in ability (physical and cognitive) as a human condition impacts participation in religious communities and theology and diakonia as professional disciplines. Functional impairment and disability are meaningful human experiences that are important to explore critically and constructively, in a Norwegian context as well.
Fellowship – that everyone is entitled to equal conditions and opportunities for participation in a society – is also relevant in the context of religion, theology and diakonia. Religious fellowship comprises among other things the possibility of being able to choose religious participation and to be religiously active, for example through degrees of association and social participation, employment and volunteer work. Many people have experienced exclusion from participation in religious practices and communities due to specific attitudes or physical barriers. This anthology presents new research on a variety of topics relating to religious fellowship with a focus on equality, human rights and views of humanity. Based on quantitative and qualitative research, the anthology examines various aspects of elections to the Sámi Parliament, both in general and regarding the 2017 election in particular. The nine chapters delve into a wide range of topics, from voter behaviour and election results to more fundamental questions regarding indigenous representation and organizing in Norway. The book covers five main themes. First, Sámi identity and criteria for voter registration. What are considered acceptable grounds for claiming to be Sámi, and what criteria do people use when judging others as Sámi or non-Sámi? When is one 'Sámi enough' to qualify for the right to vote? These questions have a bearing on the very core of Sámi politics: who should be allowed to choose representatives on behalf of the Sámi people? Second, Sámi civil society. How do organizations that represent Sámi persons and Sámi interests relate to the Sámi Parliament? Third, voter turnout. How do we explain non-voting in a system where, unlike those for other elections in Norway, one must actively register in advance to be able to vote? And what about the fact that voters in municipalities with fewer than 30 registered voters must vote in advance? Do these circumstances depress voter turnout? Fourth, the party-political landscape. Når er man «samisk nok» til å melde seg inn i valgmanntallet? Disse spørsmålene angår selve grunnlaget for samepolitikken: hvem som skal tillates å velge representanter på vegne av det samiske folket. For det andre, det samiske sivilsamfunnet. Hvordan forholder organisasjoner som representerer samer og samiske interesser seg til Sametinget? For det tredje, valgdeltakelse. Hvordan kan man forklare hjemmesitting i et system der man – i motsetning til andre valg i Norge – aktivt må registrere seg på forhånd som velger? Og hva med det faktum at velgere i kommuner med færre enn 30 manntallsførte må forhåndsstemme – bidrar dette til å trekke ned valgdeltakelsen? For det fjerde, det partipolitiske landskapet. Hva skiller velgerne til de ulike partiene? Er det tydelige forskjeller som gjør det lett for velgerne å se forskjell på partiene? For det femte, valgkampen og velgernes informasjon. Hvor henter velgerne sin informasjon om valget fra? Vi ser særlig på hvordan partier og velgere finner hverandre i Sør-Norge, en valgkrets der sametingsvalget nesten ikke dekkes i mediene.
