The right to strike action is one of the fundamental human rights and trade union freedoms. Strike, as a form of protest against broadly understood injustice is one of the most important measures of trade union protection of workers' interests. However, the right to strike is not absolute and its legal use must often take into account the interests of the employer and third parties. The aim of the article is to assess – basing on a review of the literature and the case-law – the doctors' right to strike from a legal, ethical and moral perspective. The issue of medical practitioners' right to participate in a strike is ambiguous in view of the legislation currently in force, and two opposing positions have developed in the collective labour law literature. The problem of the legality of this form of protest of medical practitioners is nowadays left to the assessment of the parties to a collective bargaining dispute, carried out based on the general clause of a possible "threat to human life and health or national security", with the lack of appropriate judicial review in this regard. It is, therefore, undoubtedly necessary for the legislature to take appropriate pro futuro legislative action. ; Prawo do strajku należy do podstawowych praw człowieka oraz wolności związkowych. Strajk, jako jedna z form protestu przeciwko szeroko rozumianej niesprawiedliwości, należy do najistotniejszych środków związkowej ochrony interesów pracowniczych. Prawo do strajku jednak nie ma charakteru bezwzględnego, a korzystanie z niego w sposób legalny musi niejednokrotnie uwzględniać interes pracodawcy i osób trzecich. Celem artykułu jest ocena legalności strajku lekarzy z punktu widzenia regulacji ustawowych oraz zasad etycznych i moralnych, przy uwzględnieniu poglądów literatury i orzecznictwa. Kwestia prawa lekarzy do udziału w strajku jest na gruncie aktualnego stanu prawnego niejednoznaczna, a w literaturze zbiorowego prawa pracy wykształciły się dwa przeciwstawne stanowiska w tym zakresie. Problem legalności tej formy protestu lekarzy pozostawiony jest obecnie w zasadzie jedynie ocenie stron sporu zbiorowego, dokonywanej przez pryzmat ogólnej klauzuli ewentualnego "zagrożenia życia i zdrowia ludzkiego lub bezpieczeństwa państwa", przy jednoczesnym braku odpowiedniej kontroli sądowej w tym zakresie. Niewątpliwie zatem wymagane jest podjęcie przez ustawodawcę odpowiednich działań legislacyjnych pro futuro.

Głównym tematem artykułu jest analiza prawicowo-ekstremistycznych nastrojów w społeczeństwie niemieckim, których rzecznikiem stają się coraz częściej przedstawiciele klasy średniej. Nieudany projekt wielokulturowości niemieckiej, długotrwały kryzys gospodarczy w Europie, zjawisko terroryzmu islamskiego i fala uchodźców stworzyły atmosferę ksenofobizmu i rasizmu. Pytanie badawcze dotyczy perspektyw utrwalania demokratycznych standardów w pozjednoczeniowym społeczeństwie niemieckim przez klasę średnią, która może stać się najważniejszym elementem wpływającym na opinię publiczną. Renesans ideologii faszystowskiej wymusił konieczność wykreowania nowego modelu komunikowania społecznego pomiędzy klasami. Percepcja tej ideologii jest przedmiotem badawczym sfery aksjologicznej. ; The main topic of this paper is the analysis of right-wing extremist sentiments in German society. Representatives of the middle-class are mostly identified with these political tendencies. The unsuccessful multicultural project in the Federal Republic of Germany, long-lasting economic crisis in Europe, Islamic terrorism and the wave of immigrants have led to the spread of xenophobia and racism. Thus, many new parties and various informal groups are being formed that expect the government to change the asylum policy of the state and which express their need to consolidate national identity. These social groups demonstrate a critical attitude to the German political system, attracting a certain portion of the protesting electorate. One of the citizens' movements, named Pegida, is demonstrating against not only radical Muslims but Islam as a whole. The organizers and supporters of Pegida publicly distance themselves from right-wing extremists, but use the fears of Islamic terror to spread general negative sentiments towards refugees and foreigners. The research question refers to the prospects of instilling democratic standards in the middle class of German society after the post-unification period. This social class may be the most important factor influencing public opinion. The renaissance of fascist ideology has forced the creation of a new model of communication between social classes. The perception of right-wing ideology is the object of research in the axiological sphere.

Societies around the globe have been witnessing the emergence of the radical right, often seen as the result of neoliberal globalization. Democratic governance, liberalism, human rights, and values are being questioned while populist, authoritarian, and ethnonationalist forms of governance are being offered. In the European Union, the tumultuous developments have been testing the viability of the identity marker of Europeanness and its perseverance in EU member states. What we are witnessing are significant shifts in the discourse about sameness and otherness, the convergence of left and right ideologies and the emergence of hybrid forms of authoritarianism and democracy that have been dubbed as illiberal democracy or authoritarian liberalism. The rise of the radical right and its mobilization across the EU member states is reflective of these processes, and it is the goal of this author to understand the mechanisms behind the empowerment, mobilization, and normalization of radical right through the case study of Slovakia. In particular, the effort of this paper is to understand how the far-right party Kotlebovci – Ľudová Strana Naše Slovensko (ĽSNS) in Slovakia re-conceptualized the notion of nation and normalized far-right ideology as a pretext of a broader mobilization.

Adjusting the legal status, and support policies for migrant workers is an issue on the agenda of international institutions for nearly a hundred years. The first efforts to protect foreign workers have been taken during the first session of the International Labour Conference in 1919. In the following decades ILO activities has led to the preparation of three international documents concerning this issue (non-binding ILO Convention No. 66 in 1939, and Convention No. 97 of 1949, and No. 143 of 1975). For many decades, the problem of the protection and assistance of migrant workers' rights was considered as a narrow issue of international labor law. Codification efforts, undertaken during seventies, has led to the adaptation of the UN document (International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families) in 1990, and inclusion this issue into more general area of international human rights law. Despite this fact, and the existence of several categories of documents concerning migrant workers within Council of Europe, the European Union, and even ASEAN, the protection of migrant workers has never been effectively functioning system. The aim of this article is the analysis of the codification of that issue, and the main obstacles to consensus on the protection of migrant workers' rights. The state parties of the UN Convention contains primarily countries of origin of migrants (such as Mexico, Morocco and the Philippines). It seems, therefore, that despite 46 ratifications the, UN convention does not have a global character, and activities of its monitoring body (Committee on Migrant Workers-CMW) reflects primarily demands of sending countries. The article closely examines particularly controversial provisions of the ILO and UN documents from the point of view of current labour migrations and policies of sending and host countries.

The author analyses the pattern of governance of the right-wing parties in Poland between 2015 and 2019. It bears many features of a concentration of powers as a method of achieving desired goals in the sphere of political competition and public policy along with the use of informal components. The manifestation of concentration of power is centralisation, understood as the transfer of functions of the state from the lower (in particular local government) levels to the higher, as well as strong interference of the central government in many areas of public life that previously remained apolitical.

Mediation is proving to be an effective way to manage conflicts in aconstructive way. But mediation not only helps to solve specific problems, because its potential encompasses aspects of greater complexity. Thus, mediation helps us to know ourselves better, to better understand others, and to use what we have learned to better manage future conflict situations. In asociety where there is no culture of agreement and where there is no education in the field of emotions, mediation becomes an adequate and effective tool to resolve conflicts in apeaceful and constructive manner. On the other hand, mediation allows the parties to take responsibility for the resolution of their own conflict, to be active agents in the process. The greater the citizens' participation in the different decision making processes, the more democratic asociety will be. That is why, in the restoration of social peace, citizenship should play arole as an active agent, and mediation is asuitable instrument for this purpose because the individuals in conflict find the way to solve it without third party impositions. ; Mediation is proving to be an effective way to manage conflicts in aconstructive way. Przypadek Polski doskonale pokazuje skalę rozbieżności pomiędzy badaczami, którzy z jednej strony krytykują specyficzny charakter polskiej wersji podziału lewica–prawica, a z drugiej strony dostrzegają jednak jego ważną rolę w procesie samoidentyfikacji aktorów politycznych i społecznych oraz zdolność do porządkowania życia politycznego – partie definiują się w określony sposób, a wyborcy trafnie owo pozycjonowanie rozpoznają i w oparciu o nie podejmują decyzje wyborcze.Celem niniejszego artykułu jest sproblematyzowanie owych rozbieżności w dwojaki sposób. Po pierwsze, poprzez ukazanie, iż u genezy tego "problemu" tkwią założenia związane z teorią racjonalnego wyboru. To pozytywistyczna ontologia oraz epistemologia leżące u podstaw paradygmatu racjonalnego wyboru pozwoliły na sformułowanie problemu, który z perspektywy podejść interpretatywnych byłby raczej nieodłączną częścią życia politycznego. Po wtóre, poprzez zastosowanie do badaniapodziału lewicowo-prawicowego założeń konstruktywizmu w celu zbadania roli, jakie pełni omawiana dychotomia w procesach komunikowania i konstruowania porządku politycznego. ; The case of Poland perfectly illustrates the scale of discrepancies between researchers who, on the one hand, criticize the specific nature of the Polish version of the left-right split, but on the other emphasize its important role in the process of identifying political and social actors and the ability of dichotomy to organize political life. Political actors define themselves in a specific way, allowing voters to recognize these acts of self-positioning and rely on them to make electoral decisions. The purpose of this paper is to problematize these divergences in two ways. First, by showing that the origin of this 'problem' lies in the assumptions underlying the theory of rational choice. It is claimed that it is the positivist ontology and epistemology underlying the paradigm of rational choice that produced 'the problem', which – from the perspective of interpretative approaches – constitutes an inherent part of political life. Secondly, by applying the assumptions of constructivism to the study of the left-right division in order to investigate the role of dichotomy in the political communication processes and construction of political order.

The institution of expropriation is an instrument for public authorities to actuate discharge of public tasks that are important for general needs of society. Substantive conditions of expropriation determine activities of public administrative authorities that reach for this instrument while specifying protection of ownership rights under the Polish legal system. In addition, they guarantee constitutional standards of expropriation that also include expropriation procedures regulated by statutes that protect owners' interests against excessive public legal interference with their rights. Securing rights of expropriated property owners is of paramount importance in the perspective of both standards of democratic rule of law and their compliance with axiology of the provisions of the Polish Constitution. The conclusions reached in this paper will help to assess how they fulfil the constitutional determinants of expropriation. ; Instytucja wywłaszczenia jest narzędziem w rękach władzy publicznej urzeczywistniającym realizację zadań publicznych ważnych z punktu widzenia potrzeb ogólnospołecznych. Materialnoprawne przesłanki wywłaszczeniowe determinują aktywność organów administracji publicznej w sięganiu po ten instrument, będąc jednocześnie dookreśleniem ochrony prawa własności w polskim porządku prawnym. Ponadto stanowią gwarancję dochowania konstytucyjnych standardów wywłaszczenia, przez które rozumie się także ustawowo uregulowane procedury wywłaszczeniowe, w ramach których chronione są interesy właścicieli przed nadmierną publicznoprawną ekspansją w ich prawa. Zabezpieczenie praw właścicieli nieruchomości wywłaszczanych ma ogromne znaczenie z punktu widzenia zarówno standardów demokratycznego państwa prawnego, jak i ich zgodności z aksjologią przepisów Konstytucji RP. Poczynione w niniejszym artykule ustalenia pozwolą na ich ocenę pod względem spełnienia konstytucyjnych determinantów wywłaszczenia.

This book explores the issue of development-induced population displacement from the point of view of development studies and development ethics. Based on an ethical approach, specifies the measures to minimize the problems of displaced persons and strengthening their participation as a beneficiaries of development projects. The book combines a thorough examination of the most important causes of involuntary population resettlement with numerous references to ethical and social aspects of this problem. Ethical considerations have become a starting point for the analysis of the decision-making process in the most spectacular cases of development-induced displacement and resettlement, associated, inter alia, with the construction of the Sardar Sarovar Project on the Narmada River, and the Kariba Dam on the Zambezi River. In addition to the groundbreaking theoretical approach to the problem, the significant advantage of the book is to draw attention to the lesser-known causes of displacement and notable historical considerations. The interdisciplinary nature of the study is reflected in the application of ethical approach as a point of reference for considerations on the basis of development studies, decision-making mechanisms and legal framework for resettlement planning, defining the responsibilities and the nature of the displaced (DIDPs) and affected (PAPs) communities (rights-based approach).

The main object of the presented article is to prove that, according to Robert von Mohl's views on the idea of civil rights, he should be classified as the exponent of moderate early German liberalism. The first section of the study drafts a background for its next two parts. It presents the socio-political circumstances of the German states from the beginning of the 19th century to the developments of the Springtime of the Peoples. The analysis of the German scholar views on the citizenship's idea in the context of the Rechtsstaat and basic rights notion is undertaken in the second part of the article. In the third part, it is proved, that von Mohl was a thinker who chose the path of the "golden mean". Regarding the citizen's position in state, on the one hand, he proposed a substantial catalogue of civil rights. On the other hand, he didn't support the idea of universal political rights. ; Główny cel niniejszego artykułu polega na dowiedzeniu tezy stanowiącej, że rozumienie idei praw obywatelskich w poglądach Roberta von Mohla klasyfikuje go jako przedstawiciela umiarkowanego niemieckiego wczesnego liberalizmu. Pierwsza część opracowania obejmuje omówienie uwarunkowań społeczno-politycznych ziem niemieckich od początków XIX w. do wydarzeń Wiosny Ludów. Stanowi ona tło dla następnych dwóch części. Skupiono się w nich na analizie poglądów niemieckiego uczonego na pojęcie obywatela w kontekście idei Rechtsstaat oraz na prawa zasadnicze (w których zawierały się prawa obywatelskie i polityczne). W artykule dowiedziono, że von Mohl był myślicielem wybierającym drogę "złotego środka" w odniesieniu do pozycji obywateli w państwie. Z jednej strony, zgodnie z dominującym w ówczesnym niemieckim liberalizmie poglądem, przewidywał on szeroki katalog praw obywatelskich w państwie, z drugiej zaś obca mu była idea powszechnych praw politycznych, ich wykonywanie ograniczone było bowiem u von Mohla cenzusem.
