The review describes the conceptual and content side of the collection of articles, mainly authored by English-speaking specialists that focus on the development of Rome and Constantinople between the 4th and the 6th century. The reviewer emphasizes the topicality of the collection as related to the subject of research. He also points out the arguable nature of issues that have to do the infrastructure formation of early Constantinople and the development of historical typography of Rome in late antiquity. Special attention is paid to the articles that have a new interpretation of the social and political aspects of the two capitals of the late antique society and their social influence on the conservation of structures originating from the classical polis and the western civitas as societies of free citizens enjoying full rights. ; Рецензия раскрывает концептуальную и содержательную стороны сборника статей преимущественно англоязычных специалистов, анализирующих развитие Рима и Константинополя в IV–VI вв. Указана актуальность избираемой исследователями тематики в рамках заявленной сборником проблемы. Подчеркнута спорность решения вопросов, касающихся формирования инфраструктуры раннего Константинополя и развития исторической топографии позднеантичного Рима. Особое внимание обращено на статьи, по-новому раскрывающие социально- политические аспекты функционирования обеих столиц позднеантичного общества и их социальное влияние на консервацию структур, восходящих к классическому полису и западному «цивитас» как коллективам полноправных свободных граждан.

The article is devoted to the problem of the origin of the earliest ideas about themeaning of positive law in the jurisprudence of Ancient Rome and the ancient Romanlegal consciousness and legal culture. The distinction between law and legislation, therole and status of positive law in the legal system, its evaluation from the point of viewof compliance with the idea of law – ideas, specific to different types of legal consciousnessof a later period originated in the legal doctrine of Ancient Rome. The problem ofnorms of the Roman law is examined from the point of view of modern ideas about therule of law; its features in relation to this historical period are distinguished. The authorscome to the conclusion that the characteristic of Ancient Rome multiplicity of sources oflaw led philosophers and lawyers to the allocation of a special concept of law, unitingthe entire set of regulations of the normative nature. ; Статья посвящена проблеме зарождения наиболее ранних представлений о значении позитивного права в юриспруденции Древнего Рима и древнеримском правовосознании и правовой культуре в целом. Разграничение права и закона, роль и положение позитивного права в системе права, его оценка с точки зрения соответствия идее права – идеи, характерные для различных типов правопонимания более позднего периода, берут начало именно в юридической доктрине Древнего Рима. Исследуется проблема норм римского права с точки зрения современных представлений о норме права, выделяются ее особенности применительно к рассматриваемому историческому периоду. Авторы приходят к выводу о том, что характерная для Древнего Рима множественность источников права привела философов и юристов к выделению специального понятия права, объединяющего всю совокупность предписаний нормативного характера.

Актуальность работы обусловлена необходимостью пересмотра существующих в исторической науке трактовок мотиваций варваров в отношениях с римским обществом и государством в свете современных концепций социологии, социальной и исторической антропологии. Цель работы: реконструкция предпосылок, повлиявших на решение короля готов Алариха о взятии Рима в 410 г., в контексте взаимодействия Римской империи и варварских народов методом историко-антропологической интерпретации и компаративного анализа историографии дискуссионных проблемных точек. Методы исследования: общенаучные методы анализа, синтеза и историзма, исторический нарратив, историко-генетический и историко-типологический методы, компаративный анализ источников и историографии, критика исторического источника. Результаты. Реконструированы обстоятельства, повлиявшие на решение предводителя готов Алариха о взятии и разорении Рима в 410 г. Определены две группы таких обстоятельств, условно обозначенные как внутренние и внешние по отношению к личности Алариха. К числу первых относятся личностные интенции и приоритеты: 1) стремление Алариха сохранить статус лидера и короля варварского войска, для чего требовались воинские успехи и распределение предметов престижного потребления; 2) стремление Алариха интегрироваться в систему римской воинской иерархии и администрации, получив официальный пост командующего войсками диоцеза или всей Западной империи в целом; 3) индивидуальная стратегия воздействия на правительство империи и местную аристократию через сочетание переговоров и военного шантажа. К числу вторых относятся не зависящие от Алариха и не контролируемые им факторы и условия: 1) предубеждение со стороны императора Гонория, подозревавшего Алариха в стремлении к узурпации, 2) распространение антиварварских настроений в романском обществе, периодически подогреваемых сознательной риторикой придворных фракций, 3) необходимость обеспечить войско продовольствием. ; The relevance of the discussed issue is caused by the need to reiterate Roman-Barbarian relations' current interpretation. The nowadays conceptions of sociology, social and historical anthropology give us the opportunity for the profound understanding of ideal and material cultural impacts in the frame of the late Roman Empire. The main aim of the study is to reconstruct the causes of Alaric's decision to plunder Rome in 410 AD in the context of intercultural Roman-Barbarian interactions by means of historical and anthropological interpretation and historiographical comparative analysis. The methods used in the study: general science methods of analysis, synthesis and historicism, method of historical narrative, historical genetic method, historical typological method, historical source criticism, comparative historiographical analysis. The results. The author found out the causes of Alaric's decision to plunder Rome in 410 AD. There are two groups of the causes in relation to Alaric's person. The first group consists of the personal aims and priorities: 1) the intention of Alaric to keep leader's status among the Barbarians and to provide military luck and loot for that purpose, 2) the opposite but akin intention of Alaric to enter in Roman military system by the assignment to the office of magister militum, 3) Alaric's personal strategy of pressing on the Roman imperial and local officials by the combination of treaties and blackmails. The second group consists of the factors unrelated to Alaric's person: 1) the bias of the emperor Honorius, who had rejected any proposals of treaty between the Empire and Alaric, 2) the widespread antibarbarian common opinion by the Empire's citizens put Alaric in an outcast's position; 3) Alaric had had to find a foodstuff for the army.

The starting point of the conclusions of politicians and experts was the recognition of the changed nature of threats to the New World Order. In post-Westfalia system of international relations the main actors are not sovereigns, but transnational actors of world politics, including transnational terrorist and criminal networks. In this situation, the support of global security threat serves the underground world – terrorists, shady business structures, failed states. The unconventional nature of the threat to peace and stability of the New World Order requires an equally innovative response which transcends the formal constraints of international law and the traditional doctrine of deterrence. An analysis of the U.S. foreign policy concepts suggests that today's academic and political community has promoted consensus of neoliberals and neoconservatives, supporters of the institutional functionalism and representatives of the school of Realpolitik. This consensus was based on the recognition of the admissibility of pre-emptive strikes on the territory of failed states, sponsoring international terrorism, or the implementation of open interference in the internal affairs of "rogue states" for human rights and democratic freedoms guarantee. ; В статье рассматривается эволюция понимания современного международного правопорядка в зарубежной глобалистике. Делается вывод о том, что утрата эпистемологического и социально-политического оптимизма современных исследователей сопровождается критикой ими линейно-прогрессистских концептов развития системы международного права, открывая дорогу принципам альтернативности, синергетики, транзитивности исторического развития. Неоконсенсус представителей школы Realpolitik (неоконсерваторов) и институционального либерализма (неолибералов) основывается на допущении иной природы международной правосубъектности в условиях возникновения новых угроз национальной и всеобщей безопасности со стороны транснационального терроризма и несостоятельных государств. Практическим воплощением такого нео-неоконсесуса становится легитимация гуманитарных интервенций и превентивного сдерживания «преступных режимов» на периферии мир-системы.

This article concerns the interaction of the barbarian kingdoms of Italy and Constantinople between the second half of the 5th and first half of the 6th centuries. The author of the article considers the role of the Roman senatorial aristocracy in the diplomatic communication of Western rulers with the Byzantine emperor caused by both political necessity and religious differences in the Christian Church. The initiative to send senatorial embassies to Constantinople came from the secular and ecclesiastical authorities. Using the comparative and historical and anthropological approaches, the author of the article analyses the goals and results of the Roman senators' stay in Constantinople, as well as the reasons that prompted the reges Odoacer and Theodoric to involve aristocrats in embassies. The study is based on reports by Procopius of Caesarea, Liber Pontificalis, Anonymus Valesianus, as well as letters from the Popes. The author concludes that senatorial trips to the East during the period in question acquired special significance in connection with the aggravation of church contradictions. Discussion at the diplomatic level of religious issues led to a more thorough selection of applicants for the role of representatives of the West in negotiations with the emperor. The ambassadors under kings Odoacer and Theodorich had a high social status (titles of patricius, caput senatus, and rank of vir inlustris), which was also recognised on the international stage. The author puts forward an idea that the decisive factors in the appointment of senators as envoys of the West were, along with their origin, their diplomatic abilities, education, and rhetorical training, which gave them an advantage over the non-noble officeholders and church officials. An additional argument for the barbarian kings was the fact that Roman nobles were Catholics. ; Статья посвящена проблеме взаимодействия варварских королевств Италии и Византии во второй половине V — первой половине VI в. Автор статьи рассматривает роль римской сенаторской аристократии в дипломатическом общении западных правителей с византийским императором, вызванном как политической необходимостью, так и религиозными разногласиями в христианской церкви. Инициатива отправки в Константинополь сенаторских посольств исходила от светских и церковных властей. Используя компаративный и историко-антропологический подходы, автор статьи анализирует цели и результаты пребывания римских сенаторов в Константинополе, а также причины, побудившие королей Одоакра и Теодориха привлекать аристократов к участию в посольствах. The creation of statehood in the countries of the ancient world - ancient Athens, ancient Rome and Byzantium. Democracy, as a form of political organization of the urban community (polis) in ancient Athens, became a way to solve the problem of confrontation between different forces of society by looking for the possibility of their rapprochement, focusing on the only, important for all, goal - the achievement of the common good of the polis. The work shows how these attempts of interaction developed and what result was achieved as a result. Another experience in solving the problem of the opposition of the forces of society was obtained in ancient Rome. This form becomes the sole power of the emperor, allowing to unite a significantly expanded space. But at the same time, in Rome, the need to unite the opposing forces is also realized, therefore, representatives of the parties fighting for their rights are allowed to rule, thus causing a mixed form of statehood. An instrument of communication between the first person and society was also found. It becomes the system of Roman Law. The third experience of creating statehood in the territory associated with the ancient world took place in Byzantium. Arising as the heir to the Roman Empire, she adopted a number of features of the imperial rule of Rome. However, the expansion of the territory of the country, where people lived not only close to the culture of antiquity, but also the peoples of other civilizations, determined the course of development of society and statehood, which acquired the features of other types of cultures and, above all, Eastern civilizations, which ultimately affected the fate of Byzantium as predetermining the departure from its fundamental principles and the onset of the final of the empire. ; Демократия как форма политической организации городской общины (полиса) в Древних Афинах стала способом решения проблемы противостояния разных сил общества путем поиска возможности сближения их, ориентируя на единственную, важную для всех цель – достижение общего блага полиса. В работе показано, как складывались эти попытки взаимодействия и какой итог в результате был достигнут. Другой опыт решения проблемы противостояния сил общества был получен в Древнем Риме. Формой власти, призванной решить эту проблему, становится единоличная власть императора, позволяющая объединить значительно расширенное пространство. Но вместе с тем в Риме осознается и необходимость объединения противостоящих сил, поэтому представители сторон, борющихся за свои права, допускаются к управлению, обусловливая таким образом смешанную форму государственности. Найден был и инструмент связи первого лица с обществом. Им стала система римского права. Третий опыт создания государственности на территории, связанной с античным миром, состоялся в Византии. Возникшая как наследница Римской империи, она переняла ряд особенностей императорского правления Рима. Однако расширение территорий страны, на которой проживали не только народы, близкие к культуре античности, но и народы других цивилизаций, обусловило ход развития общества и государственности, приобрётший черты иных типов культур и прежде всего восточных цивилизаций, что в итоге сказалось на судьбе Византии, предопределивших отход от ее первоосновы и наступление финала империи.
