The authors of the paper focused upon the general clause of social interest in the general administrative proceedings, as well as the proceedings before administrative courts and the administrative executive proceedings. Thus we got a comprehensive – although limited, considering the framework of the study – analysis of the function of this clause in the three main sets of proceedings constituting the system of administrative procedure. The paper discusses a complicated concept of social interest and its relationship to a concept of public interest. It must be emphasized that both of the terms mentioned above are used, among other things, in the regulations of the Code of Administrative Proceedings. The authors also analyze the questions regarding possibilities of a conflict between a social interest and an individual interest. ; Autorzy opracowania skupili swe rozważania na klauzuli generalnej interesu społecznego w ogólnym postępowaniu administracyjnym, postępowaniu sądowoadministracyjnym oraz postępowaniu egzekucyjnym w administracji. W ten sposób otrzymali kompleksową, aczkolwiek ograniczoną ze względu na ramy opracowania, analizę funkcji tej klauzuli w podstawowych postępowaniach systemu procedury administracyjnej. Artykuł wyjaśnia skomplikowane pojęcie interesu społecznego oraz jego stosunek do pojęcia interesu publicznego. Podkreślenia wymaga, że oba pojęcia występują choćby w przepisach kodeksu postępowania administracyjnego. Przedmiotem rozważań autorzy uczynili również kwestie dotyczące możliwości zaistnienia kolizji między interesem społecznym a interesem indywidualnym.

The film is one of few examples of political documentaries produced in Poland after 1989. It is not limited to merely outlining the political argument over General Jaruzelski's decision to impose martial law. Although it concerns events in Polish history, it is not a historical documentary, as it brings forth present-day political conflicts that have arisen around historical events. Trying to reconstruct this current political argument, Zmarz-Koczanowicz reaches for a method developed in the 1970s by the so-called "Kraków School" led by Krzysztof Kieślowski. ^e "talking heads" method was meant to help documentary filmmakers in the Polish People's Republic reach what the person in the street actually thought and avoid the distortions of propaganda. For Kieślowski, however, the overriding aim was conciliation and an attempt to understand both sides of the political barricade - the authorities and the vox popu- li. His attitude, according to the terminology suggested by Chantal Mouffe, was a post-political one striving for an agreement through a rational dialogue. Zmarz-Koczanowicz's aim, however, is different: she is intent on showing a clash of different hegemonies that do not strive for consensus. Their agonistic argument, played out in the political register, rather than a moral one, is a guarantee, according to this Belgian philosopher of politics, that democracy will continue to exist.

The aim of the publication is to present selected forecasting problems in social sciences. The article focused on the method of decision-making/simulation games that, especially with the development of game theory and computers, have increasingly been used in many fields. Using examples of decision/simulation games - Poznań International Model United Nations 2013/POZiMUN; S.E.N.S.E - and the online game EVE Online, the author recognised the importance of such exercises in an accurate prediction of the future. He drew special attention to the element of chance and confounding factors that may destabilise the process of prediction. He also raised the problem of decision-making in the context of classical and quantum logic. ; Treścią publikacji jest przedstawienie wybranych problemów prognozowania w naukach społecznych. W artykule skoncentrowano się na metodzie gier decyzyjnych/symulacyjnych, które – zwłaszcza wraz z rozwojem teorii gier oraz komputerów – są coraz częściej wykorzystywane w wielu dziedzinach. Na wybranych przykładach gier decyzyjnych/symulacyjnych – Poznań International Model United Nations 2013/POZiMUN; S.E.N.S.E. a także gry sieciowej EVE Online – wskazano jak ważne są takie ćwiczenia, by móc precyzyjniej przewidywać przyszłość. Zwrócono także szczególną uwagę na kwestię przypadku oraz czynników zakłócających, które mogą destabilizować proces przewidywania. Poruszono ponadto problem podejmowania decyzji w aspekcie klasycznej oraz kwantowej logiki.

This paper discusses guidelines for implementation of art. 107–109 of the Treaty on the Functioning of the European Union, from the perspective of tax aid. This should lead to verification of the thesis that due to economic recovery plan – in response to the effects of the financial and economic crisis – implemented at EU level, the support of the public authorities in the form of tax subsidies has become the most broadly used form of State aid due to the value among all the forms of aid granted by member states of the European Union. The adoption of such a thesis raises the question of the influence of state aid on the size of the general government sector debt in the EU member states, which have provided tax aid. This analysis was carried out based on the linear regression model. The response variable (dependent variable Y) is the size of the general government sector debt, and explanatory variable (independent variable X) is the expenditure on state aid. ; W artykule omówiono wytyczne dla wdrażania art. 107–109 Traktatu o funkcjonowaniu Unii Europejskiej, z punktu widzenia pomocy podatkowej. Prowadzi to do weryfikacji tezy, że ze względu na wdrożony na szczeblu UE – w odpowiedzi na skutki kryzysu finansowego i gospodarczego – plan naprawy gospodarczej, wsparcie ze strony władz publicznych w formie subsydiów podatkowych stało się najczęściej stosowaną ze względu na wartość formą pomocy publicznej spośród wszystkich form pomocy udzielanych przez państwa członkowskie Unii Europejskiej. Przyjęcie takiej tezy skłania do postawienia pytania o wpływ pomocy państwa na wielkość zadłużenia sektora finansów publicznych w państwach członkowskich UE, które udzielały pomocy podatkowej. Analiza ta została przeprowadzona na podstawie modelu regresji liniowej. Zmienną objaśnianą (zmienną zależną Y) jest wielkość długu sektora general government, a zmienną objaśniającą (zmienną niezależną X) są wydatki na pomoc państwa.

Celem artykułu jest przedstawienie działalności Polskiego Towarzystwa Nauk Politycznych z zaznaczeniem ukierunkowania na sprawy internacjonalizacji. Od początku swojej działalności PTNP współpracowało z IPSA. W Polsce powstało wiele cennych publikacji przestawiających historię i stan obecny politologii w Polsce. Szczególnie ważnym dla polskiej politologii wydarzeniem była organizacja światowego kongresu politologii w lipcu 2016 r. Ważne miejsce zajmują także polskie czasopisma naukowe, które w ostatnich latach podlegają silnej internacjonalizacji. Przed PTNP stoi wiele wyzwań i możliwości podejmowania kolejnych działań, które sprzyjają dalszemu rozwojowi i promocji nauki w kraju i zagranicą. ; The aim of the article is to present the activities of the Polish Political Science Association, underlining the issues of internationalization. Since the beginning the organization, PPSA has been cooperating with IPSA. Many valuable publications regarding history and contemporary situation of Political Science have been published in Poland. Particularly important for Polish political science was the organization of the World Congress of Political Science in July 2016. The Polish scientific journals, that have been strongly internalized in recent years, take an important place nowadays. The aim of this article is the presentation and the attempt to analyse such phenomena as: an excessive general government deficit and public debt in EU Member States over the past 3 years. For the European Union the years 2008-2010 were the time when public finances of most member countries worsened dramatically. The average budget deficit in the EU increased during that period to a value of almost 7% compared to gross domestic product and public debt reached almost 80% of GDP. Referring the numbers to the principles of the budgetary policy in the Treaty on the European Union (the deficit should not exceed 3% in relation to GDP and public debt – 60% of GDP), the observance of budgetary discipline has been significantly violated. In consequence, the excessive deficit procedure has been initiated. in relation to almost all the countries of the EU, Its purpose was to force the member countries to take concrete actions to stabilize public finances. The economic crisis that began in the second half of 2007 in the United States of America which resulted in a significant deterioration of the finances of all the EU member countries might be regarded as the major source of violation of their budgetary discipline. The reactions of most governments TO the harmful effects caused by the financial crisis were to stimulate national economies and stem the decline of domestic demand. The higher level of public expenditures was simultaneously the cause of increased budget deficits,. To develop and present the problem of an excessive budget deficit and public debt in the EU countries some statistical methods were used and the data source statistics were mainly carried out by the European Commission and the European Statistical Office. ; Celem niniejszego artykułu jest prezentacja i próba analizy zjawisk: nadmiernego deficytu budżetowego i długu publicznego w krajach członkowskich Unii Europejskiej na przestrzeni ostatnich 3 lat. Lata 2008-2010 były dla Unii Europejskiej czasem, w którym stan finansów publicznych większości krajów członkowskich pogorszył się w sposób drastyczny. Średnia deficytu budżetowego w UE wzrosła w tym okresie do wartości prawie 7% w stosunku do wielkości produktu krajowego brutto, a zadłużenie publiczne osiągnęło poziom niemalże 80% PKB. Odnosząc te wielkości do założeń polityki budżetowej zapisanych w Traktacie o Unii Europejskiej (wartość deficytu nie powinna przekraczać 3% w stosunku do PKB, a zadłużenia publicznego 60% PKB), poszanowanie dyscypliny budżetowej zostało w sposób znaczący złamane. W następstwie, w stosunku do prawie wszystkich państw należących do UE, została wszczęta na szczeblu UE procedura nadmiernego deficytu. Jej celem było wymuszenie na krajach członkowskich podjęcia konkretnych działań zmierzających do ustabilizowania stanu finansów publicznych. Kryzys gospodarczy, który narodził się w drugiej połowie 2007 roku w Stanach Zjednoczonych Ameryki i skutkował znaczącym pogorszeniem stanu finansów wszystkich krajów członkowskich Wspólnot Europejskich można uznać za główne źródło złamania przez nie dyscypliny budżetowej. Reakcje większości rządów na niekorzystne zjawiska finansowe wywołane kryzysem miały na celu próbę pobudzenia gospodarek narodowych oraz zahamowania spadku popytu krajowego. Zwiększony poziom wydatków publicznych przyczynił się jednak równocześnie do wzrostu poziomu deficytów budżetowych. W celu opracowania i zaprezentowania problemu nadmiernego poziomu deficytu budżetowego oraz długu publicznego w państwach UE zostały zastosowane wybrane metody statystyczne, a źródłem danych były przede wszystkim statystyki prowadzone przez Komisję Europejską oraz Europejski Urząd Statystyczny.

The article is an attempt at presentation how basic notions and ferms used by sociology of organization function in other sciences dealing with problems of organization as eg. praxiology, theory of organization and «management or psychology of organization. General reflections are concentrated around various ways of understanding of the notion of "organization" and around the so-called concept of system analysis of organization. The author advocates understand of organization as a set of rules of action or rules of functioning of groups or other human communities. He represents an opinion that organization cannot be identified in sociology with institution assi there are essential differences between them. The author attempts to present a relationship between organization and institution in sociolo¬ gical aspect on the grounds of (the proposed way of interpreting the notion of organization. The article includes critical remarks on the so-called system approach in sciences on organization. It is found that in most of the oases the system approach functions only as a language formation unable to contribuite any methodological qualities but a new slang. Treating the system approach as a new methodological directive assumes a p r i o r i , that any organization is a system which does not always correspond to social reality. For there are organizations not fulfilling their statute goals because they do not function as a system. In the Europe of the European Union, policies and programmes on the social inclusion of millions of Euros have been presented for years in different countries, with a greater concentration in the countries of the South and neighbouring countries. This issue is of concern to state, regional and also local governments. The strategies proposed are also multilevel. It is the latter that have the most complicated role since they are the ones that are closest to the problem. For this last level of public administration, the main obstacle is the lack of resources, becoming clearly dependent on European, national and autonomous funds. The analysis of the plans guides us as to which aspects are the most important. This is the case of Barcelona, because it is an example of inclusive support measures and teamwork on a European and international scale. On 1 June 2017, a major amendment to the Code of Administrative Procedure came into force. The article deals with mediation incorporated into the Code as a new institution of administrative proceedings. The authors presented the advantages and disadvantages of mediation in public matters and discussed the theoretical foundations of this construction. They analysed the effectiveness of the mediation conducted in the proceedings before the administrative courts, pointing that en­trusting mediation to professional mediators (by amending the Act of 7 April 2017) was justified. The new regulation provides for mediation that is voluntary, secret, and conducted by an impartial mediator. The amending act does not specify the preferred mediation strategies, leaving this issue to the mediators, but the analysis of the content of the new provisions leads to the conclusion that the evaluative type of mediation is the leading one. The amended provision of Article 13 § 1 of the Code allows mediation in any matter, provided its the nature is sufficiently suitable. In the Authors' opinion, mediation should be allowed especially in matters that need to be resolved basing on the administrative discretion and in matters whose settlement requires the interpretation of terms that are not specified. In the authors opinion, mediation may be an effective instrument for eliminating administrative disputes but requires proper preparation of the clerks involved.

The article covers the legal and tax aspects of the implementation of general anti-avoidance clause in Polish tax law, including the historical outline of the clause, its essence, and the usefulness of achieving the legislator's intended effects. The article deals with the disadvantages and advantages of the clause, its compliance with constitutional regulations, as well as the institution of GAAR protective tax opinions and the position of the Council on counteracting tax evasion. ; Artykuł omawia prawne i podatkowe aspekty wdrożenia do polskiego prawa podatkowego klauzuli o przeciwdziałaniu unikania opodatkowania, rys historyczny klauzuli, jej istotę oraz przydatność dla osiągnięcia zamierzonych przez ustawodawcę efektów. Artykuł odnosi się również do kwestii wad i zalet klauzuli, konstytucyjności regulacji oraz instytucji opinii zabezpieczających i pozycji Rady do Spraw Przeciwdziałania Unikaniu Opodatkowania.

The purpose of the present paper is to characterise the UN General Assembly (UNGA) Resolution No. 65 276 on the 'Participation of the European Union in the work of the United Nations.' This resolution was adopted as a result of efforts undertaken by the EU following the entry into force of the Treaty of Lisbon which radically changed the principles and conditions of the EU's participation in other international organisations. Pursuant to the provisions of Resolution 65 276, the EU was granted a new set of new rights at the UNGA as well as in some of its subsidiary bodies, international conferences and meetings held under its auspices. Despite these changes, the status of the EU at the UNGA is not similar to the status of observer states, and Resolution 65 276 points out that the same rights may also be accorded to other regional international organisations. Consequently, the UNGA does not account for the uniqueness of the integration process in the EU member states, treating the EU like any other international organisation.

Services of general interest form an essential element of the European model of society as a way to increase quality of life and to overcome social exclusion and isolation. They are also at the core of the public debate touching the central question of the role public authorities and the institutions of the European Union play in a market economy. The competencies and responsibilities conferred by the Treaty, the EU regulations and directives lay emphasis on the essential role and the wide discretion of national, regional and local authorities in defining, organizing, financing and monitoring services of general interest. The same time the EU Law provide the European Commission with a wide range of means of action to ensure the compliance of the process of organizing and financing such services according to a comprehensive regulatory regime at Community level to make them compatible with the internal market and to prevent a distortion of the competition rules. The paper indicates divergences of the points of view of public authorities and the Commission on their role, shared responsibility and powers in that process. ; Usługi użyteczności publicznej stanowią zasadniczy element modelu europejskiego, służąc polepszeniu jakości życia i przezwyciężeniu społecznego wykluczenia i izolacji. Pozostają również w centrum publicznej debaty co do roli, jaką w gospodarce rynkowej odgrywają władze publiczne państw członkowskich i instytucje Unii Europejskiej. Kompetencje i obowiązki określone przez Traktat oraz unijne rozporządzenia i dyrektywy podkreślają zasadniczą rolę i szeroki zakres swobody krajowych, regionalnych i lokalnych organów władzy w definiowaniu, organizowaniu, finansowaniu i monitorowaniu usług użyteczności publicznej. Jednocześnie prawo unijne wyposaża Komisję Europejską w liczne instrumenty mające zapewnić zgodność procesu organizowania i finansowania tego typu usług z ogólnym reżimem prawnym Unii – tak, aby uczynić je kompatybilnymi z jej rynkiem wewnętrznym i zapobiec zakłóceniu konkurencji. Artykuł wskazuje na rozbieżności w punktach widzenia władz publicznych i Komisji na ich rolę oraz podział odpowiedzialności i władzy w tym procesie.
