학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김동욱. ; 이 논문은 한국과 이집트의 지역사회개발정책을 국가주도성이라는 공통적 측면에 주목하고, 이러한 국가주도적인 지역사회개발정책의 형성 및 발전과정에 따른 경로의존성을 분석하는데 주요한 관심을 둔다. 이를 위해 역사적 사건, 초기경로의 생성 경로의존적 닫힘, 그리고 새로운 경로의 열림으로 구체화 했다. 이러한 과정 하에 역사적, 제도적, 행위자적 요인으로 재분류함으로써 제도 변화의 경로 의존적 요인과 촉진 요인을 보다 면밀히 파악하고자 했다. 이는 기존의 제도적 맥락, 즉 제도 내외의 환경의 영향으로 설명하고자 하는 역사적 신제도주의에 기반하였다고 볼 수 있다. 이 논문을 통해서 지역사회개발정책을 둘러싼 국가 계획은 역사적, 제도적 그리고 행위자적 요인으로 인해 일정기간 지속성을 이끌어가는 요인으로 작용했으며, 한편으로는 역사적 요인에 의하여 단절적인 변화를 경험하기도 했다. 한국의 새마을운동이 적어도 정부가 의도한 바대로 지역사회의 변화를 이끌어내기 위한 의미있는 성과를 가져왔음에 비해, 이집트의 슈르끄 운동을 포함한 일련의 지역사회개혁정책이 지역민의 참여와 자원을 효과적으로 이끌어내지 못한 점을 경로의존성 분석을 통하여 도출해내었다고 볼 수 있다. 이러한 분석결과는 다음과 같이 양국의 지역사회개발정책의 유사성과 상이성으로 나뉜다. 먼저, 유사성으로는 한국과 이집트는 개발도상국으로서의 국가주도 지역사회개발정책을 실시한 경험을 가지고 있다는데 있다. 기본적으로 농경에 바탕을 둔 사회이며, 19세기 외세에 의한 근대화 및 권위주의정권에 의하여 지역사회개발정책이 상당부분 영향을 받았다는 점이 유사하다. 이외에도 개발도상국으로서 공업화 등에 대한 우선적 관심으로 상대적으로 지역사회개발정책과 관련된 자원을 투입하는데 한계가 있었지만, 대통령의 일반적인 관심사가 되었다는 점에서 유사하다. 다음, 상이성으로는 한국의 경우, 새마을운동은 앞선 시기의 여러 사회적, 제도적 및 행위자 요인과 함께 지역사회의 인적 물적 자원을 효과적으로 동원하는 내무부 주도의 제도적요인과 박정희 대통령의 정책에 대한 관심과 거버넌스를 촉진하는 행위자적 맥락 요인이 함께 작용하여 이러한 국가주도적 경로의존성을 지속시켜나갔다. 이러한 국가의 개입은 민간의 참여와 자원을 효과적으로 동원하는 방식으로 나아갔다. 한편, 1980년대 새마을운동은 박정희 정부의 종식과 연이은 전두환 정부의 민간주도 정책으로 인해 기존 국가주도적 경로를 이탈하게 된다. 한국과 달리 이집트의 국가주도 지역사회개발정책의 경로는 국가가 이러한 변화를 주도하는 측면에서는 여전히 경로의존성을 유지하고 있었다. 이는 1980년대 무바라크 정부에서는 슈르끄 사업을 실시함으로써 민간주도로 이행하기 위한 노력을 진행했으나, 현재까지 강한 국가주도적 경로를 유지하고 있다. 국가의 의도를 실현시킬 수 있는 효과적인 집행기관과 지역사회의 참여와 자원을 이끌어낼 수 있는 기제가 마련되어 있지 않는데 원인이 있다. 또한, 실제 지역사회개발정책을 통한 정책효과에 대한 무바라크 대통령의 관심의 부재와 지역사회개발에 참여하는 대지주 및 기업가의 부패문제는 지역사회 참여자의 관심을 이끌어 내지 못함으로써 국가가 대부분의 지역사회개발과 관련된 문제를 독자적으로 해결해나가야 하는 악순환에 처해 있는 것이다. 그러나 2012년 현재 이집트는 쟈스민 혁명으로 일컬어지는 민주화운동에 의하여 새로운 정부 수립을 앞두고 있다. 이렇게 새로이 수립된 정부가 그간 권위주의 정부에 의하여 추진된 농촌 등 지역사회개발정책에 대한 개선책에 대한 기대감이 크다. 새로운 정부의 수립 이후 과거 이집트정부가 추진한 강한 국가주도 지역사회개발정책의 실효성을 강화하는 방향으로 나아갈지 혹은 새로이 민간주도 정책으로 전환하는 주요 결절점으로서 작용할지가 주목된다. 이와는 별개로 정권교체 이후에도 당분간 국가가 주도하여 지역사회개발정책을 수립해나갈 가능성이 크므로 이러한 작업을 위해 이집트 정부는 한국 새마을 운동의 성공요인이었던 내무부 주도, 민간의 자발적 참여와 자원동원을 이끄는 방식을 추진한다면, 지역사회개발의 성공을 앞당길 수 있을 것으로 전망된다. ; Focusing on similarity of the state-led character between both countries, this study aims to analyze its formation and developmental process of Korea and Egypt's rural development policy in terms of a path dependency. For this purpose, this study fall into the four sub-parts, which is historic events, creation of initial path, closeness of path and openness of new path. Under this circumstance, as being reclassified in the basis of historic, institutional, and stakeholder factor, it was able to look into more specifically how the path was proceeded. This based on historical institutionalism to be explained by its environmental circumstances both inside and outside institutions. This study shows the national plan on both country's policies of rural development contributed to keep consistency within a certain periods, but they often experienced several sudden shocks which might be disconnect their paths. The Saemaeul Undong in Korea at least have brought significant outcomes for changes in its rural societies. In comparison, The Egypt's case was not successful at that much because they failed to efficiently attract its rural people's support and securing their resources for their national rural development plans. These result outcomes came from analysis from the perspective of path-dependency and it can be more specifically classified into the two categories, which is similarity and difference of both nation's rural development policies. First of all, Korea and Egypt have a similar experience for conducting their own state-led rural development plans as a developing countries. Besides, when they started to develop rural area, the state mainly relied on agriculture and the rural development plan influenced from the authoritative regimes or the power of a foreign countries. In addition, both countries was more focused to invest their limited resources into the industries, rather than rural development. Next, In Korea, with its prior several social, institutional and stake holder's factors, Saemaeul Undong kept its state-led developmental path as successfully mobilizing its human and material resources with help of deep concern of president Park Chung-hee as stakeholder factor and his ministry of interior as institution factor. Especially, this engagement by the central government was gave more initiatives to private sectors when they obtaining their participation and resources. Meanwhile, in 1980s, the Saemaeul Undong derailed its path due to the facts such as the assassination of president Park Chung-hee or the privatization policy of president Chun Doo-hwan. Different from the Korea case, Egypt's state-led rural development has kept on sustaining previous path until now. There are several attempts such as president Mubarak's Shrouck plan toward private-led rural development. However, it does not seem to be enough for detouring its current state-led development tendency for a new change. This is responsible for lack of effective implementation agency and mechanism which is able to get cooperation from rural society. It hinders them in carrying out their plan not only by president Mubark's lack of actual concerns on rural reforms, but also by business man or large farm owner's corruption problems. Therefore the Egyptian government was caught in a vicious circle in which the central government should exclusively take on whole responsibility for rural development issue. However, as of 2012, Egyptians are facing a new government by liberalization movements which called 'jasmine revolution'. They hope that a reform packages of the new government would be differentiated from that of the previous. it might be a prime concerns whether they are maintaining its state-led path or changing their course toward a more private-led one. Whatever the case it would be, their strong involvement by the central government is more likely to be kept for a while. In these circumstance, if the Egyptian government adopt those successful factors of the Saemaeul Undong, their success for rural development would be advanced by substantial length of time. Objectives: The purpose of this study is to figure out the current state of patient safety research in Korea and to evaluate whether the research fund support project for patient safety research is proceeding in priority order. Methods: Through the literature search, a list of research projects in the field of patient safety in Korea were collected as of January 6, 2017. Four researchers independently evaluated the subject using the priority list of patient safety research derived from the previous study. Results: As of January 2017, a total of 21 research projects were conducted in the Korea Health Industry Development Institute and 42 research studies were conducted in the National Science & Technology Information. The results of the priority evaluation showed that there were no researches that ranked first and second priority. Many of the research topics were �쁀dverse drug events/drug errors,�� �쁇ealth information technology/information systems,�� and �쁋ess relevance.�� Conclusion: Patient safety research projects are not only diverse but also quantitative in Korea. Support for research topics that need to be prioritized is needed, such as developing safety indicators and measuring patient safelty levels, improving communication, and improving patient safety incident reporting systems. ; open

Game-theoretic approach has been providing a powerful tool in qualitative understanding of macroscopic social phenomena in social sciences, e.g., in economics and political science. Recently, researchers in physics, especially in statistical physics, use these game-theoretic approaches but in more quantitative way and have been producing a variety of interesting results in the new research area called 'sociophysics' by studying human society as a complex system. This work introduces recent works that have tackled combinatorial complexities arising in game-theoretic studies with the aid of simplified assumptions and numerical computations. We first show how cooperation emerges in the prisoner's dilemma game when each player's memory capacity is enhanced and suggest that the intelligent tit-for-tat strategy plays a crucial role in the history of cooperation. And then it is numerically shown that there is a certain case of simultaneous coordination among many players where the system has a high risk of failure when everyone is willing to follow the coordination, which is actually higher than when some are not concerned about it. Lastly, we discuss mathematical treatment of an equilibrium solution for a reverse auction game, which is a variant of the minority game, and its computational approach. ; Artikel på koreanska, abstract på engelska.

본 연구는 연방체제와 연방사회 간 합치(congruence) 여부에 초점을 맞춰 연방주의가 교육복지에서 어떻게 구현되었는지 또는 구현되는데 실패했는지 미국 사례에 조명하고자 한다. 구체적으로 공식적 제도에 근거한 연방국가와 민족-언어에 근거한 다양성이 표출된 사회구조를 가리키는 연방사회가 불합치하면 교육복지에서 어떤 연방주의로구현되는지 시대별로 검토하고자 한다. 이에 본 논문은 우선 연방주의를 건국이념으로채택한 미국이 다른 연방국가와 대조적으로 헌법상 교육 권한의 소재지를 주정부에게명기함에도 불구하고 교육복지에서 연방정부가 소규모이나 점진적으로 권한영역을 확대하는 근거를 살펴보고자 한다. 특히 미국의 교육 및 교육복지는 민족-언어의 동질성이 크지 않음에도 불구하고 대칭적 연방주의로 발전했고, 그 부산물로 헌법에도 명시되지 않은 교육 권한이 제한적이기는 하나 점차 연방정부로 이전하는 양상을 보인다. 따라서 본 논문은 연방주의를 작동시키는 주요 동력으로서 사회적 요인, 보다 정확하게민족-언어적 이질성에 일차적으로 초점을 맞춰 교육 연방주의의 정치 사회학을 연대기적으로 재조명하고자 한다. 그리고 미국 연방주의를 교육복지에 초점을 맞춰 연방제의운용 단면을 살펴보고자 한다. ; In this paper, I propose to explore the political sociological aspect of federalism in education welfare in America. Specifically, I intend to illuminate the misfit between federal system and federal society by providing the historiography of education welfare in U. S. In doing so, I plan to put emphasis on the role of societal factors, or more precisely, the ethno-linguistic patterns, in influencing the workings of the American federal system. Unlike other federal states, U.S. eventually evolved into a symmetrical federalism in education welfare where the federal demarcations were drawn independently of the underlying social structure despite her lack of ethno-linguistic homogeneity. In this paper, I first contrast across 7 federal states and strive to explicate how American federalism stands apart from her counterparts. Then, I look into how the meager federal department of education occasionally but gradually managed to tread on states' right in providing education and education welfare. Anesthesia facilitates surgery in millions of young children every year. Structural brain abnormalities and functional impairment observed in animals have created substantial concerns among clinicians, parents, and government regulators. Clinical studies seemed ambivalent; it remains unclear whether differential species effects exist towards anesthetic exposure. The current literature search and analysis attempts to unify the available clinical and animal studies, which currently comprise of > 530 in vivo animal studies and > 30 clinical studies. The prevalence of abnormalities was lowest for exposures < 1 hour, in both animals and humans, while studies with injurious findings increased in frequency with exposure time. Importantly, no exposure time, anesthetic technique, or age during exposure was clearly identifiable to be entirely devoid of any adverse outcomes. Moreover, the age dependence of maximum injury clearly identified in animal studies, combined with the heterogeneity in age in most human studies, may impede the discovery of a specific human neurological phenotype. In summary, animal and human research studies identify a growing prevalence of injurious findings with increasing exposure times. However, the existing lack of definitive data regarding safe exposure durations, unaffected ages, and non-injurious anesthetic techniques precludes any evidence-based recommendations for drastically changing current clinical anesthesia management. Animal studies focusing on brain maturational states more applicable to clinical practice, as well as clinical studies focusing on prolonged exposures during distinct developmental windows of vulnerability, are urgently needed to improve the safety of perioperative care for thousands of young children requiring life-saving and quality of life-improving procedures daily. ; open

Background X-linked spondyloepiphyseal dysplasia tarda (SEDT-XL) is a skeletal disorder characterized by defective structures of vertebral bodies and/or of epiphyses of the long bones, resulting in moderately short stature and early joint degeneration. TRAPPC2 gene, which is important for collagen secretion, has been reported as causative for SEDT-XL. Case presentation Here, we report two variants of TRAPPC2 gene of SEDT-XL patients, a missense variant of start codon, c.1A > T, and a deletion variant, c.40delG. To understand molecular consequence of the variants, we establish an in vitro gene expression assay system and demonstrate that both mutated genes are transcribed, but are not properly translated, indicative of the pathogenic nature of those TRAPPC2 variants. Conclusions In the current study, we provide additional experimental data showing that loss-of-function TRAPPC2 variants are probably causative for SEDT-XL phenotype. Between 1995 and 2011, Peruvian GDP grew by 4.9% each year, driven by exports and private investment's increase. However, it only grew by 3.3% in 2015 and by 4% in 2016 due to a reduction in the international price of metals that the country exports. In this scenario, the government elected in 2011 faced the challenge of replacing private investment with public investment as a growth engine. However, this decision revealed two structural problems of the Peruvian economy: 1) the limited spending capacity of central and regional governments; and 2) the difficulty of increasing tax collection due to a very significant informal sector in the country. However, trade liberalization, stability in domestic prices and reforms in public management are strengths of the Peruvian economy, which would enable it to return in the next few years to growth rates of around 4% or more.

Readmission which reflects capacity to manage patients and general level of medical services has been known for one of the causes of medical expenditure due to inefficient service. Compared to disease-specific readmission, hospital wide readmission (HWR) is relatively easy to understand, and has merit to get over limitation of collateral medical services assessment; therefore, a growing interest in development and usage of readmission indicator as quality of care indicator focusing on all-disease is detected. In this study, we investigate current state of risk standardized readmission rate indicator used in the United States, the United Kingdom, and Canada, and examine the considerations when using readmission rate as quality indicator in Korea. Differences in risk-adjustment methods were showed among countries. The United States do not control race not to hide socio-demographic factors on readmission. Canada shows differentiation compared to other countries about reflecting community factors. All three-countries utilize readmission rate as monitoring quality of care rather than incentives or penalty due to the fact that readmission rate could not represent the whole quality of hospital and has a limitation at controlling socio-economic factors. Therefore, for usage readmission rate as quality indicator in Korea, preparing readmission classification standard for Korean medical environment and additional methods for acquiring information by using discharge summary is need. Moreover, continued discussion with clinical specialists is needed for obtain clinical reliability and validity. ; open

Through this, this research tries to understand the problem of economic reconstruction in Korea after the Korean War. When UNKRA was founded, the United Nations forces anticipated military success and an early cessation of hostalities. However, Chinese intervention in Korea might prolong hostilites and hamper rehabilitation and recovery indefinitely. In the early years, UNKRA could not fully implement the reconstruction program until the military situation had settled down. Instead, it operated under military supervision. During the war, UNKRA mainly seconded its experts to the UNCACK(United Nations Civil Assistance Command in Korea). After September 1952, CINCUNC, UNKRA and the Government of the Republic of Korea agreed to start as much basic rehabilitation and reconsruction program as the military situation would allow. Nevertheless, the general situation had made it necessary to accord the first priority to the importation of consumer goods. Furthermore, UNKRA proceeded to develop comprehensive plans and programs in the support of the UN specialized agencies and the Nathan Associates. The Nathan Associates developed the Five-Year Plan for the reconstruction of Korea, which meant Korea could achieve economic independence in five years. It suggested that the major portion of investment would go into sectors of physical production and distribution where the direct, measurable impacts on national output would be heaviest and quickest. However, despite of the desirability of a large social investment programs in Korea after the Korean War, they did not emphasize upon social investment because of limited resources for reconstruction. After Armistice in July 1953, UNKRA actually launched the reconstruction program. However, UNKRA could not take over responsibility for all relief and rehabilitation activities because the United States developed a defense support program for South Korea after the war. That is, UNKRA was assigned a certain segment to operate and the rehabilitation of the war was coordinated through the OEC(Office of the Economic Coordinator). Nevertheless, UNKRA was independent from the defense support program of the United States and could emphasize on non-military areas of the economy. UNKRA's largest over-all investment allocation was made in the idustrial field. UNKRA undertook the reconstruction of the major industrial plants and the construction of new manufacturing facilities in the important sectors of manufacturing industries. In spite of many problems in operation and shortages of funds, it provided the capital and engineering for industrial expansion in Korea. ; 본고는 1950년대 한국의 전후 재건과 부흥을 위해 유엔 총회 산하에 설립되어 활동했던 유엔한국재건단(UNKRA: United Nations Korean Reconstruction Agency)의 조직과 활동을 고찰하였다. 재건단 원조는 1950년대 대한원조의 주축이었던 미국의 대한원조와는 독립된 방식으로 운영되었다. 그러므로 본고는 재건단의 설립과 위상변화 과정, 재건구상과 활동의 실제를 살펴보고 그 의미를 밝히고자 하였다. 유엔한국재건단은 한국전쟁에서 유엔군이 승리하여 조속히 전투가 종료되고 통일이 이루어질 것이라는 전망 속에서 설립된 기구였다. 재건단은 전투 종료 이후 통일된 한반도에서 긴급 구호와 기초시설의 재건, 생산성 확대에 이르기까지 대한원조 전반을 총괄하는 기구로서 수립되었다. 그러나 1950년 12월 1일 수립 이후 전쟁이 장기화되면서 독자적인 활동영역을 확보하지 못하였고, 유엔군사령부가 경제원조를 포함하여 한국에서의 전반적인 권한을 보유하는 가운데 재건단은 주로 유엔사의 활동을 보조하는 위치에 머물렀다. 그리하여 전시에 재건단은 본격적인 사업에 돌입하지 못하는 대신, 유엔사 산하에서 구호와 단기복구를 담당하는 기관인 유엔한국민사처(UNCACK)에 민간인력을 파견하는 것으로 주요 활동을 대체하였다. 1952년 중반 이후 전선이 안정되고 한국 경제의 위기가 심화되면서 유엔사, 한국정부, 재건단 사이에 본격적인 재건사업이 시작되어야 한다는 합의에 이르렀지만, 극심한 인플레이션으로 인해 재건단의 활동은 일부 소비재를 수입하는 것에 그쳤다. 이와 더불어 전시 재건단은 전쟁 종료 후 본격적인 재건사업에 돌입하는 단계를 준비하며 각종 조사를 실시했다. 재건단의 의뢰에 의해 유엔 전문기구들은 농·수산업, 교육, 보건 등 분야별 조사를 담당하였고, 네이산 협회는 이를 포괄하는 전반적인 재건계획을 제출하였다. 재건단의 의뢰로 작성된 네이산 보고서는 한국에서 5년 간의 재건계획을 수행하여 전전과 비슷한 생활수준을 회복하고, 국제수지의 균형을 맞출 수 있을 것으로 전망하였다. 이를 위해 생산영역에 집중적으로 투자하면서, 농산물, 수산물, 광물 등 자연자원을 개발하여 수출을 증진한다는 계획을 제시하였다. 전후 한국사회에서 주택, 보건, 복지 등의 분야에 대한 필요가 절실했지만, 사회서비스나 복지 분야는 직접적인 생산력 증대를 불러오는 분야가 아니라는 점에서 재건계획 상 상대적으로 후순위에 배치되었다. 1953년 7월 휴전협정 체결 이후 재건단은 본격적으로 재건사업에 착수하였다. 그러나 이때에도 재건단은 한국 재건사업에서 전반적인 권한을 보유하지 못했는데, 미국의 전후 구상에 따라 방위지원을 주축으로 하는 미국의 대한원조가 중심이 되고 유엔 원조기구의 위상이 상대적으로 축소되었기 때문이다. 결국 재건단은 미국 원조기관과의 협의에 따라 한정된 영역에서만 사업을 진행할 수 있었다. 그럼에도 재건단은 독자적인 조직을 유지하며 담당 부문에서 자체 사업을 진행하였고, 원조의 내용에서도 미국 원조와는 다른 특성을 보였다. 즉 미국 원조가 주로 소비재 판매대금을 통해 막대한 국방비를 충당하고 경제를 안정화하는 데 초점을 맞추었던 것과 달리, 재건단은 장기적으로 한국경제의 생산력을 증진시키는 것이 필요하다고 보고 시설투자와 기술원조가 결합된 형태의 원조를 주로 진행하였다. 재건단 원조에서 전시기에 걸쳐 가장 많은 비중을 차지한 것은 공업 부문이었다. 재건단의 공업 부문 원조는 소비재에서 생산재까지 여러 분야에 걸쳐 진행되었고, 노후화된 기존 시설을 대체하고 전쟁으로 파괴된 시설을 복구하는 것 이상으로 신규투자를 통해 새롭게 공장을 건설하기도 했다. 특히 재건단은 중소규모 기업에 자금과 기술, 시설을 제공하는 한편, 면방직 공업이나 시멘트 공업, 판유리 공업과 같은 몇몇 분야를 전략적으로 성장시켜 국내 생산을 증가시키고 수입을 대체하고자 했다. 이와 같은 재건단의 원조는 운영상의 여러 문제점을 노정하였으나, 한국의 초기 전후 복구 과정에 상당 부분 기여했다. ; 머리말 1 一. 전시 유엔한국재건단의 설립과 재건구상 7 1. 재건단의 설립과 유엔군사령부와의 관계 정립 7 2. 전후 재건구상 18 二. 전후 유엔한국재건단의 조직과 활동 25 1. 휴전 이후 재건단의 대외적 위상 변화 25 2. 재건단 내부의 조직운영과 예산 구성 34 3. 재건단의 활동 분석―공업 부문을 중심으로 47 맺음말 59 참고문헌 62 Abstract 67 ; Master

학위논문 (석사)-- 서울대학교 대학원 : 외교학과, 2012. 2. 윤영관. ; 개발원조가 더욱 중요해지고, 투입되는 금액 또한 증가하면서 개발원조의 효과성에 대한 관심이 증대되고 있다. 본 논문 역시 이에 주목하여, 원조가 수원국의 경제발전에 긍정적인 영향을 미치는 조건을 알아본다. 특히 수원국의 경제발전전략과 원조효과성과의 관계를 살피기 위해서 시장주도적인 경제발전전략을 채택한 방글라데시와 국가주도적인 경제발전전략을 채택한 보츠와나의 원조이용과 그 효과성을 비교하여 살펴보았다. 보츠와나 방글라데시 두 국가 모두 독립 당시에는 매우 가난하여 해외 원조에 의존하였다. 그러나 현재, 보츠와나는 1인당 국민소득이 7,000달러에 달하고 방글라데시의 국민소득은 600달러를 겨우 넘는다. 양국의 개발전략을 비교해보면, 국가주도의 경제개발전략을 택한 보츠와나 정부는 국가개발계획을 작성하고 이에 따라 경제를 관리하였다. 개발계획의 수립, 예산의 작성 등을 재정 및 개발계획부라는 한 개의 정부부서가 통제함으로써 효율적인 관리가 가능했다. 반면 방글라데시는 시장주도의 경제개발전략을 택했다. 1980년대와 1990년대 세계은행과 국제통화기금 등의 공여국의 영향으로 시장주도적인 개방형 경제구조를 위한 자유화, 민영화, 규제완화 조치가 본격적으로 시행되었다. 그러나 방글라데시는 시장 자체나 이를 뒷받침해줄 제도가 제대로 갖춰지지 않았기 때문에 개혁은 제대로 성공을 거두지 못했다. 양국의 원조의 이용 역시 달랐다. 보츠와나는 국가주도의 개발전략에 따라 원조를 이용하였다. 공여국은 국가개발계획을 참고하여 원조 분야와 사업을 결정함으로써 보츠와나 정부의 우선순위에 따른 원조를 하는 것이 가능했다. 반면 방글라데시의 원조는 방글라데시의 필요에 맞춰 이용되는 것이 아니라 공여국의 입장에 따라 이용되었다. 이에 따라 사업이 중간에 중단되거나, 원하는 목표를 이루지 못하는 경우가 생겼다. 그 결과 양국에 제공된 원조의 효과성에도 차이가 있었다. 보츠와나의 경우, 원조가 투자된 교육 분야나 보건, 교통 등의 분야에서는 예전에 비해 많은 발전이 이루어졌으며, 경제발전에 도움이 되었다는 평가를 받고 있다. 반면 방글라데시의 경우, 경제성장을 위해 필요한 부분에 원조를 투입하기 보다는 공여국의 개혁정책을 실시하기 위해 필요한 부분에 원조를 투자하였다. 시장의 발달을 위해 민간 금융 기관의 설립, 국영기업의 민영화 등에 투자된 원조는 공여국의 요구에 따라 성급하고 무리하게 투자된 것이었다. 이렇게 투자된 원조는 제대로 효과를 발휘하지 못하고 오히려 실업이나 채무 부담 증가 등 부작용을 발생시켰다. 국가주도적인 개발전략을 세우고 실행하면서 원조 역시 성공적으로 이용한 보츠와나와 공여국의 영향으로 시장주도적인 개발전략을 세우고 개혁을 시도하였으나 실패하고 개혁에 투입된 원조도 그 효과가 크지 않았던 방글라데시의 사례를 비교해본다면 무조건적으로 시장주도적 경제발전전략을 세우고 이에 따라 개혁을 실시하는 것은 수원국의 경제를 발전시키고 원조의 효과성을 제고하기 보다는 오히려 부작용을 불러올 수도 있는 것으로 보인다. 그보다는 수원국의 정부가 장기적인 안목을 갖고 국가주도적으로 경제발전전략을 정하고 이 과정에 통합하여 원조를 이용하는 것, 그리고 공여국은 최대한 그에 따라 원조를 지원하는 것이 원조의 효과성을 높이는 방법이라고 생각할 수 있다. ; As development aid becomes more important and the volume of it increases, more people develop interest on the effectiveness of aid. In this dissertation, I sought for the conditions to improve aid effectiveness. To find the conditions that positively influence the economy of a recipient country, I compare the development strategy and the use and the effectiveness of aid between Bangladesh and Botswana. Both Botswana and Bangladesh were so poor that they could not help depending on foreign development aid when they became independent. However, the GDP per capita of Botswana is almost 7,000 dollars now while Bangladesh's is barely 600 dollars. Bangladesh has selected a market-oriented economic development strategy and Botswana a state-led strategy. The Botswana government built the National Development Plan and managed their economy according to this. Because the Ministry of Finance and Development Plan controls the development plan, budget, and so on, it managed the economy efficiently. On the other hand, Bangladesh initiated reform policies to have an open market economy under the influence of donors. In the 1980s and 1990s, the policies for liberalization, privatization, and deregulation were placed guided by major donors, such as the World Bank and the International Monetary Fund. However, Bangladesh did not have the proper market and the institution to support it; therefore, its intended reforms did not succeed. The use of aid is also different in both countries. Botswana efficiently used aid according to a national development strategy. Donors could give aid to Botswana in alignment with its priorities because the donors decide an aid project in light of Botswana's development plan. In addition, aid was invested in education, health, and transportation in Botswana. There was improvement in those fields that contributed to economic development. The Bangladesh aid is used according to the opinions of its donors. The aid projects ceased consequently thereby deferring its set goals. Bangladesh invested aid to practice reform policies for a market-oriented economy. It invested aid impetuously on requests by donors for the establishment of private financial institutions and the privatization of state-owned enterprises. These aids could not help the country's economic development and produced side effects, such as unemployment and national debt. As we compare the two, we can infer that building a market-oriented development strategy and practicing reform policy unconditionally according to the purpose of donors do not render aid effective. It is rather more effective if the recipient country makes a long-term development plan, controls the economy, and uses aid according to its strategy. ; Master

More specifically, this paper argues that Roh government's dependency on the United States is the main variable that describes Roh government's alliance policy. The Bush administration realized the uncertainty of threat and the vulnerability of its homeland security following the September 11 attacks in 2001. The new military security strategy appeared to be coping with the changed international security environment and have maintained the United States' unipolarity. The core of the military security strategy was the war on terrorism and military transformation, and the United States was preparing to consolidate its alliances and partnerships in order to implement these strategies effectively. The United States emphasized Global Defense Posture Review (GPR) and Missile Defense, and demanded the cooperation of its allies. The United States' demands brought about the alliance security dilemma to the Republic of Korea (ROK), a weaker state in the asymmetric alliance. Cooperation with the United States could cause the ROK to become unintentionally involved in the northeast asia conflict and Peninsula conflict, while noncooperation could cause abandonment from the United States in facing the threat of North Korea. In the alliance security dilemma, Roh government gave an opposite decision, that is, the agreement of strategic flexibility and the decision not to participate in missile defense. In the case of strategic flexibility, Roh government recognized that South Korea was superior to North Korea in terms of conventional power. But what Roh government ultimately pursued was not the power to win the war, but the power to deter the war (deterrence). North Korea, as a result of its aggressive military strategies and its strengthening military power, could cause immense damage to South Korea by launching a sudden attack on South Korea. The participatory government judged that South Korea was not equipped for deterrence to prevent North Korea's sudden attack alone. The United States Forces Korea (USFK)'s fighting power (especially counterfire warfare power, intelligence capabilities) contributed to South Korea's deterrence against North Korea immensely, and South Korea realized that it would be difficult to replace USFK's fighting power within a short period of time. A combination of the degree of threat South Korea faced from North Korea, the extent to which the United States could contribute to deterrence and defense against the threat of North Korea, and the limited availability and high cost of alternative means of meeting the threat made Roh government more dependent on the United States. A high degree of alliance dependency led Roh government to perceive the fear of abandonment by the United States as greater than the fear of being involved in unwanted conflicts; accordingly, Roh government agreed to the strategic flexibility of USFK in order to decrease the possibility of abandonment by the United States. In the case of missile defense, Roh government perceived North Korea's weapons of mass destruction as weapons for the purpose of maintaining its regime or having leverage during negotiations rather than for threatening South Korea. Therefore, Roh government sought a peaceful resolution through dialogue. In addition, a missile defense system asked by the United States would not be reliable enough to be suitable for deployment, and was not suitable for the geography of the South Korean peninsula. The perception of a low level of threat and the small amount of security contributions made by the United States to protect South Korea against North Korea's weapons of mass destruction led Roh government to become less dependent on United States' security umbrella. A low degree of alliance dependency led Roh government to perceive the fear of abandonment from the United States as less than the fear of being involved in unwanted conflicts; accordingly, Roh government decided not to participate in a missile defense system in order to decrease its possibility of entrapment. However, in October 2006, North Korea's nuclear testing led Roh government to perceive North Korea's weapons of mass destruction as a 'serious threat'. Therefore, Roh government needed to protect South Korea against North Korea's weapons of mass destruction and then officially declared the need to construct the Korea Missile&Air Defense (KAMD). This paper concluded that a combination of Roh government's threat perception and United States' security contributions had a decisive effect on the decision of USFK's strategic flexibility and missile defense. In other words, while a low level of United States dependency led Roh government to present a strong level of commitment to the United States, a high level of dependency on the United States led Roh government to present a weak level of commitment to the United States. This conclusion shows that asymmetry between allies within an asymmetric alliance differs depending on the case; it also suggests that studies on the ROK-US alliance should overcome limitations of claims that weak states have no choice but to accept strong states' demands. ; 본 논문은 참여정부의 동맹정책을 전략적 유연성과 미사일방어체제 결정사례를 중심으로 살펴보는 것을 목적으로 한다. 보다 구체적으로 주한미군의 전략적 유연성 합의와 미사일방어체제 불참 결정을 비교분석함으로써 참여정부의 동맹정책을 설명하는 주요 변수가 참여정부의 미국 의존성이라는 점을 주장하고자 한다. 부시 행정부는 2001년에 발생한 9․11테러를 계기로 위협의 불확실성과 본토안보의 취약성을 인식하였다. 변화된 국제안보환경에 대응하고 미국 중심의 단극질서 유지를 위해 나타난 것이 새로운 군사안보전략이었다. 군사안보전략의 핵심은 테러와의 전쟁과 군사 변혁(Military Transformation)이었다. 그리고 미국은 전략의 효과적인 수행을 위해 동맹 및 파트너십의 강화를 도모하였다. 미국은 군사안보전략의 구체적 실천에 있어 미국의 전 세계 군사태세의 변화를 의미하는 해외주둔미군재배치계획과 새로운 능력의 구축이자 전쟁수행방식의 변화를 의미하는 미사일방어체제를 강조하였으며, 동맹국에 동참을 요구하였다. 미국의 동참 요구는 비대칭동맹인 한미동맹 내에서 약소동맹국인 한국에 동맹의 안보딜레마를 야기하였다. 각 쟁점에의 협력은 한국이 동북아 분쟁 및 한반도 분쟁에 의도치 않게 개입되는 상황을 야기하는 반면, 미국에 대한 비협조는 북한의 위협에 대한 미국으로부터의 방기를 야기하는 것이었다. 참여정부는 연루와 방기의 딜레마에 직면하여 주한미군의 전략적 유연성 합의와 미사일방어체제 불참이라는 상반된 결정을 내렸다. 전략적 유연성의 경우, 참여정부는 재래식 전력에서 한국이 북한보다 우위에 있다고 인식하였다. 하지만 참여정부가 궁극적으로 지향하는 바는 전쟁에서 승리할 수 있는 전력이 아니라 전쟁 자체를 예방하는 전쟁억제력이었다. 북한의 공세적인 군사전략과 군사력 증강은 북한이 기습적으로 공격을 가해 한국에 막대한 피해를 야기할 수 있었다. 참여정부는 북한의 기습적인 공격을 예방하기 위한 전쟁 억제력을 한국 단독으로 갖추고 있지 않다고 판단하였다. 주한미군이 갖추고 있던 전력, 특히 대화력전 능력과 정보력이 한국의 대북억제력에 지대한 기여를 하였으며, 한국이 이를 단시간 내에 대체하기는 어렵다고 보았다. 북한 위협에 대한 인식과 미국의 안보기여에 대한 고려는 참여정부로 하여금 안보획득을 위해 미국에 보다 의존적이 되도록 하였다. 높은 의존성은 원치 않는 분쟁에 연루되는 위험보다 미국으로부터 버림받는 위험을 더 크게 인식하도록 하였으며, 이에 따라 참여정부는 방기의 위험을 줄이기 위해 미국에 강한 공약, 즉 전략적 유연성 합의를 결정하였다. 미사일방어체제의 경우, 참여정부는 2006년 북핵 실험 이전에는 북한의 대량살상무기를 한국에 대한 위협용이라기보다는 체제 유지용 혹은 협상용으로 인식하였다. 따라서 대화를 통한 평화적 해결을 모색하였다. 그리고 북한의 대량살상무기를 방어하기 위해 요구된 미사일방어체제는 운용 신뢰성이 배치에 부합할 만큼 높지 않았으며, 군사분계선과 서울과의 인접성과 협소한 면적을 특징으로 하는 한반도 지형에는 적합하지 않는 체계였다. 북한의 대량살상무기에 대한 낮은 위협인식과 낮은 미국의 안보기여는 참여정부로 하여금 미국의 안보우산에 덜 의존적이 되도록 하였다. 낮은 의존성은 미국으로부터 방기되는 위험보다 원치 않는 분쟁에 연루되는 위험을 더 크게 인식하도록 하였으며, 이에 따라 참여정부는 연루의 위험을 최소화하기 위해 미국에 약한 공약 즉 미사일방어체제 불참을 공식화하였다. 하지만 2006년의 북핵 실험은 참여정부가 북한의 대량살상무기를 '심각한 위협'으로 받아들이게 하였다. 이는 북한의 대량살상무기 공격으로부터 한국을 보호할 필요성을 야기하였으며, 그 결과는 한국형 미사일방어체제의 공식적 구축이었다. 본 논문은 주한미군의 전략적 유연성 합의와 미사일방어체제 불참 결정에는 참여정부의 위협인식과 미국의 안보기여가 결합된 미국 의존도가 핵심적으로 영향을 미쳤음을 밝혔다. 미국 의존도가 낮을 경우 참여정부는 연루의 위험을 줄이기 위해 약한 공약을 제시하고, 반면 의존도가 높을 경우 방기의 위험을 줄이기 위해 강한 공약을 제시하였던 것이다. 이는 비대칭 내 동맹국들 간의 비대칭성이 쟁점별로 다를 수 있으며, 한미동맹에 대한 연구들이 약소국은 강대국의 요구를 수용할 수밖에 없다는 주장의 한계에서 벗어나야함을 보여준다. ; Master

학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 정치외교학부(외교학전공), 2020. 8. 신범식. ; 본 논문은 테러와의 전쟁에서 많은 피해를 입은 미국과 러시아의 테러조직 리스트가 예상과 달리 왜 유사점보다 차이점을 더 많이 가지고 있는가를 밝히고자 하였다. 이를 위해 러시아와 미국이 테러조직을 지정하는 과정을 비교함으로써 양국의 테러조직 지정에 영향을 미치는 요인들을 규명하고자 하였다. 우선 미국과 러시아의 국가 안보전략 문서들을 분석함으로써 양국이 시기별로 중요하게 여긴 관심사와 이러한 관심사에 대한 위협이 무엇인지 분석하였다. 그 다음으로, 미국과 러시아의 대통령들이 1993년부터 2017년까지 발표한 테러 관련 연설문, 인터뷰, 공문서들 가운데 제목이나 본문에 'terror' 및 'террор'라는 어근이 포함된 다양한 형태의 텍스트 자료들을 대상으로 워드분석을 함으로써 양국이 테러를 어떠한 위협으로 상정하는지, 국내외의 어떤 안건들과 연결하는지를 파악하였다. 그리하여 본고는 테러에 대한 역사적 경험과 인식, 안보에 대한 이해, 국제 질서와 상황 파악 등 많은 요인들이 테러조직 지정에 영향을 미치면서 양국이 테러에 대한 기본적인 인식, 즉 초국가적인 테러조직들이 한 국가만이 아닌, 국제사회 전체에 위협이 될 수 있다는 인식 면에서는 시간이 지나면서 비슷해졌지만 양국의 안보개념, 안보와 관련된 국익의 우선 순위, 테러에 대한 인식에 영향을 미친 역사적 경험이 상이하기 때문에 테러조직의 지정에서 유사점보다는 차이점이 더 많이 나타나게 되었다는 결론에 도달하였다. 본고는 일견 미국과 러시아가 테러조직을 공동의 적으로 간주하는 것처럼 보이지만 실제로는 다양한 요인들로 인해 테러와 테러조직의 지정에서 서로 다르게 접근한다는 사실을 보여주었다는 데 그 의의가 있다. ; Russia and the United States have been on the front line of the fight against terrorism for a long time, and at first glance it may seem that they are fighting against the same enemy. However, upon careful comparison of the U.S. Department of State list of Foreign Terrorist Organizations(FTO) and corresponding list of the Russian Federation the distinctions are strikingly obvious. The organizations designated by each country outnumber the ones that were appointed by both. This study aims to examine the factors behind the differences in the approaches that Russia and the U.S. took to defining the enemy. It is argued that the designation method is mainly determined by two broad aspects – the security concept and the perception of terrorism. Through the analysis of the national security strategies from 1997 to 2015, this study investigated several crucial issues: the ways Russia and the United States had been perceiving the international order, their place and role in it, as well as changes in their national interests over time, and most importantly, what constituted the perceived threats to the national security. Supporting this with the examination of the perception of terrorism through the word frequency analysis of Russian and American presidents' speeches, the study concluded that despite the fact that both countries claim terrorism to be their main threat, the approach to defining it is not the same as each country bases it on their own historical experience and national priorities. The United States views terrorism largely as a part of the global security framework, inseparably associated with other issues (such as the threat of WMD proliferation) that are claimed to emanate from rogue states and tyrannies. Consequently, the strategy in the fight against terrorism has been derived from the desire to converse these regimes to democracy. On the other hand, Russia was found to view terrorism as a more direct threat to the country's national security. For Russia, terrorist organizations are separate entities that try to violate the country's constitutional order through separatist and extremist slogans. Unlike the United States, Russia does not view terrorist organizations as an instrument in the hands of tyrannical regimes, therefore it condemns the American unilateral approach that is structured around interference into the internal affairs of other states. These differences are reflected in the formation of the terrorist organizations lists. The list of the United States is more comprehensive and geographically global. The FTO list includes not only the organizations that directly threaten US security, but also the ones that harm the partners and allies of the United States. At the same time, Russia is focused on designating the organizations that directly threaten the security of the country and the nearest region like Central Asia. There are also organizations on the list that do not commit terrorist acts, but undermine the values of Russia's constitutional system through the conduct of propaganda on the Internet. After September 11 and the Beslan school siege in 2004, there is a convergence in the perception of the US and Russia on the rise of terrorist organizations network as a major transnational threat in the 21st century. This explains why there are the same ten organizations on both lists. The vast majority of the organizations that have been designated by both countries are affiliates of al-Qaeda, which are fighting not one specific country, but the entire modern international society. Bearing in mind the distinctive features of prepetition claims and postpetition claims where the former are generally classified as insolvency claims subject to restrictions as per insolvency procedures while the latter as administration claims granted the rights to be paid irrespective of insolvency procedures, one may well assert that the actual amount of realized payment will consequently be different by a significant margin. Thus, it does matter to classify straddle claims before and after the order for relief. In South Korea, the part-fulfillment test(일부구비설) is widely accepted as a common view. In pursuant to the part-fulfillment test, once a particular debt in question is affirmatively established as insolvency claims, other claims that do not fall into the category of insolvency claims but nevertheless fulfill the requirement of administration claims are deemed administration claims. Even if the claims are unliquidated, contingent, unmatured, disputed, they can be classified as insolvency claims when the significant part of the claims are fulfilled prepetition. It seemingly is due to the reception of the Japanese insolvency acts which has eventually resulted in South Korean insolvency frameworks adopting the relevant Japanese legal theories and precedents that developed on the basis of the part-fulfillment test. But the word 'the significant part of the claims' is too vague to establish a clear and consistent criterion. Among the cases of the Supreme Court of South Korea, some cases contradict each other. In Japan, a scholar following the part-fulfillment test even admits that the test has its defects as some cases of the Supreme Court of Japan are inconsistent. The 'theory of deduction(控除説)' in Japan, based on the study of history of theories about classifying claims, criticizes the present common view in Japan, the part-fulfillment test, and suggests that the claims subject to insolvency risks be insolvency claims and the claims free from insolvency risks be administration claims. It may sound like a tautology, but it pinpoints that the present part-fulfillment test is far from realizing the essence of treatment and disposition of claims, using the word 'the significant part of the claims'. However, the theory of deduction also leaves much to be desired to set a clear and consistent criterion. In the United States, timing problems of claims in insolvency have been an important research theme, making use of a substantial balancing test. Thus, the arguments in the United States serve as a good reference. The theories of the United States do not apparently dichotomize, but virtually distinguish contractual claims from non-contractual claims. When it comes to contractual claims, the claimants voluntarily enter the contracts considering insolvency risks, so it is easy to determine whether the claimants bear the insolvency risks in accordance with their intention. In contrast, as of non-contractual claims, the claimants often get the claims involuntarily. It is hard to determine, based only on the claimants' intention, whether they should be burdened with insolvency risks. Therefore, dichotomy is desirable. In case of contractual claims, almost all federal courts of appeals and scholars adopt the performance test in the United States. As of non-contractual claims, there are the accrued state law test, the conduct test, the relationship test, and the fair contemplation test in the United States. Most of federal courts of appeals follow the relationship test, while most of scholars support either the conduct test or the fair contemplation test. For contractual claims, including the ones based on executory contracts, we can accept the performance test as it is. The part contributed to a debtor prepetition by a claimant abandoning exceptio non adimpleti contractus is subject to the insolvency risks and should be treated as insolvency claims. The part induced to do business with a debtor postpetition is beneficial for the estate and thus should be treated as administration claims. For efficiency, prepetition claims should be cut off from post-insolvency as sunk costs, while postpetition claims should receive priority to induce entities to enter new business with a debtor so as to foster reorganization. In case of non-contractual claims, it is hard to tell whether the claims are supposed to bear insolvency risks or not. It is a matter of policy. Unless it is the case where Debtor Rehabilitation and Bankruptcy Act in South Korea excludes explicitly the non-contractual claims from insolvency claims, prepetition claims should be classified as insolvency claims and postpetition claims administration claims. While the meaning of 'claims' for insolvency is defined in a unique sense under the United States Bankruptcy Code so as to put a great weight on that specific point of time, Debtor Rehabilitation and Bankruptcy Act in South Korea yet omits to define the meaning of 'claims' for insolvency, making it unnecessary to be obsessed with as to when a claim arises. For insolvency in South Korea, I hereby propose the relationship test that does not stick to the point when a claim arises. Rather, I suggest a more flexible solution that allows bifurcation of claims. If the part of the claim occurring before the order for relief creates a relationship, such as contact, exposure, impact, or privity, between the claimant and the debtor, then the part of the claim is insolvency claim. At the same time, the purposes of the acts on which the claim is based, the entity benefitted by the expense, and so forth, should be considered. Prepetition claims should be cut off to encourage a fresh start of the debtor, but that does not mean that the debtor is free to commit torts or gain unjust enrichments. Though it is quite theoretical, postpetition claims that the claimant gains involuntarily because the debtor fails to block a relationship between them should be treated as administration claims so that the estate shoulders the expense. As a result, insolvency can proceed with efficiency and equity. The representatives and the social insurance programs for future claimants can satisfy due process concerns. 학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 권혁주. ; 본 연구는 정책변동(policy change)사례 연구이다. 정책변동은 정책형성(의제설정과 의사결정)을 포함한다는 시각에서 논의를 진행하였다. 정책변동의 성공과 실패의 원인을 찾기 위해 '신행정수도이전정책'의 두 차례 정책변동과정을 분석하였다. 의제설정과정은 Kingdon의 정책흐름모형(policy stream model)을 적용하였고, 의사결정과정은 입법과정을 고려한 거부점(veto point)과 거부권행사자(veto player) 개념을 적용하여 분석하였다. '행정수도이전정책'은 1971년에 최초로 제기되었으나 구체화의 기회를 잡지 못하였다. 시간이 흘러 '행정수도이전정책'은 노무현 정부의 등장과 함께 정책의제가 되고 결정되어 추진되었다. 그런데「신행정수도의건설을위한특별조치법」이 헌법재판소로부터 위헌판결을 받게 되어, '행정중심복합도시건설정책'이 후속정책으로 채택되어 집행되었다. 한편, 이명박 정부는 '교육과학경제도시건설정책'으로 정책변동을 추진하지만 실패하게 되었다. 본 연구는 '신행정수도이전정책'이 좌초된 이후 노무현 정부가 실시한 '행정중심복합도시건설정책'으로의 제1차 정책변동과정과 그 성공을 다루었다. 그리고 이명박 정부의 '교육과학경제도시건설정책'으로의 제2차 정책변동과정과 그 실패에 대하여 분석하였다. 이론적 분석틀은 다음과 같이 구성하였다. 먼저 정책변동을 위한 의제설정과정은 Kingdon의 정책흐름모형에 따라 분석하였다. 정책의 3가지 흐름(정치의 흐름, 정책대안의 흐름, 정책문제의 흐름)을 정리한 후, 각 흐름들이 어떻게 결합되어 정책의 창을 열게 되고, 정책의 창 내에서 자신의 의사를 관철시키고자 하는 참여자의 활동을 해당 정책의 찬성과 반대집단으로 구분하여 살펴보았다. 다음으로 정책변동을 위한 의사결정과정은 국회에서의 입법과정을 중심으로 제도적 맥락에 따라 거부점과 거부권행사자를 구별하여 살펴보았으며, 사후적 거부점으로서 헌법재판소를 포함하였다. ; This is a case study on the policy change. This study have a perspective on policy change that includes policy formation (agenda setting and decision making). In order to find the cause of success and failure of policy change, this research analyzed two cases of the policy change of The New Administrative Capital Relocation Policy. Agenda-setting processes were analyzed on the basis of Kingdon' policy stream model, and decision-making processes were analyzed by applying the concept of the veto point considering the legislative process and veto players. The Administrative Capital Relocation Policy was first raised in 1971, but the policy did not take a chance to be materialized. Over time, the policy was determined by the policy agenda and driven with the advent of the Rho Moo-Hyun Administration. However, The Constitutional Court ruled that The New Administrative Capital Relocation Law is unconstitutional, so Multi-functional Administrative City Construction Policy was adopted as a subsequent policy and implemented. On the other hand, Lee Myoung-Bak Administration was attempts to policy change from the Multi-functional Administrative City Construction Policy to the Education and Science Centered, Economic City Construction Policy but Lee administration was failed to change the Multi-functional Administrative City Construction Policy. This study analyzed the first policy change process to the Multi-functional Administrative City Construction Policy and the success since the failure of the New Administrative Capital Relocation Policy.
