This paper examines the politicization of the United Nations Security Council (SC) and seeks to explore the causes and effects of this process. I will first demonstrate that the SC has expanded both its scope and authority after the end of the Cold War. With the SC becoming more powerful I then consider whether the Council has become the target of politicization and has met with criticism and resistance. I find that there is an on-going, observable process of politicization although the SC is significantly less contested than a number of other international organizations. Regarding the possible effects of politicization, the paper examines whether and to what extent the Security Council has adapted its institutional design. I find that the Council has—hesitantly— opened up to civil society actors, although interaction with NGOs is limited to an informal consultation process coupled with broad discretionary power of the SC's Permanent Members. In the concluding part of the paper I briefly examine how this outcome might be best explained and offer some hypotheses for further research. ; Das vorliegende Papier untersucht die Politisierung des UN-Sicherheitsrats und beleuchtet Bedingungsfaktoren und Effekte dieses Prozesses. Dazu wird zunächst gezeigt, dass der Sicherheitsrat nach dem Ende des Kalten Krieges deutlich an Bedeutung gewonnen hat und nicht nur seinen Kompetenzbereich ausgeweitet hat, sondern auch zunehmend tief in nationale Gesellschaften hineinregiert. Anschließend wird beleuchtet, ob der Sicherheitsrat im Zuge dieses Machtzuwachses zur Zielscheibe von Kritik und Widerstand wurde. Es zeigt sich, dass sich ein Prozess der Politisierung feststellen lässt, der gleichwohl deutlich unter Schwelle von Protesten bleibt wie sie von anderen internationalen Organisationen bekannt sind. Hinsichtlich möglicher Effekte von Politisierung wird gefragt, ob das Gremium sein institutionelles Design angepasst und sich für zivilgesellschaftliche Akteure geöffnet hat. Es wird deutlich, dass sich der Sicherheitsrat zwar in der Tat zunehmend für NGOs öffnet, dass diese Öffnung aber auf informelle Konsultationen beschränkt bleibt, deren Zustandekommen zudem stark dem Willen der Ständigen Mitglieder unterworfen ist. Der letzte Teil des Papier fragt schließlich, wie ein solcher Prozess der partiellen Öffnung erklärt werden kann und formuliert einige Hypothesen für künftige Forschung.
"Cyber-Krieg – der Begriff dringt langsam ins öffentliche Bewusstsein" schreibt Eugene Kaspersky heute in der SZ (offline). Eine recht vorsichtige Umschreibung für eine buzzword-Karriere, die bald Globalisierungs-artige Züge annehmen könnte. Dass der Begriff mehr verschleiert als erhellt, haben wir hier im Blog schon oft thematisiert. Doch mit der Lektüre des Kaspersky-Beitrags wird nicht nur die Bedrohung eines internationalen Cyber-Kriegs vor Augen geführt – nein, es ist ein "Angriff auf den Alltag". Zumal Kasperskys Aussenansicht im Zusammenhang steht mit einer etwas klandestinen Zusammenkunft in Bonn, dem Cyber Security Summit.

As well as in the Atlantic Charter (1941) as well as in the Beveridge Report (1942) an extension of the social security to the whole population had been requested with the end of the limitation to the sole workers. The International Labour Organisation (ILO) took over the majority of the ideas written down in the Beveridge Report at the International Labour Conference in Philadelphia (1944) and tried to make the governments sensitive to this problem by adopting the Recommandations n°67 and 69. After World War II, the ILO committed herself to a quick implementation of the principles of universality and extension to new risks but the European reconstruction did not allow her to play a leading role in this field. Nevertheless, she managed to conclude some internetional agreements at the begining of the 1950s, like the International Agreement concerning the social security for the Rhine boatmen or the European Social Security Convention for Migrant Workers. The creation of strong regional entities like the ESCC and the EEC, the national character of each social security system, the traditions' "weight", the influence of the East-West-conflict and the adhesion of a increasing number of Third World countries at the ILO lead to a quick decline of her role in the field of the European social security. No country was really interested in the harmonization of social norms. This is why the ILO had to satisfy herself with the Convention concerning Minimum Standards of Social Security (Convention n°102) and to give up the project of superior standards. But the ILO made the error to look upon the European regional organisations as competitors and not as allies. Die Realität zeigt auf, dass Kasachstan intensiv – wie kein anderes Land Zentralasiens – regionale/internationale Politik betreibt, indem immer mehr Politikfelder über die Grenzen des Nationalstaates (gewollt) hinaus getragen werden, um so in diesen regional/international zu agieren. Das lässt die Schlussfolgerung zu, dass Kooperation das Leitprinzip des Landes auf der internationalen Bühne war und ist. Der sicherheitspolitische Bereich ist geradezu das Paradebeispiel hierfür. In der Arbeit wird die sicherheitspolitische Kooperation Kasachstans mit seinen wichtigsten Partnern in diesem Bereich, nämlich: Russland, China, USA und NATO (3. Fallbeispiel: Internationale militärische Kooperation der Streitkräfte von Kasachstan.) sowie Kasachstans Kooperation in den beiden regionalen Organisationen wie die OVKS und die SOZ (1. und 2. Fallbeispiel: Kasachstans sicherheitspolitische Kooperation am Beispiel der Organisation des Vertrages für kollektive Sicherheit (OVKS). Fallbeispiel: Kasachstans sicherheitspolitische Kooperation am Beispiel der Shanghaier Organisation für Zusammenarbeit (SOZ)) untersucht. Dabei wird folgende Fragestellung zu Grunde gelegt: "Hat sich eine Diversifizierung internationaler sicherheitspolitischer Kooperation Kasachstans tatsächlich vollzogen?" Es gilt also zu untersuchen wie sich die Zusammenarbeit im sicherheitspolitischen Bereich Kasachstans, von der Unabhängigkeitserklärung bis zur Gegenwart, gestaltet hat und welche Veränderungen – in Form der Partnerwahl, Kooperationsbereiche – feststellbar sind. Zur Überprüfung der oben gestellten Fragestellung werden zwei Thesen aufgestellt. These 1: Aufgrund eines Wandels in der internationalen sicherheitspolitischen Kooperation von Kasachstan, hat sich der Kooperationsspielraum für Astana quantitativ und qualitativ (Der Begriff quantitativ zu verstehen sinngemäß als mengenmäßige/zahlenmäßige Bedeutung. Der Begriff qualitativ soll als inhaltliche Bereicherung von etwas verstanden werden) vergrößert. Russland bleibt dabei zwar nach wie vor ein strategischer Partner, muss sich aber nun die strategische (Führungs-)Position mit anderen Akteuren teilen. Die zweite These geht hingegen vom Gegenteil aus. These 2: Das gegenwärtige Kasachstan betreibt zunehmend selbstständig und multivektoral – i.S. einer Einbeziehung anderer Partnerstaaten, auch über die postsowjetische Region hinaus – sicherheitspolitische Kooperation. Der Kooperationsspielraum von Kasachstan ist zwar grösser geworden, trotzdem bleibt der russische Vektor in der kasachischen Sicherheitspolitik am ausgeprägten. Mit anderen Worten die sicherheitspolitische Kooperation von Kasachstan ist zwar breit ausgelegt, bei näherer Betrachtung aber stellt man fest, dass sich die Tendenz einer kontinuierlichen Vertiefung und Ausbau der Kooperation jedoch mit Russland abzeichnet. Der Verfasser der Arbeit kommt zu dem Schluss, dass ungeachtet vieler anderer Kooperationspartner und Kooperationsrahmen, Russland bzw. die OVKS die sicherheitspolitisch wichtigsten Kooperationspartner Kasachstans sind. Im Ergebnis kann somit der zweiten These zugestimmt werden. ; It can be observed that Kazakhstan – more than any other country in Central Asia – is intensively engaging in regional and international politics by (deliberately) pursuing an increasing range of policy fields beyond its national borders, allowing it to act regionally and internationally in these fields. This suggests that co-operation was and is the country's guiding principle in the international arena. The field of security policy is a prime example of this. This dissertation examines Kazakhstan's co-operation in the field of security policy with its key partners, namely China, the USA, and NATO (3rd case study: International military co-operation of the armed forces of Kazakhstan), as well as Kazakhstan's co-operation in two regional security organizations, the CSTO and the SCO (1st and 2nd case studies: Kazakhstan's security policy co-operation with the Collective Security Treaty Organization (CSTO). Case study: Kazakhstan's security policy co-operation with the Shanghai Cooperation Organization (SCO)). The aim of the research is to answer the following question: "Has there really been a diversification in Kazakhstan's international security co-operation?" To pursue this aim, the dissertation will examine how Kazakhstan has framed its security policy co-operation from independence to the present day and what changes – in terms of choice of partner and areas of co-operation – can be observed. In examining this research question, two theses will be considered: Thesis 1: As a result of shifts in Kazakhstan's international security policy co-operation, Astana's opportunities for co-operation have expanded in both quantitative and qualitative (Quantitative expansion refers to an increase in volume or number. Qualitative expansion refers to an enrichment of substance) terms. While Russia remains a strategic partner, it now needs to share its strategic (leading) position with other actors. The second thesis makes contrary assumptions. Thesis 2: At present, Kazakhstan is pursuing a security policy that is increasingly autonomous and multivectoral – in the sense of engaging in security co-operation with other partner states besides Russia, including states from outside the post-Soviet region. While Kazakhstan's scope for security co-operation has increased, the Russian vector in Kazakhstan's security policy remains the strongest. In other words, while Kazakhstan's security policy co-operation has been diversified, closer examination reveals a tendency towards continual deepening and expansion of co-operation with Russia. The author of this dissertation concludes that despite the existence of many other partners and frameworks for co-operation, Kazakhstan's most important partners for security co-operation are Russia and the CSTO. Consequently, the second thesis is correct.

Europe is currently facing one of the biggest influx of refugees and displaced people since the end of the wars in the Balkans. At the same time, there has also been an increase in terroristic attacks in recent years. States seem to fear a correlation between these two developments, and refugees and asylum seekers are increasingly seen as risks to national security. This doctoral thesis contains a thorough analysis of those provisions of the EU Asylum Qualification Directive which aim to address these concerns, and allow for the exclusion of certain persons from international protection, the restriction of their status rights, or even the revocation or ending of protection. It argues that it is possible and imperative to uphold the standards of international refugee and human rights law even in the face of exacerbated security concerns of the Member States.
Die von den USA ins Leben gerufene "Proliferation Security Initiative" (PSI) soll den Transport von Massenvernichtungswaffen, Trägersystemen und waffenfähigem Material auf dem See-, Luft- und Landweg unterbinden, die Proliferation insgesamt erschweren und abschreckend auf die beteiligten Akteure wirken. Ihr Ansatz besteht darin, die zwischenstaatliche Zusammenarbeit und den Informationsaustausch zu verbessern. Aufgabe der Teilnehmerstaaten ist es vor allem, innerhalb ihres Hoheitsbereichs durch den verstärkten Vollzug nationaler Rechtsvorschriften zur Exportkontrolle, Strafverfolgung und Gefahrenabwehr eine wirksame Implementierung der gemeinsam verabschiedeten Prinzipien zu gewährleisten. In der öffentlichen Debatte werden - meist unter Fokussierung auf bestimmte maritime Einsatzszenarien - Zweifel an der Rechtmäßigkeit der Initiative geäußert. Ziel der vorliegenden Studie ist es, im Hinblick auf solche kritischen Szenarien Ansätze für eine völkerrechtskonforme Lösung oder Umgehung möglicher Konflikte zu erarbeiten. Die Bundesrepublik Deutschland ist als eine der führenden Handelsnationen in besonderem Maße über den Seeverkehr in den weltweiten Warenaustausch eingebunden. Mit dem Umfang maritimer Teilhabe wächst auch die Verantwortung, innerhalb des eigenen Einflußbereichs dafür zu sorgen, daß der Seeverkehr nicht von Akteuren mißbraucht wird, die durch den Handel mit Massenvernichtungswaffen und waffenfähigen Komponenten den Weltfrieden und die internationale Sicherheit bedrohen. Die PSI bietet eine geeignete Plattform, um dieser Verantwortung gerecht zu werden. Im Rahmen ihrer Hoheitsrechte verfügt die Bundesrepublik über weitreichende Möglichkeiten, sich an der Umsetzung der Initiative zu beteiligen, ohne gegen geltendes Völkerrecht zu verstoßen. Der Einfluss Internationaler Organisationen reicht angesichts der Herausforderung, für globale Probleme Lösungen zu finden, mittlerweile so weit, dass sich die Frage nach den in ihnen vorhandenen Machtbegrenzungsmechanismen stellt. Doch wie kann die Macht Internationaler Organisationen kontrolliert werden, wenn das aus dem nationalen Verfassungsrecht bekannte Gewaltenteilungsprinzip nicht auf die internationale Ebene übertragen werden kann? Die Arbeit analysiert die dazu innerhalb der Vereinten Nationen (UNO) und der Welthandelsorganisation (WTO) existierenden formalisierten Mechanismen anhand ihrer Gründungsverträge. Dabei werden drei Kategorien von Machtbegrenzungsmechanismen identifiziert: Kompetenzzuweisungen und -abgrenzungen, organinterne Mechanismen und schließlich Interaktion zwischen den Organen. Die in der Praxis bedeutsamsten Mechanismen stellen zum einen das Vetorecht im UN-Sicherheitsrat sowie der negative Konsens im Streitbeilegungsgremium der WTO dar, die zur Gruppe der organinternen Mechanismen gehören. Zum anderen besteht in der Kontrolle der Streitbeilegungs-Panel der WTO durch den Appellate Body eine wichtige Machtbegrenzung durch Interaktion. Die Untersuchung dokumentiert das paradoxe Phänomen, dass die Mechanismen zur Begrenzung der Macht in vielen Fällen auch eine machtsteigernde Wirkung haben, indem sie die Effizienz, Akzeptanz und Legitimation der Organisation erhöhen. Die Verfasserin erklärt dies damit, dass das Augenmerk der Gründungsstaaten in der Entstehungsphase auf dem Funktionieren der Organisation als Gegengewicht zu ihren jeweiligen Mitgliedsstaaten lag. Dass Internationale Organisationen in der Zwischenzeit so stark an Einfluss gewonnen haben, dass ihre Macht nunmehr begrenzt werden sollte, ist eine neue Entwicklung, die jedoch in Zukunft deutlich an Bedeutung gewinnen wird. ; In light of the challenge to find answers to global problems, the influence of international organizations nowadays goes so far that the question of existing checks and balances within these organizations arises. But how can power be controlled when the principle of separation of powers originating from national constitutional law cannot be transferred to the international stage? The purpose of this thesis is to analyze existing formalized internal mechanisms within the United Nations and the World Trade Organization on the basis of their founding treaties. The author identifies three categories of checks and balances: allowing and limiting competencies, mechanisms within the organs and finally interactions between the organs. In practice, the most important mechanisms of these organizations are on the one hand the power of veto within the UN Security Council and the negative consensus within the WTO dispute settlement body, which belong to the category of mechanisms within the organs. In addition, the control of the WTO dispute settlement panels by the Appellate Body is an important form of checks and balances through interaction. The analysis shows the paradoxical phenomenon, that checks and balances in many cases have the effect of increasing power by augmenting the efficiency, acceptance and legitimacy of the organization. The author explains this by reference to the intentions of the founding states during the developing phase to strengthen these organizations as a counterbalance to their respective member states. It is a new development that international organizations have now increased their influence so much that their power should be limited, but this will become significantly more important in the future.
The paper discusses the impact of high capital mobility for monetary and budget policy as well as for the Provision of public goods, for taxation, for wage policy and trade unions, for distribution policy, and for social security Systems. The mobility of porrfolio capital puts additional restraints on monetary and fiscal policy of governments, the mobility of real capital restricts the maneuvering space of governments (in redefining the opportunity costs of government decisions in open economies). It is shown that competition between governments does not degenerate but serves as a mechanism to reduce costs and to discover new institutional arrangements.
Auf der großen Konferenz der SGIR (Standing Group on International Relations) vom 9.-11. September 2010 in Stockholm, Schweden, organisierten wir eine eigene Sektion zum Thema Sicherheitskultur im Wandel. Der ICC, eine IO, die Völkerrechtspersönlichkeit besitzt, hat sich das Ziel gesetzt, ?der Straflosigkeit der Täter ein Ende zu setzen und so zur Verhütung solcher Verbrechen beizutragen?. Es schien jedoch unumgehbar, in das ICC-Statut selbst Bestimmungen aufzunehmen, die dessen Beziehung zu den Vereinten Nationen regeln. Art. 2 ICC-Statut stellt sicher, dass diese beiden IO durch ein zu schließendes Abkommen zueinander in Beziehung gebracht werden. Durch das ReAg wurden Regeln aufgestellt, die für eine erfolgreiche Zusammenarbeit der beiden IO unabdingbar sind.Mit Art. 5 (1) lit. d) ICC-Statut wurde das Verbrechen der Aggression in den Katalog der Tatbestände aufgenommen. Durch Absatz 2 wird sichergestellt, dass der ICC erst dann Jurisdiktion über diese Straftat ausüben kann, wenn dieser Begriff definiert ist und Bedingungen für die Ausübung der Gerichtsbarkeit festgelegt wurden. Eine solche Bestimmung muss mit der UN-Charta vereinbar sein. Art. 13 lit. b) ICC-Statut ermöglicht es dem SR, dem Ankläger des ICC eine Situation zu unterbreiten, in der es den Anschein hat, dass Verbrechen, wie sie Art. 5 ICC-Statut nennt, begangen wurden. Der SR muss nach Kapitel VII der UN-Charta tätig werden. Ermächtigt die UN-Charta den SR hierzu? Wie ist der Begriff der ?Situation? zu verstehen? Kann der SR die Komplementarität außer Kraft setzen? Ist der ICC auch für Verbrechen zuständig, die vor dem 1. Juli 2002 stattgefunden haben? Anschließend wird SR-Res. 1593 analysiert. Art. 16 ICC-Statut ermöglicht es dem SR, mit einer nach Kapitel VII UN-Charta angenommenen Resolution den ICC um Aufschub der Ermittlungen oder der Strafverfolgung zu ersuchen. Fraglich ist allerdings, wie eine Situation aussehen kann, in welcher der SR um Aufschub ersuchen kann. Die Begriffe ?Ermittlung? und ?Strafverfolgung? werden erläutert . Weiters ist zu klären, ob ein Aufschub auf 12 Monate beschränkt ist. Danach wird SR-Res. 1422 einer Analyse unterzogen. ; The ICC is an international organization with international legal personality. It is necessary to be brought the Court into relationship with the United Nations. The Relationship Agreement between these two organizations entered into force on 4 October 2004. The basic elements, which are essential for a good cooperation, are regulated by this paper. Article 5 para. lit. d) ICC-Statute stipulates that the crime of aggression falls within the jurisdiction of the ICC. Article 5 para. 2 provides that the court will not exercise its jurisdiction over the crime of aggression until such time as the states parties agree on a definition of the crime and set out the conditions under which it may be prosecuted. Such a provision have be consistent with the Charter of the United Nations. Article 13 allows the Security Council to refer a situation in which one or more of such crimes appears to have been committed to the Prosecutor. For this purpose the SC have to act under chapter VII of the Charter of the United Nations. In this context numerous of questions arise: Is the SC able to refer a situation the ICC? What means the term ?situation?? Is the principle of complementarity relevant? Can the ICC prosecute crimes which are committed before the 1 July 2002? After that SC-Resolution 1593 will be analyzed in detail. Article 16 allows the Security Council to require the ICC to defer from investigating a case for a period of 12 months. The SC have to do this in a resolution adopted unter Chapter VII of the Charter of the United Nations. Such a deferral may be renewed by the Security Council. Which situation allows the SC to defer an investigation or prosecution? The terms ?investigation? and prosecution? have to be explained.
