Die Arbeit beschäftigt sich mit dem Einfluss des Völkerrechts auf das deutsche Genehmigungsverfahren für den Export von Kriegswaffen und Rüstungsgütern. Der Handel mit Waffen und Rüstungsgütern ist ein Milliardengeschäft, mit weitreichenden politischen Konsequenzen. Wie sämtliche militärische Fragen bildet der internationale Waffenhandel einen sensiblen und schwer zu regulierenden Rechtsbereich, da viele Nationen schnell einen Eingriff in ihre staatliche Souveränität befürchten. Der internationale Waffenhandel ist jedoch mit vielen Problemen behaftet – so erscheint insbesondere die Lieferung von Waffen in Krisengebiete als kritisch, weil diese die Eskalation von Konflikten und Gewalt bewirken können. Ebenfalls können die Waffen von autoritären Regimen zur Unterdrückung der eigenen Bevölkerung missbraucht werden. Insgesamt ergaben sich aus dem Fehlen von internationalen Standards und Regularien für den globalen Handel mit konventionellen Rüstungsgütern bisher gravierende negative Folgen. So entstehen aus den nicht oder lediglich rudimentär vorliegenden Exportkontrollsystemen, namentlich bei Kleinwaffen, Leichtwaffen und Landminen, u.a. eine intensivere und schnellere Eskalation von Konflikten, anwachsende und ausufernde illegale Waffenmärkte sowie die Erhöhung des Risikos des Missbrauchs von Waffen gegen die Zivilbevölkerung. In diesem Kontext sollen idealerweise die internationalen und die nationalen juristischen Gestaltungsmittel der Kontrolle der Rüstung und des internationalen Waffenhandels ein übergreifendes politisches Konzept zur Herstellung von stabilen zwischenstaatlichen Beziehungen und zur Gewährleistung der internationalen Sicherheit bilden. Im Spannungsfeld zwischen den internationalen und den nationalen Interessen und Bestimmungen wird hier die Bedeutung des deutschen Grundgesetzes und des internationalen Rechts im Bereich des Waffenhandels für das deutsche Genehmigungsverfahren für Rüstungsexporte relevant.

The Max Planck Institute for Comparative and International Private Law organized a conference on international private law in China and Europe, which was supported by the Deutsche Forschungsgemeinschaft and the Hamburgische Wissenschaftliche Stiftung. It was initiated by China Law Unit research fellow PD Dr. Benjamin Pissler, M.A. (Sinology), hosted by Prof. Dr. Dr. h.c. mult. Jürgen Basedow, LL.M. (Harvard), and took place at the Institute in Hamburg on 7 and 8 June 2013.New private international law (PIL) legislation enacted in the two Chinese jurisdictions – namely, mainland China and Taiwan – has adopted terminology and a structure that is oriented on continental European conceptions, often on German approaches. Moreover, the new legislation makes apparent the two jurisdictions' increasing integration into the global economy. This is particularly relevant for legal problems that arise in business activities and require PIL for their solution. The sale of goods and personal relationships find themselves woven together at an international level and issues that arise include: Which court has jurisdiction over a given dispute? Whose law is applicable? Die Arbeit befasst sich mit dem mandatum iuris gentium und der völkerrechtlichen Treuhand. Im ersten historischen Teil werden die rechts- und ideengeschichtlichen Wurzeln beider Institute nachvollzogen. Im zweiten Teil werden problematische Fälle des modernen Völkerrechts dargestellt, in denen das Mandats- bzw. Treuhandrecht in völkerrechtlichen Streitfragen besondere Relevanz hatte und z. T noch hat, z.B. Südwestafrika/Namibia, Israel/Palästina und Nauru. Im dritten und letzten Teil wird die Zukunft der völkerrechtlichen Treuhand untersucht, insbesondere in besonders aktuellen Fällen wie Kosovo, Afghanistan und Ost-Timor, die de facto mit der völkerrechtlichen Treuhand vergleichbar sind. In diesem Teil werden auch Vorschläge zu Wiederbelebung des UN-Treuhandsystems, auch im Umweltvölkerrecht, und ähnliche Vorschläge aus der Völkerrechtslehre diskutiert. Insgesamt wird festgestellt, dass der Treuhandgedanke seit seiner Entstehung im Völkerrecht nicht an Aktualität eingebüßt hat. ; This thesis deals with the concepts of mandate and trusteeship in international law. In the first historical part of the thesis the legal and historic roots of both concepts are reviewed. In the second part controversial cases of modern international law in which the concept of mandate respectively trusteeship was or still is of particular importance are discussed, for example South West Africa/Namibia, Israel/Palestine and Nauru. In the third and last part the possible future of trusteeship in international law is dealt with, in particular recent cases like Kosovo, Afghanistan and East Timor which are at least de facto comparable to the concept of trusteeship in international law. Also, proposals to revive the UN-Trusteeship System, even in environmental law, and similar proposals among experts are reviewed. The conclusion in general is that the concept of trust or trusteeship is still of importance in recent questions of international law, although its roots trace back a long time.

Seit 2003 hat sich das politische Bild des Irak stark verändert. Dadurch begann der Prozess der Neugestaltung der irakischen Rechtsordnung. Die irakische Verfassung von 2005 legt erstmalig in der Geschichte des Irak den Islam und die Demokratie als zwei nebeneinander zu beachtende Grundprinzipien bei der Gesetzgebung fest. Trotz dieser signifikanten Veränderung im irakischen Rechtssystem und erheblicher Entwicklungen im internationalen Privat- und Zivilverfahrensrecht (IPR/IZVR) im internationalen Vergleich gilt die hauptsächlich im irakischen Zivilgesetzbuch (ZGB) von 1951 enthaltene gesetzliche Regelung des IPR/IZVR im Irak weiterhin. Deshalb entstand diese Arbeit für eine Reformierung des irakischen IPR/IZVR. Die Arbeit gilt als erste umfassende wissenschaftliche Untersuchung, die sich mit dem jetzigen Inhalt und der zukünftigen Reformierung des irakischen internationalen Privatrecht- und Zivilverfahrensrechts (IPR/IZVR) beschäftigt. Die Verfasserin vermittelt einen Gesamtüberblick über das jetzt geltende irakische internationale Privat- und Zivilverfahrensrecht mit gelegentlicher punktueller und stichwortartiger Heranziehung des deutschen, islamischen, türkischen und tunesischen Rechts, zeigt dessen Schwachstellen auf und unterbreitet entsprechende Reformvorschläge. Wegen der besonderen Bedeutung des internationalen Vertragsrechts für die Wirtschaft im Irak und auch zum Teil für Deutschland gibt die Verfasserin einen genaueren Überblick über das irakische internationale Vertragsrecht und bekräftigt gleichzeitig dessen Reformbedürftigkeit. Die Darstellung der wichtigen Entwicklungen im deutsch-europäischen, im traditionellen islamischen Recht und im türkischen und tunesischen internationalen Privat- und Zivilverfahrensrecht im zweiten Kapitel dienen als Grundlage, auf die bei der Reformierung des irakischen IPR/ IZVR zurück gegriffen werden kann. Da die Kenntnisse des islamischen Rechts nicht zwingend zum Rechtsstudium gehören, wird das islamische Recht dazu in Bezug auf seine Entstehung und die Rechtsquellen dargestellt. Am Ende der Arbeit wird ein Entwurf eines föderalen Gesetzes zum internationalen Privatrecht im Irak katalogisiert, der sich im Rahmen der irakischen Verfassung gleichzeitig mit dem Islam und der Demokratie vereinbaren lässt. ; The political framework of Iraq has remarkably transformed since 2003. Hence began the process of reshaping the Iraqi legal system. For the first time in the history of Iraq, the Iraqi Constitution of 2005 determines Islam and democracy as two essential principles to be followed in legislation side by side. Despite this substantial development within the Iraqi legal system and current considerable development of international private and civil procedural law in international comparison, the legal regulation of the Iraqi international private and civil procedural law, which contained mainly in the Iraqi Civil Code of 1951 still applies. This thesis wants to sketch a possible reform of the Iraqi international private and civil procedural law. This work is considered the first comprehensive scientific work dealing with the current content and the future reform of Iraqi international private and civil procedural law The author gives a general overview of the current Iraqi international private and civil procedural law, indicates its weak points and makes appropriate reform proposals. The German, Islamic, Turkish and Tunisian international private and civil procedural law are used occasionally and in keywords in this passage. Due to the special significance of international contract law for the economy in Iraq and partly for the German economy as well, the author gives a more detailed overview of the Iraqi international contract law and at the same time reaffirms its need for reform. The outline of the main aspects of German-European law, of traditional Islamic law and of Turkish and Tunisian international private Law and civil procedure law in the second chapter serves as a basis that can be used to reform the Iraqi international private Law and civil procedure law. Because the knowledge of Islamic law is not necessarily part of the law studies, Islamic law is presented additionally in relation to its origin and the sources of law. At the end of the work, a draft of a federal law on private international law in Iraq is catalogued, which is compatible with Islam and democracy within the framework of the Iraqi constitution.

The modern understanding of autonomy (at least in its strong version) often includes the idea of selflegislation. As was paradigmatically the case for the French Revolution, self-legislation was considered as ideally neither bound by tradition nor by existing institutions. But some contemporary political theorists of the bourgeois revolutions (including Hobbes and Burke) felt uneasy about the loss of order and therefore tried to dispense with the concept of autonomy altogether. This article reconstructs this unease and its relation to Habermas′ proposal of staging the desire for autonomy within an institutional setting. Habermas′ suggestion privileges the existing institutional order over the desire for autonomy. Against Habermas I stress the importance of the desire for autonomy with its consequences for threatening the authority of law. Against this threat, I advocate that we recognize an existing institutional order actively and explicitly.

The article explores the contribution of the purity of Kelsen's theory of international law to the exclusion of ethics and political analysis from the workfield of the international lawyer. It is argued that Kelsen's own approach is an epistemologically grounded argument against involvement in the emotional dimension of political relations, which he dismisses as irrational. This is what justifies professional evasiveness in the face of the continuing self-assertiveness of the nation-state. Kelsen is now such a formidable obstacle to the development of the discipline because the profession lacks his general intellectual culture and so is unable to question the foundations of his system.

Mónica García-Salmones Rovira hat ihr – mittlerweile preisgekröntes – Buch als "The Project of Positivism in International Law" betitelt. Das klingt etwas schmissig und zugleich verlockend rätselhaft. Wessen Projekt war es, wann gab es das und was ist davon zu halten? Die Verfasserin setzt keinen Untertitel dazu, der dem Leser einen erläuternden Hinweis geben könnte. Die eigentliche Überraschung ist, dass sich nach Lektüre der rund 400 Seiten beide Eindrücke sogar verstärkt haben: Das Buch-Ende wartet im Anschluss an die völkerrechtshistorische Darstellung mit einer persönlichen Positionierung der Autorin gegenüber ihrem Gegenstand auf, die eine akzentuiert kritische Haltung offenlegt und den Leser nochmals zum Nachdenken bringt. .

Mit seinem Hauptwerk 'De Iure Belli ac Pacis' gilt Hugo Grotius (1583 - 1645) als Gründer einer systematischen modernen Völkerrechtstheorie. In dem vorliegenden althistorischen und rechtshistorischen Beitrag wird Grotius Werk demgegenüber auf seine Beziehungen zum Altertum und zum älteren Christentum untersucht. Im ersten Teil widmet sich der Autor der Frage, ob man - selbst bei Beschränkung auf grundsätzliche Züge - überhaupt zusammenhängend von von einem Völkerrecht der Antike reden kann und worin seine gemeinsamen Züge und Besonderheiten liegen könnten. In diesem Zusammenhang kommt er zu dem Ergebnis, daß ungeachtet einer Pluralität antiker Rechtssysteme eine Reihe universeller Rechtsfiguren in einer Vielzahl von Äußerungsformen ausgemacht werden kann, die auch entscheidend das moderne Völkerrecht formen: die Subjekte des Völkerrechts, Rechtshandlungen zwischen diesen Subjekten, der Begriff eines überall als solchen geltenden Unrechts , das Kriegsrecht , das Recht einer Gemeinschaft verschiedener Völkerrechtssubjekte, das durch Vertragsbeziehungen begründet wird. Die besonderen Züge antiker Völkerrechtssysteme sieht der Autor in ihrem unilateralen Charakter, im Gegensatz zu dem bilateralen oder multilateralen Charakter moderner Völkerrechtsordnungen, darüberhinaus in der zentralen Bedeutung des Krieges in seiner Funktion als Instrument der Rechtsbehauptung und -durchsetzung und schließlich in dem nahezu völligen Fehlen einer Positivierung. Rechtliche Aussagen in antikem Völkerrecht pflegen aus vorpositiven Standards abgeleitet zu sein, die wiederum stark bestimmt werden durch Religion, Tradition und allgemeine Gerechtigkeits- oder Natur-der-Sache-Abwägungen. Im zweiten Teil zeigt der Autor, daß Grotius in seinem Hauptwerk in erheblichem Maße auf antiken Konzepten und ihren Autoren aufbaut, ohne sie allerdings unkritisch zu übernehmen. Die Untersuchung geht in zwei Schritten vor: zunächst wird im Rahmen einer Analyse des Referenzsystems der Umfang, in dem sich Grotius mit antiken und mit Autoren und Werken seiner Zeit befaßt, quantitativ ermittelt und bewertet. Hier findet der Autor eine intensive Auseinandersetzungen in beide Richtungen. Im nächsten Schritt erhärtet und substanziiert er dieses Ergebnis anhand der Erörterung von vier thematischen Komplexen: Grotius Interesse für die Quellen eines bindenden Völkerrechts, für die souveränen Völkerrechtssubjekte, für die Rechtstitel auf Territorialbesitz und schließlich für das Recht der Begrenzung von Kriegshandlungen, für das Neutralitätsrecht und für die Regeln des diplomatischen Verkehrs. Abschließend kommt der Autor zu dem Ergebnis, daß sich in Grotius Werk eine beeindruckende, wenn auch immer kritische Verbundenheit mit der ganzen literarischen Tradition aus dem Altertum offenbart - eine neuzeitliche Form der Völkerrechtsrezeption aus dem Altertum. ; With his main work De lure Belli ac Pacis, Hugo Grotius (1583-1645) is considered the founder of a systematic modern doctrine of international law. In the present classical-historical and legal-historical text Grotius' work is examined concerning its relation to the classical and early Christian period. In the first section, the author devotes himself to the question whether one may speak at all, even with regard to basic features, of a homogeneous classical international law and what its characteristic structures and peculiarities are. In this connection, he concludes that notwithstanding the plurality of classical legal approaches a canon of universal basic convictions pertaining to a variety of topics is discernable which also decisively shape modern international law: the subjects of international law, legal transactions between these suhjects, the concept of a universally assumed wrong, the laws of war, the law of a community of several suhjects of international law which are parties to a treaty. The author identifies as particular features of classical international law its unilateral character, in contrast to the bilateral and multilateral character of relations within the modern community of states, furthermore, the dominating position of war as an instrument to determine and secure rights as well as its almost complete lack of codification. Legal orientations in classical international law are derived from pre-positive standards, which are in turn characterized by religion, custom or argumentation based on justice / nature-of-things. In a second section, the author shows that Grotius draws decisive support in his main work from classical notions and their originators without, however, adopting them uncritically. The investigation proceeds in two steps: first, in analyzing his system of references, the scope of Grotius' concern with classical in comparison to contemporary writings is quantitatively ascertained and evaluated. Here, the author finds intensive reflection in both directions. Subsequently, he verifies and substantiates this conclusion in discussing four topic-complexes: Grotius' attention to the sources of a binding multilateral international law, to the subjects of international law, to titles to territorial claims, as well as to the law with respect to limitations on war, to neutrality and to diplomatic law. Ultimately, the author comes to the conclusion that an impressive although always critically considered relationship to the tradition of the classical authors manifests itself in Grotius' work, an early modern form of reception of classical law.

Gegenstand der vorliegenden Dissertation ist die Frage nach der Anerkennung ökologischer Menschenrechte auf verschiedenen Rechtsebenen. Dabei wird die Entwicklung der ökologischen Menschenrechte herausgearbeitet und ihre Wirkungen auf internationaler, regionaler und staatlicher Ebene untersucht. Dazu wird die gegenwärtige Rechtslage der ökologischen Menschenrechte im Europa- und Völkerrecht dargestellt und bewertet. Teil der Aufgabenstellung der Arbeit ist auch die Idee einer ökologischen Gerechtigkeit, anhand derer unterschiedliche Problemfelder wie Armut und ökologische Rechtsstaatlichkeit beleuchtet werden. Das Ziel der Arbeit besteht damit in einer rechtsdogmatischen und rechtspolitischen Begründung ökologischer Menschenrechte im internationalen sowie im regionalen Recht. Mithilfe der rechtsvergleichenden Methodik soll eine wirksame Problemlösungsfindung aufgezeigt werden, welche dazu beitragen kann, eine menschenwürdige Umwelt in der ganzen Welt zu sichern. ; The main aim of this dissertation is to understand how environmental human rights are recognized at different legal levels. It maps out the trajectory of development of environmental human rights and examines its impact at the international, regional and state level. In view of that objective, the current legal situation of environmental human rights in European and International Law is presented and evaluated. The dissertation also aims at examining the idea of environmental justice and its intersection with other social and legal aspects like poverty and the environmental rule of law. The findings, therefore, serve to present a legal dogma and provide a legal policy framework for environmental human rights in international and regional law. The legal comparative methodology used in the analysis intends to present an effective problem-solving model, that may create a decent environment around the world.

Die Weiterentwicklung und Forschung im Bereich der Autonomie und künstlichen Intelligenz schreitet schnell voran. Insbesondere die Rüstungsindustrie hat ein hohes Interesse an diesen Technologien entwickelt. Das Aufzeigen möglicher völkerrechtlicher Probleme im Zusammenhang mit dem zukünftigen Einsatz autonomer Waffensysteme ist dringend erforderlich, um auf Ebene des Völkerrechtes zum entsprechenden Zeitpunkt Lösungsvorschläge anbieten zu können. Besonderer Stellenwert kommt den Überlegungen zu, inwiefern autonome Waffensysteme zur Einhaltung der Prinzipien des humanitären Völkerrechts in der Lage sein können. In der vorliegenden Diplomarbeit dient eine grundlegende technische Einführung als Basis für ein interdisziplinäres Verständnis der diskutierten Problemstellungen. Durch die Analyse der kriegsvölkerrechtlich und menschenrechtlich relevanten Fragestellungen wird ein rechtlich realistischer Rahmen aufgezeigt. Dieser bietet die Grundlage für die Beantwortung der Frage nach der rechtlichen Verantwortung für Rechtsverletzungen beim Einsatz autonomer Waffensysteme sowie für einen sinnvollen politischen Diskurs auf internationaler Ebene. Schließlich werden unterschiedliche Herangehensweisen zur Regulierung autonomer Waffensysteme diskutiert. Nach der Auseinandersetzung mit dem Thema lässt sich sagen, dass ein verantwortungsbewusster internationaler Diskurs sowie ausgereifte Technologien die zwingenden Voraussetzungen für einen zukünftigen Einsatz autonomer Waffensysteme sind. Dem Menschen muss in der Vorbereitung solcher Einsätze immer eine bedeutsame Einflussnahme erhalten bleiben. ; Research and development in the fields of autonomy and artificial intelligence are progressing rapidly. Above all, the arms industry has developed a great interest in these technologies. For offering feasible solutions to arising problems in international law at the relevant time, pinpointing possible legal problems in international law regarding the future use of autonomous weapon systems is essential. In this context, considerations whether autonomous weapon systems will be able to comply with the principles of international humanitarian law are of utmost significance. In the present diploma thesis, a fundamental technical introduction is provided to facilitate an interdisciplinary approach to the discussed questions. The analysis of relevant issues of international humanitarian and international human rights law presents a realistic legal scope. Based upon this, the question of responsibility for breaches of international law that are caused by autonomous weapon systems can be answered and an expedient political debate on an international level is made possible. Last but not least, various approaches concerning the governance of autonomous weapon systems are discussed. Concluding this critical analysis, it is to say that a responsible international discourse as well as fully developed technology is mandatory for a future deployment of autonomous weapon systems. Zunehmende Globalisierung hat das Entstehen neuer Karrierekonzepte gefördert, u.a. des Konzepts der Self-Initiated Expatriates (SIE). Es umfasst Personen, die sich aus eigenem Willen für eine Berufserfahrung im Ausland entscheiden. Internationale Arbeitserfahrung kann wesentlich dazu beitragen, Karrierekapital aufzubauen, welches in der Literatur (z.B. DeFillippi & Arthur 1994) als Anhäufung der Kompetenzen Knowing-Why, Knowing-How und Knowing-Whom definiert wird. Diese Masterarbeit, die in einen theoretischen und einen empirischen Teil gegliedert ist, beschäftigt sich mit folgenden Forschungsfragen: (1) Welche Beweggründe haben südosteuropäische SIEs, an einem Praktikum bzw. Traineeprogramm einer österreichischen Bank teilzunehmen?, (2) Inwieweit trägt eine internationale Berufserfahrung dazu bei, Knowing-Why, Knowing-How und Knowing-Whom zu entwickeln? Und (3) Welchen Einfluss haben die Beweggründe südosteuropäischer SIEs für eine Berufserfahrung im Ausland auf den Aufbau ihres Karrierekapitals?Die empirische Studie wurde im Zuge eines Projekts des Instituts für Personalpolitik an der Karl-Franzens-Universität Graz durchgeführt. Dabei wurden 17 Studierende und junge HochschulabsolventInnen aus Südosteuropa interviewt, die an einer Personalentwicklungsmaßnahme einer österreichischen Bank teilnahmen. Die Ergebnisse wurden mittels NVivo anhand theoretischer Kriterien kodiert und ausgewertet. Die Beweggründe, warum sich die TeilnehmerInnen für eine Arbeitserfahrung im Ausland entschieden, sind mehrheitlich beruflicher Natur, z.B. um Karriereaussichten zu verbessern. Internationale Arbeitserfahrung trägt auch wesentlich dazu bei, Knowing-Why, Knowing-How und Knowing-Whom zu entwickeln. Die Beweggründe haben auf die Entwicklung von Knowing-Why und Knowing-How keinen Einfluss, wenn nicht einzelne Elemente gesondert betrachtet werden, jedoch wird Knowing-Whom eher von Personen entwickelt, die aus beruflichen Beweggründen eine Arbeitserfahrung im Ausland absolvierten. ; As a result of increasing globalization new career concepts have emerged in the last couple of years, for example the concept of self-initiated expatriates which focuses on people who personally decide to work abroad. As discussed by DeFillippi und Arthur (1994) international work experience can contribute enormously to the development of an individuals career capital and can be described by an accumulation of the following competencies: knowing-why, knowing-how and knowing-whom. This master thesis consists of a theoretical and an empirical part and deals with the following questions: (1) What are the motives of self-initiated expatriates from South Eastern Europe to participate in an internship or trainee program within an Austrian bank?, (2) How can an international work experience contribute to the development of knowing-why, knowing-how and knowing-whom? and (3) Which influence do motives of self-initiated expatriates from South Eastern Europa have on the development of their career capital?The empirical study was conducted as part of a research project of the Department of Human Resource Management at the University of Graz. In this context, 17 students and young graduates who participated in a personnel development measure of an Austrian bank were interviewed. Based on theoretical categories the empirical findings were coded and analyzed with NVivo software. Most of the participants decided to go abroad for professional reasons (e.g. to improve career prospects) rather than for private reasons. International work experience has a strong impact on the development of the participants knowing-why, knowing-how and knowing-whom. However, the motives do not influence the development of knowing-why and knowing-how if specific elements are not considered separately. An der Sprache des Rechts wird Kritik geübt, seit die Aufklärung die Verständlichkeit der Gesetze zu ihrem Anliegen gemacht hat. Mit den großen Kodifikationen des Rechts im ausgehenden 19. Jahrhundert hat die Kritik am angeblich schlechten, unverständlichen Juristendeutsch eine besondere demokratietheoretische Legitimation bekommen. Diese Sprachkritik sucht seit den siebziger Jahren vermehrt bei der Linguistik Rat, wie denn eine bessere Allgemeinverständlichkeit von Rechtstexten verwirklicht werden könnte. Der Band versammelt systematisch aufeinander bezogene Beiträge ausgewiesener Linguisten, Juristen und Schriftsteller zur Problematik des Verständnisses juristischer Sprache, zur Methodik empirischer Verständlichkeitsmessung und zu den Möglichkeiten transdisziplinärer Kooperation zwischen Rechts- und Sprachwissenschaftlern.
