Стаття розглядає правосуддя перехідного періоду в контексті пошуків нових форм миротворчої діяльності. Перехідний період від конфлікту до миру потребує спеціальних заходів щодо відновлення та розвитку суспільного життя. Комплекс даних заходів у документах ООН та в наукових теоріях отримав назву «правосуддя перехідного періоду». Україна внаслідок збройного конфлікту на Донбасі та анексії Криму Російською Федерацією потребує механізмів постконфліктного врегулювання, адаптованих до національного контексту. Актуальним питанням є використання практичних та теоретичних напрацювань правосуддя перехідного періоду та визначення необхідних функцій держави в реалізації постконфліктних заходів. Серед даних ініціатив – акцент на державній політиці в регіонах, пошук шляхів допомоги слабким державам посилити власну суб'єктність і самостійно боротися з наслідками насилля. Вочевидь, різні інтерпретації минулого використовуються політиками, що є особливо характерним для розділених суспільств, де настроями окремих груп населення користуються заради отримання політичних дивідендів. З цієї точки зору завдання держави у постконфліктній відбудові – діяти автономно від короткострокових, кон'юнктурних політичних дискурсів, значна частина яких може розділити суспільство. Правосуддя перехідного періоду – сукупність процесів, пов'язаних зі спробами суспільства знайти спільну мову щодо спадщини минулих масштабних зловживань для забезпечення відповідальності, служіння справедливості та досягнення примирення. До функцій правосуддя перехідного періоду відносяться: сприяння демократизації; зменшення кількості випадків порушення прав людини; законодавче закріплення офіційних подій конфліктного минулого в офіційній версії; надання репарацій і насамперед матеріальних виплат жертвам; сприяння примиренню. Фактично правосуддя перехідного періоду не є нейтральним інструментом досягнення правди, відновлення жертв та примирення, оскільки завжди реалізується в певному політичному контексті. Крім юридичної експертизи імплементації транзитивного правосуддя, на нашу думку, має використовуватися соціально-політична експертиза. These initiatives include a focus on public policy in the regions, finding ways to help weak states strengthen their capacity and deal with the effects of violence on the society. The transition from conflict to peace requires special measures to restore and develop social life. The set of measures in UN documents and scientific theories was called "Transitional Justice". As a result of the armed conflict in the Donbas and in the annexation of the Crimea, Ukraine needs mechanisms of post-conflict settlement, adapted to the national context. A topical issue is the use of practical and theoretical developments in transitional justice and defining the necessary functions of the state in the implementation of post-conflict measures. Obviously, different interpretations of the past are used by politicians, which is especially characteristic of divided societies, where the attitudes of particular groups of the population are used for political dividends. From this perspective, the task of the state in post-conflict reconstruction is to act autonomously from short-term, conjunctural political discourses, much of which can be divided by society. Transition justice is a set of processes related to society's attempts to find common ground on the legacy of past widespread violence to ensure accountability, serve justice and achieve reconciliation. The functions of transitional justice include: promoting democratization; reducing the number of human rights abuses; legislative consolidation of official events of the conflict past in the official version; reparations and, first and foremost, material payments to victims; promoting reconciliation. In fact, transitional justice is not a neutral tool for achieving truth, recovering victims and reconciliation, as it is always implemented in a particular political context. In addition to the legal expertise of transitional justice implementation, we believe that socio-political expertise should be used. A key element of such expertise is the formulation of memory policies, in particular through the study of public opinion and the interests of various social groups in society.

Despite the relative sustainability, the concepts of justice are consistent with the principle of development and therefore they evolve together with social being and social consciousness. The era of globalization, information society and consumerism objectively and regularly make a tangible contribution to the revision of content-axiological priorities of justice. At the heart of any fairness concept or paradigm is symmetry between the actual and proper – as the actual deviates from the proper, so it is unfair and is subject to correction. When at the level of mass consciousness we see the sense of necessity, justice is reflected in the mass consciousness in the form of expectations. Social expectations define the specific historical symmetry between what is proper and valid towards the rights to freedom and equality. Justice reflects the actual status of compliance with anticipated ideas about freedom and equality of opportunities. The debates on justice are still open. Currently they are focused not only on the issue of justice itself, but also on discussing a range of related topics – political legitimacy, collective and individual responsibility, functional boundaries of state, identity problems etc. The boundaries between these paradigms frequently disappear. Therefore, we are observing attempts to build an integrative theory of justice. The conceptual basis of the theory of justice is becoming increasingly detailed, acquiring incremental properties. The concept of justice gains meaningful significance: axiological, legal, ethical and political. In addition, today the concept of justice may not be considered in essence without analyzing globalization processes. The article analyzes and compares two interpretations of the "social question" and the ways of solving it as they are offered in the works of N.A. Berdyaev and S.L. Frank. A particular attention is paid to the connection between the "social question" and the problem of "Christian socialism". While acknowledging the general importance of the social issues for the Christian mindset, both philosophers traced the origin of social injustice to the human nature rather than to the social structure. In both interpretations, in fact, the value of social justice is inferior in its hierarchal status to the value of Christian love. However, while they both rejected the socialist utopia of a "paradise on Earth" and the idea of a "Christian socialism", Berdyaev and Frank radically diverged in their interpretation and assessment of socialism as a social system. This article highlights the fact that Berdyaev combines a criticism of the ideological claims concerning atheistic and materialist socialism with an uncritical acceptance of a number of socialist ideologies (e.g. "class struggle" and "exploitation") and assumptions. Unlike Berdyaev, in interpreting the "social issue" Frank tended to distance himself from both classical liberalism (with its notions of private property, freedom, and state) and from socialism, which he considered as another ideological extremity. Frank's social philosophy treats the thesis that the socialist system is more consistent and successful than others in tackling the "social issue" as an empirically dubious assumption. On the contrary, Berdyaev took this thesis for granted and used it as the starting point of his reasoning. This divergence, along with the fact that the same key terms were often used by the two philosophers in different (ideological) meanings, partly accounts for their differences in the interpretation of the "social question" and in the assessment of socialism.

Modern democratic development of Ukraine is accompanied by the emergence of acute socio-economic challenges directly related to the quality of life of the population and the necessity for constant attention to them by the state. Under such conditions, the importance of social policy increases, and it is highly important to respond appropriately to the deterioration of people's social security. The implementation of effective social policy is complicated in the context of decentralization reform, when a significant range of powers to implement is transferred to the territories and there is an expansion of the circle of direct executors. Recent research and publications analysis. The issue of forming the effective social policy and proper social protection of vulnerable groups is considered in the works of many foreign and domestic researchers. Theoretical and methodological foundations of the humanitarian component of the social policy are revealed in the works of the classics of world sociological thought M.Weber, P. Sorokin, Y. Habermas, P. Reeker and other scientists. In the domestic science of public administration, social policy is given considerable attention; various aspects of its implementation at the central, regional and local levels are considered. Highlighting previously unsettled parts of the general problem. At the same time, it should be noted that the theoretical study of the issues of social justice and the filling of social work with humanitarian content in the current context of reforms requires much more attention. Paper main body. The article states that the peculiarity of the modern transformation of the social policy of the Ukrainian state is the transition from a paternalistic to a market model of economic and social development. This causes a number of problems and requires adherence to the democratic principles of social security, which include, in particular, the concept of humanitarianism. The latter, along with the requirement of humane treatment of the rights and freedoms of every citizen, focuses on a deeper involvement of the provisions of human science. The theoretical and methodological basis of the humanitarian direction of social policy is humanitarian knowledge and the corresponding values of civilizational development of modern society. In the specific context of the implementation of social policy in the context of decentralization, humanitarianism is revealed through such principles as anthropocentrism, polysubjectivity, justice and the paradigmatic unity of all participants in the process of social interaction. Conclusions of the research and prospects for further studies. It is stated that the humanitarian orientation of social policy in the modern conditions of public openness and decentralization reform becomes of special importance. Deepening the care for vulnerable groups of the population is carried out by introducing new technologies of accounting and verification of their status, a combination of general approaches and targeted assistance to each group. Thus, speculative concepts of humanity and tolerance are part of the direct practice of public communication and social transformation, become the content of legal and organizational support of social policy. Further scientific research in this direction is possible in particular by ensuring the unity of theoretical developments and practical steps by guaranteeing the proportional development of society on the basis of democracy and justice. Peculiarities of social policy transformation in the conditions of decentralization reform and application of modern innovative mechanisms of its realization are considered. The specifics of the organization of social security at the local level and its specific forms are revealed. The necessity for observing the humanitarian orientation of the implementation of social policy on the basis of the principles of anthropocentrism, polysubjectivity, transparency and justice is substantiated. An important condition for the implementation of this orientation should be the introduction of a model of humanitarian paradigm in the activities of all social policy actors. ; Розглянуто особливості трансформації соціальної політики в умовах реформи децентралізації та застосування сучасних інноваційних механізмів її реалізації. Розкрито специфіку організації соціального забезпечення на місцевому рівні та його конкретні форми. Обґрунтовано необхідність дотримання гуманітарної спрямованості здійснення соціальної політики на основі принципів людиноцентризму, полісуб'єктності, транспарентності та справедливості. Зазначено, що важливою умовою реалізації вказаної спрямованості має бути впровадження моделі гуманітарної парадигми в діяльність всіх суб'єктів соціальної політики.

The subject. The leading position of the personal income tax in most countries is due to a number of circumstances. First, it is a personal tax, the object of which is the income actually received by the payer, and not the estimated average income that could be received in specific economic conditions. Second, income tax allows to maximize the implementation of the basic principles of taxation - universality and uniformity. In recent decades, national regimes of personal income taxation regimes have been actively developed both in foreign countries and in Russia.Purpose of the study. The article shows the results of analysis of the framework of personal income taxation in the Russian Federation in the context of the principle of the social fairness. Dealing with selected provisions of the national legislation of European countries and Russia the article shows that elements of progressive taxation can be applied only in particular aspects. The proposals of taxation of rich taxpayers are also brought into light. Methodology. The research was carried out with the application of the formally legal interpretation of legal acts as well as the comparative analysis of Russian and European legal literature. Structural and systemic methods are also the basis of the research,The main results. After studying the European experience of personal income taxation the authors come to the conclusion that some of the ideas described can be transferred to the Russian tax legislation, but this should be done with caution. It is not necessary to introduce a progressive tax system in its pure form in the Russian Federation, but it is worth considering options for switching to a dualistic system. The authors believe that the elements of borrowing foreign experience should be aimed rather at a fair distribution of benefits, for example, through rules that fix tax benefits.Conclusions. The following proposals can be formulated to improve the legal regulation of personal income taxation in the Russian Federation: the distinction between taxation of taxpayers with ultra-high incomes and those with minimal incomes should be based not on the income criterion, but on the expenditure criterion; to establish a non-taxable minimum in the amount of the minimum wage, which will ensure tax fairness for taxpayers with lower-average incomes; to review the criteria of taxation of luxury vehicles, raising the border separating the mass and premium segments of the Russian car market by at least two times - up to 6 million rubles. The best solution would be to abolish the vehicle tax and impose an increased excise tax on fuel and lubricants for personal transport. ; Рассматривается правовое регулирование налогообложения доходов физических лиц в Российской Федерации в контексте проблем социальной справедливости. На основании сравнительного анализа опыта стран ЕС и ОЭСР делается вывод о том, что элементы заимствования зарубежного опыта должны быть нацелены скорее на справедливое распределение благ, например с помощью норм, закрепляющих налоговые льготы. Ставки налога должны быть максимально эффективными, обеспечивать принципы определенности и справедливости налогообложения. Кроме того, результаты сравнительного анализа опыта государств - членов ЕС показывают неэффективность прогрессивной шкалы подоходного налогообложения как инструмента борьбы с социальным неравенством. По итогам исследования сделан вывод о том, что за основу разграничения налогообложения налогоплательщиков со сверхвысокими доходами и с минимальными доходами необходимо взять не критерий дохода, а критерий расходов.

The article considers the principles of social security as a basis for the formation and development of social security law, which today is one of the key branches of law, as its rules are aimed at implementing one of the most important constitutional human rights - the right to social protection. However, proclaimed, but not implemented in practice, it distances the state from the directed course of democratic transformation and social welfare. For the effective and efficient realization of this right, a system of principles is established, on the basis of which social security is based. The principles of social security law are defined as basic ideas, guidelines and basic principles based on international standards in the field of social policy and enshrined in national legislation, which embody scientifically sound developments and ideologically established concepts in the field of social security and promote more effective and socially fair distribution of state funds and non-state social funds among citizens who in the manner prescribed by law acquire the right to receive social security in one or more forms. It is noted that with a significant change in social relations in the field of social security there is a need to change the content of the recognized principles of social security law. That is, the latter should be formed in stages depending on the economic situation in Ukraine. Thus, currently the main principles of social security are proposed to include: comprehensiveness (universality) of social security; equality of rights and opportunities, prohibition of discrimination; social justice; unity and differentiation in social security of the population of Ukraine; targeted and effective use of state and non-state social funds; immutability of the content and volume of social benefits and services; state guarantee of established rights in the field of social security; solidarity and subsidies in social security; transparency, timeliness and completeness of social security; ensuring a standard of living not lower than the subsistence level established by law; taking into account the requirements of international treaties of Ukraine in the field of social security. ; У статті розглянуто принципи соціального забезпечення як основу формування та розвитку галузі права соціального забезпечення, яка сьогодні є однією з ключових галузей права, оскільки її норми спрямовані на реалізацію одного з найважливіших конституційних прав людини - права на соціальний захист. Втім, проголошене, але не реалізоване на практиці, воно віддаляє державу від курсу демократичних перетворень і суспільного благополуччя. Для ефективної й дієвої реалізації цього права встановлюється система принципів, на якій ґрунтується соціальне забезпечення. Принципи права соціального забезпечення визначено як основоположні ідеї, керівні положення й основні начала, засновані на міжнародних стандартах у галузі соціальної політики та закріплені в нормах національного законодавства, які втілюють у собі науково обґрунтовані розробки та ідеологічно закріплені концепції в галузі соціального забезпечення та сприяють більш ефективному та соціально справедливому розподілу державних грошових коштів і коштів недержавних соціальних фондів між громадянами, котрі в установленому законом порядку набувають право на отримання соціального забезпечення в одній або декількох формах. Зазначено, що у разі суттєвої зміни суспільних відносин у сфері соціального забезпечення виникає потреба у зміні змісту визнаних принципів права соціального забезпечення. Тобто останні повинні формуватися поетапно залежно від економічного становища в Україні. Отже, до основних принципів соціального забезпечення запропоновано віднести: всебічність (універсальність) соціального забезпечення; рівність прав і можливостей, заборону дискримінації; соціальну справедливість; єдність і диференціацію у соціальному забезпеченні населення України; цільове й ефективне використання коштів державних і недержавних соціальних фондів; незменшуваність змісту й обсягу соціальних виплат і послуг; державну гарантованість установлених прав у сфері соціального забезпечення; солідарність і субсидування у соціальному забезпеченні; прозорість, своєчасність і повноту соціального забезпечення населення; забезпечення рівня життя, не нижчого за прожитковий мінімум, встановлений законом; урахування вимог норм міжнародних договорів України у сфері соціального забезпечення.
