The discussions at the Warsaw conference concerning socialist law had indicated to Western jurists that if the law is indissolubly linked to democracy, it can appear in various guises, & can differ in content from 1 democracy to another. If bourgeois law & socialist law have many points in common, esp in those aspects concerned with the connection of law to the rights of man & with the protection of subjective rights, there are still important diff's between the 2. The family in Sweden is profoundly affected by socialist ideas. Education is rigidly controlled by a bureaucracy that seeks to curtail family influence & to impose total equality on all children. Taxes are so high that both spouses must work; they favor unmarried individuals over families. Housing policy is more favorable to renters than to homeowners, & most housing units are small, encouraging small families. Punishment of children is legally forbidden to parents. In addition, a full employment policy seeks to include all women in the labor market on a full-time basis. The result is that children are often neglected, & have a weak value system & low level of hopes. W. H. Stoddard.

Der Autor unternimmt den Versuch, unter Anwendung des verhaltenstheoretischen Ansatzes die Problematik der Statusinkonsistenz in der sozialistischen Gesellschaft zu analysieren. Zuerst werden die allgemeinen geschichtlichen und strukturellen Entstehungsgründe untersucht. Danach folgt die Beschreibung der häufigsten Arten der Statusinkonsistenz in sozialistischen Gesellschaften, ihre Diskussion als unabhängige Variable und schließlich die Schilderung der häufigsten reaktiven Verhaltensweisen. Der Aufsatz wird mit einigen Hypothesen über mögliche Entwicklungen und makrostrukturelle Konsequenzen beendet. (HE)

Der Aufsatz charakterisiert die vier bekanntesten Ansätze zur Erklärung der Strukturmerkmale und Probleme des realen Sozialismus: die Totalitarismustheorie, die Konvergenztheorie, den westlichen Marxismus und die neoklassisch orientierte Wirtschaftstheorie. Ein wesentlicher Charakterzug der realsozialistischen Gesellschaften - die Tendenz zur Stagnation - könne von keinem der vier Ansätze adäquat erfaßt werden. Das Spezifische des realen Sozialismus sei ein bestimmtes Mißverhältnis von Problemen und Problemlösungsversuchen: die Erzeugung von "Problemkreisläufen", in denen der Versuch der Lösung von bestimmten Problemen seitens der politischen Führung eben jene Probleme produziert und reproduziert, die gelöst werden sollen. Gemeinsamer Fehler der genannten Ansätze sei es anzunehmen, jene Ideologie, die regulative Kraft für den Charakter des realen Sozialismus zugesprochen wird, ließe sich relativ umstandslos in soziale Wirklichkeit umsetzen. Zur Vermeidung dieses Fehlers führt der Autor heuristische Begriffsdifferenzierungen ein, die das Problem der strukturellen Verselbständigung nicht-intendierter Handlungsfolgen konzeptualisieren können. Der Autor konstatiert acht Problemkreisläufe, die miteinander verflochten sind, Ausgangspunkt ist dabei Selbstlegitimierung der politischen Führung mit Hilfe einer Ideologie, an der im Selbsterhaltungsinteresse festgehalten werden muß. Das Modell der verflochtenen Problemkreisläufe ließe sich nach Auffassung des Autors mathematisch formalisieren, eine ökonomische Schätzung wäre schwieriger, wegen der sich verschlechternden Datenlage. The English school of 'socialist pluralists' of the early twentieth century pictured socialism as an order in which maximum autonomy of social & economic functions coexisted with a minimum of political functions. The 'pluralist socialists' among the Czech reformers of the 1960s, by contrast, insisted that such autonomy can be realized & sustained only in conjunction with effective political modalities. The pluralization of socialist regimes entailed for them, therefore, not 'the withering away of the state,' but its invigoration as a space for contesting general ends. Such contestation was envisaged principally in terms of competition between political parties, which could give expression to ideological differentiation even within the confines of socialist belief, the implication being that agreement on fundamental societal values does not preempt diversity over political ends.
