It is argued in this article that a study on the law reform of a country is the study which related to understanding of a scientific paradigm which made up of the basic idea of a country's legal system. The main argument in this article is that the basic idea ofma legalmrefom on a legal system must be build upon the enforcement of the juridical principles found and developed in the system. This is derived from a postulate of the Dignified Justice teory perspective.In this view legal virtues underpinning a legal system are examined together as one system of principles and rules or a legal system. Philosophically, or it is a theoretical and a paradigm that law is believed as inseparable from the legal science itself. This philosophy has been developed to make a correction to the sociological jurisprudence perspective, which mainly argued that each occurence of social changes in a legal system cannot be answered by regulation alone. The sociological jurisprudence point of view argues that law is confined to the status quo of a society. Many has argued that this sociological indicative has occurred in many civil law systems, in particular Indonesia, to be used as its best prototype. In the Indonesian legal system, law is positioned as rules and regulations made by the legislative branch of the government. In this perspective laws has been excluded from humanity almost altogether. This article argues that Pancasila as the Indonesia Legal System is the way to solve this problem. Since Pancasila is used as the basis of the State and the source of all legal sources. For this reason, it is interesting to examine how the Pancasila actually became a basis of values in initiating the project of law reform in Indonesia.

Anthropological Bases for the Regulation of the Web of Data is a Dissertation on law and regulatory models on the Web of (Linked) Open Data, the Internet of Things, and Industry 4.0. These fields are converging in a new information processing environment, and society is challenged to ensure that appropriate regulatory responses can uphold the rule of law fairly and effectively in this emerging context. The challenge extends beyond merely submitting digital processes to the law. The 20th century notion of 'legal order' alone will not be suitable to produce the social order that the law should bring. The Dissertation explores the concepts of rule of law and of legal governance in digital and blockchain environments. It positions law (as meaning, as data, and as sense) and legal governance (as a formal mechanism, as political form) from an empirical perspective, i.e., as explanatory and validation concepts to support the implementation of the rule of law in the new digital environments. Abstract: Law, instead as the basis of national agrarian management, also as sources of agrarian conflict because of conflicted regulations. Many academic papers on agrarian conflicts have described the conflicts, as well as women's narrative regarding the conflicts. This article explore the theoretical discourse during agrarian conflict to analyze women's role on that case. This paper is written based on secondary data gathered from juridical normative research with analytical descriptive type. The research found that main legal theoretical discourses presented mostly in on agrarian conflicts literatures are legal positivism, politics of law, legal reality, natural law, sociological jurisprudence, legal pluralism, local wisdom, and eco-feminism. The role of women during agrarian conflicts is explained using eco-feminism theory, particularly as agent of change who actively fight for non-exploitative agrarian management based on their experience.Key words: women, agrarian conflict, eco-feminism.Intisari: Hukum, selain sebagai dasar penyelenggaraan agraria nasional juga menjadi sumber konflik agraria karena pengaturan yang tumpang tindih. The Qur'an and Hadith are the most important sources of norms for Islamic society. Hence this article tries to first refer to the scriptures. Then, empirically proves that understanding the Qur'an and Hadith to extract its essence as a moral and normative guide (as in the case of waqf) works in various methods. One of them is sociological jurisprudence. This research found that the text of the Al-Qur'an and Hadith regarding waqf has been interpreted beyond its textuality. It is because and for the sake of justice to achieve social benefits. This interpretation is validated by government decrees and is widely practiced by the Indonesian Muslim community. Thus, the text has been understood and translated more broadly. Reading text through sociological jurisprudence implies reading text in various stages: text, reader, writer (disclosure), and last but not least the social impact and its surroundings (utility). Abstrak Al-Qur'an dan Hadits adalah sumber norma yang paling penting bagi masyarakat Islam. Karenanya artikel ini mencoba terlebih dahulu merujuk pada tulisan suci. Kemudian, secara empiris membuktikan bahwa memahami Al-Qur'an dan Hadits untuk mengekstraksi esensinya sebagai pedoman moral dan normatif (seperti dalam kasus wakaf) bekerja dalam berbagai metode. Salah satunya adalah yurisprudensi sosiologis. Penelitian ini menemukan bahwa teks Al-Qur'an dan Hadits tentang wakaf telah ditafsirkan di luar tekstualitasnya. Itu karena dan demi keadilan untuk mencapai manfaat sosial. Penafsiran ini disahkan oleh keputusan pemerintah serta dipraktikkan secara luas oleh masyarakat Muslim Indonesia. Dengan demikian, teks telah dipahami dan diterjemahkan lebih luas. Membaca teks melalui yurisprudensi sosiologis menyiratkan untuk membaca teks dalam berbagai tahap: teks, pembaca, penulis (penyingkap), dan yang terakhir tetapi tidak sedikit dampak sosial dan sekitarnya (utilitas).

This process of disaggregation has proved to be a profoundly gendered phenomenon: it signified and continues to signify, to a great extent, a fragmentation of fatherhood. Vis-à-vis current family realities, this thesis attempts to establish to what extent the European Court of Human Rights deviates from or replicates the model of 'conventional fatherhood' when determining whether the refusal to grant the status of legal father or parental rights to the applicant amounts to a violation of his right to respect for family life (Article 8 ECHR), taken alone or in conjunction with Article 14 ECHR. For present purposes, 'conventional fatherhood' presupposes the coexistence of the following features within the same individual: a biological link between the father and his child, a marital relationship with the child's mother, economic provision, heterosexuality and, more generally, compliance with heteronormative standards. The jurisprudential analysis points to, at least, four main findings. Firstly, rather than abandoning a conventional understanding of fatherhood, the Court tends to simply add a new layer to it: the father's interest and commitment to the child. However, this combination of change and continuity and, more specifically, the increased importance attached to nurturing bear a partial exception: the definition of fatherhood and, more generally, of parenthood endorsed in the jurisprudence pertaining to homo-parenthood. Secondly, the reaction of the Court to the realities of fragmented fatherhood is changeable. In decisions concerning the award of parental rights, the Court overcomes the assumption of exclusivity more easily, provided that the coexistence of more than one paternal figure serves the child's best interests. Differently, when it is the full legal status of fatherhood that is under scrutiny, the Court attempts to maintain the paternal figure as compact as possible, in line with the conventional ideology of fatherhood. Thirdly, the Court has proved generally cautious to impose new legal conditions at the national level; therefore, it seems to understand the role of the Convention as being that of reflecting – more than transforming – national legal realities. At the same time, although to a limited extent, the Court has begun to adopt an anti-stereotyping approach, thus employing the Convention as a tool for asserting a new definition of fatherhood, untied from general assumptions. Fourthly, and finally, the Court tends to focus almost exclusively on the interests of the applicants, thus ignoring the implications of its own decisions on other potentially affected parties, in particular mothers. The position of children is largely disregarded and, when considered, is subject to variable interpretations. While in the domain of homo-parenthood, the child's interests are interpreted according to conventional and, therefore, subjective understandings of 'good' parenting, when dealing with the claims of unmarried fathers, the Court appears to ground its assessment on the specific circumstances of the case.

La importancia de la sociología en el estudio del Derecho constituye hoy por hoy una de las aristas más importantes para analizar el mismo. Resulta indiscutible la importancia de estudiar no sólo las normas legales sino el contexto económico y social que es regulado por el Derecho. El análisis sociológico del Derecho, en ocasiones es observado con desconfianza en las facultades de Derecho colombianas, considerándosele, quizá subversivo, por cuestionar la estructura jurídica en su esencia y por querer superar el arquetipo del operador jurídico autómata del Derecho, que valiéndose de la lógica formal aplica el derecho como instrumento de poder para mantener el orden establecido, sin indagar en los cambios sociales, económicos, políticos o en las necesidades históricas de la sociedad. Quizá también se menosprecia por tenérsele como un ejercicio académico esotérico basado en especulaciones cognoscitivas y académicas, sin asidero real. Pero la realidad mundial y la consolidación del proceso de globalización hace imperativo replantear el estudio del Derecho, pues la humanidad se encuentra en un nuevo estadio que en nada se asimila al modelo generado a partir de la revolución industrial inglesa que inundó todas las ramas del saber, incluido el Derecho, y equiparó el ejercicio del mismo a un proceso mecánico e industrial, en el cual las decisiones judiciales eran producidas por un juez máquina que manufacturaba el Derecho como un silogismo perfecto en el que se tiene por premisa mayor la ley general, como menor, la acción conforme o no con la ley, de lo cual se inferirá por consecuencia la libertad o la pena, en el marco de la lógica formal y la estrechez del análisis exegético de la norma. ; The importance of sociology in the study of Law constitutes today one of the most important to analyze it. The importance of studying not only the rules is indisputable legal but the economic and social context that is regulated by law. The sociological analysis of Law, is sometimes observed with distrust in Colombian law schools, considering him, perhaps subversive, for questioning the legal structure in its essence and for wanting overcome the archetype of the automaton legal operator of Law, which, using formal logic applies the law as an instrument of power to maintain the established order, without inquiring into the social, economic, political changes or in the historical needs of society. Maybe also despised for being regarded as an esoteric academic exercise based on speculation cognitive and academic, with no real grip. But the global reality and the consolidation of the process globalization makes it imperative to rethink the study of Law, since humanity is in a new stage that is not at all assimilated to the model generated from the English industrial revolution that flooded all branches of knowledge, including Law, and equated the exercise of it to a mechanical and industrial process, in which judicial decisions were produced by a machine judge that manufactured the Law as a perfect syllogism in which the law is the main premise general, as a minor, the action in accordance or not with the law, from which the freedom or punishment, within the framework of formal logic and the narrowness of the exegetical analysis of the norm.

This article uses the Supreme Court of Canada's decision in G.(J.) v. New Brunswick to frame a discussion of the historical and ideological character of Canadian child welfare regimes on the nature and experience of women's citizenship within the liberal political order and, in particular, within the current neo-liberal restructuring of welfare provision. The article also analyzes traditional understandings of the political character of child welfare in terms of state intervention and non-intervention, by placing the state ordering of parent-child relations in the context of larger issues of colonialism, gendered parenting discourses, and the linkage between child neglect and poverty. The article argues that this more complex account of state/family relations exposes the rhetorical slippage between a family privacy and family support interpretation of liberal respect for family autonomy in both judicial discourse and the broader political sphere.

Peneltian ini bertujuan untuk mengetahui apakah dengan dikeluarkannya Peraturan Pemerintah No. 92 Tahun 2015 tentang pelaksanaan KUHAP berkaitan dengan naiknya besaran ganti kerugian dapat dilaksanakan dengan proses mudah sesuai degan prinsip kemudahan dan keadilan. Penelitian ini berbasis pada ilmu hukum normatif (peraturan perundang-undangan), mengamati berbagai reaksi dan interaksi yang terjadi ketika sistem norma itu bekerja di dalam masyarakat .Penelitian ini dikategorikan sebagai hukum doctrinal tentang hukum in concerto dengan sumber data primer melalui teknik wawancara dengan pihak terkait yang serta data sekunder berupa teknik pengumpulan data dilakukan dengan teknik studi pustaka dengan mengkaji bahan-bahan hukum dan dianalisis dengan menggunakan logika deduksi. Berdasarkan hasil penelitian dan pembahasan diketahui bahwa proses pelaksanaan upaya ganti rugi berkaitan dengan biaya ganti kerugian belum bisa terlaksana dengan mudah karena masih harus mengacu pada keputusan Menteri Keungan No. 983/KMK.01/1983 yang memang sudah perlu direvisi karena terlalu banyak tahapan yang mengakibatkan prosesnya menjadi lama tidak sesuai dengan Peraturan Pemerintahan No. 92 Tahun 2015 yang mensyaratkan pada pasal 11 ayat 2 yang berbunyi " Pembayaran ganti kerugian dilakukan dalam jangka waktu paling lama 14 (empat belas) hari kerja terhitung sejak tanggal permohonan ganti kerugian diterima oleh menteri yang menyelenggarakan". ABSTRACT: Current publications in professional literature often discuss terrorism and extremism in the system of coordinates developed by jurisprudence where the different phenomena are eclectically combined and grouped for analytical purposes. Charles Tilly in his works insisted that the terms terror, terrorism, and terrorist do not identify causally coherent and distinct social phenomena but rather strategies that recur across a wide variety of actors and political situations. This paper tries to depict basic theoretical models and methodological framework for doing field sociological inquiry on the hottest issue in current migration studies which is how the reality of social exclusion in everyday life turns immigrants to the practices of ideological extremism. Halal certification is an obligation as protection and certainty consumer law that is regulated in Job Creation Law and PP No.39 of 2021 concerning Implementation of Halal Product Assurance. One of the provisions is about Self Declare. However, still many restaurants in Lowokwaru district, Malang City haven't been certified halal. This study aimed to know the legal understanding of restaurant entrepreneurs on halal certification and to determine the legal consequences of entrepreneurs who haven't halal certification perspective Job Creation Law and BPJPH. This research method used a juridical-empirical with a sociological-jurisprudence approach. Data collection with questionnaire and interview. The results showed that the legal understanding of restaurant entrepreneurs on halal certification was less understood. They haven't understood the provisions of Self Declare and the period of termination of halal certification. So far no one article regulated the legal consequence, but entrepreneurs who haven't been certified halal will get social consequences excluded from entrepreneurs who have been certified halal. Administrative sanctions of written reprimand in advance become a possible alternative conducted by Halal Product Assurance Agency (BPJPH).

Se trata de un análisis de la forma como se ha elaborado en nuestro país una discursividad estatal respecto a cómo el derecho influye en las relaciones sociales, específicamente en lo que se refiere a la guerra insurgente que se desarrolla en Colombia.

The pioneering African-American historian Rayford Logan called the early years of the Progressive era the "nadir" of race relations in the United States. Historians and political scientists who study the Supreme Court generally agree that Supreme Court decisions are rarely substantially out of line with the kind of sustained national consensus regarding race relations that Logan described. Professors Bernstein and Karman point to popular culture, including the roaring success of D.W. Griffith's epic Birth of a Nation attacking Reconstruction and defending the Ku Klux Klan, and elite opinion such as the flourishing of scientific racism to demonstrate that there was indeed a broad national consensus favoring policies of racial subordination. What then are we to make of Progressive era decisions like Buchanan v. Warley? Professors Bernstein and Klarman offer slightly different explanations for those decisions, and slightly different accounts of their significance. Both agree that the result in Buchanan is best explained as resulting from the Court's jurisprudential commitments. For Professor Bernstein, those commitments were to what he calls "traditional," as distinct from sociological, jurisprudence, while for Professor KIarman, the commitments were to enforcing at least, but perhaps no more than, the minimal meanings of the Constitution's language. Similarly, both authors agree that Buchanan had little impact on residential segregation, and that the NAACP's success in that case might have had some organization-building effects that contributed to the development of the NAACP's vigorous litigation campaign in succeeding decades. Professor Bernstein emphasizes the impact a ban on publicly mandated segregation would in theory have on housing prices, and is a bit more sanguine than Professor Kiarman about the possibility that a Court with a sustained commitment to "traditional" jurisprudence would have stood in the way of public policies that contributed to African-American subordination.
