The theme of the Conference is focused on the current conditions in urban centres; on the future challenges for public policies – as part of a reform of national urban planning legislation – coming from the new needs of society and placing the territory at the centre as the "object" and "subject" of planning and production of services. These themes are "vital" in areas destroyed by seismic events, for which it is necessary to find through new approaches and new rules adequate immediate and long-term responses. The contribution investigates the main technical, procedural and regulatory steps following the seismic events in Central Italy (from 2016 to date) necessary to conciliate: emergency, reconstruction, planning of eco-solidarity services. A complex process, as close as possible to territorial characteristics and requirements, which forces a reflection on future urban planning and the functions that can be carried out in it, combining planning, security, participation addressed simultaneously and interdisciplinary, with a long-term political project: the main prerequisites for the resumption of economic activity and for the reshaping of the urban and social fabric. With regard to the identification of the planning/design of sustainable interventions – in the awareness that climate is today overwhelmingly emerging among the causes of social inequalities – we refer to the international research experiences (SoURCE project-Sustainable Urban Cells) carried out at the Interdepartmental Center Territory, Building, Restoration, Environment (Citera) of Sapienza University of Rome. The aim is therefore to highlight new paradigms of reconstruction that must be declined with reference to the territory and its needs coming from below – identifying priorities and subjects also with innovative institutional methods – avoiding the unrealistic and high risk hypothesis of working by models.

Secondo l'art. 80 TFUE, la politica di asilo dell'UE è governata dal principio di solidarietà e di equa ripartizione della responsabilità tra gli Stati membri, anche sul piano finanziario. Tuttavia, le Istituzioni europee e gli Stati membri non hanno sinora fatto granché per dare attuazione a quel principio in modo da andare incontro alle richieste degli Stati più esposti ai flussi migratori. Partendo dalla struttura dell'art. 80 TFUE e della persistente "tirchia" solidarietà europea, in questo lavoro ci si ripropone di dimostrare che le iniziative passate e presenti (come le quote di ricollocazione o la recente bozza di dichiarazione comune di intenti, fatta a Malta nel settembre 2019) sono destinate al fallimento, e che il processo di modifica del sistema Dublino difficilmente può condurre a maggiore solidarietà. Allora, forse sarebbe opportuno "ripensare" l'applicazione dell'art. 80 TFUE nel senso di creare un sistema di visti umanitari e/o di introdurre un sistema di "responsabilità comuni ma differenziate" che ponga l'onere della prima accoglienza sui Paesi di frontiera esterna (come oggi) ma che, al contempo, porti a una modifica della direttiva del 2003 sullo status dei cittadini di Paesi terzi che siano soggiornanti di lungo periodo nel senso di una riduzione sostanziale (o una completa rimozione) del periodo di tempo nel quale rifugiati e beneficiari di protezione sussidiaria non possono spostarsi verso altri Stati membri per più di tre mesi. ; According to Article 80 of the TFEU, EU asylum policy shall be governed by the principle of solidarity and fair sharing of responsibility, including its financial implications, between the Member States. Nevertheless, EU Institutions and Member States have so far done very little to give substance to this principle to the benefit of those MS more exposed to migratory flows. Starting from the legal structure of Article 80 and the persistent European "scrooge-like" solidarity proofs, this paper aims at demonstrating that past and present initiatives (i.e. relocation quotas and the recent Draft Malta Joint Declaration of Intent of September 2019) are intended not to be successful and the amendment process of the so-called "Dublin System" hardly could lead to more structural solidarity. Thus, maybe it is time to rethink the implementation of Article 80, either by setting-up of a EU humanitarian visa system and/or shifting into a "Common But Differentiated Responsibilities" system, placing the burden of the first reception on the frontline MS (as it is today) but amending the 2003 Long Term Resident Directive in order to substantially reduce (or completely remove) the period of time during which refugees and beneficiaries of subsidiarity protection are not allowed to move to other MS for more than three months.

Il presente articolo intende indagare le diverse forme organizzative e i metodi di lotta del movimento femminista jugoslavo con l'obiettivo di fare luce su un aspetto poco conosciuto della vicenda balcanica e di rendere conto della storia della nascita e dello sviluppo di uno dei femminismi più peculiari sulla scena internazionale. A partire da un esame delle modalità di aggregazione e partecipazione alla vita politica delle donne nella Jugoslavia socialista degli anni Cinquanta, si procede ad un'analisi dei tratti distintivi del Neofeminizamnegli anni Sessanta e Settanta e della sua evoluzione nei decenni successivi che videro il movimento perdere i suoi caratteri teorici e intellettuali e divenire spazio di confronto e supporto per moltissime donne vittime della violenza di guerra. L'articolo si conclude con un esame delle politiche, dei progetti e delle attività di cinque organizzazioni non governative femministe oggi attive in territorio bosniaco e selezionate sulla base della loro dislocazione geografica e del tipo di attività svolta: lo studio dei tratti distintivi di ciascuna di queste organizzazioni ha permesso di individuarle come i soggetti più attivi e competenti nel panorama associativo bosniaco, capaci di apportare un contributo fondamentale ai processi di democratizzazione e riconciliazione della società tutt'oggi in corso. ; This paper attempts to explain the different organizational forms and methods of struggle of the feminist movement Yugoslavia with the aim of shedding light on a little known aspect of the Balkan events and accountingthe history of the birth and development of one of the most peculiar feminisms on the international scene. Starting from an examination of the aggregation and participation modes of women in socialist Yugoslavia, the paper proceeds with an analysis of the most important hallmarks of Neofeminizamin the Sixties and Seventies and its evolution in the following decades that saw the movement lose its intellectual characters and become a real space for comfort and support of many women victims of the violence of the war. The articles ends with an examination of the policies, projects and activities of five non-governmental feminists organizations active in the Bosnian territory and selected on the basis of their geographical location and type of activity. The study of the distinctive features of each of these organizations has enabled to identify them as the most active and competent groups in the Bosnian associations' panorama, able to give a strong and precious contribution to the democratization and reconciliation processes still in progress in post-war Bosnia and Herzegovina.

La tesi mira a dimostrare l'esistenza di un principio di solidarietà nel diritto dell'Unione europea e, in particolare, nella nuova disciplina relativa alle modalità di gestione delle crisi bancarie. La tesi si articola in quattro capitoli. Il primo capitolo ricostruisce, dal punto di vista storico-filosofico, la nascita del termine 'solidarietà'. Questa analisi si è rivelata necessaria per comprendere la matrice ideologica che ha spinto il legislatore europeo ad adottare certe scelte normative in materia di solidarietà. Il secondo capitolo è dedicato all'esame delle disposizioni che nei trattati richiamano la nozione di 'solidarietà'. Il terzo capitolo affronta il problema di come originariamente il principio di solidarietà sia stato applicato nella legislazione secondaria relativa alla gestione dei dissesti bancari. Il quarto capitolo mira invece a verificare come sia stato declinato il principio di solidarietà nella nuova disciplina (Dir. sui DGS, Dir. BRRD, Reg. sul SRM), entrata in vigore tra il 2015 e il 2016, che ha introdotto innovativi strumenti di gestione delle insolvenze bancarie. In conclusione, la tesi tenta di dimostrare come anche in questo rinnovato quadro giuridico, conformemente a quanto statuito nei trattati, il principio di solidarietà sia stato attuato entro limiti ristretti e ben definiti. Gli interventi solidali di cui sopra sembrano, infatti, attivarsi solo in presenza di gravi difficoltà, che nel settore bancario si identificano nei pericoli di instabilità finanziaria che possono derivare dalla crisi anche di un singolo intermediario; viceversa, la 'regola' continua ad essere la non-solidarietà, come confermato dall'introduzione del bail-in che impone agli azionisti e ai creditori della banca di contribuire con i propri fondi all'assorbimento delle perdite e a ricapitalizzare l'ente in misura sufficiente per ricondurlo alla sua normale viabilità. ; The thesis is intended to demonstrate the existence of a principle of solidarity in the new European legal framework, i.e. the European Banking Union, which has laid down innovative tools in order to best manage the banking crises. This work is divided into four chapters. The first chapter aims to retraces which are the various nuances that characterize the semantics of this concept; this operation served to seize the ideological matrix that has led the European legislator to adopt certain legal provisions in terms of solidarity. The second chapter is devoted to the assessment of the provisions of the Treaties which refer to the concept of solidarity. The third chapter aims to ascertain how the principle of solidarity was originally applied in the secondary legislation concerning the management of bank failures. Chapter four, finally, analyses how it is declined the principle of solidarity in new legislation (DGS Directive, BRRD Directive, SRM Regulation), which came into force between 2015 and 2016 and has introduced innovative methods to manage the resolution of a bank with a capital shortfall. In conclusion, the thesis tries to prove that also in this renewed legal framework, in accordance with the Treaties, the principle of solidarity has been implemented within narrow and well defined limits. Indeed, both in the Treaties and secondary legislations, the 'rule' continues to be the non-solidarity; by contrast, the 'exception' continues to be the solidarity as confirmed by the new tools introduced, which could be activated by the competent authority only in presence of serious difficulties in the banking sector.

The dialectic between citizens and a foreigners illuminates the profound distance which divides Public Law from the Social Doctrine of the Church. According to the first, the identity of the citizen and the identity of the community are ruled by the laws which rule the belonging. According to the second, no one is a foreigner, and the Church is not foreign to any man. In no place. Should we be content with such distinction and endure the separation of groups, peoples and nations that it implies and supposes? Or should the State and the public law gain a new perspective on the problem? Trying to provide a valid answer to this question, the Author reconstructs the category of citizenship under the sign of duty, identifying in the term "duty" the only concept which could link together freedom, dignity, equality and common good. Keeping universal and particular intertwined, we can therefore propose the definitive overcoming of the ancient dialectic between citizen and civis mundi. Because a cohesive, open and caring society is possible if only both of them know and respect their own duties. ; La dialettica tra cittadino e straniero illumina la profonda distanza che separa il Diritto Pubblico dalla Dottrina Sociale della Chiesa. Per il primo, l'identità del cittadino e l'identità del noi politico sono regolate dalle leggi che governano la distribuzione dell'appartenenza, per la seconda, invece, nessuno è straniero, e la Chiesa non è straniera a nessun uomo e in nessun luogo. Dobbiamo semplicemente accontentarci di questa distinzione, e con essa sopportare le separazioni identitarie di gruppi, di popoli e nazioni che essa implica e suppone, oppure lo Stato e il diritto pubblico possono assumere un nuovo ruolo e guadagnare un nuovo sguardo sull'altro-a/sugli-sulle altri-e? Cercando di fornire una valida risposta a questa domanda, l'Autore ricostruisce la categoria della cittadinanza sotto il segno del dovere, identificando nel termine dovere l'elemento che può unire libertà-dignità-uguaglianza e bene comune.
