Der Verfasser setzt sich mit dem Spannungsverhältnis Ethnos - Demos - Staatsbürgerschaft auseinander und untersucht die sozialen und rechtlichen Konsequenzen der Optionen bei der Bestimmung des Gegenstandes des Minderheitenrechts. Es wird argumentiert, dass in Bezug auf neue Minderheiten das Kriterium Ethnizität nicht das geeignete erscheint und nicht das geeignete sein kann, weil für diese Gruppe Ethnizität in der für kollektive Minderheitenrechte nötigen Homogenität nicht gegeben ist; daraus muss folgen, dass der Blick sich stärker auf die Subjekte richten muss. Konsequent müsste das heißen, dass zunächst jener Status verändert wird, der diese Gruppe unzulässig homogenisiert: der Status "Ausländer". Solange dieser Status aufrechterhalten bleibt, werden neue Minderheiten in vielerlei Hinsicht benachteiligt sein. Es wird dann für sie nötig sein, zur Identitätsfindung unter anderem auch das Kriterium Ethnizität zu strapazieren, weil dies zunächst eine minimale Gemeinsamkeit mit anderen herstellt - unabhängig davon, ob dies der Ursprungsidentität noch entspricht oder mittlerweile so etwas wie eine neue, neu entstandene Form darstellt. Minderheitenschutz für neue Minderheiten wird nicht nur zum rechtlichen, sondern vor allem auch zum politischen Problem. Gleichzeitig wird hervorgehoben, dass durch die Änderung des staatsbürgerschaftlichen Status allein die soziale Benachteiligung zwar gemindert, nicht aber wirklich effektiv beseitigt werden kann. Rogers Brubaker has argued that the German ethnic conception of citizenship, forged in a 1913 law, was 'nourished' after World War II, when ethnic german expellees and refugees entering the western occupation zones were given equal citizenship with those native to the west. This paper contends that the supposed straight line from 1913 to 1953 was in fact bent by the considerable events of the immediate postwar period. Postwar German citizenship laws cannot be understood without giving attention to the policies under military occupation, just as later German ethno-cultural self-identity must be qualified by first recognizing the extreme divisions within German society that resulted from the expulsion. In 2001 Hungary passed 'the Status Law', which legally recognized a Hungarian nation that extended into its neighbors. This article argues that the shap debate across Europe on the law's legitimacy and European efforts to change the law radically are a reaction to the neo-medievalist vision embedded in the law. By setting up overlapping authority over and multiple loyalty of the Hungarian communities in the neighboring states, the law violated carefully crafted and interrelated European norms on individual equality of citizens, state responsibility towards minorities, and the circumstances under which sovereignty can be violated.
