This article discusses the key issues regarding the newest concept of the legal regulation of working time through the prism of trends in the development of society, the state, and the labor market. The chief attention should be paid to the issues of the priority of requests and interests of employees, the formation of effective mechanisms of social partnership, and the trends of the international labor market. Critically comprehended is the state of legal regulation of working time. It is stressed that, from the legal point of view, the current state of the legal regulation of working time appears somewhat vulnerable, taking into account the following factors: the non-compliance with the state of labor market development; inefficiency, ineffectiveness of legal regulation; the lack of proper motivation of labor productivity, taking into account the necessity of guaranteeing the life, health, and efficiency of every worker; the lack of proper mechanisms for organizing the working time, including modern, innovative jobs; insufficiency of legal mechanisms for the use of information and other technologies of working time control; lack of quality mechanisms for the implementation of international social standards; absence of an optimal combination of the working time, rest time, and occupational safety; the lack of proper mechanisms for taking into account the needs and interests of persons with disabilities and other socially vulnerable categories of persons; the lack of effective oversight and control; the lack of jurisdictional protection, etc.The paper discusses the importance of a proper assessment of the problems of the legal regulation of working time in the present, given the importance of the integration processes of labor market development, its international vector, the introduction of the newest information and other technologies, the implementation of international (European) standards, the formation of mechanisms for the optimal combination of legislative, sub-legislative and the local regulation in this area. In addition, the issue of particular importance is raised in the context of the recent codification of labor legislation as a component of developing an effective concept of the legal regulation of working time. The modern system of principles of the legal regulation of working time is outlined. It is concluded that working time is a period during which an employee, as a rule, must be in the workplace, subject to the control of the employer and other established rules, must perform the labor function and other duties under the employment contract. The main features of the working time are as follow: regulated on the basis of international legal acts, acts of domestic national legislation, local normative legal acts; the worker is subject to established working time norms and rules; directed to the behavior of the employee and the employer under an employment contract (correlates with the system of rights, responsibilities, responsibilities of the employee and employer); payable; accompanied by a system of international standards on labor issues; accompanied by a system of social and labor guarantees; time, intended to perform labor function and other duties under an employment contract; the employee is subject to control by the employer (the authorized body or official); subject to accounting, control and supervision; subject to jurisdictional protection.It is emphasized that the principles of the legal regulation of working time are the basic principles and provisions that determine the peculiarities of the legal regulation of relations in the sphere of working time.The basic general principles of the legal regulation of working time are the following: the rule of law; humanism; social justice; priority of the maintenance of the working capacity, the health and life of workers; the priority of international (European) standards in the field of working time; the priority of the legislative regulation of relations in the field of working time.The main special principles of the legal regulation of working time are the following: inclusiveness, efficiency, and accessibility; the priority of needs and interests of employees; stimulation of labor productivity; ensuring the efficiency of work of persons with disabilities and other socially vulnerable categories of persons; the principle of social partnership; versatility, flexibility of types and working hours; implementation of international (European) standards in the field of working time; a combination of legislative, contractual, and the local legal regulation of working time; combination of working time and rest time, occupational safety; the principle of unity and differentiation of the legal regulation of working time. The article is devoted to the analysis and systematized generalization of the totality of scientific facts that objectively characterize various aspects of life and activities of the thirteenth Minister of Railways of the Russian Empire, Adolf Yakovych Hiubbenet. In preparing the work were used, historical, comparative and biographical methods which made it possible to systematize and critically evaluate the sources used, compare assessment results of A.Ya. Hiubbenet by various authors, to highlight the main thing in the current state of studying the topic and the results of other researchers, to give a description of previous works on this issue and clearly separate the issues haven't been solved yet. The sources analysis allowed giving an objective assessment of the contribution made by A.Ya. Hiubbenet into projects of nation-wide significance devoted to the subordination of the railway affairs to the state control, settlement of railway tariffs, subordination of railway tariffs to government supervision, determination of the access roads state and many others. It has been shoved that being the Minister of Railways A.Ya. Hiubbenet played an important role in the Institute of the Corps of Civil Engineers established in St. Petersburg. The paper has analyzed multi-vector activity of A.Ya. Hiubbenet as Minister of Railways of the Russian Empire. Based on assessments comparison made by various researchers as for measures adopted by A.Ya. Hiubbenet to improve the waterways of the Russian Empire, his role in solving the problem on restructuring of the Mariinska water system as a large-scale nationwide project, which provided for an immediate survey of all artificial waterways of the state with a view to resolving the issue of their future use has been shown. The paper establishes that due to A.Ya. Hiubbenet, the project quickly found support and was approved in 1890 by Emperor Alexander III, thanks to which the Special Commission was created, which in 1890-1892 researched Vyshnevolotsky, Berezinsky, Ohinsky and Dnipro-Bug water systems. This allowed us to outline a number of measures to improve radically and rapidly develop the waterways of the Russian Empire. The use of the biographical method allowed considering the personality of the thirteenth Minister of Communications of the Russian Empire Adolf Yakovych Hiubbenet as an individual, which made it possible to re-evaluate his life path. ; Статья посвящена анализу и систематизированному обобщению совокупности научных фактов, которые объективно характеризуют различные стороны жизни и деятельности тринадцатого Министра путей сообщения Российской империи Адольфа Яковлевича Гюббенета. При подготовке работы были использованы исторический, компаративный и биографический методы, которые позволили систематизировать и критически оценить использованные источники, сравнить оценку результатов деятельности А.Я. Гюббенета различными авторами, выделить главное в современном состоянии изучения темы и результатов других исследователей, дать характеристику предыдущих работ по данному вопросу и четко отделить вопросы, которые остались еще нерешенными. Анализ литературных источников позволил дать объективную оценку вклада, который сделал А.Я. Гюббенет в проекты общегосударственного значения, посвященные подчинению железнодорожного дела контролю государства, урегулированию железнодорожных тарифов, подчинению железнодорожных тарифов правительственному надзору, определению состояния подъездных путей и многих других. Показано, что как министр путей сообщения А.Я. Гюббенет играл важную роль в деятельности Института Корпуса инженеров путей сообщения, созданного в Санкт-Петербурге. Проанализирована многовекторность деятельности А.Я. Гюббенета на посту Министра путей сообщения Российской империи. На основе сравнения оценок, сделанных различными исследователями, относительно предпринятых А.Я. Гюббенетом мероприятий по улучшению водных путей сообщения Российской империи, показана его роль в решении проблемы перестройки Мариинской водной системы, как масштабного общегосударственного проекта, который предусматривал немедленное обследование всех искусственных водных путей страны с целью решения вопроса об их дальнейшем использовании. Установлено, что благодаря личному вкладу А.Я. Гюббенета, проект быстро нашел поддержку и был одобрен в 1890 году императором Александром III, благодаря чему была создана Особая комиссия, которая в 1890-1892 гг. исследовала Вышневолоцкую, Березинскую, Огинскую и Днепровско-Бугскую водные системы. Это позволило наметить ряд мер по кардинальному улучшению и быстрому развитию водных путей сообщения Российской империи. Использование биографического метода, позволило рассмотреть фигуру тринадцатого Министра путей сообщения Российской империи Адольфа Яковлевича Гюббенета как отдельную личность, что позволило по новому оценить его жизненный путь. ; Стаття присвячена аналізу та систематизованому узагальненню сукупності наукових фактів, які об'єктивно характеризують різні сторони життя та діяльності тринадцятого Міністра шляхів сполучення Російської імперії Адольфа Яковича Гюббенета. При підготовці роботи було застосовано історичний, компаративний та біографічний методи, які дозволили систематизувати та критично оцінити використані джерела, порівняти оцінку результатів діяльності А.Я. Гюббенета різними авторами, виділити головне в сучасному стані вивчення теми та результатів інших дослідників, дати характеристику попередніх робіт з даного питання та чітко відокремити питання, котрі залишилися ще нерозв'язаними. Аналіз джерел дозволив дати об'єктивну оцінку внеску, який зробив А.Я. Гюббенет у проекти загальнодержавного значення присвячені підпорядкуванню залізничної справи контролю держави, врегулюванню залізничних тарифів, підпорядкуванню залізничних тарифів урядовому нагляду, визначенню стану під'їзних колій та багатьох інших. Показано, що як Міністр шляхів сполучення А.Я. Гюббенет відігравав важливу роль у діяльності Інституту Корпусу інженерів шляхів сполучення, створеного у Санкт-Петербурзі. Проаналізована багатовекторність діяльності А.Я. Гюббенета на посту Міністра шляхів сполучення Російської імперії. На основі порівняння оцінок, зроблених різними дослідниками, щодо прийнятих А.Я. Гюббенетом заходів стосовно покращення водних шляхів сполучення Російської імперії, показана його роль у вирішенні проблеми перебудови Маріїнської водної системи, як масштабного загальнодержавного проекту, що передбачав негайне обстеження усіх штучних водних шляхів держави з метою вирішення питання про їх подальше використання. Встановлено, що завдяки особистому внеску А.Я. Гюббенета, проект швидко знайшов підтримку та був схваленим у 1890 р. імператором Олександром ІІІ, завдяки чому була створена Особлива комісія, яка у 1890-1892 рр. досліджувала Вишнєволоцьку, Березінську, Огінську і Дніпровсько-Бузьку водні системи. Це дозволило накреслити низку заходів щодо кардинального покращення та швидкого розвитку водних шляхів сполучення Російської імперії. Використання біографічного методу дозволило розглянути постать тринадцятого Міністра шляхів сполучення Російської імперії Адольфа Яковича Гюббенета як окремої особистості, що дало змогу по новому оцінити його життєвий шлях.
У статті розглянуто процес еволюції нотаріальної справи в Україні в період другої половини ХVIII–ХІХст. Досліджено законодавчу базу, яка була основою в діяльності нотаріусів в окреслений період часу. Проаналізовано внесок купців у розвиток інституту нотаріату як складової, а потім відокремленої частини від судової системи імперії. Саме цей стан був провідний на посаді нотаріусів у другій половині XVIII ст.–ХІХ ст. Нотаріуси готували та засвідчували різноманітні юридичні акти, надаючи їм значення публічних актів, займалися видачею різного роду свідчень, складанням описів майна, здійсненням публічних продаж. Діяльність нотаріату в кожному регіоні контролював губернський суд, який перевіряв кваліфікацію «претендента», призначав особу на посаду нотаріуса, перевіряв його роботу. У повітах при вакантній посаді нотаріуса його функції виконував мировий суддя. «Положення про нотаріальну частину» від 14квітня 1866р. визначало права й обов'язки нотаріуса. Досліджено, що завідування нотаріальною частиною під наглядом судових місць надавалося нотаріусам та старшим нотаріусам, які знаходилися при нотаріальних архівах. У містах та селищах, де нотаріуси були відсутні, засвідчення явки актів надавалося мировим суддям. Нотаріуси призначалися та звільнялися старшим головою судової палати. Звільнення не могло відбутися без судового процесу. Нотаріуси вважалися на державній службі з присвоєнням восьмого класу, але при цьому право на чини або пенсію за цим званням не мали. Зазначено, що нотаріуси, призначені урядом, мали право користуватися тими ж правами, що й помічники секретарів окружного суду. Підкреслено, що свої функції виконували лише в межах округу, за яким окружний суд був закріплений. В інших регіонах здійснений ними акт не мав юридичної сили. По всіх актах нотаріуси несли таємницю зберігання та нерозголошення, окрім винятків, указаних державою. Нотаріуси були зобов'язані вести реєстр, де зазначалась інформація про всі здійснювані ними акти, протести та засвідчення, а також позикові зобов'язання та договори. Вони мали здійснювати різні акти за вимогою населення: видавати виписки з актових книг та копії актів, приймати на зберігання від приватних осіб різні документи. Старший нотаріус мав ті ж права, що й члени окружних судів. Старші нотаріуси мали право засвідчення актів про перехід нерухомого майна, затверджувати акти та вносити в реєстр кріпосних справ відмітки про обмеження права власності на нерухоме майно. ; The article considers the process of evolution of notarial work in Ukraine during the second half of the XVIII–XIX centuries. The legal framework, which was the basis for the activities of notaries in the specified period of time, is studied. The contribution of merchants to the development of the institution of notary as a component and then a separate part of the judicial system of the empire is analyzed. This state was leading in the position of notaries in the second half of the XVIII–XIXcenturies. Notaries prepared and certified various legal acts, giving them the meaning of public acts, engaged in the issuance of various types of evidence, compiling descriptions of property, public sales. The activities of the notary in each region were controlled by the provincial court, which checked the qualifications of the «applicant», appointed a person to the position of notary, checked his work. In the counties with the vacant position of notary, his functions were performed by a justice of the peace. The Regulations on the Notarial Part» of April 14, 1866 defined the rights and duties of a notary. It is investigated that the management of the notarial part under the supervision of judicial places was given to notaries and senior notaries who were at the notarial archives. In cities and towns where notaries were absent, attendance certificates were provided to justices of the peace. Notaries were appointed and dismissed by the senior chairman of the court chamber. The dismissal could not have taken place without a trial. Notaries were considered in the civil service with the assignment of the eighth grade, but they were not entitled to ranks or a pension for this title. It is noted that notaries appointed by the government had the right to enjoy the same rights as assistant secretaries of the district court. It was emphasized that they performed their functions only within the district to which the district court was assigned. In other regions, the act they carried out had no legal force. In all acts, notaries carried the secret of storage and non-disclosure, except for exceptions specified by the state. Notaries were required to keep a register of all acts, protests and certifications, as well as loan commitments and agreements. They had to carry out various acts at the request of the population: to issue extracts from act books and copies of acts, to accept for storage from individuals various documents. The senior notary had the same rights as members of the district courts. Senior notaries had the right to certify acts on the transfer of real estate, to approve acts and to make notes in the register of serfdom on the restriction of ownership of real estate.
The article examines the norm of the draft Labor Code of Ukraine of 2019, which enshrines the principles of labor law. In particular, it is emphasized that among legal norms, the norms-principles are of particular importance. It is they who enshrine the constituent provisions in their content, which further determine the basis of the activities of the state, its bodies and other entities.Legal norms can be interpreted literally, ie a legal norm in its understanding completely coincides with a certain normative-legal provision, its textual expression. Instead, sometimes the content of a particular norm after its interpretation may be broader than its literal consolidation (broad interpretation). Conversely, when the content of the norm itself is understood more narrowly than the text enshrined in the normative legal act, we are dealing with a restrictive interpretation.Among the norms-principles proposed to be enshrined in the Draft LC, we can find different types of interpretation, which in turn affects the application of such constituent norms in different ways. One of these is the freedom of labor, which includes the right to work, which everyone freely chooses or freely agrees to. It turns out that in the project it is expedient to enshrine the freedom to conclude an employment contract.Closely related to the principle of freedom of labor is the principle of prohibition of forced labor, which in the draft, in turn, is proposed to be enshrined alongside the prohibition of child labor. It is impractical to do so. It would also be better to differentiate the principle of prohibition of discrimination in labor relations (as the scope of labor itself is a too broad concept that goes beyond the scope of the LC) as well as the principle of protection of rights and interests in court in case of violation of labor rights and the compensation for damage.A clear formulation of the principle of equality for labor law is currently extremely important. Even greater importance to this principle is given by its enshrinement in the norm of the codified act, namely the Labor Code. At the same time, it is necessary to take into account the dynamics of global changes that affect the political and economic course of countries, including Ukraine. This is primarily reflected in the adaptation of legislation to the ability to perform remote work, which is currently associated with the covid-19 pandemic. Equal access to the possibility of performing a labor function remotely should be granted to all employees, whose labor is permissible under such conditions.It is emphasized that the principle of ensuring decent labor includes the establishment of fair wages, safety at work, social protection of employees, as well as the opportunity to freely express their interests, including collective organization and participation in decision-making through the institution of social dialogue. And the principle of ensuring the protection of employees from unlawful dismissal includes the principle of protection against unjustified dismissal, as such a dismissal is also illegal. The principle of supervision and control over the observance of labor legislation is of paramount importance, as well. ; Досліджено норму проекту Трудового кодексу України 2019 р., яка закріплює принципи трудового права. Зокрема наголошено на тому, що серед норм права особливе значення займають норми-принципи, оскільки саме вони закріплюють установчі за своїм змістом положення, які визначають у подальшому основи діяльності держави, її органів та інших суб'єктів. Вперше запропоновано у трудовому законодавстві закріпити принципи трудового права у змісті проекту Трудового кодексу.Зважаючи на те, що норми-принципи повною мірою мають відображати та закріплювати принципи права, а також слугувати орієнтиром для їхнього тлумачення, запропоновано закріпити такі норми-принципи: заборону дискримінації у трудових відносинах та забезпечення працівникам, які зазнали такої дискримінації захисту у встановленому законом порядку; захисту прав та інтересів працівників у суді у разі порушення трудових прав та відшкодування заподіяної шкоди; рівність прав і свобод працівників, у тому числі забезпечення диференціації щодо умов праці; принцип забезпечення права кожного працівника на гідні умови праці; принцип забезпечення захисту працівників від незаконного звільнення; здійснення нагляду і контролю за дотриманням трудового законодавства.
One of the three main components of the Ukrainian paradigm of accounting and control, along with methodological and linguistic, is the legal framework, which determines the possibilities of preserving cultural heritage in Ukraine. A characteristic feature of the regulatory component is its legislative consolidation at the state level. At the same time, the conditions of its formation in the historical dimension should be taken into account. The regulatory component is formed under the influence of world accounting practice, and, above all, under the influence and relationship with neighboring countries, which deserves the attention of scientists. This is especially true for the preservation of cultural and historical heritage, which has not only national but also international significance due to the multicultural population of Ukraine. Since the legal provision of accounting and control significantly affects the basis of perception of cultural heritage sites, the effective legal field depends on their preservation and constant monitoring of the condition of these objects, which may be lost forever. The complexity of the situation with regulatory and legal problems of accounting and control in the preservation of cultural heritage arise due to lack of attention of scientists to theoretical and methodological research among representatives of accounting and analytical sciences, which leads to legal conflicts.An analysis of accounting and analytical aspects of cultural and historical heritage in the legal field of Ukraine. It is established that the main regulatory problem of accounting and control in Ukraine is the lack of methodological developments aimed at standardized perception of cultural heritage sites. The analysis of the main criteria of perception in the accounting of such objects of cultural heritage as intangible cultural values, revealed the lack of scientifically sound classification of its species, which complicates the application of standard accounting methods. In this regard, there is a need for scientifically sound elaboration of issues related to the creation of a standard classification of cultural heritage sites in the context of the main national and historical priorities of Ukraine. It is also established that changes in the normative and legal nature of the accounting and control of cultural and historical heritage will promote the objective perception of both tangible and intangible objects in order to exercise constant supervision over them.It is proved that the solution of normative-legal problems of accounting and control presupposes first of all development of objective-essential classification of objects of cultural heritage, and also creation of a technique of reliable estimation of their real value. The assessment of cultural and historical heritage sites of Ukraine should take into account the prospects of both national and world cultural and historical progress in the use and promotion of valuable monuments. У дослідженні використано методи діалектики під час аналізу нормативно-правового поля, зокрема, проведено аналіз обліково-аналітичних проблем культурної спадщини у правовому полі України. Встановлено, що основною нормативно-правовою проблемою обліку і контролю в Україні є недостатність методичних розробок спрямованих на стандартне сприйняття об'єктів культурної спадщини. Методи аналізу і синтезу основних критеріїв сприйняття в обліку об'єктів нематеріальної культурної спадщини показали відсутність науково обґрунтованої класифікації нематеріальних культурних цінностей, що ускладнює їх облік і контроль. Встановлено, що зміни нормативно-правового характеру сприятимуть об'єктивному сприйняттю культурної спадщини з метою її збереження.Сформульовано висновок, що вирішення нормативно-правових проблем обліку і контролю об'єктів культурної спадщини передбачає розробку обґрунтованої класифікації і методики оцінювання їх реальної вартості. Оцінка об'єктів культурно-історичної спадщини України має враховувати перспективи національного і світового поступу з використанням можливостей транскордонного співробітництва із сусідніми країнами. The article considers the legal grounds and procedure for removal from office in criminal proceedings, analyzes the range of procedural problems that arise in the implementation of the investigated measure. As a result, it was established that removal from office in criminal proceedings belongs to the measures to ensure criminal proceedings. Important aspects that require consideration are the grounds for dismissal, as well as the appropriate procedural procedure for the implementation of the measure under investigation. The study reveals the need for further study and detailed legal regulation of such a measure of criminal proceedings as removal from office, given the underdevelopment of its effectiveness and significance by the pre-trial investigation authorities. The main task of the current CPC of Ukraine is to respect and protect the rights and legitimate interests of persons involved in criminal proceedings, to ensure the legality and reasonableness of restrictions on constitutional human rights and freedoms at the pre-trial stages of criminal proceedings. Measures to ensure criminal proceedings are directly related to the restriction of human rights. This institute is given considerable attention both at the legislative level - within the CPC of Ukraine provides for a separate year II, and in the practical implementation of its provisions - the implementation of specific criminal proceedings. Modern criminal procedural legislation of Ukraine, enshrining a new system of coercive measures, proposed a humanistic approach to the restriction of labor rights of the individual and established preliminary judicial supervision over the legality and justification of temporary removal from office of a suspect or accused. In the system of measures of criminal procedural coercion, removal from office occupies a special place due to the high probability of creating social difficulties for a suspect or accused person who loses his job, position and position in society, receiving a statutory level of material support from the state. Therefore, there are problems of unclear legal regulation of removal from office, the practice of applying this measure to ensure criminal proceedings has not been properly formed, which has led to a decrease in the number of satisfied requests of the prosecution. Встановлено, що сучасне кримінально-процесуальне законодавство України, закріпивши нову систему примусових заходів, запропонувало гуманістичний підхід до обмеження трудових прав особи та встановило попередній судовий нагляд за законністю та обґрунтуванням тимчасового усунення від посади підозрюваного чи обвинуваченого. Відсторонення від посади займає особливе місце у системі заходів кримінально-процесуального примусу через високу ймовірність створення соціальних труднощів підозрюваному чи обвинуваченому, який втрачає роботу, становище в суспільстві, отримуючи встановлений законодавством рівень матеріального забезпечення від держави. У дослідженні розв'язано проблему незрозумілого правового регулювання відсторонення від посади та практики застосування цього заходу для забезпечення кримінального провадження. Так як кримінально-процесуальна норма не була сформована належним чином, що призвело до зменшення кількості задоволених клопотань сторони обвинувачення. Аргументовано такі проблеми: по-перше, відсутність обґрунтування необхідності обмеження трудових прав громадян, по-друге, зростаюча роль правових гарантій захисту прав громадян у обмеженні їх конституційних прав, і по-третє, відсутність чіткий перелік підстав для звільнення, що є змістом цього заходу забезпечення кримінального провадження та правове регулювання правових наслідків відсторонення від посади.
IntroductionGeneral practitioners should have a good knowledge and skills on rendering urgent medical aid at accidents and acute diseases. The general percent of lethality depends on quality and timeliness of emergency medical aid. The medical practice now requires the preparation of a general practitioner, which is able at modern scientific and technical level to decide the questions of specific help to the victim.The aim of research: to offer some additions to the main program, which could help to improve the quality of training of general practitioners on providing the urgent medical aid in extreme conditions.On the cycles of traumatology and military-field surgery the main part of the educational process, according to our experience, are the aspects of clinical diagnosis and differentiation signs of the acute conditions. Today it is necessary to create programs, oriented on providing of high-professional level and high-quality preparation of graduating students to work in extreme conditions. The trainings must have a practical orientation, consideration of variants of medical sorting, order of doctor's work in extreme situations, when the volume of diagnostic and medical measures is sharply limited. The issues of medical sorting of pathology must necessarily represent on the lecture courses of traumatology and military-field surgery, as well as during the analysis of duty doctors at the morning conferences. On practical trainings a considerable place should be given to discussion the questions of succession in treatment of victims on the stages of medical evacuation. In our opinion, the best form of acquisition of practical skills is the independent work with urgent patients under the supervision of the teacher, duty in receiving-diagnostic, traumatology and other surgical separations, and also reanimation hall during production practice. The control form of the level of knowledge and skills is a three-stage mixed control: the I stage is examination of a specific patient (victim) and diagnosis; the II stage is an assessment of the practical skills on performance of diagnostic and medical manipulations, work as assistant at the operations; the III stage is assessment of theoretical knowledge by the test control, situational tasks and interview. The program of preparation on rendering medical aid in extreme conditions includes three levels of mastering of knowledge and practical skills: the I level is a professional orientation on the situation task; the II level is a student can use the knowledge and mastered skills under control of specialist; the III level is a student independently uses knowledge and practical skills in professional activity. A final form of control of knowledge is module control on a traumatology and military field surgery, that must be plugged in state examinations, which includes test control, check of practical skills and interview.Conclusions: In our view, the offered additions to the main program, three levels mastering of knowledge and practical skills on providing of the urgent medical aid, will help to improve quality of preparation of the doctors to work in extreme conditions, when the volume of diagnostic and medical measures is considerably limited. ; Врачи семейной медицины и общего профиля должны хорошо владеть навыками оказания экстренной медицинской помощи при травмах и острых заболеваниях. По мнению автора, основную часть учебного процесса в клинике должны занимать вопросы клинической диагностики на циклах травматологии и военно-полевой хирургии, особенно в условиях, когда объем диагностических и лечебных мероприятий резко ограничен. На практических занятиях при прохождении производственной практики особое внимание необходимо уделять приобретению и закреплению навыков медицинской сортировки и методов оказания неотложной медицинской помощи на этапах эвакуации. Преподаватель подчеркивает четкую зависимость между шансом на выживание и временем оказания экстренной помощи. При подготовке врачей общей практики предлагаем оптимизировать методологию занятий и стандартизировать схемы оказания неотложной медицинской помощи на этапах эвакуации. ; Лікарі сімейної медицини та загального профілю повинні добре володіти навичками екстремальної медичної допомоги під час травм і гострих захворювань. На думку автора, основну частину навчального процесу у клініці мають становити питання клінічної діагностики на циклах травматології і військово-польової хірургії, особливо в умовах, коли обсяг діагностичних і лікувальних заходів різко обмежений. На практичних заняттях протягом виробничої практики особливу увагу необхідно звертати на напрацювання та закріплення навичок із медичного сортування та методи надання невідкладної медичної допомоги на етапах евакуації. Викладач відзначає чітку залежність між шансом на виживання та часом надання екстреної допомоги. Викладаючи курс для студентів, майбутніх лікарів загальної практики, пропонуємо оптимізувати методологію занять і стандартизувати схеми надання невідкладної медичної допомоги на етапах евакуації.
У статті розглядається процес інституалізації політичної складової внутрішньоцерковної кризи в Харківській єпархії Українського Екзархату (УЕ) Російської Православної Церкви (РПЦ) у 30-х роках ХХ ст. Автор виділив головні сфери діяльності Православної Церкви, які традиційно склалися протягом багатьох століть її присутності в українських землях. Досліджено, які з них Церква втратила в результаті антирелігійної політики комуністичної влади. Це, на думку автора, й спричинило глибокі кризові явища в українському православ'ї. Зазначено, що у 30-х роках ХХ ст. в українських землях політикою більшовиків було започатковано докорінні зміни у всіх сферах життя. В релігійному середовищі особливої гостроти набула антирелігійна політика комуністичної влади. Антирелігійна політика в радянській Україні 30-х років ХХ ст. провокувала появу численних конфліктів на релігійному ґрунті. Автор статті стверджує, що органи радянської влади свідомо йшли на загострення конфліктів з церковно-релігійним середовищем, нівелюючи і придушуючи невдоволення православних вірян антирелігійними заходами за допомогою потужного і безпощадного апарату насильства тоталітарної держави. Проаналізувавши суспільно-політичну ситуацію в УРСР, автор дійшов висновку, що коріння появи і розвитку кризових явищ в середині Українського Екзархату РПЦ знаходилось у позбавленні Церкви впливу на культурно-ідеологічну, соціально-економічну, публічно-правову й політичну сфери діяльності. УЕ постійно зазнавав руйнів них впливів і неприхованого тиску з боку політичних і каральних органів комуністичної влади. До війни проти Церкви долучились партійні, профспілкові, а також молодіжні організації. Радянська влада прийняла низку законів, якими юридично закріплювала за собою право проводити антирелігійну політику. Проілюстровано, що у цей період під постійним спостереженням і тиском перебували не тільки священнослужителі УЕ РПЦ, а й віруючі громадяни республіки. Залучивши численні архівні документи, автор статті показав, що у 30-х роках ХХ ст. одним з основних елементів цілеспрямованої політики репресій по відношенню до Церкви було закриття православних храмів, каплиць, церковних недільних шкіл, храмових бібліотек тощо. З метою демонстрації фальшивого народовладдя сталінський режим змушував збирати підписи так званих небайдужих громадян, які виступали за закриття православних храмів на Харківщині. Чимало першоієрархів Харківської єпархії УЕ РПЦ, священно-служителів, парафіян було репресовано і загинули у сталінських катівнях. Антирелігійна політика радянської влади 30-х років ХХ ст. в УРСР, масові репресії зруйнували Харківську єпархію УЕ РПЦ.Ключові слова: церква, храми, Харківська єпархія, радянська влада, держава, репресії, криза. The article deals with the process of institutionalization of the political component of the internal church crisis in the Kharkiv diocese of the Ukrainian Exarchate (UE) of the Russian Orthodox Church (ROC) in the 1930's. The main purpose of the article is to analyze the emergence and development of the crisis in the Ukrainian Exarchate of the Russian Orthodox Church in the 1930's. The author highlights the main areas of activity of the Orthodox Church which have traditionally developed over many centuries of its presence in the Ukrainian lands and which of them were lost by the Church as a result of the anti-religious policy of the communist government. This fact, according to the author, led to deep crisis phenomena in Ukrainian Orthodoxy. It is noted that in the 1930's the Bolsheviks' policy initiated fundamental changes in all spheres of life in the Ukrainian lands. The power of Soviet Ukraine began an ideological war against the Orthodox Church. In the religious environment, the anti-religious policy of the communist government acquired particular urgency. The anti-religious policy in the Soviet Ukraine in the 1930's provoked the emergence of numerous conflicts on religious grounds. The author argues that the Soviet authorities deliberately pursued a policy of exacerbating the conflicts with the church-religious environment, leveling and suppressing the dissatisfaction of Orthodox believers with anti-religious measures through the powerful and ruthless apparatus of violence of a totalitarian state. Having analyzed the socio-political situation in the Ukrainian SSR, the author came to the conclusion that the roots of the emergence and development of crisis phenomena in the Ukrainian Exarchate of the ROC were in depriving the Church of influence on the cultural-ideological, socio-economic, public-law and political sphere of activity. The UE constantly experienced destructive influences and undisguised pressure from political and punitive bodies of the communist government. Party, trade union, and youth organizations joined the war against the Church. The Soviet government adopted a number of laws that legally enshrined the right to pursue an anti-religious policy. It has been illustrated that during this period, not only the clerics of the UE of the Russian Orthodox Church, but also religious citizens of the republic, were under constant supervision and pressure. Having studied numerous archival documents, the author showed that in the 1930's one of the main elements of a targeted repression policy towards the Church was the closure of Orthodox churches, chapels, church Sunday schools, temple libraries, and the like. In order to demonstrate false democracy, the Stalinist regime compelled to collect the signatures of so-called non-indifferent citizens, who advocated the closure of Orthodox churches in the Kharkiv Region. Many of the First Hierarchs of the Kharkiv Diocese of the UE of the Russian Orthodox Church, clergymen, and parishioners were repressed and killed in the Stalinist torture chambers. The anti-religious policy of the Soviet government in the 1930's in the USSR and mass repressions destroyed the Kharkiv Diocese of the UE of the Russian Orthodox Church. The author concludes that the mass repressions of the Orthodox Church in Kharkiv was a logical implementation of the Bolshevik policy in the religious sphere. According to its results, the organizational structure of not only the Kharkiv diocese, but the entire Orthodox Church in Ukraine was destroyed. The party and penal organs of the USSR actively engaged in the physical destruction of the confessors of the Orthodox faith.Key words: church, Kharkiv Diocese, Soviet government, state, repressions, crisis.
The scientific publication is devoted to the history of the formation and development of administrative and legal foundations of the organization and activities of the prosecutor's office at the regional level. It is noted that the study of the history of formation and development of administrative and legal principles of organization and activity of the prosecutor's office is a necessary condition for effective cognitive and creative processes in order to formulate historical tests to improve existing and future legislation. In the context of decentralization of public administration, the study of the history of administrative and legal support of the prosecutor's office at the regional level becomes especially relevant. In the history of the formation and development of the Prosecutor's Office of Ukraine, it is expedient to distinguish five main periods: the first, related to the appearance on Ukrainian lands of the first officials who served as prosecutors in Greek settlements in southern Ukraine, Scythian city-states; the second, related to the introduction and subsequent elimination of the function of supervision of the prosecutor's office in the Ukrainian lands as part of Russia in the XVIII-XIX centuries; the third, related to the formation of the UPR and the formation of prosecutors in the courts (the French model of organization and operation of prosecutors); the fourth period - the Soviet (the Prosecutor's Office of the Ukrainian SSR was actually in the status of a regional prosecutor's office); the fifth period, related to the emergence and development of the prosecutor's office of independent Ukraine, the abolition of the oversight function and further reform of the prosecutor's office (including the regional level). It is concluded that given the federal system of many foreign countries, the prosecutor's office at the regional level was formed in different historical periods with different functions and organization of their activities, but there are general trends in their formation and development, the emergence of functions inherent in modern bodies. Administrative and legal support for the organization and activities of the prosecutor's office in different historical epochs was provided by the judiciary, the judiciary and directly by the leadership of the prosecutor's office. There is a tendency to centralize and strengthen the role of legislative support for the organization and activities of the prosecutor's office as a whole and at the regional level, given the important role played by the prosecutor's office in the criminal justice system. Given the above analyzed positive historical experience of administrative and legal support of the organization and activities of prosecutors at the central and regional levels, a promising area for improving existing national legislation is to amend the Constitution of Ukraine, Laws of Ukraine «On Judiciary and Judge Status» and «On Prosecutor's Office» French model of the unity of the judiciary. Ураховуючи проаналізований вище позитивний історичний досвід адміністративно-правового забезпечення організації та діяльності органів прокуратури на центральному та регіональному рівнях, перспективним напрямом удосконалення чинного національного законодавства є внесення змін до Конституції України, Законів України «Про судоустрій і статус судді» та «Про прокуратуру» щодо впровадження французької моделі єдності судового корпусу. Перспективність подальшого дослідження даної тематики зумовлена необхідністю детального досвіду історії становлення та розвитку адміністративно-правового забезпечення організації та діяльності органів прокуратури на регіональному рівні у провідних зарубіжних державах із метою запозичення найкращого позитивного досвіду та визначення можливості та доцільності його впровадження в національне законодавство та юридичну практику у сфері правового регулювання прокурорської діяльності на регіональному рівні.

The political dialogue between Ukraine and the EU takes place within the framework of the Ukraine-EU summits, Association Council, Association Committee, Parliamentary Committee of the Association and the EU-Ukraine Civil Society Platform.At the summits, the political dialogue is conducted at the highest level between the parties. During the summits, the general supervision over the implementation of the Agreement, discussion of any bilateral or international issues of mutual interest is carried out.The Association Council monitors and controls the implementation of the Agreement, and periodically reviews the functioning of the Agreement in the context of its goals. It addresses issues that arise under this Association. The Association Council holds ministerial-level meetings.The Association Committee assists the Association Council in carrying out its duties. On the Ukrainian side, members of the Association Committee are deputy ministries for European integration issues, Deputy Minister of Economic Development and Trade – Trade Representative of Ukraine, deputy heads of other central executive bodies, whose powers include the implementation of the Agreement. The competence of the Committee is to prepare meetings of the Association Council. In addition, the Council may delegate any of its powers to the Association Committee, including the power to take binding decisions for the Parties. The Association Committee prepares its decisions with the consent of the Parties. The Association Committee holds special meetings to solve all the questions to ensure the functioning of a comprehensive and deep free trade area between Ukraine and the EU.The Parliamentary Committee of the Association is a forum for conducting meetings and exchanging views between members of the Verkhovna Rada of Ukraine and the European Parliament. It includes deputies of the Verkhovna Rada of Ukraine and the European Parliament. This body has the right to ask the Association Council to provide information on the implementation of the Association Agreement and to give it own recommendations, as well as to create appropriate subcommittees.The Civil Society Platform is a joint civil society body composed of representatives of trade unions, employers' organizations, civil society organizations of Ukraine and representatives of the European Economic and Social Committee. The Civil Society Platform may make recommendations to the Association Council, and should be informed about the decisions and recommendations of the Association Council.Conclusions of the research and prospects for further studies. The political dialogue within the framework of the Association Agreement allows the leaders of Ukraine and the EU to agree and coordinate approaches to strengthen the political association and economic integration of Kiev and Brussels, to jointly respond to strategic challenges in conditions of dynamic changes at the global and regional levels. The results of the political dialogue were the ratification and entry into force of the Association Agreement, the EU diplomatic support against the aggression of Russia, the free trade zone between Ukraine and the EU, the free-trade area between Ukraine and the EU, a visa-free regime, and important steps to overcome Ukraine's energy dependence on the Russian Federation. As a result of the implementation of the Association Agreement, over the last 4 years Ukraine implemented more reforms than for the previous 20 ones.Corruption, the dominance of the oligarchy in Ukraine, ineffective reforms and cosmetic changes in the Ukrainian state, Russian aggression, the lack of a firm EU position on the European perspective of Ukraine and sanctions against Russia, refusal to provide Ukraine with military and financial assistance, ignorance of the situation of Ukraine, which leads the "hybrid war" with Russia, disappointment of the people caused by the significant drop in their standard of living after the Revolution of Dignity, as well as the war fatigue are the problems which may become an obstacle to the realization of the political association between Ukraine and the EU.

The article determines the changes having taken place in institutional design and identifies trends in the recovery of the financial services market as a complex systemic phenomenon. The essence of current tendencies on the market of financial services of Ukraine as well of those in the period of crisis is revealed. Their influence on the financial system of our country is also determined. The research conducted showed that the vast majority of subjects of the Ukrainian financial services market have experienced a significant decrease. This is especially true of banks and credit unions, though the number of financial companies is growing. The growth in the number and amount of the activities of financial companies suggests that the microcredit sector is also growing. Slowing down real salary increases indicates a loss of public confidence in banks and in the future may lead to a decline in effective demand of the population. This has led to the conclusion that the credit market of Ukraine is becoming non-institutionalized. These processes have led to a concentration of capital in the credit segment of the financial services market. The decline in the number of financial institutions is not critical to the market while the growing number of non-bank financial intermediaries is considered to be a negative trend. The deep socio-political crisis has caused capital outflows from the Ukrainian stock market and the reduction in the volume of contracts at the domestic stock exchanges. This is clearly a negative trend, since the decrease in the volume of contracts on the stock market is one of the factors that affect the investment climate and reflect investors' interest in buying securities of domestic companies. State regulation of the financial services market needs to be reformed in two stages: the first is to reduce the number of regulators to two and move to a task-based patter with the division into licensing activities and macro-prudential supervision; the second is thetransition to a single regulator. This is in line with current global trends and will make government regulation of the financial services market comprehensive and systematic in order to avoiding hyper-regulation and lack of regulatory influence in certain market segments ; В статье установлены изменения, произошедшие в институциональном дизайне, и определены тенденции восстановления рынка финансовых услуг как комплексного системного явления. Раскрыта сущность текущих тенденций, происходящих на рынке финансовых услуг Украины в течение периода кризиса и на текущий момент, определено их влияние на финансовую систему нашей страны. Проведенные в статье исследования позволили установить, что подавляющее большинство субъектов рынка финансовых услуг Украины претерпели значительное сокращение. Это особенно касается банков и кредитных союзов, однако количество финансовых компаний возрастает. Рост количества и объемов деятельности финансовых компаний дают возможность утверждать о росте объемов микрокредитования. В условиях торможения темпов роста реальной заработной платы это является свидетельством утраты доверия населения к банкам и в будущем может вызвать спад платежеспособного спроса населения. Это стало основанием для вывода о том, что кредитный рынок Украины приобретает неинституционализированный характер. Указанные процессы привели к концентрации капиталов на кредитном сегменте рынка финансовых услуг. Уменьшение количества финансовых учреждений не является критичным для рынка. Отрицательным является распространение неинституционализированных финансовых посредников. Глубокий общественно-политический кризис вызвал отток капитала с украинского фондового рынка и уменьшение объемов контрактов, заключаемых на отечественных фондовых биржах. Это является однозначно негативной тенденцией, поскольку уменьшение объемов контрактов биржевого рынка является одним из факторов, влияющих на инвестиционный климат и отражает заинтересованность инвесторов в приобретении ценных бумаг отечественных предприятий. Государственное регулирование рынка финансовых услуг должно быть реформировано в два этапа: первый – сокращение количества регуляторов до двух и переход к модели по задачам с разделением на лицензионную деятельность и макропруденциальный надзор; второй – переход к единому регулятору. Это соответствует современным мировым тенденциям и позволит сделать государственное регулирование рынка финансовых услуг всеохватывающим системным, избежать гиперрегуляции и отсутствии регулирующего воздействия на определенных сегментах рынка. ; У статті визначено зміни, що відбулися у інституційному дизайні, та визначено тенденції щодо відновлення ринку фінансових послуг як комплексного системного явища. Розкрито сутність поточних тенденцій, що відбуваються на ринку фінансових послуг України як упродовж періоду кризи, так і на поточний момент, та визначено їх вплив на фінансову систему нашої країни. Проведені у статті дослідження дали змогу встановити, що переважна більшість суб'єктів ринку фінансових послуг України зазнала значного скорочення. Це особливо стосується банків та кредитних спілок, проте кількість фінансових компаній зростає. Зростання кількості та обсягів діяльності фінансових компаній дають змогу стверджувати про зростання обсягів мікрокредитування. В умовах гальмування темпів зростання реальної заробітної плати це є свідченням втрати довіри населення до банків та у майбутньому може викликати спад платоспроможного попиту населення. Це стало підставою для висновку про те, що кредитний ринок України набуває неінституціоналізованого характеру. Вказані процеси призвели до концентрації капіталів на кредитному сегменті ринку фінансових послуг. Зменшення кількості фінансових установ не є критичним для ринку. Негативним є поширення неінституціоналізованих фінансових посередників. Глибока суспільно-політична криза спричинила відтік капіталу з українського фондового ринку та зменшення обсягів контрактів, що укладаються на вітчизняних фондових біржах. Це є однозначно негативною тенденцією, оскільки зменшення обсягів контрактів біржового ринку є одним з чинників, що впливає на інвестиційний клімат та відображає зацікавлення інвесторів у придбані цінних паперів вітчизняних підприємств. Державне регулювання ринку фінансових послуг має бути реформованим у два етапи: перший – скорочення кількості регуляторів до двох та перехід до моделі за завданнями з поділом на ліцензійну діяльність та макропруденційний нагляд; другий – перехід до єдиного регулятору. Це відповідає сучасним світовим тенденціям та дасть змогу зробити державне регулювання ринку фінансових послуг усе охоплюваним, системним, уникнути гіперрегуляції та відсутності регулівного впливу на певних сегментах ринку.
The article analyses the state of the most popular and least popular professions and specialties in Ukraine. It's found that there are no specialties in the field of land management among them. It is also noted that at the legislative level the specialties "Land Management and Cadastre" and "Evaluation of land and real estate" were replaced by the specialty "Geodesy and land management", which belongs to the field of knowledge "Architecture and construction" (technical sciences). It is substantiated that the profession of land manager should relate to the field of knowledge of "Social and behavioural sciences". It's based on the provisions of the Law "On Land Management" and the study of world experience of the essence of the concepts of land management and land management planning (both have technical, socio-economic, legal and environmental focus).It is proved that the profession of land manager needs to be reprofiled. In this regard, there is a need to identify new specialties and specializations and add them into the state classifier DK 003: 2010. It's important to expand the training of specialists within: 1) specialty 193 "Geodesy and land management" specializations "Land Management and Land Use Administration" and "Cadastral Registrar"; 2) specialty 101 "Ecology" specialization "Land management and ecologization of landuse", 3) specialty 051 "Economics" specialization "Economics of land management and land use". Formulation of the problem. The development of society at all times was associated with the arrangement of lands, which today remains the main means for the existence of mankind and a source of social wealth. The need to establish the limits disturb landowners from ancient times. This function is performed by land surveyors. When the first representatives of this profession appeared, it is certainly not known. But the land surveyor is now a profession demanded both in the village and in the city. In our country, the profession of land surveyor always respects honour because it is devoted to the invaluable treasures of Ukraine - land, which has always attached special significance.According to the research conducted in Ukraine, soon, the 10 most demanded professions include: programmers (C++, Java), food industry technologists, construction engineers, architects, designers of offices and interiors, personnel managers, recruiters, energy engineers, journalists, technologists of light industry products, financiers (specialization "banking") [1]. In addition, prospective include: hotel business managers, accountants, auditors, lawyers, marketers.According to the Ministry of Education and Science of Ukraine, according to the results of the 2017 admission, the most popular specialties among the entrants for the Bachelor in Ukraine were Philology, Law, and Management. 85 thousand, 74 thousand and 59 thousand applications have been filed for the stated above specialties respectively. In addition, among the leaders are "Medicine", "Computer Science", "Tourism", "Secondary Education", "Psychology", "Economics". These specialties were desirable to enter by 40 to 46 thousand of entrants. The last step in the TOP-10 was "Software Engineering" with the result of 33 thousand applications (Fig. 1) [9]. Despite the stated above facts, it has been revealed that such specialties as "Law", "Management", "Tourism" and "Economics" remain among the most popular among entrants even though they are not in demand in the labour market. At the same time, the high levels in the ranking are occupied by important for the economy specialties, such as "Computer Science" and "Software Engineering". The least popular specialties are (fig. 2) "Theology" (185 applications excluding spiritual higher educational institutions) and "Hydropower" (193 applications for entry).However, specialties for the preparation of a specialist in land management are absent among the most and least popular. Therefore, with a caution we have to perceive the situation.The list of required occupations in the labour market is changing. Focus magazine has ranked the professions that will be promising in 5-10 years [10]. Before allocating the most promising specialties, the publication together with experts identified the areas of the economy that will actively develop in the near future. So, at first there was a list of 40 spheres of the economy, which, according to Focus, will successfully develop in the next 5-10 years. Experts evaluated the prospects for the development of these industries on a 10-point scale, giving each sector a mark from 1 to 10 points. At the same time, each expert could add to the list the industry that was not among the 40 listed, but whose potential he considers rather large.According to the obtained data, the rating of 15 most promising industries has been designed, and include: information technologies, telecommunications and communications, agriculture, pharmaceutical production and pharmacy business, banking, frying and processing industry, transport services, financial services, legal services, household services, metallurgy, alcohol production, energy, livestock, utilities.So, the 20 most promising professions of the next decade will be the following: the seller, the IT specialist, the automation engineer, the marketer, the municipal services engineer, the aeroengineer, the technologist in the production and processing of food products, the technologist of consumer services, logistics, the lawyer (economic and land law), power engineer veterinarian, pharmacologist, financier, communication engineer, practical psychologist, geneticist, biochemist, robotic technician, nanoengineer.In addition, agrarian countries are actively developing organic and farm farming. This will require the involvement of a large number of employees who are able to work on the ground - and thus, forms a serious niche. In general, the labour market trends in the coming years can be reduced to nine main directions [5]: engineers, IT specialists, nanotechnology specialists, marketers, service providers, logistics, environmentalists, chemists, and physicians.The Resolution of the Cabinet of Ministers of Ukraine dated December 30, 2015, No. 1187, approved new Licensing conditions for the conduct of educational activities [7] concerning the further conduct of educational and scientific work in educational institutions. By the order of the Ministry of Education and Science dated November 6, 2015, No. 1151 "On the peculiarities of the introduction of the list of branches of knowledge and specialties [6], which are the training of applicants for higher education, approved by the Cabinet of Ministers of Ukraine from April 29, 2015, No. 266" [8] approved Table of correspondence List of directions for training of specialists in higher educational establishments for the educational-qualifying level of bachelor (List 1), List of specialties, which was carried out training of specialists in higher education institutions for educational and qualification levels of a specialist and a master's degree (List 2).In the stated above Resolution, it is defined that instead of the specialties "Land Management and Cadastre" and "Land and Real Estate Valuation" – the specialty "Geodesy and Land Management" is established. The latter belongs to the field of knowledge "Architecture and Construction", which belongs to the technical sciences.At the same time, the Law of Ukraine "On Land Management" stipulates that land management is a set of socio-economic and environmental measures aimed at regulating land relations and rational organization of the territory of administrative-territorial units, economic entities carried out under the influence of social and productive relations and development of productive forces [2]. The same law (Article 1) stipulates that activities in the field of land management are the scientific, technical, production and management activities of state authorities, local governments, legal entities and individuals, which is carried out under land management. Land-use documentation (land management documentation) is the text and graphic materials approved in accordance with the established procedure, which regulate the use and protection of lands of state, communal and private property, as well as survey and land survey materials, author's supervision of project implementation, etc. Measures on land management – provided by documentation on land management on the rational use and protection of land, the formation and organization of the territory of the object of land management, taking into account their purpose, restrictions on the use and restrictions (encumbrances) on the rights of other persons (land servitudes), preservation and increase of fertility soils.This is evidence that the profession of land surveyor is more likely to belong to the field of knowledge of "Social and behavioural sciences" than to "Architecture and construction". Architecture (Greek αρχιτεκτονικη - construction) is both a science and the art of designing buildings, as well as a system of buildings and structures that form a spatial environment for the lives and activities of people in accordance with the laws of beauty. Land management, as stated in the Law of Ukraine "On Land Management" – a set of socio-economic and environmental measures aimed at regulating land relations and rational organization of the territory of administrative-territorial entities and economic entities on the ground.As the research of A.M. Tretiak and V.M. Tretiak shows, the concept and essence of land management has both a technical direction and socio-economic, legal and environmental.Land managers have worked and work in the structural subdivisions of the State Committee for Land Resources of Ukraine, the State Land Agency of Ukraine and the State Audit Office of Ukraine, state authorities and local self-government bodies, and ministries (where there are departments of land resources); in public and private design and valuation companies, real estate firms, agroholdings, agricultural enterprises; territorial communities, scientific institutions, institutions of legal direction. civic organizations.The land manager learns not only his professional knowledge, but also legal and natural sciences. For a profession it is necessary to have mathematical abilities, engineering approach, spatial imagination, ability to understand the legislation. The profession is extremely interesting and creative, which requires the ability to make informed decisions, communicate with people, requires care, clarity and responsibility. To become a successful specialist in this field, you need to be persistent, self-confident, active, have a well-developed intuition and logical thinking.According to the classification of professions, the professional activity of the land manager relates to professions such as "human-nature". To date, the land manager must have a higher education in the field of "Architecture and Construction" from the specialty "Geodesy and Land Management", according to the educational qualification level: a junior specialist, a bachelor's or a master's degree.Currently, land managers use modern equipment in their work: electronic instruments; new technologies of geographic information systems. Significant problems arise when making managerial decisions due to the imperfection of the regulatory framework - when three different land managers can have three different views on the same issue. At the same time, for professionals it is extremely important to come to a joint decision. But how can the problems of legislation be explained to an ordinary peasant? It's a shame when you can not help a person in solving his question, and even more - when you do not know how to explain the impossibility of solving a particular problem. The disadvantage of the profession is also that there is little free time for personal life, family and wage mismatch in modern times. The advantages include: work is interesting, lots of communication, new knowledge in land law, and more.At the same time, we consider it necessary to stay on the proposals of A. Martyn outlined in the scientific paper "Directions of adaptation of the content of land management education to the needs of the national and world economy" [3], where he publishes "bad news" for land management education – whether we are ready for them? He states: "Most of our graduates will not develop landuse documentation at all; the number of jobs in the industry is quite limited; the overwhelming part of the "modern" Ukrainian land management is a terrible mix of fairly archaic rules, a crazy bureaucracy and meaningless rituals, in order to master the development of primitive land management documentation, it takes 2-3 weeks of practical training, but not 5 years at the university, and a significant part of cadastral registrar are lawyers.Some of these reservations agreeable. Therefore, his thoughts emphasize once again the need for serious changes in the training of land management specialists.Thus, all of the above stipulates the need for changes in the classification of occupations DK 003: 2010 and the definition of new specialties and specialization training of land management specialists.In our opinion, it is expedient to extend the training of specialists in land surveying in the following areas: 1) specialty 193 "Geodesy and land management" of the specializations "Land Management and Land Use Administration" and "Cadastral Registrar"; 2) specialty 101 "Ecology" specialization "Land management and ecologization of land use"; 3) specialty 051 "Economics" specialization "Economics of land management and land use".At the same time, we consider it expedient to add the following qualifications to the classifier of professions DK 003: 2010: in section 8 "Main specialists – heads of scientific research units and subdivisions on scientific and technical preparation of production and other managers" – Chief land surveyor; in section 14 "Managers of enterprises, institutions, organizations and their subdivisions" – Manager of land management, Manager in the field of operations with land, Manager in the field of research in the land market; in section 25 "Agronomists, hydraulic engineering, forest managers and professionals of related professions" – Land manager; in section 33 "Assistant veterinarians, junior specialists in agronomy, forestry, water management and nature conservation" – Land Resources Inspector; in section 34 "Other technical specialists in the field of management" – State Inspector for the use and protection of land; in section 249 "Professionals not included in other classification groups". Land manager-ecologist, Land manager-designer.Conclusions.Summing up, we note that the assignment of the specialty "Geodesy and land management" to the field of knowledge "Architecture and Construction" (engineering science) does not comply with the provisions of the Law "On Land Management", the study of world experience of the essence of the concepts of land management, which determined that they are inherent in technical, as well as socio-economic, legal and environmental trends. In this connection it is proved that the profession of land manager belongs to the field of knowledge of "Social and behavioral sciences".In view of this, the need for re-engineering the directions of land management training is urgent. Therefore, we must work ahead and make changes to the classification of professions DK 003: 2010 regarding the definition of new specialties and specialization training of specialists in land management. We consider it expedient to expand the training of specialists within: 1) specialty 193 "Geodesy and land management" of the specialties "Land Management and Land Use Administration" and "Cadastral Registrar"; 2) specialty 101 "Ecology" specialization "Land management and ecologization of land use"; 3) specialty 051 "Economics" specialization "Economics of land management and land use" (qualification "Land Management Manager"). It is proposed to make changes to the list of qualifications. ; У пропонованій статті проаналізовано стан найзатребуваніших і найменш популярних професій, спеціальностей в Україні та виявлено, що спеціальності для підготовки фахівців землевпорядного профілю серед них відсутні. Також відзначено, що на законодавчому рівні спеціальності «Землеустрій та кадастр», «Оцінка землі та нерухомого майна» з підготовки зазначених фахівців замінено на спеціальність «Геодезія та землеустрій», яку віднесено до галузі знань «Архітектура та будівництво» (технічні науки). Обґрунтовано, що професія землевпорядника має відноситись до галузі знань «Соціальних та поведінкових наук», підставою чого слугували положення ЗУ «Про землеустрій» та дослідження світового досвіду сутності понять землеустрою і землевпорядкування (мають як технічне, так і соціально-економічне, правове й екологічне спрямування). Доведено, що професія землевпорядника потребує перепрофілювання. У цьому зв'язку існує необхідність у визначенні нових спеціальностей і спеціалізацій та внесенні їх до класифікатора професій ДК 003:2010. Вказано на доцільність розширення підготовки фахівців в межах: 1) спеціальності 193 «Геодезія та землеустрій» спеціалізацій «Землеустрій та адміністрування землекористування» і «Кадастровий реєстратор»; 2) спеціальності 101 «Екологія» спеціалізації «Землевпорядкування та екологізація землекористування», 3) спеціальності 051 «Економіка» спеціалізації «Економіка землевпорядкування та землекористування». Запропоновано внести до класифікатора й перелік нових кваліфікацій.Ключові слова.
