This study explores a significant and little studied aspect of the pioneering doctrinal work of the Fajia tradition, the Book of Lord Shang 商君書 (ca. 260 B.C. -‐233 B.C.): its system of rewards. In contrast with previous scholarship that has questioned the existence of a coherent Legalist political vision and even its idea of law fa 法 or that has focused strictly on penalty, this study considers Fajia law and discipline not only viable categories for analysis, but also important conceptual products of the intensely competitive, bellicose political climate of the Warring States period. The central concern is with the character fa 法 in Fajia texts. Beginning with an analysis of the Book of Lord Shang's system of rewards, the study then examines how the use of the character fa 法 in this text distinguished itself from earlier usages and, hence, represents an important distinctly shared characteristic across Fajia texts generally. This shows that the Fajia system of rewards includes an important pedagogical aspect that requires the ruler's subjects to develop themselves for the sake of state development. Therefore, this study also evaluates the pedagogical value of Fajia rewards based on social scientific research on organismic learning. 微博在中国的互联网上十分流行,这对中国宣传机构的信息控制形成了新的挑战。微博可以使信息得到快速和广泛的传播,从而增加了国家宣传机器进行信息控制的难度。本文试图探讨微博可以在多大程度上帮助网民挑战政府对信息的控制。通过分析在新浪微博上收集的数据,本文发现微博对宣传工作的挑战有四种机制。首先,基于对微博上热门政治信息的分析,本文发现微博上的部分话语权由媒体转向个人,同时出现了一批对政府持批判态度的超级网民。其次,对于一些热点事件,微博与传统媒体的报道角度与侧重点不同,从而使得中国的政治信息更加多元化 。第三,虽然中央政府可以实现对微博的有效审查,但地方政府时常不能控制微博上的报道。第四,网民通过微博上的信息运动,可以将某些传统媒体不愿报道的事件问题化,这对中国传统媒体的自我审查形成了冲击。本文认为微博可以帮助人民挑战国家的信息控制。 ; The micro-blog, with its huge popularity in recent years, poses a new challenge to the propaganda state in China. The micro-blog is able to spread information fast and reach a wide audience. The liberating potential of the micro-blog on the information flow is in conflict with the control efforts from the propaganda state. It is puzzling then the extent to which the netizens are able to use the micro-blog to counter the information control. Based on the data collected from Sina Weibo, this study finds the propaganda state is challenged by the micro-blog through four mechanisms. First, analysis of political posts demonstrates a partial shift of discursive power from media to individuals and a rise of critical super-netizens in the micro-blog. Second, the posts in the micro-blog report the controversial issues in a different way than the traditional media that contributes to the pluralization of political information. Third, the netizens are able to use the micro-blog to expose certain information that the local government would like to censor. Forth, the netizens are able to problematize certain issues through information movement that challenge the self-censorship of media. 中國自一九七八年以來一直致力於法制現代化建設,但至今仍未能建立一個具有高度凝聚力和獨立性的法律共同體,國家與法律職業之間的關係依然緊張。職業主義並沒有隨著過去三十年的法律發展而成為改革的核心。在這種背景下,非職業化法律服務制度在中國的發展無疑值得進一步的關注與研究。 ; 本文將分析國家在職業化與非職業化機制中所扮演的角色。在全面評估非職業化法律服務發展概況的基礎上,分析的焦點將放在基層法律工作者和非政府組織雇員這兩類重要的非職業化服務團體上。本文也將通過實證研究與比較研究的方法對這兩種類型的非專業人士進行深入的探討。 ; 本文通過以上視角得出若干重要的啟示。第一, 非職業化法律制度的發展主要服務於國家控制的目標。第二,非職業化法律服務團體的生存與發展必須建立在滿足特定國家機構利益的前提上。第三,在本文所觀察的樣本中,非政府組織雇員比基層法律工作者更有效率。總體而言,國家在職業化和非職業化機制的形成與運作中都發揮了決定性的作用。 ; Since 1978 China has been committed to modernizing its legal system, yet a cohesive and independent community of legal personnel is far from established and the tension between the state and the legal community remains high. Despite three decades of legal development, China has not truly made professionalism central to its reform agenda. Among many others, one noteworthy but understudied aspect is the widespread use of non-lawyers in the legal services system. ; This dissertation aims to examine the role of the state in the making of professional and non-professional mechanisms in China. In addition to a holistic evaluation of non-professional legal services, the dissertation includes empirical studies and comparative analyses of the two most important groups of non-lawyers the government-sponsored basic-level legal workers and the non-lawyer staff of non-governmental organizations. ; These perspectives reveal a number of important facts. First, the development of non-professional legal institutions mainly serves the purpose of state control. Second, non-professional groups are able to survive only by satisfying the bureaucratic interests of specific state agencies. Third, the staff of non-governmental organizations observed in this study appeared to perform more effectively than basic-level legal workers. 美国和加拿大都是传统移民国家,家庭团聚是美国、加拿大移民政 策法规的重要组成部分。而对这一问题的研究,中国学术界极为薄弱。加强对家庭团聚移民政策的研究,对于深入剖析美国、加拿大移民法体系,发展两国经济,维持社会稳定与发展,具有重要理论和现实意义。本文分析了美国、加拿大家庭团聚移民政策,认为美国和加拿大都是传统移民国家,家庭团聚是美国、加拿大移民政策法规的重要组成部分,或者说是移民法体系的核心。实施综合移民改革,使家人得以团聚,意义重大,它使国家获得安全,经济得以恢复,这个艰辛而智慧的立法过程,也在最佳程度上反映了美国人和加拿大人的价值观。目前要求放宽家庭团聚的民间呼声持续高涨,体现美国和加拿大人价值观的"家庭团聚"成为难以被忽视的移民改革核心话题。The United States and Canada are traditional nation of immigrants, the United States, Canada family reunion is an important part of the immigration policies and regulations. But the study on this problem, Chinese academia is very weak. To strengthen the family reunion immigration policy research, for in-depth analysis of American, Canadian immigration law system, development of bilateral economy, maintain social stability and development, has the important theory and the practical significance. This paper analyzes the United States, Canada family reunion immigration policy, thinks the United States and Canada are traditional nation of immigrants, the United States, Canada family reunion is an important part of the immigration policies and regulations, or is the immigration law system core. The implementation of comprehensive immigration reform, make family to reunite, the sense is great, it makes national security, economic recovery, the hardships and the wisdom of the legislative process, but also in the best reflect the values Americans and Canadians.
